pass a new funding bill. just hours ago, the new house speaker, mike johnston, unveiled his plan to keep the government funded. it is a two-step approach, putting some parts of the government until january, there is still february. this new plan does not include spending cuts nor additional military aid to israel. >> this untested strategy also serves as a major first test for speaker johnson, who has limited experience and battles. already getting pushback from his own caucus, congressman -- saying today, quote, it has a 100% clean and i 100% opposed. nbc news confirms roy is now one of three republicans to already say no deal. in the meantime, the white house is calling the spawn a, quote, recipe for more republican chaos, and more shutdowns. in a new statement, press secretary -- added house republicans are wasting precious time with an un-serious proposal that has been panned by members of both parties. nbc news capitol hill correspondent has more. >> hi, alicia, six days ahead of next friday's government shutdown deadline, we finally have a plan from house speaker mike johnson and how he wants to overt that shut down that line. you talked about it with his colleagues, republicans on the phone call a couple hours ago laying this out. he is calling it a two-step continuing resolution that is because on january 19th half of the agencies will run out of funding, then on february 2nd other agencies will run out of funding. it is really an untested situation. democrats certainly not in favor, have it in fact a couple moments after this plan was, revealed senator ryan -- appropriations committee had posted on next, saying quote, we are going to pass a clean short term deal, the question is whether we will do it -- like adults. now this plan is clean, meaning there are no spending cuts in this bill, that is something that was a red line for democrats. house democratic leader hakeem jeffries at the end of this week told me that the only think they will accept is a -- concurrent levels. and they were under leader schumer, speaker pelosi, and it is something that democrats were very serious about. a couple of minutes we actually heard from a senior democratic aide, who, said they are glad, it is a good, think, quote the speaker did not include unnecessary, cuts and kept defense bonding with a second round of programs. now we are hearing from some republicans who aren't thrilled about this. a hard line conservatives talk about someone like -- on the call with republicans will still happening, that he is a no on this plan. it does include budget cuts. certainly slamming speaker johnson, and it sounds like he is -- speaker mccarthy found himself in just a month and a half ago. we also just heard from congresswoman marjorie taylor greene, who told me she never votes foresee, are making it clear she is a no on this one as well. tuesday could be the earliest we could see a vote on the house floor, big question if johnson can get 2 to 17 with just republicans, or whether he's going to have to work across the aisle and get some democrats to join him as well. >> -- matt underlines voters contemplate which parties should control government when they head to the ballot box next year. in just a reminder of the whiplash nature of american politics. democrats made a strong showing tuesday for off-year elections in ohio. a solid run, state voters and trying to vote to abortion access into the states institution. democratic -- reelected and a beshear, and in virginia democrats on both chambers of the state's general assembly. this all comes nearly 18 months after the supreme court overturned roe v. wade. as tuesday, shows that ruling is still reshaping elections. while democrats celebrate these hard-fought victory, is the slate of new polling paints a different picture for the race of the white house. just days before tuesday's election, a new york times poll found donald trump leading president biden and five out of six battleground states, in a hypothetical rematch. of that, pulling the new yorker writes this, quote, whichever individual polling you choose to believe or not, need at a point overwhelmingly to biden sitting at near historic lows in popularity remain essentially tied with trump. a man was running on an explicit platform of revenge, retribution, and constitution termination. it is not just congressman, i want to start with you and this funding fight. we are hearing skepticism from the white house, they are calling this unserious. you also had far-right republican saying this is a no go. tell me, where do you think this is all going? >> alicia, welcome speaker johnson to the wacky world of managing the house republican conference. it squeezes on. democrats are not going to support his plan. extreme right wing republicans are starting to oppose this plan. and some of the centrist members i have already heard from expressing doubts about setting up multiple cliffs. the last thing the government needs in washington d.c., alicia, the last thing the congress needs is more cliffs. some of the conservative members in the house republican conference want to use those clips as leverage, but we all know how those and sometimes. congress and the falling off those cliffs, and government shuts down. so put on your seatbelts the next few days are going to be turbulent. >> here is the thing. we often talk about how the gop caucus is uncomfortable. you have one republican member saying she's described some self could not get this caucus its act together, which seemed pretty on point that is not just politics. it is not just in the house. in this point we are talking about people who rely on government benefits, not being able to access the benefits they need that they pay into. because, a cohort of republicans who are not serious about governing. they were not serious about doing the very basic of their duties and make sure the government was funded into the new year. >> alicia, you touched on it there. fundamentally, the point, yes the republican party is now in control of the congress of the house. it cannot govern, it is ungovernable, it is not just a cliché. it is true. i think you almost have to pull the layer back, because the one thing they said they could do, at least electorally, was when elections. we keep seeing these 2020 results, all the way into 22, back into 2018, they are on a losing streak at the ballot box themselves. so when you ask the question, what can this republican party do of today do? i'm not sure there is much. that is also the reason why, as you heard congressman say at the outset, the onus here on passing and making sure this government does not go into a shutdown is on