and later, a key witness back on the stand today in a hastily called hearing in georgia. what his testimony could mean for the d.a. and prosecutor in trump's sweeping election case. thank you for joining us. it is 10:00 eastern. i'm ana cabrera reporting from new york. we begin with this matchup in michigan, polls open right now in that state's primary. nikki haley already defiant ahead of an expected defeat by donald trump as trump insiders watch this race for signals about his strength in this swing state. meanwhile, president biden has his own test of strength in michigan today. a protest vote, and backlash over his response to the israel-hamas war. we have team coverage. nbc news national political correspondent steve kornacki is at the big board. shaq brewster is in grand rapids. and gabe gutierrez in deerborn for us. steve, let's start with the big things to watch today. >> yeah, a couple of things. i'm glad we're doing this with a correspondent in grand rapids and in deerborn, those are two of the biggest places to be watching for very different reasons for different parties. let's start on the republican side, trump/haley. haley in two primaries now, new hampshire and south carolina has gotten about 40% of the vote and what we have seen is a huge, huge split in these republican primaries, where the areas with high concentrations of college degrees, higher incomes, suburbanites, a lot of suburbanites, they have been strongly moving toward haley. other areas, you know, especially rural areas, working class areas, core trump areas. that's the divide we're seeing. as we look at this map for michigan tonight, what to watch on the republican side, if haley is going to have a strong night, meaning she hits the 40% or so she's been hitting. that's what she's been saying is her goal here. so, grand rapids is in the heart of a region of michigan, very unique politically here. it is the traditionally republican and conservative, but also uniquely averse to donald trump. it is a very complicated thing, but there is -- the ancestry goes back to dutch americans who came here in the 19th century and created a culture that is kind of endured a political culture that endured in this region that, again, it is not been friendly to donald trump. in 2016, when he ran in the primary of michigan, trump won the state with 37% of the vote. he only got 23% in the heavily dutch areas here around grand -- in and around grand rapids. so, if haley is going to have success in michigan tonight, this is an area where she needs to rack up big numbers. about 17% of the vote, state wide. that's about 1 out of every 6 votes will come out of this grand rapids area tonight. another place to look on the republican side here is sort of a tail of two counties, just outside detroit, this is oakland county, this is macomb county, together 25% of the vote in this republican primary. and they couldn't be more different. each one is suited to a trump strength and to a haley strength. the trump strength is macomb county. big suburban county, but blue collar. this is one of trump's best counties in michigan in the 2016 primary and one of the counties that keyed his victory in the general election in november in 2016. next door is oakland county, big suburban county, but here you got higher incomes, much higher concentration of college degrees, a place that has been strongly against trump, so this is where haley would need to rack up big margins, haley in oakland, trump in macomb. on the democratic side, deerborn, it is in wayne county, the whole issue of the democratic side is how many folks are going to vote uncommitted as a protest of biden's policy and the israel-hamas war. deerborn, michigan, it is a majority arab-american city, and it has the largest concentration of muslim americans per capita of any city in the united states. so pay close to attention to deerborn and wayne county tonight. >> you just whipped through all of that. let's go to kent county where shaq is in this state. what are you hearing from voters there? >> reporter: they're telling you they're coming out for different reasons. many of them already looking ahead to the general election. you heard steve talk about grand rapids, talk about kent county as an important general election county. it is a place that back in 2016 donald trump barely won by 3 percentage points and 2020, joe biden flipped the county and split the state of michigan. and nikki haley has been trying to use that as she makes a general election argument, saying donald trump wouldn't be successful in places like kent county. it is an argument that at least for the first three voters i talked to here at this polling location has been somewhat successful. listen here. >> i voted for nikki haley. >> reporter: why nikki haley? >> a vote against donald trump. i will likely be voting for joe biden in the fall, but today was a chance to vote against donald trump. >> reporter: why did you vote for haley? >> because she's not donald trump. i realize it is probably a protest vote, but i wanted to vote anyway. >> they just need a good role model, not someone who is unreasonable. and unkind. >> reporter: and that first gentleman that you heard from said he actually likes president biden. he points to the overperforming