>> totally. she killed him. >> i was defending my family. and that is all i can keep thinking about. ♪ ♪ ♪ >> twilight, in an eye or roy farming town. darkness is in the windows of a victorian house. downstairs in the kitchen, a crock pot is simmering. upstairs, a young mother runs a bat for her baby daughter. her two older sons huddle by a tv in the bedroom down the hall. suddenly, they hear a shout. their mother's cry for help. >> all of a sudden, you can hear her yelling. and then i can hear her yelling towards the door. and i'm standing there, like what is going on? >> 11 years old, he sees his mother running towards him. >> she's in the door jam, trying to get in. i can see her getting yanked back by her hair. >> the mother flings the baby into the suns arms, and slams the door shut behind her. >> i can hear, just rustling around. moving around. and her yelling for help again. and then it was, the sound of her being choked. >> nearly 20 years on, the truth or that happened that december night. of what an 11 year old boy says that he heard, then saw. still haunts the town of early, iowa. a crime, sudden, vicious, inexplicable. and it's link? the fear. >> i was afraid for myself, i was afraid for my family. >> the pain. >> incidentally, we felt alone, lost, confused. >> and the unanswered questions. just what had happened on that frigid night? >> liar is a tough word in american culture. do you think the kids a liar? >> absolutely! >> the spasm of violence in an unexpected place, happened here at the self proclaimed, crossroads of the nation. early, iowa. population vibe hundreds stance on the junction of two highways. and most people drive right on through. but in 1998, two strangers rolled into town from chicago. tracey ann and michael roberts. >> they came off as, they were from chicago, he's from australia. >> seems to be a nice family? >> yeah. >> local realtor, mona, said that she heard the bustle about the big city transplants. second marriage for both of them. michael was a computer expert with plans of investing in the home business. and more. >> michael said he wanted to help the community, we're gonna grow the community, we're gonna build it up. >> tracy kept a lower profile around town. but mary, a farmer's right, got to know him extremely well. >> she was great, she was fun, she was beautiful. she seemed very educated. she was kind of a fun person to be around. >> the tuesday at home mom's car pulled, and shared confidences. sometimes they played hooky when they were trying to be in an aerobics class together. >> we will go to the bar! we would have a beer, she would have a drink, we would sit, their talk, laugh. >> she also met tracy's husband, michael, at church. but as much as she liked her friend, she took an instant dislike to the husband. she thought the entrepreneur seemed full of himself. >> he was a huge bragger. he would brag about everything he had, and what he was gonna get. and tracey would look at him and tell him, don't do that. but, he would. >> someone not put off by the swagger was the realtor, mona. >> i help them buy and sell several homes. >> she was impressed by michael 's go getter attitude and his strong, religious convictions. >> did you regard them as friends? personal friends? >> i would've done anything to help them, or system. >> the feeling was mutual. michael seemed eager to help mona to. for instance, when she told him her 20-year-old son dustin was drifting. struggling to hold down a job, and with his parents. michael made an offer. >> he said, you know, i can take him under my wing. and mentor him a little bit. and see if i can get him off on a good path. and it just seemed so sincere about it. and i'm like, really? wow. that is special. okay. >> which is why what happened on december 13th, 2001, and the identity of who had been inside the roberts home, surprised everyone the way that it did. no light spilled from the windows of the house where the brutal attack was taking place. inside, 11 year old -- , was frozen. unsure. he had hoped his mother being choked. but now there was silence. he grabbed a baseball bat, and headed his younger brother upend. tell him to use it as a weapon. >> so you're the protector, and you are an 11 years old? >> the only thing i wanted to do was protect them. >> he stood behind a closed-door, clutching the bat, ready to fight back. >> and i was like, the first person to come through here. i'm hitting. going out fighting. i want to try. >> the boy could hear the voices of two men in the hallway. >> they eventually started banging on the door. it felt like they were trying to get in. >> he says he started cursing at the intruders, using every bad word he could think of. >> then i could hear all of a sudden, another set of footsteps. in the upstairs. start running. and then, eventually, i heard. you know. she has a gun. >> and then, the boy heard a series of gunshots. a breathless -- , dialed 9-1-1. >> someone came to my house and tied my mom up. >> but the boy was saying was something like out of a movie. as first for the small town police department. >> early rescue, you are needed that. that michael's residence. i'm not really sure what's going on. >> what had happened inside the roberts home? who is alive? and who was dead? coming up! the picture starts to come together as tracey's mother gets word of the attack. >> he said, they're working on her. that she could not breathe. >> would tracy make it? 20 miles away, tracey's mother was also wondering about her daughter. tracy was late picking her up for her grandson, bert, basketball plastics. then the phone rang. it was her, sobbing. >> she just broke out in tears. and was crying hysterically on the phone, was really hard to understand him. and said that someone was shot in the house. and someone -- >> tracy's mother, hoped in her car and raced down country roads to the house. she says the policeman stopped her from going inside. >> he said, i couldn't go in because it was a crime scene. and i said, i want to see how my daughter, how she is. i'm sorry. and he said, they are working on her. and she couldn't breathe. >> tracey was alive, but she was gasping for breath. paramedics loaded her into the ambulance and took her to the hospital. two hours later, another mother came rushing to what was once the home of a friend, but now a crime scene. >> and there's all these kids, and cars and stuff there. and we go flying through the barricade. >> local realtor, mona, was looking for her son dustin wehde. his car was parked in the driveway of the roberts home, secured now behind crime scene tape. mona said that police officers would not let her near it. >> i looked at them and i said, is my son here? and they go, yes. and i go, is he dead? and they go, yes. >> the body of dustin wehde, the young man being mentored by tracy's husband. it was sprawled on the couples bedroom floor. tracy had shot him, in what appeared to be a desperate act of self-defense. >> did they tell you anything about what happened in that house? >> no. they told us to go home. i said, i want to hold, him and they said you can't. >> 12 miles away at the hospital. tracy was finally safe, and breathing on her own. investigators captured the ugly red choke marks on her neck, and the look of terror in her eyes. what did she endured? tracy said that she couldn't believe it when the police told her, it had been her friend son dustin wehde, who had attacked her. she hadn't been able to make out his face in the dark. what did you think when you had a name attached to this? >> it was so hard. because at that point i heard the worst of it was behind me. and then. >> you killed mona's son? >> yeah. that's who i felt bad about. because i cared about mona. you know? and now? she's lost her son. >> from her hospital bed, tracey told investigators a little bit of what she remembered. how she had been running a bath for her daughter, mason, when she heard sounds at the bottom of the stairs. has they had chased