his lawyer's latest moves and the battle of the special counsel's request for a protective order. while jack smith fires back with his own response. then ron desantis about face on his biggest 2020 election lies, as he attempts to revamp his 2024 campaign. and a look ahead to tomorrow's political special election in ohio. what it could mean for the state's constitution and the fight for abortion access. -- as the 11th hour gets underway on this monday night. ♪ ♪ ♪ >> good evening once again. i am stephanie ruhle. we begin this evening in washington, d.c. where lawyers for former president donald j trump have responded to special counsel jack smith request for a protective order in the 2020 election case. trump's team countered with a narrower protective order that would allow him to publicly discuss some of the evidence collected by the government ahead of the trial. the special counsel's office came back just hours later urging judge chutkan to forego and additional hearing and sign off on the government's proposed protective order. jack smith's team said donald trump once to try this case in the media rather than in the courtroom. and our friend glenn kushner, glenn kirschner said it best last week, judge tanya chutkan, she doesn't play. and we saw that tonight when she wasted no time responding at nine pm on monday night, ordering to see both sides and getting them to agree on a time for a hearing on this protective order, on or before this friday. all this after the former president spent the weekend attacking the judge personally and the special counsel on his social media platform. former doj official mary mccord says all of this is just part of trump strategy. >> i think this is really a delay tactic. mr. trump is now the defendant in an ongoing criminal proceeding. and they are treating this as though he is still just an ordinary citizen, who whose rights cannot be restricted at all. and that is not just the way it works in the criminal law, rightly or wrongly, the law provides a showing of the requisite predicate cause. there could be restrictions on people that can be restrictions on their liberty. many, many defendants in criminal cases and up detained pre trial. there can be restrictions on their speech. and i think that is something that mr. trump and his attorneys so far are not really acknowledging. >> in addition to writing up that 29-page response, trump's lawyers spent their weekend work shopping potential defenses, guess where? on television. here's that one lawyer john lauro how he responded to a question about mike pence's testimony. >> he said the president asked him to violate the -- it's another way of saying -- >> he never said, no, that's wrong. a technical violation of the constitution is not a violation of criminal law. that is just plain wrong. and to say that is contrary to decades of precedent -- legal statutes. >> let's take a deep breath because for fact sake, we all learn in middle school civics that the constitution is the law of the land. so a violation of the constitution is by definition a violation of the law. lauro also claimed that pence's's testimony would help trump, saying the former president would be acquitted if his vice president is called as witnesses. but do not forget, mike pence is not the only former trump official who could testify. >> i have no plans to testify or. but, look, we will always comply with the law. >> where you interviewed by the special counsel? >> i'm not gonna get into heavy discussions about -- >> would you appear if a witnesses call? >> of course. >> of course, this is just one of the many legal proceedings the former president finds himself subjected to. trump is potentially facing seven trials before next year's election day. three civil, four criminal. meanwhile, there is also news in the classified documents case. today, judge aileen cannon who is overseeing that case down in florida has asked the justice department to explain its use of a d.c. grand jury in its continuing investigation. there's a lot to govern. let's get smarter with the help of our leadoff panel tonight. pulitzer prize winning journalist philip rucker, he is the next national editor for the washington post. kyle cheney is here, politico's senior legal affairs reporter. and tali farhadian weinstein, a former federal and state prosecutor in new york. she clerked for merrick garland and justice sandra day o'connor. tali, let's talk about this timing. jack smith just took three hours, that is it, to respond to dozens of pages from trump's team after three plus days. and then, judge chutkan responded just a couple of hours after that. is trump's team firsthand, this is what happens when you face off against the world's largest law firm? >> indeed, stephanie. and i think that part of why everyone has been able to move so quickly is that what jack smith had to say in that motion is so totally obvious. which is that a defendant does not have the right to publish discovery. a defendant has a right to a discovery, and remember, discovery is evidence that the government has gathered. for example, transcripts of interviews with witnesses that the government has conducted. a defendant has a right to see that and to use it in any of his defense, not to put it out there, and particularly not in a way that might