economy, but says that he sees donald trump as a threat to democracy, so that's why he came out and backed haley. i'll tell you off camera, i did talk to someone who came out to support president -- former president trump. she told me that it was immigration that got her out, despite the fact that she likes what she's been seeing somewhat from nikki haley. it just gives you a sense that voters are coming out for different reasons in this primary, ana. >> gabe, you are in deerborn. how much concern is the biden campaign giving this uncommitted vote challenge? >> reporter: well, hi therian, good morning. democrats are certainly watching this and we have been reporting on this for the last several months, how arab-american voters, especially here in deerborn have been so frustrated regarding the policies with the israel-hamas war. one of the groups made it their goal to get 10,000 uncommitted votes here in this primary. i asked governor gretchen whitmer about that yesterday. here was her response. >> i think there will be a sizable number of votes for uncommitted. i think that it is every person's right to make their statement about what's important to them. >> reporter: the uncommitted organizers said they want to get at least 10,000 votes. do you think they'll reach that? >> i think that's possible, yeah. >> reporter: the governor saying that's possible. it may even be likely, ana. here where biden campaign officials are saying they want to highlight the context here. they say over the past several elections, both in 2012 and in 2020, the uncommitted vote actually got well above 10,000, right around 20,000 or so, even though there was no real opposition significantly in 2012 when president obama was running for re-election. so that 10,000 number might actually be a very low threshold. still, ana, democrats are definitely watching how high that uncommitted vote ends up being. >> all right, shaq brewster, gabe gutierrez, steve kornacki, thank you, all. let's talk in 24 hours and see how it shakes out. i want to bring in senior former aide adrian elrod and carlos curbelo. adrian, let's talk about this protest vote. president biden's team pointed out that this uncommitted vote in michigan isn't new. this time is different, though, right? michigan has a big arab, big muslim population, mobilized to vote in protest of what is happening in gaza right now. should the biden campaign be more concerned than they appear to be? >> look, i think it is important to look at the context here. i think gabe laid it out very succinctly. the protest vote in michigan in particular is nothing new. obama got part of the protest vote. we saw it in previous elections. this is nothing new to michigan voters. but what i will say is that when you do look at the protest vote, and you look to see, like, where is it going to line out tomorrow, it gives you a snapshot and provides a road map for where to go in the future. the administration has been having really important talks with arab-american voters. michigan being one of the largest states that has the largest population, arab-american vote in the country. they have been having important conversations. president biden simultaneously as president of the united states has been working toward a two-state solution, working, you know, overtime to try to get to, you know, a more peaceful situation in the middle east. a lot of what is happening over there very much is not in his control. so, the bottom line is we will see what happens tonight. i think, again, it is important to manage expectations and to look at how the protest vote has gone in previous elections. i think governor whitmer was very succinct by saying, you know, they very well could get 10,000 votes. this is, you know, what democracy is all about. and we got a long time until the general election. and there is a lot that will happen between now and november. >> she was pretty direct that there is a lot of pain right now among the residents in michigan. congressman, governor whitmer also said any vote that is not for biden is essentially a vote for trump. here is what she said earlier this morning on msnbc about how she expects the contest to go. >> i also am expecting that president biden will be the victor in today's primary as well very likely president trump between all the chaotic different things that are happening on the gop here on the ground and that this will be the matchup and as we look to november, it is going to be a stark choice once again. >> congressman, do you think that sort of messaging might help the president in this protest vote? >> well, i think the big story, ana, is for both candidates the protest vote. although none of the above is an option for republican voters in michigan, certainly if you're voting for nikki haley, you're protesting against donald trump. it is pretty obvious that donald trump is going to be the republican nominee and at this stage you're not supporting donald trump as a republican voter, you're making a big statement against him. so, for both of these front-runners, trump and biden, what they're dealing with in michigan and i think for the rest of this primary season is who is upset at them, who is frustrated with them, who is not going to show up for them in november and given