her when she ran to bert room. the baby in her hands. >> bert said i threw mason, i don't remember throwing her. i don't remember. but at some point she was out of my arms, and she was in the room. >> you were trying to get in there with your children? >> yeah. and. i was pulled out. >> that's when one of the man, she said. had started to strangle her with some pantyhose that had been left drying on the banister. >> i was having trouble breathing, and i couldn't get away. and i, i was having trouble even twisting out of it. >> tracy says that she must've passed out, because the next thing that she remembered was waking up on the floor. she could hear bert cursing at the intruders. this was the moment that she knew she had to act to protect her children. she ran for a gun safe next to the bed in the master bedroom. >> i dove into the room. and i just, i went for the safe. >> she could feel dustin and the other man grabbing, her as she tried to open the safe. even so, she managed to punch in the code and open it. she grabbed a handgun, and pointed it over her shoulder. but when she pulled the trigger, nothing happened. the safety was on. >> it was such relief when i got it open. and then, nothing. >> she pulled the trigger again, and this time she says, the gun fired. >> the thing i remember the most is that, it was so loud. and it was so bright. like, the flash from the gun was blinding, really. >> tracy says that she managed to swivel around to face her attacker's. she kept firing. are you hearing the assailant scream? >> i didn't hear anybody scream. >> what she could hear when she stopped shooting, was the sound of someone breathing. and then, sudden footsteps running out of the door. had one of the home invaders fled? tracey inch down the bed, she couldn't see much. the bedroom was hazy with gun smoke. but she heard her kids calling for her, she said. and she ran to bert room. >> i opened the door, and bert almost took my head off with a bat. and i don't remember having a conversation with them. i just remember being so happy that they were fine. >> both of us were on pure adrenaline. just like, trying to just grasp what just happened. you know? are you okay? yeah we're fine. >> tracy said that she shepherded bert and her younger children into the hallway, thinking they were finally safe. but according to both tracy and bert, the nightmare was far from over. the intruder lying on tracey's floor, was still alive. she could see it was dustin wehde, the son of her wife's friend. mona. >> he was on the floor, i could see that there was blood around him. and i could see him start to get up. >> he was moving? >> he started moving. >> was he gonna attack tracy again? >> and i remember, it just put me back into, when is this gonna end? when is it gonna stop? just make it stop. >> tracy says that she ordered the kids back into the bedroom. and before she knew it, she had another gun in her hand. and she fired a warning shot. telling dustin to stay down. >> i could hear her yelling on him to stay on the ground. don't get up, don't get up. and then another shot, and then another. and finally, dustin was still. there was no sign of a second in trudeau. tracy's husband, michael, had been out of state when the breakout occurred. there must have been questions occurring in your brain. how is she? how are the kids? >> there were too many questions. >> reunited with the family, he was puzzled what would happened. >> the story is that this incredibly brave mama bear is protecting her cubs, against these two home invaders? >> it was incredible. i was proud of her. they are my heroes. >> but he said he could not understand why dustin wehde, a kid he taking under his wing, had apparently turned on him. breaking into his house, attacking his wife and children? that night, michael spoke to dustin wehde mother on the phone. >> mona called me. apologized, and asked me to tell tracey that she loves her. >> she believed her son was in the wrong? >> yeah. she said that she was sorry, but that she loved her. it was heartbreaking. >> heartbreaking to hear mona's grief. and chilling to think what might have happened if tracey had not fought back the way that she did. michael wondered what, or who, had driven dustin to such violence that night. >> coming up! >> living here, most of us don't lock us door. a lot of us can't lock our doors. we were nervous. >> a town on edge as police search for the second intruder. was it someone from tracey's mysterious past? tracy gave an interview to a local tv and reporter, in the months following the invasion. >> there is a person still out there. and as a mother, i have a natural instinct to want to protect my children. >> she gave a description of the second intruder, but other than that police did not have much to go on. crime scene technologist could find no fingerprints at the scene. no one saw anyone suspicious fleeing the area that night. >> we're still looking. and again, we have no clue who the second party was. in the house that night. >> and of course, police know the identity of the attacker that had not gotten away. dustin wehde, the son of tracy's friend. realtor, mona. >> i was in shock. i could not think. >> it was also hard from wanted to hear. her boy, dustin wehde, a child she raised. was not a violent young man. he was just misunderstood. >> i felt my son was labeled at a very young age. and really started getting bullied at a very young age. he was never invited to a birthday party, he was never invited for a sleep over. >> was there a name for what troubled him? mona had taken dustin wehde, from doctor to doctor to get a handle on his social awkwardness. his moodiness. >> every place we went, there was also always a different diagnosis. i felt that he was very misunderstood as a child. >> had the troubled young man simply snapped? tracy sought so. she said that she had never felt safe around dustin, even when michael was mentoring him. >> i told michael i didn't like the idea of him being around the kids. because when i saw him with michael, the affect was just off. >> tracy said that dustin's mother once confided in her that she was scared of her own son. >> she complained that he was physical with his sisters. >> scaring his own sister? >> she said that she could not he leave him alone with the girls. because he would hurt them. >> physically hurt them? >> physically hurt them. yeah. >> she says mona told him that day -- >> and you believe he did that? >> yeah. i saw her cry over it. >> in the hours after the attack, tracy speculated about what had brought the unstable teenager to her home in the first place. had some of michael's collectible guns caught his eye? was it a botched robbery? investigators didn't think so. the intruder showed no interest in grabbing the expensive jewelry, or the cash michael kept in the safe. the one item made off with from the house, was an old computer found in the backseat of dustin's car. >> when i heard the computer was taken, i did think it was strange that a ring, that is a lot smaller, and has a lot more value, which could easily fit into somebody's pocket. why didn't someone just slipped the ring off my finger? >> but if dustin and his mysterious coconspirator had not been looking for clues, what had they been doing? had their mission been even more sinister than anyone had first imagined? investigators wonder, did someone want to scare tracey? or maybe even kill her? but no one could picture dustin, troubled as he was, as leading that vicious assault. who then, was the other personfo figuring out who would want tracy dead. ichael roberts had a glimmer of a theory. involving some sordid, personal history with his wife. wasn't the first time that tracy had come under attack. >> i was at work, and she said i'm about to send you a facts. can you make sure that you are standing at the facts machine? and i hope you still love me after i send it to you. >> four years before, when the roberts had still been living in chicago. tracey