something he sees as part of a pattern of democrats trying to turn him against former president trump. here's one of the member of committee said about that very report just a few hours ago. >> we would just like him to come in and share with us what he knows, he knows what's right for the country. he knows what happened in the election, he knows the pressure of the campaign he was under. i think it'll be of service to the country by talking about. but he also knows there's a political cost that comes with that. i hope he makes the right decision. the price president has very material testimony, and we hope to do the right thing. >> in new news that is no surprise, republican congressman jim jordan now signaling he may not comply with the committees requests for voluntary interview. about what he was doing on the six. lee esther de jordan's and the committee a lengthy letter, saying in part quote, this request is far outside the bounds of any legitimate inquiry. he called it an outrageous views of the select committee's authority. also happening today, lawyers for trump himself as a federal judge to toss out lawsuits that seemed to hold him liable, for his own role in inspiring the january 6th attack. in another legal battle for trump, rachel maddow reported tonight that attorneys for the former presidents have met in person, with the fulton county district attorney's office in georgia. tonight a georgia prosecutor investigating trump efforts to overturn that states results, tells the ap that a decision on potential charges could come in the first half of this year. could being the important word. president biden and vice president harris will be heading to georgia tomorrow, for what the white house says is a major push to protect voting rights. biden speech is expected to call on congress to pass bills overhauling election laws, the administration also dealing with a high stakes foreign policy challenge at the very same time. today, u.s. diplomats met with russian officials for the first time, of several to try to defuse the crisis over the ukraine. russia has now 100,000 troops stationed along ukraine's borders. the white house is threatened sanctions if russia invades. today the kremlin insisted has no plans to do so. we will get a report from ukraine's border later in the hour. with that, let's bring in our lead off guest on this monday night. ashley parker, pulitzer prize-winning white house bureau chief with the whales per post, eugene daniels -- and jeremy bash, former chief of staff at the cia and the pentagon. ashley i turn to you first. this january six committee needs witnesses, with firsthand knowledge of what went down on capitol hill. walk us through how critical mike pence's. and let's get real. if mike pence does not cooperate, what are the actual consequences? because thus far, it seems like the consequences to turn on trump or worst. >> it's interesting. mike pence is incredibly critical in the run up to january six. he was the critical person, who the former president and all of his aides, his attorneys, people in trump's orbit, we're putting pressure on, to as we now know, overturn the results of the election. the former vice president was in frequent contact, including on january 5th. with the very tough conversation again on the morning of january 6th. when he again told the president and what we know was a very unpleasant conversation, that he was not going to do. on the actual day after that conversation, mike pence is very little contact. this is one of the things that republicans were very upset about, as trump supporters are chanting hang mike pence, they're coming in just about 60 seconds of being able to reach the, man some of them wanted to hang for treason. there's no outrage from the white house anyone on his team. at some point pence's chief of staff, cause the white house and says hey guys, just so you know, we're okay. he is a lot of insight the it would be incredibly important. to answer your specifically question, he's almost never crossed president trump except on january six when he upheld the election results. seems unlikely that he'll flip on him now, the way that the committee would like to see. >> given how unlikely it. is given that people like jim jordan, are not going to cooperate. jeremy, is the committee really able to make these criminal referrals. if they don't, they're not getting anything? >> i think the committee has objective, that's to do several things. first and foremost is to put out all the facts. if the american people can see exactly what happened on january six. the dimensions that were seen on live television. but also the dimensions that were hit in. the planning that went on at the way house. the pressure campaign behind the scenes. against vice president pence. the effort to coordinate with insurrectionist, to stage an armed revolt and our democratic process. and i think if there are criminal referrals to be made, the committee is not going to shy away from making. them whether or not a prosecutor feels they have all the evidence, to bring a case in front of a jury and convict somebody, that is a different standard. but the committees standard is to shine a light on these facts. it's absolutely critical that people participate, and cooperate with this investigation. and if they don't, i think it just showcases how much the trump team wants to hide the facts, from the american people. about exactly what their role was and january six. >> okay fine then jeremy, but yes it showcases that. but what is showcasing do? >> well i think there's political accountability, that can emanate from a credible investigation. this is a credible bipartisan investigation. i think stephanie, is what you're getting, unless someone goes away in handcuffs, whose last name rhymes with trump, and this is all a waste of time. i disagree. i think there's a very strong political electoral dimension, we have to make sure this never happens again. this is the absolute bare minimum role of this committee in this congress, which is to ensure that the 2022 elections, in the 2024 elections are free, fair and open, from coercion. the kind of which we saw just a year ago. >> that same person whose name rhymes with trump, his lawyers met in person with the lawyer georgia, da who may or may not do something by the end of the first half of this year. any chance that sticks to the person whose name rhymes with trump? jeremy? >> i personally don't put a lot of stock in the criminal investigations jurisdiction by jurisdiction. i think what the president did on a grand scale, was unconstitutional, it was unlawful, it was criminal. it was an effort to inject voter fraud, and to steal the election. ultimately at the end of the day, the american people are going to have to hold him accountable. they will have to hold political leaders who lined themselves with him accountable. whether or not fulton county da or some other prosecutor can make a case, i don't know. but i don't think anyone should hold their breath for that, and declared a failure if that's not the outcome. >> eugene, the white house is a big legislative agenda