you heard was republican congressman george santos of new york before the release of a damning ethics report. we'll go through that and what could come next for the embattled lawmaker. plus, we'll bring you the latest out of the middle east. israel says it has more evidence that hamas was operating out of a hospital in gaza. it comes as the idf recovered the body of a hostage near that facility. and also ahead we'll recap another busy day of diplomacy on the west coast for president biden where he met with the leaders of south korea and japan. good morning and welcome to "way too early" on this friday, november 17th. it's friday. we made it. i'm jonathan lemire. thanks for starting your day with us. we'll begin with some good news. the federal government will stay open at least through the end of the year that's because late last night president joe biden signed the stop gap funding bill that was passed by the house and senate a few days earlier. the move avoids a government shutdown that would take effect tonight. the continuing resolution as it's known the cr extends funding for several federal agencies until january 19th. that includes departments of agriculte, transportation, housing, and urban development as well as veteran affairs. the cr then funds the remaining parts of the government including the defense department to february 2nd. but that means lawmakers will face another funding fight to keep the government open early in the new year, an election at that. elsewhere on capitol hill, new york congressman george santos is now saying that he will not run for re-election next year after a scathing house ethics committee report found that he, quote, blatantly stole from his previous campaigns. in the 56-page report released yesterday, the bipartisan group of house lawmakers concluded that santos was a, quote, knowing and active participant in a complex unlawful activity. according to the committee santos spent years lying to the federal election commission, banks, and even his own staffers in order to cover up his misuse of campaign funds that spendingllegedly included mo than $10,000 at italian and french fashion stores, nearly $2,500 for botox and other cosmetic trtments, more than $2,000 at atlantic city resorts, and more than $3,000 for a weekend in the hamptons. the report also alleges that santos convinced staffers to hire an organization called red stone strategies to do work on his campaign without telling him that he owned that very company. santos then allegedly transferred money from red stone's bank account into his own personal account. now, of course, questions about santos' background started to arise shortly after he was elected to congress last year, but the ethics committee determined no part of his back story is found to be true. let's say that again. no part of his back story has been found to be true. the report outlines how santos' own campaign staff even encouraged him to drop out of the race back in 2021 after becoming convinced and concerned about a lack of evidence to support some of his claims. the ethics committee has deferred its findings to the department of justice where santos already faces 23 federal fraud charges. in a tweet yesterday, the embattled congressman called the report part of a smear campaign against him but announced he would no longer be seeking re-election next year at least for now he's not going to resign his seat. but santos may be out of the job anyway long before january 2025. that's because later today house ethics committee chairman michael guess is expected today introduce a resolution that would expel the new york republican from congress. an expulsion would need the support of two-thirds of the house, something that appears to be becoming increasingly likely. if you'll recall just a few weeks ago the effort to kick san is an tose out of congress failed with many lawmakers saying they were going to wait until they saw the findings of the ethics report. now many of those who previously voted against expelling santos said they would vote differently next time. the resolution would not to come a vote until after the house returns from its thanksgiving recess, so a little less than two weeks time they're slated today be back on november 28th. joining us now capitol hill reporter for "the wall street journal." great to see you again. so let's start with the ethics report. give us a little bit of sense, if you will, to the reaction you're hearing there on the hill about this truly damning allegations against congressman santos. >> the allegations are damning, are detailed, thoroughly reported. what you're hearing is this increasing march towards expulsion. it is a high bar that two-thirds majority. but what previously was not inevitable is now seeming to be increasingly so. one of the members of that committee did say they didn't recommend certain charges because they would have required at trial which they didn't want to do, so this is the route we've seem to have ended up with. and it's worth noting here you talk about the members who weren't going to vote to expel him until they'd seen the report. well, this is due process at work, and we should opponent out this is one of the norms in washington at least has not been broken. one norm here is still holding. >> this probably is how the process should play out even though the evidence against santos has appeared to be overwhelming for quite some time. his time in congress may be running short. let's get to the other top headline. we opened the show with the news president biden signed the stop gap funding bill, so government is going to stay open for the next couple of months, but set the stage for us just how pitched a battle will it be over government funding early next year? >> the signing of the continuing resolution that two-part bill delays a fight, but it does not end a fight. and in fact, we are going to see a very pitched battle at the start of next year, and that's in part because lawmakers know that if they are not able to come up with some type of solution, a 1% cut in the federal budget is going to kick in the