[inaudible] tells me what concerns him the most about this in just a couple minutes. we'll be right back. right bac. i everybody. good to see you. i'm yasmin the sea in coming to you live from msnbc head quarters live in new york city. welcome to alex witt reports. we begin this hour on the campaign trail with republican presidential candidates underway in michigan missouri and idaho. ahead of super tuesday donald trump is out campaigning. speaking in north carolina as he caps a week of legal maneuvers he is making all of push to delay his federal criminal cryo until after the election and may get an assist from the supreme court. not so eminent day from judge cannon's day nikki haley also in north carolina. speaking to voters and raleigh. she'll be massachusetts later on while trump will speak in virginia. haley telling nbc's meet the press moderator christian walker while trump should not be given a second term in the oval office. >> i don't think there should ever be a site president who was above the law i don't think there should ever be a president who has totally unity to do whatever they want to do. i think we need to have someone who our kids can look up to. they can be proud of. i think we need to have a country of law in order. >> first in the latest legal maneuvers by the former president, join me now is former federal prosecutor and msnbc analysts carolyn and ryan reilly, just report for msnbc and author sedition hunters, how january 6th broke the justice system. , caroline start with you on this one. asking about the classified documents hearing on friday to decide the new trial date. we did not get one. we really don't even get a direction as to whether the next hearing would be, quite honestly. the government proposing in july as the trial date. trump's lawyers saying august. but in fact they really wanted this thing to happen after the election. when do you think we will actually fall with this thing? >> jasmine, the that is why the florida case, i think most people feel like that is just not going to get to trial. certainly not going to conclude before the election in november. everything oh we seems to end up in a bit of a model in florida. jack smith has asked for a date of july 8th. we think trump's team has asked for august 12. although now there isn't even clarity over that. even if a trial is scheduled in that case for the summer of 2024, that is not a guarantee that the trial actually take place. trial dates are not set in stone by any stretch of the imagination. there are a number of things that could happen before any trial date that might result in judge cannon putting off the trial yet again. having a trial date before november 24th ignores the likelihood that a trial will take several weeks or even months. -- the jury deliberations, how long will. take it just seems unlikely. when -- if you aren't judge and you are trying to get a case to move efficiency you have to do it in a certain way. we have to say this is what i think should happen it's now a heavy burden on the party to see that happen. it's not the kind of action we are seeing from judge cannon. >> trump was in court yesterday, he didn't have to be there. he was very calm, cool, collected. did not speak out. attorney really speak at all. didn't storm out of the courtroom. none of the images that we had seen appearing in the ye new york judge, judge engoron or judge kaplan either. overseeing the e. jean carroll case. what are the expectations you are learning from trump's attorneys as to how this thing is going to play out? it seems the judge aileen cannon is open to their delay tactics that they have been logging so far. >> yeah. i think the reason we didn't see trump really upset or streaking because his strategy has been working. it's all about delay, delay, delay. he got a huge delay from the supreme court this. week i think one thing we did learn from the hearing in florida yesterday, we heard the special counsel team come out and say that, basically, the 60- day rule. the so-called 60 a rule with the doj basically bands outward actions against political candidates in the 60s, which in months before an election, doesn't really apply to an ongoing trial. that was, i think, some news out of that hearing. basically, if we were to go forward, it more flies more in the d.c. case and it would in the documents case in florida. it does seem unlikely that that would get around, come around. i think there is at least a chance that you could see a situation where the judge in d.c., judge chutkan, could with potentially set this especially at the d.o.d. saying that 60-day window doesn't matter. it is really a huge thing. this is going to be a weird year, right? 