disappointing results in the early trial. while here in washington senate democrats are coming face-to-face with a difficult reality. they're in the verge of closing out their year in the majority without deals on three of their biggest agenda items. i'll ask a member of the senate team about setbacks ahead. we are start with the breaking news from pfizer about the vaccine trial with kids age 2 through 4 years old. in the last hour, the company reported two doses in that age group did not generate a strong immune response that was equivalent to seen with teens and adults. although the two-dose approach did have the results they hoped for in children's six months to 2-year-old. the company now plans to test three doses in sid ages 2 through 4. this make news comes on the vaccine front, comes as we're seeing new warning signs all arrange the country. cases are surging and hospitalization are on the rise. we want to be right to the latest so, dr. blackstock, this pfizer vaccine news, how far back does this potentially set the effort to get the 2 through 4-year-old kids vaccinated. >> as you mentioned at the top of the hour, this is disappointing news, but i think the transparency is incredibly important. i think parents need to see how the science works. what pfizer is going to do. they're going to go back and see if a third doane of three micrograms is effective. we know the 6 to 2-year-old group was effective, but it remains to be seen if three doses will be. it seems like the primary series will be three doses. my hope is this dose will provide an adequate response in this age group. it would push the deadline out to mid 2022, unfortunately, with pfizer submitting an eua probably in early 2022. >> it will be enormously frustrate fog parents, i have to think. we just got news that the nfl is postpones some games this weekend because of the covid surge working its way through the league. this is all moving incredibly fast. can you give us the big picture about where we are and where we're not with the latest wave? >> the big picture is we're at the beginning of this surgeon. we'll see the highest numbers in the next four to five weeks. we only have about seven states with indoor mask mandates. very few have indoor capacity restrictions. we're seeing even longer lines for testing. testing is incredibly important to identify people who are positive, so they can let other folks around them know. we knee to make -- and need to encourage people who are not vaccinated a. and for those eligible boosted. only 25% have been boosted so far. >> the testing part of this remains to frustrating. we're beginning to see loan lines in testing centers. well hear from the president's covid team omicron is in 25 states. the cdc director says it will become the dominant variant. at we're looking -- as they're starting to look ahead, so people be thinking about changing their holiday plans? >> i know people are so excited about being with family and loved ones over the next one to two weeks, but i would think this is a critical time. we're already in a delta surge and omicron is here. so i would caution people to be very thoughtful about getting together for large indoor gatherings, and probably avoid that. even for small gatherings, it could potentially be risky. make sure to see if you can obtain rap tests and test as close to the gathering time as possibility. if you're indoors, you want to make sure you're opening doors, opening windows, using a hepa filter if you have access to one. i'm specially concerned. i would caution people to be thoughtful why that time frame? i think back to the early stakes, two weeks to stop the spread. the then president said things would be over by easter. and now we're in the situation where you have a large percentage of people vaccinated. we're still advancing in this there's more information? give people some hope about what we're looking at here. >> well, what we hope to have in the next few weeks is more information about whether it causes more severity dizzy. there also were unioner. and so, we know that hospitalizations and death are lacking indicators. so so even know that number, that could even lead to a shared increase in cases which would lead to more hospitalizations. i wish i had better news for you. >> i won't hold it again you, doc if you're somebody who god your second shot recently, how soon can you go get a third? can they do it whenever? >> if you've an mrna vaccine, you have to wait six months. >> that's a moderna and pfizer. right. for j&j you can get boosted after two months. i also want to point out the two doses still are protective against the severe outcomes of covid. even though the effectiveness that is drop with omicron, it's about 70% effective. doctor, thank you for walking through all of this. turning now to the trial in the death of daunte wright. kim potter gave emotional testimony throughout the afternoon. she says she mistakenly reached for her firearm instead of her taser. i'm joined by ron allen, and danny cevalos and charles coleman. ron, we just heard this lengthy testimony from kim potter most of the afternoon. take us thus the most significant parts of the testimony. >> reporter: it was extremely emotional 'em talk about the she just broke down and had a difficult time. at one point she said, i'm sorry, i'm sorry this happened. i didn't need to hurt anyone. and about how they're going to interpret the law, but here's an example, for example, a cross-examination of the prosecutors pressen potter. >> you would agree as a police officer, you have the duty to render aid and communicate information to other officers, right? >> yes. >> part of the job is to assist those who are injured? >> yes. >> but you didn't deal with any of those things on april 11th, did you? >> no. >> you stopped doing your job completely. you didn't run down the street and try to save daunte wright's life, did you? >> no. >> reporter: she essentially betrayed her badge on that day, in terms of how she responded to what was going on. the last part of the testimony there, about not rendering eight, and so forth, speaking to the prosecutors trying to increase the penalties she would face if in fact convicted. we've seen reams and reams of