how close this race was last time, that could make all the difference. >> i don't think anybody is expecting a haley victory in michigan today. congressman, this would be, i guess, a test of trump's strength there, right? this is a state flipped for biden in 2020, so, what would constitute a strong showing for trump in michigan? >> i think he can't afford to continue losing 40% of the vote in republican primaries because that's actually a sign of weakness for someone who is essentially an incumbent. he's running in this race as an incumbent. and by any measure he's got this nomination pretty much locked up unless we get some big surprise here, right? so the people showing up and voting against him who are republicans, he's going to have a tough time or, you know, going to be big homework for the trump campaign to try to regain the trust and support of those voters heading into november. but if he keeps losing 40% or more than some of the primaries, i think that really hurts his narrative, you heard him trying to make it after south carolina that the republican party is more united than ever. 40% of republican voters aren't supporting you that runs counter to that narrative. >> he's like an incumbent president as well. adrian, meantime, democrats are launching a new billboard ad campaign across eight battleground states including michigan, also wisconsin, pennsylvania, georgia, among others, directly connecting trump to the alabama ivf decision. one of the billboards will read, then i was able to kill roe v. wade. now, alabama court ruling stops ivf, banning abortion, stopping ivf, is georgia next? what do you think of this strategy? >> i think it is incredibly smart because, again, this election is about a contrast between president biden's leadership and donald trump's failures. donald trump is trying to hide from the fact that he put three very pro-life supreme court justices on the supreme court, but he knew it would overturn roe v. wade. this, of course, is a situation in alabama, it is a prepercussion of overturning roe v. wade, trying to hide from it, trying to say ivf, i support ivf, he may support ivf but the billboard happening in some of these states now going up in these states is just the very beginning. we're going to be spending a lot of money. president biden and vice president harris are going to be spending a lot of time on the campaign trail, at the bully pulpit, making sure that americans are very clear on what side president biden is on, and versus what side donald trump is on when it comes to allowing women to make their own reproductive choices about their body and their own healthcare decisions. trump is trying to have it both ways. it is in the going to work, when it comes to the general election and the key independent swing voters who will decide who becomes president. >> we know the abortion issue has really mobilized and energized voters since the dobbs decision. the biden administration is sending the secretary of health and human services to alabama today, following that ivf decision. how politically perilous is this issue becoming for republicans, nationwide? >> well, since the overturning of roe, republicans have been punished on the abortion issue. they want to make this issue more prominent. on the other side, republicans will be trying to emphasize immigration and inflation. they think those are their winning issues because president biden's numbers are low on those issues. however, on abortion, democrats are trusted more by the general electorate to handle the issue than republicans. so you're going to see president biden and his administration do everything possible to shine a big spotlight on the abortion issue while trump and republicans are going to keep hammering immigration and inflation. >> adrian elrod and carlos curbelo, thank you, both. time running out to stop a partial government shutdown this week. will a white house sit-down next hour make a difference? does the president have leverage to force a deal here? >> i think the short answer is no. the white house has said he's called the congressional leaders to the white house with the vice president to really elevate the urgency of the moment, the need to keep the government open, beyond the deadlines friday and next week and to elevate the urgency of passing a national security supplemental, funding for the war effort that ukraine is mounting against russia as well as other efforts that are being undertaken for israel and aid for gaza as well, for the people -- for the palestinian people there. the white house said that this is an issue, these are issues really that are for congress to take care of, the idea of funding the government is a congressional responsibility. and passing these measures also is a congressional responsibility and we heard the white house say that they need to get the job done. the president, though, believes and has believed in the past that sometimes he can get people in a room, around the table, and in this case, leaders from congress, around the table, and have a conversation about how important these things are. and walk through the stakes of the moment and perhaps then move the needle. white house said there has been progress that has resulted from meetings like this in the past and