the republican party. they have set the situation up where they will appropriately bear all the blame and responsibility. it is not up to the democrats to bail them out. the need to put together and present a responsible bill that will fund the government and all of the services that so many millions of americans are counting on. if they, don't they are facing electoral apocalypse more than experience in 2024. >> part of the reason i did not allow you to have a weekend office because last week and i invited you into the program, we talked on air together as those voting numbers came out. you said to me, listen, these are not the numbers you want. it is also more complex, and part of the reason the campaign has to get started today. one of the reasons i wanted you to come back and have this conversation with, us is i want you to help me square the polling numbers you are seeing from others, and what we saw this weekend of multiple states, adding the element of complexity during these off cycle elections, it is not the same electorate you're going to see come in november. >> well, take it from this pollster. this is going to sound strange. through all the polls out the window. i really do not believe the polls mean anything right now. and not until we really get into the post convention period will that be the case. if you want to look at indicators of future performance, look at these election results. in election after election, with a special election, mid term, elections or presidential elections dating back to 2020 and before, democrats are performing where they need to. not what i will say is this. one thing i discovered in the early part of 2022, is despite president biden's low approval rating, his lower popularity, voters are saying in spite of all of those things given the opportunity, i am still going to vote for the democrats in the face of this extreme authoritarian project which the republican party represents, and even more so anna o'donnell trump domination and 2024. that does not mean they should rest on their laurels, everything is, fine because it does not. as they said last, week these are running, signs they need to react accordingly. but they shouldn't do more gloom based on the levers right now. >> the pollster who tells you do not believe the post you are self sabotaging her own business in the name of democracy. thank you for that, fernando. carlos, i do wonder, i get the point that there is a question around reproductive rights, and the extent to which that is motivating specifically as an isolated issue not seen and the global context of the economy, and other things that will drive voters to the polls. i still have to wonder, if republicans watch what happened this week, and said this is not a winner for, us and is now and we know the way we thought it was a winner. in multiple contacts, including this authoritarian within the republican party, this issue is feeding into this idea that we are not where other americans are. so, we know how democrats felt this week with elections are a national republican, saying going into 2020, for this is not a win it without -- >> alicia, they are really waking up to that reality after so many losses. you heard nikki haley especially at that last nbc news republican debate, really dancing around the issue, talking about how they don't think about the issue the way she, does state rights have to be respected. donald trump has openly criticized people like ron desantis who signed a six-week ban in the state of florida. people ask me, have republicans gone too far? are the worried about it? of course the answer is yes when donald trump the front runner, and in the republican primary is openly attacking other republicans for being too restrictive for the comes to the abortion issue. so, yes there is a lot of peril in the future for republicans on abortion. but, democrats can't just rely on that. joe biden summers are low. that is keeping republicans in the game. >> i want to ask you, this reporting with the new york times, trump advisor stephen miller outlining trump's plans for immigration if trump were to bring back the white house, the times reporting, quote, trump wants to revive his first tour border policies, including banning entry from certain muslim majority nations, scouring the country for unauthorized immigrants, and deport people by the millions per year to ease the strain on detention faciliti. he wants to build huge camps to detain people while their cases are processed and they avoid deportation. rematch that with the reporting of how he wants to go out, use the doj to go after his political rivals. he is telling us what his vision for this country is. and if you can believe, it it is even darker than what he sold to americans during his first term. i wonder who you believe he is trying to appeal to with this message. >> first of all, i believe him. believe donald trump. what he is telling you, -- let's obviously the disgusting ridiculous offensive notion that had round up and the immigrants that's going to, country and language that sounds of a george orwell novel, a son bad enough. think about what it would mean, and how quickly the mechanism of a rounding up of police could be, and how quickly that could be applied to the next type of -- is a undesirable political opponents? well donald trump is -- the department of justice, other entities to go after political opponents. so this idea of going across the country, rounding up undesirable, you can insert whatever category of what the enemies list of the trump administration would be, he won in 2020, four and believe him when he says he's going to employment, that because if he does he will. >> i want to ask, you, carlos beef island, you go you mentioned nikki haley. the pivot the softening on abortion. i wonder, if you know the story in that last debate she is still very reluctant to take shots at donald trump. that is one pivot she is not willing to make. what do you make of it if you think it is strategically sound? >> well, felicia, i think nikki haley has seen a couple models. ron desantis tried to follow dawn on trump to the nomination, electrical to defeat someone when you are imitating them. people like chris christie and others are struggling, because they have taken the full trump lane. nikki haley is trying to go around on trump. it is interesting. typically, if you want to defeat someone, you can go right at them, but this is a weird time in the republican primary. so, nikki haley is trying to finish this and go around donald trump. maybe it works out for her. but at the end of the day, every candidate, every republican is going to have to say