videotape. the jury will get the case sometimes monday afternoon. >> we saw a lot of emotion from potter. i'm curious what you think of this. >> i remember taser, tasers, taser, and nothing happened, and then he told me i shot him. >> charles, in the space of that nothing happened, that's when potter shot wright. i wonder if you thought that might be the kind of thing that prosecutors would want to draw attention to. the way she described that and what happened in that moment seemed important. >> absolutely, garrett. i do agree, in that time span. in that break, where we talk about nothing happening, that's exactly when the trigger was pulled and when daunte wright was shot and killed. i do expect prosecutors will harp on that, and we may hear part of that during summation. >> potter got upset several times on the stand. how much of that is to make her seem like a thoughtful person, a person who is emotional about this, a person who regrets what happened, to make her relatable to people. how do scenes like that help or hurt her defense. >> most if not all of her testimony is for that purpose. is there any really any fact in dispute innocence cage. most of the time the jury is there to decide the facts. the facts are pretty much nor in dispute. this was a mistake, an unintended shooting. the only real dispute is whether that amounted to consciously creating a risk or recklessly creating a risk. ultimately, that is a legal issue that the jury is going to be called upon to decide. to in this case potter 100% had to take the stand. she had to let the jury see who she was, and explain to them, i didn't intend this, this was not conscious, and also for them to see how much this devastated her. she probably did a effective job of communicating that, unless the jurors found it just not credible for whatever reason. >> normally a tricky decision, but here you say it was a no-brainer. >> they had to do it. even more so here for two major reasons. one, it humanizes kim potter. number two, police officers are the very best testifying witnesses in our system. better than lawyers, better than judges, better even sometimes than the expert witnesses. >> because they have so much experience? >> they do it every day. in most places, for example, they may have one day a week where that is where they go to court all day, and that's the only thing they do is testify all day long. they definitely get their 10,000 hours in when it comes to runs. >> charles, the fact really aren't in dispute at all. what do you want the jury to take away in and how careful do you have to be, to make her more sympathetic to the jury? >> that is a really good question, one that i've been asking to senators as we've been here on the hill today is, what the timeline is going forward. most of the caucus agrees that they want to move forward on the build back better agenda, the centerpiece of democrats and joe biden's plan here while they have the majority here in congress, but really the question is, what is the next deadline. this building tends to act only when their backs are up against the wall. in market because of joe manchin's slow-walking process, continues to negotiate, and not with great speed. the other piece of this is it's been a no good, very bad week, partly because of the parliament taken coming in, they could not do the third version of imgrails reform. there's other pieces that still have to be written and all of that led to the fact it's ending with a whimper, not a bang here. they have two complete bills, but the votes are still a problem there. where does the senate stand on making a rules change or fidding some other way to worry their voting rights agenda through? >> the rules change is something that's gained a lot of team in terms of being a conversation among democrats. yesterday ply sources told me in that caucus meeting, tim kaine went over what a rules change could look like. as i was tacking to senator warnock today, another leading voice here in the senate, he continued to stress the need for this to be a public debate. he wanted the public to hear where senators fall on this. it looks increasingly unlikely in the seconds and minutes passed, but also how they move into next year. they have made voting rights a centerpiece of their agenda here. other people started looking at this, there are other price here to make a carveout on, too. >> they are trying to spin this as we're going to continue woring, this is our first year, you've seen them go around the country talking about it there was a time when they basically wouldn't talk about it. they talked about it as something -- we've seen that messaging not work with the american people, and so their job now, and what we're trying to decide right now is how forceful the president will be publicly, about especially something like voting rights, trying to get something done by the end of this year, it is really heart, you know, to see anything get down with voting rights by the end of this year because of the all the reasons that ali just laid out, also toward next year. what the white house is really thinking about is how they're going to be steadfast and quick to move on voting rights at the beginning of next year, that is the project they want to take on, but it's unclear how they plan on doing that. they already telling people how to find -- where to vote, how to voight, how to make it easier. how to get around some of these laws restricting voting rights, but not really passing voting rights legislation. that's something i've been talking to especially black activists this week, what are you giving us to tell people to come back to vote? you can't tell us to vote in 2020, to give you the right house, and then nothing happened that black people really wanted, especially protecting the right to vote. that is something that the right has to grapple with. >> that gives me an opportunity to pivot here. thank you. i'm going to bring in the senator from michigan, debbie stabenow you just heard it from eugene, democratic activists are frustrated about the pace of these two big bills. as you heard from unine, african-american activists are frustrated. you're in the room where it happens. what's the plan? this has been as an incredibly