donald trump. there is something they both have in common, according to colorado secretary of state. we'll explain. a very good day to all of you from msnbc world headquarters here in new york. welcome, everyone, to alex witt reports. we're going to begin with this breaking news. confirmation that israel and hamas are inching closer to a deal for the release of hostages. it comes as israeli defense forces released new video of what it describes as raids in the gaza strip. you want officials say to school shelter in civilians were destroyed by israeli missiles in the last 24 hours, leaving women and children among the dead. the world health organization says 31 premature babies left behind when god says al-shifa hospital was evacuated are now safe and receiving medical treatment. joint operation by the u.n. palestinian red crescent move those infants to incubators at a facility near the border crossing into egypt. while a trickles into gaza, one truck at a, time new confidence for qatar, which has been facilitating negotiations between israel and hamas, that only logistical hurdles now stand in the way of a deal that includes the release of hostages. >> the sticking points, honestly, at this stage, they're more practical, logistical. the deal is going through ups and downs, from time to time, throughout the last few weeks. i think that i am more confident that we are close enough to reach a deal that can bring the people safely back to their homes, whether they are hostages on the homicide, or whether there or exchange that will happen, that will take place. >> okay, let's bring in nbc's matt bradley, reporting from beirut, lebanon. matt, welcome. what can you tell us about this potential hostage deal? >> yeah, alice, as you mentioned, it comes down to the details of this. what we've been hearing about this for the past couple weeks. this will be the largest hostage released so far since that hamas terror attack on october 7th. it will also represent if it goes through, the longest sustained pause in the fight a, and in the gaza strip, ever, since the israel lost the counter offense in the gaza strip. it is now killed more than 10,000 people. we are talking about huge numbers of civilians had been killed in the gaza strip. the details, as we know them so far, is that this would mean as many as 50 women and children released from the custody of hamas, of hamas fighters. these are people that's only been held in tunnels underneath the gaza strip. that would be what we see so far. we've already seen four hostages released so far, in two batches. this will be dozens of people released over several days. probably in 24 hour periods. it's a confidence building measure, as we would expect. now, what we haven't heard so far is anything like what we heard last week. this could be an exchange for israel, but it's opening its, prison releasing mostly women and children from israeli jails. we haven't heard so much. this will come from the details of this, by news organizations, including nbc. we have heard from the israeli ambassador to washington, who spoke on abc news today to mark this. if you put a little bit of cold water on some of the closeness of the steel, here's what he told nbc news. >> we were against the cease-fire because that would allow hamas to retain, power to regroup, we, arm strike again. >> it would be a cease-fire for a few days? >> this is -- >> is that the difference? >> we're talking about a pause in the fighting for a few days so we can get hostages out. it's not a cease-fire, because we will continue to push against hamas, to dismantle their military infrastructure, and their terror infrastructure. we won't stop that. we are willing to go for a pause, for significant number of hostages if we have a deal. >> so, alex, as you can hear from the israeli, side a lot of skepticism about the language behind that term cease-fire. they don't want to give hamas to any's breathing space in order to do what they say is re-armena painful for the fighting. it looks that without a cease-fire, without pause in the fighting, that's the only thing offered to hamas. we haven't heard much about their presidents, really seem men and children. alex. >> the word cease-fire and pause seem to have taken on tremendous political significance. if not, i don't understand the difference between militarily, the difference between a cease-fire, and a pause. if you are allowing to mandatory an aide to either get, in or extract hostages. >> yeah, i had to look this up to. i was skeptical myself. you know, there's been writing about this. a cease-fire implies some level of permanence, or some terms that would allow for the cease-fire to be broken. we've heard in the past, in the gaza strip, that is not what we're seeing now. we're talking about a pause. essentially, the israelis are saying, this is a limited time. a cease-fire could be something that lasts indefinitely. the israelis are, saying we will begin to fight again. you cannot rely on us putting down our guns. this is not a confidence building measure, that is working towards peace. a cease-fire would work towards, you, know a true system kind. this is something where they're saying that we are simply creating a humanitarian, pause and we won't pick up our guns again. alex. >> thanks for