the truth about what they think about donald trump, his election, lies and his entire record. so she might be able to avoid it for a while, but at some point, she is going to have to trust these issues. >> it is a weird, time may be the understatement of an israeli tanks surrounded and attacked one hospital. it comes after an explosion cut off power at gaza's al-shifa hospital. affecting the pediatric intensive care facilities. today, the palestinian health ministry said at least two -- because of the power outage. doctors without borders called for the media to cease fire after the mob argument, nbc's -- most starting guys, that what we know about both hospitals and the situation tonight. >> you mentioned there, premature babies dying. we are hearing from the director of the hospital saying that 39 babies were in incubators, therefore relying on power to oxygen 80s incubators. they were removed from those incubators, and placed in a room where they were swaddled, and keep the manually warm, and -- two of the 39 unfortunately lost their lives. we understand there are very limited treatment options now, at, al-shifa hospital an other hospitals in northern gaza, where many medical facilities are completely out of commission. there are few power points and some of the hospitals that are being used, for really just the most when she drastic, the most medically necessary interventions. this is all happening against the backdrop of this mass displacement of people in the northern part of gaza to the south. israeli military has time and again said, people need to move. now this important to note the of hospital is not able to disconnect people from life support and move them, and still six or 700 patients there. we did hear from our team on the ground, who sent us a video of a man who was making his way south, down right. i can't move. we could not move. we could not do anything. when you were so tired after we passed the bridge, the gaza ridge. >> well, also, it is important to note the chief hospital among others is struggling to bury its dead. they have nowhere to put them. they cannot get excavating material to even dig a mass grave. so oftentimes, they are leaving bodies where they lay, where they have passed away. so it is a really dire situation. it is only getting worse according to the medical authorities on the ground, alicia. >> prime minister benjamin netanyahu has -- >> well, once again, saying that the security situation, the security control over gaza will remain in israel's hands. this is something we heard from a few days ago. now this is a message that is really very differently depending on what side of this conflict you are on. as far as israelis are concerned, many of them might say if this is necessary, that will allow us to be protected from hamas rockets. as far as palestinians, especially those displaced from the north of gaza are concerned, this means the displacement might once again be a permanent one. i have heard, from and spoken over the last several weeks that have been, here to senior palestinian officials in the west bank who have told me their biggest concern is that the security more buffer zone, or whatever the israeli military a government call, it will end up just becoming a permanent fixture, and will be annexed to the state of israel. that is one of their biggest worries right now. but benjamin netanyahu repeated once again, in his speech once again this evening, alicia. >> thank you. in london, demonstrators took to the streets today calling for any immediate cease-fire in gaza. police arrested at least 150 protesters in 82 counter protesters nearby. nbc's -- has more from london. >> we are talking hundreds of thousands of people who are backing the streets here in london, and this is the fifth consecutive weekend of a pro palestinian demonstration, but this is the largest. we have been speaking with people all throughout the day, here there are folks with no connection to the middle east, others who, do and -- take a listen to what some folks had to say. >> i spent most of my life working, there has a u.s. diplomat, i'm really horrified in this aboard for this really brutal attack on civilians and palestine. >> over the last few, weeks it has become hard to -- coming from gaza, and claim ignorance and an action is -- you have to at the end of the day, it is just -- >> because of hearing in march. for now, trump's quartet in florida is set for may 20th 2024. look at that calendar. that is five months before the presidential election. joining us to discuss, msnbc legal analyst paul, butler he is a georgetown law professor, and former federal prosecutor. thank you so much for being here. help us make sense of this timeline. what do you make of it? >> so judge cannon said no to trump's request to delay the trial, but it looked like no for right, now feel free to be up in -- my just say yes, but the judge said she understands it is not just donald trump who has the right to a speedy trial, the public also has that right. that is true. so the judge left the door open to delay the trial leader. she said there is an unusually high volume of evidence, and she knows that trump has criminal trial scheduled in december, or scheduled in d.c. and new york. he also has to prepare for. but i do think that the judges slow walking this, case for example she had a motion to delay the trial on september 22nd, and she did not decide that motion until yesterday. she was supposed to file the main -- last week. but he judge gave them an extension until february 22nd of next year. she is not acting like a judge who is trying to move a case long. >> well i think there may be some subtext to what you are saying. so -- is of course a trump appointee, other previous rulings she has favored him overturning an appeal. there have been these two core questions with aileen cannon, one a question of core competencies around this area of judicial review, and secondarily of whether or not a trump appointee she is backed by -- i wonder if what we have seen has been from other question. >> now she has a possible reason for delaying the, trial in that there are a number of motions, and the evidence is how to look, at some of it has to be viewed in a secure facility. what i am going to be interested in is july 15th, that is when the republican national convention starts. if trump wins the nomination, the campaign would go until -- and a crimina trial of the defendant has to be in court every day. so i don't know if judge cannon would actually acknowledge that trump's campaign is a reason to postpone theial till after the election, butshe would -- need to see election interference