good evening once again, i'm stephanie ruhle. donald trump is now seeking to delay his federal election interference trial until april of 2026. no, not next april 26, april 2026. that is almost three years from now. 17 months after the 2024 election. it is when his legal team proposed this evening in a court filing to the judge handling the case. they say, quote, must have adequate time to defend himself, citing the governments 11 and a half million pages of evidence, they said if the pages were stacked on top of one another, the result would be a tower taller than the statue of liberty and the washington monument. remember, jack smith has asked for jury selection to start in december, with a trial beginning on january 2nd of 2024. meanwhile the former president has been speaking out against his four separate indictments. today he told fox business, he wants his party to do a better job of defending him. >> it is just a continuation of silencing, they want to silence. you if you look, this is not even possible. it is a disgraceful thing. republicans can't get -- republicans have to be tough, if the republicans are great in many, ways but they do not fight us hard for the stuff. >> double fact check, yes it is entirely possible, and no, it is not a political fight. this is with the department of justice. it is about breaking the law. tonight, donald trump canceled a news conference he had been touting for monday, that he was going to use to discredit at the georgia election case. and a post on his social media platform, he said his lawyers had convinced him to places evidence of so-called election fraud to legal filings instead. before trump canceled the event, abc news reported his lawyers told him, holding the news conference would implicate his legal problems. there's also news tonight about a trump codefendant former lawyer -- asking to move his case from fulton county to federal court just like mark meadows. >> federal defense for me is acting as counsel, to the president of the united states, well my actions were as his lawyer. he asked me to be his lawyer. the day after the election. i was acting as his lawyer at all times, during the course of what is charged against me as crimes. >> and while all of this is happening, donald trump remains consistent. he's continuing to raise cash for his 2024 presidential campaign. today he was that national candidate tennessee for private fund-raiser. with that, let's get smarter with help of our leadoff panel tonight. peter baker, zero chief white house correspondent for the new york times. -- pulitzer prize winner for the new york times and former prosecutor -- glenn, did we -- when i heard april 26th, i honestly thought i misheard, it i thought it was a typo, i thought it was april 26 2024, but no, three years from now, what do you think about that? >> steph, the nicest word i could come up with for that request is, absurd. i would probably throw offensive in the mix as well. you know what is even more offensive? when you look at the first page of the motion of the trial seeking, this this ridiculous trial date, they cite the -- 1932 called power versus alabama, it is a case we all know. well, i teach it to my george washington university students, it actually involves a case where nine african american teenagers ages 12 through 19 were accused of sexually assaulting a white woman, they were forced to go to trial. they were arrested, arraigned, and forced to go to trial in two weeks, in a death penalty case without counsel. that is the case against which they are measuring donald trump's legal team being told they may have to go to trial within about six months or so. it really is deeply offensive. >> well donald trump and his allies keep arguing that there are two justice systems and he is being mistreated, asking for something three years away is that not the ultimate special treatment request? how do you think the judge is going to respond to this? you know her well. >> i do, i tried murder cases against, or and i was so upset to see the threat level against her and her family, i also have been to try murder cases against her husband when he was a public defender. these are long time dedicated -- now she's going to preside fairly, she's going to roll over back, u.s. marshals will protector as they protect all judges and provide courtroom security in all federal trials. she's going to have none of, this but you will be professional, and i have a feeling that everything donald trump is saying and doing including asking for a ridiculous trial date, is only moving the trial date up in her mind, so she can get to this child promptly and can give donald trump a fair trial and speedy trial. >> katie, we know jackson with team is going to fight, this what comes next? >> they are going to -- there will be an argument between the two sides, what will happen is, as glenn, said the judge will -- both sides are going to argue whether or not this is a fair deal. one argument of the trump team makes that does seem somewhat reasonable for -- this is a tremendous amount of evidence that they have to go through. in criminal trials, the defense team, they receive all the evidence the prosecution has, so they can have the strongest defense. it is just the way the legal system works. we are talking about terabytes of, information all of the video, footage all of basically all the social media, all the messages, everything you saw electronically happening around the january 6th attack, and that is just a piece of the evidence that needs to be gone through. so i do think the judge is going to have to weigh that irrefutable fact of just a voluminous evidence that the defense will have to comb through, with the idea of a speedy trial. clearly what the defense is looking for is probably not -- so we will see a date somewhere between what their two sides ask. i don't think the justice department is going to get its day either for a variety of reasons, including -- but again, it is really up to this, judge making a, ruling but in court, talking about a way that allows the american people to understand why she is ruled the way she has. >> but peter, we shouldn't be surprised, donald trump is the master of a delay and it has worked for him time and again. so should we be