>> we have a very busy show. we want to start with the developing situation outside the dallas-ft. worth area. authorities there are negotiating with a man who has now taken at least one hostage at a synagogue in colleyville, texas. he is demanding the release of a woman convicted of attempted murder in 2010. nbc news's morgan chesky joins us live. bring us up to speed on the latest, what we know about the attacker, the hostage taker, and what's going on inside. >> yeah. a very fluid situation. in colleyville, we are about a quarter mail away from congregation beth israel synagogue and we have some developments that have happened in the last half-hour or so. the colleyville police have said that at least one person has been released and will be reunited with family. important to know, there are no reported injuries at this time. as far as the hostages inside that synagogue go, we know a rabbi was taken hostage and three or four others. that was prior to the release of this hostage. police say this began around 11:00 a.m. this morning. that's when they received a phone call that there was an ongoing situation happening here. they arrived to find out that a man believed to be armed that had entered that synagogue during the services and had begun taking hostages. this service was being broadcast on facebook, streaming and there was at least several minutes in which that hostage taker could be heard making his demands before that live stream was cut off. since then we have seen agencies from the federal and state level converge on this scene. they have established communication with the man who is believed to be the only suspect at this time. and right now they say that these negotiations are ongoing. this man, believed to be armed inside the synagogue about a quarter mile there where i'm standing asking for release of that federal prisoner. right now is still in talks with federal authorities. >> all right. morgan chesky there live for us in colleyville, texas. we'll continue to monitor the situation. there were major developments in the battle over democracy this week and it was a week on paper had some signs of progress. as the week draws to a close, it becomes impossible to ignore the big wins for anti-democratic forces in this country. after a year's worth of investigation, the justice department arrested, finally charged the leader of a far right militia group and ten others for the january 6th attack on the capitol. stewart rhodes, the founder of this group, the oath deeper, is now facing up to 20 years in prison after being charged with seditious conspiracy. on tuesday, president biden and vice president kamala harris traveled to atlanta to throw their weight behind efforts to protect the right to vote in this country. after republicans spent 2021 passing new laws across the country in state after state, the very foundations of our democracy, it now seems like democrats in washington were about to strike back. they were about to go on the offensive. here's what biden, his chance to make something happen in the senate, that's what people thought would happen. where the john lewis rights act have been stalled for a couple weeks. and he didn't hole back. >> i believe the threat to our democracy is so grave that we must find a way to pass this voting rights bill. debate them, vote, let the majority prevail. if that bare minimum is blocked, we have no option but to change the senate rule, including getting rid of the filibuster for this. i've been having quiet conversations with members of coming for the last two months. i'm tired of being quiet. >> so this was the speech that so many of us have been begging biden to make for months. people wanted to see him deliver the speech. it was delivered to the entire nation. in reality, it really had an intended audience of only two people. joe manchin and kirsten sinema. while there were optimistic reports on capitol hill, by mid-week, senator sinema has basically torpedoed that when she went on the floor and said this. >> these bills help treat the symptoms of the disease, but they do not fully address the disease itself. and while i continue to support these bills, i will not support separate actions that worsen the underlying disease of division infecting our country. eliminating the 60-vote threshold will simply guarantee we lose our critical tool that we need to safeguard our democracy from threats in the years to come. >> so think about what senator sinema just said there for a minute. she's basically refusing to accept a carveout of the filibuster to pass two voting rights bills because she supposedly worried about safeguarding our democracy. it just really begs the question. how dumb does she think we are? because sinema and manchin aren't willing to compromise on the fbi, we're essentially in a situation where republicans, i should emphasize, the minority party, can dictate what democrats, the majority party can do. it is completely antithetical to the very concept of democracy. you know the one where majority rules. specially when you consider the 50 democratic senators represent over 41 million more americans than the 50 republican senators who basically abandon their responsibilities to actually help govern this country. unfortunately, that was far from the only evidence of minority rule and our weakening democracy this week. on wednesday, the january 6th select committee formally requested an interview with leader kevin mccarthy. in response, he released this statement saying wouldn't cooperate. without any trace of irony, considering he is a close trump ally, called the investigation an abuse of power, believe it or not. he actually said that. on thursday, the conservative majority blocked president biden's employer vaccine mandate. although that has to do with public health and not democracy, when you think about it like this, you'll understand why. it means that 80 million americans who could have breathe ad little easier at work are now being put at greater risk because of the three justices put on the bench by trump who by the way did not have a popular vote mandate to govern. not to mention the fact that no one, no one on the supreme court, has a direct mandate from the people like president biden does. by the way, did we mention president biden nearly won the election with nearly 7 million more votes than donald trump? also this week we learned new details about a group of trump-backed secretary of state candidates that are working together in open, plain sight, to take control of the election processes in their states. here's the nevada secretary telling steve bannon about these efforts. >> do you have a coalition we formed on may 1st? a coalition of america first, secretary of state candidates around the country getting the word out that people that decided there's somebody doing something behind the scenes to try to fix 2020 like president trump said. you know, we've got to learn what they did in 2020 in order to go forward and keep it from happening in 2022. >> i hope you heard that. i hope you heard that and paid attention very closely. as i've said many times on this program. the next attempted coup. the next coup, the one that we should be