i don't like the bill. >> speaker johnson's been on the job for, what, two or three weeks now and that's like throwing a quarterback in the fourth quarter and expect him to make up for three quarters of failure and you're behind 35-0. the reason he finds himself in the position he's in because of nine months under speaker mccarthy. >> it's also a no vote from bob good of virginia on speaker mike johnson's plan to avoid a government shutdown. but there are some democrats who are signaling they may support the funding bill. we'll tell you about that. plus former trump allies who pleaded guilty in the georgia election interference case give new details about the plans to stay in power. and also ahead, the latest from gaza where the area's largest hospitals are running out of fuel and efforts to evacuate the patients are stalled amid heavy fighting. good morning, and welcome to "way too early" on this tuesday, november 14th. i'm jonathan lemire. and thanks for starting your day with us. with just three days left to avert a government shutdown, the house is set to vote today on an unconventional plan put forward by speaker mike johnson to keep the government open. and at least for now several democrats appear to be signaling their support for the measure because it's clean, meaning, it does not cut spending or attach other conservative policy add-ones. the democratic caucus will meet later this morning to formalize their position on the plan. at the same time, at least eight house conservatives have said they will vote no on the continuing resolution known as a cr, which must get the support of at least two-thirds of the chamber to pass. if approved, it would then head to the senate. under this two-step laddered plan, the cr wou extend funding for several spending bills needed to keep the government runni until january 19th. funding for the remaining bills would go on a cr until february 2nd. joining us now to help us understand this, politics reporter at semafor. great to see you this morning. thanks for starting us off. let's begin with democrats. there are some who have signaled support for speaker johnson's plan. tell us how he seems to have won them over. and what's their calculation in saying you know what, we're going to do this? >> yeah, i think the key here is that speaker johnson has a very uphill battle. he's coming with a fractured caucus who just ousted their previous speaker, but he also has a very, very tight majority. so with that said, i think he's gained some favor with democrats by making this a clean cr. that is something that leader -- minority leader hakeem jeffreys insisted on a couple of days ago. so i think he's positioned himself well to get democrats onboard with that cr even knowing that he's going to lose some of his republicans. >> so what is the current whip count do we think? do they have the votes to get this through? >> i would say so. there's about eight republican who said they won't vote for the cr, but there's far more democrats who just wanted a clean cr that would totally be onboard. and when you hear people like the leader jeffreys messaging that that is something that would be appealing to him, i think you could imagine most of the caucus will just go along. we'll be hearing in with more democrats voting for republican speaker's measure. >> i know you've been following this closely and have new reporting about how this has been a test for the brand new speaker, a speaker who took the office with a lot of his own colleagues not necessarily knowing who he was or what he stood for. what's the sense as to how he's fared snd. >> i think he's garnered a lot of good will, and largely because people do know his conservative background. they're familiar with him working with adf. and i've been talking to a lot of conservatives outside of the hill, and they just have all great things to say about him. those are some of the same people who are, you know, in the era of member in congress. so he does come with some good will, some trust also. and when you talk to these people they just say, you know, he's a good guy and we think he'll do what's right. you heard good say there just now he inherited a really bad deal so he's doing the best he can. so even though there are people who would push back against this kind of clean cr, i think he's in a good position. >> and then kadia, what would be -- i know you have some reporting as to his secret weapon. tell us what that would be. >> yeah, i think that's the support of outside conservative groups. people like people like brook rawlins and tony perkins who stand for the movement or have been leaders in the conservative movement. once you have people like that backing you and those are certainly people that members in congress are looking to, you know, appease or get the support of, that's kind of a heads-up for -- i'd say a one-up for speaker johnson. >> all right, well, terrific reporting, and we'll be watching the vote potentially as soon as later today. politics reporter at semafor, kadia, thank you for starting us off this morning. we now turn to the latest in the fulton county election interference case. "the washington post" and abc news made public excerpts of ellis and sidney powell. watch this as ellis recounts a conversation with one high ranking trump advisor where he said the boss wasn't leaving the white house for any reason. >> i emphasized him -- i thought that the claims and the ability to challenge the election results was essentially over. he said to me in a kind of excited tone, well, we don't care, and we're not going to leave. and i said what do you mean? and he said the boss is not going to leave under any circumstances, we're just going to stay in power. and i said to him it doesn't really work that way you realize. and he said we don't care. >> we don't care. the video was filmed during ellis' proffer session where she was required to lay out everything she knew that the prosecution could use in exchange for a plea deal. nbc news did not obtape the videos