surprised? i mean this is what he has done in the past, and whether we think it is ethical or right, it has been a winning move. >> yes, it has been a winning move as far as he is concerned. -- as many motions as you, can move to recuse the, judgment have to change, venue move to exclude evidence, move to do this. and, the longer you do, it the more you push it down the road. now he is not going to get -- a trial date here, but remember, the real data that matters here, one way or another, january 2020, five is elected president again, that they are standing justice department guidance that democratic and -- sitting president cannot be tried for a crime. so if he were elected, this is scheduled for after january 2005, that automatically -- for u.s. unless somebody found some way to undo that which is hard to imagine. so you know, the longer he can delay, the long he can push this, off the longer he can -- find a way to get out of it in the short circuit prosecution -- >> plan, none of us should be surprised, just why donald trump would ask for these delays, the more surprising news today is that donald trump called of his news conference that he had planned on monday, where he was going to talk about the georgia election. the fact that he called it off which some have reported because his lawyers are basically saying, you continue to do, this and you will worsen the legal situation that you are in, is this a sign that maybe for the first time he is actually listening to his lawyers? >> it could very well be. i can't imagine he would exercise sound judgment on his own. i mean, we all heard him say, get ready for a full exoneration. exonerations do not come at press conferences. exonerations come after you presented a case that is jurors sitting in the jury box, and they are persuaded that you are not guilty. the government failed against proof beyond a reasonable doubt. and, they try to not guilty. so you know, it is surprising that somebody managed to talk donald trump down as well as -- because every time he makes a statement about his case, or the evidence, what he is doing is, he is boxing himself in. because, anything he says about why he did what he did is actually taken away another potential avenue of defense for his attorneys. so maybe once they had an intervention with him, and said please, stop you, know damaging our ability to represent you ultimately when the trial comes. >> a successful intervention with donald trump, that is something few people have seen. peter, you know what, what do you think is happening here? >> well look, that is possible. i think it is a logical conclusion. i think it is also conceivable that the lawyers are a good excuse to not have to live up to the promise he made, that may or may not be deliverable. there is no proof anybody knows of, the georgia election was anything other than free and fair. there is no proof at all of any of the allegations that donald trump may suggest that it would somehow be on his way had evidence been presented. so i'm not sure what he could have presented, and persuade, anybody now he has to actually present it while still telling his -- i have the audience, i can tell it to you, but louise don't need to. so we don't know, and i think again, two and a half years, out nobody has presented evidence suggesting there was -- overturn the election in any of the states, much less three or four -- overall outcome. >> and remember, there were audits and audits. how many were there in arizona, five audits? and, none of it. >> republicans who were his allies, time and time again, the claims have been debunked. >> katie, do you think jack smith is playing close attention to those georgia case, do you think you already knew most of what was in this indictment already, fani willis? >> sure, so much of what is in her indictment is like -- was made public either because a lot of it played out in public, or the press reported these things including -- but of course he is playing close attention not only to the indictment, but to what these defendants do and say. i think there's really interesting to see both meadows and giuliani, making the case arguing their case should be in federal court. giuliani probably doesn't have a strong case here, even though he said he was acting as the president's, lawyer it wasn't for government business, at best they could say was their campaign business. that would be covered in the -- make that move, but mark meadows was the chief of staff, so it will be u.s. joyce vance earlier, legal contributor, hard -- acting as the president cochise of staff, and you will see how the judge rules. but again, jack smith is -- to all of this, because of what people are saying in, court what they are doing, and how they represent themselves. they are all things he is thinking, about and could have some bearing on his case whether perhaps cutting deals, or testifying, and all things he could either potentially, use or potentially -- >> what do you think mark meadows and -- do you think it will successfully get their cases to move to federal court? >> rudy giuliani, no. he was not a federal officer, i don't think he is eligible to have this case removed in federal court. mark meadows, i think has a very -- and because i think it is -- to suggest that it is within the scope of the chief of staff to go to a state, election to oversee the recount, and i'm not all that persuaded with his lawyer puts things into motion, like, well what he does is schedule phone calls, and he scheduled meetings for the president. well, that does not make an effort to overturn the presidential election in a, state and part of your official duties as a chief of staff, something i would be really interested to hear is, how many other chiefs of staff new presidents of the united states have gone to states after the fact and participated in, or overseen recounts. if the answer is zero, which i suspect it, is i think that cuts against that being some of the ordinary duties within the scope of a chief of staff. >> peter, you recently wrote about trump indictments becoming routine. do you think there is a risk to -- because that is what people thought was going to happen with january six, and the whole country turned in. >> look, i think there is a risk of -- one political consultant or -- so -- told me in her weekly focus groups, people can't tell the difference between jack smith and fani willis, and alvin bragg prosecutions, all they know is the trump and -- they have already sided in which case is either a criminal who is finally being brought to justice, or a victim of persecution, and they fitted that those two -- but doesn't mean it is not important, and they are really crucial moments in our history, which we are testing the limits of accountability, and i think we will see this play out in the courtroom and a times in the next year, or whatever it is going to, be and people presented with evidence, witnesses, and if they will hear either direct on tv as -- media and cases where we don't have tv, what is at stake here. i think that is important for democracy and important for a country that is about half an election. >> all right, glenn, an attorney knew you know well who went from trump's human shield, to more recently hypercritical barr. i want to share what he said about donald trump earlier today. >> i think the chances are, that he will be convicted on some counts, but i don't think that translation to jail time. >> why? >> because i think if i was attorney general, and prosecuting for example on documents, case which is a righteous case, i would not want to see a former president in jail. i think a very substantial penalty will serve the public interest, but putting him in jail has too many collateral that impact on the country. >> hey, what is your reaction to that, and if not jail, time what is the substantial penalty? >> it is, steph. so i was in the courtroom, albeit -- when the judge, the matter magistrate judge announced donald trump's conditions of pre trial release. and, the magistrate judge said, and i quote, the most important condition is that you not commit any federal state or local crime. if you do, a warrant could be issued for your arrest, your release could be revoked, and you will be detained at the trial, jailed. what did donald trump do? within days, he posted something that violated georgia state law. he posted that and i'm paraphrasing that former lieutenant governor jeff duncan is about to testify to the grand jury, and i, quote he said, we shouldn't. in other words, he should not testify. what is that? the violates the state code section 16 dashed and that 93 for unlawfully influencing, were attempting to influence a witness. so what are the implications assuming that post a violates georgia state law? well, the federal law says, if you are on pretrial relief, and you violate a state law, as long as the prosecutors can prove that violation by a preponderance of the evidence be very low evidentiary standard, then the judge should revoke you on release and detaining you pending trial, incidentally for other violations of relief for example, if somebody violates a curfew or travel somewhere, the judge says the defendant should travel, then the burden of proving that violation is clear and convincing evidence, much higher than evidentiary heard of, but only probable cause if you violate state law. so is violation of georgia state law and lawfully attempting a witness should serve as a vehicle to revoke his release pending trial. let's see what judge -- does when next has donald trump in court in front of her. >> what about keeping these down in georgia safe? there is some trump supporters who are targeting them, posting their supposed names and addresses, online george investigators are already working to respond to what they call credible threats how do the courts protect these jurors? these are every day americans taking their time, doing their civic, duty talk about patriotism, showing up for that is being a patriot and now there are safety as that risk. >> you know, staff, these are people, citizens doing their civic duty. it is not easy, trust, me when we call people for grand jury service, it is extremely disruptive to their lives. we have to step away from their jobs, stay way from their families, they have to spend days, and, days and days in windowless secure grand jury room swearing evidence of crime. that is not easy to do. and, then you have donald trump supporters doxxing them, putting their address, their pictures, their information into the public square. why? i do not see it. attacking the media, what are these, things what fiction, joan find more magical thinking that these documents to to ron and casey the desantis. i'm not often speechless, stephanie, but i have found myself speechless tonight. >> i cannot believe that political strategist get paid big buckets of money to give advice like, attack him, attack joe biden 3 to 5 times along with the media. go after, take a sledgehammer to -- how much does someone get paid to give that kind of advice? juanita, why do you think they so worried about -- wouldn't you think donald trump is the target? >> you would think. but according to their recommendations, it seems like they want desantis to clear the path for trump, and make it quite comfortable by defending him every step of the way. when you talk about -- i think that would make a shameful move for desantis. because, reminding people of just how hard he has fallen, this is someone who was within arms reach of trump months, ago now talking about the -- he should be embarrassed that their names are written in the same sentence at this time. i feel like the embarrassment is -- i think the other striking recommendation is, of a human moment, mention your wife and kids, again treating desantis like he is a robot who needs to be reminded of the most basic factors of campaigning. it is ridiculous. >> let's talk about what donald trump is doing, right because he is going after fox news of all places. he is ranting about, it complaining about the polls they show, but also complaining about the pictures the use of him. he wrote on his social media platform, quote, the purposefully show the absolute worst pictures of me, especially the big orange one with my chin pulled way back. he is complaining about looking orange, and having a double chin. i'm pretty sure that is under his control, not the control of fox news. what is he doing? i >> mean we should remember he has never been -- when he thought they