preparing for now bypassing the two bills in the senate won't be carried out by a maga mob storming the capitol like what we saw on january 6th, 2021. it will be carried out by trump sycophants like these guys who has won the election before a single vote has even been cast. they are no longer satisfied with just governing when they're out of power. they're actively doing everything they can to make sure that they're never the minority party ever again. now, when you put all these things together, it becomes crystal clear that the reason democrats struggle to get anything done in washington is not just because of traditional politics and ideological divides. it is because of the system itself. to be clear, i'm not saying democracy can't work. i'm saying this democracy isn't working the way it is intended to. lots to discuss right now. joining me is rick wilson, a republican strategist and author of running with the devil. a plot to save republicans from themselves. and a professor of history at new york university. the author of strongmen. and professor at emory university and author of one person, no vote. how voter suppression is destroying our democracy. i can't think of a better panel to have this conversation with. thank you. i want to start with you. do you think that the minority party is able to control so much of what gets done that impacts tens of millions of americans represents a critical flaw in the structure of democracy as it is operating now? it may not be at the time of its creation. now with 330 million people, 50 states. it doesn't seem to be functioning the way it was intended to. >> the problem that we have is that we have what we had back in the cold war era. these southern democrats who look like they have the democratic label but in fact, they were ultra conservative and deeply anti-civil rights. deeply anti-black. and they would align with the conservative republicans in order to block key legislation that would make this democracy vibrant. they blocked anti-lynching legislation. they blocked civil rights legislation. they blocked fair employment legislation. so that's what we're having right now. when you see sinema and manchin, they're acting like traditional southern democrats. >> ruth, is this how our system supposed to be working? i appreciate the genius of the american system as a decentralization of power. co-equal branches of government. when you look at how it is operating today. the fact that you have an ann democratic party trying to, as we just laid out there in the opening monologue, attempting to subvert elections, subvert the outcome of elections, the ability to overthrow them. is this one party abusing the system from hundreds of years ago or is the system beginning to fray a little bit? >> when you have somebody like trump come on the scene, they take advantage and exploit all of the things in the system that could be used against democracy. this has happened time and again. so for example, the long period between november and the inauguration in january is a time where somebody like frump can make a lot of trouble. what we've seen now is the party that has been radicalized. there's a reason mccarthy and the rest are not cooperating. they do not see themselves as invested in democracy anymore. a good comparison is what we're seeing with the attempt to control the election machinery. there is a word form. autocratic capture. when a party allied with despotism attempts on control the election machinery, the judiciary, so you hold elections but they have to come out the way you need them to. that's what we're living through right now. >> to carol's point, we saw sinema and manchin continuing to do more to protect the filibuster than to arguably protect the right to vote itself. even though kyrsten sinema said she's supporting these bill, she's not willing to get them done. what was your reaction to her speech on the senate floor on thursday? i speak for myself, insulting, as many of us did. >> i thought it was insubtling, serve serving. it came the same day the people around her are leaking that she will run for president soon. i think it is an affront to the republic and the democratic system that underpins it. they're not up against people who have some policy difference or philosophical difference. they're up against people trying to engineer 2024 to be the last election in america. they want to capture the machinery of gov. they want to do an autocratic capture of gov. who gets the weigh the votes if they're contested? they want to build a system where they will never lose again. we will end one something like the baath party in iraq where saddam hussein got 117% of the vote. if people like manchin and sinema don't see this, i have a lot of contempt for them in that regard. i will say this. it is time for chuck schumer and the rest of the democratic leadership to take an iron cap to their knee caps. they think they're empowered with this ultimate degree in which they're the swing votes. if they're going down, they have to toughen up. they need to go on work. because right now, mitch mcconnell runs circles around him every day. schumer doesn't have the ability to hold his own people to account. >> it can't be ignored that republicans cherry pick and even pass trump tax cuts by a vote back in 2017. and it is another example to your point for democrats. playing by rules that republicans have long stopped caring about. >> of course. if it suits, let's stay republicans take back the senate majority next year. if mitch mcconnell wants to screw joe biden, he's going on shred the filibuster in a hot minute. don't they understand who they're dealing with? have they not met mitch mcconnell at this point? >> yeah. cybill that they're so naive to the reality of mitch mcconnell and the republicans. i want to go back. it was the need to defend the right to vote. something we all agree on. many people thought he should have given this speech months ago. and actually worked over the past year to shore it up. do you think it was a mistake to prioritize passing his domestic agenda before protecting the vote when you look back? hindsight is 2020. we lost the year in which voting rights were not shored up. it would have been the same position in 2021 will. >> what we really needed was to have the kind of strength of an lbj as he was putting pressure on the southern democrats for the civil rights act and the voting rights act. we needed to have the wiliness and the strength of senator reid who knew how to move that machinery through. and i do believe, given that we saw how these states, the republican legislatures, came out of the box immediately with these voter suppression laws. it was a two-track way. one was to make it difficult for african americans, asian-americans, indigenous people, poor people, to vote. the other method was to capture the machinery that counted the votes. that certain fade the votes. that figured out how to vote. to lower the guardrails that have prevented trump from being able to overturn the votes in like georgia. so that's what we saw happening in 2021 immediately. we needed to have the feds move quickly and decisively on that and they did not. >> speaking of