in hawaii president biden promises more aid as the anger rises over the initial response. and communities across the western u.s. clean up from tropical storm hilary, and another powerful storm is barrelling towards texas right now. we begin this hour with the latest on the legal troubles surrounding former president donald trump. two of trump's 18 codefendants in the georgia election interference case surrendered themselves to authorities in fulton, georgia. trump's attorney, john eastman, surrendered himself hours after the codefendant, scott hall, who accessed voting machines and data in coffee county, georgia, turned himself in. this as donald trump says he will travel on thursday to surrender to authorities. that news came hours after his attorneys and the fulton county authorities agreed to his release, and all this as jack smith's team responds to trump's proposal to start the trial in april of 2026. joining us, leslie caldwell and ali vitali. what do we know about this surrender today and when others could turn themselves in? >> reporter: we tried to be eagle eyed about this, knowing all the codefendants have the same deadline, and they have until friday to turn themselves in. there was talk about some of them trying to come in the wee hours of the night to avoid some of the media presence, and what we have seen in the last few hours and we are starting to see an uptick in the number of cameras and photographers, and we have seen the last two of these folks turn themselves in, in the building behind me. the big name we are looking at today is john eastman, the man at the heart of the fake elector scheme, and he is somebody who has his bail set at $100,000. while we can't see folks physically go in and out, what we are able to do is refresh the system that shows who is actually in the midst of being processed in the building behind me. we know that both eastman's and hall's name are currently in the system. what will happen at this point is the process as it will typically unfold, a fingerprinting and mugshot and the processing going through. that could take several hours. that's why we are closely monitoring that digital system to show when these people are processed out, once they met their bail and have been processed through the fulton county jail. that's a good indicator of what we could see tomorrow, or rather thursday, when the former president trump says he will turn himself in, just a day before the deadline. for trump, of course, it's not business as usual. he's a former president of the united states. we know secret service, of course, will be involved in the deliberations of what it looks like to have a former president turn himself in, and whether or not we get the fingerprints and the mugshot, that's the key questions here. >> donald trump's bond agreement sets rules for his release, which is promising not to threaten any codefendant or witness, and how is this different than the protective orders in the federal cases and in the new york hush-money case? >> it's the most specific case we have seen in one of these bond orders. judges in other cases admonished trump or his lawyers verbally not to threaten witnesses or codefendants, and this is in writing. i think that's notable. as you said, it's worth reading. the defendant shall make no direct or indirect threat of any nature against witnesses, victims, any member of the community. the above shall include but not limited to posts on social media or reposts of others on social media, and that is that putting trump in a box as he continues to post inflammatory things on truth social. it lays down a marker and the question becomes what is the judge's leverage if he goes over that line. the maximum leverage is the judge can call him into that courthouse and revoke his bond and put him in jail, and nobody thinks that's a good option, and that could be something mr. trump welcomes and declares himself a martyr. >> how does a judge hold trump accountable if he violates the bond agreement or protective order? and this is not a regular kind of defendant. >> yeah, i think that was well said, josé. he's not the kind of regular defendant and that changes the normal rules. i think it will be very difficult to police words like intimidate and threaten are susceptible to different interpretations, and i think it's likely he would have to do something that was quite undeniably intimidating or threatening for any serious action to be taken, so i would expect a verbal admonishment if there's a breach of the conditions to start with. i agree with the former president of the united states, being sent to jail seems remote and probably not a good idea. >> and enjoining mark meadows, and trying to move cases from state to federal court. what is that looking like? legally, is that something that is often done? >> so this whole situation is very unusual. i would say it's not often done, but it's possible if somebody such as mark meadows was engaged in his official duties, his official chief of staff duties, that they would be better adjudicated in a federal court. however, i don't know that his official chief of staff duties included assisting and arranging obstructing an election and promoting fake electors and some of the other things alleged in the indictments. i think it's certainly a basis to make that motion