had sent her husband of troubling document. it appeared to be the type written confession of a dentist, admitting that he had assaulted tracey after sitting her during a dental treatment. >> she said she had woken up and she was redding red high heeled shoes that were too small for her. and he was masturbating over her. >> in the document, the destin sent out the terms for an understanding. he would seek counseling for his sexual obsessions, and pay tracey $160,000 in damages. in turn, tracy promised to keep it a secret, even from her husband. >> so what do you do? you're reading this facts in which her talk -- is documenting hurry from the dentist. >> what do i do? i'm her husband. >> of course, he didn't mean it. he told her to call the cops. >> i just meant, she had to call the police. it was rape. and she would not do it. >> tracy filed a lawsuit against the doctor instead, alleging medical malpractice. and a few days before the home and vision, they were set to go to trial in a chicago courtroom. >> so your first allusion to the home invasion is the dentist? >> of course it was the first thing i want to. and i was told the guy had a chicago accent. >> it was a solidly and a potential mastermind of the home invasion. had her big city past followed her to rural iowa? >> of course i did. >> tracey had met her first husband at a chicago teaching hospital. his name was john. he was a medical student, and she was a radiography or. purely 20 years old. >> he was very much in control. and i like that. i grew up in a household with a very domineering, controlling father. so to me, i thought that's what was how it was supposed to be. >> tracy's mother was not a fan of her doctor husband. >> he never really talked. he was very much almost to himself. and it was hard having a conversation with him. it almost felt like you are driving things out. >> did he have something to hide? tracy revealed to investigators that her marriage to the doctor had quickly deteriorated. he was a philanderer, and a bully. she said. even in the bedroom. she described how the doctor enjoyed tying her to the bed. and gagging her. at one time, he had even left her tied up overnight, uncovered, with the windows open. in 1992, the couple separated. they'd shared custody of their son baby bert, until one day she reported to the authorities the three-year-old had blurted out something shocking. his father had touched him. >> bert is the first one that made a comment. and we weren't sure. so here she took him to a doctor. and it was a doctor who said that it looked like he was abused. >> had the boy been sexually abused by his own father, doctor john pitman iii? the one who tracy's ex husband? the allegation of abuse became a part of an expensive, toxic struggle for the boy. -- has been number two was furious with husband number one in the months preceding the home invasion. >> she was married to a monster, look at what he did to this boy? >> i thought, how can he still be practicing medicine and my son, my stepson, had to go through this? >> tracy's acts, the doctor, adamantly denied the allegations. but when he returned to court rents again seeking sole custody of birds. michael, has been number two. could not believe it. >> i called him and i said john, i am very deep pockets. and i'm not gonna stop fighting. it's gonna get very expensive, why don't you just give up? >> had the warning from tracey 's husband quoted the doctor into taking a different approach to the custody battle? had he decided to bypass the family courts altogether, by hiring two hitmen to knock off his ex? that was the most likely scenario that tracey told investigators. her first husband could very well be behind the home invasion. the doctor saw bert echoed that theory, when he was being interviewed by a social worker. >> they're thinking that, john pitman iii, had something to do with it so. >> to do with those people coming to your house? the weed investigator called tracey to fill her in on the progress. >> we are looking at her ex husband. where looking at his attorney. those are all, we're looking at everything. >> tracy had told the cops about that nasty custody battle she was raging with her ex husband, the virginia doctor. she said her ex had a possible motive to want her dead, but investigators couldn't find any hard evidence linking him to dustin wehde. no phone records, no money trail. it was a dead hand. as the weeks passed, another name began to crop up around town. >> a lot of speculation. >> speculation that robin heard bishop over diner, a few blocks from the robert's home. >> a lot of people wondered if michael was trying to get rid of tracey. >> michael roberts, tracy second husband. he had always said that he was out of state at a business trip that night. but once he? could he prove it? >> obviously, the husband is also the suspect in most cases. involving a attempt on the white lights. >> county sheriff, who took over the case in 2003. said investigators had been intrigued by michael roberts from the get-go. who was this australian businessman who moved from chicago, to tiny early, iowa. >> what is the draw? you know? law enforcement officers with careers for a while have seen the criminal elements move out of the cities, and into the rural areas. so i think you just gotta sit back and look at that and say, why are they here? >> tracy was in conflict. the suspect that she wanted investigators to get serious about was her ex. that doctor in virginia. but they seemed just as interested, if not more interested, in her current husband. michael roberts. good friend, -- told tracey directly what some people in town were going to believe about her spouse. >> she came out and told me that was it was michael. >> that set up dust in this other guy? >> and the goal was to do what? >> to kill me. >> they said the roberts perfect marriage was on an act. >> you know the difference between someone who is in love, and mad at them, and still was in love? that was gone there. there was just that feeling of this isn't good, this is cold. this is bad. >> and her opinion wasn't just based on a feeling, mary, who often picked bert up at school. had heard him tell horrible stories about what was going on at home. >> if bert didn't move fast enough, there was a harsh punishment. many times, bert, welcome to school without a coat. and it did be below zero because he did not move fast enough in the morning. >> but as the story went, it was december 2000, a year before the home invasion, that really exposed tracy and michael's marriage for the facade it was. it began with an argument over finances in the home office. dustin's mother, mona, watched it unfold. >> tracey come storming into the back door. and she is just rampaging, and yelling, and screaming. and michael looked at me, and goes. i'm going to have to excuse you, and ask you to leave. >> and then it went nuts. according to this police report, tracy said that michael had knocked her down and jumped on her. he also pulled her hair. >> that's when he put my mom's head through dry wall. >> through the drywall? >> through the drywall. >> michael was arrested and spent the night in jail. he then pleaded no contest to charges of disturbing the peace. saying he was just trying to restrain tracy for her own protection. but bert told police that there was more they needed to know, this boy, who had accused his biological dad of sexually abusing him, now said he had -- horror stories about his stepfather too. >> is he hitting you? giving you the back of the hand kind of thing? >> yeah. he broke my nails at one point. for not cleaning up horse crap at my bare hands. >> and along with the beatings, he said, there was constant humiliation. >> one of the worst ones was when i was older, and just psychologically, i mean, i was like 13 at the time. and he was beating me, and i was crying. and since i was crying, i was baby. and at the little baby needed his bottle. so he made me drink out of a bottle. >> are