2024 -- >> it's going to be? >> it is already, correct. >> it is! we are in, riley! [laughs] what do you make, carol, of judge cannon bringing up the 60- day rule? >> the 60-day rule is not really a rule. it is important to acknowledge that at the beginning. it's an understanding that it had by prosecutors at the department of justice that it is not a good idea to take over, usually investigative, or indictments too close to an election. there is a rule that says you should not take any action with the intent, or the purpose, of influencing an election. i think the department of justice made a correct point in judge cannon's hearing. that applies to over investigative steps over which the department of justice has more discretion. don't serve subpoenas, don't execute search warrants. certainly don't bring an indictment within a certain timeframe that could end up influencing and election. the distinction here, as was offered by judge cannon, i think correctly, is this is an already indicates. this is a case moving towards. trial the scheduling of a trial date in trial proceedings are not subject to that six today, 90-day, understanding that prosecutors have. i think that is a vow distinction. i think it was a correct argument. >> were you surprised at all? i think many of us were who have been covering this on the ground. despite the fact that trump's lawyers brought up the immunity case, one heard on the supreme court in april 22nd. it was not necessarily key to their delay arguments in court yesterday. it was more brought up in passing. we are deduce-ing the judge cannon will likely not take that into consideration when deciding a trial date. were you surprised at that at all, carol? >> it is a little surprising. i was surprised it had not been brought up in a formal sense. another way, perhaps, of exercising delay. the practical effect is it will have a bearing on the prosecution in this case. possibly all of the criminal cases. depending on how broadly or narrowly the supreme court decides to issue through looking. for example, the question presented to the parties for them to brief in their papers says, should a former president be immune from criminal prosecution for, allegedly the, luck acts that donald trump's alleged artificial acts. it does not distinguish between federal and state criminal prosecutions. that was actually a surprise to me. you can see wants the supreme court rules, his attorneys will be reading that opinion really carefully to see in which cases they can raise the argument, if any, that he does still have some immunity arguments left. >> ryan, i want to ask you about this federal peels core pain on friday ordering the recent of a january six rioter. talk us through that. >> essentially this means you could get a rule a shaving off of the ultimate sentence for over 100 of these january six defendants because they had an enhancement for a how this impacted some of the cases. whether or not this was a valid administration of justice on january 6th. whether obstructing the electoral college was interfering in an act of the administration of justice. typically it has been applied more to court proceedings. you see someone interfering perhaps with a witness or something of that nature. they sort of applied to the electoral college in this case. the appeals court ran that back and said that that enhancement should not apply. you will ultimately end up with a lot of work before judges who are gonna be shaving some time off of what in january six defendants have been sentenced already. >> carol, what was your reaction to this happening? how optimistic should be? >> he hopes there will be a deal on day they heard from egyptian officials saying high- level desecrations from hamas and israel will visit cairo tomorrow we have seen high- level delegations from hamas and if you're traveling around the world. but if they are indeed going to the same city, it does seem like this could be within striking distance but it could be for the entire holy month of ramadan. an entire 40 days. while that fighting is halted the ideas there could be the release of israeli hostages in palestinian person. are there could be an exchange. the negotiations have been going on for months. they have seen a lot of false dawns already. has? ben >> bradley forest. thank, you matt. i want to go to nbc's allie raffa at the white house. talk us through the air drops that are being called the first of many. what are we hearing from the white house about the plan going forward? >> yasmin, the destruction, the damage, the impact is in every single direction in the texas panhandle. the cattle industry has been particularly hard hit. the overwhelming majority of cattle ranges are up here in the texas panhandle. ranchers are still going through how many cattle they lost, or trying to find places to take cattle. i want you to hear what one had to say outside of canadian, texas about this incredible impact. take a listen. >> our range land here in my county, over 400,000 acres, has burned up due to this wildfire, including many our cattle lost in that wildfire. these ranchers have not only lost their factories, their mother cows, they've also lost the cavs those calves would've produced whispering. it is a cataclysmic catastrophe for them. financially, and it is going to take years and years for us to get over the situation here. but >> yeah $3,000 ahead here for rangers that lost hundreds of cattle, do the math. it is an incredible loss here, yasmin. here in texas you are getting a glimpse of what this fire was capable of. this was the home of joyce blankenship. she is one of the two confirmed death. you will forgive me yasmin as i look down at a walk towards the camera here. this fire is now causing fine dust, with this heavy wind, flying through the air. right now because we have 40 to 50-mile-per-hour