with a straight face, but whether it will succeed or not, i think, is doubtful. >> and meanwhile, there's somebody else that has been included there in atlanta? >> reporter: yeah, that's exactly right. we are seeing several more consent orders come through, which is effectively the procedural step of agreeing on a bond number and particularly precedes having these people come to the fulton county jail, and eastman surrendering in the last hour and trump is set to surrender on thursday. we have since seen consent orders for ray smith and ken schafer and ken chez borough. for people like chesebro, if we can dwell on ken chesebro for a second, what we have heard in other things that have become public, he's somebody that is central in enacting the fake elector scheme. john eastman was front facing to the administration, to trump and trump allies, and you can think of ken chesebro who was front facing on the state level with the fake electors. he's another man we are tracking closely, and a name you will remember and our audience will probably remember as part of the group of names from the j 6 committee, and they are just a congressional committee and not a body of the law, and that's why they were recommending those referrals. now chesebro is a name we have seen come forward in multiple investigations in 2020. we are starting to see the process pick up the pace after a slow weekend and very slow few days after the indictments initially came down. we're now starting to see the consent orders coming through, and we will closely monitor our app that shows when these folks are coming and surrendering in the business behind me. >> leslie, just to clear things up for my mind, because on basic 101, consent orders, what does this turn out to be? this is people essentially being booked, right? >> yeah, and it's having their bond set. the practice for pretrial release varies from jurisdiction to jury sticktion, but my understanding is in fulton county, it's normal for any criminal defendant to have a bond, to be considered for appropriate release conditions, and to have a bond set and that's made up of a matrix of factors that the county applies and that's what yields the number that is put on to a particular person, and it's a combination of risk of flight and danger to the community. >> can you tell me the numbers? >> i am sorry. ali, were you saying something? leslie, i am sorry. continue. >> go ahead. i think ali was saying something? >> no, i was just asking my producer for the right numbers. >> this is part of the live tv that i thank you all for moving along with us. ken, i want to turn now to one of the other cases. what did the special counsel's team have to say about trump's for his election interference trial to be in 2026? >> the special counsel in making that extraordinary appeal noted that they are going to receive and are receiving 11.5 million pages in discovery, and the counsel said you don't have to read every page of that stuff. come on, we live in an electronic age, and a lot of it was already released by the january 6th committee and a lot of it is your own records and a lot of it is meaningless gibberish, so the 11.5 million pages figure is misleading. and the judge chutkan is holding a meeting to decide where she falls on the continuum of the trial starting in 2026, and she will set a date and we will see if it holds. >> thank you so very much. we are able to hold conversations with all kinds of different places, and that happens on live tv. i am grateful to have you as part of that conversation. tomorrow night, eight republican presidential hopefuls will take the stage in the first debate of the campaign season, and we will tell you who made the cut. and then how large will trump loom over the night, despite not even being there. eight people died from a flesh-eating bacteria in several states. you're watching "josé diaz-balart reports" on msnbc. rg this kitchen. (vo) make the switch. it's your business. it's your verizon. it's 14 past the hour. tomorrow night will mark the first presidential debate of the 2024 election season. the rnc announced these eight contenders will take the state in milwaukee, and one person notably missing, the frontrunner, donald trump. over half of likely iowa republican caucus goers say they believe trump's false claim he won the 2020 presidential election. and darsha burns is live from milwaukee. good morning. what should we be watching for? >> look, josé, former president trump figured out a way to make himself as present as possible at tomorrow night's debate while being absent. he forced a split screen where he has counter programmed the event with his own interview with former fox news host, tucker carlson. it has been prerecorded. we know this. and it will air tomorrow. he's got that going. and the hosts of the debate are going to ask questions about the former president and we know he will be turning himself in the following morning, so there's so much oxygen being taken up by the former president these candidates will have to figure out how they are going to thread this tough needle, and what you introduce with the poll, it puts a fine point on why this is such a major challenge. in my interview with governor ron desantis, it took a lot of pressing for him to say trump lost the 2020 election. so much of the