accepts political violence as a norm? are we going to be a nation where we allow election officials to overturn the legally expressed will of the people? are we going to be a nation that lives not by the light of the truth but in the shadow of lies? we cannot allow ourselves to be that kind of nation. the way forward is to recognize the truth and to live by it. >> starting later this hour, more than a dozen democratic senators will speak about the anniversary on the senate floor. at noon/9:00 pacific, house speaker nancy pelosi will lead a moment of silence, then speak on the house floor. this afternoon, a number of house democrats will give testimonials on what they experienced that day, and this evening there will be a prayer vigil on the stems of the capitol. with me to start off our coverage is capitol hill correspondent leigh ann caldwell and car roll author of "i aonly can fix it, donald trump's final year" bootry swann, national correspondent for politico an andy glaud chair of the department of african american studies at princeton university and msnbc analyst. the president had a forceful, direct speech today. what was your reaction to what he said? andy, can you hear me? >> yes, i can. my reaction, i'm sorry, my reaction was that he shifted to terrain. he's no longer on his heels. he took the fight to those who are threatening democracy. i thought it was strong. i thought it was very important and necessary, and in some ways, it turns the dial up a bit in terms of the stakes of where we are right now. i thought it was a very important and historic speech. >> eddie, it was unusual in that presidents don't normally take aim at former presidents. the president did so very directly on a day that really something like this makes a big difference. >> absolutely and i think, you know, in the presser afterwards in the q&a he said that you have to identify the problem. we've been dancing around this. there are those who are kind of susceptible to the big lie and there is the former president who is in some ways sowing over and over again distrust in the very process that undergirds our democracy, and it seems only right and necessary that the president of the united states brings the full weight of the office to bear on those who threaten the very foundations of our democracy. remember, he said he will not stand by and watch as those people put a dagger to the throat of our democracy. that's a very important point, very critical point in this time where it seems that we stand on the precipice as a republic. >> you know, i'd like your thoughts on this and the vice president brilliantly mentioned some moments in our history that have defined americans, right, thinking and she mentioned for example the attack on pearl harbor or 9/11. a year ago today definitely had a massive effect on our history and how we see ourselves, and what are the lessons of january 6th? >> in some ways i think the clearest message to me is that our democracy isn't guaranteed. we've only been a multiracial democracy since 1965 and that was on paper really. it took a while and what do i mean? 1965 was the passage of the voting rights act which tried to fulfill the broken promises of reconstruction. so we've only been a multiracial democracy for a short perform and remember at the heart of the insurrection was this idea of stopping the steal that the votes in atlanta, philadelphia, milwaukee, the votes of black and brown people didn't matter as much as those who stormed the capitol. what we're seeing in this moment is this insistence that america must remain a white nation in the vain of old europe. we have to decide, this is what the president said to us, what kind of nation are we going to be and that cuts to a number of different issues, but at the heart of it, will we finally decide to be a multiracial democracy and what will that mean at the level of culture at the level of politics and who we take ourselves to be. >> what will it be and how do we get there, eddie? >> first you got to identify the problem. we have to be courageous and identity it and state the truth like the president did today. i'm a moral floss philosopher, what we have to do is grow up and what i mean by that, americans have to make a choice. i know we're in the mipdle of a pandemic. we have to choose sides. will we stand with throws threatening the foundation of democracy or fight for a new america? that's what we have to decide and that is going to require a maturity that we must evidence in these times. [ speaking in foreign language ] he who is quiet is accepting and recognizing and condoning things, eddie. >> complacecy is complicity at this moment. too much is at stake. our democracy is at stake and we heard that from the president of the united states today and it seems to me we need to evidence the urgency of now in our practice in our day-to-day lives, in our choices at this moment. >> thank you, eddie, thanks for being with me and for this conversation that is so important. leigh ann, what is the republican view of the first anniversary of the 6th of january, an attack we know only a handful of republican also take part in today's ceremony. >> reporter: it depends what sort of republican you ask, as you mentioned, there's not a lot of republicans on capitol hill today participating in the commemoration. there's a scheduling conflict. many senators at the funeral of the late georgia senator johnny isakson, which is also today. in the house there is no excuse. leader mccarthy will not be in town, we