just the opposite. also tonight, kevin mccarthy's government shutdown is now just three days away with little hope he can get control of his chaos caucus in time to avert disaster. democratic house leader hakeem jeffries joins me. but we begin with breaking news tonight. judge tanya chutkan, presiding over donald trump's federal election interference case, has rejected trump's request for her to recuse herself in the case. judge chutkan's thorough rebuke that he should be prosecuted and imprisoned. it's trump's second defeat by a judge in just two days. yesterday's ruling by a new york judge, an attorney general latitia james civil lawsuit against trump undercut one of his most consequential myths, the lie that trump was in real life the character that he played on tv for 14 seasons on the apprentice. billionaire, successful real estate developer, a wise businessman. but the truth was, and still is, that the twice-impeached, four times indicted, civilly liable for sexual abuse former president has been none of those things. in his scathing, 35-page ruling, judge arthur n. gordon found that trump committed repeated acts of fraud for years as he massively overvalued his assets and net worth by billions of dollars in his financial statements. the judge said that trump's legal arguments defending those statements were based in a, quote, fantasy world. and noted the difference between how independent professional appraisers value trump's properties, compared to what trump claimed they were worth. his west chester county seven springs estate appraised at $30 million. trump's value, between 261 and $291 million. 40 wall street in manhattan was appraised at $540 million, trump's value, $735 million. and of course, there's mar-a-lago, which was appraised at between 18 and $27 million, but according to trump's financial statements, it was supposedly worth anywhere between 426 and $612 million. an overvaluation of at least 2,300%. and then there's trump's pension for overstating the size of things. the judge pointed to trump having wildly exaggerated the size of his new york apartment. in his flagship property trump tower on fifth avenue to pump up its value. repeatedly claiming it was over 30,000 square feet, when it was actually a third of that size. which prompted the judge to write -- a discrepancy of this order of magnitude by a real estate developer sizing up his own living space of decades can only be considered fraud. and so, the trial in the civil lawsuit will begin on monday, more than four years after latitia james first opened her civil investigation. it's an investigation that she said only began because of the 2019 congressional testimony from trump's former lawyer, michael cohen, who put a spotlight on trump's misconduct. >> to your knowledge, did the president or his company ever inflate assets or revenues? >> yes. >> to your knowledge, did the president ever provide inflated assets to an insurance company? >> yes. >> do you know -- to your knowledge, was the president interested in reducing his local real estate bills, tax bills? >> yes. >> and how did he do that? >> what you do is you deflate the value of the asset and then you put in a request to the tax department for a deduction. >> and was that done with the president's knowledge or direction? >> everything was done with the knowledge and at the direction of mr. trump. >> joining me now is michael cohen, trump's former person lawyer, host of the political beatdown podcast and author of "revenge" how donald trump weaponized the department of justice. >> mar-a-lago he claims is worth -- it's kind of funny, $1.5 billion. here is the deposition from donald trump. question, do you have a sense of the price of mar-a-lago, the value, yes. i think i do. i mean, i think i do. how much do you think it's worth, 1.5 billion. what's your basis for that? just broker talk. never been for sale. two people owned it. based on what will have people come in, experts and like this to show a price of 1.5. i believe the price is 1.5 billion. he makes up the value of things out of his own mind, how he is feeling that day? >> absolutely. there's no basis for a $1.5 billion valuation of mar-a-lago. let me, though, be clear, when judge -- when judge in this specific case stated that the value of mar-a-lago was between 14 to $26 million, he didn't mean the sale price. he was talking about the assessed value. and trump actually tried to have that reduced even further because by reducing it even further, based upon some alga rhythmic number that's used by the state, would reduce the tax bases. >> right. >> it's not the value of the property. i would pay $20 million for mar-a-lago in a heart beat. so would anybody in palm beach. >> sure. >> he's talking about the assessed value. there's some number. i wanted to be clear about that. >> sure. >> but under no circumstance is it worth anywhere near $1.5 billion. >> right. and some of the things he's doing, in the case of mar-a-lago, it is zoned to be a club. it is not a private residence anymore because he had to give it up in bankruptcy and make it turn a profit, so he's assessing it as if he could sell it as parcelled off lots in palm beach and then inflating that by 3,000%. >> right. first of all, you can't just take a property, which is zoned as a social club and automatically turn it into a residential property. then on top of that you can't parcel it off simply because that's what you want to do. there's all forms of application and he would not be entitled to it. first of all, let's assume that he sold the property tomorrow. he doesn't get the money. he doesn't get to keep all that money. there are people that paid $350,000 as a bond to be a member of that club. they're entitled to their bond money back. they may not be entitled to interest. i'm not sure how the paperwork goes. i'm pretty sure knowing donald there's no interest that will be paid on it. but for certain, they're entitled to their bond money back. and he's got several hundred members. so now you have to take that amount of money. >> right. >> reduce it and if, in fact that he's forced to sell it, there's also the delta between his acquisition, which is called the bases and how much he sold it for, he's going to have to pay federal tax on that money, too. >> and he did this with property after property. we'll put them up on. seven springs, mar-a-lago, trump national golf club, trump national golf club l.a. and the trump park avenue. he doesn't own as many things as people think, by the way. so in the case of seven springs, he plussed it up from 30 million to almost 291 million. the case of 40 wall street, 540 to 735. case of mar-a-lago we just talked about. trump national golf club, he says 73. 