♪♪ a very good day to all of you from msnbc world head kwaurters in new york. this hour from houston, texas, where eight young people are dead after a music festival turned deadly. now the police are opening a criminal investigation to figure out just what happened. more new video today showing a crowd of 50,000 people pushing toward the front of the stage during rapper travis scott's performance at the astro world festival which he organized and he is now speaking out. >> we're actually working right now to identify the families so we can help assist them through this tough time. you know, my fans, my fans like -- my fans really mean the world to me. and always just really want to leave them with a positive experience. >> msnbc's katie beck is following this story in houston. katie, what are we learning about the investigation? we know the situation is utterly heart breaking. >> reporter: it is. there's a lot of mourning going on here in houston today as victim's names are coming to the surface and as folks are behind me, alex, going back into the venue and trying to retrieve some of the items that maybe when they left in a haste on friday night they left behind. they are just letting in a few at a time to go inside. but we are seeing lots of folks as they go inside drop flowers, drop candles at an outside memorial as well. investigators saying the crux of their investigation right now is focussed on what exactly caused the crowd to surge. why did those swarms of people move forward and eight victims lose their life. that's what they're looking at. they're looking at surveillance video from inside the venue to see exactly what the catalyst for that might have been. another incident they're investigating with ties to this is that a security guard that night said he was stuck with some type of needle in the neck and actually became unconscious and had to be revived by paramedics. they say they're wondering if that was an isolated incident or perhaps there were more victims that could have started a chain effect there within the concert. but concert goers describing the atmosphere, describe a pretty traumatic situation. many unable to breathe. they say they were smashed and pinned. couldn't move their arms and making it very difficult for medics to make the way through the crowd to get to the people once they did go down. here is what one 16-year-old concert goer told us about her experience. >> so we was in the center towards the front of the stage. so we was really close. there was no way out. so the feeling of just people like pressing up against you and all the body heat, it was just like -- that was one of the reasons why i think everyone was passing out because there was so much body heat and so much noise and so much going on. and smoke, blowing in your face and it's just really hard, especially when there's younger kids and everything, people have never experienced anything like that. >> reporter: another concert goer told us that if she had fall on the the ground it would have been for her, which she said a death sentence. that's how sort of dire the situation was there. investigators say it could be a week, even a month before we have direct answer as to what happened here, but they plan to do a robust and independent investigation going over all of the safety protocols should have been adhered to and finding out if they actually were, alex. >> thank you so much. continuing the conversation joining me now is lou, director of the elite agency that's a global security protection and intelligence firm, also a former new york police detective and host of the podcast "between the lines." lou, big welcome to you. this is a terrible story. i want to play for you an incident that took place during the astro world event. here it is. >> we do have a report of a security officer, according to the medical staff, that was out and treated him last night, that he was reaching over to restrain or grab a citizen and he felt a prick in his neck. when he was examined, he went unconscious, they administered narcan. he was revived and the medical staff did notice a prick that was similar to a prick that you would get if somebody is trying to inject -- >> i mean, what the -- have you ever heard of something like this? >> i have to be honest, this is a new one for me. i mean, i've experienced a lot in coordinating events and crowd management. this is the first time i heard of an episode of this nature. and everybody should sit up and take notice because this might not be the end of this type of activity. you know, we've had incidents in new york, for example, with people randomly punching people in the street, trying to knock them out. well, this may be what we're now doing at concerts, injecting them withcontrolled substances that could cause their death. they have to look at what transpired. the good news is they apparently have video of the concert as you and i both know. and they can maybe focus in and see exactly who was in the crowd that they might recognize from having a criminal past or involvement in narcotics. and may have participated in that event in particular. >> that's a really good point you make. and of course, catie beck, our reporter on scene said this will take several weeks, a month because of the size of the crowd and trying to go through all that kind of video. but earlier in the day, lou, the astro festival, multiple rushing through a vip, they were ignoring the security staff. we heard from that concert goer right before coming to you, she was in the center of that crowd. she described there being, quote, no way out. does it seem to you, lou, like this event was properly secured? >> absolutely not. as i mentioned to you, i've been doing this for over three decades. i ran a security for the academy awards in the early '90s around the iraqi conflict. i ran the golden globe for 14 years, nascar. >> you're legit for sure. >> i would be very candid with you, something similar to this was with "good morning america" that they would stage in the summer during fridays. and we dealt with very large crowds, for example, like with the jonas brothers. what i could tell based on what i'm able to observe from tapes is that there was absolutely no mechanism, no method to the madness there. normally when you introduce large numbers of crowds like this, you would put them in pens with emergency lanes in the event you had to admit emergency services, disorderly person or if you had a medical emergency. none of that was present. but i want to mention something to you that's highly, highly important, this event took place on astro world, right? the fire department should have intimately involved to identify exactly what the battle plan was here and apparently they did not. now, i do want to mention the amount of help i received both from the beverly hills fire department and los angeles fire department who were intimately involved in the planning and staging of my events. they wanted to know what was going to be done, where it was going to be done and how it was going to be done. if you deviated from the plans submitted to these agencies, they shut you down. now, as i mentioned earlier, i ran these concerts in the park for "good morning america" started actually at gramercy park and later moving to the back of the new york public library on 42nd street for more than a decade without incident. we controlled how the crowd was introduced into the space. we then put them in pens so that we could regulate the number of people and