child has been very clear, she's treating trump like every other defendant that does not matter, but again -- has shown a lot more difference to -- >> need a job. hearing running for president as the day, job it will never grow old to me. trump, he is joined and we see, pushing for cameras at his d.c. election interference, i just have to note what you -- >> that he knows it is not going to happen. so news organizations are appealing to the judicial conference, the judicial conference has already said it does not have the power to allow cameras in the courtroom. it is the organization that makes policy for federal court. even if it wanted to make a, change or an exception for the president, it would have to go through the normal process. so there is no way that is going to happen in time before the election interference trial. trump knows that. i don't think there is any way he wants all of the evidence -- has a symbol for the public. especially, that trial scheduled to start the day after, for the day prior. >> every time we bring up the calendar, i'm minded there is truly something happening ever day. so let's talk abou what is happening. trump's trial resumes, you have john junior back to testify, i wonder what you expect from the defenses monthlong case? >> so the state was the defense started -- with don jr.. so the defense that trump's adult sons are using, is that they got dragged into the middle of a fight between their dad and letitia james. and they are saying, they relied on the accountants and lawyers who filed the financial statements that the judge says are fraudulent. the problem with that defense is that both don junior and -- eric signed documents saying they were responsible for the preparation of the financial statements. the former president also signed those statements, which the judge has ruled were, out of business. they would be out. they would be out of the election. >> joining me now, former deputy assistant attorney general lisa gray. i want to know, both what you make of trump's threats to use at the doj for political retribution, but also the first part of his answer where he is accusing the current administration of doing the same once again without any evidence. >> he is certainly lying yet again. this is -- he is trying to create. the justice department under merrick garland has followed the rules, cuts, corners and is not engaged in any political retribution. it has pursued the facts as they have found them. as have the other attorneys in other jurisdictions like georgia and new york. i think that what he said is just chilling and frightening, and utterly inappropriate for a new candidate, for presidency in the united states. it was my -- as a deputy general to come to work at the justice department, and walk through those aluminum doors where it was engraved in place of justice is a -- think of the type of men and people he surrounded himself, people indicted like john eastman, jeffrey clark, frequent fliers the federal society. frequent contributors who have been indicted because of their willingness to aid him in his political agenda, to overturn the election and -- simply chilling and completely outrageous and inappropriate. >> as you call it chilling, it brings to question, we always circle back to, are the guardrails in place in order to protect this country from him making good on that promise? >> i am concerned very much because of the number of judges donald trump put on the federal courts, including the u.s. supreme court, how politicized it has become. the trump faction has been leaning our judicial system down a very dark path, in terms of its willingness to set aside the president. these, rules these understandings, and policies about non intervention, about the president not dictating political retribution through the justice department, or the fbi, these are vital rules for the health of our democracy, i'm not sure that we have confidence that the -- trump has chosen one of those rules. i hope as we saw in his presidency that judges would stand up and defend the rule of law, but he has chosen a number of people who seem very willing to set aside long-standing presidents that american rely upon. so i'm worried we don't have the guardrails in place. >> i would argue that there is compounded dangers, dual dangerous in what he laid out in that interview. there is both the danger of his promise to use a doj to go after political enemies, and i'm equally concerned by the first part of what he, said which is this lie that he is continuing to sell to his supporters, to the american people, that this is already -- we often talk about the ways in which he -- underlying norms the way in which there was a devaluation of american institutions. the lie, once it is repeated a certain number of times, and not debunked as you did so succinctly at the beginning of your first answer, it festers and becomes it would seem to me to be part of his intent in saying that interview. >> alicia, i agree with you completely, this is a very dangerous lie. a fiction that he's trying to create. it comes in the aftermath of him seeking to embrace these chances of -- lock her up around hillary clinton. his efforts to redirect foreign policy to basically attack biden while he was in the white house. and, so i just think it is extraordinarily dangerous, extraordinarily chilling, and it is also just very disappointing that people who probably went along with those chants when he was indicating his intent to politicize the justice department would now somehow claim, or embraces notion that the justice department under biden has left the genie out of the bottle. it is just a lie. but it is an extraordinarily dangerous lie for democracy. it is extremely dangerous life or someone who is the front runner in the presidency next year. >> i have less than a minute left, but i want to ask you to know tim, interview trump defended family separation, saying if immigrant families nor they will be separated, they will come family separation in addition to being critically damaging for migrants affected. also, a host of legal problems as, well from the doj vantage, point out about 30 seconds, pass a new funding bill. just hours ago, the new house speaker, mike johnston, unveiled his plan to keep the government funded. it is a two-step approach, putting some parts of the government until january, there is still february. this new plan does not include spending cuts nor additional military aid to israel. >> this untested strategy also serves as a major first test for speaker johnson, who has limited experience and battles. already getting pushback from his own caucus, congressman -- saying today, quote, it has a 100% clean and i 100% opposed. nbc news confirms roy is now one of three republicans to already say no deal. in the meantime, the white house is calling the spawn a, quote, recipe for more republican chaos, and more shutdowns. in a new statement, press secretary -- added house republicans are wasting precious time with an un-serious proposal that has been panned by members of both parties. nbc news capitol hill correspondent has more. >> hi, alicia, six days ahead of next friday's government shutdown deadline, we finally have a plan from house speaker mike johnson and how he wants to overt that shut down that line. you talked about it with his colleagues, republicans on the phone call a couple hours ago laying this out. he is calling it a two-step continuing resolution that is because on january 19th half of the agencies will run out of funding, then on february 2nd other agencies will run out of funding. it is really an untested situation. democrats certainly not in favor, have it in fact a couple moments after this plan was, revealed senator ryan -- appropriations committee had posted on next, saying quote, we are going to pass a clean short term deal, the question is whether we will do it -- like adults. now this plan is clean, meaning there are no spending cuts in this bill, that is something that was a red line for democrats. house democratic leader hakeem jeffries at the end of this week told me that the only think they will accept is a -- concurrent levels. and they were under leader schumer, speaker pelosi, and it is something that democrats were very serious about. a couple of minutes we actually heard from a senior democratic aide, who, said they are glad, it is a good, think, quote the speaker did not include unnecessary, cuts and kept defense bonding with a second round of programs. now we are hearing from some republicans who aren't thrilled about this. a hard line conservatives talk about someone like -- on the call with republicans will still happening, that he is a no on this plan. it does include budget cuts. certainly slamming speaker johnson, and it sounds like he is -- speaker mccarthy found himself in just a month and a half ago. we also just heard from congresswoman marjorie taylor greene, who told me she never votes foresee, are making it clear she is a no on this one as well. tuesday could be the earliest we could see a vote on the house floor, big question if johnson can get 2 to 17 with just republicans, or whether he's going to have to work across the aisle and get some democrats to join him as well. >> -- matt underlines voters contemplate which parties should control government when they head to the ballot box next year. in just a reminder of the whiplash nature of american politics. democrats made a strong showing tuesday for off-year elections in ohio. a solid run, state voters and trying to vote to abortion access into the states institution. democratic -- reelected and a beshear, and in virginia democrats on both chambers of the state's general assembly. this all comes nearly 18 months after the supreme court overturned roe v. wade. as tuesday, shows that ruling is still reshaping elections. while democrats celebrate these hard-fought victory, is the slate of new polling paints a different picture for the race of the white house. just days before tuesday's election, a new york times poll found donald trump leading president biden and five out of six battleground states, in a hypothetical rematch. of that, pulling the new yorker writes this, quote, whichever individual polling you choose to believe or not, need at a point overwhelmingly to biden sitting at near historic lows in popularity remain essentially tied with trump. a man was running on an explicit platform of revenge, retribution, and constitution termination. it is not just revenge being found inside the plan to govern should he be -- reporting for the new york times dives into trump's new plans for -- crackdowns on illegal immigration, building camps to prepare for mass deportations. as we so often say on this show, -- is the point. joining me now, president of the -- former florida congressman carlos, both are msnbc political analyst. it is good to see you both. congressman, i want to start with you and this funding fight. we are hearing skepticism from the white house, they are calling this unserious. you also had far-right republican saying this is a no go. tell me, where do you think this is all going? >> alicia, welcome speaker johnson to the wacky world of managing the house republican conference. it squeezes on. democrats are not going to support his plan. extreme right wing republicans are starting to oppose this plan. and some of the centrist members i have already heard from expressing doubts about setting up multiple cliffs. the last thing the government needs in washington d.c., alicia, the last thing the congress needs is more cliffs. some of the conservative members in the house republican conference want to use those clips as leverage, but we all know how those and sometimes. congress and the falling off those cliffs, and government shuts down. so put on your seatbelts the next few days are going to be turbulent. >> here is the thing. we often talk about how the gop caucus is uncomfortable. you have one republican member saying she's described some self could not get this caucus its act together, which seemed pretty on point that is not just politics. it is not just in the house. in this point we are talking about people who rely on government benefits, not being able to access the benefits they need that they pay into. because, a cohort of republicans who are not serious about governing. they were not serious about doing the very basic of their duties and make sure the government was funded into the new year. >> alicia, you touched on it there. fundamentally, the point, yes the republican party is now in control of the congress of the house. it cannot govern, it is ungovernable, it is not just a cliché. it is true. i think you almost have to pull the layer back, because the one thing they said they could do, at least electorally, was when elections. we keep seeing these 2020 results, all the way into 22, back into 2018, they are on a losing streak at the ballot box themselves. so when you ask the question, what can this republican party do of today do? i'm not sure there is much. that is also the reason why, as you heard congressman say at the outset, the onus here on passing and making sure this government does not go into a shutdown is on the republican party. they have set the situation up where they will appropriately bear all the