georgia, ruth, listen to this from senator joh in many, laws have been passed and further laws are being offered which would selectively disenfranchise voters, give partisan officials the power to subvert elections. the united states senate needs to act to defend the sacred franchise and the integrity of american elections. we have the constitutional authority to do so. we cannot hide from history at this moment. >> so ruth, do you think that democrats in congress, you know, they're obviously not meeting the moment because of sin may and manchin. but do they have any more power in their hand to try to force some solution to shoring up voting right in this country? who better to ask than someone who used to work inside the justice department? joining me now, matt miller. he served with the director of affairs under the attorney general eric holder. also an msnbc contributor. thank you for spending time with us. let's talk about some of the new charges filed against the oath keepers. a lot of people taushs about seditious conspiracy not being an easy charge to prove. what does this mean? what does it mean that the doj took this step with this specific charge? >> it was a critical step for the department to take. i don't think it is one that they took lightly. there is a great deal of discussion and debate and at times disagreement over whether the evidence could eventually support these charges. i think it is important for two reasons. number one, these are very serious charges and it is important that you charge the most serious crime you can prove in a case like this to both, so that you actually achieve justice and send people to jail for the longest sentences you can get. so you have the ability to potentially film witnesses, suspects, and get them to turn against other people who may have been part of the plot. it is also important because look, the department of citizens name certain crimes and treat different crimes differently. the same reason we call people terrorists and charge them with terrorism charges and not just hate crimes. it is important that we name these attacks for what they were. if these oath keepers are convicted, they forever go down as traitors to the united states. it is critical in the short term and the long material. >> an important distinction to make and a very valid concern to have as well. the threat of domestic extremism. it is obviously not something new. in 2021, you had the fbi reveal that it had 2,700 open domestic terrorism investigations, compared to just 1,000 international terrorism investigations. why did it take so long to create this unit or take this threat seriously? or are they doing it at the right time or should it have happen earlier? >> i think the trump department was very sloes to react. i think under president trump, although they did charge people with crimes when they could prove him. wasn't in focus from the leadership. because they knew that focusing on it would anger the then president. if you look at where this new domestic terrorism will be housed, inside the national security division, that was created in the wake of 9/11. and it was created after 9/11 because doj and the fbi recognized that the department did not have enough of a focus and it didn't investigate national security terrorism crimes in the way with the kind of focus and rigorous effort that it required. so it created this division. and i think what we've seen over time, not to say that the threat of international terrorism has diminished. certainly the threat of domestic terror has risen and risen. if you look at the number of attacks in reason years, domestic terrorism far outweighs international terrorism as an ongoing threat. so it is important the department recognizes this. what it does is it brings focus and resources, which is what you need to turn investigations into cases and cases into serious sentences. >> and bring focus and resources. there will be a bit of a challenge. correct me if i'm wrong. when you're dealing with domestic extremists, you have to walk this front line and what is protected under the first amendment. how does this complicate investigations? >> well, so often in this country, we love to put things in terms of red and blue and conservative and liberal. if you're looking for an unabashedly bipartisan topic, and of course, a bipartisan problem here, too, you found it in the sense that lawmakers have effectively in many, many cases just ignored a law that was passed ten years to serve as a bulwark, a check on their personal finances, in making sure that those personal finances were not going to conflict with their public duties as members of congress in washington, d.c. and capitol hill. but that aspiration ten years ago is not really lived up to the reality of where things stand today. >> yeah. and house speaker nancy pelosi was asked about this in december. and it was a very straightforward question. whether lawmakers should be allowed to trade stocks. listen to her answer. >> this is a free market and people, we are a free market economy. they should be able to participate. in. >> it seems to me that's such a simplistic answer. because it is a 47 market. we all know that. but they're also privy to an incredible amount of influence and information that could have influence on the price of a stock. what is your take to that response from her? >> well, haums are different. member of congress are different in that they are privy to insider information, confidential information. they receive briefings on capitol hill that no other americans do. certainly not you or me or anyone else in the country. so they will have information that they can act on in a way that could potentially benefit them were they to go and say, for example, at the dawn of the paemic, buy b of stock in moderna and johnson & johnson or ppe or testing. and many did. okay? the other issue with nancy pelosi saying that, she received a lot of blowback. there was not just necessarily the republican criticism that you mate expect of nancy pelosi for anything she might say but she's been squeesed in subsequent weeks by those on the right and the left, too, people in her own party. the democratic party. so you have now probably about a half a dozen different similar bills that have been introduced in congress to one extent or another, limit or outrightly ban members of congress from trading individual stocks and effectively telling nancy pelosi, you're wrong on this issue. >> yeah. and as i noted, this is happening on both sides. who are some of the worst defenders of the stock act. as i understand it, this is a very bipartisan affair when it comes to using this position they have and purchasing stocks. >> sure. well, i'll give you two examples. democrat yik representative tom medicalinowsky running a close race. we reported in march of this year that he had failed to disclose dozens upon dozens of different stock trades that he made all through 2020, during the pandemic, some of those were pandemic sensitive stocks. and until we called him on it, he wasn't willing to make those disclosures. he said hey, my financial adviser screwed up. we hear that a lot. both from republicans and democrats. he ultimately