ahead of, them voting rights is the whole ball of wax. and then there's this january six investigation. how much focus are they putting on that? >> on january six as you saw on the anniversary, president biden for the first time really leaning in and talking about january six, talking about his predecessor. without saying his name, painting him is dangerous for democracy. something that aides talked about. how do we, how much does president biden lead in? for months, you have seen democrats, progressives activists, historians. wanting the president to do, so really call iowa happened on january, six more specifically tie that to president trump, and then tie that to voting rights. that is with the white house knows that it can do. it can use this to open and raise awareness to talk about these things as they see it. to make things plain to the american people. there are, the american people are in their corners on this, they know that it's going to be difficult to change the minds of republicans. on what happened on january, six is the way washing of that day his already started, but they are focused on the democracy aspect. protecting democracy and talking about, it as much as they possibly can, hoping that it's going to break through it's proven difficult so far, with president biden going tomorrow and vice president harris and going tomorrow to georgia, to talk about voting. writes we know that he will do some of that time again, from january six into protecting voting rights. we are hoping to make that connection. and continue to make that connection, and hope that helps. as we all know, january six continues to be a day that democrats and historians, we're able to see and watch that, day we've seen what happened, and republicans see things very differently. >> let's stay on that speech tomorrow, white house calling it a big, speech big focus on voting rights. it could be an extraordinary speech, the president gave a very strong speech last week. but it does not change legislation. and democracy is at risk. are we going to get anything different tomorrow? anything different than what we have heard before? >> i think we are going to hear the president talk about voting, rides differently than he has. before i think this is not the first time he's called on the senate to pass these two pieces of legislation, that are sitting on their desk. he is going to come out we are told, full-throated in a carve out for the voting rights. for filibuster, voting rights, a plan that is in motion and democrats in the senate have been planning on doing something like this, and these pieces of legislation. and possibly doing a bow on these voting rights filibuster. he's going to? >> he knows, we know there's still a steep hill to climb. he can only do so much when it comes to the filibuster. he can pressure members of congress, excuse me, senators, to do that. to get on board with that. you know manchin and sinema have proven to be a bit difficult there. it's not just them. you have mark kelly, arizona senator who's up for reelection in november. also kind of seen is whether or not he'll be on board with a carve out for the filibuster. it's not just those two. civil rights leaders are hoping they will see biden really lead in, and even call out some of these folks by name. we've already seen that backfire with joe manchin. i'm not sure the president is going to do that, but we are hoping to see a complete different shift, this white house knows, and i've said over and over, it's reached a different level, a different level of interest and involvement when it comes to voting rights. >> ashley, let's stay on that strategy, does talking to people in georgia matter? or should he be camped out and joe manchin's driveway, and outside kyrsten sinema's apartment? >> you have mixed attitudes on, this you have some activists in georgia and elsewhere, who are saying they are frustrated with the president, and they are saying they are deliberately not going to go to the speech, they say at this, point a year, in someone who ran on restoring democracy, who made promises on voting rights. we need to see more than a speech. unless you're going to come down here and tell is exactly how these two pieces of legislation get through congress, we don't want to hear. at the time for talking is over. there's also a lot of that, simply going to a state, where people voting for incredibly important? >> going to a state that has some very restricting voting laws. using -- history in the shows of the places is meaningful. you have a very narrow senate, there's only so much you can do by executive order, it's a good tool. for those people they're also happy that at the very least, biden is finally turning full attention to. this there's a sense that build back better may be on the backburner. they're pushing to change the filibuster. and some of that public pressure may help sway those senators. going in sitting in manchin's driveway, -- won by about 40 points, is frustrating [inaudible] -- >> voting rights is hugely important. those activists ashley's talking, about have huge influence in the party, let's talk about regular voters. how does joe biden get them to prioritize voting rights? they are thinking about putting food on the table, and their kids in school. >> stephanie, i think that's of course fair, and america's families have to prioritize, quote unquote regular families. i'm not sure what that means. people who are disenfranchised, people of color, minority groups in this country, communities of color, they are quote unquote regular americans. sometimes we say regular americans, and we were really meeting is kind of white folks. >> i mean on politically active people. people who aren't thinking about politics. you are not thinking about voting rights, people were just thinking about living their day-to-day lives. too many of them voting rights is an abstract. >> of course, i understand, that but of course the foundation of the ability to have any power at all, in the ability to change your community, your civic leadership your neighborhood your city council, your mayorship, your members of congress, the foundation is your right to vote. we were democracy in this country until the 60s, until people actually had the voting rights act to enabled so many millions of americans who up until that have not been able to cast a ballot, to do so. i think this is foundational. i think it's fundamental. i'm not sure i agree with the premise that people don't care about. i think that people understood that their vote was denied, they would care about, and they do care about it,. >> are they thinking about an? enough do you think people think about it in their day-to-day life. in the exact way you laid it out, it's something we all should understand and prioritized, but given all the people are dealing with, how do democrats get people to make it that priority? exactly how you just said? >> it's connecting what's happening in the political realm, to making sure that there is equal pay for equal work, making sure that the right to make medical decisions on your own behalf, are actually