plus, the date is set. trump's federal trial on election interference charges now on the calendar for march 4th, 2024. 189 days from now. our nbc reporters are following all of these latest developments and we have insights from one lawyer inside that d.c. courthouse as the judge heard from trump's lawyers. so let's start in fulton county with nbc senior legal correspondent laura jarrett where the court is just getting back from recess. mark meadows took the stand today, he was asked about that now infamous phone call where donald trump asked the georgia secretary of state to find him the votes. what did he say? >> yeah, chris, it was something of a surprise move to have meadows take the stand at all. we wondered how exactly he was going to defend as it is his burden to prove why he should be in federal court in the first place. his argument is all along he was acting as a federal employee, and he was virtually on different calls and meetings by the former president's side for several weeks and months there as he took all of those different actions, he says, on the former president's behalf. he believes he didn't do anything wrong whatsoever, but of course, we thought it was going to be a risky move because the prosecutor can use anything he says on that witness stand against him, and already we see a vigorous cross-examination by the prosecutor's office asking him, in what specific way were the things that he was doing to try to overturn the election related to his job duties at all. we believe that the cross-question will continue shortly. they have about 40 minutes left, chris. >> so at least one of trump's attorneys was spotted in what's known as the overflow room, where they put folks who can't fit into the regular courtroom. what should we make of that? >> it's been interesting to watch that strategy play out here. you might think one of the reasons they're doing it is to decide if they too, might get the case kicked over to federal court. we have not seen the former president make that kind of request. they have time if they decide to do so. the same arguments that you hear prosecutors making. this doesn't have anything to do with your job duties, trying to overturn the election is the same argument you would see them make as to the former president. we'll see whether they were curious spectators today or whether he'll make a similar motion in the near future, chris. >> laura jarrett, thank you so much. let's go to d.c. now because that's where judge chutkan set the date for donald trump's federal election interference case. it's one day before super tuesday. let me bring in nbc justice correspondent ken dilanian. so trump's team originally requested this trial take place all the way into 2026, so this isn't even close to what they were looking for. have we heard any response to this decision? >> chris, as you laid out there, this decision by judge chutkan pretty firmly sided with the prosecution a trial date with next year is inconsistent with president trump's right to due process and the right to effective assistance of counsel. special counsel jack smith was in the courtroom taking notes but prosecutors have made no public statements since the hearing ended. they had to have been pleased, chris, because it could not have gone better for them. the judge rejected defense arguments that there was so much evidence in the case that the defense needed more than two years to get ready for trial. the judge repeatedly asked laurel to propose a more reason able date of april 2026. in arguing for a speedy trial, prosecutor marley gaston said the following, mr. trump is accused of historic crimes, and she added there's an incredibly strong public interest in a jury's prompt consideration of those claims in open court, and the judge really appeared to agree. she said the public had a right to a speedy trial in this matter. she said the claims by mr. trump and his team about the huge volume of evidence they had to deal with are exaggerated, even though it's true that prosecutors have turned over 12.8 million pages of documents, and prosecutors are providing a road map to the key documents in the case. chutkan made a point of saying that mr. trump will be treated with no more or less deference than any defendant would be treated. and if this trial holds, there may be a verdict before the republican national convention in august. chris. >> ken dilanian, thank you for that. now, at one point today, judge chutkan asked the lawyers to take the temperature down. former u.s. attorney kirschner was there. he joins us from outside the courthouse. the stakes are high, you can understand why there might be an intensity in the courtroom, but what was going on to bring that warning from the judge and just overall bring us up to speed on what you saw and heard inside the courtroom? >> yeah, chris, trump's lead defense attorney john started out loud and got louder. it was twice judge chutkan had to tell him, take the temperature down. he was insisting that the only appropriate trial date that would give he and his team enough time to prepare to defend donald trump was the april 2026 trial date, which i don't think anybody