that explanation. my, broadly appreciated. let's go from there to nbc's -- who's at the white house. forest, gary welcome. what are you hearing on where negotiations stand on this at this hour? >> i think it's important to recognize, alex, the last thing that folks here at the white house will do is talk about ongoing hostage negotiations, this is because of the risks could collapse the. deal have been said, that i meet the press this morning, they did quite a good job talking about john, finer the deputy of national security adviser. we do have some details about how this may play out here. we know that these conversations are ongoing between american officials, qataris, and israelis, to work to get as many hostages out as possible. it's say that it will likely be women and children, largely. now it's important to note, there are nine americans that the u.s. is aware of that are hostages in gaza, held by hamas. it's all unclear whether these nine will be a part of whatever deal comes out. here as you are saying with the cease-fire versus peace, the conversation about the wording, john fire doesn't use a word cease-fire in this. interviews we had to say. >> well, what i can say at this point is that some of the outstanding areas that disagreements, and a very complicated, very sensitive negotiation, have been narrowed. that it believes we are closer than we have been in quite some time. maybe closer than we have been since the beginning of this process, to getting the steal done. we are following this minute by minute, hour by hour, and have been for a number of weeks, up to and including the president, for who this is a major priority, as you just heard. at this, point we really need to adhere to the mantra that nothing is agreed until everything is agreed. >> something else that john is not saying is whether or not he thought israel was playing by the international rules of the rule. setting a good example when it comes international law. he said he didn't want to be judge or jury as it relates to israel. alex. >> thanks so much for that, i'm going to be speaking further on this topic of congresswoman, deborah, ross coming up shortly. in the, meantime tomorrow morning, lawyers for donald trump are set to appeal the limited gag order placed on him and his d.c. election interference case. prosecutors and attorneys for trump or making oral arguments before a three judge panel. this will be streamed live. joining me now, nbc's ryan riley. author of sedition hunters. how january 6th broke the justice system. welcome to you, ryan. so what arguments will trump's lawyers make tomorrow? >> essentially what i think they're going to try to do is conflate the jack smith investigation with the white house, say that all of this is ultimately coming from joe biden. that this is an extraordinary measure to try to suppress the speech of joe biden's primary opponents, and likely republican nominee. for the presidency. in 2024. so basically what they're going to try to do is go beyond the normal course of the case. what they're up against as a gag order that's pretty narrowly set. even at the time it was issued, when mike pence is still in the, race it said that donald trump could in fact continue to criticize mike pence, for example, but couldn't speak specifically about the things that mike pence did around january six, because mike pence is a witness in this case. and, fact he testify before the federal grand jury before the ultimate indictment of donald trump was returned and august of this year. so the trial is now only a free months, out and bahrain any unfortunate circumstances, that appears to be on schedule. tomorrow morning, it really will be something in terms of this argument over the question of what the donald trump has this gag order in. place >> can i just, say joe biden has repeatedly said that he is not associated with a jacks mitt or the doj in any way, shape, or form on this? i'm kind of curious how that argument will end. let me ask you about the audio of the hearing. that is going to be livestreamed. what is the significance of that? what did we learn about this case? >> yeah, as you mentioned, there's not a lot of facts around this idea that donald, trump or, rather biden is controlling this investigation. there's just no evidence of this at all. eric garland was independent, then set up a special counsel which is independent as well. i'm curious to see how, given that this is broadcast available to the broader world, whether or not that changes the dynamic of these arguments. that is what the federal courts have been wanting to try to avoid. because this is a federal public, court you'll be able to hear the actual audio of. it all, though it won't be televised. this will ultimately be another way to campaign, and that these lawyers will be making arguments for a broader political audience, as well as for an audience of one. donald trump himself, he wants to hear his lawyer say these things before judge. >> yeah, okay. i think you're spot on on. that appreciated. it's a monopoly cart that you always hope to pick. up someone use very specific reference to that, game talking about a colorado judge as donald trump relied. they weren't happy about. it will be back in 60 seconds. 