republican base believes he won. it's a fear for these candidates to alienate those voters. everybody, i can tell you, they are in study hall and in the debate preparations figuring out how they will walk that fine line and how they will contrast themselves with trump, and how do they do that without alienating those voters. we know that florida governor, ron desantis, is prepared to take a lot of the attacks tomorrow night. the target is absolutely on his back. he probably has the most to lose as he's been the second in line next to trump. he has been the number two, though he has been slipping in the polls. we know he historically has not been the strongest debater and the knives will be out for him, whereas the other candidates will try and make a moment for themselves. chris christie will be the only one on the stage that has presidential primary debate experience, and he has an advance with that and he's a more natural speaker in those kinds of settings. it will be a major moment. again, all happening under the shadow of the former president, josé. >> thank you so much. for more on this, i want to bring in jennifer horne, and the chief impact officer and served as a senior adviser in biden's 2020 campaign. 51% of republican iowans believes trump's claims that he was the winner of the 2020 election. >> that's the biggest challenge candidates like nikki haley and rick scott will have to contend with. when a majority believes something that you know is falls, and you have to draw them into your circle, your support, that's almost impossible. donald trump, with the hold he has over the base of the voters, and the ability he has to manipulate and influence them on things like facts, he created a situation where he doesn't need to be on the stage to trip up all the other candidates in the race. >> and many caucusgoers say their minds are not made up and could be persuaded to support somebody else. what kind of opportunity does that create for the other candidates? >> well, if they are playing their cards right, they understand the trump conversation will dominate a lot of the debate stage. they will also be paying attention to what some polls have been saying about republican voters, and they want to talk about the issues like the economy, and some of the cultural issues where desantis is doubling down on. a good candidate, one that sees this opportunity will be able to make clear their positions on the issues that matter to their voters. it's kind of interesting to wonder what is the most pressing issue for the republican primary-based voters because a lot of them are still with donald trump and he doesn't have any platform beyond him saying this is a quote, unquote, witch hunt, towards them, and they being the proverbial other people, and there's a opportunity and you will see some of the candidates pivoting from the conversation around donald trump, and they believe they have a plan that would work for some of the broader republican base. >> i am just wondering, jennifer, how you do that as a candidate in iowa when the focus is very much on donald trump. how do you get to the other issues when that's not only the biggest issue, the fact that he is not there, how do you do that, jennifer? >> it will be extremely difficult. think of candidates like nikki haley and tim scott, who i mentioned earlier. they are going to be on a crowded stage where they blend in with a lot of lesser-known candidates, and it's not a place they want to be. i don't think chris christie will have any trouble doing that, and he's the truth teller, and will hurt is trying to and doesn't have the oomph that chris christie has. i see candidates like mike pence and nikki haley and tim scott as the ones that have the biggest burden on them coming on to the stage last night. and the ones that are unlikely, unfortunately, to get the least out of it, and because they are going to look like they sort of blend in with a lot of faces and voices that people don't recognize. frankly, none of them -- none of them have shown the strength or courage to do what you need to do to separate themselves from the whole trump mess. >> there will be racial diversity onstage tomorrow. can we expect other candidates to make that at all a pitch, or part of their pitch, at least? >> listen, i think tim scott might talk about him being a black man on the stage, a black man in the republican party. i think nikki haley talked about her heritage, and so have one of the other candidates. i think in addition to race that might come up on the stage is nikki haley being the only woman there and are republican voters ready to elect a woman president. the reality is based on polling i looked at this morning, they are not as ready to be behind a woman president the way you see democrats and the vast majority of america as a collective are, and it will be interesting to see how they talk about their race and gender in a primary from a party that actually doesn't celebrate those things in a way that the democratic party does. >> thank you both so much for being with us this morning. appreciate your time. up next, breaking news. a new tropical storm just made landfall in texas. plus, as president biden tries to assure hawaii he's dedicated to the wildfire recovery there, some survivors remain skeptical. >> what happens after this?
