any kind of justice for the attempted coup? that question was answered on august 1st when special counsel jack smith indicted him on four felony counts for trying to steal the election now. subsequently was answered again by fani willis in fulton county, georgia. as a republican front runner and criminal defendant runs for president explicitly with the message of finishing the job he started on january 6th. give back power to avoid criminal prosecution and to end the american constitutional republic, the question i have now is, will he have to stand trial before election day? that's what we are all thinking, right? it has been and remains to be an open question. there have been some big developments in the last few days, though. first of all, we now have a trial date. washington d.c. federal district court tanya chutkan said that trial date as march 4th, seven months before the november 2024 presidential election. it is also the day before the primaries on super tuesday. it is just two months after what the government proposed. jack smith has been clear from the start, from the day this indictment was unsealed, the case needs to go to trial as soon as possible. >> the attack on our nations capitol on january six, 2021, was an unprecedented assault on the seat of american democracy. in this case, my office will seek a speedy trial, later evidence can be tested in court and judged by a jury of citizens. >> this team argued the january trial date would vindicate the public strong interest in a speedy trial, and interest guaranteed by the constitution. fortunately for the defendant, donald trump, a march 4th trial date is two years earlier than what his lawyers had asked for, because according to his attorney, this case needs years to prop. >> to have a ballpark figure when you would be ready for trial? >> i can tell you that in four years of practicing law, on a case of this magnitude, i have not known a single pace to go to trial before two or three years. >> judge chutkan flatly rejected that contention in court yesterday. she said, quote, well mr. trump has a right to time to prepare, the public has a right to a prompt and efficient resolution of this matter. i have seen many cases unduly delayed because the defendant lacks adequate representation or cannot properly review discovery because they are detained. that is not the case here. consequently i find that a trial beginning on march 4th, 2024, would give the defense adequate time to prepare for trial in through the publics interest in seeing this case resolved in a timely manner. judge chutkan also pointed out that march 4th trial date will be over three years since the january six insurrection. she then went on to know the trial for the boston marathon bombing occurred less than two years after those events. remember, over 100 rioters have already been convicted since uri six. over 600 have already pled guilty. tomorrow, and re-gate.io, who led the proud boys, will be sentenced. he could be facing decades in prison. earlier today a jury of his peers and some of his confederate guilty of comes seditious conspiracy. the government is asking for 33 years in prison for him. a trial over three years from the actual crime, the insurrection, seems pretty fair. of course one thing that we have all learned, in torture rusty tail, as we have all watched the grinding trajectory these investigations are now cases that the american justice system does not move that swiftly. and given that content taxed, and maybe john laura was right, but there are all kinds of reasons you could imagine the march 4th date's -- and if it were any normal trial in the category of experience, that others have had which is not really relevant to this, there would most likely be delays. the trial would probably move. it could go for a long time. but the thing to remember here, is that it is unlike any other trial in american history. it is the criminal trial with the highest public steaks of any criminal trial that has ever been conducted in the country's 236 year history. flat out, i don't think there's a close second. the public interest has never been higher. the public interest precisely in a swift trial has never been higher. because the person who has the most latitude over whether it happens is judge chutkan, who does seem to recognize that. i take some solace in that. she clearly wants this trial done. jack smith and the special counsel office want this trial, because the american people deserve to have it done. everyone believes to be on the same page except the defendant and i assume his supporters. even the polling suggests that even americans want a quick trial. but trump said yesterday he would, get this, appeal judge chutkan's trial date order. that's not even possible. and it can't be appealed. which means, here we are, roughly six months out from the start of the trial. the only person who doesn't want it to happen is the republican front runner and his backers. and the only question is, what can they do to get out of it? doris cordell served 19 years as a judge including over a dozen on the superior court of california. author of her honor, what's broken, how to change. it harry litman served as deputy's attorney general and the department of justice and both join me now. judge cordell, let me start with you. i'm joined when i'm concerned with how you think about this as a judge. there's a lot of discretion given to a judge over the timing of these things. you have an unusual case here for a number of reasons, not just the ex president has been indicted, but the campaign calendar. how do you think is a fair way to evaluate a schedule, and how would you be approaching it, were you this judge? >> no trial judge with any experience who is assigned a case this, gathering this much attention, such a high profile trial, would ever do anything in a haphazard manner. so when judge chutkan came forward and said the trial date is march the 4th you better believe she gave it a lot of thought. she has experience as a public defender so she understands what defense attorneys have to deal with in terms of going through documents. but be