60 seconds. the subway series is taking your favorite to the next level! like the #20. the elite chicken and bacon ranch. built with rotisserie-style chicken and double cheese. i love what i'm seeing here. that's some well-coached chicken. you done, peyton? the subway series just keeps gettin' better. new reaction to a call about a judge's ruling keeping donald trump on the ballot in 2024, even after that judge declared trump engaged in insurrection on january six. >> the idea that any official who engaged in insurrection would be barred from taking office, except the presidency, is incredibly surprising. that basically means that the presidency is a get out of jail free card for insurrection. i finds that it is very troubling that the president of the united states could engage an insurrection. i'm like everybody else, could then be president again. >> joining me, now jacqueline -- reporter with the washington post an msnbc contributor. harry litman, former u.s. attorney, former deputy assistant general, now constitutional law professor. hello, friends. on the sunday, it's good to see. you, jackie you first. does griswold's reaction square with what you are hearing from politicians, staffers, employees there in d.c. on the hill? that if a judge cites you for insurrection, you shouldn't be off the hook because you were president? >> well, i mean, harry's lawyer here, alex, but our reading of the constitution, according to the multiple people that i've spoken to, in our colleagues at the washington post spoken to over the course of the last few months, is so far are reading that engaging in an insurrection does not necessarily preclude you from running for president, or holding office. >> i get, that but what is the sentiment on capitol hill? what's the sentiment with your sources. is anyone scratching their head like what? he can be accused of insurrection, but because he's president, he gets to get out of jail free card? >> if you are a constitutional purest, and you are looking at the three-year requirements outlined in the constitution, and a candidate needs to be 35 years old, born in the u.s., a natural born u.s. citizen, and has resided in the u.s. for 14 years, yes. and at the end of the day, i think that even outside of whatever reading you have of the constitution, under the 14th amendment that you would like to, taken obviously, you, know the judge in colorado had really parsed that section that everyone keeps talking about within the 14th amendment. saying that this does not apply to trump, or anyone who would be in the presidency. it does not specifically mention the presidency. we can get more into the back story of that later, but this has become such a polarized partisan conversation. there, it would be hard-pressed to find a republican. we have, been on capitol hill, who would agree with a different reading of a section. people who are all backing trump on the, hill and who see him as a de facto leader of the republican party, of where there are more private concerns, and public. we heard from people who can buck during the speakers race, for example, who said that one of his problems with some of the people who were running for speaker was their refusal to say that the 2020 elections rightfully won by joe biden, and for their participation and the insurrection on january six. can box retiring. those voices are becoming quieter, and quieter. i think as we get closer to 2024, this is becoming an increasingly partisan conversation. >> yeah. so coloradow the fifth state to reject challenges to trump's 2024 eligibility. give me your sense of the significance of this judge declaring thatond trump engaged in insurrection, if he's not going to need to answer to it. >> he may well need to answer to, alex. i understand the chagrin of the colorado secretary of state, but i think they're missing the broader view. what the judge decided is way more important than what she did on this, to let him wriggle out at the end. he, she went to a factual representation, evidence, all week long trial, and said he engaged in insurrection. that is something that you couldn't, that is necessary if you are ever going to have this claim prevail. the things she said at the, end which was a sleeper issue, minor in the case, was this reading of the clause saying, while, it doesn't count for presidents. that is something that a court of appeals has a pure legal issue, they could simply revert this easily. that would be necessary anyway, for them to hold before going to the u.s. supreme court. the much, much bigger points is that some, judge unlike every other case you mentioned, took it upon herself to actually adjudicate on the facts that he engaged, were jet universe amendment, defense and insurrection, and without something like that, the claim would be dead in the water. so actually, it makes the claims possibilities of survival way greater than they were two days ago. >> extraordinary. jackie, what about trump's mar-a-lago classified documents, case because you know that it's that for next year. judge aileen cannon is rejecting jack smith's pretrial deadline, saying she is not even going to considerate until march. what are you hearing about the timing on the documents trial? >> right, alex, buchanan said she would revisit this request to delay the trial in march, jackson has