thought was a legitimate request by the defense. judge chutkan said several times, this case will not be tried in 2026. and she urged him to give her an alternative proposal. another trial date that would still give him enough time to prepare, and he flat out refused and he lost the battle, because she said, fine, we're going to begin this trial with jury selection on march 4th, 2024, and she said point-blank, you and i have very different ideas about how much time it takes to prepare a one defendant four-count trial, and she shared some of her experiences handling murder cases as a defense attorney in the courts of the district of columbia and how she was able to prepare cases. so i think her trial date is firm, it's all but set in stone, and it looks like the people will get the speedy trial that judge chutkan acknowledged they are entitled to, not just the defense but the people have a right to a speedy trial as well. >> glenn, i also read that jack smith was in the courtroom. i don't know where you were sitting if you could get a good look at where he was, what he was doing, how he was reacting, what can you tell us about that? >> i was sitting behind jack smith, and his right-hand prosecutor, jay cooney, there was not a lot of reaction, he did seem to nod in agreement, specifically when judge chutkan would say things like donald trump would get a fair trial. the defense will have enough time to prepare, and then she set a trial date about six or seven months down the road and it really does feel like that will give the defense adequate time to prepare, but, chris, that is something they will never admit, because just as ken dilanian shared with you, at the end, john lauro said -- the judge asked him point-blank, when would you like the next status hearing to be set in this case. there are several status hearings set in the runup to trial, and he said, quote, i don't see the need for a status hearing. he knows full well there will be a status hearing set. she said, fine, look at my minute order, it will have the date of the next status hearing. >> glenn kirschner, thank you for that. on top of the whirlwind day for legal news, peter navarro was in court today for a hearing related to his refusal to cooperate with the january 6th select committee. navarro told the judge trump made it clear he did not want him to cooperate with the committee. the judge questioned why his defense couldn't present the actual words trump used, instead of just his impression of the conversation saying, quote, that is pretty weak sauce. we're following breaking news out of north carolina, an emergency alert has been sent out by unc chapel hill warning of an armed and dangerous person on or near campus. we want to show you these pictures. they of course show law enforcement on the scene. the school is warning all students to shelter in place, stay inside, and stay away from windows. we're going to keep a close eye on this situation as it unfolds, and we will have any updates for you as we get them. with donald trump's d.c. trial now just a little more than six months away, what are the biggest challenges in the months ahead for jack smith as he tries to convict a former president. we've got that in 60 seconds. es. we've got that in 60 seconds power e*trade's easy-to-use tools, like dynamic charting and risk-reward analysis help make trading feel effortless. and its customizable scans with social sentiment help you find and unlock opportunities in the market. e*trade from morgan stanley. ancestry made it really easy to learn about my family's history. finding military information, newspaper articles, how many people were living in the house and where it was, makes me curious and keeps pulling me in and the photos reminding me of what life must have been like for them. finding out new bits of information about the family has been a wonderful experience, it's an important part of understanding who we are. i want to go back for just a second to that scene in the courthouse today. special counsel jack smith in the front row of the d.c. courtroom, and said to be taking note, and scheduled the interference. i want to bring in chuck rosenberg, former u.s. attorney, and former senior fbi official who was an msnbc contributor. i just want to get your take first on judge chutkan's ruling, essentially saying to donald trump's defense, we're not going anywhere near that. >> yeah, it makes sense to me. look. some of what i'm about to say, chris, may be informed by the fact that i grew up as a prosecutor in the eastern district of virginia, where cases moved quickly, expeditiously, and without any continuance. six months is plenty of time to prepare for trial that doesn't even strike me as a close call, and so i think she was right to recognize that just as a defendant has a right to a speedy trial, so does the people represented in this case by the government. >> we know the defense wanted more time to prepare or their real desire was to get it pushed past the election. right? what about jack smith and his team, what are his challenges, what are their challenges between now and then. >> well, the biggest challenge for a prosecutor is the