blame and responsibility. it is not up to the democrats to bail them out. the need to put together and present a responsible bill that will fund the government and all of the services that so many millions of americans are counting on. if they, don't they are facing electoral apocalypse more than experience in 2024. >> part of the reason i did not allow you to have a weekend office because last week and i invited you into the program, we talked on air together as those voting numbers came out. you said to me, listen, these are not the numbers you want. it is also more complex, and part of the reason the campaign has to get started today. one of the reasons i wanted you to come back and have this conversation with, us is i want you to help me square the polling numbers you are seeing from others, and what we saw this weekend of multiple states, adding the element of complexity during these off cycle elections, it is not the same electorate you're going to see come in november. >> well, take it from this pollster. this is going to sound strange. through all the polls out the window. i really do not believe the polls mean anything right now. and not until we really get into the post convention period will that be the case. if you want to look at indicators of future performance, look at these election results. in election after election, with a special election, mid term, elections or presidential elections dating back to 2020 and before, democrats are performing where they need to. not what i will say is this. one thing i discovered in the early part of 2022, is despite president biden's low approval rating, his lower popularity, voters are saying in spite of all of those things given the opportunity, i am still going to vote for the democrats in the face of this extreme authoritarian project which the republican party represents, and even more so anna o'donnell trump domination and 2024. that does not mean they should rest on their laurels, everything is, fine because it does not. as they said last, week these are running, signs they need to react accordingly. but they shouldn't do more gloom based on the levers right now. >> the pollster who tells you do not believe the post you are self sabotaging her own business in the name of democracy. thank you for that, fernando. carlos, i do wonder, i get the point that there is a question around reproductive rights, and the extent to which that is motivating specifically as an isolated issue not seen and the global context of the economy, and other things that will drive voters to the polls. i still have to wonder, if republicans watch what happened this week, and said this is not a winner for, us and is now and we know the way we thought it was a winner. in multiple contacts, including this authoritarian within the republican party, this issue is feeding into this idea that we are not where other americans are. so, we know how democrats felt this week with elections are a national republican, saying going into 2020, for this is not a win it without -- >> alicia, they are really waking up to that reality after so many losses. you heard nikki haley especially at that last nbc news republican debate, really dancing around the issue, talking about how they don't think about the issue the way she, does state rights have to be respected. donald trump has openly criticized people like ron desantis who signed a six-week ban in the state of florida. people ask me, have republicans gone too far? are the worried about it? of course the answer is yes when donald trump the front runner, and in the republican primary is openly attacking other republicans for being too restrictive for the comes to the abortion issue. so, yes there is a lot of peril in the future for republicans on abortion. but, democrats can't just rely on that. joe biden summers are low. that is keeping republicans in the game. >> i want to ask you, this reporting with the new york times, trump advisor stephen miller outlining trump's plans for immigration if trump were to bring back the white house, the times reporting, quote, trump wants to revive his first tour border policies, including banning entry from certain muslim majority nations, scouring the country for unauthorized immigrants, and deport people by the millions per year to ease the strain on detention faciliti. he wants to build huge camps to detain people while their cases are processed and they avoid deportation. rematch that with the reporting of how he wants to go out, use the doj to go after his political rivals. he is telling us what his vision for this country is. and if you can believe, it it is even darker than what he sold to americans during his first term. i wonder who you believe he is trying to appeal to with this message. >> first of all, i believe him. believe donald trump. what he is telling you, -- let's obviously the disgusting ridiculous offensive notion that had round up and the immigrants that's going to, country and language that sounds of a george orwell novel, a son bad enough. think about what it would mean, and how quickly the mechanism of a rounding up of police could be, and how quickly that could be applied to the next type of -- is a undesirable political opponents? well donald trump is -- the department of justice, other entities to go after political opponents. so this idea of going across the country, rounding up undesirable, you can insert whatever category of what the enemies list of the trump administration would be, he won in 2020, four and believe him when he says he's going to employment, that because if he does he will. >> i want to ask, you, carlos beef island, you go you mentioned nikki haley. the pivot the softening on abortion. i wonder, if you know the story in that last debate she is still very reluctant to take shots at donald trump. that is one pivot she is not willing to make. what do you make of it if you think it is strategically sound? >> well, felicia, i think nikki haley has seen a couple models. ron desantis tried to follow dawn on trump to the nomination, electrical to defeat someone when you are imitating them. people like chris christie and others are struggling, because they have taken the full trump lane. nikki haley is trying to go around on trump. it is interesting. typically, if you want to defeat someone, you can go right at them, but this is a weird time in the republican primary. so, nikki haley is trying to finish this and go around donald trump. maybe it works out for her. but at the end of the day, every candidate, every republican is going to have to say the truth about what they think about donald trump, his election, lies and his entire record. so