sure, she gave a lot of deliberation to this and i bet you she consulted and may have consulted with other judges on the bench to put together what is the fairest way for both sides understanding full well that the defense is entitled to due process, the time to put the case together. so when she came out with this, it wasn't like oh, i'll just have half of what each side wants. that didn't happen. trust me, she put in a lot of thought in coming up with this trial date. it's a date that is fine. will it change? it could. someone could get sick. things can happen. but if the data changed it's not going to be changed to two years out. >> she said this during those arguments. she said this to john laura, a very different estimate u.n.i. of the time prepare to prepare for this case. mr. trump will be treated with no more or less deference than any other defendant. harry, seemed to be flagging an issue for appeal already in this hearing. he says we will not be able to provide adequate representation to a client who has been charged with serious offenses as a result of that trial date. the trial date will deny president trump the opportunity to have effective assistance of counsel in light of the enormity of this case. of course effective assistance of counsel that something you can use for a post conviction appeal. what do you think about him using that language in that context here? >> there is no doubt about it, he was already in a bit of a hole with her in this hearing. she said twice turned down the temperature and he had proffer that outlandish proposal to go two years out, so he is without doubt saying to her, you are violating the constitution, your honor. of course we will comply, but you're violating the constitution and we're going to bring this to the court of appeals. all of those things, i really want a second one thing that judge cordell just said. remember the very first day how there were several judges of that court who showed up, including the chief judge. i think it's clear that the whole court here, each of which has dealt with hundreds of cases and has been including appeals, is really cohesive and thinking together as a test of the court. and she absolutely can rely on our colleagues to reach a considered decision of what will hold up against a quarter of appeals. the final thing is to say that while she did note the speedy trial interests, it's clear she lead, again, as the judge has just indicated, with the due process rights of the defense. she is not going to get in the trap of suggesting that they are pushed back behind, below the due process line because of a need for speed. that comes first, and that's just what she said. >> so, judge, i've been talking to lawyers, and one of the things that is notable, things get delayed all the time. this was happening very slowly. one of the lawyers could have heart surgery. there's a whole bunch of things that can happen. what is clear here, what is evident to everyone, and i think judge chutkan has been very clear, there is a strong public interest in a swift trial, donald trump and his lawyers don't want a swift trial. so the question now is, what can they do to throw sand in the gears? what would you be anticipating if you are that judge? >> when a judge presides over pretrial motions, it's the opportunity for the trial judge to size up with the parties are. how are they gonna behave? who's gonna engage in theatrical? who's going to be rude or maybe not want to follow the orders? and what i did on the bench, when i had a high profile case, and i knew there would be issues, this is what i would do. you have the top. it's the judicial talk. the top is very simple. you look the litigants and the lawyers, all of, them did in the eye, and you say to them, and this is what i did when i presided over cases, i am going to give you the fairest trial you have ever had. and you are going to give me your respect and you're going to follow my orders. are we clear? and generally i would hear from both sides, yes your honor. then we would move on. and so it may be soon the judge chutkan, when these attorneys start again about maybe the trial date, to have the top, the judicial talk. it certainly worked for me, and i'm not the only person, the only judge who has done this, especially when you're a female judge. sometimes we don't get the respect that we should be getting as opposed to a male judge. and also being a judge of color. so this combination is such that we have to make sure we are in control of the proceedings. i encourage the judge, if she has to do so, and maybe she has already done it, to have the talk early on. >> that seems, i mean, she has, by all accounts, and i have not been in that courtroom, seems to control the space authoritatively. she is both respected and experienced. judge aileen cannon in florida is gonna be presiding over her third criminal trial or something like that. so this is a totally different universe. and harry, you said this, and other folks have said this, watching coverage about this, this is pretty hard. it is set in stone. it might flip for small logistical reasons. what are they going to try to do to make that not be the case? >> there are two kinds of delays, chris. one would be the week at a time, someone has just had an emergency surgery or this very emotion or we want an evidentiary hearing, and i think this march jade builds in some of that. a month, two months, and still the nation's very strong interest in having a verdict before election is served. the big way of if you have time is an appeal and that, for example, i, think will be happening in fulton county, where removal motions and you bet that trump will bring in at the last minute our appealable. but the different actions to challenge the whole case here, that laurel has telegraphed, that it's pretextual, it's reprisal for hunter biden, that trump has immunity, none of them at least has automatic right of appeal. it will be up to traffic. and so assuming she is a strong gatekeeper here, i think they have to go in little bite size chunks, and that can't get them far enough. so the big issue is, can they get a look at