same challenge for every prosecutor, right? they have to prove their case to a unanimous jury by proof beyond a reasonable doubt. that's a high standard, properly so, and so the burden is on the government and never shifts off the government, and they're also going to have to have to handle some dispositive motions, motions filed by the defense to have the case dismissed. one of mr. trump's lawyers, for instance, said they are going to bring a selective prosecution motion to dismiss the case, saying essentially that mr. trump was singled out because of his status as former president or a candidate for presidency. again, that's nonsense. that's garbage. nevertheless, the smith team will have to contend with that, and will have to answer those motions and argue them in court. at the end of the day, though, chris, this sounds like it's on track for trial on march 4th. the date could slide, but right now, march 4th, and the burden will be on the prosecution to prove its case to a unanimous jury. >> do you think it's likely it slides at all, chuck? >> yeah, you know, it's possible. again, i think some of what i'm about to tell you is informed by my judgment, growing up in a different district where cases weren't routinely or traditionally continued. i think there's a chance it slides, but i hope it doesn't. it's important to get it done right. and it's important to get it done quickly. i think march 4th is plenty of time. an ancillary point. we have heard there have been millions of documents produced by the government in discovery, but only a tiny, tiny, tiny fraction of those will be relevant or key or hot documents as we sometimes refer to them. so my advice to the defense team, and i mean this sincerely, i don't mean this facetiously is sit down and start reading. >> okay. so alena haba who was asked about the whole idea yesterday that they needed years to prepare had this to say. i want to play for you, an interesting exchange. how do you logistically handle, you know, prepping a client for all of those different trials and running for president of the united states. >> yeah, if it was a normal person, honestly, shannon, i could understand the concern, president trump is not your average person. he's incredibly intelligent, and he knows the ropes. he also knows the facts because he lives them. these are not complicated facts. look at fanny, it was a phone call. a phone call that's been around forever that he refers to as the perfect phone call. what is he going to have to be prepped for, the truth. you don't have to prep much when you have done nothing wrong. >> so take us out of donald trump land, and go into regular defendant land in a case with implications that this has or any of the other four to be honest with you. what would be typical in terms of prep, and by arguing he doesn't need any time to prepare, he's a smart guy, does she in some way undermine their argument they need years? >> well, they don't need years, and i don't think she's the one who undermined that argument. the judge saw right through it. regardless of how much of an intellectual trump may be or how well he knows the facts in his own case, it's still true that his lawyers have to prepare, they have to review the documents in discovery, they have to prepare the question and or cross examine witnesses. what mr. trump knows or what he thinks he knows. his lawyers still need to prepare. i wouldn't pay a lot of attention to what a spokesperson has to say here, there or anywhere, frankly. >> but do you need as a defense attorney need to prepare your client in any way? >> you do, particularly because your client is going to take the stand and testify. i'm sure that's not a decision that they had definitively made yet. that's a very difficult decision for defense attorneys and their clients. it's probably one they will make much closer to the trial date, if not during the trial. any trial lawyer would want to prepare his client to testify in case that's the direction they decide to go, and regardless of how well mr. trump may know the facts in his own case, being prepared to take the stand, and testify, and be cross examined is a very different matter and will take a lot of preparation if you want to do it right. >> chuck rosenberg, always so great to see you my friend, thank you so much. new details in a deadly racist shooting in jacksonville as the nation also commemorates the march on washington. how much work still needs to be done 60 years later? unc where there are reports of an armed and dangerous person. you can see this video we just got in from the scene. you see the students leaving one of the buildings with their hand up. at another point, just a few minutes later, we saw a group of kids running across that road. the first report came out just an hour ago, the school warning students to shelter in place. people who are not on campus are being told to stay away. as far as we know the situation is ongoing, we will keep you updated with new any information as we get it. meantime, in south carolina, a college student was shot and killed, just trying to get into the wrong home according to police. officers in columbia say they were