connected to your ability to have political power. the ability to have civil, rights and human rights in your community. to have good education for your kids. to have health care for your family. when those are things that emanate from one place, which is your ability to have political power and democracy, i think if democrats make that clear, make that plain, people do and they will understand that. >> ashley, let's turn now and talk about the russia situation. how worried is the way house about it? >> if you look at just this first day of security talks, both sides, on the one hand we're a little bit cautiously optimistic. this way house is incredibly chloride. a number of the things that russia is asking for, are simply non starters. the idea that ukraine will never join nato. that's a nonstarter for the united states. the idea that nato would go back to its 1997 boundaries. that's nonstarter for the united states. well they're having these talks, they're amassing troops on the border, there's helicopters and other things being moved, in president biden's been very clear that he does not trust putin. biden is also wanting diplomacy first, but of course they're worried about this. >> jeremy, earlier today i spoke to a russian political activist garry kasparov, i want to share what he said about putin. >> this talks with putin's are hostage negotiations with the tariffs. he invaded ukraine and now he's using a throw of earlier visions to demand commission concessions. it's basically about destroying the eastern flank of nato. this isn't about geo political interest of russia. national security, it's extortion in putin's interest of causing chaos. it's expanding his influence, and staying in power. it's completely backward. the free world should be making the demands of the terrorist groups, the invader groups. the man president biden correctly called a killer. >> did the u.s. come away with any concessions today? >> well they've gotta get serious about the threat that's in front of. then they have to be able to articulate exactly would it, is in understanding exactly what it's coming from. and why it's so animated. this relates back to your conversation you just had in the opening segment. it really does boil down to the simple question, how do you reason someone out of a position, that they never resend themselves into. that is the rub of this. donald trump came in and got people who everybody said, oh this was a regular joe republican. and he's stood for strong defense, russia was the bad guy. grow the economy etc. and now it's all trump. and no one is yet put their finger on well how, and why did that happen. when you look at the proposals that democrats have put out on the table based off of the 2020 election, voters are going hey i did that. i voted to get rid of trump, but i didn't vote for all this other stuff. so that's the gap right now that you're seeing playing out. >> hold on a second. what do you mean, the other stuff. do you mean that democrats need to slim down what they're trying to put? in this new proposal. i don't follow. >> exactly. listen to what the voters are telling you. they love the infrastructure plan. build back better not so much. you keep trying to force a square peg into a round hole politically. where the voters just aren't ready to accept. it doesn't mean they don't want build back better at some point, but other things are more pressing to them, and that is the conversation i think democrats are not having. which is what is reflecting in the polling that you see. and why the landscape looks the way it does politically for republicans. the country feels, these guys don't get, may you hear with black voters, you here with hispanic. it doesn't matter the group. if they don't understand why i gave them the power in the first place, then maybe these other guys will get it back, and we'll see what happens. and you don't want that added to decide in, he need to speak to what the voters are telling you what's driving them right. now and it's not the things that some of the democrats are out there pushing. >> matt you conducted what you've classified as a stress test an american democracy, what does that mean, and what did you learn? >> i did not conduct, it's what we have been going through, in my view. in the last five years. i mean it's a stress test as your viewers know and as you, know it's what we do as we advance in the age. we want to make sure we're healthy not just respite in vigorous activity. and you think you're strong, then you go through a stress test where they put you on a machine, it increases your heart, right and then sometimes you discover, people he thought were healthier not healthy and there's underlying problems. whether it's cardiac or whatever. it's something's going on in your organs. >> you're saying we don't realize. >> our country's been through the same. thing i think what happened was we thought we were okay as a democracy. this is pre-trump. we had our ills and we had our pains and we had our aches and we had certain things, but we thought we are okay. with donald trump and his election in the aftermath and january six and i believe also covid and how we how it's been politicized has shown our democracy is not healthy. it was not healthy when it led to trump and it has not been healthy true trump and i my fear is all of the prescriptions are like giving people tylenol or advil to relieve their headache or relieve their fever and we are not dealing with the fundamental problem. the fundamental problem which led us to hear in which in my view is endangers our democracy, is in my view of through fold. first it's a huge segment of the population that has been lied to and is now propagandized to both cable networks and radio and all that we. have a segment over population that has no longer shares a common set of facts with us. democracy cannot survive with that. the second part of that is now we have people that are on cable and people that are exasperating people's fear in haiti in grievance. and so with that then leads to is this one horizon white nationalism or a fertilizing of what's already existed here. it also doesn't allow us to get to the common good if we no longer share some values with their neighbor care about our neighbor and no longer believe that. we don't have a common set of facts because of the propaganda but the way grievances about done have also given rise to a lack of the common good. which we arrive at donald trump and to me donald trump is not the singular cause of. this donald trump is a reflection of the sickness of our democracy. until we excise the tumors or understand there are some fundamental problems in our democracy that needs to be fixed, we will keep repeating this in repeating. this >> michael, tomorrow president biden will be speaking publicly to the people of georgia and. we will see those remarks. what does he need to say? but a republican telling the truth about the last election, is this going to catch on? >> probably not as much as some would hope. but here is the rub. and i applaud the senator's comments and thank him for saying it. because he's