wind gusts, that is the big concern at this plane time. it takes a single ember, a spark, to cause another flare up. i can also say, as it goes to the smokehouse quickly her, more than 1 million acres, a lawsuit has already been filed against the xl energy company because they run the powerlines in a certain area. one woman in canadian, texas, says they are responsible for snap powerlines that she believes caused this massive fire. i just got done speaking with the student fire chief. investigators went out to that scene. saw poll snapped with the line on the ground and could see the burned area going away from it. that is still under investigation. they are confident it can be traced back to that one spot. hard to believe that more than 1 million acres of the panhandle all goes back to a single powerful. yasmin? >> i will start off with those results. we just heard from the state party chair. he is saying donald trump will win 100% of the 39 delegates up for grabs today. that will be in combination with what he earned from tuesday's primary. that is of no surprise here. we need on the trump was expected to get a large delicate poll from the convention taking place today. but what is the big storyline heading into this was the chaos and confusion about this convention. coming into this week there was a dispute within the michigan republican party over who the party chair was. that led to two different locations for this weekend's convention with the majority of the state's delegates allocated. that led to some hurt feelings, a lot of frustration here. in the and you saw that big haul for donald trump. i want you to listen to what some delegates told us about the chaos, division, and confusion that they've been dealing with here. >> we've all come together. regardless of what side you're on, it is important to still work together as a team. the ultimate goal is to get trump voted in, and when our counties. >> if it isn't corrected, if there is not a unity brought together, i think it will be detrimental to the presidential election. we need to get we get together. >> you hear many of the delegates now saying despite what happened last week, despite that it took literally a judge to come in and declare who the state party chair truly is, they want to move forward and look at this as a general election matchup. based on the delegates that were here, those who were able to cast ballots, 97.7% of them voted for donald trump. and they are not notified about their own ah -- >> jack brewster forest. thank you, shaq. we appreciate. it was super tuesday still days away, nominees for both parties seem all but guaranteed. even in this, shall we, say unusual election season, it seems something about the primary system has gone wrong. joining me now is nick toronto. author the new book, the primary. solution rescuing our democracy from the fringes. the executive director of night in america. thank you for joining us, nick. we appreciate. there we know the primary essentially's began, were erected, because of democratizing the process. you argue that it has really done the opposite. there is a wide statistic that your organization found. in 2022 only 8% of all voters cast ballots in the partisan primaries that determine 83% of house contest. how did that happen? >> it's great to be with you. how that happened is most of our general elections these days are foregone conclusions. because the congressional districts are so lopsided for one party or the other. in reality it is the party primary that winds up effectively deciding who represents us in congress. in the last election, only 8% of americans cast ballots in 83% of the primaries that determine those outcomes. we wonder, why doesn't congress act on issues that a majority of americans want to see action on? it's because our congress does not represent us. that is because our primary process is so broken today. i write about in the book how it is the biggest solvable problem in our politics. the good news it is solvable. states can fit this without requiring a constitutional amendment or an act of congress. we are seeing that happen all across the country. >> you recommend nonpartisan primary. i know alaska has already adapted. this we wrote about one republican state senator who essentially said it completely change the way they campaigned. >> in our current system most elected officials only have to campaign or earn the votes of their party base that decide these primary elections. under nonpartisan primaries where you have an all-candidate ballot in every voter can vote for any candidate they wish, candidates and elected officials are incentivized to campaign to everyone. what we are seeing is where these reforms have been implemented candidates throw out the old playbook and go to actually talk to every voter in constituent. think about what our democracy would look like today if every voter actually had a valid that mattered that is what we are trying to work on when we fix our broken primary system. >> you talk about the option of rank choice voting some republican primaries have actually adapted them, as well. that is essentially ranking who you like best. how could this help if he were to have a nonpartisan primary? with those two work together? >> yes. and that is what