undermine the integrity of the proceedings or in some way intimidate or affect witnesses and people who are going to bring in evidence. and, you know, sometimes i find it helpful, stephanie, to just recall, most of my career was violent crimes. and i almost always saw protective order, to make sure that a defendant would not cross those lines and take the discovery that we have put together and use it in ways that are obviously prohibited and undermine the rule of law. >> kyle, what are you watching next in this dispute? >> so as you noted, the judge was extremely quick about getting us on the calendar. so, she is still moving at a pace that i think the trump team said, we don't want to move at that pace. you know, they didn't want to meet until later in august. they did not want to have this conversation until at least the end of this week, let alone having other hearings before the end of this week. so, i think the fact, you know, what we need to see here, essentially, you know, how that hearing unfolds. i think the government is very squarely saying that donald trump should not be left to try this case in the press. they reported to his lawyer going on tv five times on sunday. they pointed to trump attacking pence on social media. that is trump's standard and oh. if the government wins this fight, how is trump going to operate, you know, his campaign going forward. it's the only way he doesn't, he knows how to operate witches attack, attack, attack anyone who he perceives as being his opponent and so, these two things are not compatible right now. >> all right, phil, i promise not to ask you to our questions tonight. i know you are coming off a huge weekend. you celebrated your dog's third birthday party. you threw a birthday party -- how do i even say that, that is insane. so i won't make it too tough. but i do want you to get inside the mind of donald trump because it's what you do best. he is now facing several trials. this man is not used to being a criminal defendant. walk us through, he will be sitting in a courtroom, right? as the judge provides overall rules, witnesses, one after the other, many of whom may have been his colleagues, may have worked for him, potentially testifying against him, while his rivals will be out on the street campaigning against him. how is donald trump going to be able to handle this? this man, he needs to set the tempo and control the narrative. >> yeah, stephanie, first of all, it is likely that it's gonna be an unprecedented unprecedented moment in history where the leading republican candidate for president is facing trial on multiple fronts. you are right to point out that there would be all these witnesses who are close to him. there may even some witnesses who are working on his campaign, several of his own campaign advisers, helping build his presidential campaign right now, they were key figures in the indictment and are, you know, potentially going to be called as witnesses in this january 6th trial. meanwhile, you got the classified documents trial. you've got the possibility of another indictment in fulton county, georgia. all of this colliding with the presidential campaign calendar next year. and one of the things we've seen trump and his legal team try to argue, at least in that florida case, is to delay the timing of a trial. trump very much wants to try to secure the republican presidential nomination before he gets bogged down in these courtrooms. and he seems to have a belief. in fact, he has said it out loud on social media, and in rallies he said if he were to get elected as president, he could potentially, you know, try to undo some of these legal problems that he is in. and, so he wants to delay as much as possible, and what you are seeing from jack smith and the prosecution is an effort to speed things up to move very quickly, decisively, and try to bring these cases to a trial as quickly as possible. >> well, in theory, or logic would tell you that trump and his legal team are on the same page publicly, maybe not privately. but we are hearing, i'll, donald trump publicly demand this judge to recuse herself. and not hearing that from his lawyer who was all over television. why are they not in lockstep? what are you hearing? >> this is another example, you know, trump being out front of his legal team, we've seen this play out behind the scenes in some ways. we've seen tensions emerge in other, you know, criminal and civil matters that trump and his team, depart, there is differences in legal strategy. trump wants to go after this judge. he wants to say she is biased, appointed by barack obama. and that just makes her unacceptable as a judge. whereas judge cannon, his own appointee in florida, he said only kind things about her. that's clearly not a basis for a recusal. just political affiliation of the appointed president. however, trump is trying to make this case right now. his lawyer is not ready to go there and that big media tour that he did, he very carefully avoided that subject, and he actually said on a separate podcast, we haven't even decided if we are going to do that yet. yet on monday morning, trump came right back and said she needs to recuse. they are clearly not aligned on this. whether that were to force trump lawyer in, and they'll actually find something he