and they've not been independently verified. ellis is one of four codefendants in the sprawling georgia rico case that accepted a lighter sentence in exchange for information. sidney powell who accepted a deal in her own proffer session accepted a meeting with donald trump when he was told he was lost in 2020. >> were you ever around when someone, anyone told donald trump that he had lost the election? >> oh, yeah. >> who? >> pat cipollone, eric hirschman, derek lines, all thought he'd lost. >> was that the september 18th meeting? >> yes. >> what was president trump's reaction when i guess this cadre of advisers would say he lost, wewell they'd say that and walk out. >> powell also discussed her scheme to seize voting machines across the country and said she talked with the former president often while she carried out her plans. both she and trump now claim she never represented him. meanwhile, "the washington post" also reported that kenneth chesebro, a key figure in the plan to use fake electors, told prosecutors he briefed trump on the attempt to falsely certify his win in battleground states. chesebro's statement would personally tie the former president to the elector plan. the fulton county d.a.'s office has refused nbc news' request for comment. trump's lead attorney in georgia said this about the reports. "if this is the nonsense line of inquiry being pursued and this is the type of bogus, ridiculous evidence that d.a. willis intends to rely upon, it is one more reason that this political travesty of a case must be dismissed." the former president, meanwhile, is taking advantage of a pause in the gag order against him in the federal election interference case. trump posted on social media yesterday that special counsel jack smith and the u.s. deputy attorney general would be institutionalized if he is re-elected president next year. the former president wrote they were suffering from trump derangement syndrome. the gag order against him in the federal election case is on hold at least until next monday. that's when an appeals court is set to hear arguments from trump's legal team on why that order should be removed. trump will play this off as he was joking, but, again, he's telling us what he would do if he were back in power. meanwhile, special counsel jack smith's office is arguing geps having cameras in the courtroom during trump's upcoming federal election interference trial saying the former president wants a carnival atmosphere. in a filing yesterday smith's team wrote that there's a, quote, constitutionally sound broadcast prohibition that has governed federal criminal trials no matter the defendant for decades, and that there's no reason to depart from common practice. media outlets including msnbc's parent company nbc universal are arguing for the trial to be televised. initially, trump's attorney told the special counsel that they took no position on televising the trial. but over the weekend trump's team changed course, asking for the trial to be broadcast while accusing the special counsel of wanting to proceed in secret. at this point, the trial is very unlikely to be televised given that federal criminal proceedings have never been aired on tv. what's more, judge tanya chutkan has repeatedly stated that she'll treat trump like any other criminal defendant and that broadcasting the trial would be a major departure from the form. and if that wasn't enough in trump legal news, we've got one more story for you. donald trump jr. testified again yesterday in the family's new york state civil fraud trial. this time as a witness for the defense. the trial is mostly in place to determine the punishment that will be imposed as a judge has already found trump and his adult sons guilty of fraud. during his testimony don jr. praised his father as a visionary, an artist, and a genius. he described the former president as someone who, quote, creates things that others would never envision. no need for a fact check there. trump jr. attempted to paint a picture that the properties are extremely valuable and that the company actually underrated them. in a statement the judge has already deemed fraudulent. however, trump's eldest son failed to provide any evidence to support his claims while the prosecution has presented spread sheets, financial statements, and more to the contrary. as the prosecution attempted multiple times to object during don jr.'s testimony, the judge in the case overruled the lawyers saying that trump will appeal his decision anyways. still ahead here on "way too early," president biden weighs in on the fighting around gaza's largest hospital, which is no longer able to operate because it's run out of fuel. we'll play for you the president's comments. plus an update on the federal investigations connected to new york city mayor eric adams. those stories and a check on weather and sports when we come right back. weather and sports when we come right back tiny, branch, poppy on another musical adventure. you see that button? yeah. press it. hold onto your cupcakes. ♪ ♪ ooh! too much hustle is a thing. look at that. ♪ my name is josh sanabria and i am the owner at isla veterinary boutique hospital. i was 5...6 years of age and i knew i was going to be a vet. once alexandra called me to let me know that bank of america had approved my loan... it was important to me. we not only just provide the financing piece, we do everything that we can to surround them with the right people. all you need is a perfect, amazing team that will guide you through the right steps to be successful. and that's what bank of america was for me. "the washington post" reports organizers anticipate about 100,000 people to attend according to a permit that was issued by the national park service. security in the area will be increased while d.c. police have asked for assistance from the national guard to help with traffic safety points. slated to speak are family members of hostages taken by hamas as well as some members of congressional leadership. in