to reel. the parents of the teen gunman now in police custody after a ten-hour long manhunt. this morning we have new information about what unfolded in the hours before the shooting and why authorities are now investigating school officials. and 24 hours before vladimir putin and president joe biden set to speak, tensions on the russia/ukraine border are soaring with new fears that a conflict there is basically unavoidable. we're going to start this morning with those new restrictions i mentioned a moment ago. starting today, anyone flying into the united states will have to show a negative covid test taken no more than one day before they get on the plane, and it does not matter whether you've been vaccinated or not. the idea is to try and stop the spread of this new covid variant now present in at least 17 states. that's after georgia and louisiana reported their first cases yesterday. even so, 99.9% of new cases are still coming from the delta variant, and those cases unfortunately are rising. we're back over 100,000 a day for the first time in over two months. there is one piece of good news. we're also seeing a spike in vaccinations, roughly a million and a half a day. as we speak, the u.s. is on the verge of a very good new milestone, 200 million fully vaccinated americans. so let's dig in. antonia hilton joins us at jfk airport, and with us dr. kavita patel, she served as policy director in the obama white house. let's start with this variant, initial data from south africa, that is the epicenter of this variant, does not show a surge in hospitalizations. that seems like really good news to me. >> it is, stephanie, and even though some concerning data is coming out about how easy this is to transmit, meaning that it just is more infectious than the delta variant, it is great news these early preliminary data is a sign that this might not be as severe or lead to severe illness. and especially amongst vaccinated people, this could be exactly what we've been hoping for. >> oh, good, i like that. we heard some other news this morning, actually, just a few minutes ago, new york city mayor bill de blasio announced right here on "morning joe" that the city is going to impose a vaccine mandate for private sector employers across the board. that's the first we've seen of this kind. what do you think? >> look, i think that they're watching the numbers as we are, stephanie, and it's just very clear. where you have incredibly high pockets of vaccinated individuals including people up to date on boosters, you just see lower cases. it's not no cases, but it's lower cases, and i think that that leads to especially while we're getting all this court confusion over the federal mandates and federal restrictions and testing requirements, i think that cities are left, as usual, to some of their own devices. so i am in favor of it. i also think that it's what people need to feel confident. we're going into a busy holiday season. the most common question i'm getting from patients is can i go to this holiday party? is it safe to go to this restaurant? i have tickets for a play. i'm sure the mayor of new york city realizes so much rides on the confidence consumers and citizens have. that's why i support what they're doing. >> i will say i have been to the theater quite a bit over the last month. it is great to see every theater in this city requiring vaccines, making sure we're showing our cards even for our children. antonia, talk to us about these new rules for travelers. >> reporter: well, stephanie, people are waking up this morning to a slightly different travel landscape and new testing requirements. as of 12:01 this morning, if you are already going abroad, in order to fly back to the united states, you're going to have a one-day window to get a negative test back, and that could look like a pcr test, some at-home or specific antigen tests that might require you to do a televisit with a provider. this is going to apply to anyone over the age of 2. it's going to apply to you regardless of vaccination status or what country you are in or your country of origin. it applies to everyone. it may not sound like a major change, people have been getting tested routinely, but that one-day window is key for people to plan around, especially if you plan to go somewhere that doesn't have a testing infrastructure such as we have in the united states or perhaps an area where these tests can cost in some cases north of $100. something that travelers may also see if you're coming into jfk or newark or hartsfield jackson in atlanta, some of these major international hub, there's going to be additional bio surveillance. a company called express check will be taking samples of passengers and looking to see patterns of how the omicron variant is entering the united states, trying to anticipate community spread. it's that testing aspect people need to plan around logistically and in terms of their budget. >> what do you make of all these restrictions? people are saying, what, this is massive. there are other countries who have these kinds of restrictions, canada, for example. >> absolutely. i think testing, especially 20 months into this pandemic, testing is the most reasonable along with the vaccine requirements. i'd love to go a step further, and now that we know that omicron and delta cases are rising in the domestic united states, i don't think it's unreasonable, if we can get people free access to testing to have that domestic requirement as well. that's not on the table but i do think we're eventually going to need that kind of confidence. the rapid at-home tests do qualify if they're proctored or kind of observed by video. these are the types of things that bring up all the digital divide, the disparities we've talked about for months but we can overcome them and create a safer environment. that's the confidence we need. we're all tired but we can create confidence of some of these requirements. see them as giving you that boost so that you can feel that your family is safe