we have seen in alaska. the combination of two reforms. one is a top four nonpartisan primary. everyone can vote for any candidate. the top four finishers go to the general election and it is in the general election where voters have the option of ranking the candidates according the preference. what that does is ensure that whoever wins does so with majority support. if no one has a majority of first place votes, the rankings are used to conduct an instant runoff. again this is about democracy that truly represents a majority of people. in alaska worked. it wasn't one parties benefit or another. we saw democrats and republicans get elected under the system. the candidates that succeeded were the ones that could build the widest possible coalitions. that is what ultimately will improve the quality of governance that we see. our legislative institutions will actually do what is in the best interest of the country. >> this is a really unique primary, right? republicans are treating donald trump as if he is an incumbent. as if he is, essentially, joe biden,? right from the very beginning there was no other choice for republicans besides donald trump. do you think ranked shaw is nonpartisan primaries, or both together, could work together in a primary that is not like the one we have this year? or would have benefited this primary season, as well? >> one of the major challenges we are seeing especially at the presidential level is in 22 states across the country they prohibit independent voters from actually participating in the primaries that will determine the general election candidate. over 23 million independent voters are locked out. that includes a majority of veterans, it includes almost half of young people. people who fought for our country, the future of our country, they don't get to have a say. i think that is wrong and un- american something we need to fix. if we had a more representative primary electorate i think we would see candidates who are more broadly representative of the american people as a whole. unfortunately, that is not what we have today. i think that's why so many people are dissatisfied with what their options are come november. >> nick cherie,. . what peter strzok joins me next. later, on the voter participation. gaffney numbers just released today about the difference in turnout between why in nonwhite voters. we will be right back. in nonwh voters. we will be right back. >> i am terribly concerned. he is going to do everything we saw in his first administration and so much more. you mentioned john kelly. it would, at least during the first trump administration, any number of people who stood and the way of trump's first and policies. and what we've seen for the studies you have a side, the reporting on, them is not only authority to oppose the government to pursue his enemies but to get rid of all of the people who are in place who would function as guardrails against him doing so. whether it is installing loyalists at the head of the department of justice or the fbi or theodore meant to, faints to the men's firing of senior executives across the government to replace them with people loyal specifically to him. i think the right and scope of what trump in a second administration flour outpaces anything we saw during his first administration. >> former trump white house aides are sounding the alarm about what this trump to put a may look like. let's play some of that for you, peter, then we'll talk on the other side. >> he's been saying things like calling for the execution of mentally. he said he wants to do away with part of the constitution. he said he wants to read this country of papal cases as vermin. that is what a second trump presidency would look like. it would be solely focused on retribution and an exit revenge on people he sees as his enemy. >> you just have to take trump at his word. he wants to demolish the separation of powers. he said he wants to go after his political adversaries and potentially pull fcc licenses from people on the air that disagree with him. that is enough for me. >> the president is here and is elected to protect the people. not to incite violence on place people. i think about myself but more importantly i think about men like rusty bowers, who was cornered in his home. i think about ruby freeman and shaye moss. i think about members of congress on the january 6th committee. >> what do you make of these warnings, peter? >> i think they are sobering. i think all those folks are extraordinarily brave to come out and discuss their firsthand experience watching trump. now more than ever, it is essential we get the people echoed top, the generals who spent their entire career servant the ministry, serving the constitution of the united states, people like general kelly, general mattis, general milley, general mcmaster, oh who at very senior levels interacted with former president trump. they need to come forward with one voice to talk about while they, sought to express their concerns. they've done it to authors, don it to reporters, now is the time we need to hear from the senior voices who were with trump literally every day during his administration to carry their concerns directly to the american people. >> i want to talk quickly, if we can't