absolutely right. but here's the rub, when he was asked a little bit later on would you vote for donald trump if he's a nominee of the party in 2024? and he said i will support the nominee of the party. and that is the rub. you cannot on the one hand say that we've got to be honest and integrity matters. but then want to put back into power the very thing that undermines that integrity and put forth the big lie. and so this is the space that republicans, like the senator, are going to find themselves over the next few months. as they sort of roll out this emancipation moment. where they say, i'm free at last from donald trump. until you ask if they're gonna vote for them if he's a nominee. if you're going to support his candidacy. when you say no to that, in addition to the first part now we have turned a corner. >> i don't know. mr. dowd what is your take? he is not out there saying that he openly supports trump. could this be the opening where we actually see the republican party fracture in a meaningful enough way where another republican could challenge trump? >> i think that the real answer is probably not. i mean, the problem is that the republican party is very unified. people like what mike rounds said, liz cheney adam kings linger, our unicorns. they are unicorns in the party. and some of them couldn't and cannot win reelection. some of them, love mike rounds if he goes any further could lose a republican primary. and he's got a governor that is completely on the opposite side of him on this issue. who praises and follows around donald trump wherever he can. so i think the problem is in donald trump, as i keep checking. even though donald trump signifies the problems we have. it's that 75 to 80% of voters are not aligned with the idea that integrity matters. and that the truth matters. they are not there. they don't believe -- they believe that the election is stolen. they believe that joe biden is not a legitimate president of the united states. they don't believe in all of these things. that is the republican voting base today. and so donald trump can be here, or not be here. the problem that republicans have is when they run in those primaries. they are facing voters that believe exactly what donald trump says and whether or not donald trump is saying it again, today, tomorrow. that is the party. and that is the problem. >> okay,, then michael, take us to the midterms. because the big lie is an absolute lie. and americans know. that the majority of the american people know that joe biden, whether you like him or not, one in a secure election last year. people say, oh, democrats are going to get killed in the midterms. but are they? given the big lie that keeps getting pushed, which is nonsense, if covid to speak this spring, if inflation slows, we have a strong underlining economy. are we writing off the fact that democrats could win in the midterms? >> well now you are going back to how we started the conversation. because that is exactly the point. all of those things that you mentioned are the threats that kind of roll beneath the surface, right? and people are tucked into the inflation think. because gas prices went up, and the cost of bread one, up on the gallon of milk is down 30 cents or $1 than it was. so yes, that piece is there. and it goes back to what matt was saying about how you talk about this stuff in a way that people kind of see themselves reflected in. and so, yes. you are absolutely right. we can be in that position where we see the democrats make the case. but again, to what matthew dowd said, you've got the position of the base. i'm not just republican base voters, by the way. let's be clear about who is part of this mix here. there is some conservatives, center right, independent and other types of voters in that mix. if they believed the big lie, how do you help them turn that corner? which gets us back to the point that i was making with the senator. you begin to turn that corner once the leadership is consistent from 0.1 to point and. in their discussion, you cannot tell me that the thing was bad. but then on the back end of it you say that you're going to be with the thing that's bad. and that is the problem. you don't turn that with the voters because the leadership is coming across as duplicitous. they are trying to have it both ways. and what i am saying is, you don't get to have it both ways. donald trump is that next essential threat. from beginning to end. and if you don't state that clearly, you will see 70% of the voters go. they are all lying. >> and they -- are donald trump last the last election. michael steele, matthew dowd, every time i speak to, you make a sparkler. >> coming, up as the omicron surge continues. looking into the rising of hospitalization numbers. doctor vin gupta is here. when the 11th hour continues. when the 11th hour covid is not over, health experts are pleading with parents to get their kids vaccinated as schools are struggling to stay open. in the city of chicago after a standoff for covid safety protocols. forced classes to be canceled for several days. city schools are expected to resume in-person classes by wednesday. back with us tonight to discuss, dr. vin gupta, a critical care pulmonologist in seattle. he is also on faculty at the university of washington institute for health metrics and evaluation. doctor gupta you make us feel safe there. and definitely smarter on all things covid when you hear. new york times is reporting in some hospitals, as many as half of the people who are testing positive, we're actually brought into the hospital for something else. testing positive after they were admitted. when we look at the soaring numbers about the omicron variant. are they even close about how we should believe about how serious the hospitalizations are? >> stephanie, good evening, good to see you. what i will say, for all your viewers out there is this. the hospitalizations numbers, the case numbers, we all have to take them into context. but by january 23rd, the institute for health metrics and evaluation was predicting that we are going to see a peak and daily deaths from this virus. about 2000 daily deaths at that point. and then a pretty precipitous climb, stephanie, to less than 1000 by lets a valentine's day. the middle of february. and then it is going to be potentially a spring of renewal here by march 1st. that number is going to continue to become law. and then by april 1st, which is the date i want everybody to imprint their minds, we are talking an estimated infections might be 80 to 100,000. that is estimated, not confirmed. that is what we think is happening in communities across the country. and that is the total across the country. but the estimated that we think might be less than 50. so this is going to be a pretty quick peek. maybe 2 to 3 weeks of sustain that over 1000. and then hopefully we're really going to see a relief that we have been waiting for for the last two and a half years. so let's hope that we are on the horizon. >> that is excellent news. just hearing that, going through that timeline. amazing news. and how do we prepare for