this country. and particularly to its workers. the disease right now, killed almost 1 million americans. it spreads from person to person contact, and is confined in small spaces. that includes work place environments. and in those environments, individuals have little control in their capacity to mitigate risk. covid-19, in short, is a war -- since the diseases onset, most americans have seen their workplaces transforms. the administrative agency charged with having health and safety in workplaces, told congress what to do. -- osha, the occupational their safety and health administration, issued an emergency temporary standard. requiring either vaccination or masking and taxing -- all within recorder of the agency's mission, to protect employees from great danger, osha estimates, and there is no ground for disputing. that the standard that they proposed would save more than 6500 lives. and for over a quarter million hospitalizations just in six months time. yet today, the court issues a stay from preventing the standard from taking effect. the courts order dismisses the governments ability to counter the unparalleled threat that it poses to our nations workers. without competence and legal placements -- given the responsibility to respond to workplace health responsibilities. quote, we respectfully dissent. justices elena kagan and stephen b. or dissenting today from the ruling today from the conservatives on the sea supreme court. it required workers either be vaccinated or to get where gallery tested. in a separate ruling today, the court did leave in place the vaccine requirement in the health care setting. but if you don't work in health care, if you're stacking in shelves, or working in a kuehn of coal and your workplace doesn't want to protect you from a covid environments, the supreme court just blocked the biden administration from helping you. they blocked the biden administration from being allowed to make your workplace more safe. it's not exactly an ex unexpected ruling given how right-wing the supreme court is right now and how an informed the supreme court justices questions were but now it is done. we'll have more ahead tonight. we'll also have more ahead on what's happening with democrats joe manchin and says -- that they effectively will sign with republicans, even as republicans roll back voting rights and attacked them all across the country. joe biden lived tonight, we'll have the latest on that. we'll also have the latest on a story that we are well stuck into, the strange and spreading story, about the previously unknown, mysteriously coordinated efforts to have republicans in multiple states forged documents after the last election. they presented themselves as fake electors to the electoral college. this is a story we've been covering in recent days of you've been watching the show, it's still ongoing. we have more new, ahead on that tonight. but here's where we need to start tonight, as you have heard tonight from the justice department, in the year since the justice attack on the -- of the justice department has arrested in charge more than 700 people with participating in that event in some capacity. the vast majority of the 700 plus people who have been charged were charged with low offenses like trespassing. it almost immediately after the attack, people looking at footage said that in the crowd, many rioters were throwing themselves that barricades, police officers, and doors. within that riotous, and uncoordinated crowd, there were some attackers who seem to be highly organized. this is the report just days after the attack. donald trump supporters massed outside the capitol last week, a line of men wearing olive drab outfits and body armor trudged up the stairs in a single file line. each holding the jacket collar of the man ahead. that formation, known as ranger file, is standard for a combat team who stacking up to breach a building. it's easily recognizable to any marine who served in afghanistan. -- storm the seat of the american amongst -- trained by those who did. again, that was the associated press reporting just days after the attack. this is footage that many came into stark relief. that military stack formation. there's a bunch of people standing around yelling, but who are these guys? this organized group. one hand in front of the next one. wearing helmets, wherein coordinated outfits of some time, just trudging up the stairs just like the ip said. within six weeks the fbi actually tracked down and arrested the people who form that sack on january 6th. they were not just charged with trespassing or breaking into the capitol, they were charged with the conspiracy. nine people charged with charging to destruct the capitol -- it was not just that they showed up to protest, that things got out of hand. or even that they planned to storm the capital just to wreak havoc. these guys planned in advance to storm the capital and disrupt an official proceeding, to disrupt the official proceeding of the election. and in service of that proceeding, according to prosecutors, they arranged for firearms and combat training. they required weapons, lots of them, and have stock of them in a hotel outside of washington d.c. so they could go there quickly for use on whatever they were planning to getting themself into on january 6th. all of those