digits roast the deep south. we'll tell you what's next from this wild weather coming up. and a new poll shows that half of all democratic voters don't want president biden to be the nominee for 2024. we'll explain why that's actually good news for the president. but we start in washington, d.c., where a new chapter in american political history is waiting to be written if and when special council jack smith decides to make his move. we know the grand jury investigating former president trump's role in trying to overturn the 2020 election arrived at the d.c. courthouse several hours ago. and if past is prologue, a decision on an indictment could come soon. in the classified documents investigation, trump was charged three days after his attorneys held a final meeting with jack smith. that same kind of meeting in this case was five days ago if that provides us any clues. we want to bring in nbc's garrett haake following this from washington. ryan reilly is outside the u.s. district courthouse. chuck rosenberg is a former u.s. attorney and senior fbi official who is also an msnbc contributor. and michael steele is former chairman of the rnc and an msnbc political analyst. so, ryan, what is the latest? what is happening in that courthouse behind you? >> well, there is an increased security presence here at the courtroom. it is the most reporters that i've seen inside the courthouse up until this moment in the months we have been watching for the action from this grand jury. just a lot of people gathered inside the -- waiting on news on this grand jury. the grand jury did take a lunch break, we know. and, you know, the timing of that could suggest they would be getting back very soon. but, you know, all eyes are basically on this courthouse, just given the timeline as you laid out. it seems like it is the time to be watching this courthouse and for this potentially historic potential indictment of the president for his connection with the lead up to january 6th. this doesn't only have to do with january 6th. it is about that period in the leadup after the election when there were these efforts. they interviewed a lot of the fake electors who have been reporting to this courthouse and testifying before the grand jury and the biggest name that we have seen here thus far a few months back, back in april, was former vice president mike pence who was testifying before the grand jury. so a really wide range of figures have sort of had their say before the grand jury here, including a lot of people in donald trump's circle, an aide, william russell, who was asked questions about what donald trump's state of mind was after the election, but leading up to january 6th. we don't know obviously when that indictment will drop. we don't know what the contents of it will be. but given the breadth of the individuals they spoke with, we can expect a pretty compelling narrative, just based on what we have seen from jack smith's office thus far. they do like to tell stories through these indictments and do a fine job at it, really laying out the facts in the case in a really compelling manner. i think, you know, once this potentially really lengthy indictment hits, whenever that is, we'll be scrambling to go through the pages and make sense of what this investigation has. there is a lot of stuff they were able to touch over across the hill here, capitol hill, that the january 6th committee wasn't able to get to. there is a lot more that federal investigators can do, so i think that, you know, in conjunction with the investigation that the january 6th committee did, we could still expect some surprises, even with all the journalism that has gone into reporting what donald trump was up to in those days after january 6th and in the leadup to january 6th itself. >> and in those hours, chuck, before decision finally drops, give us a sense of what happens in that final meeting between the prosecutors, the federal prosecutors and members of the grand jury. >> sure, chris, well, typically, after the grand jury has heard from lots and lots of witnesses under oath, where the government locks in their stories, their narrative as evidence for a trial, should one occur, the last meeting usually involves the government asking a summary witness, likely in this case, an fbi, special agent, to testify before the grand jury to present in sort of in summary fashion the indictment to go through all the allegations in each of the charges. once that is concluded, the agent and the prosecutors have to leave the grand jury room. the vote takes place in secret. only the members of the grand jury can be present for the vote. when i was a federal prosecutor, i typically told the floor person of the grand jury that we would be available in the hallway. if the grand jury had any additional questions, we would be happy to come back in and answer them on the record. but, the vote itself is an entirely private matter. it is done in secret. and the vote total is never made public, even though the outcome of the vote is. that's what the end stage of this looks like, chris. >> okay, so, garrett, we heard from donald trump, he thinks this is going to happen and it is going to happen soon. are you hearing any rumblings that beyond him they're concerned -- there is concern others might be indicted or that there may be witnesses that can do serious damage to the president? what is the buzz inside trump camp? >> well, look, there is a little bit of both. the first reality is that they just don't know. this investigation has been so broad and has gone on for so long, they're in a similar position where we are, trying to keep track of who the witnesses are, who has spoken and as best they can figure out what they have said. and chris, as best we know, i'm not seeing any other reporting that contradicts this other, there are no other individuals who received target letters in this case. the universe of other possible targets is presumably quite broad but we have not gotten any tip of the hat as to which direction it might go. if you consider all the former lawyers and former aides who, for example, the