did disclose. on the right you have somebody like pat fallon, a representative from texas. maybe not a household name but trading dozens and dozens of different stock trades to the tune of about $20 million when you add it all up. and all of those disclosures were well past the federally mandated deadline that congress set for itself. it is its own referee. members can play by their own rules. and tlaes two cases and dozens more, they have not done so for one reason or another. >> to be clear here and to button it up. what is the rule? jerry, you gotta see this. seen it. trust me, after 15 walks... gets a little old. i really should be retired by now. wish i'd invested when i had the chance... to the moon! ugh. unbelievable. we're still watching that breaking news coming out of colleyville, texas. this at the congregation beth israel. in a lye stream earlier, police now confirming one uninjured hostage was released but there potentially could be more inside. the hostage takers demanding release of a woman in federal prison for attempting to kill u.s. officers in afghanistan in 2010. we'll have more a little bit later. now back to you. >> all right. we'll continue to keep you updated as we know more. thanks form. while the omicron variant swept across the country and homes across the world hunkered down, a new netflix film captured imaginations with its star studded studded lineup, jennifer lawrence. don't look up has become the second highest streamed movie ever on netflix. and in case you haven't seen it yet, no spoilers, but the movie's premise is that there is a comet heading straight towards earth due to make direct impact. the film's creators are using the crazy premise to represent thes not so crazy very real threat of climate change destroying our planet and highlighting the failings of world leaders, the media and everyone else to take action. joining me now is david seratta, founder and editor of the daily poster and co-producer of "don't look up." i have to say off the bat, full disclosure, love this movie. absolutely brilliant storytelling, david. i just thought it was such a smart movie. tell me, how did this film first come about? where did you get the idea for it and what was the goal for making it from your perspective? >> thanks, i'm glad you like the movie. it came out of discussions with screen writer and director adam mckay. i was talking with his after his last movie vice. i said you have to use your super powers of film making to address the climate crisis. he said, i've been trying to figure out how to do that. i don't want to make a mad max post apocalyptic movie. i said it really feels like the climate crisis is headed towards earth and not enough people care. he said, you know what, maybe that's actually the movie. and we started sort of discussing scenes and how ridiculous it would be if that kind of thing happened. and the story really is about scientists confronting real facts that are scary, and trying to tell those facts to the world, and raising the question of whether the world can accept facts, stipulated facts, and act constructively on those facts. that's what the story really is about. >> yeah, and as i mentioned, absolutely brilliant storytelling. peter, the science part of this is also extremely fascinating. this week we've heard the very latest reports that last year was the sixth hottest year on record. last summer one in three americans experienced a climate disaster of some sort. compare for me the current situation that we're in with the hypothetical threat posed in the film, and tell me why you think people aren't paying more attention. >> well, you can't overstate how serious the climate emergency is, in my opinion. and we're just right now entering the very lowest foothills of what we're going to be facing in the coming years and the coming decades if we don't take rapid action. i personally feel like it's time for us as a society to stch into emergency mode. the fossil fuel industry is the main cause of what's happening. we have to stop as a society dancing around that issue and face the fact, the fundamental facts we have to rapidly phase out the fossil fuel industry as quickly as possible. >> david, i want to play for you another clip from the movie. watch this. >> i'm sorry, are we not being clear? we're trying to tell you that the entire planet is about to be destroyed. >> okay. >> well, you know, that's not something we do around here. we just keep the bad news light. >> right, it helps the medicine go down. >> listen, it's obviously that there is an indictment and fair criticism, the indictment of the media and the way we cover climate change. so there is definitely a little dig at the news coverage on this issue. i want to ask you, how does the movie not become a parody of itself here for a moment? there's been a bit of a backlash basically saying the film doesn't come up with answers in this particular scenario, or even any suggestions. what do you say to that? >> well, what i say is that, first and foremost, the movie is a movie. so that's one set of stories. secondly, it's designed to try to raise awareness of the problem we have in communicating with ourselves as a society about scientific facts. and i think the movie does accurately raise questions about whether the media right now as it's constructed is willing to take a crisis like climate seriously and bake it into the day to day coverage. you know, climate -- we cover -- the media covers the economy every day as part of its coverage. it covers all sorts of things, the political wranglings on capitol hill, day to day coverage. it does not cover the climate crisis day to day for a number of reasons. one, it's a terrifying topic. that doesn't mean it shouldn't be covered. the media gets a ton of funds, people in the corporate media know where that comes from when they're working for those outlets. i think the bottom line here is that climate change needs to be part of the day to day. when the president has a press conference, that should be part of the question. it shouldn't just be the economy or what's going on in congress. it should be what are you doing to stave off this crisis that threatens the livable eco system of our planet. >> i know, that's an absolutely valid criticism against the media in this country for not putting climate change front and center in every aspect of our coverage, and taking it as seriously. peter, the flip side to that is how do you take as a scientist and activist, how do you take the eyeballs that have seen "don't look up" and translate that into action towards climate change and preventing this disaster? >> well, in my opinion, you know, david mentioned that the fossil fuel industry, which i might add has been literally lying, spreading misinformation about climate change for decades, and doing everything it can to stop legislation. so to counteract that level power, we need a massive grassroots movement that's mainstream. and that was what was so thrilling to me about this film, is that for maybe the first time it's really -- this discussion has really broken out into the mainstream and that's what we need. we need basically every human being on this planet is