have not heard anything from him yet. leader mcconnell released a statement and in that statement i'm paraphrasing, he said january 6th was a dark day for this country and did condemn it but went on to say democrats are politicizing it and tying his statement to what leader schumer is trying to do, perhaps change the senate rules in order to pass voting rights legislation, leader schumer all week has been talking about the link between january 6th, the failure of democracy, and the suppression of voting that he says could be happening across the country and so there are some republicans who are sending out press releases saying it was a dark day, but a lot of others are ignoring it and then we have this section and the faction of the republican party who was downright dismissing it denying it and whitewashing it. there's two republicans in that category, matt gaetz and marjorie taylor greene holding a press conference what they call the republican response to the commemoration and we'll see what they have to say. it's likely not based in reality and supporting the former president, jose. >> former president apparently just released some kind of a release criticizing president biden as one could expect. carol, the january 6th insurrection also failed because democracy and democratic institutions held. how close did american democracy come to collapsing a year ago? >> jose, it was a hair's breath from collapsing. i can think of three different things that would have resulted in a failure in the peaceful transfer of power. former president then president donald trump was fighting with every ounce of energy that he had and every lever he had in the oval office and beyond to block that peaceful transfer of power. for example if mike pence hadn't gotten pretty angry about the fact that donald trump had sicked all of his supporters on pence, if he hadn't been ticked off to find out that there was a hang man's noose outside his window at the capitol, and insisted on staying to certify the election once the building was cleared of rioters, things could have gone quite differently that day. would pence have returned, if pence had stayed loyal to donald trump's wishes all the way through, even though they violated the constitution? i can't imagine it coming closer than it did that day and that's one example. one more thing i'd say about the commentary about biden's speech, if i may, and that is that there are a lot of democrats who wish that president biden had said this more forcefully a lot sooner. if he had clarified and cast and framed what was happening in our country a lot sooner in his presidency. one thing that he'll be remembered for in this speech is the fact that he finally took it to donald trump, by saying he can't accept that he lost. most of his speeches, president biden has sort of flicked donald trump off like a gnat that he can't discuss, doesn't want to go there. this is the first time he's sort of gnashed his teeth at a former president and likely the next presidential candidate. >> and one more the threats leading up to the attack, authorities weren't just looking at donald trump supporters. >> reporter: that's right. i obtained an intelligence report produced by the u.s. capitol police department just three days before the january 6th attack, and in that report the analysts who wrote it flagged a republican member of congress who they were worried about. they said that louie gomert made comments that could result in or encourage violence. gomert and his spokesperson say that was not the intent of the comments but the context was, gomert sued to try to get pence to throw out the election results and a federal judge an appointee of president donald trump tossed out the lawsuit saying this is a non-starter. after gomert suffered one of a massive host of legal defeats trump's allies went in the election gomert meant on newsmax a pro-trump network and made remarks the capitol police analysts viewed as having the potential to communicate that people needed to turn to violence because the courts and the legal system in this country weren't defending their rights. gomert said that was not the intent of the remarks but the actual statements he made were so concerning that capitol police flagged them in this report and think how strange that must have been for capitol police intelligence analysts. this is a law enforcement entity that exists to protect members of congress, and the capitol building and in that moment, just three days before the attack, intelligence analysts in the department worried that one of those members had made comments that actually could create further danger. it just shoeds how intense and how frightening even the days leading up to january 6th were and of course, all of those threats, all of that danger burst into an unforget mabl day unforgettable day a year ago. >> thank you for being with me this morning. now to continue our conversation is california democratic congressman pete ago lira a member of the january 6th committee. pleasure to see you. you were on the house floor one year ago today as the events unfolded. what sticks out in your mind about that day? >> every member has their own experiences. i sat behind jamie raskin and had to help him undo the gas mask basically and jamie was grieving himself for a loss that he had that we all acknowledged on the house floor so we were just all frazzled and thinking about what was happening and what was transpiring. >> there's a photo of you holding a transparent bag and you talk