new york city, the city's mayor eric adams will finally address the swirl of investigations surrounding him as he will hold a press briefing later today. the first-term mayor is the center of several ongoing federal investigations including potential campaign donation issues and accusations of misconduct. adams has not yet been charged with a crime. there are three cases surrounding the mayor. the first involves an indictment by the man han d.a.'s office of six people accused of funneling money to his 2021 mayoral campaign. in the second case the mayor's building commissioner was charged in a bribery investigation. and the final case is the one most closely tied to adams himself. the fbi seized several electronic devices, his phones, ipad, from adams as part of a probe into whether he worked to cut red tape for the turkish government shortly after winning the election, questions about the financial donations there as well. we'll bring you the latest. baltimore infielder henderson and the arizona diamondbacks carol as the league's rookies of the year. the young stars were voted unanimous winners after helping their teams reach the playoffs. this marks just the fifth time both the al and nl selections were unanimous and the first time since the yankees erin judge and the dodgers cody bellinger did so back in 2017. the las vegas golden knights were honored at the white house yesterday. president biden joked about his sagging poll numbers in nevada while marveling that a hockey team plays in the desert. >> just six years ago the idea of a championship team playing on the ice in the vegas desert -- oh, vegas desert. i mean think about this. who would have thunk of it as they say? seemed like a pipe dream. but the team ownership had faith, predicting in a playoff run in three years and a stanley cup in six. i've got to talk to them because the polling data i'm not paying much attention to it. time now for the weather and let's go to meteorologist angie lassman for the forecast. the president tells us it's hot in las vegas. we're allowingia to tell us how it is everywhere else. >> i agree with him on that. it is hot in las vegas. it's a little rainy, though, along the gulf coast. it's been busy there when it comes to the showers over the past couple of days, and we've got more on the way. we need the rain in a lot of spots. waking up in new orleans, mobile, and stretching into the florida panhandle you'll need the umbrella. and we kind of have just this system sitting to the south and gulf of mexico that leaves it unsettled through the day today. notice tomorrow, though, it focuses on the state of florida, and we'll have ample amounts of rain as we get through thursday. heavy rain expected from basically west palm to key west. we'll likely be seeing flood alerts coming out of this spot and region here the next couple of days. localized amounts could be anywhere from 6 to 8 inches. meanwhile, it is warm across the u.s. too. mid-60s in minneapolis, 60 degrees for kansas city later today. we'll head to the mid and upper 60s tomorrow, too, and settle into the cooler conditions as we get through thursday, friday, and specifically into saturday. drop down into the 30s for pittsburgh saturday, and mid-50s for new york. and of course hurricane season not officially done just yet. still got a couple of weeks and we've got a 70% chance this will likely develop into a tropical depression by the time we get into late week. still a couple weeks left in hurricane season, so we'll see what that for being with us. the house of representatives is set to vote today on an unconventional plan put forward by speaker mike johnson in an effort to avoid a government shutdown. after the white house initially labeled the laddered continuing resolution as extreme, president biden is now at least keeping options onhe ble. >> i'm not going to make a judgment on what i veto and what i sign, but let's wait and see what they come up with. >> let's wait and see what they come up with, the president said. joining us now co-founder of punch bowl news, anna palmer. she's also an msnbc contributor. the bill, though, it's got a few steps before it gets to his desk. so walk us through it. what are its chances of passing the house? and where's the whip count stand? >> yeah, that's the big question we're going to kind of be laying out later today, but it does feel like the momentum is in favor of speaker mike johnson. not only are republicans taking a look at this but so are house democrats. the big question for johnson is going to be will democrats bail him out in the house? so far we have a rough whip count of 50 or so republicans who said they'll not be supporting this. we expect that to potentially grow after this morning's conference meeting. and so right now the question is going to be what can hukeep jeffries and democratic leadership do after this bill. everyone is telling us they don't want a government shutdown. they want to go after after this thanksgiving. >> israel and ukraine funding is that part of it? and if not, when might that come? >> this is going to be a bare bones coming at the current level. part of it will go through middle of january and part of it early february, but a lot of those things both democrats and republicanps wanted israel funding, ukraineunding, taiwan, border security in the senate among other things are not part of this package. this is just keep the lights on legislation. >> and is there any sense of schedule, assuming this passes which i realize is a far from a sure thing? >> it's unclear whether or not there's going to be another package here before the end of the year. they also wanted today do the annual defense authorization. that is not going to be part of this package. you expect at least probably one other legislative vehicle before the end of the year. as far as these kind of foreign aid disaster relief package, right now that's really in the senate, and this gives them a little bit more time to negotiate on those border security proigdss. so