busy and productive years, starting with protecting people in terms of the vaccines, helping people get through the pandemic, children get back to school, all of the things associated with the pandemic, and then going to the innovation bill that's going to bring jobs back to america, the infrastructure bill. we have a whole range of things more than any other time. >> senator, i appreciate that -- >> i will go to your question, yeah. >> okay. >> i think it's important, because it's very easy to say, well you've gotten ten things done, two more haven't gotten done. the reality is, now, really, really important to take the next step on build back better. we know this will be done first of the year, not now, because of a number of issues, both getting final agreements, final language, as well as going through the parliamentarian and all the issues there. we know that. the president nose that, we will come back, immediately go back to work in january to get that done. on voting rights we have 50 democrats all supporting the same bill, the freedom to vote act. as you said, the challenge is we have to change the rules to do it every state, we're note talking about the filibuster, though i would support that, we are talking about restoring the senate by making some rules changes that are very much in bounds with -- >> let's talk about that, senator. you had a meeting today at lunch, as i understand it so let's debate on the floor. you can have your voice heard but when we're done there's a lot of things discussed about restoring storing the senate to how it's supposed to work we're having a lot of discussions about that last night the parliamentarian struck down the -- all had similar actions he said these these are too big to be included in a budget bill. so there is a plan d for this bill? >> reporter: it's been delayed according to an aide, because alex jones is engaging with the committee. they diplomat say when the new date is. they also didn't say whether alex jones has provided any information,or anything useful at the least. i think broadly, they're scratching their heads at the prospect that alex jones will ever cooperate. is he genuinely going to cooperate and provide information? [daughter] slurping don't pay for water. pay for clean. it's got to be tide. ♪ ♪ 'tis the season to break tradition in a cadillac. don't just put on a light show—be the light show. make your nights anything but silent. and ride in a sleigh that really slays. because in a cadillac, tradition is yours to define. so visit a cadillac showroom, and start celebrating today. ♪ ♪ our msnbc colleague tremaine lee just added a new title to his resume, harvard instructor. while a fellow, he led student discussions on race and politics. harvard has one of the highest numbers of black students among the ivy league but it is still just 11% of the total student body. at the end of the semester, lee sat down with a small group for a deep discussion about what it is like being black on campus. he jouns us now. tremaine lee, while i would have loved to have been in your class i am curious what your time was like at harvard and what did you learn about the black experience there? >> garrett, it was a fascinating experience to engage with young people whose minds are so open. but they have a grasp for themselves and the world around them. one thing i learned is while harvard does a lot of things really really well, truly understanding its connections and legacy to claefr and white supremacy, and each more so, how black students experience blackness on their campus, they don't do such a great job. here's one of the conversations i had. >> i am queens new york. >> i am from long island new york. >> the schools aren't keeping they can of their black students' backgrounds but the students estimate less than a third are generational african americans. >> how do you identify? >> caribbean american. >> nigerian america. >> i was born here, but my parents lives were spent in nigeria. >> the son of two immigrants who migrated here in their early adult life. >> we sent a detailed list of questions to harvard about their diversity and recruitment efforts. the proportion of black students who are deed ants of enslaved people and those who is families immigrated. the school responded with a handful of web links and then declined to comment further. they launched an initiative in 2019 to understand the legacy of slavery in our institution and community. >> is the institution doing enough to remedy any of the past? >> simply, the answer is no. custom is admitting and seeking out and recruiting generationally african american students specifically ones directly implemented by the impacts of slavery, red lining, public schools, overfunded police communities, all of those are directly impacted by the slavery. >> in the meantime, the sigh sponsora. >> i knew people who come from where i came from but who have to conform to the culture here. >> i imagined it to be a melting pot yet it didn't live up to that expectation? >> in what way? >> i was expecting to have white friends, latinx friends, african friends. and when i got on campus, it was opposite. people stuck to their cliques. it was diverse on paper but in actuality the college is very segregated. >> how much of that do you put on the institution? >> i put a great deal on the institution. i think that just admitting 18% black students into your population is not enough. >> i think that that change really can start right here like with the black students. and making more structural changes as we have all talked about, making those tangible efforts to reckon with their past, could really inspire america to do the same. >> while it is not lost on any of these students who a privilege it is to go to a university like harvard they say it is unfortunate they have to bear the full weight and burden of their full experience and what it means to be black on that campus. they just hope the university at some point pitches in and has a self reflective moment on what their black students are going through. >> fascinating stuff, tremaine, thank you for sharing that reporting with us. thank you all for watching this hour of hallie jackson reports. i am garrett haake signing off.