the court of appeals. even then, by the, way the court of appeals is primed for trump's really delaying tactics. but absent that, i don't think they're going to be able to eat up a lot of time. >> interlocutory appeal, appeal by right, pre trial, right? a totally different universe. i'm on the record of the show, and i want to maintain this, i have faith in americans. i really do. so i think this idea of oh, it's a florida palm beach, the julie jury pool, when lindsey graham says you can't try him in washington d.c.. personally i think, i'm willing to put my faith in americans of all different stripes. do you think that's what -- driving this? >> i think partially that and also a view that to the extent that meadows has any shot at getting rid of the case on motion practice, it's going to happen in a federal court and not a state court. why? >> stop one second. what do you mean by that? >> brian meadows is going to ask a judge, in a written brief, to get rid of the case, eject the case because under the federal constitution and the supremacy clause clause in particular, he's gonna say that he's immune. as a federal officer acting under color of law, it's unconstitutional for a state prosecutor to go after him. and he thinks that motion has a better chance of succeeding in federal court. i agree with you that the jury pool is probably driving him as well, but i'm with you. watch the e. jean carroll case, where a juror who had minister who listened to -- a far-right podcast, or sat on that jury and yet was one of the people who agreed that donald trump had defamed e. jean carroll and sexually assaulted her. i don't think that her lawyers were convinced that that would happen when they knew that he was on a jury. and yet a group of attentive jurors from all over the new york area, not just manhattan, also found donald trump liable in that case. >> so clearly they're going to try to move on immunity. part of what the hearing was taken up with yesterday, the question of can you get a case thrown out an immunity is overlapping but not exactly co terminus with the question of, do you get removed? >> yes. that's exactly right. >> so his argument for removal is similar, which is that i was acting in my official capacity. >> as you and i were discussing before, it's a much lower buyer. in order to get removed you just have to show that the prosecution is for or relating to some act that you took under color of federal law. the standard for federal immunity, especially in the 11th circuit, the court of appearance appeals that's above the district court in georgia, is much more exacting, and i read into from the brief that meadows people submit it. his contact has to have some nexus with furthering federal policy and, and i think this is the kicker, can reasonably be characterized as complying with full range of federal law. i don't think they're gonna get agreement from that, even if the judge -- the case. >> and removal it does seem they have a plausible case here. >> on removal? i don't know if -- i read the order as the judge straining, because she -- meadows has two counts against. him from reading the order today where he's asking someone on a briefing, it seems the judge has concluded that one of the counts against mark meadows, the one that deals with soliciting brad raffensperger, is not within his scope of dealings as federal chief of staff. but the other question that he raises is a question about the rico charge. basically, if mark meadows took actions as part of that conspiracy that are within the scope of his duties as trump's chief of staff, does the case have to be removed? not only is that a closer call, factually, but it's one without any legal precedent. and i think steve jones, the judge here, is really struggling with that. >> we will get some order one way or the other. >> yes. >> they'll have appeal on that, long day? >> they will. it's automatically appealable. >> so that's going to play out. now we've got the -- chesebro said i want the express service. let's deal with it. let's go right now. it's like a break dancing movie. >> i think about it as footloose. >> exactly. there's a trial set october 23rd. there are others who have also put in their sort of speedy trial applications. willis is now asking the judge in that chesebro case, the judge who has control over that, to fast-track all 19 defendants, not just chesebro, to file individual motions to sever from a larger case. what is this? >> when the dose at this trial date for chesebro last, week he said the stage for chesebro alone at this time. and fani willis is probably making the calculus of october 23rd is not that far away, i already have sydney powell who wants a speedy trial. i have little trump who has already told the court that he intends to sever with but hasn't. yeah she's basically saying judge, it's time to move this train along. if you're going to several people, let's have a briefing. let's go through this process. but, it's a default position, i want you to know, judge, my position is, we should try all these -- >> what that's gonna do is shake loose the motion to sever, which trump's people have been sitting on because every day that goes by is good for them. >> yes, and -- >> they're not gonna get head of anything. they're not like the ones are gonna go okay we probably sent them motion to sever. we're gonna wait to the last minute to do. it >> and they're probably gonna see how the removal motion is going to come. donald trump has not filed his own motion for removal, but his lawyers were in the court during that hearing and they're probably free riding on what meadows has done so far. why? >> i am confident. the reason why i'm confident, we have house gop call yesterday, and that was his big push on the call. so, if we were to have the vote today right now, kevin mccarthy would be one of the first ones to vote yes. >> now, there is just one small problem. republicans have no evidence that joe biden committed a high crime or misdemeanor. you have to take my word for it. as one unnamed republican lawmaker told reporters, quote, there's just no evidence. and they can't impeach