that? something he sees as part of a pattern of democrats trying to turn him against former president trump. here's one of the member of committee said about that very report just a few hours ago. >> we would just like him to come in and share with us what he knows, he knows what's right for the country. he knows what happened in the election, he knows the pressure of the campaign he was under. i think it'll be of service to the country by talking about. but he also knows there's a political cost that comes with that. i hope he makes the right decision. the price president has very material testimony, and we hope to do the right thing. >> in new news that is no surprise, republican congressman jim jordan now signaling he may not comply with the committees requests for voluntary interview. about what he was doing on the six. lee esther de jordan's and the committee a lengthy letter, saying in part quote, this request is far outside the bounds of any legitimate inquiry. he called it an outrageous views of the select committee's authority. also happening today, lawyers for trump himself as a federal judge to toss out lawsuits that seemed to hold him liable, for his own role in inspiring the january 6th attack. in another legal battle for trump, rachel maddow reported tonight that attorneys for the former presidents have met in person, with the fulton county district attorney's office in georgia. tonight a georgia prosecutor investigating trump efforts to overturn that states results, tells the ap that a decision on potential charges could come in the first half of this year. could being the important word. president biden and vice president harris will be heading to georgia tomorrow, for what the white house says is a major push to protect voting rights. biden speech is expected to call on congress to pass bills overhauling election laws, the administration also dealing with a high stakes foreign policy challenge at the very same time. today, u.s. diplomats met with russian officials for the first time, of several to try to defuse the crisis over the ukraine. russia has now 100,000 troops stationed along ukraine's borders. the white house is threatened sanctions if russia invades. today the kremlin insisted has no plans to do so. we will get a report from ukraine's border later in the hour. with that, let's bring in our lead off guest on this monday night. ashley parker, pulitzer prize-winning white house bureau chief with the whales per post, eugene daniels -- and jeremy bash, former chief of staff at the cia and the pentagon. ashley i turn to you first. this january six committee needs witnesses, with firsthand knowledge of what went down on capitol hill. walk us through how critical mike pence's. and let's get real. if mike pence does not cooperate, what are the actual consequences? because thus far, it seems like the consequences to turn on trump or worst. >> it's interesting. mike pence is incredibly critical in the run up to january six. he was the critical person, who the former president and all of his aides, his attorneys, people in trump's orbit, we're putting pressure on, to as we now know, overturn the results of the election. the former vice president was in frequent contact, including on january 5th. with the very tough conversation again on the morning of january 6th. when he again told the president and what we know was a very unpleasant conversation, that he was not going to do. on the actual day after that conversation, mike pence is very little contact. this is one of the things that republicans were very upset about, as trump supporters are chanting hang mike pence, they're coming in just about 60 seconds of being able to reach the, man some of them wanted to hang for treason. there's no outrage from the white house anyone on his team. at some point pence's chief of staff, cause the white house and says hey guys, just so you know, we're okay. he is a lot of insight the it would be incredibly important. to answer your specifically question, he's almost never crossed president trump except on january six when he upheld the election results. seems unlikely that he'll flip on him now, the way that the committee would like to see. >> given how unlikely it. is given that people like jim jordan, are not going to cooperate. jeremy, is the committee really able to make these criminal referrals. if they don't, they're not getting anything? >> i think the committee has objective, that's to do several things. first and foremost is to put out all the facts. if the american people can see exactly what happened on january six. the dimensions that were seen on live television. but also the dimensions that were hit in. the planning that went on at the way house. the pressure campaign behind the scenes. against vice president pence. the effort to coordinate with insurrectionist, to stage an armed revolt and our democratic process. and i think if there are criminal referrals to be made, the committee is not going to shy away from making. them whether or not a prosecutor feels they have all the evidence, to bring a case in front of a jury and convict somebody, that is a different standard. but the committees standard is to shine a light on these facts. it's absolutely critical that people participate, and cooperate with this investigation. and if they don't, i think it just showcases how much the trump team wants to hide the facts, from the american people. about exactly what their role was and january six. >> okay fine then jeremy, but yes it showcases that. but what is showcasing do? >> well i think there's political accountability, that can emanate from a credible investigation. this is a credible bipartisan investigation. i think stephanie, is what you're getting, unless someone goes away in handcuffs, whose last name rhymes with trump, and this is all a waste of time. i disagree. i think there's a very strong political electoral dimension, we have to make sure this never happens again. this is the absolute bare minimum role of this committee in this congress, which is to ensure that the 2022 elections, in the 2024 elections are free, fair and open, from coercion. the kind of which we saw just a year ago. >> that same person whose name rhymes with trump, his lawyers met in person with the lawyer georgia, da who may or may not do something by the end of the first half of this year. any chance that sticks to the person whose name rhymes with trump? jeremy? >> i personally don't put a lot of stock in the criminal investigations jurisdiction by jurisdiction. i think what the president did on a grand scale, was unconstitutional, it was unlawful, it was criminal. it was an effort to inject voter fraud, and to steal the election. ultimately at the end of the day, the american people are going to have to hold him accountable. they will have to hold political leaders who lined themselves with him accountable. whether or not fulton county da or some other prosecutor can make a case, i don't know. but i don't think anyone should hold their breath for that, and declared a failure if that's not the outcome. >> eugene, the white house is a big legislative agenda