doesn't want to file, that's a different question. but trump, he is pushing that issue forward. >> it is tough for republicans on the hill to push this. and judge chutkan was confirmed to the bench 95 to 0. tali, and the other defendant and the world would already be facing consequences, potentially including pretrial defenceman, detention for going after the judge, which is exactly what trump has been doing over the last week. what options does judge chutkan have here? >> stephanie, she has a range of options. and they can build up over time. i do expect that she will put serious restrictions on what he could do with discovery, and what he could say, not in terms of political opinions. i mean, he is of course free to express those. but what he could say that could interfere with the administration of this case. and that's going to put him in peril, the more restrictions that she puts, you know, the greater danger he is in, that she ultimately will have to say, you know, you will be further restricted, you might only be able to see this stuff in particular spaces under very tight circumstances, all the way up to detention. so, i think this is going to ratchet up overtime. >> phil, how worried is trump's team that he is going to do something that will force this judge's hand either out of the trial or even worse, once it begins. >> they should be pretty worried because this is an undisciplined defendant. we've seen that over time, including throughout his presidency. and i think it helps explain why trump's lawyers have been so adamant in pushing back against this request for a protective order to try to create, build structurally as much freedom as possible for their client, to be able to talk openly on social media and on the campaign trail about the discovery, about the various potential witnesses, about the prosecutor himself, and even about the judge. i mean, they're trying to create some space for trump because they know there's really no way to control what he says or to have him be disciplines defendant in any way. and just to underscore how extraordinary this is, it is really not normal to see any sort of criminal defendant out there in public, trashing the judge, trashing the prosecutor, trashing the sort of overall credibility of the case itself. but that is what we see from trump every day. >> still, this is not normal when out the window about six and a half years ago. this one does boggle mind. trump's defenders have been testing out this idea that he asked pence to overturn the election in a quote, aspirational way. i'm not even sure i know that means. but given, that does the prosecution have to prove what donald trump believed? >> no. it does not. so stephanie, this is a part of the bigger strategy. obviously one of the pillars of the defense is to say things that are speech. that come out of your mouth, can't be crimes. we know that is not true. obviously, if you ask somebody to kill somebody, to do something illegal. or you fraudulently induced somebody into an investment, that is bogus, just because you talked about it does not mean that it is not a crime. and a cousin of that is this idea that if he believed that he won the election, then nothing, and no action he took afterwards could be a crime. of course that is not true. for example, if you think that the bank somehow defrauded you and owes you money. that does not mean that you can go and rob the bank or ask somebody else to rob the bank for you. so, this idea. the special counsel puts this in the indictment. he said he was free to believe what he wanted. to say what he wanted about the election. he was not free to take certain actions that are crimes based on those beliefs. >> tally, if you ever lose your voice in the next nine months, we are just going to get you a little sign that goes of course that's not true. of course that's not true. of course not true. kyle, let me ask you about mike pence and bill barr. they say that they will appear as witnesses if they are asked. have you heard anything about others who could be more susceptible to be witness intimidation atoms from trump? o'neal says that a lot more than jack smith has. >> yeah. it's hard for her to heart from the spotlight, she's a publicly elected official. been able to get trump book vance, around town. look, she said she's ready to go. we know behind the scenes that there is still a few more things she's got to do. we know for instance that she has subpoenaed at least for witnesses. none of them have gotten the 48-hour notice to show up and testify behind closed doors. that does not mean that there is a delay or anything like that. but at this point, it would still be shocking if we don't have any sort of news from fools. any announcement within the next week or so. so we are expecting in this week, early next week. that's sort of the timeframe we're looking at right now. >> let's talk about jeff duncan, that is not a name our audience is familiar with. but they could be soon. he was one of the republican officials who spoke out against trump's election misinformation. tonight he says that he will testify to a grand jury. how important could that be? >> this is crucial. because as you mentioned earlier, there is about three other witnesses. two of them are former democratic lawmakers. one of them is an