going to be affected by climate change if you're not already affected by climate change. and every single human being on this planet should really be a climate activist. so, i say we need a billion climate activists, maybe we need more than that. we just need a very, very strong mainstream movement, and everyone should get involved using their creativity, using their courage in any way they can. >> yeah, we have to do absolutely better. on a side note, david, congratulations on the success of this movie. peter, keep up the amazing work that all of you are doing on this front. but we do all have to do better. thank you gentlemen for joining me this evening. appreciate it. >> thank you. >> thanks. >> stick around. we are live in texas for an update on that hostage situation next. don't go anywhere. hostage situn next don't go anywhere. ♪ liberty, liberty, liberty, liberty ♪ only pay for what you need. ♪ liberty, liberty, liberty, liberty ♪ why give your family just any eggs when they can enjoy the best? >> we have a very busy show. we want to start with the developing situation outside the dallas-ft. worth area. authorities there are negotiating with a man who has now taken at least one hostage at a synagogue in colleyville, texas. he is demanding the release of a woman convicted of attempted murder in 2010. nbc news's morgan chesky joins us live. bring us up to speed on the latest, what we know about the attacker, the hostage taker, and what's going on inside. >> yeah. a very fluid situation. in colleyville, we are about a quarter mail away from congregation beth israel synagogue and we have some developments that have happened in the last half-hour or so. the colleyville police have said that at least one person has been released and will be reunited with family. important to know, there are no reported injuries at this time. as far as the hostages inside that synagogue go, we know a rabbi was taken hostage and three or four others. that was prior to the release of this hostage. police say this began around 11:00 a.m. this morning. that's when they received a phone call that there was an ongoing situation happening here. they arrived to find out that a man believed to be armed that had entered that synagogue during the services and had begun taking hostages. this service was being broadcast on facebook, streaming and there was at least several minutes in which that hostage taker could be heard making his demands before that live stream was cut off. since then we have seen agencies from the federal and state level converge on this scene. they have established communication with the man who is believed to be the only suspect at this time. and right now they say that these negotiations are ongoing. this man, believed to be armed inside the synagogue about a quarter mile there where i'm standing asking for release of that federal prisoner. right now is still in talks with federal authorities. >> all right. morgan chesky there live for us in colleyville, texas. we'll continue to monitor the situation. there were major developments in the battle over democracy this week and it was a week on paper had some signs of progress. as the week draws to a close, it becomes impossible to ignore the big wins for anti-democratic forces in this country. after a year's worth of investigation, the justice department arrested, finally charged the leader of a far right militia group and ten others for the january 6th attack on the capitol. stewart rhodes, the founder of this group, the oath deeper, is now facing up to 20 years in prison after being charged with seditious conspiracy. on tuesday, president biden and vice president kamala harris traveled to atlanta to throw their weight behind efforts to protect the right to vote in this country. after republicans spent 2021 passing new laws across the country in state after state, the very foundations of our democracy, it now seems like democrats in washington were about to strike back. they were about to go on the offensive. here's what biden, his chance to make something happen in the senate, that's what people thought would happen. where the john lewis rights act have been stalled for a couple weeks. and he didn't hole back. >> i believe the threat to our democracy is so grave that we must find a way to pass this voting rights bill. debate them, vote, let the majority prevail. if that bare minimum is blocked, we have no option but to change the senate rule, including getting rid of the filibuster for this. i've been having quiet conversations with members of coming for the last two months. i'm tired of being quiet. >> so this was the speech that so many of us have been begging biden to make for months. people wanted to see him deliver the speech. it was delivered to the entire nation. in reality, it really had an intended audience of only two people. joe manchin and kirsten sinema. while there were optimistic reports on capitol hill, by mid-week, senator sinema has basically torpedoed that when she went on the floor and said this. >> these bills help treat the symptoms of the disease, but they do not fully address the disease itself. and while i continue to support these bills, i will not support separate actions that worsen the underlying disease of division infecting our country. eliminating the 60-vote threshold will simply guarantee we lose our critical tool that we need to safeguard our democracy from threats in the years to come. >> so think about what senator sinema just said there for a minute. she's basically refusing to accept a carveout of the filibuster to pass two voting rights bills because she supposedly worried about safeguarding our democracy. it just really begs the question. how dumb does she think we are? because sinema and manchin aren't willing to compromise on the fbi, we're essentially in a situation where republicans, i should emphasize, the minority party, can dictate what democrats, the majority party can do. it is completely antithetical to the very concept of democracy. you know the one where majority rules. specially when you consider the 50 democratic senators represent over 41 million more americans than the 50 republican senators who basically abandon their responsibilities to actually help govern this country. unfortunately, that was far from the only evidence of minority rule and our weakening democracy this week. on wednesday, the january 6th select committee formally requested an interview with leader kevin mccarthy. in response, he released this statement saying wouldn't cooperate. without any trace of irony, considering he is a close trump ally, called the investigation an abuse of power, believe it or not. he actually said that. on thursday, the conservative majority blocked president biden's employer vaccine mandate. although that has to do with public health and not democracy, when you think about it like this, you'll understand why. it means that 80 million americans who could have breathe ad little easier at work are now being put at greater risk because of the three justices put on the bench by trump who by the way did not have a popular vote mandate to govern. not to mention the fact that no one, no one on the supreme court, has a direct