guys, previously indicted, were part of a white greying dressed up call the oath keepers. this is how they describe the oath keepers. the oath keepers are large but loosely organized collection of individuals, some of them associated with militias. the associated press says they have law enforcement and first responder personnel. they are led by, person one. person one, the leader of the oath keepers, he's put by name in a lot of communications with those folks who are indicted last february. the guys who are in sack formation at the capitol. this guy's name stewart rhodes. that is him with the eye patch. you would be shocked to learn it was to do with the unsafe handling of firearms. an accident with a gun, that is what happened to the eye. but in this election, as the 17 oath keepers were arrested for attacking the capitol in various capacities. some of them pleaded guilty, but throughout all this time the oath keepers leader with the eye patch, has been unavoidable for comment. he has been loudly telling any reporter who gets near him that the election was absolutely stolen from donald trump and he encourage them to be in d.c. in january 6th. he was there coordinating with fellow oath keepers, but also meeting to say, that he was not breaking the law because he is way too smart to have done anything illegal. today, stewart rhodes was arrested just after lunchtime in texas. another oak keeper guy was arrested in phoenix at the same time. and they, along with other oath keepers who were arrested at the attack in various capacities, they were indicted today on the very suspicious charge of conspiracy -- seditious conspiracy derives from the concept of suspicion. it is openly mulling, since the beginning of the investigation, the justice department used to do briefings for the media in the aftermath of the attack, they had not confirmed seditious conspiracy -- but now more than a year after the attack, this is the first time they actually have used it in the indictment today. sue dishes conspiracy is basically a act to commits conspiracy against the government. it's a conspiracy to stop the government to come carry out its flaws by fourth. here's how the indictment describes this. it is the plot to -- of presidential power. beginning in 2020, defended stewart rhodes, began sending messages on an encrypted app to have its -- on november 5th 2020, two days after the presidential election, mr. rhodes urged its followers to refuse the election results. we are getting through this without a civil war. prepare your mind, body, spirit. and on november 7th, 2020, they were projected to lose the election and he told his fellow oath keepers, we must now do with the people of serbia did when mullah suffolk stole their election. refused to accept it and storm en masse in the nation's capital. he spelled it wrong, that's okay. mr. rhodes referring to the sister storming of the serbian parliament in 2000. he shared with his followers, a video and not step-by-step instruction on how to storm it. this messed up guide, specifically, included storming the parliament. we don't call it the parliament, we call it the capital, because it houses our congress, same idea. on december 11th 2020, he wrote a message saying that if president biden were to assume the presidency it would be a bloody and desperate fight. we will have a fight. on december 25th, merry christmas, mr. rhodes wrote, i think congress will screw president trump over. the only chance he has is if we scare the issue out of them and torture them into doing the right thing. i don't think they will listen. on december 31st, happy new year, an arizona quicker force action team member mention -- everyone coming that has their own technical quick mint and knows how to use it. and a wink he face emojis. mr. rhodes replied, awesome. the arizona quick reaction force team member also said the group would have force and manpower. on january 4th, they did all's go to washington and were stationed with quick reaction forces just outside of the district where they stockpiled weapons, assuming to be ready on short notice to come blazing in. these stacks of oath keepers, have beginning headed toward the capitol and the capitol steps. the point of the spear for breaking into the nation's government. according to days indictment, there was not one, but two stacks of oath keepers who breached the sacks on two separate occasions. they were looking to try to find speaker, nancy pelosi. just before 1:30 pm, us claimed by and oath keepers affiliate that they had breached the capitol, mr. rhodes replied, no i'm right here. these are patriots. pence, as i predicted, isn't doing anything. the patriots are taking it into their own hands. they have had enough. approximately 1:30 pm, oath keepers said -- they have pepper spray at the capitol and what the rioters said we're gonna happen if the rioters wrapped the capitol. the person with the method time said quotes, we are like a fathers. can't stand down. mr. rhodes quoted, hey were storming the mansion in the governors in massachusetts. -- they didn't fire on them but they street fought. that's where we are now. next comes our lexington. it's coming. it's coming, just one more thing i want to share with you from today's indictment. it actually continues beyond january 6th. the section of the indictment