january 6th committee suggested be brought up on charges at the end of their investigation, it is a pretty significant universe of people who might potentially also be charged and the list of cooperators is kind of an interesting one too. the person who appears on both of those lists, who is the first name i'll be searching for in any indictment that may or may not come out is mark meadows. this is somebody who has been around, right at the president's side during all of this time period when he was in the white house. someone whose text messages were the rosetta stone for the january 6th committee and someone who has gone totally dark in public really for the last several months. whether he is -- which end of this indictment he might find himself on is something that i'm very interested in. and i know people in trump's orbit are very interested in as well. >> so, as ryan pointed out, michael, the j 6 committee did a lot. this grand jury heard more, they heard from more witnesses, they were privy to more evidence. the conventional wisdom in the polls would suggest that the more trump gets indicted, the better it is for him, he makes more money. he gets more support in the polls. but is there anything you think that could come out of this from mark meadows or anyone else that might change that calculation? >> no. not really. you know, his base believes he's legitimately acted in this regard, you know, as president. they still see him as president. so, you know, all of what the system is doing at this point in view -- in light of -- in the view of his base, rather, is, you know, outside the ordinary. that's -- from their perspective, that's the strange part. what's happening to him is not ordinary. they see him as justified and having those documents. they see him justified in doing what he did on january 6th. so, for the base, this is -- this is more bad behavior, not by donald trump, but by the administrative state that donald trump was sent to washington to deconstruct. and so they would like him back in power to further that deconstruction. and this is further evidence of the reason why they want him back. so, no, this doesn't change anything dynamically for trump. in fact, it just locks him in a lot further. and what makes that even more so is that those running against him don't have the spine to lose the primary. in other words, go after trump in a sufficient enough way that at least one of them is able to survive to take him on head to head and defeat him in this primary process. but that's not their risk. they don't want to take that risk. so, donald trump right now still commands the field. he commands the outcome of this primary. and all of this that is going on legally is just, you know, big -- deep state interference. >> at the risk of incrementalism, but that's where we are, ryan reilly, i understand the grand jury is back. >> yeah, going back from lunch. as our understanding. a very tight watch here. i think we'll all be able to sort out potentially what's really happening behind the scenes once, you know, all the sort of -- we know what ends up having if something is happening this afternoon, we'll be able to piece this timeline of what they were exactly doing potentially. but, yeah, i think that we're sort of all waiting for there to be action out of here. as soon as i go back into the courtroom, i'll be going around to different doors. how this has to come down essentially, it is quite interesting, they have to do this in open court, even if it is a sealed case. they typically use the initials. in this case, if we see a prosecutor from the special counsel come out and say, you know, it is announced in court as dt or djt, pretty good idea of what is going on there. that's what we're watching for, if they try to bring this into another courtroom, there is a magistrate judge who is on duty who is watching outside the courtroom there to make sure there is no action there. but theoretically it could be in any of the courtrooms throughout the building. and all they have to do is unlock the door and say, okay, yes, this happened in open court. just a little bit, we might have some producers physically running through the halls checking doors in the next few hours. >> well, let's hope they're up to the task. let me go back to chuck, what we heard from garrett, which is that he's going to be watching very closely to see how mark meadows fits into all of this. was he somebody providing testimony? is he potentially a target himself? what are you looking for out of any indictment potentially? >> i agree with garrett. i think there is a lot of interesting questions about which side of the line a number of these people will fall. chris, i don't have any special information about mark meadows other than this. he was around the president during the events that the grand jury and the special counsel's office are keenly interested in. why are they so interested in what someone like mark meadows would have to say. in a case like this, the government has to prove intent. in order to prove intent, you want to know what someone was thinking. to know what they were thinking, you want to know what they were told and what they said. and who better than the white house chief of staff, the president's number one aide, to give you some insight into what the president was hearing, saying, thinking and doing? i don't know if he'll be charged or not. i'm not rooting one way or the other for people to be charged. i imagine the special counsel will make principle decisions about which side of the line these people fall on. but you will need some number of witnesses who had proximity to the president to help explain to the jury what mr. trump's intent was. >> so, garrett, lots of stories out there today about how much all of this is costing donald trump. nbc news is reporting his save america pac spent more than $20 million on legal fees just this year, roughly two-thirds of it spending. "the new york times" says that same pac had more than a million -- $100 million at the start of last year. that's down to $4 million. what more can you tell us about all