were not doing right by him and when it goes back to desantis, it looked like desantis was the favorite of the -- the thought that trump was all over, them trump was never been afraid to -- here is what he knows, he needs him more than he needs them at this point. and, he can make more -- i would say, also, it is just a reminder, stephanie, of how brutal and dense -- what i have noticed another picture of him -- i wouldn't have. but now we have all seen, it and -- as he possibly can, and i would just like to say that we never have to make anything up about this guy. he does it forest, and we just serve it up on a platter. and now, what is he worried about, you double chin and the orange skin. we are going to find every double chin picture we can, and -- that is what we will do. this is why he should have never been a -- man he is corrupt, and incompetent. aside from all the other things, the criminality, corruption, and the guy isn't -- never has been, he has battled, the job did not want to, job did not expect to win the first time. the only reason he wants it back now is to stay out of prison. you know what, it take a double, check donald, you will not have one after you get out of the georgia penitentiary, a policy that. >> this is to, much i really tried to raise the level of -- because as the former president going after his own appearance, i do not even know what category to put that in. so, there are new reports saying that pence and his team are super stock to get on the debate, stage and how they want to draw a contrast between him, and trump. do you really think mike pence is going to go scorched or than his former boss? he has had an unlimited amount of opportunities to do so up until this point. >> stephanie, this is going to be the biggest block of the debate, if from the -- one time even after he told him to his face, that they would put a target on his, back in an angry mob on january six. and, i don't expect the village self -- interest coming from mike pence next week, especially him trying to land punch trump. he cannot handle trump. that has been made clear repeatedly over time. >> and you know who knows that? >> yes. absolutely. it was designed to create a chilling effect on our publication. >> nationalist organizations, including nbc news, called the raid a violation of the first amendment. >> the response was like that of to the many drug cartel with its massive brain that occupation all the police and all the eastern half of the county. >> the search warrant accused reporters at the paper of identity theft and computer crimes, while investigating a local restaurant owner, carry newell. newell said the paper illegally obtained her driving record, which included a dui. meyer denies the allegations. he said the raid was a bullying tactic, and believes the stress contributed to the death of his 98-year-old mother, who co-owner the paper. >> if she had known that her death would have caused some people to notice this issue, i think she would have felt very proud about that. >> in the last five days, my yourselves he has received 2000 new subscriptions. most new leaders who don't live anywhere near marion, kansas. >> i'm honored to welcome eric meyer, co-owner publisher and editor of the marion county record. you saw him in stephanie's report. he is joining us now from the newsroom, where he is sitting at the part-time sports editor desk. why? because it is the only computer left in the building. eric, this is such an extraordinary upsetting on so many levels story. the search warrant has now been withdrawn. have you gotten any insight into how the raid was proved how this even happened? >> it's very interesting, because the probable cause affidavit, which normally preseason search warrant, was actually filed three days after the search. it contains, there was also a search done at vice mayor's house, and the probable cause affidavit for that clearly states that the vice mayor got the document which we were accused of supplying, her got a document from the source that we had, and that all we did was verified that the documents existed. we don't know why they searched her house. we don't know why they searched my mother's house. we don't know why they searched our office. the evidence that we had of the document that we obtained from our source was sitting on my desk. they didn't sees it. they didn't sees the computer of a reporter who had been investigating the police chief sometime earlier. she had been sick that week. she wasn't even in the office. there's also, we had just uncovered tonight new evidence, going through some of the probable cause things, and i'm not ready to say exactly what it is yet, but it hits of a political moment motive for this as well. >> the kansas bureau of investigations is looking into this. have you heard from them? >> we have not. we in fact have not heard from any law enforcement officer throughout this except for the fact that a week ago today, a week ago tomorrow, we sent them a notice saying we had come into possession of this document, and here it, is it if you have any questions about, it if you think there's a follow-up that is warranted to do about this, ask us, but we're not doing anything with it. we found out that this was really just some posturing in a divorce case between the restaurant owner angela estranged husband. he wanted to say that she had a dui in her drivers license and been suspended for 14 years. so that he could keep the cars. we told her that, she admitted that that's what she thought. in fact she knew what the source was. right after she had gone into a meeting and accused us. the political tie in of this is interesting because we have some evidence that the police and actually the city administration wasn't going to pursue this case instill there was a political motivation injected into it. we're working on that right now. i can't say anymore because that's our story for tomorrow. >> that will be your story for tomorrow because you are publishing your dam paper, which is extraordinary. we were so sad to learn of your mother joanne's passing. i know you called her an encyclopedia of knowledge. what would it have meant to her knowing that you and your staff pulled together and publish the paper as scheduled this week? good