mandate from the people like president biden does. by the way, did we mention president biden nearly won the election with nearly 7 million more votes than donald trump? also this week we learned new details about a group of trump-backed secretary of state candidates that are working together in open, plain sight, to take control of the election processes in their states. here's the nevada secretary telling steve bannon about these efforts. >> do you have a coalition we formed on may 1st? a coalition of america first, secretary of state candidates around the country getting the word out that people that decided there's somebody doing something behind the scenes to try to fix 2020 like president trump said. you know, we've got to learn what they did in 2020 in order to go forward and keep it from happening in 2022. >> i hope you heard that. i hope you heard that and paid attention very closely. as i've said many times on this program. the next attempted coup. the next coup, the one that we should be preparing for now bypassing the two bills in the senate won't be carried out by a maga mob storming the capitol like what we saw on january 6th, 2021. it will be carried out by trump sycophants like these guys who has won the election before a single vote has even been cast. they are no longer satisfied with just governing when they're out of power. they're actively doing everything they can to make sure that they're never the minority party ever again. now, when you put all these things together, it becomes crystal clear that the reason democrats struggle to get anything done in washington is not just because of traditional politics and ideological divides. it is because of the system itself. to be clear, i'm not saying democracy can't work. i'm saying this democracy isn't working the way it is intended to. lots to discuss right now. joining me is rick wilson, a republican strategist and author of running with the devil. a plot to save republicans from themselves. and a professor of history at new york university. the author of strongmen. and professor at emory university and author of one person, no vote. how voter suppression is destroying our democracy. i can't think of a better panel to have this conversation with. thank you. i want to start with you. do you think that the minority party is able to control so much of what gets done that impacts tens of millions of americans represents a critical flaw in the structure of democracy as it is operating now? it may not be at the time of its creation. now with 330 million people, 50 states. it doesn't seem to be functioning the way it was intended to. >> the problem that we have is that we have what we had back in the cold war era. these southern democrats who look like they have the democratic label but in fact, they were ultra conservative and deeply anti-civil rights. deeply anti-black. and they would align with the conservative republicans in order to block key legislation that would make this democracy vibrant. they blocked anti-lynching legislation. they blocked civil rights legislation. they blocked fair employment legislation. so that's what we're having right now. when you see sinema and manchin, they're acting like traditional southern democrats. >> ruth, is this how our system supposed to be working? i appreciate the genius of the american system as a decentralization of power. co-equal branches of government. when you look at how it is operating today. the fact that you have an ann democratic party trying to, as we just laid out there in the opening monologue, attempting to subvert elections, subvert the outcome of elections, the ability to overthrow them. is this one party abusing the system from hundreds of years ago or is the system beginning to fray a little bit? >> when you have somebody like trump come on the scene, they take advantage and exploit all of the things in the system that could be used against democracy. this has happened time and again. so for example, the long period between november and the inauguration in january is a time where somebody like frump can make a lot of trouble. what we've seen now is the party that has been radicalized. there's a reason mccarthy and the rest are not cooperating. they do not see themselves as invested in democracy anymore. a good comparison is what we're seeing with the attempt to control the election machinery. there is a word form. autocratic capture. when a party allied with despotism attempts on control the election machinery, the judiciary, so you hold elections but they have to come out the way you need them to. that's what we're living through right now. >> to carol's point, we saw sinema and manchin continuing to do more to protect the filibuster than to arguably protect the right to vote itself. even though kyrsten sinema said she's supporting these bill, she's not willing to get them done. what was your reaction to her speech on the senate floor on thursday? i speak for myself, insulting, as many of us did. >> i thought it was insubtling, serve serving. it came the same day the people around her are leaking that she will run for president soon. i think it is an affront to the republic and the democratic system that underpins it. they're not up against people who have some policy difference or philosophical difference. they're up against people trying to engineer 2024 to be the last election in america. they want to capture the machinery of gov. they want to do an autocratic capture of gov. who gets the weigh the votes if they're contested? they want to build a system where they will never lose again. we will end one something like the baath party in iraq where saddam hussein got 117% of the vote. if people like manchin and sinema don't see this, i have a lot of contempt for them in that regard. i will say this. it is time for chuck schumer and the rest of the democratic leadership to take an iron cap to their knee caps. they think they're empowered with this ultimate degree in which they're the swing votes. if they're going down, they have to toughen up. they need to go on work. because right now, mitch mcconnell runs circles around him every day. schumer doesn't have the ability to hold his own people to account. >> it can't be ignored that republicans cherry pick and even pass trump tax cuts by a vote back in 2017. and it is another example to your point for democrats. playing by rules that republicans have long stopped caring about. >> of course. if it suits, let's stay republicans take back the senate majority next year. if mitch mcconnell wants to screw joe biden, he's going on shred the filibuster in a hot minute. don't they understand who they're dealing with? have they not met mitch mcconnell at this point? >> yeah. cybill that they're so naive to the reality of mitch mcconnell and the republicans. i want to go back. it was the need to defend the right to vote. something we all agree on. many people thought he should have given this speech months ago. and actually worked over the past year to shore it up. do you think it was a mistake to prioritize passing his domestic agenda before protecting the vote when you look back? hindsight is 2020. we lost the year in which voting rights were not