without that evidence. i don't think the evidence exists. others have gone on the record with -- including don bacon of nebraska, quote, i think before we move to an impeachment inquiry, there should be a direct link to the president in some evidence. so, they have no evidence, no facts, nothing. to suggest the president committed any high crime or misdemeanor. they're going to barrel head with an impeachment anyway. what to go wrong? david jolly is a former public and congressman of florida, and he joins me now. what is your read of the calculus in the republican house caucus and kevin mccarthy on this? >> i think this goes all the way back to the 15 votes to become speaker. i said to the table during during the speaker vote, i didn't think kevin mccarthy would be able to get the votes to become speaker. largely, because i underestimated his willingness to sell the gavel to the maga crazy crowd. it was apparent, then part of his corrupt bargain with his caucus was a willingness to impeach joe biden. he wouldn't come right out and say, it but we know that many in his caucus wanted to move towards impeachment. i believe mccarthy made that promise eight or nine months ago, and this is always been the plan. so, he said there. i think it also speaks broadly to the republican party politics, internal politics. you've now cited the house, where they are convinced, through fox news and through just republican echo chamber, that the biden crime family is real. the problem is, it requires this broad innuendo gap for them to jump from a complete lack of evidence to pinning it on high crimes and misdemeanors. the evidence isn't there. kevin mccarthy has shown us it doesn't matter. he will sell out the institution, so that the country, as well, the second time around. >> i want to be clear here too, just up to take a second on the evidence. it's not even the evidence isn't there. the thing that they speculate about, that they threw hearsay and dot dot dot, someone told someone, is a wild accusation that this joe biden, as sitting vice president, was taking seven figure bribes. that no one has figure this out all this time. that is to happen, no one realized. it also, and this is crucial, it has nothing to do with his current presidency. it's all about, am i missing something? there is no actual tangible thing on that that they are even pretending to allege exists. >> that's right. >> in many ways, their allegations have been disproven, because at the heart of the hunter biden investigation, that's been going on for five years in the department of justice, was this notion that somehow, the influence peddling reached from the president son to the vice president himself. yet, there was no evidence of that. if there had been, you better believe, that would've been the charges brought against the sun on that. and evidence about the president produced. none of that, none of that has been produced. so, look, part of this is the elevation of this new group of republicans that are devoid of violent dodgy, this is simply now a witch hunt caucus. we are seeing that. the evidence just simply is not, there they fall on their face every time they make an accusation. >> here's the thing about the politics, of it i remember, obviously, i was sitting at this desk all through the trump years and watching nancy pelosi often really slow walk impeachment. all green, member from congress, was like, look, there stuff right now, they want. again, i think there were, i mean, on the emoluments, tough a number of places where they had plausible cases. the fact that he was clearly cross pressured and conflicts of interest as the sitting president. but that aside. pelosi's concern is about the politics of it. i just don't see the ten most vulnerable house republicans wanting to vote for a biden impeachment. maybe i'm crazy. maybe i'm wrong. i don't think that the votes for, that which is why i guess you can of the inquiry without the vote? [laughing] book a get-away-from-work trip. use onekeycash. order some sides. do not disturb. join one key to earn and use rewards across expedia, hotels.com, and vrbo. pharmaceutical companies, they can't keep raising drug prices at three times the rate of inflation. >> medicare will start bargaining on behalf of seniors, and make them bring the prices down. >> we'll negotiate with the drug companies, for the cheapest available price on drugs. >> medicare should be able to negotiate for lower prices for its members. >> there are certain democratic campaign pledges that almost perennial, to the degree they've been there for most of my adult career covering politics. one of them was, as you saw, to let medicare negotiate prescription drug prices. massively popular, consistently polling through the roof. it would both say of the government a ton of money, and make drugs cheaper for millions and millions of americans rely on them. the only big opposition to it was from big pharma, which wanted to keep prices as high as possible. and their dog at opposition, over decades, is why this really popular, sensible proposal, was blocked. yet, today, that air is over. president biden announcing, in a program that is part of the inflation reduction act, the names of the first ten drugs that will be subject to price negotiations with medicare. eric tanden -- serves a domestic policy adviser, and she joins me now. it's great to have, you have been a democratic policy circles for a while and i've been around this issue. so, there is something almost surreal about seeing that event today. this is a thing that is happening. >> yeah, i feel a little like i was aging with the videos. i worked on some of those campaigns over many years where we had leader after leader advocate for drugs being negotiate by medicare, very common sense proposal, but i'm really proud that joe biden and democrats in the last congress got together and made history, i think, in really being able to deliver that medicare will negotiate drug prices for the first time in history. in the first ten drugs were announced today. you know, i should point out, these are just the first ten drugs. there will be 50 next, year 50 