before the january 6 committee. talks set to start in hours over ukraine. unvaccinated superstar djokovic about to plead the case why he should be allowed out of confinement to the court in australia. plus when a florida democrat con fronted florida govern desantis about covid tests in the state she was met with ridicule and dismissal but she was right all along. we want to begin with the breaking news from new york city. at least 63 people are hurt in a brox apartment fire. officials calling it the worst in more than 60 years. it s.t.a.r.t. started in a 19-story building. 63 people so far injured. 32 had to be taken to the hospital with life-threatening injuries. a warning went out in the area close windows and to stay inside. who's a resident who escaped said it was like i went upstairs to fix breakfast and noticed smoke coming inside the door and then i heard people screaming help, help, help. she was down stairs and i told her it's a fire. we just hovered in the back room and next thing we know we see flames coming out the back windows and things and smelling the smoke and next thing we know the upstairs of the apartment is black and we hear fire department breaking in the door to get us. we had to climb out the window and everything. >> you wept down the ladder? >> we did. >> what was that like? >> very scary. god, jesus, help us. >> fire marshals are investigating the cause but the commissioner says he doesn't believe they will say it's suspicious. we are following the story and will have more information in two hours as we get it. want to get to the big political story of the zwra the president delivering a critical speech in atlanta this week that the white house says is a call on congress to pass voting rights legislation. democrats push for legislation with no movement. gop legislatures across the nation rushing to pass more voting restrictions ahead of the midterm elections. nbc is on capitol hill for us. thank you for joining us. the president will be joined by vice president harris on tuesday. what can we expect to hear from him? >> reporter: vice president harris tasked by president biden to work with congress and get voting rights legislation across the finish line. this speech is huge for president biden. he is pubbed and pressured by activists and advocates and voters to get there and get in front of the issue. when he give it is speech in georgia, it is in the backdrop of these voting fixes that will republican-led legislatures to looking to make to restrict voting so he'll deliver the speech and gave an interview embracing the rule changes. they won't get anything done with just democrat and republican votes to get to 60. you have back here in congress sno manchin and sinema in meetings and talks to get them to change the mind about going it alone and doing this in a partisan matter. president biden is turning to voting rights and needs their support to change the rules which majority leader schumer said could come up for a vote as early as this week. >> julie, talk about january 6 quickly. the committee wanted to request former vice president mike pence testimony by the end of the month. >> reporter: yeah. bennie thompson said we'll know this month whether they plan to invite the former vice president. he was pressured by former president trump and allies to delegitimatize the victory and he didn't do that. he came in close contact basically with a matter of seconds with the pro trump mob on that day and hoping that he cooperates voluntarily and help shed some light to them and i want to play what i asked speaker pelosi this morning. january 6 and voting rights goes hand in hand to democrats. >> why is voting rights so important for the senate to address now? >> because it is essential to the democracy. if we don't pass this legislation it's clear that the republicans will try to undermine our democracy. as they did on january 6. >> do you think it's important for the january 6 committee to hear from the former vice president? >> i think they have got good cooperation from the vice president from what i see. >> reporter: she defers to the committee to see what they do next. look. as they move into the next phase of the investigation it is a public one and hoping to hold public hearings. sometime in the spring and plan to wrap up the investigation by the midterm elections. >> getting a sunday morning interview with the speaker of the house, go, julie. thank you. turning now to more on the voting rights battle and the biden agenda want to bring in geoff bennett. it is great to see you. thank you for joining us. >> you, as well. of course. >> we love having you. let's talk about this. julie laid it out. the president's speech. we know what the president is going to lay out hire. talking about a rules change, get behind the rules change formally and talk about how it seemed as if the democracy is in peril here in the united states and heard from the speaker in the sbir view that julie caught this morning. do you think it changes minds and light a fire under democrats? >> it may. this is a concerted effort. it is propelled by the mlk day holiday next monday. schumer intends to hold a vote. it will be a show vote in the senate to figure out where every senator stands to push through the legislation. back in august, the house passed the john lewis voting rights act to restore pour to the federal government to make sure that states don't have rules that would disenfranchise minority voters and the bills languished in the senate and not just that democrats have to find at least ten republicans to vote with them. there is pushback within the democratic ranks about making those rules changes a carveout for voting rights if it looks like they won't have the ten republicans join with democrats. so this is a real watershed moment right now because we know that ahead of the 2022 midterms there are at least 15 republican election deniers running for secretary of state across