evening once again, i'm stephanie ruhle. donald trump is now seeking to delay his federal election interference trial until april of 2026. no, not next april 26, april 2026. that is almost three years from now. 17 months after the 2024 election. it is when his legal team proposed this evening in a court filing to the judge handling the case. they say, quote, must have adequate time to defend himself, citing the governments 11 and a half million pages of evidence, they said if the pages were stacked on top of one another, the result would be a tower taller than the statue of liberty and the washington monument. remember, jack smith has asked for jury selection to start in december, with a trial beginning on january 2nd of 2024. meanwhile the former president has been speaking out against his four separate indictments. today he told fox business, he wants his party to do a better job of defending him. >> it is just a continuation of silencing, they want to silence. you if you look, this is not even possible. it is a disgraceful thing. republicans can't get -- republicans have to be tough, if the republicans are great in many, ways but they do not fight us hard for the stuff. >> double fact check, yes it is entirely possible, and no, it is not a political fight. this is with the department of justice. it is about breaking the law. tonight, donald trump canceled a news conference he had been touting for monday, that he was going to use to discredit at the georgia election case. and a post on his social media platform, he said his lawyers had convinced him to places evidence of so-called election fraud to legal filings instead. before trump canceled the event, abc news reported his lawyers told him, holding the news conference would implicate his legal problems. there's also news tonight about a trump codefendant former lawyer -- asking to move his case from fulton county to federal court just like mark meadows. >> federal defense for me is acting as counsel, to the president of the united states, well my actions were as his lawyer. he asked me to be his lawyer. the day after the election. i was acting as his lawyer at all times, during the course of what is charged against me as crimes. >> and while all of this is happening, donald trump remains consistent. he's continuing to raise cash for his 2024 presidential campaign. today he was that national candidate tennessee for private fund-raiser. with that, let's get smarter with help of our leadoff panel tonight. peter baker, zero chief white house correspondent for the new york times. -- pulitzer prize winner for the new york times and former prosecutor -- glenn, did we -- when i heard april 26th, i honestly thought i misheard, it i thought it was a typo, i thought it was april 26 2024, but no, three years from now, what do you think about that? >> steph, the nicest word i could come up with for that request is, absurd. i would probably throw offensive in the mix as well. you know what is even more offensive? when you look at the first page of the motion of the trial seeking, this this ridiculous trial date, they cite the -- 1932 called power versus alabama, it is a case we all know. well, i teach it to my george washington university students, it actually involves a case where nine african american teenagers ages 12 through 19 were accused of sexually assaulting a white woman, they were forced to go to trial. they were arrested, arraigned, and forced to go to trial in two weeks, in a death penalty case without counsel. that is the case against which they are measuring donald trump's legal team being told they may have to go to trial within about six months or so. it really is deeply offensive. >> well donald trump and his allies keep arguing that there are two justice systems and he is being mistreated, asking for something three years away is that not the ultimate special treatment request? how do you think the judge is going to respond to this? you know her well. >> i do, i tried murder cases against, or and i was so upset to see the threat level against her and her family, i also have been to try murder cases against her husband when he was a public defender. these are long time dedicated -- now she's going to preside fairly, she's going to roll over back, u.s. marshals will protector as they protect all judges and provide courtroom security in all federal trials. she's going to have none of, this but you will be professional, and i have a feeling that everything donald trump is saying and doing including asking for a ridiculous trial date, is only moving the trial date up in her mind, so she can get to this child promptly and can give donald trump a fair trial and speedy trial. >> katie, we know jackson with team is going to fight, this what comes next? >> they are going to -- there will be an argument between the two sides, what will happen is, as glenn, said the judge will -- both sides are going to argue whether or not this is a fair deal. one argument of the trump team makes that does seem somewhat reasonable for -- this is a tremendous amount of evidence that they have to go through. in criminal trials, the defense team, they receive all the evidence the prosecution has, so they can have the strongest defense. it is just the way the legal system works. we are talking about terabytes of, information all of the video, footage all of basically all the social media, all the messages, everything you saw electronically happening around the january 6th attack, and that is just a piece of the evidence that needs to be gone through. so i do think the judge is going to have to weigh that irrefutable fact of just a voluminous evidence that the defense will have to comb through, with the idea of a speedy trial. clearly what the defense is looking for is probably not -- so we will see a date somewhere between what their two sides ask. i don't think the justice department is going to get its day either for a variety of reasons, including -- but again, it is really up to this, judge making a, ruling but in court, talking about a way that allows the american people to understand why she is ruled the way she has. >> but peter, we shouldn't be surprised, donald trump is the master of a delay and it has worked for him time and again. so should we be