ahead of, them voting rights is the whole ball of wax. and then there's this january six investigation. how much focus are they putting on that? >> on january six as you saw on the anniversary, president biden for the first time really leaning in and talking about january six, talking about his predecessor. without saying his name, painting him is dangerous for democracy. something that aides talked about. how do we, how much does president biden lead in? for months, you have seen democrats, progressives activists, historians. wanting the president to do, so really call iowa happened on january, six more specifically tie that to president trump, and then tie that to voting rights. that is with the white house knows that it can do. it can use this to open and raise awareness to talk about these things as they see it. to make things plain to the american people. there are, the american people are in their corners on this, they know that it's going to be difficult to change the minds of republicans. on what happened on january, six is the way washing of that day his already started, but they are focused on the democracy aspect. protecting democracy and talking about, it as much as they possibly can, hoping that it's going to break through it's proven difficult so far, with president biden going tomorrow and vice president harris and going tomorrow to georgia, to talk about voting. writes we know that he will do some of that time again, from january six into protecting voting rights. we are hoping to make that connection. and continue to make that connection, and hope that helps. as we all know, january six continues to be a day that democrats and historians, we're able to see and watch that, day we've seen what happened, and republicans see things very differently. >> let's stay on that speech tomorrow, white house calling it a big, speech big focus on voting rights. it could be an extraordinary speech, the president gave a very strong speech last week. but it does not change legislation. and democracy is at risk. are we going to get anything different tomorrow? anything different than what we have heard before? >> i think we are going to hear the president talk about voting, rides differently than he has. before i think this is not the first time he's called on the senate to pass these two pieces of legislation, that are sitting on their desk. he is going to come out we are told, full-throated in a carve out for the voting rights. for filibuster, voting rights, a plan that is in motion and democrats in the senate have been planning on doing something like this, and these pieces of legislation. and possibly doing a bow on these voting rights filibuster. he's going to? >> he knows, we know there's still a steep hill to climb. he can only do so much when it comes to the filibuster. he can pressure members of congress, excuse me, senators, to do that. to get on board with that. you know manchin and sinema have proven to be a bit difficult there. it's not just them. you have mark kelly, arizona senator who's up for reelection in november. also kind of seen is whether or not he'll be on board with a carve out for the filibuster. it's not just those two. civil rights leaders are hoping they will see biden really lead in, and even call out some of these folks by name. we've already seen that backfire with joe manchin. i'm not sure the president is going to do that, but we are hoping to see a complete different shift, this white house knows, and i've said over and over, it's reached a different level, a different level of interest and involvement when it comes to voting rights. >> ashley, let's stay on that strategy, does talking to people in georgia matter? or should he be camped out and joe manchin's driveway, and outside kyrsten sinema's apartment? >> you have mixed attitudes on, this you have some activists in georgia and elsewhere, who are saying they are frustrated with the president, and they are saying they are deliberately not going to go to the speech, they say at this, point a year, in someone who ran on restoring democracy, who made promises on voting rights. we need to see more than a speech. unless you're going to come down here and tell is exactly how these two pieces of legislation get through congress, we don't want to hear. at the time for talking is over. there's also a lot of that, simply going to a state, where people voting for incredibly important? >> going to a state that has some very restricting voting laws. using -- history in the shows of the places is meaningful. you have a very narrow senate, there's only so much you can do by executive order, it's a good tool. for those people they're also happy that at the very least, biden is finally turning full attention to. this there's a sense that build back better may be on the backburner. they're pushing to change the filibuster. and some of that public pressure may help sway those senators. going in sitting in manchin's driveway, -- won by about 40 points, is frustrating [inaudible] -- >> voting rights is hugely important. those activists ashley's talking, about have huge influence in the party, let's talk about regular voters. how does joe biden get them to prioritize voting rights? they are thinking about putting food on the table, and their kids in school. >> stephanie, i think that's of course fair, and america's families have to prioritize, quote unquote regular families. i'm not sure what that means. people who are disenfranchised, people of color, minority groups in this country, communities of color, they are quote unquote regular americans. sometimes we say regular americans, and we were really meeting is kind of white folks. >> i mean on politically active people. people who aren't thinking about politics. you are not thinking about voting rights, people were just thinking about living their day-to-day lives. too many of them voting rights is an abstract. >> of course, i understand, that but of course the foundation of the ability to have any power at all, in the ability to change your community, your civic leadership your neighborhood your city council, your mayorship, your members of congress, the foundation is your right to vote. we were democracy in this country until the 60s, until people actually had the voting rights act to enabled so many millions of americans who up until that have not been able to cast a ballot, to do so. i think this is foundational. i think it's fundamental. i'm not sure i agree with the premise that people don't care about. i think that people understood that their vote was denied, they would care about, and they do care about it,. >> are they thinking about an? enough do you think people think about it in their day-to-day life. in the exact way you laid it out, it's something we all should understand and prioritized, but given all the people are dealing with, how do democrats get people to make it that priority? exactly how you just said? >> it's connecting what's happening in the political realm, to making sure that there is equal pay for equal work, making sure that the right to make medical decisions on your own behalf, are actually