made it clear that he wants to get this trial done expeditiously, and before the 2024 election law is over. this is something that if trump were to become president, he could potentially, altogether dismissed the case. if it were still ongoing. that is why i think you see a desire on all of these cases, to get them done as quickly as possible. prosecutors have argued that the schedule should be stuck to, while trump's lawyers have said that they need more time to prepare, and that is not plausible for them to expect, to be expected to prepare for the, trial and then have this separate federal trial against trump. the cannon, obviously, a trump appointee, he has made previous decisions that have shown some sympathy towards the former president. so, we'll see where this goes in march. >> so, in terms of the scheduling hearing, the guardians go laurel is reporting that the classified documental that's about four,minutes or it is behind schedule. judge cannon indicating that e is inclined to lay the trial regardless. saying that trump'sses in new york and washington, those could combined with the documents case. is that a legit concern for a judge? does jack smith have any options to challenge that? >> well, here is the thing. he could. we know from the start that she is vulnerable to recusal motion based on what she did before remembering that whole search warrant debacle. but she has done something very, kind, of canaan, you could say. she moved, she granted all these interim deadlines, which almost certainly will push forward the actual dates, but she kept the date in place. even though we know it has to give. that means that the u.s. can't go to the 11th circuit now and say that she is still lane too much. so, i think that she is conscience, and worried about justice, but nevertheless, the bottom line is bad. here she has done everything but the final moving of the actual dates. it follows a certainly, that when we come to a before, and she will then be pushing it back. it is a very good dynamic for trump now. >> can i ask you quickly. the d.c. election interference case, trump lawyers are going to be arguing against that gag order. it's going to be audio, i don't as a televised, streams. is that going to be interesting? is that going to be riveting to listen to? >> well, it depends on your energy, where you fall on the north spectrum. i think so. it will actually be the talking. it will be as an amendment argument by trump. i think you will find a hostile panel to trump. yeah, you could tune. and one very quick point. audio is something that a court can do on its own, without video. that means that could also happen in the actual trial with judge jumped in chambers. >> harry and jackie, good to see both. happy thanksgiving. appreciate you. the >> happy thanksgiving. >> thank you. and insiders view of how we can capitol hill. is it feel as bad as it looks? [ cheers ] yeah! woho! running up and down that field looks tough. it's a pitch. get way more into what you're into we are following the latest in when you stream on the xfinity 10g network. the breaking news. the biden administration saying today that a deal is close to release some of the hostages held in gaza. deputy national security adviser, john finer, telling nbc news earlier today, more than a dozen hostages would soon be released. no official deal has been finalized yet. joining me, now north carolina congresswoman, debbie ross. member of the house ethics committee, and vice ranking member of the house judiciary committee. congressman, welcome. great to have you here on the sunday. i'm curious about your reaction to this news that a deal could be close to release a number of hostages in gaza. >> well, it's good news. we, of course, are all heartbroken about the more than 200 hostages that have been held for over a month. the fact that there are alive, that they may, be released is good news. we all have to be patient, and hope that this comes together along with the humanitarian pause that we will need to get them to safety. and, innocent palestinians, the assistance that they need. >> in terms of that, the administration said that a deal would be accompanied by a multi day pause and fighting. how far might a short term cease-fire go to calm divisions over round this war, within the democratic party? >> i don't know the answer, but we are moving in a really good direction. again, releasing these hostages, making sure that they are still alive, and that they can return to their loved ones. remember, nine of these hostages reportedly are american citizens. we must do that, of course, we need to have a humanitarian pause associated with that. we must make sure that people can be safe, and that they get the assistance that they need. that is critical. >> you are 100%. right let me just make the point that we do not know what these nine americans currently being held hostage will be part of this release. of course, we're all hopeful that will be the case. let's turn to focusing on the, hill begets it has been quite the week for house republicans. threats of violence during the hearing, although it was the smurf name-calling, and an elbow allegedly being thrown. as you know, americans approval of congress now stands at a dismal 13%. it could drop even more after this past