this? >> well, chris, some of this is a matter of confusing accounting because all the different vehicles that the trump campaign uses to raise money, spend money. there is this pac, a super pac that is mostly supposed to spend money on ads, the campaign itself. but the upshot is this, defending donald trump and his allies in all of these various legal cases providing attorneys for people who either worked for him or worked with him, who found themselves wrapped up in this has become enormously expensive and a huge drag on the cash resources of the kind of greater maga movement as it stands supporting donald trump. this is before any of these cases go to trial. it is before at least two cases we know are being investigated or even indicted, if that's the direction they're going. so, this will continue to be a drain on resources for the former president going forward. now, if you give money to donald trump through his website or through something like win read online, you're giving to a split between the campaign and this pac. some of this is donor money. the big question is, at some point will donald trump, the billionaire businessman, behind donald trump the presidential candidate, will start spending more money on his own legal issues for himself and his various allies. he's notorious for not spending his own money until he has to. at this burn rate, that time may come sooner rather than later. >> people can't see you, but i can, michael steele. what was that look on your face as garrett was talking? chris christie said why doesn't he sell trump tower, why doesn't he sell a boat, why doesn't he sell a golf course and stop taking money from his constituents. i don't think that's going to happen. >> i don't either. that's why i was snickering at garrett's reporting there. because he's right. that's what you think would happen. but donald trump -- donald trump knows he can get somebody else to foot the bill, he's not putting up his own cash. so it won't be until that money starts to slow coming into the campaign coffers. and the various vehicles that he's using to set up the grift that he will then have to and be forced to look at bringing in those dollars from other -- from his personal assets. why? because then his lawyers will begin to shut down. they'll be, like, i'm sorry, we just can't do this at this burn rate without payment. so, garrett's right. but the reality for donald trump is if he knows as a sucker out there that is going to send him $100 or allow him to put $100 on their credit card every month, guess what he's going to do? >> garrett haake, ryan reilly, chuck rosenberg, thank you. michael steele, we'll bring you back later this hour. dangerous flooding, typhoons, fire and heat. the brutal weather conditions brutalizing the globe as phoenix finally gets out from under record-breaking temperatures. but not out of danger. we'll explain in just 60 seconds. danger. we'll explain in just 60 seconds. subway refreshed everything and now they're slicing their deli meats fresh. that's why this qb profers the new five meat beast. and this qb profers it. and if we profer it. we know you'll profer it too. are you trying to outspokesperson me? maybe. have fun, sis! what do the days ahead look like? >> slowly from july to august, july is the hottest month of the year in our country and august gets cooler. i think in all the headlines, the el paso, 100 degree streak, areas around austin had 105 degree streak. phoenix streak, i think the water temperature that hit over 100 degrees in the keys was really the one that most people were, like, whoa, that's weird. strange. like unusual. i just looked. by the way, the warmest water temperature i could find at this hour is 93 degrees in the keys. it has dropped and is about 90 degrees over clearwater beach. phoenix, the streak is over. i'm upset they ended it because they really were 108 yesterday. 108 today and then we start a new streak, so we could have, like, added on to it. we look back at the record the most, we'll see the big streak and then two days that were close and then we'll go right back into it. at least five days in a row starting a new streak as we head toward the middle end of this week. we're already under excessive heat watches for phoenix and tucson. the worst of the heat by far, currently, now over texas and louisiana. some of this is dry from about dallas out to west texas. but it is just hot and humid and gross. a lot of areas here, i was looking at brownsville, feels like 111 right now. new orleans feels like 107 already. here we are in the lunch hour here in the central time zone, dallas, 104. it is a really hot, humid, gross type of air mass. we will be near some records. yesterday we were just shy of the record high in dallas, you get the idea here. and then tomorrow we'll do it all over again. no relief coming from the north, no cool air, no rain, no tropical systems, which is good, i guess. it is still really, really hot and dry throughout the region. and then as we look toward the edges, the actual temperatures are very warm in all areas that we just talked about. it is going to continue that way and here is your august outlook, chris. new england, great lakes, kind of normal. mid-atlantic, but down along the gulf coast, this is where we continue to bake. one of the things people are talking about with the water temperature story what happens if a tropical storm or hurricane comes? "the new york times" siena poll shows biden's support has risen 20 points in the past year. while 50% of all democratic voters still don't want him as the party's nominee, that is a marked improvement from last summer when nearly two-thirds of the party wanted someone else. he's hardly in the clear, though. the poll shows him deadlocked with donald trump, both men at 43%. and the poll offers other warning signs for democrats as voters express serious pessimism about the future. michael steele is back with us. a lot to unpack here, michael. for those who say how is it possible that joe biden and donald trump are tied in spite of everything that is going on with trump's indictments, possible