that is the hope the president has today as we understand he's scheduled according to his schedule, there is about an hour or so that has been allotted at this point for this meeting today. >> julia, it feels like groundhog day again. we were talking about a shutdown it seems. but i understand there are a couple of different off ramps here. what could happen? >> reporter: the third time in four months we're talking about a shutdown. speaker johnson staring down the barrel of another one. there are a couple of off ramps to prevent that from happening. just on my way over here, a couple of senators i spoke to said they do believe there could be a short-term cr. we saw that great graphic on the screen, if we could pull that up again, i'll walk you through the scenarios one by one. the first scenario to avert that shutdown on friday night, saturday morning, if they pass a short cr, stopgap government funding measure that bridges the gap between the two deadlines. if that doesn't happen, what hard-liners want to do, what they're pushing johnson to do is to pass a full year's cr. that means that 1% cuts, negotiated by ousted speaker kevin mccarthy and president biden last year to raise the debt ceiling, that would kick in, in april, taking them through at least, though, the september 30th deadline. that's something johnson doesn't even want according to my sources. if that doesn't happen, if neither of those happen, that means we're entering a partial government shutdown at the end of the day on friday. that would shut down the agencies concerning agriculture, transportation, water and the va as well. then you're looking at a shutdown that could potentially drag into the next deadline, next friday. that would shut down all agencies including doj, including critical agencies that would impact millions of americans around the country in order to avert all of this, in order to not pass the stopgap government funding measures, they have to agree on full year appropriations bills. that's not looking likely. there are still disagreements i'm told between republicans and democrats, even though those four leaders that aaron was talking about that are going to meet in the white house next hour certainly agree that they don't want to shut the government down. >> that's a lot of -- a lot of stress for so many of these government workers who will be impacted. thank you so much, aaron gilchrist and julie tsirkin for your reporting. next here on "ana cabrera reports," more legal drama in georgia. the hearing later today that has big implications for the d.a. investigating donald trump. plus, should trump fear stormy daniels and michael cohen taking the stand? >> yeah, so that's a great question. because yesterday judge mcafee met with terrence bradley and terrence bradley's lawyer for 90 minutes behind closed doors in what we call an in camera meeting, within chambers meeting. during those 90 minutes, judge mcafee indicated publicly he was going to explore terrence bradley's understanding of the scope of the attorney-client privilege. he used to be the former divorce attorney and law partner for nathan wade. during bradley's testimony, just about ten days ago, bradley indicated that he was invoking the attorney-client privilege in response to certain questions. but at the close of the evidence, judge mcafee said, you know what, mr. bradley, i don't think you really understand the scope of the attorney-client privilege, we're going to explore that more with you to make sure you're giving fulsome answers. so, what do i expect to happen today? well, one of two things. either a total nothing burger, something innocuous, why did you leave the law firm partnership with nathan wade, those types of questions. or we may hear some blockbuster huge testimony about the personal relationship between nathan wade and fani willis, more specifically when did that intimate relationship start and there is a lot of fervor over whether we should care. we should care if it was perjuryious, if they lied to the court. >> that's why bradley's testimony is important. we're also learning trump's defense lawyers recently submitted cell phone records they say show willis and wade had thousands of calls and interactions during 2021. and they say than analysis shows wade's phone connection to cell towers near where willis was living at the time. catherine, i guess trump's lawyers are saying this will prove that they had a romantic recessionship, prior to when they said it began, how strong is that evidence? >> all it proves is that his phone was in the general vicinity of where her condo was. the d.a.'s office said, well, they can prove that on those days it was in the general vicinity, she was at work, she was some place else. it doesn't prove that they had an intimate relationship. quite frankly, i don't know how you prove unless you have video there is an intimate relationship. there are couples who disagree on when they actually became couples. this they're doing to say they lied under oath so therefore you can't believe them. >> that could be then reason to -- given everything we know at this point what is your sense or thought about whether d.a. willis and nathan wade stay on this case? >> i thought they would certainly stay on this case, but when