independent journalist. there is other witnesses to we haven't been able to confirm on background or on the record. jeff duncan is a conservative republicans so he comes at this from a different perspective. he is no fan of the former president. he broke with during the election cycle. he spoke out very frequently, very publicly about pro trump conspiracy theories in election fraud lies. wrote a book called gop two point oh about a republican path forward beyond donald trump. even refused to endorse his successor, lieutenant governor robert jones. going to give these grand jurors a different perspective then he democratic lawmakers could. about the impact of donald trump's lies. and efforts to overturn georgia's election. >> we hear over and over in general terms that if you wait long enough, if trump were to be the elected, he would just make all of these cases go away. if there were republicans controlling these states, they will fix it for him. but in georgia, if trump was convicted in your state, georgia is one of only six states where the governor currently, republican brian kemp does not have pardon power. how would a pardon work in georgia? >> exactly. the governor does not have direct authority to issue the pardon. instead he points a board of pardons. five members of the board, some of them were appointed by his predecessor. so he has no direct control. that board of pardon its behind closed doors. i've covered them for years. it is shrouded in secrecy. but they are at arm's length from the governor. this dates back to 1943 georgia. when former governor at the time was accused of selling pardons so at the time lawmakers said we will separate the governor from this process. and since then, there have been a lot of governors who have frankly been relieved by that. that they do not have ultima thule in the hands. >> people in georgia, across the country really have been talking about this for months and months. but take us local. now that you are actually seeing barricades go up, actually it seems like this is coming. are people worried, are people talking about it? what's the mood? >> top of the town is sort of an understatement. it's all i get asked about the, jim at coffee shops in my neighborhood. but politicians are not eager to talk about the subtle. of course republicans do not want to bring it up. they see it as a distraction. if they, do they talk about a politicized justice department. it's interesting, because democrats here in georgia all also not really invoking donald trump's legal problems. they're taking cues from president biden. doesn't want to play into the gop narrative of a politicized justice department. and said, you're hearing democrats talk about the issues that really dominated in 2022. abortion, rights gun control, the economy, public safety. taking steps to curb inflation. those things that really polls showed factor into georgians election decisions. >> so when you are waiting to get on the treadmill at the gym, somebody is tapping you on the shoulder and they are like greg, is he getting indicted? >> that's the problem of going to the gym where i grew up. so, yes not only my friends but my parents friends will come out and said what's the deal? what's happening with donald trump? >> unlike look, when i, know you'll know. >> greg, came good at the grocery store without his mom's best friend asking him hey greg, what's the deal. all right greg, always good to see you. congratulations to your daughter, first day of seventh grade. hoping she has a great year. >> thank you. coming up, no more dancing around the question. rhonda scent is admits that his true view on the 2020 election. but will make a dent in trump's lead? of course he lost. it took years, and an exclusive interview with nbc's dasha burns but ron desantis stop sidestepping and finally admitted what the rest of us already knew. that cold hard truth. that donald trump lost the 2020 election. let's bring in jason johnson, a politics and journalism professor at morgan state university. and mark mckinnon, former advisor to both george gonna be bush, from cain. among the hosts of the circus on showtime. jason, i turned you first. on desantis admitting donald trump lost. is it too little too late? and what does that do to the mega voter that he needs? >> i've been saying this for months. i've said this all through last year stephanie. that literally this is going to be the first question any potential republican debate. who do you think when the presidential election? and here's the catch. you were always in a trap as a republican running against trump. because if you believe that joe biden treated. and stole the election from donald trump. then you have no justification for running. and if you think that donald trump lost the election. then 35% of the republican electorate will not vote for you. so somebody was going to fall into this trap. and i'm sure that ron desantis knew this was his only chance to least be on the news. because i don't know if you seemed to make it to iowa. so i'm not surprised by this. somebody was going to have to say that some point. besides chris christie. and ron desantis, whose campaign is leaking funds and supporters. and losing staffers. this is the kind of adobe decision he would say in early august for a campaign that