and you don't have to be scared going into the holiday season. >> then, doctor, i want to ask you about this new report showing republicans are by far the biggest unvaccinated group in the u.s. it also said that covid deaths in deep red districts run about -- are you ready for this number? five times higher than in deep blue districts, mostly because of misinformation. have you ever seen or even studied medically in the world of public health anything like this? >> no, never, and a number of us have been going back to our history books to try to understand when could we have seen a pattern similar to this? and it has been possibly centuries from when people literally were coming and discovering america's from other places that we've seen such divide amongst attitudes about health care. it's stunning, and what i worry about is that we can have like very polite conversations about vaccines and how they help, but if we have such deep divides, and these spill over into other areas, stephanie, i worry because i now see families that don't want to get any vaccinations. they've somehow taken what we've seen in misinformation with covid, and it's gone into other areas, other vaccines with their children that were never in question. so it is a turning point in our country and one that we're going to have to work really hard, but i worry it will take years to undoe, if we can, some of the damage we've done to date and lives that we've lost of course. >> it might take years but we've got to start now. dr. kavita patel, megan fitzgerald, thank you both so much -- excuse me, antonia hilton, thank you both so much. to michigan now with new investigations and more details for the oxford school shooting that left four students dead and six other students and a teacher injured. suspected shooter ethan crumbley and his parents jennifer and james are being held in the same oakland county jail. the parents arrested on involuntary manslaughter charges after an hours' long manhunt over the weekend. the school superintendent calling for an outside investigation because parents are asking questions about the school's version of the events leading up to shooting as questions are growing about why ethan crumbley was allowed to return to class after drawings he made before the shooting featuring guns and blood. all of this as the prosecutor in wayne county, michigan, has now charged seven other minors for making threats against their schools over having a weapon in school. let's get the latest from megan fitzgerald in michigan, and danny cevallos is a criminal defense attorney. bring us up to speed with what happens next with the suspect and his parents, and was he in custody when they were on the run? i'm thinking imagine if you were a parent and your kid's in jail for committing a heinous crime like that, wouldn't you be there trying to figure things out? but instead they're on the lam? >> reporter: we actually asked that to the sheriff, and he says that he doesn't think that the alleged shooter had any idea that his parents are in the same jail with him right now. the sheriff telling us that they're in individual cells. they're being segregated here and being watched closely. what we know here is the next steps is that they're all supposed to appear in court next week, but prosecutors have been so candid in this case, as you know, and saying that, listen, this is a very active and ongoing investigation as they continue to dig deep into all the evidence here. it is quite possible that we could see additional charges being filed against the suspected shooter as well as the parents, and at this hour, the question is will they face charges for allegedly fleeing from police, steph? >> let's talk more about that. we're learning about a guy who's accused of helping the parents. this guy's now coming forward. what do you know? >> reporter: that's right. his name is andre sekora. he owns that art studio that's in detroit there, and that where the suspects, the parents were found hiding early saturday morning. the attorney tells us they've been friends for several years, and he received a call from the parents friday morning saying that they wanted to come to his art studio because they had been receiving death threats. he shows up that morning, the attorney tells us by that afternoon around 5:00 in the evening, rather, his client leaves and tells the crumbleys to lock up. the next day he realizes what happens. there was this manhunt and these suspects were arrested in his art studio. that's when the attorney says he immediately went to police, told them everything that he knows and has since been cooperating. we also know that mr. sekora is expected to be questioned later today by authorities. >> danny, how rare is this the parents charged with four counts of involuntary manslaughter. have you ever seen anything like that? >> yes, i have, it's rare but not unprecedented. in michigan in 2018, the court of appeals upheld a theory of involuntary manslaughter against a parent who left a shotgun within the reach or the kids could get access to it, and there were tragic results unfortunately. but the point is that the prosecutor knows in this case that she has a clear path to conviction because the courts in michigan have previously approved and upheld a theory of involuntary manslaughter, which requires gross negligence, and that gross negligence causes the death. she has a path to conviction. she just needs the evidence. >> going forward, could we see more parents being charged in school shootings? because this is different from you left a loaded gun in your house and your kid grabbed it and it happened in the home. this happened not in the house. this happened in school. the parents weren't there. could this set a new precedent? >> you're absolutely right. we've already heard from the parents that allegedly they kept the gun secured. it was secured in the house. this case is about so much more than securing a firearm. it's about what parents know about this particular child before he