about gas masks. it's important to kind of put things into perspective, and what was going through your mind, congressman? you have a gas mask in your left hand, a bag. you're a member of congress in this extraordinary building that is the representation of our democracy and here you are having to deal with the possibility of putting on a gas mask or worse. what were some of the thoughts that were going through your mind as you kind of weighed what was going on and what this meant? >> i wasn't the only member who didn't know that there were masks under the chairs in the house chamber. i've been a member for years and when we were instructed by the capitol police to get our gas masks from under our chairs, i was confused. i didn't know what that plastic box was. it was double wrapped. it was kind of hard and we're all, you know, emotional and frazzled and kind of ripping it open with our hands and then as i mentioned my colleague had a tough time opening his, so i handed him mine and then opened his. i don't know how we're going to get out of here. those were some of the experiences that we had and put in a safe place, but it just shows how fragile our democracy is, everything the president said today is absolutely true. it's worth protecting our democracy and that's our charge and our responsibility as members here. >> congressman, i want to turn to your committee's investigation into the attack. give us a sense of where things stand. >> we're in the investigative stage. we continue to hear testimony, have witnesses come before us, some voluntarily and some quietly, and then others more publicly as you've seen, with public depositions that we've noticed as well, and so public subpoenas, and so we continue to make significant progress in talking about the activities that led up to and precipitated the rallies on january 5th and 6th, so we're really focusing on the time between the election day and january 6th, what happened, but as well as what happened in the 187 minutes that our colleague liz cheney talked about where the president did nothing and so we're analyzing and looking at that, talking to individuals who were interacting with the former president at the time and seeking mandate to get to the truth. you know, we made public some of those text messages that mark meadows gave to us. what alarms me is that this was a conversation about harming democracy, about carrying forward an alternate slate of electors. this was a conversation these individuals started very soon after the election day, and so this wasn't just something that transpired on january 6th. this was something that people around the president were talking about alternate strategies, theories, debunked idea, talking about all of those things close to the election day itself and so this was continued to support and it's our charge and responsibility to defend democracy and shine light on exactly what transpired. >> congressman, it's a pleasure to see you. thank you for being with me this morning. >> happy new year >> likewise. special coverage of the january 6th insurrection continues, up next, our very own pete williams gets behind the scenes access with the agent leading the fbi's investigation into the riot. he'll tell us where things stand right now. plus, the impact january 6th could have on the next election. we'll talk to congressman castro about the future of voting rights next. you're watching "jose diaz-balart reports." and a real estate agent. after having a kid, everything that you used to do for yourself goes out the window. the lines that i was seeing in my forehead were getting deeper than i was used to them being. and i realized, you know, what i can focus again on myself. so, what do you see when you look at yourself? (swords clashing) -had enough? -no... arthritis. here. aspercreme arthritis. full prescription-strength? reduces inflammation? thank the gods. don't thank them too soon. kick pain in the aspercreme. 22 past the hour, attorney general merrick garland made a promise to hold those involved in the events of january 6th responsible. take a listen to what he said yesterday. >> the justice department remains committed to holding all january 6th perpetrators at any level accountable under law. >> federal prosecutors in d.c. announced they have charged more than 725 people in connection with the insurrection, with the fbi saying it is still seeking out more than 200 suspects, including the person who put pipe bombs outside the democratic and republican national committee headquarters. joining me to break this down, nbc's pete williams and barbara mcquaid, msnbc legal analyst, former u.s. attorney. thank you for being with me. pete, what is the situation of the investigation, the fbi's investigation, what are the outstanding questions they still have? >> who was involved. they're still looking for about 300 people and that number is probably going to grow that we have seen pictures of assaulting people or entering the capitol and they want to know who those people are. of those, about 250 are seen on videos and photos assaulting police officers and that's the top priority for the fbi is trying to figure out who those people are. you can go to the fbi's website, they have photos and videos, they're looking still very much looking for public tips to try to identify those people. but those cases continue to come in, it's up to 705 now in federal court plus another 25 in d.c. superior court. so the prosecutions continue to mount about 170 of those people have so far