after that. and then 20 a year going forward. so, this is a historic day, but it is really just the beginning of ensuring that medicare negotiate lower prices for seniors. ultimately, more and more americans see lower prices. >> i wanna put on the screen, the first ten, drugs which are selected. i should note, the timeline, here negotiations start now. they're gonna try to negotiate and hammer out these prices, it will be awhile until we get the new negotiated price. you, see everything from diabetes, to heart failure, to arthritis. one drew a imbruvica for blood cancer. a drug for crohn's. what is the process here? how does this work? >> well, essentially, the law specifies that the drugs that cms, hhs would pick drugs that have the highest drug expenditures. the expenditures for medicare. so, that's really the process by which these drugs are selected. then there is a negotiation over the next year, really. over the next month, cms and the manufacturers are gonna mix several months, we'll have a negotiation. and the price will be selected, determined by september of next year. the fall of 2024. >> this will, like you said, expand year after year. new drugs added to this roster. it's interesting, i have noticed, there hasn't been a ton of republicans talking one way or another about this today. which i thought was kind of interesting. largely silent on this. michael burgess i, saw a member from texas, said cms is holding pharmaceutical companies hostage, jeopardizing future innovative treatments and the well-being of american patients. and the interest group pharma, which represents the pharmaceutical in industry, and spent something like $700 million lobbying on this, something like that, hundred million dollars. they say, what the white house isn't telling, you they're giving a single government agency power to arbitrarily set medicine prices were little accountability, oversight or input for patients and their doctors. with consequences long after the administration is gone. what do you say to the argument that this is going to stifle innovation in american drug research? >> well, during the inflation reduction act, deliberation in congress, the congressional budget office did a deep dive into this question. they really studied what the impact would be on innovation, and a future drug production. they found that it would limit the inflation reduction act would limit one drug, let me say that again, one drug over the next ten years. so, these arguments are really just palpably false. i would also say, the va, veterans administration, it has been negotiating drugs for decades. the department of defense negotiate drugs for decades. essentially, what pharma wants, what pharmaceutical companies want, is the ability to charge any price they want. that is what they are asking for. they can have any, and that is what they have essentially gotten away with. in the past. so, the federal government, and consumers have paid more and more money, and that is why we want to restore this basic principle, of capitalism. buyers and sellers negotiated price. and that is what medicare negotiation is about. >> buyers until this notion of, right particulate, both buyers tend to get better prices. i mean, that is happens in every, as far as i know, every country. the government's purchasing drugs, they're the purchaser, when you buy a lot of, something you go to the supplier you say, hey, i'm gonna buy a ton of this, let's work at a price. >> absolutely. in fact, medicare negotiates prices for everything else. hospital payments. doctors payments. it's really only because pharma got a sweetheart deal carve out, decades ago. that medicare has not been able to negotiate drug prices until the inflation reduction act. that's why today is so historic. this thing with health care advocates, many people who've been working in this field for decades have advocated, for it's finally coming to fruit. >> let me ask you a timeline question, as a veteran of the affordable care act battles, famously, the affordable care act was pulled very poorly. pulled very well before it started being debated, pulled poorly by the time is being passed. it continued to pull very poorly in the first year or two. and then they tried to repeal it twice, they couldn't do it. because a very popular, very popular now. partly, there's a bunch of reasons for that. partly, delayed implementation. so, people don't get to see what the law was, and the tangible status quo that was gonna produce. are you worried about the timeline here, where these new drug prices aren't going to hit people, i think, until after the election? they have a similar sort of timeline issue? >> well, first, it pains me to say, the affordable care act was not as popular. essentially, medicare prescription drug negotiation has an 80% approval rating. it is strongly supported by democrats, independents and republicans. i know republicans were perhaps relatively silent today, that does not stop the fact that they voted against the inflation reduction act, and against the ability for medicare to negotiate drug prices. so, it is a popular, bill it is a bipartisan, provision of the legislation, that's why i think it will stand the test of time. i will note, drug prices will be public, in the fall of september, 2024. and in many arenas, health insurance companies have followed medicare in setting price. so, we expect, and we really do hope, that this will not just be a price for medicare, but that it will be a price that ensures use as well. >> neera tanden, they should come to. that come back anytime. that is all in on this tuesday, alex wagner tonight, starts right now. with canada's ali velshi. thanks for asking. >> on toward those snapping. there are loved it. >> a couple people comment, nikki haley, i think it's called a communist. but if it rains tomorrow also be a communist. cathy mcmorris rodgers calls it socialist pricing. i'm glad you pointed out, it's a negotiation on the drugmaker, you are forming a price. i don't like it. we'll negotiate, or i won't say the drug. you know to me, it's the caution is not communism. >> it how everything happens.