she might be able to avoid it for a while, but at some point, she is going to have to trust these issues. >> it is a weird, time may be the understatement of an israeli tanks surrounded and attacked one hospital. it comes after an explosion cut off power at gaza's al-shifa hospital. affecting the pediatric intensive care facilities. today, the palestinian health ministry said at least two -- because of the power outage. doctors without borders called for the media to cease fire after the mob argument, nbc's -- most starting guys, that what we know about both hospitals and the situation tonight. >> you mentioned there, premature babies dying. we are hearing from the director of the hospital saying that 39 babies were in incubators, therefore relying on power to oxygen 80s incubators. they were removed from those incubators, and placed in a room where they were swaddled, and keep the manually warm, and -- two of the 39 unfortunately lost their lives. we understand there are very limited treatment options now, at, al-shifa hospital an other hospitals in northern gaza, where many medical facilities are completely out of commission. there are few power points and some of the hospitals that are being used, for really just the most when she drastic, the most medically necessary interventions. this is all happening against the backdrop of this mass displacement of people in the northern part of gaza to the south. israeli military has time and again said, people need to move. now this important to note the of hospital is not able to disconnect people from life support and move them, and still six or 700 patients there. we did hear from our team on the ground, who sent us a video of a man who was making his way south, down the gaza strip, describing what he saw along the way. listen. >> we saw limbs, bodies thrown, left and right. but we can't do anything. when we saw the -- people, the children, they were left and right. i can't move. we could not move. we could not do anything. when you were so tired after we passed the bridge, the gaza ridge. >> well, also, it is important to note the chief hospital among others is struggling to bury its dead. they have nowhere to put them. they cannot get excavating material to even dig a mass grave. so oftentimes, they are leaving bodies where they lay, where they have passed away. so it is a really dire situation. it is only getting worse according to the medical authorities on the ground, alicia. >> prime minister benjamin netanyahu has -- >> well, once again, saying that the security situation, the security control over gaza will remain in israel's hands. this is something we heard from a few days ago. now this is a message that is really very differently depending on what side of this conflict you are on. as far as israelis are concerned, many of them might say if this is necessary, that will allow us to be protected from hamas rockets. as far as palestinians, especially those displaced from the north of gaza are concerned, this means the displacement might once again be a permanent one. i have heard, from and spoken over the last several weeks that have been, here to senior palestinian officials in the west bank who have told me their biggest concern is that the security more buffer zone, or whatever the israeli military a government call, it will end up just becoming a permanent fixture, and will be annexed to the state of israel. that is one of their biggest worries right now. but benjamin netanyahu repeated once again, in his speech once again this evening, alicia. >> thank you. in london, demonstrators took to the streets today calling for any immediate cease-fire in gaza. police arrested at least 150 protesters in 82 counter protesters nearby. nbc's -- has more from london. >> we are talking hundreds of thousands of people who are backing the streets here in london, and this is the fifth consecutive weekend of a pro palestinian demonstration, but this is the largest. we have been speaking with people all throughout the day, here there are folks with no connection to the middle east, others who, do and -- take a listen to what some folks had to say. >> i spent most of my life working, there has a u.s. diplomat, i'm really horrified in this aboard for this really brutal attack on civilians and palestine. >> over the last few, weeks it has become hard to -- coming from gaza, and claim ignorance and an action is -- you have to at the end of the day, it is just -- >> because of the innocent children and parents that are dying, they are having to carry on with -- -- a police have been very concerned about violence, so they have doubled their presence in the, street and they judge cannon denied trump's request to postpone the mar-a-lago trial, but she did extend several deadlines for submitting discovery materials. cannon also said she will reconsider the trial date at a hearing in march. for now, trump's quartet in florida is set for may 20th 2024. look at that calendar. that is five months before the presidential election. joining us to discuss, msnbc legal analyst paul, butler he is a georgetown law professor, and former federal prosecutor. thank you so much for being here. help us make sense of this timeline. what do you make of it? >> so judge cannon said no to trump's request to delay the trial, but it looked like no for right, now feel free to be up in -- my just say yes, but the judge said she understands it is not just donald trump who has the right to a speedy trial, the public also has that right. that is true. so the judge left the door open to delay the trial leader. she said there is an unusually high volume of evidence, and she knows that trump has criminal trial scheduled in december, or scheduled in d.c. and new york. he also has to prepare for. but i do think that the judges slow walking this, case for example she had a motion to delay the trial on september 22nd, and she did not decide that motion until yesterday. she was supposed to file the main -- last week. but he judge gave them an extension until february 22nd of next year. she is not acting like a judge who is trying to move a case long. >> well i think there may be some subtext to what you are saying. so -- is of course a trump appointee, other previous rulings she has favored him overturning an appeal. there have been these two core questions with aileen cannon, one a question of core competencies around this area of judicial review, and secondarily of whether or not a trump appointee she is backed by -- i wonder if what we have seen has been from other question. >> now she has a possible reason for delaying the, trial in that there are a number of motions, and the