week, setting up a fourth possible indictment for trump. also ahead, we will explain the new development in the department of justice's investigation of hunter biden and the special counsel now appointed to that case. and plus, we will bring you an update on the catastrophic maui wildfire which is now the deadliest in modern u.s. history. ♪♪ good morning, and welcome to "way too early" on this monday, august 14th. i'm jonathan lemire. thanks for starting your day and week with us. and we will begin with the latest on the devastating wildfires burning across the island of maui. firefighters there in hawaii continue to battle flames this morning as officials have now confirmed that at least 96 people have died. the wildfire now ranks as the deadliest in modern united states history, surpassing 2018's campfire in california which killed 85. hawaii governor josh green said the fires will likely be the largest natural disaster in his state's history, with damages estimated at close to $6 billion. hawaiian electric is reporting that power has been restored to 60% of maui residents. we of course will keep you posted all morning long. as the tragedy continues to unfold there. elsewhere this week after more than two years of investigating district attorney fani willis will begin presenting her election interference case before a grand jury in fulton county, georgia. a majority of that grand jury will have to sign off on an indictment for willis' team to press charges against former president trump or some of his allies. at least two witnesses that were subpoenaed by the da's office have confirmed their scheduled dates to appear. former lieutenant governor geoff duncan tweeted on saturday that he was scheduled to testify tomorrow. journalist george chiti also confirmed his tuesday slot in an interview with nbc news. >> so saturday afternoon i received a phone call from the da's office one of their investigators to tell me that i should come in tuesday to offer testimony to the grand jury that's investigating election interference here in georgia. very reluctant to act adds an agent of the government, as any, you know, good journalist should be. the only reason i'm doing this honestly is because i think that the stakes are that important to democracy writ large in the united states and because i have this limitation on what i'm going to be -- what i'm going to be asked about. >> former georgia state senator jen jordan and former state representative bee nguyen are also both confirmed to have received subpoenas. da willis has said she will announce any potential charging decisions by september 1st. and as he awaits those possible charges in georgia, trump is already testing the limits of a new protective order put in place in the federal election interference case against him. in court on friday judge tanya chutkan ruled that going forward trump's lawyers must review any notes he takes while looking at sensitive materials to make sure he is not copying down personal information about any witnesses. she also prohibited trump from having a phone out while reviewing those materials for that exact same reason. prosecutors requested the order after trump started attacking potential witnesses, special counsel jack smith and even the judge herself on social media. on friday judge chutkan warned the former president's lawyers that, quote, while he has a first amendment right to free speech, that right is not absolute. she added that the more a party makes inflammatory statements about this case the greater the urgency will be that we proceed to trial quickly. despite trump's lawyers insisting that he would, quote, scrupulously abide by his conditions of release it sure didn't take long for the former president to seemingly start breaking those new set of rules. on social media last night in addition to calling jack smith a, quote, deranged low-life prosecutor. the former president went after judge chutkan herself, sharing a post with her photo and a caption falsely claiming that she, quote, openly admitted she's running election interference against trump. later on trump wrote that she was, quote, very biased and unfair and that she obviously wanted him behind bars. last night attorney neal katyal who you know from msnbc posted this, it would not surprise me if judge chutkan called a hearing with trump's presence given his new remarks. joining us now msnbc legal analyst danny cevallos. we have a lot of topics to get through with him. thank you for being here. let's start with that new protective order. what is happening here? trump is seemingly so blatantly pushing back against it. what you've seen, do you think he has already violated it? the dwruj suggested she would give him some leeway, but do we think that neil might be right and we are going to see a hearing this week? >> we spent the last week ranking from one to four the not only pending cases against donald trump but if you include georgia the potential criminal case against trump but now i'm add ago fifth to the mix and it's pretty high on the list in terms of threats to donald trump's liberty and that is a potential contempt charge or any kind of penalty for violating not just judge chutkan's order but any other pretrial order insofar as he may threaten witnesses. i've imagined along with chuck todd donald trump standing at the podium during a debate pointing to mike pence and calling him a traitor or a rat. that's the kind of thing that prosecutors charge other defendants, defendants that no one has ever heard of, with witness intimidation. that's how seriously not just state prosecutors but federal prosecutors take the idea of defendants threatening for intimidating witnesses. so when people ask about what cases pose the most threat to donald trump, i might put right near the top not just donald trump's d.c. case but perhaps a greater threat is the potential he may violate that protective order by either potentially threatening a witness or revealing something that he learned in discovery. but i would just add that trump's own legal defense team in