nathan wade submitted a sworn affidavit that said when the relationship began or didn't begin and that they went half sys on paying back the expenses, that meant that if it wasn't true, they lied to the court. because she, fani willis, adopted this sworn affidavit. so this could be a self-inflicted wound. they didn't have to go that far. she could have just said, yeah, we had a relationship, but it is not a conflict, and, in fact, i'm going to recuse nathan wade from this matter and move on. but because they swore to the court one thing, if they're proven to have lied, then i think they're going to get bounced from the case and it could be more repercussions beyond that. >> let's talk about what is hatching in the manhattan d.a. case, the hush money case against donald trump. we're learning alvin bragg is asking for a gag order, a limited gag order in this case, that would keep former president trump and any of his surrogates from attack individual witnesses, prosecutors, minus bragg, and court staff members. trump's team said this would violate his first amendment rights, argues this would be election interference, would prevent him from fully campaigning, catherine, do you think this gag order is necessary? >> it is necessary. and the manhattan d.a. very wisely just lifted the language from the january 6th federal election case that the d.c. court of appeals upheld. so, trump can trash d.a. bragg, trash the judge, trash the case. he just can't attack the individual prosecutors, the court staff, go after jurors, or go after the witnesses which the d.c. court of appeals upheld. >> speaking of witnesses, trump's own lawyers filed a request of their own, trying to limit testimony from people like michael cohen. and stormy daniels and karen mcdougal. katie, how crucial is their testimony? >> well, michael cohen's testimony is very important to the manhattan d.a.'s office, the other two not so much. there is a legal standard that needs to be met and that's the relevancy of their testimony. if something is not relevant, it is not going to be admissible. i believe the manhattan d.a.'s office will be able to prove that all of that testimony from all of those witnesses is not only admissible, but it is also relevant to be able to present the case in chief for the manhattan d.a.'s office. to the finer point, i think michael cohen is crucially a part of this, he is the one who negotiated these deals, he's the one who is a part of the payments that were made on behalf of donald trump, that was the election interference this is not just hush money payments. this san election interference case that the manhattan d.a.'s office is trying to prove. >> they have given these individuals are at the heart of this case, their testimony would seem extremely pertinent. why would the judge not allow them to testify. do you see any reason for him to accept this request from trump's team? >> the roughly 25 minutes of video released by houston police show numerous angles of the terror inside the church, including when police confronted the shooter. the chilling images come over two weeks since the deadly incident and we want to warn you the video is disturbing. >> what is that? >> this morning, new video from houston police capturing the barrage of gunfire that sent worshippers scrambling for their lives inside joel osteen's houston megachurch. authorities say the shooter identified as 36-year-old genesse moreno tried to enter the sanctuary, which was locked, so began firing in the lobby ahead of a spanish service. >> come on. >> reporter: one officer heard praying before running toward the gunfire. >> god be with us. give us mercy. >> reporter: police say one 47-year-old church member was shot in the hit and moreno was gunned down after making bomb threats. >> stand down! i have a bomb! >> reporter: police never found any explosives. >> the tabc agent told miss moreno to put her weapon down, but she refused. the agent fired his duty weapon again striking her, she was declared deceased at the scene. >> reporter: moments before the gunfire, security footage shows moreno pulls up to the church in a trench coat and walking in with a backpack, two rifles and her 7-year-old son. the young boy is seen covering his ears during the shooting and at one point appears to reach for his mother. he was struck in the head during the shootout, but it is not clear who shot him. over the weekend, his grandmother posted on facebook he's making progress and now is breathing well, but may soon face his sixth surgery since the incident. houston's police chief tweeting no child should ever be placed in that position. he needs our support and prayers. pastor joel osteen moved to tears upon returning to sunday services. >> that woman was troubled and nobody brings their son or comes to some place to do that. i guess i just felt the gravity of it all. >> there is no word on what is believed to have motivated this devastating shooting. investigators say she was carrying an ar-15 with the word palestine written on it and they found antisemitic writings during a search of her home. this remains an active investigation. back to you. >> emilie ikeda, thank you for that report. up next on "ana cabrera reports," could a cease-fire between israel and hamas be imminent?