will barely make it to iowa if he's lucky. >> mark, what do you think? >> well first of all, great interview. i think there are three components. a practical consideration, a strategic consideration and a psychological one. and the practical consideration is, as was just pointed out that it's problematic to talk about trump not winning one 35% of the base or more of the republican party believes that he has been, that he didn't win the election. >> the psychological component, the strategic components that is important for anyone running against trump on the product is a loser. that's how you ultimately convince the primary electorate that you change horses. because trump, even if you love the guy has problems winning the general election. and i think increasingly we see that the polling is going forward. and psychologically it's going to drive trump crazy talking about and losing. >> jason, one strategy rhonda santos is not changing, we shouldn't be surprised. his signature, the anti woke agenda. even flow there's new polling out for the times that says gop voters are not even buying it anymore. so i lean into it? it's his only game? >> what else has he got? look, stephanie this is hilarious to me. i do not know when republicans are going to understand that going to war with popular culture doesn't really when you anything. it sounded cool when it was reagan back in the 80s. but mitt romney going after big, bird he probably lost every week in america. right, i'm gonna put big beta job. you seem like a horrible person, iran desantis saying i'm going after disney. do not understand, that's not just mickey mouse. if you say you are after, disney you after the avengers. you are saying you don't like captain america. wars on wokeness do not work, because the kinds of people who believe in that kind of stuff, they either don't vote or they are voting republican anyway. and anyone else who's an independent, everybody else who goes to movies, who likes tv shows, they do not like hearing that. they want to go, sports go to movies and enjoy themselves. every time you hear republican say, go local broke. look at what barr, he barely made a billion dollars. go, october. what happened with entered the spider-verse? about a black spider-man. it's not a winning strategy. and i'm not surprised desantis is not holding on to, because he's a loser to. >> mark, what do you think? >> well i'm not sure i agree completely, listen on desantis is sitting at 20% in iowa right now. which is about twice any other candidate running is. it's a problem. the whole woke strategy is problematic in the journal trump is a distinguishing feature in the republican primary. 25% of the voters like that message. so all you've got to do is get enough to break out in iowa. and then push on to new hampshire. so, listen as i said i don't think it's a winning general election strategy, but i think it is a distinguishing factor that could help desantis. i'm just not ready to bury him yet. i think he's got staying power, he's got money. and i think people message appeals to enough of the primary electorate. as i said, it's a distinguishing factor. >> let's talk trump. because new polling shows that a majority of republicans believe these indictments are just an attempt to stop his reelection campaign. how alarming is that? because we need to remind our audience that among other things, he is being charged with trying to defraud the united states of america. what do you think about the way we republicans are reacting to this mark? >> they are just feeding off of what trump is telling. and of, course i think long-range, listen we still have six months until iowa. and as we get a fourth indictment, we see more and more polls between now and i will. and we see that well he has strengthened the primaries increasingly problematic for donald trump. in the general election, then this is joe biden. i think that is going to sag. and i think ultimately, the voters who appear to be for donald trump, it's kind of the opposite of 2016. in 2016, it was very unpopular to say your for trump. this cycle, it's unpopular to say you are not for trump. so these are kind of just goes to voters that could easily disappear at the map when i was around. >> jason? >> look, there is a certain amount of the republican organization that are just cultists and it doesn't matter. these are the people trump was talking about. i could shoot somebody on fifth avenue and nothing would happen one way or another. it doesn't shock me stephanie. nothing about the current form of the republican organization shocks me. if people look, how can i be surprised that somebody thinks all of these investigations are a deep state planned to take out trump. these are the kinds of people who thought a pizza joint was for child trafficking. right? (sfx: family screams in background) >> tomorrow voters in ohio cast their ballot. he was not will have a major impact on abortion rights in the state. but it is a little complicated. bear with me. this all started when abortion rights supporters got enough support to put a measure on the november ballot. it would protect abortion rights in ohio's state constitution. but republicans control the legislature tried to restrict abortion rights. so in, response they called for a special election. that's