the d.c. case was open to a protective order. in fact, the parties were not that far apart, they just reached an impasse and when that happens it's not that uncommon to let the judge work it out and figure out and that's exactly what she did, she came out up with her own version of the order, gave something to the prosecution, gave something to the defense, neither side was right "on the money." the judge found the middle ground to be the best route. >> trump clearly decided this is good politics to play the aggrieved victim. there may be legal consequences he doesn't quite grasp. let's turn back to the georgia investigation now. we've known for a while that this was the window in august where charges were they to be filed would come. there's witnesses presenting evidence this week and testimony. what do you make of that and what does it mean for a timetable for any potential charge. >> siamak namazi. >> the scuttlebutt which is not reliable had potential charges coming as early as this week. to the extent there are additional witnesses coming in to testify that would suggest the timeline is pushed back even more, maybe a week, maybe more than a week. it's hard to say. that means the system is working the way it's supposed to because grand juries are conducted in secret and these witnesses were not supposed to know when they're coming in, it's only through watching the courthouse closely or watching the locations closely or putting our ear to the ground and figuring out that there's a possibility an indictment may come this week. but it equally could come next week if witnesses are still testifying. >> the doj on friday announced attorney general merrick garland announced they would be appointing a special counsel in the hunter biden case. later in the show we will talk about the political ramifications of that with anna palmer of punchbowl news, but just in terms of legal matters, if this has happened, does this increase the likelihood that hunter biden is going to trial, that special counsel david weiss suggested that it would, and does it necessarily mean that the investigation into hunter biden is widening or is this simply a tactical matter in order to bring charges outside of the state of delaware? >> the answer is yes to both. it is theoretically possible that the special counsel will be expanding the investigation to, for example, and this is just one theory that's out there, that you might need a special counsel if you were investigating or even had to speak to the current president, joe biden, but on the other hand it could be as simple as the fact that the plea deal broke down unexpectedly to both sides means that the case must go forward to trial and if venue for some of these tax crimes lies only in d.c. or maybe the central district of california, that could be why the special counsel status was sought, although the existing -- david weiss already had significant broad investigative and prosecutorial power, but it may be as simple as that, that as the government is now shifting to a trial mode, they need that special counsel status in their minds to take this case to trial, whereas as long as hunter biden waived venue objections or anything else, then theoretically they could have wrapped this up in the district of delaware, but i think it was a surprise to everyone, but i should also criticize both sides that you shouldn't walk into a plea hearing without everybody being on the same page. that's what led to this unexpected situation where they may be going to trial and now they need special counsel status to do that. >> hunter biden thought he was mere minutes away from putting his legal woes behind him. we do know that whether it's the expanding probe or simply a trial, this is going to now shadow his father's reelection campaign. msnbc legal analyst danny cevallos covering a lot of ground for us this morning. thank you for being here. still ahead on "way too early," we're learning new details about a deadly house explosion in pennsylvania. we have new video that shows you just how destructive it was. plus with the new school year about to get under way, there's growing concern about a teacher shortage across the country. those stories and a check on sports and weather when we come right back. a check on sports and weather when we come right back rsv is in for a surprise. meet arexvy. continues to target strategic locations on the black sea. a drone strike hit a dormitory and a supermarket injuring three people. it came just hours after a series of strikes in the eastern kherson region. in total, seven people were killed in that shelling, including a 3-week-old baby. this as ukraine is now reporting tangible progress in its counteroffensive, even while wading through countless mine fields on the battle front. on friday ukraine's military commander in the south said his forces claimed, quote, partial success as they took back territory near a kyiv village in the zaporizhzhia region. as the institute for the study of war notes, even small progress in this area by ukraine is strategically significant. russian forces have dedicated significant effort and resources into defending that region. back here in the states, five people were killed over the weekend when a house exploded in pennsylvania. the terrifying event was captured on camera. nbc news correspondent emilie ikeda has the latest on the investigation into the deadly blast. >> reporter: a western pennsylvania neighborhood in pieces after a deadly house explosion rattled the area. the terrifying incident in plum captured on a doorbell camera, you can see debris shooting across the whole block and the fireball that demolished several homes on saturday morning. >> we have a full building completely gone. we have copious amounts of debris. >> reporter: greg lives several doors down. >> as a police officer you hear an explosion and you run towards it. >> yes. >> reporter: he helped carry his neighbor from the raging fire, who now he says is in critical condition. >> we're fighting through the debris, the rubble, the fire trying to