pleaded guilty, and in the coming weeks, jose, we'll have the first of the trials to stem from the january 6th attack. so far, all of the sentences have come from people who have pleaded guilty. >> and the person who put that bomb or those doms, the dnc and rnc still not a lot of information on that. >> no, and it's not for lack of trying. the fbi has interviewed 900 people virtually everybody who lives along the route that he walked or i say he, he or she. that's one of the things they don't know. they don't know whether this is a man or a woman because the person is so heavily disguised wearing a hodhoodie, a mask, nothing distinctive about the clothe, even the kind of shoes has gotten public scrutiny. the fbi doesn't know. they've gotten over 30,000 tips and followed hundreds of leads, but that is still a big question, who is that person. >> i'm glad we're seeing these images again of this person because it's kind of important to keep that in mind. there are so many different camera shots and you're right, pete, person was clearly very careful, right? barbara, the attorney general did not explicitly mention former president trump or his associates but was there anything that implied the justice department may be looking at high-profile targets like trump or inner circle? >> yes, i think so. you know, i know for the general public there's some frustration that he didn't say more about donald trump but for those who have been in that situation of giving public statements on behalf of the justice department i was listening for key words and heard them. he said things like anyone who was involved at any level, he said that people who were present for the attack on january 6th and who were not. he talked about not having one set of rules for the powerful and different set of rules for the powerless. he talked about how the work is not yet done and we necessarily start with the less severe crimes and work our way up to the severe crimes. i think it's unrealistic, you wouldn't believe the evidence against trump and getting ready to fire away with charges. he's never going to say that. president words i heard suggested to me that everyone is on the table up to and including donald trump. >> you think we may get some information going forward in the near future or not until this whole thing is completely wrapped up? >> it was a scary day for everybody that was at the capitol, for the staff, for the members of congress, for the folks who worked there in the cafeteria and everywhere else. it was a chaotic day and you know, i just remember at the time, i don't think looking back, i don't think i understood the severity and the gravity of the situation that day. there were people from texas part of that rally in that mob. i didn't know if they'd look in the house offices for me. i know other members of congress from their own states had the same concerns and it's obviously a day that will be forever etched in my memory. >> what do you think the year ago today meant for american democracy and in the larger picture, in the history of our country? i mean, we're such a divided nation. >> it's a day that lives in infamy amongst other days remembered in the same way and it was the start of a real test for our democracy, and you know, in the year that's passed, it's unfortunate that the congress still has not passed strong voter protection laws to make sure that our democracy stays safe and secure, that we will have fair and free elections in 2022 and 2024, and so as i think about january 6th, i think still about all the work that we have to do, to make sure that it never happens again, that the people who perpetrated january 6th are held accountable, including members of congress who may have coordinated with those responsible and that mob or participated themselves and then also, you know, to make sure that we pass voting laws to secure democracy. >> well, congressman, let's talk specifics. you've been very outspoken against texas as being one law that bans various methods of voting, said it's motivated by the same reasoning behind the insurrection. explain what you mean by that? >> well, you know, across the country and in my state in particular and other states like florida, georgia and other places, there has been this big lie perpetrated that started by donald trump but spread across the country there's widespread voter fraud and harder for people to vote. often times the people targeted are the people that disagree with donald trump's republican party and what's especially scary as we go forward is that the price of admission to win a republican primary now is that you have to buy into the big lie and you have to show complete fealty to donald trump, complete loyalty to donald trump. if you don't, you're forced into retirement or beaten in the republican primary. so in other words, this problem, jose, is just getting worse and worse, and that's why passing hr 1 and hr 4 through the federal government, the united states congress is so incredibly important. >> let's talk about priorities, legislative priorities for you. you've been one of the outspoken really supporters of immigration reform that was in the build back better bill that didn't go anywhere, that we know what happened in the senate with the parliamentarian three times, no inclusion of anything on immigration. what are your priorities, congressman? >> well, you and i over the years have spoken about a lot of different issues. we've spoken about immigration, about health care, about education, but i want to