connected to your ability to have political power. the ability to have civil, rights and human rights in your community. to have good education for your kids. to have health care for your family. when those are things that emanate from one place, which is your ability to have political power and democracy, i think if democrats make that clear, make that plain, people do and they will understand that. >> ashley, let's turn now and talk about the russia situation. how worried is the way house about it? >> if you look at just this first day of security talks, both sides, on the one hand we're a little bit cautiously optimistic. this way house is incredibly chloride. a number of the things that russia is asking for, are simply non starters. the idea that ukraine will never join nato. that's a nonstarter for the united states. the idea that nato would go back to its 1997 boundaries. that's nonstarter for the united states. well they're having these talks, they're amassing troops on the border, there's helicopters and other things being moved, in president biden's been very clear that he does not trust putin. biden is also wanting diplomacy first, but of course they're worried about this. >> jeremy, earlier today i spoke to a russian political activist garry kasparov, i want to share what he said about putin. >> this talks with putin's are hostage negotiations with the tariffs. he invaded ukraine and now he's using a throw of earlier visions to demand commission concessions. it's basically about destroying the eastern flank of nato. this isn't about geo political interest of russia. national security, it's extortion in putin's interest of causing chaos. it's expanding his influence, and staying in power. it's completely backward. the free world should be making the demands of the terrorist groups, the invader groups. the man president biden correctly called a killer. >> did the u.s. come away with any concessions today? >> well they've gotta get serious about the threat that's in front of. then they have to be able to articulate exactly would it, is in understanding exactly what it's coming from. and why it's so animated. this relates back to your conversation you just had in the opening segment. it really does boil down to the simple question, how do you reason someone out of a position, that they never resend themselves into. that is the rub of this. donald trump came in and got people who everybody said, oh this was a regular joe republican. and he's stood for strong defense, russia was the bad guy. grow the economy etc. and now it's all trump. and no one is yet put their finger on well how, and why did that happen. when you look at the proposals that democrats have put out on the table based off of the 2020 election, voters are going hey i did that. i voted to get rid of trump, but i didn't vote for all this other stuff. so that's the gap right now that you're seeing playing out. >> hold on a second. what do you mean, the other stuff. do you mean that democrats need to slim down what they're trying to put? in this new proposal. i don't follow. >> exactly. listen to what the voters are telling you. they love the infrastructure plan. build back better not so much. you keep trying to force a square peg into a round hole politically. where the voters just aren't ready to accept. it doesn't mean they don't want build back better at some point, but other things are more pressing to them, and that is the conversation i think democrats are not having. which is what is reflecting in the polling that you see. and why the landscape looks the way it does politically for republicans. the country feels, these guys don't get, may you hear with black voters, you here with hispanic. it doesn't matter the group. if they don't understand why i gave them the power in the first place, then maybe these other guys will get it back, and we'll see what happens. and you don't want that added to decide in, he need to speak to what the voters are telling you what's driving them right. now and it's not the things that some of the democrats are out there pushing. >> matt you conducted what you've classified as a stress test an american democracy, what does that mean, and what did you learn? >> i did not conduct, it's what we have been going through, in my view. in the last five years. i mean it's a stress test as your viewers know and as you, know it's what we do as we advance in the age. we want to make sure we're healthy not just respite in vigorous activity. and you think you're strong, then you go through a stress test where they put you on a machine, it increases your heart, right and then sometimes you discover, people he thought were healthier not healthy and there's underlying problems. whether it's cardiac or whatever. it's something's going on in your organs. >> you're saying we don't realize. >> our country's been through the same. thing i think what happened was we thought we were okay as a democracy. this is pre-trump. we had our ills and we had our pains and we had our aches and we had certain things, but we thought we are okay. with donald trump and his election in the aftermath and january six and i believe also covid and how we how it's been politicized has shown our democracy is not healthy. it was not healthy when it led to trump and it has not been healthy true trump and i my fear is all of the prescriptions are like giving people tylenol or advil to relieve their headache or relieve their fever and we are not dealing with the fundamental problem. the fundamental problem which led us to hear in which in my view is endangers our democracy, is in my view of through fold. first it's a huge segment of the population that has been lied to and is now propagandized to both cable networks and radio and all that we. have a segment over population that has no longer shares a common set of facts with us. democracy cannot survive with that. the second part of that is now we have people that are on cable and people that are exasperating people's fear in haiti in grievance. and so with that then leads to is this one horizon white nationalism or a fertilizing of what's already existed here. it also doesn't allow us to get to the common good if we no longer share some values with their neighbor care about our neighbor and no longer believe that. we don't have a common set of facts because of the propaganda but the way grievances about done have also given rise to a lack of the common good. which we arrive at donald trump and to me donald trump is not the singular cause of. this donald trump is a reflection of the sickness of our democracy. until we excise the tumors or understand there are some fundamental problems in our democracy that needs to be fixed, we will keep repeating this in repeating. this >> michael, tomorrow president biden will be speaking publicly to the people of georgia and. we will see those remarks. what does he need to say? but a republican telling the truth about the last election, is this going to catch on? >> probably not as much as some would hope. but here is the rub. and i applaud the senator's comments and thank him for saying it. because he's