the country including in states that joe biden narrowly won and so now you have a blueprint for election deniers to try to overturn free and fair elections. the president and the white house and the democratic party are doing the work now that advocates and members of the democratic base have been calling for them to do all along. >> the question is, is it too little too late? what does joe manchin have to say about this? let's play a little bit of what he had to say about the filibuster and why he is against at this moment changing the rules. >> it is a very, very difficult, a heavy lift and the reason i say it's a heavy lift is once you change a rule or you have a carveout, i've always said this, any time there's a carveout you eat the whole turkey. there's nothing left. >> okay. so here's what i hear. i want you to tell me if you think i'm wrong here. is joe manchin foreseeing a republican controlled congress where this carveout is made for a filibuster? if it is made for a filibuster here who knows what can happen in the future? we have kind of putt manchin and sinema on the same plane and seems like sinema is more open to a carveout. >> that's right. tim kaine from virginia described sinema as forward leaning on voting rights and other democratic senators, too, who also have concerns and misgivings about changing the filibuster. they relied on the filibuster during the trump era when democrats weren't in the majority to stop bills they thought were harmful. before joe manchin was a senator he was the governor of west virginia and also the secretary of state and so i've talked with people who have talked with him privately and he knows i'm told what's at stake. what will the process be so that democrats can get the two bills across the finish line? >> thank you, bret. this is hard. we have ever-evolving science with an ever-evolves variant and provide updated guidance in the face of rapidly rising cases and here to explain it to the american people and committed to continue to do so and to improve. >> want to bring in dr. nately azar to the conversation. great to see you. we have had this conversation about the cdc and whether or not people lost confidence in the cdc with the changing rules out there and the way that the virus in itself has changed and as we know it's changed significantly. we have learned something new about the virus every day. what do you make of that question put to the cdc director? >> i certainly understand why the question is being asked. i think most of us in the science community who followed and reported on the pandemic think of it much more a communications problem rather than a quality problem within the cdc in terms of the caliber and qualifications of the scientists and epidemiologists and everybody studying and interpreting the data and trying to turn that around to educate the public. i see dr. walensky. she is a practicing physician. who is very, very well regarded in her field. who has the unglamorous job of having to be the point person if you will to communicate this information to the american public and when i listen to her on air and i understand some of the criticism she's got recently, i understand what she is saying and reading between the lines and understand how she is sort of coming to the way she is actually bringing the information to the public but if you're not in that world and speaking that language i certainly can see why people are very quick to judge and criticize and say, listen, one day is one thing, one day is the next thing. you don't seem to believe what you are saying. how can we? i don't think that's the case at all. >> you want to point the finger after somebody if not anybody, right, because of the devastation to deal with throughout this pandemic? doctor, we have mayor eric adams on the phone to talk about the fire and appreciate you sticking with us. thank you. want to go to the breaking news out of new york. do i have you, mayor? >> yes. how are you? >> i'm good. thank you for jumping on the phone with us. we appreciate it. just devastating news from the bronx with this apartment fire. 19 people confirmed dead. nine of them children, ten adult just we are awaiting more information. what do we know so far, mayor? >> you are right. it's an extremely disheartening and just a troubling moment for the city. this is probably going to -- most fires experienced since the happy land fire of many years ago. 13 people more in critical condition. 62 total were injured. a lot due to smoke inhalation. we are right now, the fire is under control and want to be there for the families impacted by this. >> do we know how this thing got started? >> the fire marshal fdny are doing analysis to determine exactly the cause of the fire and we will have a thorough investigation to determine what happened so we can start to do everything possible not to have a repeat. >> how were people informed in this building to communicate to get out with a fire, a dangerous fire. >> that's part of what the investigation is going to determine. what we do know is that the issue, source of the fire, the door was left open and we cannot emphasize the importance of when you exit an apartment or a room in a house where a fire is located to close the door behind you. we're going to double down on that psa, that information. we do know that the door was left open and that led to a much spreading of the smoke. >> was it just apartment where the fire began, mayor? >> yes. according to preliminary reports that is what we are coming back with. but again the fire department will do a thorough investigation with the marshals. they'll be able to tell us the source and how this fire occurred in the first place. >> talk to me about the system inside the building once again. were there fire alarms? was there a p.a. system to inform residents what was happening? were they given any heads up? was there any protections in place? what type of building was this? >> that