called at around 2:00 saturday morning following a report of a home burglary and shots fired. they found 20-year-old nicholas anthony dinalfrio from connecticut on the front porch with a gunshot wound. he later died. the university of south carolina student lived on the block where he was shot. >> and just moments ago, we heard from a university security guard who encountered a gunman who later killed three people in jacksonville. the gunman attempted to enter edward waters university, an hbu, but the guard turned him away, potentially saving lives. >> i was not able to see a weapon at that time. however, i did see what appeared to be a tactical vest, a mask, along with a hat covering his head at that time. so it's just, for you to see me approaching and for you to leave that fast, something's not right. i thank god that i was there and that the students was there and was able to alert me. >> yeah, a lot of people are thanking god he was there and brave. that shooting created a startling split screen this weekend about race in america. a white gunman targeting and killing three black people at a dollar general in florida while 700 miles away, activists celebrated the 60th anniversary of one of the biggest moments in this country's civil rights movements, the march on washington. civil rights leaders called for policies to end gun violence, while in jacksonville, a community is trying to pick up the pieces after this senseless, racist shooting. joining me now, "washington post" columnist, and msnbc political analyst, eugene robinson, nbc's trymaine lee is here as well. i mean, when you look at that split screen, you have to answer the question about the fight, where it was then, how far have we come now. >> sadly, chris, we haven't come that far at all, when you think about in the 1960s, as a country deeply divided along racial lines, the wealth gap extraordinarily large. you think about residential segregation, also the specter of hate and violence looming. you had lynchings going on. and 60 years later, many of these inequalities have gotten worse. the wealth gap has grown. 60 years later, we're mulling how far this country has to go and how far they have come, this weekend, to get people gathered. this wasn't a commemoration, this was a continuation. i had a chance to talk to martin luther king iii and his family about what this means. here's what they had to say. >> something is wrong in this climate right now, and we have to make the dramatic turn. what concerns me most is we're at a boiling point, where we could go in a direction where we will destroy ourselves. darkness can't put out darkness, only light can do that. violence will only stamp out violence. love and nonviolence can do that. >> less than five years after the march on washington, a white supremacist shot and killed dr. king, forever changing the trajectory of the country. in many ways, a unifying moment, and cast a pull on how violence is baked into the country. white supremacist violence in particular, is as american as apple pie. time and again we see it rearing its ugly head. >> thank you so much, we appreciate you being here. eugene, one of the things that struck me was an interview that was done with florida state senator tracy davis at the sunday morning vigil. take a listen to this. >> we have three people that are dead. dead. because they are black. shopping in their community, gunned down, because they were black. >> eugene, what do you make of this split screen moment? >> it's an incredible moment, as he said, it's entirely consistent with american history. and we need to know that history. you know, think back to just last year in buffalo, where ten people were killed at that tops supermarket because they were black. think back to 2015 in charleston, south carolina, my home state, where nine innocent worshippers at mother emanuel, emanuel ame church were killed because they were black. so today is the actual anniversary, 60th anniversary of the march on washington. yesterday was another anniversary in jacksonville. it's the anniversary of something that is locally called ax handle saturday, and what happened was on august 27th, 1960, a group of young, mostly students who were conducting a sit-in to protest a segregated lunch counter were attacked by a white mob bearing baseball bats and ax handles, and when the police finally intervened, they intervened on the side of a white mob, and arrested the black victims rather than the white assailants, this is the kind of history that we need to know in order to process it and to try to move beyond it. if you ask why people got upset about those standards of education in florida, for example. florida was the state we were talking about. the standards that were created or imposed by governor desantis, it's because not only what they said that was just totally weird about slavery and being a benefit to the enslaved, but the way it gives rift to the violence committed against black people during the jim crow period, and just barely touches on episodes of our history that we must know in order to get beyond them, and we don't know them. >> i was talking last hour to charles coleman, a