16 to 56. we could go on, trump park avenue, 750,000. these are rent-controlled apartments. >> not all of them. not all of them. >> but there is 750,000 -- 62,500 per unit but inflated by 700%. he's making up numbers and says based on the value of his name and brand and the judge came out and dropped an anville on him. what happens now? that part of the case is over. latitia james won that. now he has to litigate the other parts of it. is just how much he's going to pay? >> yeah. all trials in new york are bifurcated. two parts to it. the first part is the liability. that's been decided by the judge yesterday in this decision. now you go to the second part based on damages. how much is -- are unsinkable attorney general tish james going to take from donald trump based upon the overvaluation and the actions that he did with the personal financial statement, how much is she going to hit him up for that? that doesn't even include interest and penalty that gets associated to it. now, there's a lot of mistakes that are made by pundits and journalists, where they turn around and claim that it's a $250 million lawsuit. no, it is not. it's a baseline of 250 million dollars. that means she's not going less than 250 million. >> that's the minimum. >> that's the bottom. >> yeah. >> how much? well, that we'll see at trial. which, as you know, i've already been subpoenaed by tish james in order to testify. >> yeah. >> i have to be very honest with you, after a lot of the actions that we're seeing, the attacks on judge chutkan, the attacks on tish james herself, the attacks on d.a. alvin bragg, the attacks on everyone. >> fani willis, jack smith. >> everybody. let me tell you something, i think it's going -- it's incumbent now upon government -- i listen again to a lot of pundits on the various different staxs talking about how they have to do something to curb donald trump's language. what are we going to wait until something god forbid happens and then everyone is going to say thoughts an prayers to the family? no. he should not be permitted to do what he's doing. he's threatening judges. he's threatening prosecutors. he's threatening witnesses. this is all obstruction of justice. >> yeah. >> and witness tampering. and if they don't do something about it, i have a strong suspicion a lot of people may not end up showing up to testify. listen, i'm considering it myself despite the fact i'm under subpoena. i don't have to put my life on the line simply because donald trump cannot control himself. and the courts are not controlling him. >> the point being that the witnesses don't have security. the judges have security but the witnesses are sort of on their own if they can't afford personal security. >> first of all, nobody should be required to pay for personal security because the government needs you in order to prove their case. >> that's right. >> i have stated that i intend to testify. i said it to god rest his soul representative elijah cummings. i said to him that i will do what i need to do in order to ensure that donald trump is held accountable. and i have done that. i have honored my pledge to this great man. unfortunately i also don't want -- i don't want to meet my maker just yet. and i think it's incumbent upon government because there are too many maga supporters out there that don't understand, as donald, right, doesn't understand reality from fantasy, all right? >> yeah. >> we don't live in disney land. we live in reality. and his numbers at disney land and so is his behavior. it's just not normal. >> you also have a case directly with him. you're going to be able to depose him because you have a lawsuit. talk about that. >> actually tomorrow we have a compliance conference with the court. no different than what he's doing in all of these other cases. he goes ahead and he files motion after motion. he's the plaintiff. plaintiff isn't supposed to fight you for a deposition. he's supposed to provide you with the discovery and the documentation that you need. it's part of the way the system works. nope. not in this specific case. his goal was to wait, which is what his lawyer asked for, 90 days after the election in order to be deposed. the judge in this specific case, it's insane, we have court order coming up for october 3rd. now, of course, they don't want to do it because they're saying the october 2nd start of the a.g.'s case. i wonder whether donald is coming to the a.g.'s case. i wonder if he'll show up at all. if he isn't, why would that then preclude him from appearing for the 7 or 9-hour deposition that we're entitled to take. >> please come back and tell us how that goes because it should be interesting. he in a deposition usually doesn't do well. >> no, he doesn't. >> bad for him. the truth ain't on his side. >> no. >> michael cohen, thank you. >> good to see you. up next on "the reidout," the awkward feeling when you try to drum up support with striking union workers by giving a campaign speech at a non-union factory. brilliant. well, house republicans will hold their first biden impeachment inquiry tomorrow. impeachment hearing tomorrow afternoon. and today they adopted an amendment from marjorie taylor greene to cut defense secretary lloyd austin