titled, coconspirators continue plotting after the january 6th attack on the capitol. quote, throughout the evening of january 6th, 2021, the coconspirators discuss the need to continue fighting to stop the lawful transfer of presidential power. in the weeks after january 6th, roads purchased a large volume of firearms and related equipment. the indictment analysts, thousands of dollars, tens of thousands of dollars worth of -- scopes, backpass, gun groups, ammunition, firearms, gun cases, pollsters, and gun maintenance equipment all purchased by mr. rhodes at that time. you can see the dates there. january 10th, january 11th, january 14th through 19th. adding up all the purchases listed in the indictment arose made a firearms and related equipment, over that short burst of time, he spent something like $40, 000, right around january 6th, just on weaponry. quote, on inauguration day, january 20th, 2021, one old keeper message another, after this, if nothing happens, it's war, civil war two point oh. around this time, roads messaged others organized local militias to oppose president biden's administration. for the oath keepers, january 6th was not the end point, it was apparently the beginning of a new phase of their new fight against the government. as of today, 11 of them are facing seditious conspiracy charges. that is a serious felony count. but, by u.s. federal prosecutors in d.c.. -- kathleen velour, she is the author of bring reward home, the white power movement and parliamentary america. you may recall her op-ed post in which she said, we still lack an adequate understanding of one of the days in many dangers, the threat of malicious to american democracy. she has spent a very long time studying the white power movement and militia movement in this country. professor, thank you for making time for us. i appreciate you being. here >> thank you for having me. >> so, we've had more than 700 people charged for doing various alleged crimes, related to january 6th. this is a different type of crime that is been charged against the, sort of, different kind of defendant. what do you think the public should understand is different and important about these right-wing parallel marital groups, like the oath keepers, who were the subject of the indictment? >> i think, when we think about january 6th, it really represents the collision of three different groups of people. one is the trump base, which contains within it, a range of -- that goes from people who were simply attending a demonstration, as they, thought to people who came there with an intent to do something more than that. or who's were swept up in the. moment then we had qanon, which is very new, and very different and it's tactical organization. finally, we have what is the smallest group, but a very important group, which is the militant right. militia, as white power groups, and other groups that are highly organized. coming from a coherent ideology and decades, if not generations of training. who bring with them paramilitary training, infrastructures, tactics weapons, explosives and more. what we say in these charges is the beginnings of a reckoning with that part of what happened on january 6th. now, i think, the full reckoning has many many parts to it. something to do with the complicity of people who were -- trump's administration, decisions about when to send the national guard, for instance. all of these have to do with political response. this set of charges has to do with the on the ground, violent actors, who, according to the indictment, came to this action with an enormous amount of planning, with the intention of a attack on democracy. >> was there anything -- there was some of the things about the behavior of the oath keepers and they're planning around these advance that we had seen in and other indictments -- that have faced previous other indictments, involving conspiracy charges and other things. but, i wondered if there is anything in these new indictments concealed today that was surprising to you. i'll tell you just reading it as a non expert observer, i was surprised by the extent, and the expense of the arsenal -- the actual weapon arsenal that they both assembled on the day of january 6th, but also around the time of january 6th, and leading up to the inauguration. that left out to me as something as new detail that i did not understand. before as more expert of deserve, what's surprised you? >> i think that's right. this does show a higher degree of militarization, and weaponization, then we've seen at the lower level indictments. partly, that's because of typically building a big case, like a conspiracy case, often rests on the prosecutorial efforts and the fruits of the lower stakes. prosecutions leading up to that moment. i think, the best cognate is the seditious conspiracy trial in 1977, 88. were 13 white power activists were charged on seditious conspiracy. there again, we see a high level of paramilitary organization, inter group, an inter personal communication for a sustained period about the plan. a high level of armed -- in that, trail it ended up escalating even beyond what we see in this charging document, to have things like, though -- those activists had not the typical automatic rifles, which are very -- are all around in the movement, from the beginning to now, but that would've