shored up. it would have been the same position in 2021 will. >> what we really needed was to have the kind of strength of an lbj as he was putting pressure on the southern democrats for the civil rights act and the voting rights act. we needed to have the wiliness and the strength of senator reid who knew how to move that machinery through. and i do believe, given that we saw how these states, the republican legislatures, came out of the box immediately with these voter suppression laws. it was a two-track way. one was to make it difficult for african americans, asian-americans, indigenous people, poor people, to vote. the other method was to capture the machinery that counted the votes. that certain fade the votes. that figured out how to vote. to lower the guardrails that have prevented trump from being able to overturn the votes in like georgia. so that's what we saw happening in 2021 immediately. we needed to have the feds move quickly and decisively on that and they did not. >> speaking of georgia, ruth, listen to this from senator joh in many, laws have been passed and further laws are being offered which would selectively disenfranchise voters, give partisan officials the power to subvert elections. the united states senate needs to act to defend the sacred franchise and the integrity of american elections. we have the constitutional authority to do so. we cannot hide from history at this moment. >> so ruth, do you think that democrats in congress, you know, they're obviously not meeting the moment because of sin may and manchin. but do they have any more power in their hand to try to force some solution to shoring up voting right in this country? who better to ask than someone who used to work inside the justice department? joining me now, matt miller. he served with the director of affairs under the attorney general eric holder. also an msnbc contributor. thank you for spending time with us. let's talk about some of the new charges filed against the oath keepers. a lot of people taushs about seditious conspiracy not being an easy charge to prove. what does this mean? what does it mean that the doj took this step with this specific charge? >> it was a critical step for the department to take. i don't think it is one that they took lightly. there is a great deal of discussion and debate and at times disagreement over whether the evidence could eventually support these charges. i think it is important for two reasons. number one, these are very serious charges and it is important that you charge the most serious crime you can prove in a case like this to both, so that you actually achieve justice and send people to jail for the longest sentences you can get. so you have the ability to potentially film witnesses, suspects, and get them to turn against other people who may have been part of the plot. it is also important because look, the department of citizens name certain crimes and treat different crimes differently. the same reason we call people terrorists and charge them with terrorism charges and not just hate crimes. it is important that we name these attacks for what they were. if these oath keepers are convicted, they forever go down as traitors to the united states. it is critical in the short term and the long material. >> an important distinction to make and a very valid concern to have as well. the threat of domestic extremism. it is obviously not something new. in 2021, you had the fbi reveal that it had 2,700 open domestic terrorism investigations, compared to just 1,000 international terrorism investigations. why did it take so long to create this unit or take this threat seriously? or are they doing it at the right time or should it have happen earlier? >> i think the trump department was very sloes to react. i think under president trump, although they did charge people with crimes when they could prove him. wasn't in focus from the leadership. because they knew that focusing on it would anger the then president. if you look at where this new domestic terrorism will be housed, inside the national security division, that was created in the wake of 9/11. and it was created after 9/11 because doj and the fbi recognized that the department did not have enough of a focus and it didn't investigate national security terrorism crimes in the way with the kind of focus and rigorous effort that it required. so it created this division. and i think what we've seen over time, not to say that the threat of international terrorism has diminished. certainly the threat of domestic terror has risen and risen. if you look at the number of attacks in reason years, domestic terrorism far outweighs international terrorism as an ongoing threat. so it is important the department recognizes this. what it does is it brings focus and resources, which is what you need to turn investigations into cases and cases into serious sentences. >> and bring focus and resources. there will be a bit of a challenge. correct me if i'm wrong. when you're dealing with domestic extremists, you have to walk this front line and what is protected under the first amendment. how does this complicate investigations? >> well, so often in this country, we love to put things in terms of red and blue and conservative and liberal. if you're looking for an unabashedly bipartisan topic, and of course, a bipartisan problem here, too, you found it in the sense that lawmakers have effectively in many, many cases just ignored a law that was passed ten years to serve as a bulwark, a check on their personal finances, in making sure that those personal finances were not going to conflict with their public duties as members of congress in washington, d.c. and capitol hill. but that aspiration ten years ago is not really lived up to the reality of where things stand today. >> yeah. and house speaker nancy pelosi was asked about this in december. and it was a very straightforward question. whether lawmakers should be allowed to trade stocks. listen to her answer. >> this is a free market and people, we are a free market economy. they should be able to participate. in. >> it seems to me that's such a simplistic answer. because it is a 47 market. we all know that. but they're also privy to an incredible amount of influence and information that could have influence on the price of a stock. what is your take to that response from her? >> well, haums are different. member of congress are different in that they are privy to insider information, confidential information. they receive briefings on capitol hill that no other americans do. certainly not you or me or anyone else in the country. so they will have information that they can act on in a way that could potentially benefit them were they to go and say, for example, at the dawn of the paemic, buy b of stock in moderna and johnson & johnson or ppe or testing. and many did. okay? the other issue with nancy pelosi saying that, she received a lot of blowback. there was not just necessarily the republican criticism that you mate expect of nancy pelosi for anything she might say but she's been squeesed in subsequent weeks by those on the right and the left, too, people in her own party. the democratic party. so