week. what do you make of all this republican dysfunction? >> well, this is what happens when you have a slim majority with a minority that is extreme maga conservatives. they did this to kevin mccarthy to it takes a very few members of the house to slow down what's happening, to have ridiculous conditions, many of these folks are putting amendments on the floor when we should be passing humanitarian aid, aid to our allies. amendments on the floor to reduce administrators salaries. to not have gun violence prevention, all of which would fail just because they want to be able to assert something, but when they're doing that, they are keeping the government from doing the peoples business. the vast majority of both democrats and republicans want to do good work for our people. we are being held hostage by this mega majority. >> less than 13% approval rating, but a republicans, as you know, to avert the government shutdown, the clock is still taking. are you optimistic that congress compasses to do lists, given this republican dysfunction that we've all witnessed? is there any hope they can do so, do this with a civil tenor. >> i'm an optimist, the things that makes me optimistic about our ability to do the budget is how the senate has been operating. the senate has taken off all the budget provisions, they've gotten through committee with five bipartisan support, little opposition, this budget provision has already been set to the house is very little opposition, we know how difficult it is to get things to the senate, and that is going to put pressure on the house. if you put this on the house floor, they would pass. it is just wrangling this maga minority. that was a difficult task for speaker mccarthy. he lost his speakership over at. it is going to be a difficult task for speaker johnson. >> let me ask you quickly, given your position on the house ethics committee, is there bipartisan support to remove george santos from the house of representatives right now? what are your questions as you watch this play out? >> alex, i think that some of the reporting gives cautious optimism. certainly, not only the united states, but the hamas and other representatives in the qatari government are working towards a potential hostage return and exchange for a cease-fire. i think we need to find some way to slow down the level of violence, the level of not only israeli in gaza, hamas's response to, israel and try to find off-ramps to move away from the violence that we're seeing here. but there are statements from prime minister netanyahu, he seems very determined. certainly, israel has a right to defend itself against the attacks by hamas. we also can't lose sight of the fact that hamas does not represent palestine, in the palestinian people. that these are very separate issues. that there is absolutely a place to be appalled by the conditions under which the palestinian people are living. at the same, time we can denounce the actions by hamas, and insist that their ability to ever attack israel like this again is removed. may have some cautious optimism that we may see a return of some of the women and children, certainly, but we need to be patient with the process, and hopefully it will bury some positive results. >> peter, i know that you are, as i mentioned, and gaza last year. you have probably had a good sense of the tunnel system. how much progress do you think the idf has made in eliminating the tunnels? >> the well, to be, clear i was on the israel side of the gaza border, but i do think that it was part of the reason why they wanted to, needed to go in and occupy gaza. to get a firm handle on what existed, certainly, below ground. i think there was, as we look, attic nino, somewhat of an intelligence failure. not only on the part of israel, but on the part of their western allies, including the united states, did not appreciate the level of preparation that hamas was aiming to achieve, to carry out these very complex, very broad attacks. i think what we're seeing now is some indication of what the israelis are fighting. i have not yet seen the complete picture, either because israel does not know, waited because they've chosen not to really set. i think the jury is still out about the nature of the tunnels, the extent to which they have been used, not only the preparation of these attacks, but on the ongoing operations by hamas. >> stunning piece for the economist, which is a donald trump poses the biggest danger to the world in 2024. riding in the test cover story, the election will be decided by tens of thousands of voters and just a handful of states. in 2024, the fate of the world will depend on their ballots. i'm curious what day trump victory would mean for the u.s. intelligence community. >> well, this is an extraordinary, sobering article by the economist. if we focus in the united states about what a second trump presidency would mean here within the united states, but i think it's important, as the economist, us to look at the impact on the international order of the trump presidency. the economist gustier thing for national security matters to economic policy, to the broad international democratic order. i think, from an intelligence perspective, what everyone needs to realize is the extraordinary extent to which