probably not until the early part of next year. you're going to see some of that aid that a lot of members of congress believe is needed -- was needed last month if not definitely for ukraine in the next couple of weeks. >> that's a great point. there's such rhetoric about the urgency of getting this to israel and that terror attack was october 7th and now might be looking into january. that'd be three months. that's sort of hard to fathom. forecast for us a little bit. let's say it does get through the house this week, and i know there's as you said some momentum. where do things stands with the senate and then the white house? >> it's been interesting to watch. i think everybody is trying to give this speaker in his kind of early days some time here, and so it does feel like the momentum in the house is they're going to have a bill that will pass. again, everything is a little bit tbd until they actually put something on the floor. right now you have senate democrats and republicans open to this decision to kind of move forward with this kind of tiered package to keep the government open. i think it gives them a little bit more breathing room in terms of trying to figure out that foreign aid package we were just talking about. and i think what you just saw there with president biden is first it seemed kind of dead on arrival, and now i think everybody wants to avert a government shutdown going into the thanksgiving season, night republican senator tim scott dropped out of the race for president. everyone responded by saying that's too bad, and who is that, again? but the announcement has really shaken up the race for fifth place. >> our friend jimmy fallon put his finger on it there. the tim scott campaign never really took off. he's now returning to the senate. we'll have politics later in the hour, but let's go to business now and go to cnbc's julianna tatelbaum who joins us live from london. great to see you this morning. stock futures appear flat this morning ahead of an inflation watch due just before the bell. what are aconomists anticipating? >> john, good morning. wonderful to see you. investors do seem to be in a bit of a holding pattern. headline inflation is expect today have gone 3.2%, that is about 0.1% higher than where we were a month ago. core prices are expected to be on changed from the previous month, and as we discussed so many times before this report matters because it will help dictate where the federal reserve goes from here in terms of rates. yesterday was pretty uneventful in terms of trade, so investors really waiting for this highly anticipated report. >> all right, so we talk about tiktok a lot here. it's a massive company and a lot of countries trying to figure out what to do with it. the latest to ban the chinese social media is nepal. tell us about it. >> so nepal is moving to ban tiktok on the basis that this obviously incredibly popular video app is disrupting social harmony and good will. more than 1,600 tiktok cyber crime cases have been registered over the last four years in nepal according to local media reports. and nepal is not alone here. hoir not the only country to have moved ahead with blanket bans on the app. india in june 2020 banned tiktok along with other chinese developed apps saying they could compromise national security and integrity. >> if the standard is disrupting social harmony and good will, we'd just throw this thing closing in on gaza's main hospital as officials believe the medical center sits above a hamas headquarters. the hospital complex has been hammered by air strikes in recent days. last week at least six medical centers reported being under combat.nd close to heavy urban thousands of people have fled the area. the doctors tell nbc news that no one is leaving gaza's main hospital because of the incessant fighting. they say it's simply not safe to move out. this despite promises from israel it'll help evacuate the wounded and sick. all this comes as hospitals as we noted earlier are running out of fuel, medicine, and food. the world health organization says one of the main medical centers is no longer functioning because it has been without electricity and water for three days. now president joe biden is calling for more protections. >> well, you know i have not been reluctant in expressing my concern with what's going on. and it is my hope and expectation that there will be less intrusive action with the hospitals. and we're in contact with the israeli military and we're in contact tonegotiate the release of prisoners. i remain somewhat hopeful, but the hospital must be protected. >> there's been some reporting even a multi-day pause might be agreed to release a couple dozen hostages but no deal just yet. joining us now democratic congresswoman of the state of california, she sits on the house foreign affairs committee. we're glad to see her this morning. let's start there, congresswoman, and thank you for being with us. the humanitarian crisis and the images coming from the hospital are so heart wrench [the reports pretty dire. what more can the u.s. do to ease this humanitarian crisis? >> well, i think the president has it right. we need to be continuing to ask for a humanitarian pause. americans are tired of seeing so many images of innocent civilians who have been killed, you know, over half of whom have been children. i think it is of the utmost importance that we take a pause so that we can get fuel and medicine and food and water into gaza and also to protect the hospital. i think it is so important that israel continue to abide by international law and practice incisive targeted military operations so that we can minimize the number of casualties in this war. >> so while that's happening overseas, we're seeing a real jump in anti-semitism here at home. we mentioned earlier there's going to be a rally on the mall there in washington later today. but there are spikes throughout the country right now. what more can be done, congresswoman, do you think to combat that hate? >> i