you okay with this? he's your little boy. >> i wasn't happy with it, but i found when i ejected it made it worse. >> bert said his mother remained blinded, to something that was becoming clearer and clearer to him. it wasn't his biological dad who had plotted the murder. he now believed, it was his stepfather. >> so you think that michael, your stepfather, was involved in this? orchestrated it? planned it? >> fully involved. >> looking back, bert thinks michael gave himself away at the hospital the night of the attack. >> just the way that he looked at us. or the way that he reacted to see us alive was, off. >> as though he did not expect you to see alive? >> yeah. >>bert thinks michael was posing as a loving, concerned husband. and pointing fingers at the chicago dentist, and tracy's ex-husband just throw cops off the trail. >> he is trying to look in all of these directions. instead of at him. >> isn't it counterintuitive that he stays with your mother? and he does for years. you think he would have a reason to have this phone go off, and go out of town. >> i mean, if you paid people to kill your family, and they failed. you don't want to leave. because, it looks like you did it. i think that he was waiting for his next opportunity to do it. >> and remember, it was michael roberts who had began nurturing dustin wehde, in the year leading up to the attack. dustin's relationship with his own dad had been difficult. >> they're just wasn't a lot of connection between the two of them. and i think for dustin, that was painful. >> had michael exploited this boy to his advantage? becoming some kind of father figure to the trouble teen? grooming him to kill tracey? the lead investigators confronted michael in his home office. >> he looked me in the eye and said, michael, how much did you pay to dustin to kill your wife? >> michael denied any involvement in the crime. and police establish that his alibi out of town business trip was rock solid. there was no way he had been in the house that night as the second intruder. but that doesn't mean that he couldn't have masterminded the attack. police asked tracey's husband to take a polygraph. the results, according to the examiner, concluded michael's truthfulness could not be verified. and he could not be cleared in this matter. >> the fact that he failed a polygraph, yeah, i have to think maybe he is involved. >> was tracy now living with a man who wanted her dead? he rolls over and goes to sleep. and i'm laying in bed. like, what is going on here? >> tracey thought how little she really knew about her second husband. and what he was capable of. they met online, and then got married 18 days after their first face-to-face meeting. >> who is michael? >> i do not know. i really do not know. i wish i knew. because, when we were together. when we were having problems, i honestly still believe that he loved me. you know? >> tracy started to grapple with the idea that it was michael, her current husband, and not dr. john pitman her ex, who might have been behind the home invasion plot. and the way tracy piece it together, michael had a motive to. in 2001, the roberts computer business was in trouble. had he seen tracy's death as an easy way to get his hands on some cash? after all, they had millions of dollars worth of life insurance policies? >> in 2004, nearly three years after the home invasion. the roberts marriage imploded. michael filed for divorce, tracy filed for an order of protection against him. the sheriff saw the rift between the husband and wife as an opportunity. >> when they got divorced, really, that's when we figured out we would know if michael roberts was involved or not. >> but the sheriff would be disappointed. as ugly as the roberts divorce became. it did not yield any clues about the home invasion. the investigation went cold. and then, as suddenly as she had arrived in small town, iowa. tracy up and left. she moved with her children to omaha, nebraska. new town, new job. she even changed her name. >> in reality, she needed to get away from michael. i mean, he still was harassing her all the time. >> he's not past tense? >> he's still making it, life hard from her. >> the other one mother in the story, dustin's mother, was also long gone from early, iowa. and she taken dustin's sisters to live in minneapolis, after her husband, their father, took his own life in the cemetery where dustin was buried. >> he was there, and he put a bullet in his heart. and left a note said, i cried every day since december 13th. >> but what a stark world you are looking at on your husband 's death. >> i was very -- horrible. >> how did you put yourself together? >> i buried stuff. i hid it. put up walls, closed doors. try to tell myself, it's a horrible nightmare. and that i'm going to wake up. >> the worst part of the nightmare, that she felt so alone. mona was consumed with questions that she felt no one else cared about. instead of wondering about the idea of the mysterious, second intruder. or who masterminded the attack. she wanted to know what had really happened to her son that night. >> was there any way that you could put him in the house up to no good? >> no. i just said, there is no way, no way possible. >> for starters, mona said her son wasn't this scary, hair trigger misfit described by tracy. his mother knew dustin with a sweet smile, masking a little sadness. not a killer. certainly, a kid who connected his family would -- that's why he treasured his relationship with the roberts family. no way was he putting them to harm. >> they were my friends, they defended him. he was like, i got a friend. no, he's not gonna go down there and say, oh, i think i will kill you today. >> common sense told mona that there was something wrong with the very idea that dustin had been a hitman for hire on that night. >> he parked in front of the house, he had no gun, he had no knife. >> but hadn't dustin revved off a computer? they found it in the car. >> you're gonna tell me that my son, went into the house, that is full of bells and gateways. and he went upstairs in the corner of the bedroom, and picked up a obsolete piece of drunk? >> it's an old beat of computer. >> useless computer, went out, put it in his car. packed it in nice and neat. and went back in the house, and went upstairs to get killed? >> monett know there had to be a better explanation. maybe dustin had stumbled in on someone else trying to kill tracey? mona peppered investigators with questions. >> i kept asking questions, and, i got, funny answers. and they just plain and simple said, her story fits the evidence. and i'm just going, no it does not. >> coming up! tracey roberts under scrutiny. a new investigator tracked down her first husband. and boy, does he have a story to tell about his ex. >> next thing i know, she disappears and comes out with me at a gun. >> when dateline continues! dennis murphy (voiceover): mona wehde's son dustin had been shot dead. >> mona's son dustin had been and she knew tracey robert's story didn't add up. shot dead. and she knew that tracey roberts story did not add up. but it was a conversation with the town's funeral director that made her think, tracy might be deliberately be misleading police. that she had something to hide. >> they told me that dustin was shot. three times in this under arm. two times in his hip. and at that point, four times in the back of his head. and i went, what? >> the violence of dustin's death overwhelmed her. mona now believe not only did tracey's story of self-defense was bogus. not only that her son was innocent of any crime the night of the home invasion. she also believed that austin had been murdered, targeted. >> so this is an execution he walks into? is that the way you see it? >> totally. >> but years after the attack, she felt as if there was no want to listen to her. >> i felt like my hands were tied because i could not do the investigation. i could not do anything. and i was so sad, because my son and his file