the united states intelligence community partners with our allies. i'm not just talking about nato allies, i'm talking about countries, democratic countries around the world. that rely on each, other that we share intelligence to support operations that reserve or national security. when you have a large number of foreign nations looking at donald trump, watching and waiting, at some, point maybe we'll have a before the election, i don't think we will, a trial, in the united states, about whether or not trump has handled classified information that has to give pause. there is an every intelligence agency around the, world wondered whether or not trump, is reelected, will be able to engage with the united states and the same way that they have for generations. >> yeah, it is very -- levels in together to part of an exchange between republican congressman, an fbi director, christopher wray, on capitol hill last week. here's that. >> if you were asking whether the violence at the capitol on january six was part of some operation orchestrated by fbi sources, and/or agents, the answer is emphatically -- >> you say no? >> no. violence orchestrated by -- sources or agents. >> are you familiar with, you know what it goes to feel cool is? these buses are nefarious in nature, were filled with the fbi just as trump supporters. >> i mean, what do you make of this accusation? >> well, i think that you're seeing in the numbers, anytime there is a war on the world stage, is anxiety. we've seen civilian sualties. u.s. voters are reacting to that. i do think we have to temper expectations and be realistic about this. israel is not going to stop their mpaign until hamas is defeated, or has surrendered. as well as the hostages, they are accounted for. what should the expectation be on joe biden? it's exactly what you're seen. it is brokering a deal for temporary cease-fire, for the release of hostages. joe biden is not going to be in a position to convince israel to stop the current campaign, and call for permanent cease-fire. i think what joe biden is doing is exactly what voters should be expecting, in a way that reflects america's values, in the current alliance with israel. it is going to take joe biden to remain on message about that. that israel intends to continue this campaign, the u.s. will work where they can to protect civilian casualties, and try to broker additional deals that ultimately resulted in reducing the loss of civilian lives. >> this poll also shows the worst of democrats. you have 51% of them saying that israel has gone too far. 49% say they oppose the u.s. sending military aid. is this episode in history far enough removed from next november? that is not a big concern for president biden's campaign strategies? >> actually, i don't think that it is something so far removed from the election. some of this polling that we've seen is how young voters are viewing what's happening. between israel and hamas. what's happening with the palestinian people. the reality is, there is a growing group within the united states, those folks are having a very complicated situation, they are questioning the united states unequivocal support of the israeli government, right? there are a lot of people who do not believe, or support what hamas is doing, but they are very concerned about the very real humanitarian crisis that the palestinian people are facing. so folks of color, their democrat, questioning the democratic party. listen, young people do not forget. they're going into the 2024 election wanted to vote for something about what the other side is or isn't doing. this is going to be one of the issues that is top of mind going into next year's election. >> so jim pasadena, who managed the 2012 election campaign, he says the biden campaign doesn't need to panic yet. obama also struggled with pull in at this point. his message to biden? doubled down on the battleground states. tout economic accomplishments, and remind americans of the chaos of the first trump presidency. so might the remind everyone of the chaos have the greatest influence on democrats, and independent voters? >> listen, i think this is a different campaign in 2012. i was the first committee presidential campaign that i worked on under jump is seen as leadership. we were concerned, right? we looked at the polls, and not to panic, but to make sure that we had a strategy that combatted with those polls were sane. i think the biden campaign needs to look at this as, yes, don't panic. also, don't take for granted how crazy the other side is. remember, voters have been saying over and over, they want to vote for something. as the election results, they're in the issue that the democratic party stands for, that a lot of voters care about, and want to see moving forward. then there are promises that are not followed through on, and we need to do a better job communicating this while it happens, whether this very slim majority that we have in the senate, and then also this war. don't panic? also don't take things for granted. >> last question to you, david. this, we capitol hill turned into five club after a series of heated exchanges. watch this. >> law do you want to run your mouth? we can be to consentino dolls, finish it here. >> that's, fine perfect. >> you want to write?