surprised? i mean this is what he has done in the past, and whether we think it is ethical or right, it has been a winning move. >> yes, it has been a winning move as far as he is concerned. -- as many motions as you, can move to recuse the, judgment have to change, venue move to exclude evidence, move to do this. and, the longer you do, it the more you push it down the road. now he is not going to get -- a trial date here, but remember, the real data that matters here, one way or another, january 2020, five is elected president again, that they are standing justice department guidance that democratic and -- sitting president cannot be tried for a crime. so if he were elected, this is scheduled for after january 2005, that automatically -- for u.s. unless somebody found some way to undo that which is hard to imagine. so you know, the longer he can delay, the long he can push this, off the longer he can -- find a way to get out of it in the short circuit prosecution -- >> plan, none of us should be surprised, just why donald trump would ask for these delays, the more surprising news today is that donald trump called of his news conference that he had planned on monday, where he was going to talk about the georgia election. the fact that he called it off which some have reported because his lawyers are basically saying, you continue to do, this and you will worsen the legal situation that you are in, is this a sign that maybe for the first time he is actually listening to his lawyers? >> it could very well be. i can't imagine he would exercise sound judgment on his own. i mean, we all heard him say, get ready for a full exoneration. exonerations do not come at press conferences. exonerations come after you presented a case that is jurors sitting in the jury box, and they are persuaded that you are not guilty. the government failed against proof beyond a reasonable doubt. and, they try to not guilty. so you know, it is surprising that somebody managed to talk donald trump down as well as -- because every time he makes a statement about his case, or the evidence, what he is doing is, he is boxing himself in. because, anything he says about why he did what he did is actually taken away another potential avenue of defense for his attorneys. so maybe once they had an intervention with him, and said please, stop you, know damaging our ability to represent you ultimately when the trial comes. >> a successful intervention with donald trump, that is something few people have seen. peter, you know what, what do you think is happening here? >> well look, that is possible. i think it is a logical conclusion. i think it is also conceivable that the lawyers are a good excuse to not have to live up to the promise he made, that may or may not be deliverable. there is no proof anybody knows of, the georgia election was anything other than free and fair. there is no proof at all of any of the allegations that donald trump may suggest that it would somehow be on his way had evidence been presented. so i'm not sure what he could have presented, and persuade, anybody now he has to actually present it while still telling his -- i have the audience, i can tell it to you, but louise don't need to. so we don't know, and i think again, two and a half years, out nobody has presented evidence suggesting there was -- overturn the election in any of the states, much less three or four -- overall outcome. >> and remember, there were audits and audits. how many were there in arizona, five audits? and, none of it. >> republicans who were his allies, time and time again, the claims have been debunked. >> katie, do you think jack smith is playing close attention to those georgia case, do you think you already knew most of what was in this indictment already, fani willis? >> sure, so much of what is in her indictment is like -- was made public either because a lot of it played out in public, or the press reported these things including -- but of course he is playing close attention not only to the indictment, but to what these defendants do and say. i think there's really interesting to see both meadows and giuliani, making the case arguing their case should be in federal court. giuliani probably doesn't have a strong case here, even though he said he was acting as the president's, lawyer it wasn't for government business, at best they could say was their campaign business. that would be covered in the -- make that move, but mark meadows was the chief of staff, so it will be u.s. joyce vance earlier, legal contributor, hard -- acting as the president cochise of staff, and you will see how the judge rules. but again, jack smith is -- to all of this, because of what people are saying in, court what they are doing, and how they represent themselves. they are all things he is thinking, about and could have some bearing on his case whether perhaps cutting deals, or testifying, and all things he could either potentially, use or potentially -- >> what do you think mark meadows and -- do you think it will successfully get their cases to move to federal court? >> rudy giuliani, no. he was not a federal officer, i don't think he is eligible to have this case removed in federal court. mark meadows, i think has a very -- and because i think it is -- to suggest that it is within the scope of the chief of staff to go to a state, election to oversee the recount, and i'm not all that persuaded with his lawyer puts things into motion, like, well what he does is schedule phone calls, and he scheduled meetings for the president. well, that does not make an effort to overturn the presidential election in a, state and part of your official duties as a chief of staff, something i would be really interested to hear is, how many other chiefs of staff new presidents of the united states have gone to states after the fact and participated in, or overseen recounts. if the answer is zero, which i suspect it, is i think that cuts against that being some of the ordinary duties within the scope of a chief of staff. >> peter, you recently wrote about trump indictments becoming routine. do you think there is a risk to -- because that is what people thought was going to happen with january six, and the whole country turned in. >> look, i think there is a risk of -- one political consultant or -- so -- told me in her weekly focus groups, people can't tell the difference between jack smith and fani willis, and alvin bragg prosecutions, all they know is the trump and -- they have already sided in which case is either a criminal who is finally being brought to justice, or a victim of persecution, and they fitted that those two -- but doesn't mean it is not important, and they are really crucial moments in our history, which we are testing the limits of accountability, and i think we will see this play out in the courtroom and a times in the next year, or whatever it is going to, be and people presented with evidence, witnesses, and if they will hear either direct on tv as -- media and cases where we don't have tv, what is at stake here. i think that is important for democracy and important for a country that is about half an election. >> all right, glenn, an attorney knew you know well who went from trump's human shield, to more recently hypercritical barr. i want to share what he said about donald trump earlier today. >> i think the chances are, that he will be convicted on some counts, but i don't think that translation to jail time. >> why? >> because i think if i was attorney general, and prosecuting for example on documents, case which is a righteous case, i would not want to see a former president in jail. i think a very substantial penalty will serve the public interest, but putting him in jail has too many collateral that impact on the country. >> hey, what is your reaction to that, and if not jail, time what is the substantial penalty? >> it is, steph. so i was in the courtroom, albeit -- when the judge, the matter magistrate judge announced donald trump's conditions of pre trial release. and, the magistrate judge said, and i quote, the most important condition is that you not commit any federal state or local crime. if you do, a warrant could be issued for your arrest, your release could be revoked, and you will be detained at the trial, jailed. what did donald trump do? within days, he posted something that violated georgia state law. he posted that and i'm paraphrasing that former lieutenant governor jeff duncan is about to testify to the grand jury, and i, quote he said, we shouldn't. in other words, he should not testify. what is that? the violates the state code section 16 dashed and that 93 for unlawfully influencing, were attempting to influence a witness. so what are the implications assuming that post a violates georgia state law? well, the federal law says, if you are on pretrial relief, and you violate a state law, as long as the prosecutors can prove that violation by a preponderance of the evidence be very low evidentiary standard, then the judge should revoke you on release and detaining you pending trial, incidentally for other violations of relief for example, if somebody violates a curfew or travel somewhere, the judge says the defendant should travel, then the burden of proving that violation is clear and convincing evidence, much higher than evidentiary heard of, but only probable cause if you violate state law. so is violation of georgia state law and lawfully attempting a witness should serve as a vehicle to revoke his release pending trial. let's see what judge -- does when next has donald trump in court in front of her. >> what about keeping these down in georgia safe? there is some trump supporters who are targeting them, posting their supposed names and addresses, online george investigators are already working to respond to what they call credible threats how do the courts protect these jurors? these are every day americans taking their time, doing their civic, duty talk about patriotism, showing up for that is being a patriot and now there are safety as that risk. >> you know, staff, these are people, citizens doing their civic duty. it is not easy, trust, me when we call people for grand jury service, it is extremely disruptive to their lives. we have to step away from their jobs, stay way from their families, they have to spend days, and, days and days in windowless secure grand jury room swearing evidence of crime. that is not easy to do. and, then you have donald trump supporters doxxing them, putting their address, their pictures, their information into the public square. why? i do not see it. attacking the media, what are these, things what fiction, joan find more magical thinking that these documents to to ron and casey the desantis. i'm not often speechless, stephanie, but i have found myself speechless tonight. >> i cannot believe that political strategist get paid big buckets of money to give advice like, attack him, attack joe biden 3 to 5 times along with the media. go after, take a sledgehammer to -- how much does someone get paid to give that kind of advice? juanita, why do you think they so worried about -- wouldn't you think donald trump is the target? >> you would think. but according to their recommendations, it seems like they want desantis to clear the path for trump, and make it quite comfortable by defending him every step of the way. when you talk about -- i think that would make a shameful move for desantis. because, reminding people of just how hard he has fallen, this is someone who was within arms reach of trump months, ago now talking about the -- he should be embarrassed that their names are written in the same sentence at this time. i feel like the embarrassment is -- i think the other striking recommendation is, of a human moment, mention your wife and kids, again treating desantis like he is a robot who needs to be reminded of the most basic factors of campaigning. it is ridiculous. >> let's talk about what donald trump is doing, right because he is going after fox news of all places. he is ranting about, it complaining about the polls they show, but also complaining about the pictures the use of him. he wrote on his social media platform, quote, the purposefully show the absolute worst pictures of me, especially the big orange one with my chin pulled way back. he is complaining about looking orange, and having a double chin. i'm pretty sure that is under his control, not the control of fox news. what is he doing? i >> mean we should remember he has never been -- when he thought they