effective date essentially at the end of april. as we saw before congress headed into its recess on the house side, there was still controversy over a number of individual bills. the new speaker mike johnson could not get those off of the house floor, and in that sense he is in the exact same situation as house -- former house speaker kevin mccarthy was, implying that the problem is not a matter of personality alone, it's not just members disliking one speaker, it is, in fact, a situational problem that reveals some deep, deep fights over the level of cuts to the federal budget that republicans are willing to accept. >> yeah, we saw just speaker johnson walking there. he for now has a period of grace from the hard right. we'll see if that lasts during negotiations next year. we continue to search gaza's main hospital for more evidence that hamas has been operating out of that building. yesterday israeli defense forces released this video of what they say is a, quote, operational tunnel shaft. they also say they have found more hamas weapons. now, nbc news cannot independently verify those claims but has been able to verify the loekds shown in the video is just outside of the hospital complex. israel says there have been no casualties since the hospital raid began on wednesday. the facility had to shutdown over the weekend due to a lack of fuel and supplies. still, hundreds of patients are inside seeking medical care. the fuel shortage has also caused internet and phone services to collapse across the gaza strip. the breakdown of the communications network, which was crucial for coordinating aid deliveries, will keep the united nations from delivering any aid into the territory today. the israeli military also says it has discovered the body of a hostage during its raid of that hospital complex. officials say the body was found in a building that also contained assault rifles and a rocket propelled grenade launcher. the 65-year-old was kidnapped by hamas terrorists back on october 7th. she had been undergoing cancer treatment. her husband was killed during the original attack. still ahead here on "way too early," we'll turn to some turn to some of the morning's other top headlines, the gag order on former president trump and his legal team in the new york civil fraud trial has been temporarily lifted. yesterday trump's lawyers appealed the order and the court issued a pause until a full panel review. the judge in the case judge engoron opposed the order after trump made multiple remarks about his law clerk and later expand today include trump's lawyers. the former pre found in violation of the order twice and has been fined a total of $15,000. he responded to the gag order pause by what else? promptly attacking engoron's law clerk on his truth social page. the judge says his office has been inundated with threats since the trump trial began. meanwhile, david depape, the man who brutally attacked paul pelosi late last year was convicted yesterday of all charges in federal court. during the trial depape looked down and showed little emotion as the jury found him guilty of assaulting pelosi with a hammer in his san francisco home. paul pulousy would go onto sustain a fractured skull because of the attack. depape was charged with attempted kidnappingf a federal officer and assault on the immediate family member of a federal official. depape now faces up to life in prison and still faces multiple state charges connected to the home invasion including attempted murder. nancy pelosi not home at the time of the attack. meanwhile, an ohio man convicted of assaulting police officers at the u.s. capitol on january 6th has now been sentenced to prison. a u.s. judge sentenced kenneth owens to four years and ten months behind bars. in 2021 thomas joined trump supporters in storming the capitol and repeatedly physically and verbally assaulted police officers. thomas was also ordered to pay a $20,000 fine and $2,000 in restitution. so far more than 1,000 people have been charged with federal crimes in connection to the violence at the capitol. more than 800 of them have pleaded guilty or have been convicted after a trial. to politics now. nikki haley is picking up more campaign cash and support in the race for the gop presidential nomination. some donors who have previously backed south carolina senator tim scott are now shifting to haley, the former governor of that state, after scott's exit from t race earlier in the week. meanwhile, billionaire hedge fund ceo ken griffon who gave millions to ron desantis for his campaign for florida governor, told bloomberg tv earlier in the week that he was actively contemplating backing haley. haley also appears to be building some momentum in the polls as a alternative to donald trump. a new poll by cnn and the university of new hampshire that was released yesterday had trump with a still commanding lead at 42%, but haley is now a pretty clear second choice. she was at 20%, 6 points higher than governor chris christie. next we'll turn to sports and bring you the highlights from thursday night football, a game that lost two being held in san francisco. yesterday the president addressed the ceos to discuss how the optics of the economy don't always line up with the data. >> more people in the united states are in the workforce today than any time in american history. unemployment has been under 4% for 21 straight months. inflation has come down by 65%. we now have the lowest inflation -- the lowest inflation rate of any advanced economy in the world. meanwhile, household wealth has grown by 37% in real terms since before the pandemic. i acknowledge there was a disconnect between the numbers and how people feel francisco. give us some take-awaysads this administration tries tuesday pivot towards asia and reset relations with china. >> good to be with you, john. the first i'm not sure you'd characterize it as exactly the high point. biden's kind of off-the-cuff answer into whether he considers xi a dictator. he said, well, he is, and that kind of overshadows pretty much everything that happened this week. a lot of the