lawyer who's a frequent guest here, and who does a lot of civil rights cases, and he said, yeah, we have to talk about guns, but what we really need to talk about here is the motivating factor, is the racism. he pointed the finger at politicians like ron desantis, he said, who he thinks their actions and their voices are very thinly veiled, that they get things moving in that direction. he talked about vivek ramaswamy who suggested that white supremacy was like finding a unicorn, finding a white supremacist was like finding a unicorn. how much do you think, if 60 years later, we are where we are, how much of it is about a lack of leadership in your mind? >> i think a lot of it is about a lack of leadership. look, this country is good at forgetting. we're good at forgetting the unpleasant, and we cannot allow ourselves to forget. we must remember because if we don't remember, we don't learn those lessons, and there are a lot of politicians these day who are essentially creating a permission structure just to say, oh, that racism stuff, that's all over and done with. we don't need to pay attention to that anymore, and that is a grave disservice to the country. it's a grave disservice to the people who are being told and who are lapping that up. without fully understanding the implications of this act of forgetting. it dooms us to the cycle of violence. it dooms us to not dealing with the root causes of systemic racism. if you deny the systemic racism exists, you'll certainly never address it. and that's what a lot of politicians want to do. >> eugene robinson, thank you so much. we do have another report of potential violence. we want to bring you this update about the ongoing situation at unc chapel hill. the university's alert system, reporting just minutes ago that there is a, quote, suspect at large. it follows an initial report now roughly an hour and a half old of an armed and dangerous person on or near campus. i want to bring in nbc's julia ainsley who is following this for us. what more do we know, julia? >> well, you're right, chris, it has been changing. at first we thought that this suspect was in custody. this was based on the alert system sent out to residents' families and students at unc chapel hill. the latest alert we're seeing, chris, says that the suspect is at large telling everyone to remain sheltered in place. some of these initial reports placed this situation by caldwell labs, a lab on the campus at chapel hill. it seems the suspect is at large. we're trying to get more information about what injuries might have occurred. they say this is what type of aircraft, courtney? >> reporter: it's still under investigation what happened here. and while investigators will likely be on the scene the next week to ten days, we probably won't have a solid answer on what happened for the next weeks or maybe months, as is generally the case with these crashes. it was at osprey, it looks like a helicopter, when it's on the ground, when it's taking off, hovering over the ground, but then it has the ability for the rotors to tilt forward and for it to essentially fly like a plane, and fly very quickly. that's why it's known as a tilt rotor aircraft. that is one of the reasons it makes this a more complex and difficult aircraft for pilots to fly. here's how one aviation expert explained it. >> it fulfills an important military mission. because of the uniqueness of the powered lift and tilt rotor aspects of the aircraft, it does introduce hazards in the form of a little more difficulty flying the aircraft as well as mechanical complexity. >> reporter: and one of the main missions of the osprey, chris, is to move people around. that's what we saw in australia. it was physically moving marines from one location to another. that's why there were more than 20 individuals on that aircraft at the time of this crash. it crashed in a remote area known as melville island, taking part in a training exercise with both the australians, the u.s. military and a number of other nations in the region there, the pacific. the u.s. military maintains about 150 marines in darwin, australia, year around, as much as 2,500 rotate in throughout the year. the idea is they are in as a presence. they have a forward presence in there. this is part of the u.s. military, as a show of presence with allies in the region, primarily to show china. >> courtney kube, thank you for that. tropical storm idalia expected to intensify in a category 3 hurricane as it barrels into florida's gulf coast. we'll head to tampa to see how residents are preparing next. o w residents are preparinneg xt [it's the final game, folks. this one wins the series.] struck out with the cheap seats? >> this is the picture that went out from unc police showing this individual, saying that this person is a person of interest, and today's armed and dangerous person situation telling everyone to keep their distance and call 911 if they encounter this man. now, we have to point out, chris, the first alerts went out to the campus and residents at 1:00 p.m., and a lockdown went in place because of an armed and dangerous person. at first, they said this individual was in