was just sitting on a shelf. how long would it sit there? would there ever be a day of justice? ♪ ♪ ♪ >> for years, mona had quietly watched the woman who had shot her son, give interviews. >> i turned around and then fired it. >> a time came when mona fired back at a local paper. >> i did put out one small article in the paper. and i just asked, why did you kill my son? tell me why. >> the grief and the frustration was taking its toll on mona's family. >> i just felt, everybody ripping apart everybody. i didn't know how to pull back, and i hurt. >> but then, on christmas eve. seven years after dustin's death. mona got a surprising phone call. iowa's division of criminal investigation had given the home invasion case file to a cold case investigator. at last she had a reason to hope. someone else was suspicious of tracey story. >> i had a hard time making sense out of it. because i could not get past her original statement. >> special agent, trent, noticed a lot of inconsistencies in tracey's statements to police. basic facts that she kept changing. like the number of intruders in the house. the other red flag? the crime scene photos. >> why aren't things for broken? why aren't things on the cupboards, or dressers lying on the floor? did it make any sense. it looked to me like justin had gotten shot in tide. >> had treacy been lying about what happened in the house? and if so, why? agents came to realize that he knew almost nothing about tracey. the woman at the heart of the crime. >> what i did was i slowed down, and i went back to the beginning really. that i could find for her. and that was about 1988. >> 1988. the year that tracey married john pitman, the doctor in virginia. after talking to tracey's acts, and sifting through court documents surrounding the marriage. the investigator realize that pittman was nothing like the auger that treacy had described to investigators. bullying incidents? the doctor said it was treacy, not he, who had been abusive. and one memorable sentence, she he said that she pulled a gun on her. >> she turned on, me and said you're never gonna leave this house alive. >> i was so stunned. and the next thing you know, there's another one comes out leaving a gun. >> she fired the revolver into the ceiling, and pittman called the cops. tracy admitted firing the gun, told police she had been contemplating suicide. dr. pin and told the agent that it wasn't the end of traces bizarre behavior. pittman pulled out surveillance logs, and photos by a private i. that he said proved it was tracy, not he, that had been unfaithful. >> and that was a real shocker. because it was starting to look like she had a second life that i was not a rare of. and she hung out with male strippers, and just all kinds of unsavory characters. >> tracy later told people that it was her first husband, not she, who enjoyed the company of strippers. she also denied having had affairs. but doctor pittman says that his private i warn him, he should not take any chances. his life might be in danger. >> he said look, she's already shot at you. the first one goes in the air, the third one goes of your head, the next one hit you. >> tracy said that it was his fat out fear that end of the marriage. not his infidelity and abuse that she had claimed. but what about the -- tracey's allegation that he had sexually abused his own son, bert. he said none of it was true. and he had a court filing to prove it. >> i've never done anything. no inappropriate touching, exposure, grooming. anything. >> the cold case investigator believed traces acts was telling the truth. that doctor, who had seen evidence of abuse? she had been wrong. said illinois child imbues investigators who exonerated pittman back in the day. even more telling, agents thought, was the fact that tracey had let burt move to virginia after the separation from michael roberts. if she believed her first husband was an abuser, why would she send her son to live in his care? tracey roberts and the truth. agent velocity to suspect that other advance in this life story might not hold up to an examination. >> either you have to believe that the whole entire world is out to get tracey. or tracey is a criminal. and she just does bad things. >> agents took another look at the story of the chicago dentist, who tracy claimed had raped her. he signed a confession offering to pay tracy damages, or so she claimed. but the dentist told the -- that the confession was a forgery. >> he said that she extorted him. >> it made the agent wonder anew about the relationship with michael, husband number two. cher, some people around the farming town didn't care much for the businessman. but had he really been abusive to his wife? back in 2000, michael had been arrested for that alleged assault on tracey. but he told the investigators that he had actually been trying to protect tracy at the time. not heard her. >> she started kicking holes through both levels of dry wall to the other side. -- where there was a 20 volt heater. >> he showed investigators photos of what he had taken of the holes. he said that tracey was about to electrocute herself, when he grabbed her and force her to the floor. as for the claims that michael had beaten him? >> breaking his nose? did that happen? >> no. i suspect him quite a few times. and i made quite a few mistakes as a parent. >> michael admitted that he was a stern father, but said he loved his children. it would never hurt them. michael also denied harassing his wife after the break up, saying it was the other way around. tracy was the violet one in the family, he claimed. he says that she tried to kill him more than once. >> she come in drunk, and she rolled me up in a cotton, king sized cheat. very tight. pinned me with safety pins. and reached underneath or, behind the bed. and took out a plastic bag over my head. >> she put a plastic bag over your head? >> the way that michael to the, tracy tried to suffocate him. she says that michael story was sheer fantasy, but not long after, he filed for divorce. but what about michael's polygraph? that seemed so suspicious to her early investigators. michael had an answer for that to. he said that the lie detector had caught his own skirmish out about tracey's story. not that he was the brains behind the home invasion. >> it's hard to answer a question as to, do you know the identity of the second intruder if you don't believe there was a second intruder. >> agents had ruled out michael roberts as a suspect. and he started to wonder, you couldn't get two more poles apartment then tracy's two ex-husbands. the australian entrepreneur, and the doctor. and yet both had similar horse stories to tell about their ex-wife. he believed that he uncovered tracy's true character. >> when she got mad at someone,. she was enraged at them. she didn't want someone to be embarrassed, to one of them to be destroyed. >> agent but let it was now convinced that as much as she fabricated her stories about the dentist, and both mental be. as she had also fabricated her account of what had happened on december 13, 2001. her dramatic description of the break-in. of being chased, and choked. her firing deadly shots to protect both herself, and the children. lies, he thought, but he could not figure out why. the answer, it turned out. was tucked away in the ten year old case file. a top secret piece of evidence that was going to break the investigation wide open. coming up! >> they said there's more to this. then what people know. and i said, do you mean that stupid notebook? who is she running from. tracy's best friend was afraid. >> i feared that i knew something that i didn't know i knew, and i feared what would happen one tracey figured out. >> because tracey had confided in mary after the attack, and told her all sorts of things. things that did not add up, like the fact that the second intruder have been wearing a ski mask. if he had, mary wondered, how had tracey given a description of his face? but it was