salary to no more than $1. joining me now is hakeem jeffries of new york. leader jeffries thank you so much for being here. i do want to start with that last element because it doesn't seem that house republicans are taking this entirely seriously if their plan is to cut the defense secretary's salary to a dollar. are the negotiations on the other side in your view serious or at this point is it just for show? >> well, good evening, joy. great to be with you. and you are absolutely correct, it's just for show. these are not serious individuals. but they are being led by individuals like marjorie taylor greene who is driving the house of representatives toward a government shutdown that would betowards the government shutdown, which will be reckless, and hurt the american people. we are wasting time, doing things that have no shot of becoming a law, by cutting the defense secretary's salary to $1 per year. they are also engaging for the impeachment inquiry, it is the bipartisan bill. they are moving the bipartisan bill for 77 senators voting to advance yesterday. it would fund the government in a way that meets the americans for the ukrainian war effort, and for every day americans who've been hit hard for extreme weather events across the country. and, also these extreme policy, poison pill amendments, by trying to undermine reproductive freedom for women. that is the only option forward. >> the audience understands what they're proposing, let me put it on screen. 1 million dollars cutting low income mothers, and low income kids to, put them on a waitlist for nutrition age. a 70% cotton home heating assistance, winter is coming. 80% cut in funding for schools with high concentrations of students and property, 33% cuts to housing subsidies, 60,000 seniors, with meals on wheels. and yet, it was a shutdown because 4 million federal employees, 850,000 workers furloughed, losing pay. military, 1.3 million active duty members continue to work without may. social security medicare checks will be sent out, but you cannot replace your social security cards, et cetera. food assistance benefits will be slashed, first snap. air travel, tsa agents would have to work without pay. national parks, someone remain open, but maintenance would stop. you can go, on and, on and on. speaker mccarthy, they are blaming joe biden. they're saying that joe biden refusing to meet with them, and is the reason why they might have a shutdown. what does joe biden have to do with passing a spending bill? >> absolutely nothing. president joe biden has done his job. in fact, we all did our jobs, a few months ago, when we resolved the reckless republican default crisis, coming to an agreement, with more than 300 members of the house of representatives, supporting that agreement, and vote for the senate. it came to the presidents desk, president biden, signing it into law, and that agreement is including setting the top line spending all those numbers for the upcoming fiscal year. but a few days after that agreement, it was signed into law, the extreme maga republicans in the house will be going back on the agreement, and that they negotiated, and supported overwhelmingly on the house floor. why? because they want to drive us to the government shutdown. or, demand payment for an extreme the bill. they include things like cutting, slashing funding for public education, and they want to impose the discontinued march for undermining reproductive freedoms, criminalizing, abortion care, cutting access to social security, and it was in americans from all of the time to undermine public housing, with public health, and things of this nature are extraordinary. they want to jam the right wing ideology, to have a storm for the american people, and is having to shut down the government. >> the bottom line question, you provide the votes, the democratic caucus is passing the senate bill that they were talking about. is that the plan for the democrats would provide the votes with whatever republicans are willing to be serious, and just passed the senate bill? >> what should happen is they are calling for an up and down vote with the senate, and is continuing resolution to fund the government will fund the american people. this provides a substantial number of votes, the lion share of votes, and it is a handful, of so-called, traditional republicans to join with us in the joint interest of the american people, and the extreme maga republicans shut down that will hurt everyone. >> we're running out of time, i apologize, but if kevin mccarthy continues putting that bill on the floor, will discharge petition follow? we know he will probably lose his speakership if that happens, but can you foresee a discharge petition, and forcing a vote on the senate bill? >> all options are on the table, and we should be able to come together, in a bipartisan way, to do the basic things that we are here to do, which is funding the government with everyday americans. >> three days, house democratic leader, hakeem jeffries, we appreciate you being here. we will be right back. l be right back. we're traveling all across america, talking to people about their hearts. how's the heart? - good. - you sure? - i think so. - how do you know? let me show you something. put two fingers right on those pads. look at that! that's your heart! that is pretty awesome. with kardiamobile, you can take a medical-grade ekg in just 30 seconds, from anywhere. kardiamobile is proven to detect atrial fibrillation, one of the leading causes of stroke. kardiamobile is now available for just $79. order at kardia.com or amazon. >> before we go tonight, i want all of my readers in the philadelph area to know about a big upcoming event. chris hayes, taking s podcast, why is this happening, out on the road for a live three-city tour. i, lle joining him in philly. you can catch us live at the fill more, on monday october 16th, and it is the cure code that is on their screen, right now. don't we love it?