been an 87, 88, with anti tank weapons, law rockets, land mines, and a whole bunch of training, paramilitary tactics. in that case, there was a very clear picture of evidence about an imminent threat to surrounding populations, and to the nation, at large. >> but, of course, the bottom line with the arkansas trial is that it failed, as a prosecution. the defendants were acquitted, which they celebrated in their inimitable way. i know a little bit about about some other mass edition trials over u.s. history. they are very, very difficult to prove. even people who have done really bad things, obviously, in coordination, with incredible weaponry, for the worst reasons, and kept records of, it they seem to get off in these trials. these are really hard trials to win. i wondered if that was part of your reaction about hearing about this indictment. keeping in mind that history on how many haven't succeeded in getting convictions. >> absolutely. it's incredibly high stakes -- also, because, over and over, again what we see with major prosecutions that fight power and military groups, when there is a failure, when people are acquitted, when a movement is able to package an acquittal as a victory for organizing, we see upticks in violence on the other side. you can draw a direct line from the 1987, 88 trial, to the aqua homer city bombing in 95. the other thing is the way -- it's now, i'm speaking as a historian, and not a legal scholar, but the way that the burden of proof works in seditious conspiracy trials has made it tremendously difficult to translate white power ideology and militant right ideology into this particular form. for instance, people were very interested in, how could a plot like this possibly succeed? if it's a seditious conspiracy, do they have a chance of, in fact, overthrowing the government? if you're sitting on the side of an ordinary person, with a mainstream political view, it seems very wild to think that a small group of people could pose a threat to the most militarized super state in history. if you are this group of white power activists, they have a plan for -- guerrilla warfare, disrupting infrastructure, or sabotaging assassination, and they took a long view of gradual destabilization leading to race war, that they believed could work. this question of ability to carry out plan came into play in ways that were not translated very well, for instance, -- >> all right. although, the psychological barrier of being able to imagine a coup effort working suddenly got a lot easier for everybody in the country, including every member of some future jury, a year ago, this month. it's fascinating stuff in the history, here. the history is rich and dark and fascinating. and doesn't point in any one direction, in a simple way. >> professor kathleen, university of chicago, author of the excellent book, bring the war admittedly strange story, about what appears to be a coordinated effort. we don't know who coordinated it. but a coordinated effort after the last election, where republicans forged documents claiming to be the electors from their states. waiting to cast the votes from their electoral college. in five states they did this. and in all five states the forged documents they produce as part of the scheme, they were identical. same facing, same exact where they. including the part where each republican sign their names and claims to be the julie appointed and qualified electors from their states. which they were not. since we've been reporting on this, this week, we've learned that one of the people, who apparently signs these door documents, appears to be a republican united states cabinet it from arizona. it's james lemon or layman. he wants to be a republican senate nominee to run against mark kelly, he appears to have signed this forged document saying that he was a duly elected electors. when he was not. we have reached out to him from comment but we have not heard back from him in his apparent role in this forged occupant scandal. we also have checked down some footage of the proverbial crime being committed. footage of the republicans who took part in the schemes in these states. meaning they signed these forged documents. here is footage of the meeting where georgia republicans filled out there forged elections document in december 2020. again, this is georgia. we also found footage of the fake electors signing these documents in the great state of nevada. >> all right, donald j trump on the state of florida, having received six electoral book, is declared the winner. we will now do the certification of the electors of nevada for president. certificate reads, we the undersigned, being the julia elected qualified electors for the united states certify the following, we organize in the state capitol in nevada on december 2020, they have joined upon us and we have received a ballot for president and vice presidents. the person they voted for is donald j trump of florida, he is received six votes. now we will sign the certificates that will go to the senate. >> donald j trump of the state of florida having received six votes is declared the winner for the state of nevada. really? declared by who? declared by you? what are you talking about? donald trump did not win nevada. he did not win any electoral votes from nevada. these folks claim that he