actually seeing for herself, the space where tracey had fired from, that gave mary pause. it was just too tight a squeeze for tracey to have dived to the gun, safe shot over her shoulder, and then turned around to keep firing. >> there is no way she could keep it in between the bed and that wall. i thought, this is not adding up. but i did not know. i didn't know. >> cold case investigator, trent -- doubted tracey's story too. after doing a background check on her, he was convinced that the home invasion was just one more lie from a woman who had conned people her entire life. >> she was a tornado wreaking havoc everywhere she went. >> so had tracy gotten away with murder by pretending to be a victim? it was not an entirely new idea. investigators had discussed it back in the day, but then in 2010, agent valletta found someone willing to listen to his wild theory. >> he would send me little teasers and continuously call me. what do you think about that? >> the newly elected sack county prosecutor, ben smith, was a captain in the iowa national guard and knew his way around guns. he was immediately skeptical of tracey's description of the shooter. >> you are saying that every shot she took was either sitting kneeling, with her eyes closed, or glasses of. >> what is the degree of difficulty here? media >> never. no. >> the secret six-page document with its scratchy writing, mis-c felons, and bizarre concepts was hard to read. but the prosecutor quickly realized that it could be the key to the investigation. it began, one day about 20 years ago, a boy was born into a middle class life. the author was 20 year old dustin wehde. >> there is no question this is dustin's handwriting? >> it is destined, sees got distinct handwriting. >> the heart of the pink journal, its core story outlined strange plot. a mysterious fellow, dustin wrote, had contacted him to carry out a shocking mission. kill tracey robbins. and the identity of the fellow commissioning the crime? it was not other then tracy's first husband, doctor jon witman. surely this was the smoking gun that confirmed exactly what tracy had suggested to investigators so long ago. that her first husband, angry about that bitter custody battle, had been behind the attack. but even though destin had physically written in the journal, investigators did not believe that he offered it. >> it contained personal information about tracey's ex that he would've never known about. that he wants wanted to be a psychiatrist, not a plastic surgeon. and another remark, that he like to play mind games. why would this 20 year old kid in iowa know any of these details about dr. pittman, where is the stuff coming from? >> you've got one or two things, he is either clairvoyant or tracey told him to put it in there. >> you think he's being dictated? >> absolutely, he's described. >> the cold case investigator told the prosecutor that he had what he thought was proof that tracey had dictated the journal. >> i basically asked her to describe her ex husbands for me. i thought i was going to go interview, them i said please describe to me so i know what kind of people they are. johnson has a one paragraph response, and what was interesting about the one paragraph response is that it was incredibly similar language to paragraph five of the journal. if i had any lingering doubts at that time, the she described john pittman the exact same way that dustin wehde describe john pitman, there is no doubt that she authored it. >> so if the journal was a fake, what does that mean? well, that is where the serpent bottom tale gets kind of simple. motive. the prosecutor says that tracy stage the home invasion to stage her acts and get an upper hand in the custody battle. >> here is what tracy is hoping. law enforcement's find the pink spiral notebook, they read it, and they think holy cow. it is going to raise enough suspicion that they're gonna spend all this time in energy to interview dr. pittman about this murder for hire scheme, and it is just enough for her to get it into the juvenile court sentence. he is being investigated into the attack. >> and dustin, according to this new theory he was no attacker but collateral damage. one boy dead because of a fight over another. >> he had no life value to her. and she used him. >> and killed him? >> and killed him. >> but how could the prosecutor prove his new theory? it came down to this. investigators had always kept a journal top secret, but if tracey had created it, she obviously knew about it. so, if investigators could prove that she knew about, it they could prove that she created it. got it? that is why the prosecutor lost one night when she was talking to tracey's old friend mary higgins. he told her that the investigation had been reopened. >> he said that there is something more to this than people know, and i said i do not know why i said it, i don't, i said do you mean that stupid notebook? >> and then just he just turned white, i kept saying to him what? what? and he said how do you know about a notebook? >> should mary higgins have known anything about the existence about a notebook? >> nothing about it. and i was leaning against the wall to begin with, but i got light-headed because, as far as i was concerned, that was it. >> it was the final piece of the puzzle. the moment tracy had slipped up and told someone she knew about the journal, the journal that was supposed to be top secret. the investigator and prosecutor wondered if they had enough for an arrest and they wondered what would happen if they did not move soon, because tracy had, it turned out, gotten in trouble in the authorities in nebraska. she had been accused of forging documents in lying about her dog or identity. she was ultimately convicted of perjury, but investigators wondered if tracy was getting ready to run. would they be able to arrest her in time? then, she noticed the police blue lights in her rearview mirror. >> the next thing i know there is a bunch of police cars and there ban pointing guns at me and telling me to get out of the car and i kept asking what is this about? and a man came over, and said i was under arrest for the murder of dustin wehde. >> ten years after she told police she had been attacked by the teenager, she was charged with dustin wehde murder. the news was overwhelming to dustin's mother. >> i just kind of went blank and was like, what? i was so heavy and i was like, it is unbelievable. because i never thought that that day was going to come when i would be told that she was actually arrested for murder. >> but that day did come on a mild october morning in fort dodge, iowa. tracey, standing trial for murder as tracey richter, she had entered a plea of not guilty. ben smith sat at his table, next to a recently assigned veteran, state's attorney. >> it was such a bizarre set of facts, it would be difficult to show that this was a setup versus a home invasion. >> at the heart of the prosecution's case was its assertion that dustin was no home invader. mona had testified that she had actually asked dustin to step stop by the house. she had some of jobs for him and asked him to stop by. >> she said that we have a whole bunch of copies that we want dust into makes. >> and he did go. the prosecutors show the jury a photo, dustin's car parked in plain view outside the roberts home. >> if he was going to commit a burglary, it would make no sense that he would park his car in the driveway. >> once inside the house, the prosecution argued, dustin had taken down the dictation for the journal. investigators found a black roller ball pen sticking out of dustin's back pocket, the same type of pen made the journal. >> it makes no sense why dustin would go into a home invasion with a black roller ball pen in his pocket, it made more sense that the pink spiral notebook was done that day. >> the pink journal, written in dustin's chicken scratches, stated that john pitman had hired him to kill tracey. the prosecution had decided to clear that