week really was about trying to mend a little bit of relations with china, get to a point where they can continue to be a conversation after obviously some tense years and some continued tense competition as biden likes to put it. but that will remain a bit of a sticking point between relations, between the two countries. obviously what you saw the rest of the week was biden trying to do a couple things. one, shore up relations, strengthen tieswise other nations around the world especially in the asia pacific among a lot of diplomatic work he's had to do around the world, and also you just saw there project strength on the economy, that's something he's trying to do both domestically and abroad, and you're seeing this message of, yes, america is doing better relative to other countries around the world. but importantly still work to do especially on inflation and cost of living. >> beijing certainly not happy with that remark, but senior officials tell us they're still please would the progress made this week in san francisco. we just heard the president acknowledge there's a disconnect between economic data and how people feel about it, democratic operatives are sounding the alarm. politico is reporting that biden's top aides met with a pair of progressives in september who provided polling that showed bidennomics not breaking through. according to that polling just 35% of americans trusted democrats on economic issues while 7 in 10 americans believe the economy was not getting better. despite this polling, biden advisers reportedly believe their strategy will pay off in the long-term. it's a good story here and hits a theme we've gone for a while. the white house keeps pointing to the economy and, guys, this is pretty good but people aren't feeling. so tell us more about what the report said and why the white house isn't changing course now a year from the election. >> yeah, this was polling circulated in the white house at the highest levels in september and october, also among democratic congressional leaders, i it told us a lot of what we already knew, right, that even though the economy by all measurable indicators is doing really well, people just don't feel it, they don't believe it. and that's in part a lot due to rising cost of living, this idea prices went up in 2022. obviously they have not can come down, and so even if inflation is easing, people aren't really seeing it when it comes to grocery bills and gas and housing. and a lot of the polling and the discussion in the white house about this was about what to do there, how to tweak the messaging, what they can say differently. and you actually heard it a little bit in that speech from biden this week saying, one, there's still work to do, and two, a lot of the impact of this great economy really has not trickled down to every day people. >> all right, politico with some good reporting and a story line going to remain front and center between now and pace for weekly gains. are they able to maintain that optimism for the remainder of this month, thanksgiving break looms. >> well, thanksgiving break certainly does loom, and this will will give most -- if you were longhe market will give you a pretty sweet note to end on given the holidays. all three of the mage indices are higher coming into today's session. the tech sector has led the gains, that nasdaq index outperforming the s&p and the dow on the week. a lot of this optimism came on the back of that down surprise and inflation we got earlier in the week on the basis investors now increasingly believe the federal reserve will cut interest rates next year. we also got some jobless data yesterday, weekly jobless claims rising a little bit more than expected in the latest week, but overall sentiment has been pretty positive state side this week. >> earnings season in full swing. retailers though, though such as wal-mart are starting to raise concerns about consumer spending as we're on the eve of the holiday season. julianna, what have we learned so far? >> so wal-mart yesterday took a pretty big hit. shares plunged 8% after the company predicted a weaker consumer spending during the upcoming holiday season specifically they said that shoppers have been shifting their spending toward essential items away from those discretionary purchases. the cfo of wal-mart says we see our customers making tradeoffs to afford the things they want given the high cost of the things they need. and wal-mart is very closely watched because it's usually a pretty good barometer of the health of the u.s. consumer. gap, meanwhile, had a really strong set of numbers yesterday. gap saw its shares soar after beating expectations on sales and earnings. old navy was strong in the quarter. gap itself also doing well. wasn't all good news. they're still working on a turn around in banana republic and atleta. it's been a long journey to re-claim the relevance it once had. >> all and what is the latest the white house administration's reviewing the situation at that hospital in gaza? >> well, look, the president and the biden administration has been resolute, and we've been clear. we believe in israel's right to self-defense. we believe in the wake of what we saw, the brutality of the terrorist attacks on october 7th, that israel has not just a right but an obligation to defend their people and to eliminate the terrorist threat posed by hamas. we also have communicated with regularity and consistently that we believe there needs to be a serious effort undertaken by israel in accordance with international humanitarian law to separate civilians from terrorists. the majority of palestinian people are suffering as a consequence of hamas' brutal terror campaign. their willingness to use the civilian population as human shields, and the united states has consistently and unequivocally advocated for efforts to ensure that israel as they've done in recent days is ensuring daily shipments of fuel to keep desaltation plants and water treatment plants and sewage facilities and hospitals run. we've continued to press for action to get our people out of gaza. to date