is a 19-story building. that's one question we can answer. the other questions is we really want to make sure the professionals do their job and they understand how to do the investigations and will give us a report of the infrastructure, everything from fire alarms to p.a. systems. everything else that's needed to answer the question of how this happen and have so many lost of lives and could do this in the future. >> what are the current requirements for new york city for fire protection? >> i'll leave that to the experts to have a clear understanding of this. this building was built before the thorough procedures were putt in place. they said the building was built when federal subsidies that did not have the same restrictions that woef now to build a safer and so many requirements needed now not needed then when this building was built. >> so this was an affordable housing building. is that correct? >> i don't have the exact information. i don't want to give misinformation. >> so let me ask you. if this builting was in fact built before the kind of updated fire protections are put in place does that mean those buildings are then more susceptible to tragedies like this one and not something in place to update them? >> the goal is to keep residents safe. we have a lot of pre-war buildings and others with the proper up dates and we'll continue to do that. i think my department of buildings, fire department and others are more suitable to say what type of up dates we must do to determine if the buildings can continue to enhance the safety. no building in the state of new york is allowed to be made unmade once it is identified. i have faith in those implementing the rules. >> i liver in new york city. there's affordable housing. this is going to be a major test for your information. a lot of residents are going to be worried ant their safety. do you feel confident you're ready for something like this to undertake this to institute the changes that need to be made to keep the residents safe? >> we have clear on the confidence because we have building the right team to identify how the city can be a safe place for fires and any other crisis that hits this city and encouraged by who we have put together. we use the model all the time. we want to get stuff done. >> are you confident in the response time? i know this fire started around 11:00 a.m. at what time did the fdny show up at this building? >> i am extremely confident. the team on the scene and the police department that responded. we have an excellent system in place to get our apparatus in as fast a time as possible and extremely encouraged by what i saw today. the firefighters ran out of oxygen tanks. the oxygen from the tanks and pushed through to rescue and save lives and extremely proud of the men and women that responded to this fire today. >> i have friends that survived fires. a friend lost a spouse in a fire. a lot of folks deal with ptsd after something like this. are these services that new york is willing to pay for? >> reporter: hey, yasmin. we heard from the newly elected mayor of new york city calling this the worst fire in the city in 30 years. so the fire broke out just before 11:00 this morning. it quickly turned to a five-alarm fire. firefighters were 0 the scene. eventually that number swelled to 200 firefighters. they were able to knock down the flames by 1:00. so they were able to respond there quickly and get the flames undercontrol. during that time dozens of people injured. initially more than 60 but there are some fatalities. nine confirmed dead. nine children. ten adults. officials said the victims were found on every floor. obviously the cause of this fire is still under investigation. but officials were saying that the fire s.t.a.r.t.ed somewhere on the third, second or third floor and an open door and it obviously if the door was closed it wouldn't have spread as quickly as it did and looking into that but obviously a lot of witnesses were on the ground. here's a witness we spoke with a short time ago describing what they saw. take a listen. >> i went upstairs to fix breakfast. i saw smoke coming in the door and then people screaming help, help. she was down stairs. i told there's a fire. we hovered in the back room and next thing we know we see flames coming out the back windows and stuff. smelling the smoke. next thing we know the upstairs of the apartment is black and hear the fire department breaking in the door to get us. we had to climb down out the window to get out. >> you had to climb down the ladder? >> yes. god, jesus, help us. >> reporter: you heard the panic and shock in her voice. i am just a few minutes from the scene. looks like they closed the roads here and trying to get closer to see what is happening. as far as the investigation, still pending. looking at the seconds or third floor where the fire broke out. most of the injuries, people taken to various hospitals in the city. smoke inhalation. that's something to follow up on. 19 confirmed dead. nine of those being children. yasmin? >> just horrific. i think a lot of questions right now as to why so many people died so quickly in this fish. right? i spoke to the mayor who we had on and asked him about fire alarms. what infrastructure they have to warn residents if there's a fire. we heard the sound you played of that woman and didn't mention hearing a fire alarm but people screaming and firemen breaking in. do you know about the infrastructure in this building? do we know if they had working fire alarms? >> reporter: that is a question to pose to the officials on the ground. that is top of mind and will be posing that question to them but we do know it's a huge apartment complex. over 100 units. still a few minutes away and not sure what the structure looks like now but a whole lot of damage. >> just awful. i'll let you get to that. please check back with us once you're able to make contact with folks there and get a sense