up once and for all. >> did you ever ask dustin wehde to set up a plan to kill tracey richter or your son? >> god no. >> because the cops had long believed that doctor pittman was innocent of any murder for hire scheme, they kept the journal secret, thinking that anybody who knew about it was probably behind the home invasion vision plot. enter mary higgins, the prosecution star witness. even though she was testifying for the prosecution, she was still desperate to make a connection with a woman who had been her friend. >> the whole time i'm in the stand, i wanted to look at tracey, i wanted to see her eyes. i wanted to see if the tracey i knew was still in there. >> she told the jury about the moment tracy had mentioned to her the journal. >> she said that, in the car, next to the computer, was a pink spiral notebook. >> did you say anything about the pink spiral notebook would prove anything? >> it would prove that john pittman did this. >> there was the foundation of the prosecution's case. the motive, skam the ex husband with a pink journal to get custody of burt. lure a young dustin wehde into her web and dispose of him. now the was going to bring the jury back ten years to the wintry house to show them how tracey had done it. first they had to clear up the physical evidence did not show, stacey's story of a home invasion did not mention the crime scene. a series of investigators testified that there was no sign of a break-in, no sign of ransacking or an attack. as for her strangulation injuries, this emt who transported tracey to the hospital was skeptical. >> are the marks on the front of the defendants neck consistent with your experience of someone having like utter marks in a strangulation? >> no sir. >> the prosecution argued that tracey had made the marks herself. it was just one more aspect of her staged home invasion. so what did the physical evidence show had actually happened in the house that night? the prosecution's last witness was a forensic expert who had analyzed the blood spatter and bullet trajectories to explain the sequence of events. using rookie prosecutor ben smith as a stand in for dustin, he recreated the shooting in the courtroom. >> there is a wound to the right arm, lower abdomen, right here on the side, shoulder right here. >> just as she told investigators, tracey had indeed started firing from the side of the bed. but, then, she tracked him as he tried to turn away and tracy had continued shooting as she moved closer and closer to dustin. >> he's going down, and down to the floor, there is a shot, number four to the right neck. >> the expert testified about the final shot into the back of dustin's head. >> one of the exits out the aloft here. >> any one of them could have been fatal, according to the process prosecution, and it was highly unlikely that dustin could've been trying to get up, as tracey had told the police over the years. >> unless he is, you know, a zombie. he is got eight bullets in his body. he's got to the back of the head too. >> the prosecutions expert then explained what the blood splatter evidence showed about the last shot. he testified that tracey had waited up to 15 minutes before firing a final round into the boys skull. and it was tracy's best friend, once again, who had something startling to say about this new evidence. mary higgins testified that she overheard something disturbing during a visit to tracey's house. burt, who had always publicly supported his mother's account of that night, was confronting tracey. >> we were sitting at a table and burnt comes in and burnt is extremely agitated. bird starts to hit his head on the table, not to hurt himself, i did not feel, but out of frustration. and he said, why did you go up there, why did you go back up there? and he said, you did not have to shoot him, you did not have to kill him. >> was there something that burt had seen his mother do that terrible night in 2001 that he had been keeping a secret all these years? what truth could ever tell the jury as he took the stand? >> coming up. >> common sense tells you that you do not plot, plan and execute a murder in an hour timeframe when he had three children at home. >> the heart of the defense case. what tracey's son remembers about that night. >> i was very, very, very scared. >> and did dustin say anything to you at that time? protecting them from peril. >> that is what we believed happened that night. >> tracey's defense attorney, scott and carmen anderson did not want the jurors to lose sight of the woman they believe their client to be, an heroic mother. her story see much easier to believe than the prosecution's theory of an elaborate frame to just -- a custody dispute. >> common sense tell you you do not plot implant murder during an hour timeframe when you have three murdered children at home. >> the defense argued forget about it. but it does not tell you who kills dustin, it is really relevant to the case, a red herring. >> as far as i'm going to the home, there's absolutely no evidence to support that. >> tracy and i would not talk about the attack a lot, and the testimony of tracy's best friend, mary higgins, -- says the defense. >> when she is interviewed in 2002, and 2003, she makes no reference to any journal. mary gave four or five different versions of what she allegedly knew and what she did not know. >> let's take it back to basics, the defense told the jury. the evidence supported tracy's story of a home invasion, argued, but investigators had missed it because of their incompetent police work. >> that was one of our biggest hurdles in the case, was that they did not do what they needed to do. >> the crime scene had been contaminated from the outset, the defense argued. paramedics have stepped in dustin's blood, evidence had been lost, and basic forensics had been botched. >> for the records, clothes were not retrieved after the shooting. >> that is correct. >> the defense argued that tracy's injuries spoke for themselves. they were the marks of someone who had been strangled. the doctor who had treated her in the er said that he never doubted her story. but, perhaps the investigator's biggest omission, the defense argued, was not giving up on the hunt for that second intruder. they presented the jury with a possible suspect for that person, someone who had been having an affair with dustin's mother, mona, and had left town abruptly after the attack. >> and you thought it was suspicious that he broke up with you immediately after dustin's death? >> i did. >> you believe he is the second man? >> yes, absolutely. >> and so it appeared, did tracey. when the the defenses alternate suspect was brought to the stand, tracy wept. her body language, gasping in effect. yes, this is the man who tried to kill me and got away. >> was she acting for the jury? >> i do not believe so. >> absolutely not. >> the man, adamantly involved -- adamantly denied any involvement in the break-in. >> did you murder dustin wehde and try to attack tracey? >> the defense then put dustin wehde the alleged perpetrator on trial. according, the he was an unpredictable young man, perfectly capable of lashing out and committing the crime. >> you testified yesterday -- >> during the cross insemination, dustin's mother, the defense attorney asked mona about occasions when dustin had lost his temper in her home. >> you were afraid of leaving your daughters alone with dustin prior to his death? >> i was not afraid to leave them alone, i did not like to leave him alone. >> mona told the jury that yes, her son had been difficult, but not violent. she said she had never told tracy that dustin was a threat to her other two children. >> they made dustin look like the bad boy and the violent child and violent adult. but it was horribly hard for me to listen to that. >> but what about the other boy at the heart of this crime, treson's son burt? he was going to be the defenses trump card. >> this is my guardian angel, right here. and that, right there, it