over 600 americans and their families have been able to get out through egypt. and we've continued to urge israel to do everything in their power to make sure they're prosecuting this campaign against hamas in a way that does the maximum to protect the civilian population in gaza. >> oliving you, as we just mentioned the president wraps up his trip to california today. two parter for you there. give us a sense as to whether when he meet with the mexican president today the idea of the border will come up. and secondly we covered the blow back from what president biden said about xi jinping calling him a dictator, which objectively he is. how are you managing that statement with beijing? >> well, second part first. this president has talked about his candid straightforward relationship with president xi jinping going back to his time as vice president. he talked the other day about the fact on the heels of this four-hour meeting they had this week, that the president has spent more than 6 to 8 hours face-to-face with president xi. that relationship and diplomacy doesn't require that you always agree. the president also was able to come away from this meeting this week with president xi with tangible benefits and results for the american people including cracking down on fentanyl, very significant for the american people that the president was able to secure that. that action from china use law enforcement action to go after and disrupt the flow of component parts for fentanyl into the united states. fueling the epidemic that is devastating our families and communities. so in addition to that, the president was also able to make progress in terms of the resumption of military to military communications between our two countries. that's very significant when you think about the fact we have two of the largest military forces on the planet, them being able to talk to each other, very important for our national security and for global security period. we feel very confident about the way in which the president is coming out of this meeting this week and the entire summit. with respect to the meeting with the mexican president today, you can be assured that a lot of our critical priorities, including border security and fentanyl, will be on the menu. stay tuned for more on that. while i'm at it, i would just say that i know we had some news overnight in terms of the cr. we've narrowly averted a shutdown yet again, but i would just be remiss if i didn't take the opportunity to remind members of congress that we also have urgent supplemental requests in front of them for things like border security. we urge them to pass that quickly, as well. >> we'll be getting into that in our next segment here. certainly a story line into early next year as the budget fight starts up again. white house principal deputy press secretary olivia dalton, thank you for joining us. we'll speak again soon. >> thanks, jonathan. up next here, as mentioned, president biden has signed the stopgap bill to keep the government open. but funding for israel and ukraine remain stalled. we'll go over where congress stands on aid for america's allies at war. you just heard what the white house wants. then coming up on "morning joe," botox, luxury fashion, and fake loans. what a damning ethics investigation into congressman george santos is revealing about how he spent donor funds. plus, we'll hear from the ranking democrat on the house ethics committee. they put together the report. congressman susan wild, as well as congressman goldman, who initially filed the investigation into the rookie lawmaker. >> our colleagues in the huddle newsletter yesterday, i thought, had a great line where they said, it might be a christmas without george santos. i think his days are numbered. we see a lot of democrats, in particular, who were not for the last expulsion resolution coming around this time. they feel this was the matter of due process they needed in order to feel like they were giving george santos the correct precedent they want to see going forward for potential future expulsions, which are incredibly rare in congress. i do think we're seeing the necessary flips. you can continue to count on that core of house republicans, particularly new york republicans, who are going to continue to support the expulsion resolution. even then, you see a handful more coming over to the side of pushing george santos out. i do believe his days are numbered. it doesn't seem like it's getting better for him. but, of course, he seems to be willing to go down i flames. he is saying he continues to be an innocent man, saying he is choosing not to run for re-election now, sort of a you can't fire me, i quit energy going on there. i think that it'll be interesting to see how it plays out over the next few days. >> we'll have much more on the embattled congressman on "morning joe." lastly, another person whose job security is not super great is the new speaker, but he weathered this storm with the cr. give us a brief sense, though, as the budget fight pushes forward, how secure is he? >> i think he's getting a little breathing room right now. the end of the day, conservatives know they put him through a lot over these first few weeks. he is coming into a house that is in tatters, that is fighting each other, that really needs a little bit of a break to go home for thanksgiving and come back potentially a little more tame. i do think, though, as we look at him going through with appropriations over the next few weeks, his time and his grace period there is going to be sort of numbered. these conserve tifatives want t budget cuts that are really difficult to obtain when you're work winning a democrat-led senate and democrat-led white house. they're going to be pushing him for something he simply may not be able to achieve. >> yeah, considering the fights that nearly broke out this week in the house of representatives, they desperately need this thanksgiving recess. ursula, thank you for joining us. have a great weekend. thanks to all of you for getting up "way too early" with us on this friday morning.