get our neighbor out of there, but not a second thought was given. >> reporter: authorities concluded the recovery effort, five people were killed including one child and nearly 60 firefighters treated by ems. as the cause of the explosion remains a mystery, gas has been shut off in this neighborhood as a precaution. >> at this point we can share that our system was operating as designed. it's still too soon to estimate when service will be restored. >> reporter: fire officials say the explosion leveled three homes and damaged at least another dozen in the pittsburgh suburb. such a force blowing out windows four homes away. >> i was sitting right here -- >> reporter: families like this one now left to pick up the pieces and face the utter devastation that claimed the lives of five of their friends. >> i was with three of them the night before and then not even 12 hours later we find ourselves in this situation. >> nbc's emilie ikeda with that report. truly terrifying footage. as millions of students get ready to head back to the classroom, school districts across the country are once again scrambling to find qualified educators. the president of the illinois association of regional superintendents of schools says the teacher shortage has gone from a crisis to a catastrophe. in some counties the shortage that many administrators hoped would be a post-pandemic hiccup, appears to now be becoming the new normal. in place. meanwhile the new york yankees fell even deeper into the basement of the american league east and at this moment are on track to miss the playoffs for the first time since 2016. the yankees influence last week. hurricane fernanda and a tropical disturbance off the coast of baja, california, that will eventually become a tropical depression. this is expected fernanda to become a category west. i'm jonathan lemire. reaction a pouring in after attorney general merrick garland announced on friday that a special counsel has been appointed to investigate hunter biden. the justice department says the u.s. attorney david weiss will be responsible for the ongoing probe into president biden's son, as well as any other matters that may arise from that investigation. now, of course, weiss was already overseeing the hunter biden case and is based in delaware. he asked to be appointed special counsel last tuesday and the attorney general agreed, saying it was in the public interest to do so. the move was announced shortly before prosecutors from weiss' team revealed in a court filing that plea talks over tax and gun charges against the president's son had broken down and the case would likely have to go to trial in california or washington, d.c. meanwhile, several republicans are publicly expressing that they're not happy with attorney general garland's appointment of weiss at special counsel, even after they initially asked garland to do exactly that. in fact, 31 gop senators wrote a letter to garland back in 2022 asking him to do exactly this, appoint weiss as special counsel, but now many of those same republican senators are saying weiss cannot be trusted given the plea deal he previously offered hunter biden. this is also when we note that weiss was appointed to his post by president donald trump. joining us now co-founder of punchbowl news anna palmer, she is an msnbc contributor. anna, help me understand this. this is something republicans wanted for a long time, the arguments they are now making against it are saying, well, weiss cut hunter a sweetheart deal so, therefore, he can't be trusted, or appointing a special counsel is just to now deflect attention from the hearings that the republican congress is having into hunter biden. let's be clear. no white house wants a special counsel appointment. are these republicans just too far down their own conspiracy theories? >> it's really interesting to see here. as you mentioned, the republicans on both the senate and house side for months now have been calling for doj to appoint a special counsel saying that weiss didn't have the ability to kind of investigate enough, now as this plea deal falls through finally doj has made that move. they are not happy with that. again, a lot of this language that you're hearing over and over from republicans is going back to that kind of theory that there's this two-tiered justice system, right? we've seen it and heard it a lot when it comes to how they defend or respond to the ongoing charges against the former president, but now you're starting to hear it when it comes to hunter biden and the investigation into him. in particular you're going to start to hear this in terms of what happens with the house judiciary committee who has actually tried to get on the calendar here a time for weiss to come and testify before that panel. >> and we should reup what our legal expert danny cevallos said earlier in the show, there is a chance this is a procedural thing, that he needed to have his title changed, weiss did, in order to pursue a trial in california or d.c. since his jurisdiction is delaware, but it could be signaling a widening of the investigation. are you hearing from the democrats you are talking to, what is their degree of concern that this is now something that is going to shadow hunter biden's father's reelection campaign. >> i think there is a couple things you hear from democrats. number one, frustration with republicans, right, saying, hey, if you look at what's happening with the former president donald trump and the number of indictments there and those cases ongoing, if he did something wrong we should be going after him. if hunter biden did something wrong, they should be going after him. so there's just frustration that they feel like when it comes to donald trump nothing can go wrong and when it comes to hunter biden everything is wrong there. i think the other thing, we really hear this, is democrats don't want to be talking about hunter biden when it comes to 2024. we are coming up on the one-year anniversary of the inflation reduction act. they want to be talking about joe biden's