accesses a firearm. you have to understand i'm a native michiganer, i'm not a hunter or a gun owner but a lot of folks there are. michigan's legislature and its people contemplate that minors will have access to firearms, for example, to go hunting up in the upper peninsula. we're smack dab in hunting season as we speak. the key is -- and the prosecutor said this word several times -- responsible. responsible gun ownership. this isn't so much about securing firearms. it's about what you do with a firearm in the home when you have clues that this particular child may not be safe with a firearm. >> i cannot imagine how complicated this is now for the school, the officials. talk to us about this investigation. could they really be charged with why didn't they take more action? i mean, it's hard. he was drawing, you know, graphic or offensive pictures in his notebook, but unfortunately kids could do that all the time. >> i'm so glad you bring that up. on the one hand you could say, well, as soon as the school sees any indication of a drawing or any kind of notes or anything that suggests the child is disturbed, they could take the ultra risk averse approach and suspend that student every single time. i don't know that's a universe we want to live in. >> there's a lot of graphic doodling that's going on. >> i spent most of my time doodling and not paying attention. sometimes you draw all kinds of things. and i know a lot of folks are going to say guns and blood, that can be a clear marker. you can imagine another kid drawing guns and blood arguably in art class and it be something that is first amendment protected speech. the key here is the totality of circumstances. what did school administrators know exactly. when did they know it, and at any point did they know that drawings, beyond drawings there was a real threat that this child could bring a firearm to the campus. >> our heart goes out to the entire community. danny, thank you so much, and the families of the four victims in the oxford school shooting are so gracious that they are actually thanking the community for their support and asking everyone to never forget the lives lost. the family of 17-year-old justin shilling releasing a very heavy statement saying in part this, the loss of justin leaves such a gaping hole in our family that we cannot conceive of life without him. our hearts are broken and yet still go out to the other families suffering this very same loss at this very same moment and which is beyond imagination. nothing any family should have to endure. his potential was boundless in life and yet in death he continues to give of himself as an organ donor. we feel the world cannot have too much of justin. if you didn't see this over the weekend, i want to share it now. as justin's body was moved for the organ donor surgery on friday, hundreds of people gathered outside the hospital to show their support. there was a vigil waving up at the windows to justin's parents as they made their way through the hospital. also over the weekend, the detroit lions dedicating their first win of the season. clearly they had four angels on their side. they hadn't had a win to date, and they dedicated that win to those victims of the shooting and the whole community there is grateful but also grieving. >> first thing i want to start with, this game ball goes to the whole oxford community, all those who were affected. for all those, they'll never be forgotten and they're in our hearts and our prayers and all the families and not to mention all those that were affected by all of this, the classmates, the brothers and sisters, the cousins, the teachers, everybody. >> the head coach adding the names of those four students who died who will never be forgotten. we'll be right back. forgotten. we'll be right back. look at the calendar, today marks 11 months to the day that insurrectionists attacked the u.s. capitol. it also marks the newest deadline for a bunch of prominent trump allies connected to that day's events as well as attempts to overturn the election. for expertise theorists like roger stone and al exjones, it's a deadline to hand over documents. for trump's former national security adviser michael flynn and his body man, nicholas luna, it was supposed to be the day for their congressional depositions, but they have been postponed. while all this goes on, the cover of "the atlantic" captures the growing, really scary fears that attempts to overturn the 2020 election were just practice, practice for what's to come in 2024. i want to bring in ali vitali on capitol hill and harry litman, former u.s. attorney who served as deputy assistant attorney general under president clinton. ali, more depositions postponed. i cannot imagine it means these guys are working with the committee. we're talking about michael flynn here. >> reporter: yeah, so, stephanie as i was talking with the committee this morning, we found out that these two depositions for nick luna and michael flynn were postponed, and the committee reminds me this is pro forma for people who are actually engaing with the committee. it also underscores that they want the information these people can provide. if it means giving them a few extra days or weeks to do so, the committee is clearly willing to do that. the other deadlines today, though, in addition to the depositions are documents deadlines for people who were involved, for example, with the permitting of some of those rallies on the ellipse and then also people like roger stone, alex jones, and then tomorrow you see document deadlines for the proud boys, those far right groups and their leaders who were allegedly involved with the january 6th insurrection as well. then you move into later in the week. we know who the people are who are involved here. john eastman, one of the former president's lawyers who argued that then vice president mike pence could overturn the election results, which he couldn't and he didn't, eastman is supposed to be deposed on wednesday. he went on to steve