also today, a federal appeals court in d.c. has taken on the case, meaning trump's effort to block the committee from seeing any and all records in the national archives that they back to what was going on in the white house on january 6th. federal judges have now slowed everything down, they have scheduled arguments in the case for november 30th which means it will be weeks now before the committee might see trump's records, and they won't be turned over tomorrow as the committee and so many other democrats at. hoped i actually don't think it's a huge step back, i think that obviously champs folks will spin this as a wind because there's a lack of winds on any of their legal side. this is not unexpected i think we expected, frankly, there would be a stay issue by the appeals court. we also see a very accelerated timeline to hear this case. it is not going to slow down, our investigation, and i expect that keeping the supreme court potentially aside, will have these documents fairly soon. >> meanwhile, president biden on this team are now grappling with the challenge trying to get a sweeping domestic plan passed as inflation strains americans all across the country. republicans and some moderate democrats say president spending bill will lead to further price increases. now, some liberal democrats are coming forward to defend biden's plan as a solution for inflation. >> i'm in california, i understand the prices are going up, we gas are almost the price of -- except, gone up one. i don't think we're out of touch. we've got to get people back into the labor market, that will help increase the number of goods. and the build back better agenda act actually helps do that. >> much more on that, later today the president honored the sacrifices of those who have served in the u.s. armed forces. this is the first veterans day in decades without u.s. troops engaged in active warfare overseas. the first since the end of the nation's longest war in afghanistan. biden took part in the annual ceremony at the tomb of the unknown, on the 100 anniversary of the monument, there in arlington. he then praised our nations veterans. >> it's the badge of courage, that unites across all ages, regardless of background, because, to be a veteran is to endure and survive challenges that most americans will never know. our veteran representatives represent the best of america. you are the very spined of americans. not just the backbone, the spine of this country. >> earlier today the white house announced efforts to provide more support for veterans who have been exposed to the carcinogenic smoke from the burning of latrine waste on overseas military bases, so-called bone pit, also tonight, there is a new development in the aftermath of last week's election. new york times reporting that tomorrow, jack ciattarelli, the republican who tried to unseat governor phil murphy in new jersey will concede defeat at long last. ciattarelli went too far on election night, talking about his stoic achievement and his transition team going to work that week. the problem for him is, murphy is now ahead in that race by 74,000 votes. with, that let's bring in our starting line on this thursday night sam stein, veteran journalist, white house editor for politico. we kimberly atkins stohr previously the whole stuff boston global opinion, and the member of battlefield commander of the persian gulf. former cabinet member former cabinet of the national security council as well. good evening and welcome to you. all we kimberly atkins stohr i'd like to begin with you, will put it this way. the documents had been slowed down to a crawl, perhaps mark meadows cooperation is slowing down to a crawl. where the's this leave democrats who want to see consequences? >> we the democrats as well as the committee, which does include republicans in a waiting game. i think it is something that was expected, yes. this means that the documents that were required to be produced by tomorrow will take a couple of weeks before they see the light of day. it actually, in the legal word, is a pretty quick schedule to schedule arguments and briefings within a number of weeks particularly if there is a holiday at the middle. this is fast-track, but this is a stalling on mechanism by trump world which was really expected. they are going to use every lever at their disposal including making appeals. they could've appeal directly to the supreme court instead, they took the intermediate a rude first. they will probably appeal to the supreme court after. that so it's going to see a protected delay. but the claim that they are making about executive privilege, really, doesn't hold any water. in fact, it is the current president who decides what is in fact privileged under that doctrine in the biden administration had waved. it may be, in some circumstances with respect to specific documents, there may be a privilege claim that a previous president can made, but not the sort of blanket thing that is happening. so we will have to see what happens after it goes through. this but the whole point is to solve this until it leaves after the midterms. and to push this investigation into january six. beyond that, so that it cannot be used by democrats as a tool, it's something that they have the legal right to do, but it is causing a political problem when it comes for democrats in that sense. >> and sam, coming off of kim just, said i suppose i should ask in a cynical way, are you surprised there hasn't been more subpoenaed defiance? bannon who has no steaks, looks around, sees no consequences, and is savvy enough to know that he can beat the clock. >> yes. i guess in a way i am a little suspicious that they are going to be more subpoena defiance. the incentives for them to defy are much greater than to comply. if you want a future within the trump orbit, so to speak, and you believe that trump is going to run for office again then he will judge you by how you respond to a subpoena requests from congress. mark meadows is no dummy. with the president he cannot defend, is donald. trump and he took this very little consequence, here until the justice department the sides to take action on the contempt of congress resolution we they don't have a price to pay. even if they were to get in legal hot water in the situation, they become martyrs. in their political communities, that is not necessarily a bad thing. the