did. it's one thing, and it wasn't, right to go say something like that if you wanted to on a soapbox on a street corner. and assisting you want to tell you relatives about your weird things about the election. but it is quite something else to put it in writing in a document that is made to look like of official documents. for the document to assert that is an official state document, and then send it to the national archives to united states and the united states senate to say the document you forge might be real. that's. and it does appear to be a coordinated effort. and we don't know by whom. representatives of the trump campaign could've asked them to do something like this. mark meadows and his connection to the january 6th -- seem to be in connection with someone about this scheme, he apparently got this to happen, and this mysterious document that all of the states created the similar forgeries? we don't know. we just know that they did it in nevada, georgia, wisconsin, michigan. and in michigan, we also have footage of when they decided to do it. the footage that we have is republicans trying to get into the side door of the michigan state capital. telling him that they were the real electors and they need to put in their votes. the commissioner politely told them to buzz off and close the doors. police had to do that because the real electors were at that moment, inside, doing this thing for real. these guys were clearly impostors. well now, thanks to this developing story, thanks to the renewed attention to this matter. it seems that someone coordinated this effort in the united states. thanks to craig mueller at the -- now we know more about what happened after that moment. we know more of what happened after the state troopers blocked the impostor republican electors from trying to get into the mission state capital that day. we know the day that they tried to get into the capital, we know the day that they created these forged elector documents that it looks like further state. that the forged documents asserted that they were the real actual electors, which they absolutely were not. they stated further, that as the julia elected a pointers of -- we can see that, thanks to the very upright and polite state police who told them no. we know, further, that the michigan republicans who signed the forged documents claiming to be electors from their state, they actually did send it into the national eye crimes as if it was a real document. we know, that because on january 8th last year, two days after the attack on the capital, the national archives in washington sent a copy of that forged documents back to michigan. send it to the state government in michigan. quote, for your awareness, we received today and official certificates from republican electors who are not reported by the government. i've attach a scan of what happens. and because we are the united states office, we will not be adding these to our website. the national archives, just last year, letting michigan's real elected officials know that this forgery was sent in trying to be michigan's electoral votes, but the officials wanted them to know that this happened. for your awareness. michigan officials, including joscelyn vincent, and her staff, reportedly met with the january six investigation late last year. according to a public records dive by detroit news, kate benson and her staff of the investigators was followed soon after by the pence's office for the january six investigation. some documentation of the republicans forgery in michigan, and the office reportedly provided on december 3rd, about the forged effort and the national archives receiving it. they forwarded that information to capitol hill, to the january six investigations. so we piece all that together and what we know is that the january six investigation is part of the plot. and, that remains the interesting question of whether the republicans who did these in these five states, whether they're on the hook for violating the law. it's not illegal to have crazy ideas, it's kind of illegal to forge election related documents. was it illegal or any of the states to forge these kind of a legal documents and trying to pass them off as real? and to comment on this, from the detroit state news, an official told the the news, and official stated that matter is part of an investigation into election related matters. we are documents claiming that trump was the rightful winner of these electoral votes, claiming that they were the rightful winners of the electors. they sent these to the national archives, the united states sentence. this is the same weird republican forgery scheme that was apparently being run in at least five states in what seems to be like a coordinated effort. and it was part of multiple investigations to attack the capitol and on january 6th. according to joscelyn benson, she and her staff have spoken to the january six investigation in congress, including about the forged election documents in her state. we know this by the public request files by the joint detroit news. and we know -- on this matter, the fake a master's suit ca shun has forged documents from republicans, according to a collector this is part of an ongoing in the state of election in the michigan. joining us state of michigan. now, are both joining