accomplishments. so i do think there is some concern that is this going to play in terms of the overall general election and just kind of this idea that lawmakers themselves are corrupt and that there's a problem with them. so that's going to be something that you see democrats having to defend against to say, this is kind of a family matter, right? you try to see democrats try to push this away, but this is going to continue now potentially for months. >> yeah. i mean, republicans engaging in some incredible whataboutism here. donald trump is the subject of four maybe more active investigations, also one of them to overthrow our very democracy, trump is running for president, hunter biden his name is not on any ballot anywhere. you mentioned the house gop that they are forging forward with their own investigations. give us a sense as to what they hope to do next in the months ahead. >> we really have seen foreshadowing in the last week or so, we've been kind of looking and seeing, you know, are republicans going to go down that house impeachment inquiry, you know, kind of that rabbit hole. it really looks like they are, right. they're forecasting that this is going to be what the states start to take this up in the judiciary committee and certainly this kind of lays some of the groundwork they've been trying to do in terms of trying to impeach president joe biden and it appears that they are full steam ahead here, that this is going to be kind of the main stage for house republicans. they've been putting together some of the pieces for the past several months but definitely the clearest signals in the last week or so that that is going to be the course of action that they are going to be taking. >> politically a risky move to say the least. we should also note some democrats praised president biden for being hands off with the department of justice allowing this to happen, the special counsel investigating his own son. hard to imagine his predecessor doing the same. co-founder of punchbowl news anna palmer, msnbc contributor and a big us live from london. good morning. another busy week of earnings and economic data on the horizon. please preview it for us. >> yeah, good morning, john. hope you had a good weekend. it is going to be a week where we're anticipating the markets perhaps will struggle for a little bit of the negative sentiment that has been flowing through the market for most of august so far. that is the anticipation. that's why you will see there is a bit of bright spots coming through in the numbers right now on the futures board, that's the anticipation anyway. on the earnings front we are seeing some of the retailers being of keen focus, the likes of walmart, target, set to bring up their earnings as well this week. you also have july retail sales set to also be released tomorrow. so a lot of data that really will showcase the sense of how the consumer is doing as well to the u.s. that will be very significant of course for the fed who of course will be looking at that data to see the strength of the economy and the strength of the consumer as they continue their hiking cycle, which may go on pause again. >> we will keep an eye on that to be sure. it feels like every time we talk about the economy where you are, united kingdom, usually it's bad news, recovering much slower than other parts of the world, including the united states, but its economy grew faster than expected in the second quarter of this year. give us a sense of how that happened and what does that mean big picture for the uk. >> yeah, so, i mean, it just means that there is at least a little bit of juice left in the uk economy. the anticipation was that it would flat line for the most part, so stagflation, so to speak or stagnating economy, 0% growth was anticipated for the second quarter, it happened and when are we going to stop pretending that this is normal? that of course is former new jersey governor and 2024 white house hopeful chris christie weighing in on a possible fourth indictment of former president donald trump. joining us now political reporter for the "atlanta journal constitution" greg bluestein, also a contributor for nbc in us and comes to us live from georgia. we know the da is starting to conclude her case. the governor, he thought and others, too, that an indictment could come this week. what's the latest you're hearing in terms of a timeline? is that still a possibility or do we think it's slipped a little bit? >> no, we are circling tuesday as the potential day when we could hear about indictment. we have two days of grand jury testimony behind closed doors starting this morning at the fulton county courthouse and we know of at least four witnesses, probably more, who have been called to testify. we have on the record now that the former lieutenant governor geoff duncan and george chidi have been called in to testify on tuesday. we expect an announcement as early has tuesday evening about a potential indictment of not only donald trump but also members of his close inter orbit. >> if it ends up not being tuesday it could be later this week. so if that does happen, what are some charges that are possible against trump and who else might face them? >> yeah, we're looking at a potential rico charges involving donald trump and some of his allies. we know that fani willis is a rico expert, she's used that state statute in georgia successfully in atlanta public schools cheating trial about a decade ago. we also know that her investigation has spread far beyond donald trump to members of the stake electors, to supporters who went down to a rural are georgia county, coffey county to copy election data, to other members of donald trump's inter circle including his former attorney rudy giuliani. we expect this to be a pretty broad and sweeping indictment if it actually comes out this week shoo we should note of course that this would be a state charge and in the hypothetical if donald trump were to return to the white house he would not be able to attempt to self-pardon a state charge while he possibly