custody, and now they're saying that suspect is at large. we're not making the connection here saying this is the suspected shooter, rather it's a person of interest, and we do know from that alert system that the suspected armed and dangerous person remains at large, and so far this area around chapel hill's campus, unc's chapel hill campus remains on lockdown. that's near the labs and the bell tower area of campus, and students and residents are told to remain to shelter in place, and we'll report more as we get. so far, chris, no confirmed reports of injuries at this time. >> julia ainsley, thank you for that update. hurricane season just kicked in to high gear in florida with the state now rushing to prepare for idalia, as it gains momentum, and heads toward the coast. 33 counties are under a state of emergency, and the florida national guard has been mobilized with more than 500 personnel, and a dozen planes at the ready. idalia is expected to cause serious storm surges that could topple buildings. priscilla thompson is reporting from panama city where local officials could cut off beach access as the water swells. we just heard from governor desantis, what's the latest? well, we're seeing marissa parra there who is also -- >> reporter: the message from the governor is that now is the time to act. he's urging people who may be in areas where they're being asked to evacuate to do that, and really emphasizing that evacuation doesn't necessarily mean traveling hundreds of miles. it could mean traveling 10 to 20 miles to get to higher ground, to an area that's not going to be hit quite as hard. already the governor has ordered a state of emergency for some 33 counties here, mobilizing more than 5,000 national guardsmen, equipped with 2,400 high water rescue vehicles, and also 12 air craft to assist with any search and rescue that may need to be done. and across the western part of the state. we are seeing folks taking this seriously. boarding up homes and businesses, filling those sandbags in order to protect property. we're also seeing shelters that are beginning to open, beginning tomorrow, in order to support residents as they prepare for this storm. and i want to play a little bit of what governor desantis had to say about what folks should be prepared for. take a listen. >> the storms of course, as we know, these things can wobble, so floridians along our gulf coast should be vigilant, even if you're currently outside the cone and indeed, you could see impacts if you are in a place that's outside the cone. >> reporter: and as it relates to that power, the governor says that they are prestaging tens of thousands of linemen who will be ready to begin to restore that power, as soon as it is safe to do so. fema also pre-positioning resources here, so certainly all hands on deck, as we expect to begin to feel the impacts of the storm within the next 24 hours. back to you. >> nbc's marissa parra is also in florida on the ground in tampa. what do preparations look like right now? >> reporter: pretty similar to what priscilla is saying. you look over my shoulder here, you can see people lining up to pick up sand bags. in terms of how residents are responding, it depends on the family. i'm going to take you to some of what we have heard on the ground from people we spoke to in the last couple of hours, people picking up sandbags, ready for idalia. >> tampa and hurricanes, i'm not used to that. my job let me off early to come get sandbags, and prepare, and would have got water, and everything. you just want to be safe. we used to always have to vacate because we live by the island. >> reporter: so what i have found just walking around here is it's a combination of people who are prepping their homes as they get ready to flee the area and some people choosing to hunker down. either way officials across the state, officials especially in the counties that are most impacted, including the tampa area, further north as you get closer to the path of idalia, asking people to evacuate if we can. there are some evacuation orders that are in place. within the hour, we found out that the county we're in has issued an evacuation order for low lining areas. the areas closest to the coast, very vulnerable to storm surges. this is something we saw with ian. it is not expected to be as devastating as it came. officials have been very clear here. it might be a tropical storm now. they are expecting it to strengthen to a cat 3 hurricane: but with these gulf waters, the way that they are. we have seen record breaking temps that has warmed up the gulf of mexico. we're seeing very high temperatures, we know what that can do for a hurricane. we saw that happen quickly. we saw with hurricane ian, so officials are being clear. take this seriously, even if it's a tomorrow right now. this could be very different, even in the next 30 hours, chris. >> marissa parra, thank you for that update. >> still ahead, speaker mccarthy calls an impeachment inquiry into president biden, a natural step forward. that is if the government doesn't shut down first. we'll dig into the latest drama on the hill, after this. t esdra on the hill, after this.