legal cost that comes with it, the stain on your career of course, is bothersome. but you can become a martyr in trump world for fighting this. and it is there for them to be defined. >> general barry r mccaffrey i'll ask for your thoughts on this day later in this segment, first news from overseas compels this question. a military buildup, by russia, along the ukraine border among other things. fox news has cast their lot on russia side. as one does what. is your level of alarm. we have certainly been here before on the topic of military buildup on that border. >> it looks like they are putting in place, offensive capability that putin, who is a very clever risk taker may decide to employ. i think he will understand that it is highly unlikely, either the european union, or the united states would fight actively on the ground. so it is a risk. i think that, putin, who's got a terrible economy is turning into an absolute authoritarian dictator believes he has to do something to move to russians personal interest off their internal problems. this might be. it we are facing a similar situation on presidents we, chinese armed forces, will they actually have to take the risk of going after taiwan in the coming years. they also put on the ground, it capability, that is going to look like they may be considering it. >> well this is a dangerous place. which is why we trained young men and women to be dangerous fighters overseas. kimberly atkins stohr, we have to talk about what we should call the groundhog bill. the second biden bill. the big social spending bill. the trim down, still massive. do you see any path forward that doesn't right into a certain conservative democrat from west virginia? >> i think that it is difficult, i think that is one reason why we saw some members in the democratic caucus trying to tie this with the infrastructure bill, saying that they are both important. but letting one go forward, and leaving the other be going, behind makes it harder for the other to suppress. it is very difficult for me to understand exactly what the senator from west virginia may want. but i do know, that voters in 2020, went out in record numbers in the middle of a pandemic, in the middle of an economic crisis, and the middle of a social justice crisis to demand change from washington. and the results were that all week and both houses of congress and the white house were delivered to democrat, joe manchin was not on the vote in the ballot of 2020. he was not who those people were voted for. but obviously has a position here that he could stand in the way of delivering. that democrats should be reminded of just how popular and we [inaudible] zach was at the beginning of this year. just remember, at the time of this economic relief for americans, when they needed it most in the pandemic, now with inflation and the economy still staggering, they still made that release. businesses are trying to get back on their feet. and i think that that is what voters are expecting, and it would be really a big problem for democrats if they're unable to deliver. i >> said, indeed inflation is growling out there. i am looking at a fox poll that says, inflation is the number one issue people are most concerned about. i am looking at a cbs poll saying that it is the issue biden's handling the worse. i am looking at our own and bc pull that republicans are better suited to tackling inflation and the margin there is almost 2 to 1. inflation happens to be joe manchin's issue and sam, as no one needs to remind you, inflation has been more than one capable u.s. president. >> yes, the echoes of jimmy carter ringing fairly oddly right now i suppose. the thing here is that the white house is really grasping at the formative case tonight. the c.a.r.e.s. act, that kimberly reference, put money in people's pockets. they are extending the child tax credit, it provided financial relief in ways that helped people with inflation and concerns right. now but what's happened is that they have done a poor job in selling the goods. and they have done a bad job in confronting that right. now they recognize that joe biden and democrats actually provided the extended child tax credit, but they do blend joe biden for something that someone out of his control, which is rising and gas prices. that is a tough position to be in, to be blamed for something that you have little control over, and for having no credit for something you have done. what they have to do is, they have to talk of the recovery. which is happening. when we talk about 500 plus jobs created last month, they have to chalk it up without seeming like there is a catch from the reality of people struggling to afford basic day-to-day items. tuition costs, grocery costs -- and that's really hard to do. especially when you are not the president. because you have to communicate with every democrat, and those are the two main issues in addition to trying to keep joe manchin on board. >> and now to you a general barry r mccaffrey. i've said the last word for you. i know you've sent the part of your day giving the speech at the 40th anniversary ceremony of the vietnam war memorial wall. on the mall, in washington. yes, it's hard to believe that it's been over 40 years. as it must be hard to believe for you to walk along that wall. look to your left and see the names of friends that you served with when they were young. when you were all young. i am curious to know where your thoughts are on this veterans day. >> it was actually a glorious day for everyone. the weather was perfect. there was a huge turnout you know that war was a bitter struggle for those of us who responded to the legal orders and commands of our country, you know, 59,000 killed 330,000 wounded. 