joscelyn benson, us is now secretary state of joscelyn since we started to has coped the scheme as to whether it implicates any criminal acts. whether or not it's legal to four general document like this. to assert yourself to be a public official, effectively, when you're not. it is potentially a matter for criminal investigation? >> yeah, absolutely. we've been evaluating charges for nearly a year now. almost as soon as we became aware of. it under state law i think clearly you have forgery of public record, which is in. offense and elections in rural law forgery, which is a five-year offense. but what we have decided to with the investigation, in light of the fact that we have, as you pointed out multiple times, now various different fall slate of electors from different sites. in what seems to be a coordinated effort, between the republican parties, in various different states. we think this is a matter that is best investigated, and potentially prosecuted by the feds. as such, just today, we were for this matter to the western district to the u.s. attorney's office, to evaluate it. we hope that means justice. and the department of justice will become involved, using information that they already have to better understand exactly what happened that day, so that federal charges can be evaluated. >> so, your office, the eternal knee generals office has -- to the federal prosecutors office, in michigan, as of today? >> as of today -- and we had thought that it was very possible -- and we still might. we still might, and of course, there is no job double jeopardy if we were to bring both state and federal charges for the same offenses. obviously, this is part of a much bigger conspiracy -- in the department of justice -- merrick garland will take this in coordination with all the other information they received, and make an evaluation, as to what charges these individuals might face. i can think of many, forgery of a public record for the purposes of dividing united states. or, conspiracy to commit an offense to defraud the united states. there are so many others, but that will be up for the feds to decide. >> secretary benson, let me ask you about -- some of which i don't know if you could talk about. the detroit news, in its infinite wisdom, use public records request to find out some of the documentation that has traveled between your office, other michigan state offices, and the january six investigation in congress. that's how we know that some of this information has been given by your staff, by your office to the january six investigation and they appear to be looking at this in multiple states. can you tell us anymore about that? about your office's involvement about you receiving this information, and indeed passing it on? >> well, yeah. first, all just emphasize that this is precisely why the work of the january six committee is so critical. there are dozens of ways, just like the one we're talking about, in which the former president, in many of his supporters, attempted to interfere with the integrity of our elections. so, with this investigation, we've been able to connect the dots in participating, and cooperating with the committee's investigation, identify this coordinated component of something that really, up until then, just came to us. we received notification from the national archives, as you pointed out, saying that this alternate, fall slate of electors had been submitted. we, of course, lived through what you showed earlier. because the attorney general and i were in the state capital when the fall slate of electors, will say, showed up outside, admitting all of that. there was a lot of security concerns, and threats percolating, as well. it was a very tense moment for all of us. so, in the midst of all that, we were seeing this as yet another way, in which the former president tried to impose his will, over the will of the voters. and, outside of the law, in a very unprecedented, way and, again, turn it over to the attorney generals office for further investigation, at that point. also, let the national archives know that we had received it, but of course, it was not an accurate reflection of the electors awarded in our state. >> just to play dumb here, for a second, i think i know the answer to this, secretary benson, but tell me the truth. is this the sort of thing that has happened before in the state in michigan? it is something that you have ever seen and your role as a chief administrator for elections in the state? it is something that looks weird to us from a national perspective, people try this type of thing all the time? >> no. for good reason. up until 2020, we've had a lot of respect to our voters, which was really upended in the chaos and can fusion that we saw surrounding the 2020 post election process. this is unprecedented. we are in uncharted territory. both of us -- as this is come out. what was legal, and what was illegal. i think it's important to emphasize that this is all unprecedented. but, it also underscores why it's so important for us to not just ensure truth -- not just how far folks are willing to go to overturn an election just because it is like the results, because we not only need to see justice and accountability for those who broke the law, but we need to work to put protections in place to make sure we don't see a