is the head of a demon. >> bird has an elaborate tattoo depicting the home invasion. >> that is my mom. >> his mother is pictured as the hero. >> i know for a fact that, if my mom had not done what she did, i would be dead. >> now his mother was relying on him to save her from a life behind bars. tracey sobbed as her son took the stand. >> how do you feel about being here today, burt? >> pretty nervous. >> burt walked the jurors it through the home invasion. >> i heard someone coming towards my door. >> and what did you do? >> i still had my that ready. >> burt told the jury there is no mistaking dustin's criminal intent. he had a disturbing look on his face. >> angry and threatening. >> and how did you feel when you saw -- >> i it was very, very, very scared. >> and did dustin say anything to you at that time? >> yes, he told me to stay in the room. my mom was dead and i was next. >> burt told the jury how he had seen dust and try to get back up after he had been shot. >> i thought that the threat was back on. >> were you afraid that you are going to die? >> no sir, absolutely not. >> if burt was telling the truth, there was no doubt that he had experienced something truly terrifying. something unforgettable. would his memories be enough to convince the jury that his mother was his savior and not the killer? >> coming up. tracey decides not to take the stand and face prosecutors questions. but, she does answer ours. >> when you looked at the injury to your neck, it just seemed to be some sort of song back and forth abrasion. did you fake it? >> it is not on this. no. >> you never told lieutenant about justin moving in trying to rock a trying to get up to do? >> it was not written. down >> tracey sat stonefaced as her son got down for the witness stand, but she mouthed i love you from across the courtroom. what would the jury make of it all? then a moment of decision, would tracy testify in her own defense? she opted not to. but she did agree to talk to us. >> did you lure dustin over to your house that day and execute him in a cold blooded fashion? >> no. >> as she dabbed at her tears with a washcloth, and shook in her chair, tracy seemed nothing like a ruthless killer. >> you fired 11 times? >> and you hit nine times? >> i do not remember firing that many times, i was surprised. >> tracy did not waver from her story of that night. she was trying to protect herself in her family, he had been attacking her. she had been a victim, desperate to get away. >> i was in the corner, the person had to follow me into the corner to get to me. you could not have gotten more further away in the house, in a more defensive position then huddled on the ground in a corner. >> the forensic reconstruction expert described this person retreating from you and that you are the aggressor. >> no. that is not true. >> and they do not believe your story about pulling on the legs either. that you had done this over the shoulder shot, there had been traces of gunshot residue on your victims. we had to be further away from you. >> well, i know i was in the corner, and the person was coming at me. that i know. i mean, i will take that to my grave. >> there are other details that tracy was less sure of. >> burt says that your hands were loosely bound with pantyhose and he had until you. is that correct? >> i do not know. >> because that would make a very difficult to understand all the things that you are saying, to manipulate the gun with your arms bound like that, you get control of the gun. >> i do not recall ever saying that they were bound. >> but were they there are not? >> i want to say that they were more wrapped around my arm. >> pantyhose, such a strange choice of weapon for a burglar or hitman. but, nonetheless, one that caused tracey to blackout, or so she told police. >> when they looked at the intrigue here enact, it did not seem to be the kind of injury that could cause you to pass out. it does seem to be some song back and forth abrasion. did you fake it? did you do that yourself? >> no. that is ridiculous, it is hurtful. i am prone to blacking out, i have very low blood pressure. but, i do not know if it was out of fear. i do know that i could not breathe, i felt like i could not breathe. >> even more ridiculous, tracy said, what is the motive for prosecution had described to her. that dustin had been the fall guy in and elaborate scheme that she concocted to save her own, sunburn, from her ex cousin husband dr. john pitman. >> did you think you're going to lose? birch >> i did not. i honestly, it was never a concern. >> tracy said that she had no reason to create the journal to try to frame her first husband. in our interview, she said that their relationship, at the time of the home invasion, was nothing but cordial. but, if she had not authored the journal, how could she have explained those biographical details contained in the journal? they were the same details that showed up in email that tracy later wrote to investigators. >> there is language in the diary of tracey that is eerily like language that you used phrases in an email to investigators. >> it was the same topic, but not the same words. >> it is not that quickly? >> why would justin be picking up on this if this is his journal? >> oh, i agree with you on that 100 percent. but i am not the only person that would have known that. michael knew it also. >> michael robins, tracey's second husband. tracy scoffed at her second husband claims that she tried to kill him. no, she says, he was the would-be killer. and the journal was part of his grand scheme to kill her and frame her first husband for it. >> the only person that benefits is michael roberts, because it benefits michael roberts because if i die, while he was out of town, then he was going to collect several million dollars in insurance on me. he was going to be the number one suspect. >> and you think that? >> i think that more today than i ever have. >> michael roberts watched the trial from across the country in california where he was now taking care of his and tracy's kids. struggling with their questions and what he says is his continued fear of his ex-wife. neither the prosecution nor the defense called him to testify. >> whatever theory the defense, then no i did not. >> but there is something that michael did feel bad about all these years later. something that he wanted to say to destin's mother. >> my apologies to mona, and dustin's say stirs to have to go through ten years, not even knowing that your son or mother has been murdered, and then being demonized and that i contributed to that when i came to the defense of tracey. for any pain that i have caused on their wounds, i am so sorry for that. >> back in court, dustin's mother waited anxiously. after seven long days of testimony, the jury had started its deliberations. what was a few more hours after ten long years of waiting for answers? >> what made you gotta keep going for it? everything you had to endure, the death of your son, the death of your husband? >> my girls, they do not have a dad. they lost their brother. i tried to give them everything. i did not always do a good job, but i knew i had to be there for them. >> and her daughters were there for her, when the verdict was read. >> we the jury find the defendant, tracy and richter guilty. >> tracy buried her head in her hands. >> when i read the verdict, i did not expect it. >> her son, bert, sat there stunned. expressionless until he to dissolved in tears. a few weeks later, a judge listened to mona's daughters as they explained the price they paid for tracey's acts. after all, dustin has not just been a son, he had been a brother to. >> you cheated my brother dustin out of his future. as i looked around the room again, and saw my big brother was not there. >> take your time, okay. >> the judge sentenced tracy richter to spend the rest of her life in prison. mona finally had justice for her son. and what about that other son, at the heart of the story?