75,000. maned it was a tragic outcome. the best thing that came out of it was the millions of vietnamese added to the country, in a positive way over the years though, the american people have embraced the vietnam veterans. the armed forces that you know and every poll that we conduct are the most respected institution in american society. the armed forces have counted on the vietnam veterans to support the war overseas, i just had lunch with the commanding general of 130 -- in kentucky and the senior officers. he would say look this is the first time in 21 years the 101st airborne as nobody deployed overseas, so i think that the veterans are proud of what they did to include the vietnam era we. understand the outcome of these wars as an afghanistan, can be brutal, military power is not the primary solution, but it was a good day for america's veterans day. 18 years of. what would your father, what would your father in law, when my late father who was a world war ii hero veteran like those previous two men i mentioned make of what we have made of our country right about now? >> well, i personally think it is shocking. my wife's dad, assault in the pacific 11th airborne division my dad thigh korean war the chosen reservoir vietnam, i think they would be aghast at what is happening. that generation, what they prize the most were leaders of character. they've been through this terrible dilemma of this complete lack of integrity in our government for years. we have to work our way out of it. we have to somehow dispel the divisiveness. 25% of the country does not believe in the constitution. they don't believe in a free press. it is astonishing turn about. i'm glad my dad did not see this, we have to solve this problem, probably in the next 5 to 10 years. >> to our starting line tonight, on an emotional night samuel stein, and tim miller contributor to the former communications director for jeb bush. gentlemen, good evening to you both. don, i'd like to start with you. -- first new hampshire then detroit michigan. does this mean that he is listening to sean patrick maloney and the dccc, or did someone pass him a pocketbook with a 2022 circle? >> it probably means a little bit of both, brian. first of all it's just revert back to that clip. mitch mcconnell is a bad man. that -- he certainly is savvy enough politician to understand that he will not be photographed at a signing ceremony giving joe biden kamala harris and credit for any substance the victory. -- to not smile and hold joe biden signed that bill. even when he takes credit for having helped pass the bill in a bipartisan act of the united states. democrats had come out and sold this bill preemptively this is certainly a reaction somewhere in political reality it is democratic losses and trying to -- for what potentially could come in 2022. >> tim miller, a few i don't wish it upon you what i just paid the last time i filled up, the inflation is roaring, pretty soon they will have an atm next every gas pumps so people have some cash to be able to afford it. despite all the lofty topics that democrats talk about, is there political precedent for biden's presidency turning on things like christmas presents that cannot be ordered. new cars, god love you if you can afford one, that cannot be ordered because there is no chips to put in them. what we are paying for gas, what we are paying for a pound of bacon. >> yeah, much. don't make me kill you. >> okay just on to gas prices. i think that the hopefully virginia was a wake up call. i think that the changing schedule, tone, urgency in the hill. credit where do you can see some changes in the democrats actions that i think is important because there is a disconnect and we talked about it on this program throughout the summer. fighting over these trillions of dollars a big ticket items like people real life concerns of what they would deal with. i think there was a discussion between biden and washington, what folks were saying at the gas, pump at their schools, at the grocery store. and i live in northern california, and you cannot avoid it. when you see the number five at the station that i drove by today in san francisco, i'm just happy that i don't live in that neighborhood. you know, i think these are real issues, if he's able to snap his fingers and fix them overnight, but it is a political imperative if the senate signaller for the care about this one two and three they will solve these problems for people one two and three. oh by the way, we will tell you all the things that we have been doing that will help. like those 1400 dollar checks that you got, like the child tax credit, that has to be the democrats focus for now all the way through 2022 or at least some of these economic indicators are turning around. >> point to personal privilege the only reason i know you is nicole wallace, so i will put the both of you and still catch death match but leslie for what he said. don, rescue me from this. when advice do you have for the care and feeding of mr. manchin of west virginia? >> it's a lot. i would be in charleston west virginia, -- [inaudible] i will be in every nook cranny town in that state talking to them about why they need to get joe manchin on board. ultimately, joe manchin if he does not respect democratic caucus, if he does not respect the president and vice president of his own party, he will be forced to respect the voters of his own state. if i were kamala harris, if i were joe biden, i would -- who is the best communicator on the democratic party i would be all over west virginia. from west virginia state, two hbcu, to the commonwealth, to the university of west virginia i would be there selling this plan, and telling them why it is good. >> i think the weather. we can google that after. this >> i don't think so. trust me on this. it's [inaudible] >> i'm going to screw this up by thing my favorite bill withers is, who is he, and what is he? >> that's right. >> oh man. it will on, here talk about his new book, monday night. i understand that you're old some words about chris christie. and you would like to share it lisa sentiment with our viewers tonight. >> sure, they can get the full sermon of the bulwark, i googled, it i wasn't so far off, i know a little bit about it. anyway, as far as chris christie is concerned, i guess it's good. that he is attacking donald trump now by just saying the reality that he lost the election. i also don't know if he deserves a standing ovation from cnn and other networks. we they're putting him on the back forcing the obvious in this effort for him to regain the spotlight that he lost. i just think that it's important to remember, a lot of the reason why we are, here is because of chris christie. i welcome him, and part of conversion is acknowledging your own mistakes. and i haven't heard them from chris christie, and back in 2015, when i was working for joe, and after chris christie dropped out of the race. he didn't lay a single glove. will he is the mainstream, he beginning the stamp of approval. and