of what's happening on the ground. kathy park, thank you. we'll follow the breaking news out of new york. the confirmed fatalities is 19 people dead. in this apartment building. nine of them children. ten of them being adults. this is a 19-story biblding in bronx, new york, which is a borough of new york city if you're not from this area. the fire starting around 11:00 a.m. and got it under control by 1:00. how is it so many people died from this? >> during the middle of december when covid was spiking again here in the state and the governor mia me and my entire office knew we had to step up to leadership and starting to call around to the office officials and health departments and in those conversations when we uncovered the stockpile of tests. >> did you feel like they were trying to hide them? >> i don't know exactly that they were trying to hide them but not willing to use them and then to say now that there's no demand or no need is once again another lie to hide the ball of what was happening here in the state of florida. i don't know if they knew and decided not to use them or in fact there was just a dereliction of responsibility. >> so let me play for you desantis' about-phase and when he changed the response. and his explanation. >> having a stockpile was the right thing to do. if we had done the opposite we would have run out. we just had a lack of demand that happened in september, october, november. they would have been used had we had omicron then. >> seems like from my understanding the tests did expire in december when there was a major flood of need for testing. >> yeah. of course the right decision is to always stockpile knowing that the coronavirus is not behind us. we knew that from watching the world that omicron was coming to the united states. and so the stockpile is correct. however knowing they were about to expire the right decision is get them all out to the local departments of health, reorder new ones or do a swap exchange with organizations that were using the tests to make sure they were going to be used or to make sure that we were ordering new ones or going to where the need was going to be. >> so to tack on what desantis had to say he also kind of made an argument against testing. >> yeah. that's another big problem. we have been hearing for almost a year now the surgeon general and the governor saying to change the psychology of testing why if you're asymptomatic you don't need to be tested. how do you know you're positive? experts consistently said we need to be doing more testing so this is a disingenuous and failed loyal from the governor not getting the information into the people's hands. the people of the state sat in the lines four or five hours and the time to be spending it with the loved ones to enjoy the end of the year but instead in the lines when now hearinging that the governor had almost a million tests that could have been distributed and saved them time. failed leadership from the governor and not apologizing. he called me a liar. his press secretary said it was a bizarre request and statement from me. not only did they have the stockpiles but lied to the people in the state and until he had no choice and then he passed the buck to the emergency management secretary and again the buck passed -- has to stop with him. he is the governor of the state. any decision made by anyone that works for him is his responsibility and onus to bear. >> nikki fried, thank you. we appreciate you joining us this afternoon. >> thank you. we are still following the breaking news of the fire in the bronx. want to bring in congressman torres of new york. congressman, thank you for coming on early for us. we were supposed to be talking about politics and washington but we need to talk about what's happening in your district. this building fire, it is awful. 19 people confirmed dead. what do you make of it? >> it is tragic and terrifying. it is the deadliest fire in more than three decades. we want to get to the facts. what were the cause of the fire? 19 people died, 9 of whom are children. many of these buildings are old. not everybody apartment has a fire alarm. most have no sprinkler system and the risk of a fire is much higher in the bronx. i know the mayor is on top of it. i got a call from the governor with support. this is as great of a tragedy for the bronx as any you could imagine. >> i want to kind of drill down a little bit on what you talked about the lack of infrastructure in a building like this one. from my understanding, the way the mayor described this to me is this is an affordable community building. 19-story building, about 100 apartments inside. it is pre-war and know as residents in new york city there's a lot of pre-war buildings in this city. why not update buildings like this so something like this duptd happen? is there an ongoing effort to do that? >> we need to find out the particular circumstances surrounding the fire. this is twin parks northwest. we need to find out the circumstances but the largest point is there's a lack of investment in affordable housing in america and allowing the developments to be plagued we put lives at risk. they're wide open to catastrophic fires. so it's a -- i see housing quality and safety as a matter of life and death and this is proof. >> how do you change that? >> we need to do something in washington and invest in affordable housing part of the built back better fact. many date back pre-war and the people of the bronx deserve the same standard of everyone in new york city and the united states. >> we talk about recovery like these tragedies and recovering the home and also the dealing with the aftermath of a tragedy like this one. the loss of a family member, a neighbor. and then surviving this tragedy. the type of services they need to offer. the ptsd so many residents will face after surviving something like this. are these the services your district has to offer for these residents?