more indictments, what do you say? >> i've been saying it since 2020. there are more people out there who align themselves with donald trump, quietly, silently, nodding their head in approval, of his view of america. they're not necessarily happy with all the indictments and all of the legal troubles, but they see him as a, quote, strong man president. and that's what they want. so, yeah, it is a national poll. i don't put a lot of stock in national polls, a year and a half out from a general election. but it is indicative, i think, in a lot of ways of an undercurrent that the media and the political class refuse to really wrap their heads around. and stop being shocked by the numbers when they see them. the true hard core trump supporter is not going to tell you i'm with trump. but they will on election day. and that should be the thing that drives democratic voters and the democratic party at this point to shore up their ground game going into next year. remember, trump lost by 78,000 votes over three states at the end of the day. that was the electoral college vote count. so, the reality for him, both of those gentlemen, is there is an opportunity to win that poll shows just how real that opportunity could be. >> i remember, i was hanging out in pennsylvania for the rest of that week, so it is clear many my mind, michael. the times borrowed an old political cliche, showing biden's support is a mile wide and an inch deep. among those who want him as the nominee, 14% said the country's problems were so bad that the nation was at risk of failing. so if you were inside team biden, if you're inside the dnc right now because we know it is not just about the top of the ticket, would you be adjusting strategy in any way? >> yeah. the strategy is the message strategy in which they're a daylight and 18 months behind on. i never understood how have allowed this narrative to form around the successes that this administration has had. now, you know, conservatives or center right folks may or may not agree in the main with a lot of this. but rank and file democrats, i just question, you know, this -- this thinking that says, we want somebody else. well, who are you going to get? >> it is being described as a conference, a hearing. he's been formally charged with six counts of first and second degree murder. he's already pleaded not guilty. and he's already been denied bail. so, the question is whether the defense may raise the bail issue again. we expect it to be some discussion of the evidentiary process, the discovery process, the timing of that, the calendar going ahead. there may be some discussion of the conditions of his confinement at the correctional facility here in suffolk county. those are the kinds of issues that we expect to happen in just a few minutes or so. very brief hearing, but one of the few times, the second time he will appear in public and people here in this community who are shocked and horrified by what has happened will get a chance to see this individual. there are no cameras in court. there are still cameras, i should say. there are no video cameras in court. so there won't be that sort of image of the proceeding. but it is being very -- watched very closely for every detail. remember, there is every expectation that even though he's been charged in the murders of three women, that that number could increase. he's been named as a key suspect in the case of a fourth woman and there are still other unresolved cases in that area of gilgo beach. as well as in other parts of the country, south carolina, las vegas, to name a couple of places where there are investigations under way where heuermann could be linked and named as a suspect. so, all that is perhaps to come as we anticipate this hearing beginning very shortly. >> ron allen, thank you for that. danny, any and all of the above possible here? >> yes. a conference is just a generic term for the parties getting together and they discuss housekeeping. sometimes you can address motions, sometimes you can make informal motions right there. depending on how serious the conference is expected to be. normally a conference deals with scheduling, so they might sit down and say, given the court's calendar, what do you think about this date for motions? when do you think you'll have discovery by? the parties will put their input and the judge will arrive at a scheduling calendar or order that works for everybody. they tailor make it to the court's docket and try to run a schedule and, of course, the reality is no one adheres to the schedule. things happen. unexpected things happen. and things often get moved around. >> ron mentioned that the community understandably shocked and horrified. his wife, soon to be ex-wife, says she was too. she gave an interview in which she said her children are crying themselves to sleep. but there are also some descriptions of the two weeks that they say the police were in there looking for evidence. what do they do over the course of two weeks? >> hi, chris. well, yes. different interpretations indeed. you just heard from dan goldman, the democrat from new york, who said that devin archer, the witness, described how hunter biden would often call his father, then the vice president, put him on speakerphone in some of his business meetings. this happens more than 20 times over the course of a ten-year period. however, dan goldman said that business was never discussed. that all the vice president did at that point was talk about niceties. talk about the weather. exchange pleasantries. so according to the democrats, there is no smoking gun. at the same time, you heard from oversight chairman, republican, james comer from kentucky, who said that this proves, this testimony proves that vice president biden was lying about the fact that he never was involved in business dealings involving his son, hunter. he said that hunter was trading on his family name. let's hear directly from james comer who was on fox news last night. >> do you believe that this is now officially the joe biden bribery allegation and do you believe that you will be able to prove that?