frankly, it was a really influential endorsement. we saw the numbers. a lot of republicans who -- say am i really going to report this game show host as president. i like the things he, says but it seems pretty aware that he could be the president, and all the sudden, you have chris christie. you have people endorsing him and that created a structure for them to vote for. trump so, you know, i get that it's better that you're doing, this going along with the coup. i give him half a cheer for that but before we get on to chris christie ben wagon, i'd actually like to hear from -- because i seem a little conflicted with the coup attempt that you just mentioned. >> don calloway take us down at least figuratively, trump has sent his, what do you call, it his envoy ambassador. and i'm sure was for lack of a coma, because no one down there can spell or right. his envoy ambassador, rick grenell. that is not a thing. and a lot of people pointed out today could very well be a violation of the logan act to the serbia coast evoke border. if true, that would be a felony. fun cocktail party conversation. don, question is why? >> because there are some people who still are tying their future to being a member of this island of misfits, unfortunately, regret now who could've been such a symbol as one of the few openly gay members of the trump campaign, he could've been such a symbol of progress. and continue to jess, by future to this trump world. it doesn't make sense. why particularly in a post glenn youngkin area, in which reasonable republicans or, appearing republicans are willing to do and say the nice things without such dusty language. they could not have been part of the solution. it's unclear why they continued to care why donald trump, other than pure cowardice, rick when all is one of. them i don't give chris christie much props for the mistake that he may because it was not a break, hopefully he got a little judge in. republicans who refused to fully condemn donald, trump are part of the problem. and we need to start calling them out. i can't take us the short version of why this is the outstanding medical miracle of our time? >> sure, brian and i think we're a little close to it to appreciate involved in it for many to appreciate, but yeah. we have to remember that at the beginning of this pandemic, the thought of producing effects seen so quickly within a, year was something that even experts didn't hold hope for. and what is really important to remember, and to understand, is that there was traumatic work done for years. we are talking decades to develop these approaches. so i speak for vaccine hesitancy. i bought into the development, and i want to emphasize that this wasn't it over the, night eureka kind of effect. and it wasn't anything that was sped up unnecessarily, as you suggested, this dramatic work done by really interesting odd almost stubborn scientists, ignored all of the experts and what wisdom would say. mrna weren't coming to work. on and they persisted that there was something that we should even celebrate. >> how do you process the fact that on at least three cable news networks, if we were having the, segment this discussion, huge portions of the audience wouldn't believe a word of it. how do you square your work and this product would be anti vax community, which has only grown. >> i tried to acknowledge the fact that there are some people that are legitimately weary, i think one could, be if one just acknowledge the fact that these are facts about vaccine. 330 days from the time that the sequence revealed to the time that these vaccines were authorized, which is remarkable, and yet you need to learn a little bit about the history and that is kind of why i wrote the book to understand the drama behind the, scene but also the persistence, the innovation, that was required, and frankly it's an american story. it's about immigrants, it's about scientists, it's about entrepreneurs, making a bit when they were told that they couldn't put it. off they persisted, they were resilient over the. you're so it's something that i think both sides of the spectrum could embrace in many ways, or should embrace. >> a quote you have here in the book about albert, what pfizer. already to our audience, burlap was so intent on developing and distributing the teams vaccine quickly that he made a surprising decision. the companies wouldn't ask for help from all spur asian warp speed. berlin didn't want to take money from the government to develop manufacture the pfizer via take shots fearing burke roddick red tape that might slow his team. what was the upshot of that decision? >> so it did help pfizer. that's one of the reasons why pfizer overtook moderna and some of the other competitors in the race. and they were the first. but i do have to be clear that that was a positive for the vaccine company, there were a lot of resources both financial and otherwise. but sometimes it did slow things down as well. the administration could criticize for downplaying the virus, i'm sorry, downplaying the virus and roll out a vaccine, but in terms of operation, there was benefits, and the pfizer folks research that there was work on their, own they did sell the vaccine, and the government doing so, but they persisted in their own research. >> is there, i'm compelled to ask because of how i make my living, is there a television version of this in the works. is there a documentary that holds the story with moving pictures as movingly as you tell it between these two covers? >> nothing is in work right now, but my phone number is easy to fine. if people watching want to reach. up but i do think that is important that people understand, readers, and others that this is something that we need to be appreciative of, if this virus had evolved a couple of years earlier. these approaches were not ready. it took years and, it's fascinating to me that we're, over coming off physicals and we were ready at the beginning of 2000, 20 of the people who are in the science in the labs, all over the country in germany as, well this company biontech we thought they were ready, they thought they had an approach, they weren't sure but it was something that we have to be appreciative, because a few years earlier we may not have been ready so it's really modern-day miracles and a lot of ways. next glut should be those who get themselves unpronounceable