could a federal one. we will see how that stands up in the courts, though. greg, there is another branch of this election investigation and it's the alleged breach of the voting systems in coffey county, georgia. there's been new reporting out this last couple of days. tell us more about that aspect this have investigation. >> coffey county is a rural county in south georgia, very republican, this is not a swing county, this was not a very competitive county whatsoever, but what emerged after the election was that it was found that several trump -- a team of trump supporters and data analysts went down to coffey county's board of elections, they were spotted on surveillance video, the visit was captured by surveillance and they copied election sensitive voting data, election data, hours, they spent hours behind closed doors there copying that data. we expect that infiltration to be a significant part of fani willis' investigation. it's just one facet of what we expect to be rico charges that centers on trump and his plot to undermine and overturn joe biden's election victory here in georgia. >> we just saw some of the footage from coffey county just now. significant week in fulton county, georgia. we're glad, greg bluestein could be with us as a preview. we will talk to you again on "morning joe" later and i'm sure a bunch this week. up next on "way too early," pork chops, games, protesters, even rap music. 2024 music. todays descended on iowa to attend that state's fair. but did they move the needle with republican voters? (psst psst) flonase. all good. several republicans running for president made appearances at the iowa state fair. but it was donald trump's brief visit to des moines that seemed to grab the most attention. the former president was there for under two hours arriving with about a dozen u.s. house members from florida in a not so subtle dig at the sunshine date governor ron desantis who of course was also there. trump talked to the crowd re350e9ing his blatant lie about the 2020 election being stolen. >> you know we didn't -- in 2016 we won. i hate to say this, but we did much better in 2020. the election was rigged. so we're back. we're way up in the polls in iowa and all over the country. up by over 50 points. a lot, but we don't want to take any chances. we'll be back. >> and meanwhile desantis received a mixed reception. he was heckled by trump supporters throughout the day including his appearance with iowa's governor. >> you know what, you know what, we're in iowa. and in iowa, we're iowa nice. so let's give everybody the opportunity to hear our candidates. >> now, while desantis was speaking at that event, the trump campaign trolled him paying for a plane to fly overhead carrying this backer, banner, being like only, ron. and also also this rap from ramaswamy. and this song is more than two decades old which makes me fee ancient. i'm got going to give any musical performances. but give us an over view of the iowa marker. was trump the big headline sner. >> yes, to your point trump was the big headliner. and to quote a rap lyric from jay-z in the hip top anniversary, it is like votes are looking at desantis he is all right but he's not real. so they like him but not eming him to the degree that they embrace donald trump. he sucked the oxygen out of the state fair the minute he descended on iowa. and it was a risky move to bring another state delegation to iowa, but it worked for him. >> and he's never been that popular in iowa, but up big in the primaries. so tell us about the other candidates who clearly need to do well in iowa. >> yeah, you saw mike pence carving out this very interesting lane, which is essentially trying to say that this really republican donald trump traditional lane. he is not diverting from that. and while he is also ultimate doing -- he is touting up for the tact that he stood up for the constitution. but it doesn't seem like that republican voters have an appetite for anyone outside of trump. of course the sub text of all of this is the fact that as you mentioned that trump is just mired in a myriad of investigations and whether or not republicans will tire of some of the antics between now and maybe january when iowa voters go to the polls and caucus. >> was there any sense among the republican voters who were there of a fatigue or worry about any of the investigations that even if they side with him, but they just simply think that that might make him unelectable? >> and interesting point because republican primary voter aren't looking at that general electability formula. because that would benefit ron desantis. again, they like ron desantis, but they don't feel that he is the right fit for this moment right now. they feel that the investigations with trump affirms their views that trump is the real fighter for them. thatis essentially what they are subscribing to. and they are overlooking at the drama and the investigations will make donald trump to unseat 2024 in that that much more challenging. >> and of course next week all eyes on the first debate. donald trump has not committed to going. it had been suggesting that he wouldn't. he was asked whether he would attend and he called it a good question and said it would be interesting. so maybe he is leaving the door open. what is the latest that you are hearing as to whether he will show up? >> essentially there is a 99% chance that he won't debate. they are leaving that 1% open because of course this is trump and anything could change at the last moment. again, you have a case where trump trying to tease, keep the oxygen and spotlight on him. and he loves that. and that works to the benefit of christie and others trying to goad him on to the state. it is like a basketball basketball. essentially he is waiting to take on the last shot. >> and so mario with basketball and jay-z lyrics, we thank you. and so "morning joe" starts right now. donald trump giving vaughn hillyard a new nickname, answering questions about the 2020 election and whether or not he would take a plea deal. and it comes