be clear, the bedrock issue for all of us, not only as democrats but i think members of congress and for all americans needs to be protecting our democracy and making sure we still have a democratic country in 2024 and beyond and that's why we've been making such a strong push to pass the freedom to vote act and the john lewis voting rights advancement act. if we don't do those basic things, then i don't know that we're going to be having a debate, a legislative debate about immigration or education or health care or economic development or anything else in the same way that we've known as americans throughout our history. >> do you fear that's a possibility, that our democracy is actually that fragile today or going forward? >> i really to. you have one political party unfortunately that has taken such an ugly turn and i'm not saying that there aren't good people in the republican party, but those folks simply are not able to for the most part stand up and push back against this cancer that is trumpism, and the price of admission to succeed in the republican party and to win in the republican party today is to equate democratic victory with voter fraud and to perpetuate the big lie and to convince the american people, and they've got a whole network of fox news and a whole apparatus of right-wing radio and right-wing shows on the internet to help them now do it to perpetuate that big lie and that makes it dangerous for our democracy. >> congressman joaquin castro, always a pleasure to see you. thank you for being with me on this important day. >> thank you. coming up, other top story today, the covid pandemic, hospitalizations are up 63% nationwide. we're going to tell you about the cdc's latest move to bring down that number. you're watching "jose diaz-balart reports." how bout sushi? >> thank you so much for having me. this is good news. we know from recent data showing three doses of vaccine offers the best protection against coronavirus especially this omicron variant. so far we have about 50% of 12 to 15-year-olds that are fully vaccinated, so we need to continue pushing for first-time vaccinations, but obviously for those fully vaccinated to be up to date the booster opportunity is important as we enter the latest surge, kids are back in school, it really is important to get them vaccinated in order to keep them safe. >> does it still hold five months or six months after their second vaccine shot? >> right, so the fda and cdc updated the recommendations, made them even stronger. there was recent data showing waning immunity as early as four months, and so fda has updated to five months after the second dose that you should get your third shot, and so that's very important for families to really be aware of. increase in breakthrough infections four to six months after the second dose so the cdc changed recommendations to getting that booster dose five months after the second dose. >> thank you. morgan, you're in dallas where one in three central texans are testing positive. what is the impact on hospitalizations there? >> we have numbers from several hospitals across texas each one a snapshot of how quickly this particular wave is moving through the state and also the nation here, we're here at parkland hospital in dallas two weeks ago, they have 30 patients covid positive inside here today, the number sitting just below 200, 70% are unvaccinated at this point in time and that's why there is frustration rising among staff, trying to do whatever they can to help folks but facing these numbers that continue to go up. i want to you hear what one nurse told us a short time ago. >> i would never in my wildest dream imagined we would be here again two years into the pandemic. most of the patients that are coming into the hospital that are requiring icu level of care that are requiring a breathing tube that are requiring ecmo have and continue to be those patients unvaccinated. >> reporter: the cases may be more mild but continue to the rise in numbers statewide and not just those back several years ago or a couple years ago seen as the older more likely to get covid folks, we're talking about children, too, texas children in houston, jose, the number of their media trick patients doubled in the last week. >> thank you for being with me. the world's number one ranked men's tennis player is held at a quarantine hotel in australia as he fights potential deportation. novak djokovic traveled to australia wednesday and refused wednesday after the government canceled his visa application. that happened after djokovic was granted a medical exemption from the australian open from having to be vaccinated or quarantined for 14 days. australia is facing a record number of covid cases. joining me from london is msnbc news foreign correspondent kelly cobiella. what is happening? >> reporter: it's bizarre, jose. novak djokovic finds himself in a strange situation having to fight a deportation order out of australia. he arrived yesterday, spent eight hours at the airport trying to plead his case, trying to convince officials he did have the right to enter. if you're a citizen or resident you're allowed in but a mandatory 14-day quarantine. a visa holder you have to prove you're vaccinated or have a medical exemption. overnight his visa was canceled because he failed to provide appropriate evidence to meet the entry requirements. there's a lot of anger in australia about djokovic being allowed in, in the first place, melbourne in particular, the city has been the most