think it's so important that we are all in our communities listening. you know, in my district it is a very diverse district. we have a very large and vocal jewish community. there's been an uptick in anti-semitism by close to 200%. and also an uptick in islamaphobia close to $1,000%, and we've seen an increase in hate crimes against both of those communities. we have to realize that americans are now hurting americans. so we have to take a pause and we have to listen. we have to listen to everyone's stories. we also have to listen to everyone's fears and then figure out a way to rebuild community. you know, i still have constituents who have family members who are held hostage in gaza. and so it's so important that we are using empathy and compassion while we're going through this incredible crisis. >> so congresswoman, let's shift to a topic we covered a little earlier in the show, which of course the clock is ticking for congress to pass a spending bill to keep the government open. it's this laddered approach put forward by speaker mike johnson. give us your take on it. it has received some support from democratic colleagues. do you back this approach, and what are your overall thoughts? >> well, once again democrats for the third time are being asked to come in and help govern because the majority party the republicanps don't know how to do it. we had to do it for the ndaa and for the first government shutdown. and here we are now back again with almost the exact same thing. so i have challenges with this. it is a bifurcated approach to, you know, funding the government. i've never heard of that before in the business community. you fund half of the business until january and then the other half of the business until february. that's some kind of strange mathematical kabuki. i also have a challenge with the fact we don't have any supplementales for national defense. it's important we're supporting our allies in ukraine and israel and taiwan, and there isn't domm supplemental. so i do want to add, you know, department of transportation would be in the first chunk and agriculture. you know, we could get our food inspected up until january. i just had the 10 freeway burn up in my district. if that reconstruction takes longer than january, but department of transportation funding ends in january, what does that mean for my district? those are the kinds of real life challenges i'm having with this proposal, but we'll see. we do know democrats are going to step in and save the >> well, i think if we learned anything from the midterms, candidates especially in swing states are going to be careful how closely they align with the president, especially because of economic fears. a lot of voters associate how the economy is doing with the president. we saw that with warnock in georgia. the president did not go to georgia almost that entire season. i wouldn't be surprised if we see spanberger do something very similar. i think this announcement comes at a very interesting time. of course, it's one week after virginia, their state legislator became controlled by democrats in both chambers, a huge win for democrats there. also, as you mentioned, she also beat a big challenge in the midterms, as well, from a well-funded candidate by the rnc who was a part of this push to elect candidates of color. she won, again, in the midterms, and i think she's really trying to capitalize off of some of this rising star power that she has really sustained in the house. she's been able to buck her party on voting for nancy pelosi as speaker, pushing for banning stock trades for members of congress. i think she felt this was her time, especially because, as you mentioned, glenn youngkin, who has had a lot of attention, is not able to run again. i think democrats see an opportunity here. >> yeah, the mayor of richmond also vying for the democratic nomination there to be governor of virginia. let's switch to president biden now. as we reported last week, they shifted in tone significantly, have gotten much more aggressive in going after donald trump in the wake of last week's elections. really trying to draw a contrast on as many issues as possible, particularly abortion. akayla, give us a preview, please. do we expect more of that from the president's team in the weeks ahead? and when will the president himself really hit the campaign trail? they had telegraphed it wouldn't be until early 2024. is that still the plan, or might they change that timetable? >> i think the shift in tone comes at a critical time, which is, there has been now a series of polls of swing state voters that show donald trump leading in the seven battleground states, including from bloomberg news, which showed the former president winning by six points in those states. i think that has certainly worried the campaign. it's worried democrats. it's also shown that, again, the economy continues to be a huge issue. frankly, our polls show that people still consider donald trump the more trustworthy candidate. they think of the economy before the pandemic as better than what it is currently, and that is a huge struggle here. i think, also, because the president is facing challenges from within his own party. you have two sitting congressmen in joe manchin and dean philips. though they have a very slim chance to actually become president, it does say something about people's concerns about his age, about his ability to win re-election next year, and that is certainly a concern to democrats. i think it's also resonating with voters. they're wondering why the president is receiving these challenges. i think there's also a big pocket of voters who don't want to see donald trump or president joe biden run again. that is a huge vulnerability for them. >> third-party challenges are rising. the president will head out west ahead of a pacific state summit with xi jinping tomorrow. we'll have complete coverage. akayla garner, one of our favorites, thank you. thanks for getting up "way too early" on this tuesday morning.