evidence is how to look, at some of it has to be viewed in a secure facility. what i am going to be interested in is july 15th, that is when the republican national convention starts. if trump wins the nomination, the campaign would go until -- and a crimina trial of the defendant has to be in court every day. so i don't know if judge cannon would actually acknowledge that trump's campaign is a reason to postpone theial till after the election, butshe would -- need to see election interference child has been very clear, she's treating trump like every other defendant that does not matter, but again -- has shown a lot more difference to -- >> need a job. hearing running for president as the day, job it will never grow old to me. trump, he is joined and we see, pushing for cameras at his d.c. election interference, i just have to note what you -- >> that he knows it is not going to happen. so news organizations are appealing to the judicial conference, the judicial conference has already said it does not have the power to allow cameras in the courtroom. it is the organization that makes policy for federal court. even if it wanted to make a, change or an exception for the president, it would have to go through the normal process. so there is no way that is going to happen in time before the election interference trial. trump knows that. i don't think there is any way he wants all of the evidence -- has a symbol for the public. especially, that trial scheduled to start the day after, for the day prior. >> every time we bring up the calendar, i'm minded there is truly something happening ever day. so let's talk abou what is happening. trump's trial resumes, you have john junior back to testify, i wonder what you expect from the defenses monthlong case? >> so the state was the defense started -- with don jr.. so the defense that trump's adult sons are using, is that they got dragged into the middle of a fight between their dad and letitia james. and they are saying, they relied on the accountants and lawyers who filed the financial statements that the judge says are fraudulent. the problem with that defense is that both don junior and -- eric signed documents saying they were responsible for the preparation of the financial statements. the former president also signed those statements, which the judge has ruled were, out of business. they would be out. they would be out of the election. >> joining me now, former deputy assistant attorney general lisa gray. i want to know, both what you make of trump's threats to use at the doj for political retribution, but also the first part of his answer where he is accusing the current administration of doing the same once again without any evidence. >> he is certainly lying yet again. this is -- he is trying to create. the justice department under merrick garland has followed the rules, cuts, corners and is not engaged in any political retribution. it has pursued the facts as they have found them. as have the other attorneys in other jurisdictions like georgia and new york. i think that what he said is just chilling and frightening, and utterly inappropriate for a new candidate, for presidency in the united states. it was my -- as a deputy general to come to work at the justice department, and walk through those aluminum doors where it was engraved in place of justice is a -- think of the type of men and people he surrounded himself, people indicted like john eastman, jeffrey clark, frequent fliers the federal society. frequent contributors who have been indicted because of their willingness to aid him in his political agenda, to overturn the election and -- simply chilling and completely outrageous and inappropriate. >> as you call it chilling, it brings to question, we always circle back to, are the guardrails in place in order to protect this country from him making good on that promise? >> i am concerned very much because of the number of judges donald trump put on the federal courts, including the u.s. supreme court, how politicized it has become. the trump faction has been leaning our judicial system down a very dark path, in terms of its willingness to set aside the president. these, rules these understandings, and policies about non intervention, about the president not dictating political retribution through the justice department, or the fbi, these are vital rules for the health of our democracy, i'm not sure that we have confidence that the -- trump has chosen one of those rules. i hope as we saw in his presidency that judges would stand up and defend the rule of law, but he has chosen a number of people who seem very willing to set aside long-standing presidents that american rely upon. so i'm worried we don't have the guardrails in place. >> i would argue that there is compounded dangers, dual dangerous in what he laid out in that interview. there is both the danger of his promise to use a doj to go after political enemies, and i'm equally concerned by the first part of what he, said which is this lie that he is continuing to sell to his supporters, to the american people, that this is already -- we often talk about the ways in which he -- underlying norms the way in which there was a devaluation of american institutions. the lie, once it is repeated a certain number of times, and not debunked as you did so succinctly at the beginning of your first answer, it festers and becomes it would seem to me to be part of his intent in saying that interview. >> alicia, i agree with you completely, this is a very dangerous lie. a fiction that he's trying to create. it comes in the aftermath of him seeking to embrace these chances of -- lock her up around hillary clinton. his efforts to redirect foreign policy to basically attack biden while he was in the white house. and, so i just think it is extraordinarily dangerous, extraordinarily chilling, and it is also just very disappointing that people who probably went along with those chants when he was indicating his intent to politicize the justice department would now somehow claim, or embraces notion that the justice department under biden has left the genie out of the bottle. it is just a lie. but it is an extraordinarily dangerous lie for democracy. it is extremely dangerous life or someone who is the front runner in the presidency next year. >> i have less than a minute left, but i want to ask you to know tim, interview trump defended family separation, saying if immigrant families nor they will be separated, they will come family separation in addition to being critically damaging for migrants affected. also, a host of legal problems as, well from the doj vantage, point out about 30 seconds,