bannon's podcast, though, just a few days ago calling the committee a farce saying that he would move to plead the fifth if he even went to the deposition at all. that's sort of one of those instances, steph, where the medium is the message. we know steve bannon hasn't complied with the committee, if john eastman is over there saying he thinks it's a farce, you probably can tell that's where you can go next. long-time senior trump aide jason miller also supposed to be deposed. the january 6th committee doing its work as one of its members liz cheney last week says in the new year we're going to start seeing more from them, including more hearings. >> okay, but harry, it clearly shows that they're not scared. all of this is going on while steve bannon is still talking about all of it on his podcast. eastman going on the podcast. help us understand the position that eastman is in, pleading the fifth. why would anyone plead the fifth unless speaking meant that they were going to incriminate themselves. further more, how does he continue as a lawyer, a career injustice having done this? >> yeah, so first, that's the killer point for him and for clark. it's a body blow, but he has to compare it now against the possibility of literally incriminating himself. he has proffered to date really lousy privilege claims, and that would be enough to trigger a criminal contempt referral and doj might take it. if he makes even a lousy fifth amendment claim here, steph, or does it and then does it in a wholesale way and the committee tries to push back, not a very strong criminal contempt referral. so that's really big. are they unafraid? i doubt it. i think they are afraid, but they're posturing, and that's their kind of style. they're now in a cat and mouse game, but they know that unless the doj takes up the house's invitation to indict them, they're not going to get hurt, and they can continue to elude. >> and of course, reminder, if you didn't do anything, there would be nothing to incriminate. harry, i mentioned this new really shocking startling, scary covering of "the atlantic" by bart gillman says 2020 was a dress rehearsal. the prospect of this democratic collapse is not remote. people with the motive to make it happen are manufacturing the means. given the opportunity, they will act. they are already acting. what do you make of that? >> read it. we think of the whole debacle of the last several years as sort of improbabilities from the time trump first went down the escalator. there are people for whom it's just a blueprint. they want to tweak and perfect it, and they really have in place a structure that the basic idea is to subvert a democratic result and put hill where this morning we've got a lot to talk about. just days after four kids were killed by one of their classmates in michigan, republican congressman thomas massie posted this photo of his family holding long guns and asking santa claus for ammunition. kevin mccarthy is defending congresswoman lauren boebert after her anti-muslim comments about democratic congresswoman ilhan omar went viral, leading to a contentious call between the two congresswomen. punch bowl news cofounder jake sherman, sahil, republicans are in good shape to take back the house. is mccarthy worried that his loudest members are getting more influence? >> reporter: stephanie, if he's worried, he's not saying or doing much to show it. t%vacuum ther a favorite right . it's certainly the betting odds are with republicans, republicans will start kicking people off committees too and that's what congress has turned into in the last couple of years. this was unheard of just two or three years ago. this was the first time this had happened was i think this congress. so this is just -- it's absolutely unheard of, and it's turned into a mess. it's a complete disaster. i'll add to what sahil said, i would add one point. the reason why mccarthy doesn't condemn this stuff is because most districts he has to win across the country are republican districts, are districts where donald trump is popular. this kind of red meat legislating, red meat behavior is popular, and he doesn't see any downside, and he's betting and republicans are betting that joe biden and democrats will be so unpopular in 2022 that that's all that matters, and he thinks that all of this stuff, all of this noise inside the capitol is just that noise. people hate washington. they hate everybody, and he could get away with not condemning this stuff. and i will be clear. he did say on friday, i believe it was, that it's not helpful, and anything that's not talking about the economy is not hlpful for republicans. he's taken i guess a quarter of a step towards condemning it and has condemned anti-muslim and islamophobic rhetoric, but not enough for most people. >> punch bowl news polled senior staffers on the hill. it seemed like both parties agreed that supply chain issues will be the top priority. here's the issue, though. people say to the white house supply chain's a problem. what are you going to do about it? it's not something the white house can completely control. they have done what they can, but it is a global supply chain problem, and even if you're talking about our ports, here's a big problem. we have antiquated infrastructure at our ports. they barely have any technology. all of it has been under invested in this country for years, so you could make investments now and you won't see results for years and years. how difficult a position does this put this administration when the world's saying what are you going to do about the supply chain? >> impossible, steph. it's impossible for this administration and leaders in congress. we're going to get into an election year, and we're going to feel the supply chain backups across the world. there are not enough ports. there are not enough people to unload things at ports, so what lawmakers are going to be asking their leadership to do, and this is what we found in the canvas, our poll, is they're going to be asking to