happening tomorrow. that special election asks if a constitutional amendment should be a 60% majority but instead of just a simple majority. it would make it a whole lot harder to pass any constitutional amendment. just three months before the state votes on abortion rights. so basically, they are trying to change the rules right before the big game. joining me to discuss, ohio state representative sweeney. representative, help us to understand your reaction to republican colleagues calling this special election. >> quite honestly, it's not shocking. it's a waste in order to change the rules of the game. to remain on accountable for the people of ohio. to do what they want for themselves and for their special interests. >> republicans picked the number, a 60% threshold. and usa today suffolk university poll last month found that 58% of ohioans support the abortion rights measure. so just how transparent is this move? you've got a 58% that supported, we want you to get 60%. >> oh, they do not try to be clever. they could not be more transparent. they've set themselves, this is specifically about stopping the rights for individuals in ohio to have reproductive justice in the state. >> bloomberg is reporting something that on a national scale surprises people. that business groups in ohio are siding with abortion opponents. because they want to make it harder to pass amendments for things like raising the minimum wage. is that true? if, so what's your take on it? >> we did have a few business groups come out in committee. they said that they are fearful of increase in the wake. but the fact of the matter, there are hundreds of organizations from across the spectrum. we have five former attorney generals for previous governors, republican democrats who've come against this. fact of the matter is that we have a wide coalition of individuals voting now. who understand that this is about abortion. but it's also so much more about abortion. because this is really about the state of a how democracy. >> the ap reports that both sides of the amendment she have seen out of state money pouring in. what does that tell you about how important this is for voters to have this power? >> this election is about whether or not the people, the citizens of ohio have power. and the republicans, my republican colleagues have indicated that this is a way to stop special interest while the single biggest fall funder of the campaign isn't out of state billionaire. this opponent have grassroots opponents of this. people are knocking doors organizing. it's about ohioans versus state special interest. i am looking forward to the people of ohio rejecting that. >> is this a wake up call though? this might be happening in ohio, but we are talking about here tonight. because this could be a national issue quickly. is it a wake up call for people in other states? about the power of state legislatures? because when you talk to the average person, four out of five americans cannot name their state rep. >> absolutely. i would say the state legislature has more power over people's lives or more influence than almost any other form of government. people aren't aware. this is just the latest attempt of the republicans in ohio. moving the goalposts, changing the rules of the game in order to cement power for themselves. so that they can do what they want against people of ohioans. we have seen similar ballot initiatives try to subvert the citizens to actually check their legislatures in other states. and we know it could be coming to other states. and we are hopeful in ohio that we will show other states that they should not attempt there, because we'll rejected soundly. >> what is the most important part of this that you want people to understand? people who are not in your state. aren't focused on what's happening in this election. why should we care? why is it important? >> because this is truly about the sake of democracy in ohio. and i do not think that is hyperbole to say that. we are talking about whether or not the legislature actually is beholden to the people that gives it its power. i've watched in the past year alone, as the republicans have when democrats started winning elections. we just passed the republicans to strip them of their power. when democrats started winning. elections on the states supreme court. they added party labels in order to make sure they continue to have power. i have watched as the republicans in ohio have ignored. six different rulings over our maps that say that the maps they produced are illegal gerrymanders. and they continue to go forward. this is truly, whether or not the legislature has to listen to the people of ohio. it is about abortion. and you can hear it from our secretary of state frank rose who said it unequivocally, this is about stopping ohioans from having reproductive justice interstate. it's really about whether or not the legislature is beholden to the people it's supposed to be protecting. >> really important story. might be happening in one state, but we all need to be aware of. thank you join us tonight. i appreciate it. >> thank you for having me. when we come back, she runs the world. and now the trains. beyoncé's big time move from fans and her daughter when the 11th hour continues. our continues. hi! need new glasses?