absolutely right. but here's the rub, when he was asked a little bit later on would you vote for donald trump if he's a nominee of the party in 2024? and he said i will support the nominee of the party. and that is the rub. you cannot on the one hand say that we've got to be honest and integrity matters. but then want to put back into power the very thing that undermines that integrity and put forth the big lie. and so this is the space that republicans, like the senator, are going to find themselves over the next few months. as they sort of roll out this emancipation moment. where they say, i'm free at last from donald trump. until you ask if they're gonna vote for them if he's a nominee. if you're going to support his candidacy. when you say no to that, in addition to the first part now we have turned a corner. >> i don't know. mr. dowd what is your take? he is not out there saying that he openly supports trump. could this be the opening where we actually see the republican party fracture in a meaningful enough way where another republican could challenge trump? >> i think that the real answer is probably not. i mean, the problem is that the republican party is very unified. people like what mike rounds said, liz cheney adam kings linger, our unicorns. they are unicorns in the party. and some of them couldn't and cannot win reelection. some of them, love mike rounds if he goes any further could lose a republican primary. and he's got a governor that is completely on the opposite side of him on this issue. who praises and follows around donald trump wherever he can. so i think the problem is in donald trump, as i keep checking. even though donald trump signifies the problems we have. it's that 75 to 80% of voters are not aligned with the idea that integrity matters. and that the truth matters. they are not there. they don't believe -- they believe that the election is stolen. they believe that joe biden is not a legitimate president of the united states. they don't believe in all of these things. that is the republican voting base today. and so donald trump can be here, or not be here. the problem that republicans have is when they run in those primaries. they are facing voters that believe exactly what donald trump says and whether or not donald trump is saying it again, today, tomorrow. that is the party. and that is the problem. >> okay,, then michael, take us to the midterms. because the big lie is an absolute lie. and americans know. that the majority of the american people know that joe biden, whether you like him or not, one in a secure election last year. people say, oh, democrats are going to get killed in the midterms. but are they? given the big lie that keeps getting pushed, which is nonsense, if covid to speak this spring, if inflation slows, we have a strong underlining economy. are we writing off the fact that democrats could win in the midterms? >> well now you are going back to how we started the conversation. because that is exactly the point. all of those things that you mentioned are the threats that kind of roll beneath the surface, right? and people are tucked into the inflation think. because gas prices went up, and the cost of bread one, up on the gallon of milk is down 30 cents or $1 than it was. so yes, that piece is there. and it goes back to what matt was saying about how you talk about this stuff in a way that people kind of see themselves reflected in. and so, yes. you are absolutely right. we can be in that position where we see the democrats make the case. but again, to what matthew dowd said, you've got the position of the base. i'm not just republican base voters, by the way. let's be clear about who is part of this mix here. there is some conservatives, center right, independent and other types of voters in that mix. if they believed the big lie, how do you help them turn that corner? which gets us back to the point that i was making with the senator. you begin to turn that corner once the leadership is consistent from 0.1 to point and. in their discussion, you cannot tell me that the thing was bad. but then on the back end of it you say that you're going to be with the thing that's bad. and that is the problem. you don't turn that with the voters because the leadership is coming across as duplicitous. they are trying to have it both ways. and what i am saying is, you don't get to have it both ways. donald trump is that next essential threat. from beginning to end. and if you don't state that clearly, you will see 70% of the voters go. they are all lying. >> and they -- are donald trump last the last election. michael steele, matthew dowd, every time i speak to, you make a sparkler. >> coming, up as the omicron surge continues. looking into the rising of hospitalization numbers. doctor vin gupta is here. when the 11th hour continues. when the 11th hour covid is not over, health experts are pleading with parents to get their kids vaccinated as schools are struggling to stay open. in the city of chicago after a standoff for covid safety protocols. forced classes to be canceled for several days. city schools are expected to resume in-person classes by wednesday. back with us tonight to discuss, dr. vin gupta, a critical care pulmonologist in seattle. he is also on faculty at the university of washington institute for health metrics and evaluation. doctor gupta you make us feel safe there. and definitely smarter on all things covid when you hear. new york times is reporting in some hospitals, as many as half of the people who are testing positive, we're actually brought into the hospital for something else. testing positive after they were admitted. when we look at the soaring numbers about the omicron variant. are they even close about how we should believe about how serious the hospitalizations are? >> stephanie, good evening, good to see you. what i will say, for all your viewers out there is this. the hospitalizations numbers, the case numbers, we all have to take them into context. but by january 23rd, the institute for health metrics and evaluation was predicting that we are going to see a peak and daily deaths from this virus. about 2000 daily deaths at that point. and then a pretty precipitous climb, stephanie, to less than 1000 by lets a valentine's day. the middle of february. and then it is going to be potentially a spring of renewal here by march 1st. that number is going to continue to become law. and then by april 1st, which is the date i want everybody to imprint their minds, we are talking an estimated infections might be 80 to 100,000. that is estimated, not confirmed. that is what we think is happening in communities across the country. and that is the total across the country. but the estimated that we think might be less than 50. so this is going to be a pretty quick peek. maybe 2 to 3 weeks of sustain that over 1000. and then hopefully we're really going to see a relief that we have been waiting for for the last two and a half years. so let's hope that we are on the horizon. >> that is excellent news. just hearing that, going through that timeline. amazing news. and how do we prepare for that?