scratch an itch, so members of congress can say they are doing things to ease this -- these backups around the world. but as you know, there's nothing that they can really do beyond what they've done already. you could say that the infrastructure bill that they passed will help because it will improve ports and airports seaports. >> but it's going to take a long time for that to happen. >> reporter: it's going to take a very long time, that's exactly right. we'll have to see how this holiday season goes. this could ease some of those tensions or it could exacerbate some of those tensions. the bottom line point here is 2022, it gets even more difficult to pass legislation. that is what's underlying all of this. >> all right, sahil kapur, jake sherman, thank you both so much. we said it was a really presidential nominee who died yesterday at the age of 98. dole is a republican from an era that no longer exists, a man who saw the government as a useful tool to help those suffering at home and clinton. it was actually the third time dole had run for president. he ran briefly in 1980, then again in 1988. when he lost to the republican nomination to his long-time rival, george h.w. bush. but the two later became dear, dear friends, and when bush died in 2018, dole saluted his casket. on sunday president biden called bob dole an american statesman and one of the greatest members of the because we can afford it. all of this leading bloomberg business week to call child care the most broken business in america. joining me now to discuss, the person who wrote that column, claire suted. also with us, alissa stater, an associate professor of policy at northwestern university. would build back better fix this most broken business. just because it's a giant number doesn't mean it's the right solution. >> that is a huge question. i think the answer is, it is contingent upon the states. because the most important thing to understand about build back better is, it's not creating a whole new federal program from scratch, right? it is allowing all 50 states to come up with their own solutions for affordable child care. and it's just making money available for them. but the economics of child care is so complicated that most states may really struggle with this problem. and also, you have to opt in to get the money. and currently, we have 12 states who still haven't expanded their medicaid program under the affordable care act. so i think you might expect that something like that might happen, where we'll have some states address it and some states won't. >> for a lot of people who blow this out say, this is just a family issue, i don't have little kids, it's not important to me. can you explain why that's incorrect? why this is hugely important. it's an american economic issue. >> absolutely, stephanie. we -- if we've seen anything over the last 20 months, it's that during the pandemic, child care is not just a family issue. it's a business issue. child care is a piece of infrastructure that gets parents to work, just like roads and bridges do. in fact, even more importantly, because lots of people can work from home during the pandemic. and even before the pandemic hit, it was estimated that the u.s. was losing $50 billion annually in lost earnings, productivity, and revenue. and during the pandemic, we found that one out of 20 working parents lost their jobs or reduced their hours, solely because of child care. and more recently, a catalyst survey just showed that over half of parents that have a child between the age of 3 and 17 is considering leaving their jobs because their concerns about child care have not been heard by their employer. >> claire, we've heard it over and over, the child care industry, the offerings have gotten slimmer since the pandemic. but we also know that $39 billion went to child care in the american rescue plan. where did that money go? did it not work? >> it did, but this industry is so huge. one in 55 working women in the u.s. works in child care or early education. and the cares act, which was the very first covid relief bill that was passed gave more money to delta airlines, just that one company, than all of those women combined. this is such a huge part of our economy. this is necessary for every family with working parents with children under 5. hopefully you don't have working children. >> i need you to say that again. tell our audience that again. delta airlines, one company, received more money than the entire child care industry? >> in the c.a.r.e.s. act. when covid first hit and we were like, oh, my gosh, people are thrown out of work, people need child care, what is going to happen. the solution that we offered, 1 in 50 working women that work in this industry was smaller than what we gave to delta airlines. >> just to you, alicia, we have a giant working shortage. people aren't going back to work in child care centers. it's not safe and they don't get paid enough. how do we solve that? >> one of the ways we really need to be thinking about this is shoring up the child care industry beyond what just the dollars flowing to us are doing. so you know, it's absolutely right that just more money into this problem is not going to solve it. it's a systemic thing. one thing that's being piloted in massachusetts is to be able to provide child care centers with basic infrastructure, so that that way, they're freed up to pay higher wages and attract more workers into this industry. >> all right. well, you've got to take it on. the most broken business is one of the most important ones. alicia, claire, thank you both so much. that wraps up this very busy hour. i always love ending with two extraordinary women. i'm stephanie ruhle, jose diaz-balart picks up breaking news coverage right now. and good morning, it's 10:00 a.m. eastern, 7:00 a.m. pacific. i'm jose diaz-balart on a very busy monday morning. today, president biden's new covid testing requirements go into effect for everyone, traveling to the united states. this as more cases of the