get, or switching garros as to what have been in a florida courtroom yesterday with judge aileen cannon and the trump mar-a-lago classified documents case. there was a moment and that court in which trump's attorneys brought up what they believed to be the fbi helping with the prosecution. immediately the prosecuting attorney stood up and said, yes, they fbi were the ones who seized these documents. that is what happens when we build our prosecution, as we oftentimes work with those agents. but trump attorneys went one step further and away and accusing the entire intelligence apparatus working with the prosecution on this case. and judge aileen cannon it seems is considering a possible hearing on this. by the way, that would give access to trump's attorneys of conversations, obviously, all of discovery between the prosecuting attorneys and the fbi and intelligence agencies. what do you make of this? >> black america is strong, resilience, has made some significant progress since 1960 full but is now under attack. voter suppression, history suppression, democracy suppression. those that would block access to good jobs by attacking the very essence of economic opportunity, which is what de&i our. it is as great as any threat we've seen in many decades. it is strong, resilient, and i think ready for a good, strong fight to protect these games. >> let's talk about some of the numbers here marc, if we can. assigning a score of 75%. the level of equality between black and white americans and this country. how is this number calculated and how does this compare to years past? >> let's take one example, which is the unemployment right. we look at 300 sets of data. we compare what whites are and we index that at one. and we are blacks are is as a percentage of one. that's how the index is developed. 75 is an average. you'll see health disparities a little narrower. education disparities a little narrower. economic and social justice disparities much wider. it is about 75 percent. it really represents the effect that notwithstanding 60 years, there is a long way to go at the pace of change we have seen. it would take 180 years to achieve parity. that is not acceptable. >> you talk about how voting rights are under attack for black americans. what steps should be taken to stop that? >> we need a new, refreshed voting rights bill. it is cold the john lewis bill. it was introduced in the beginning of the biden administration. it has been thwarted, blocked by the filibuster. we need a new voting rights bill. a freedom to vote bill. we need to protect against these state that want to encroach on the right to vote. they want to close polling places. they want to purge voters. they want to make it more difficult for people to vote. they want to increase conditions. it is old assigned to limit the number of people participating and what is the foundation of democracy, the right to vote. it is within the power and the hands of congress, and people have to recognize and realize that we are going to have to work and fight to protect excellent democracy. secondly, candidates who run for office have to do much more than they've done in the past. they have to talk to all communities. talk to black and brown communities. talk to young voters. you have got to talk to people about what it's important for them to come out and participate. that it does matter and that will make a difference. >> i want to talk about turnout rates as well, marc, a five. can you have this survey study -- finding the difference in voting rates between black and write americans and voters has grown consistently since 2012. what is driving this turnout gap ? >> what happened in 2013? we head to the supreme court struck down section five of the voting rights act. it opened the door for all sorts of voter suppression methodology. 's porches, suppression, closing polling places. making it more difficult to vote. photo suppression laws and practices have had an impact to blood the differential in photo turnout. that is number one. number two, i will always say that those who run for public office have to be more energized, more appealing, have to show up and communities, black communities, brown communities all across the nation and talk to voters about what it is important for them to vote for them. you have got to talk to voters, appeal to voters. and that is a second component of this. ignorant communities because, quote, it is a vicious cycle. you suppress the vote, people don't turn out -- people say, well, i'm not going to appeal to that community because they're not going to turn out. so trisha person is alive and i think it has a great deal to date with a widening differentials in turnout. >> we have got about 20 seconds left, marc. black woman helped win president biden his election in 2020. we are told he stand right now with black voters? >> i think a stand in a good space with black voters. but there is work to do. number one, to remind them of his accomplishments and his promises and his commitments. number two, to talk about what a second biden term would bring. we're in for us that commitment to voting rights. two police accountability. leveling the economic playing field. i would like to say in the state of the union a strong -- >> and we lost marc. than