locked down city in the world, this morning the deputy prime minister of australia told bbc that if djokovic had filled out his forms appropriately, in other words, if he had lied on his forms, then he would be deported, if he hadn't filled them out appropriately. there's no evidence djokovic is trying to be deceptive but we don't know why he was granted a medical xampgs. where does it stand now? >> reporter: well, jose, it feels surreal. it was surreal that morning. a year ago i had come to report on a political story. i was upset that i didn't -- wasn't assigned to covering the protest outside, because i thought that's where the action was going to be. i never imagined what would happen inside. we were doing our coverage, and we were told to evacuate. they took us down to the basement, and that's where we actually ended up witnessing the darkest hours this country has ever seen, i think. >> you were aware after a while of just how massively dangerous things were just above where you were. and where you stayed for more than 12 hours. what were the scenes that you remember the most vividly? >> well, we were in the cannon building, not in the capitol building. that's where congress people were being evacuated to, and there was also like a medical office where the injured capitol police officers were being taken to. so seeing police officers crying because they had been tear gassed or hurt, i saw one bleeding from the head because he had been hit in the head, that was very difficult. watching congress people crying on the verge of tears, veronica escobar from texas was shook up. later we saw her pictures on the floor because she heard the gunshot. we talked to someone from california who was angry and thought he was going to die that day and was determined to take some of the rioters with him. that's what he told me yesterday when we were talking about the experiences we had lived in that hallway. and i was -- i had you in my ear. you were actually asking me if i was scared or not. i had a microphone in my hand. i knew i was witnessing a very sad day in our history, and i was determined to report it, but when i saw people in the cleaning crew crying and telling me they had left el salvador to escape violence like this and they were living in the united states, that's where it hit me we were in danger. >> thank you for being with me this morning. it's always a pleasure. i want to check in with senator schumer's comments right now on the senate floor. >> all senate staff who are processing what happened a year ago. let me share my personal experience on that day. as i've recounted many times since then, my personal experience that day was in some ways like the opening sentence of charles tickens, a tale of two cities. the best of times, the worst of times. first came the best of times. 12 hours before the attack at 4:00 a.m. in the morning i learned or several hours before the attack at 4:00 a.m., i learned that our two democratic senators had won in georgia and we would be -- we would gain the majority. at 4:00 a.m. it became clear, i tried to get some sleep. couldn't. got down in my car, droef to washington and got to the floor of this chamber at 1:00 p.m. for the first time as the punitive majority leader. within 45 minutes of sitting there and watching the beginning of counting the ballots, a police officer in a big jacket and a large rifle grabbed me firmly by the collar like this. i'll never forget that grip, and said to me senator, we've got to get out of here. you're in danger. we walked out the senate chamber door. made a right turn. went through another door. this happened to be captured on the video tape above. it was shown at the impeachment trial, although, i didn't even know they had the tape until i saw it at the impeachment trial. we go through the door. you don't see us for 20 seconds, and then we are running out of the door at full speed. i was within 30 feet of these nasty racist bigoted insurrectionists. had someone had a gun, had two of them blocked off the door, who knows what would have happened? i was told later that one of them reported said there's the big jew. let's get him. bigotry against one is bigotry against all. and i saw something that i've been told later never happened before. the confederate flag flying in this dear capitol. that's just one of many searing grotesque images of that unimaginable, most un-american day. there are good moments, too. i remember when the leaders, senator mcconnell, myself, speaker pelosi, leader mccarthy were sent off to the secret place. we convened after desperately trying to get the president on the phone to ask him to call the rioters off. we spoke to the secretary of -- the secretary of defense and the acting attorney general, but to no avail. and -- but then the four of us got together and said we're going to come back. we're going to count those votes. we're not going to let the violent insurrectionists stop us and count the votes, we did. until i believe it was 3:00 a.m. the next morning. that was a good moment amidst a lot of bad moments. so now we ask one year later, how shall our country move forward? what are we to say and think and do in response to a day when a sitting american president rather than step down from office unleashed his supporters to attack the government through mob violence? how can we help those scarred by that day find solace, find healing? how can we make clear to the american people, to the world, and even to ourselves that our democracy is still whole? first, we