you have now probably about a half a dozen different similar bills that have been introduced in congress to one extent or another, limit or outrightly ban members of congress from trading individual stocks and effectively telling nancy pelosi, you're wrong on this issue. >> yeah. and as i noted, this is happening on both sides. who are some of the worst defenders of the stock act. as i understand it, this is a very bipartisan affair when it comes to using this position they have and purchasing stocks. >> sure. well, i'll give you two examples. democrat yik representative tom medicalinowsky running a close race. we reported in march of this year that he had failed to disclose dozens upon dozens of different stock trades that he made all through 2020, during the pandemic, some of those were pandemic sensitive stocks. and until we called him on it, he wasn't willing to make those disclosures. he said hey, my financial adviser screwed up. we hear that a lot. both from republicans and democrats. he ultimately did disclose. on the right you have somebody like pat fallon, a representative from texas. maybe not a household name but trading dozens and dozens of different stock trades to the tune of about $20 million when you add it all up. and all of those disclosures were well past the federally mandated deadline that congress set for itself. it is its own referee. members can play by their own rules. and tlaes two cases and dozens more, they have not done so for one reason or another. >> to be clear here and to button it up. what is the rule? what is a member of congress supposed to do now? there is more legislation to actually prohibit members of congress, their spouses from buying stock. what is the rule now? >> the standard is you have 30 to 45 days, depending on the type of stock trade, to publicly disclose that you have made that trade. identify what that trade is. the details, the company that you're buying or selling, the dollar value in a certain range. and also, as to whether you personally as a member of congress or your spouse or a dependent child. you have to do that, too. but that's the rule. >> as up, the members of congress are their own referees. greatly appreciate it. we'll be following this story closely in the weeks and months ahead. keep up the good job. >> thank you. appreciate i. coming up, my next guests say we should look up and start doing something. anything about climate change. i'll speak with "don't look up" people. still to come with may saturday night panel. politics, sports and culture. trump gets hung up over the big lie and novak djokovic's visa scandal down under. okovic's vis okovic's vis scandal down under downloading a movie up to 10 times faster than before. whoa! is that done? where did you get the idea for it and what was the goal for making it from your perspective? >> thanks, i'm glad you like the movie. it came out of discussions with screen writer and director adam mckay. i was talking with his after his last movie vice. i said you have to use your super powers of film making to address the climate crisis. he said, i've been trying to figure out how to do that. i don't want to make a mad max post apocalyptic movie. i said it really feels like the climate crisis is headed towards earth and not enough people care. he said, you know what, maybe that's actually the movie. and we started sort of discussing scenes and how ridiculous it would be if that kind of thing happened. and the story really is about scientists confronting real facts that are scary, and trying to tell those facts to the world, and raising the question of whether the world can accept facts, stipulated facts, and act constructively on those facts. that's what the story really is about. >> yeah, and as i mentioned, absolutely brilliant storytelling. peter, the science part of this is also extremely fascinating. this week we've heard the very latest reports that last year was the sixth hottest year on record. last summer one in three americans experienced a climate disaster of some sort. compare for me the current situation that we're in with the hypothetical threat posed in the film, and tell me why you think people aren't paying more attention. >> well, you can't overstate how serious the climate emergency is, in my opinion. and we're just right now entering the very lowest foothills of what we're going to be facing in the coming years and the coming decades if we don't take rapid action. i personally feel like it's time for us as a society to stch into emergency mode. the fossil fuel industry is the main cause of what's happening. we have to stop as a society dancing around that issue and face the fact, the fundamental facts we have to rapidly phase out the fossil fuel industry as quickly as possible. >> david, i want to play for you another clip from the movie. watch this. >> i'm sorry, are we not being clear? we're trying to tell you that the entire planet is about to be destroyed. >> okay. >> well, you know, that's not something we do around here. we just keep the bad news light. >> right, it helps the medicine go down. >> listen, it's obviously that there is an indictment and fair criticism, the indictment of the media and the way we cover climate change. so there is definitely a little dig at the news coverage on this issue. i want to ask you, how does the movie not become a parody of itself here for a moment? there's been a bit of a backlash basically saying the film doesn't come up with answers in this particular scenario, or even any suggestions. what do you say to that? >> well, what i say is that, first and foremost, the movie is a movie. so that's one set of stories. secondly, it's designed to try to raise awareness of the problem we have in communicating with ourselves as a society about scientific facts. and i think the movie does accurately raise questions about whether the media right now as it's constructed is willing to take a crisis like climate seriously and bake it into the day to day coverage. you know, climate -- we cover -- the media covers the economy every day as part of its coverage. it covers all sorts of things, the political wranglings on capitol hill, day to day coverage. it does not cover the climate crisis day to day for a number of reasons. one, it's a terrifying topic. that doesn't mean it shouldn't be covered. the media gets a ton of funds, people in the corporate media know where that comes from when they're working for those outlets. i think the bottom line here is that climate change needs to be part of the day to day. when the president has a press conference, that should be part of the question. it shouldn't just be the economy or what's going on in congress. it should be what are you doing to stave off this crisis that threatens the livable eco system of our planet. >> i know, that's an absolutely valid criticism against the media in this country for not putting climate change front and center in every aspect of our coverage, and taking it as seriously. peter, the flip side to that is how do you take as a scientist and activist, how do you take the eyeballs that have seen "don't look up" and translate that into action towards climate change and preventing this disaster?