were not doing right by him and when it goes back to desantis, it looked like desantis was the favorite of the -- the thought that trump was all over, them trump was never been afraid to -- here is what he knows, he needs him more than he needs them at this point. and, he can make more -- i would say, also, it is just a reminder, stephanie, of how brutal and dense -- what i have noticed another picture of him -- i wouldn't have. but now we have all seen, it and -- as he possibly can, and i would just like to say that we never have to make anything up about this guy. he does it forest, and we just serve it up on a platter. and now, what is he worried about, you double chin and the orange skin. we are going to find every double chin picture we can, and -- that is what we will do. this is why he should have never been a -- man he is corrupt, and incompetent. aside from all the other things, the criminality, corruption, and the guy isn't -- never has been, he has battled, the job did not want to, job did not expect to win the first time. the only reason he wants it back now is to stay out of prison. you know what, it take a double, check donald, you will not have one after you get out of the georgia penitentiary, a policy that. >> this is to, much i really tried to raise the level of -- because as the former president going after his own appearance, i do not even know what category to put that in. so, there are new reports saying that pence and his team are super stock to get on the debate, stage and how they want to draw a contrast between him, and trump. do you really think mike pence is going to go scorched or than his former boss? he has had an unlimited amount of opportunities to do so up until this point. >> stephanie, this is going to be the biggest block of the debate, if from the -- one time even after he told him to his face, that they would put a target on his, back in an angry mob on january six. and, i don't expect the village self -- interest coming from mike pence next week, especially him trying to land punch trump. he cannot handle trump. that has been made clear repeatedly over time. >> and you know who knows that? >> yes. absolutely. it was designed to create a chilling effect on our publication. >> nationalist organizations, including nbc news, called the raid a violation of the first amendment. >> the response was like that of to the many drug cartel with its massive brain that occupation all the police and all the eastern half of the county. >> the search warrant accused reporters at the paper of identity theft and computer crimes, while investigating a local restaurant owner, carry newell. newell said the paper illegally obtained her driving record, which included a dui. meyer denies the allegations. he said the raid was a bullying tactic, and believes the stress contributed to the death of his 98-year-old mother, who co-owner the paper. >> if she had known that her death would have caused some people to notice this issue, i think she would have felt very proud about that. >> in the last five days, my yourselves he has received 2000 new subscriptions. most new leaders who don't live anywhere near marion, kansas. >> i'm honored to welcome eric meyer, co-owner publisher and editor of the marion county record. you saw him in stephanie's report. he is joining us now from the newsroom, where he is sitting at the part-time sports editor desk. why? because it is the only computer left in the building. eric, this is such an extraordinary upsetting on so many levels story. the search warrant has now been withdrawn. have you gotten any insight into how the raid was proved how this even happened? >> it's very interesting, because the probable cause affidavit, which normally preseason search warrant, was actually filed three days after the search. it contains, there was also a search done at vice mayor's house, and the probable cause affidavit for that clearly states that the vice mayor got the document which we were accused of supplying, her got a document from the source that we had, and that all we did was verified that the documents existed. we don't know why they searched her house. we don't know why they searched my mother's house. we don't know why they searched our office. the evidence that we had of the document that we obtained from our source was sitting on my desk. they didn't sees it. they didn't sees the computer of a reporter who had been investigating the police chief sometime earlier. she had been sick that week. she wasn't even in the office. there's also, we had just uncovered tonight new evidence, going through some of the probable cause things, and i'm not ready to say exactly what it is yet, but it hits of a political moment motive for this as well. >> the kansas bureau of investigations is looking into this. have you heard from them? >> we have not. we in fact have not heard from any law enforcement officer throughout this except for the fact that a week ago today, a week ago tomorrow, we sent them a notice saying we had come into possession of this document, and here it, is it if you have any questions about, it if you think there's a follow-up that is warranted to do about this, ask us, but we're not doing anything with it. we found out that this was really just some posturing in a divorce case between the restaurant owner angela estranged husband. he wanted to say that she had a dui in her drivers license and been suspended for 14 years. so that he could keep the cars. we told her that, she admitted that that's what she thought. in fact she knew what the source was. right after she had gone into a meeting and accused us. the political tie in of this is interesting because we have some evidence that the police and actually the city administration wasn't going to pursue this case instill there was a political motivation injected into it. we're working on that right now. i can't say anymore because that's our story for tomorrow. >> that will be your story for tomorrow because you are publishing your dam paper, which is extraordinary. we were so sad to learn of your mother joanne's passing. i know you called her an encyclopedia of knowledge. what would it have meant to her knowing that you and your staff pulled together and publish the paper as scheduled this week?