give people breathing room. in addition something that people might find interesting, we layered across the stage when necessary adequate security personnel. we use what they call, concert barricades which have a lip on the bottom that you stand on so they can't be pushed over. >> okay, lou -- >> i'm so sorry. i didn't hear you. >> you're a total pro. i want to say the houston mayor said they had a number -- greater presence by police and private security than they have at world series games. so what you're saying is it's a lot more than just numbers to get it right. >> you have to know what you're doing. you know, i have to tell you something interesting, the great teaching ground is the new york city police department. if you look at any event that they stage, for example, at thanksgiving day parade, st. patrick's day, there's always a mechanism as to how to crowd manage, how to introduce emergency services. i will tell you -- >> so preparation. >> nothing was present here. >> yeah. all right, lou, unfortunately i'm well out of time. but thank you for the really comprehensive assessmented of things and perhaps i'll you back as this investigation unfolds. thank you. let's go to the day's other major headlines developing this hour. president biden celebrating historic $1 trillion infrastructure bill but there's still plenty of work ahead for the democrats when it comes to the president's agenda. as congress looks next to pass a major social spending package, the administration today is confident the party will come together and get it done. ♪♪ >> we think the framework we laid out has 50 votes in the senate. we think that it is popular in the house. and we're going to continue to work to get it there. look, we know we have some senators who are a little more conservative than others and we're going to keep working with them and we're going to keep pushing, but we think we have a framework that can get passed. >> meanwhile, new reaction from the white house today over a challenge to its vaccine requirement for private companies. a company appeals court issued a stay this weekend, freezing vaccine mandates for large businesses with at least 100 employees. earlier today, white house chief of staff ron klain told nbc news he believes this will be fully litigated in their favor before it is set to take effect in january. >> i'm quite confident that when this finally gets fullied a jute kated not just a temporary order, the validity of this requirement will be upheld. it's common sense, chuck, osha can tell people to wear hard hat on the job, be careful with chemicals can put in place these simple measures to keep our workers safe. vice chair of the january 6th committee a strong rebook to her own party. congresswoman liz cheney push back that the attack on the capitol was a false flag operation. >> so same kind of thing that you hear from people who say that 9/11 was an inside job, for example. it is -- it's un-american to be spreading those kinds of lies. and they are lies. and we have an obligation that goes beyond partisanship and obligation that we share democrats and republicans together, to make sure that we understand every single piece of the facts about what happened that day and to make sure the people who did it are held accountable. >> and joining us now nbc's heidi przybyla at the white house. heidi, is the white house confident they will have the votes to pass the second part of biden's economic plan? >> reporter: yeah, alex. the president is not publicly saying whether he has ironclad assurances from the key members in both chambers. it was a blow to house progressives who long wanted these two pieces of legislation to move together. the president is saying time will tell if he can keep some of the more popular provisions, like paid family leave. but here is the thing, the only reason this infrastructure bill was able to move was because they got enough progressives to believe them that they would get the second part of this agenda done. by them i mean, house moderates, pramila jayapal said that she did get assurances from at least five moderates that as long as a budgetary analysis checks out, that may take a couple weeks that this bill would be passed. here is cedrik richmond, a white house senior adviser earlier today expressing some of that confidence. >> many people didn't think we could get to 50 votes on the american rescue plan because it was $1.7 trillion. many people didn't think we could do a bipartisan infrastructure bill. so, things are noisy, but we get things done. and we're confident that we can get the party united around a piece of legislation. this comes from months of talking to all parties involved. so the framework that the president laid out, he believes has the ability to get 50 votes in the senate and pass the house at the same time. >> reporter: so alex, while there was a procedural vote on this second piece of soft infrastructure legislation, we do expect it to be delayed for several weeks while they wait for that independent budgetary analysis to come back. in the senate, the fate seems a little more uncertain with senators manchin and sinema wielding outsized influence given we don't expect any republicans to support this, alex. >> okay. we'll go there from gary on capitol hill. thanks, heidi. gary, so what's the timeline for getting the build back better act passed on to the president's desk. we should say there are a couple hurdles first. >> reporter: hey, alex. yes, this is a human infrastructure part of things. we're talking about money going towards childcare and paid family leave and provisions towards the environment. that sort of thing. so let me take you through schoolhouse rock style what this is going to mean. we're going to be getting a full vote from the house the week of november 15th. then it will go to the senate for the parliamentarian to look at it and make sure it's following all of the senate rules. then the full senate will vote on it. then it comes back to the house for a full vote in the house before going to the president's desk. but none of this can happen before november 15th because congress is out of town and none can happen as heidi was mentionings without the full support of senators joe manchin and kyrsten sinema. i want to have you listen to representative sherry about what she said about the negotiations today. >> there's no doubt that there will be some changes coming up between now and november 15th. but we have made a decision as house democrats that we are going to send over a package to the senate and obviously they will make some changes. they'll have to send it back to us where we'll -- where that's what we're going to have to accept and make some vote for that when it's all said and done and send it over to the president. there will be negotiations. we will not get everything we want. but that is the essence of what being a legislature is all about. >> reporter: now, this is not the only thing on congress's agenda. they have to raise the debt ceiling, fund the government and renew the ndaa all before they leave on december 13th. alex? "the new york times" reporting the fbi saturday searched the home of james o'keefe, the founder of project veratas a conservative outfit that makes undercover videos of democratic groups and operatives. joining me on the phone, michael schmidt, washington correspondent who covers federal investigations and is part of this most recent story. michael, welcome to you. for those who don't know the story, give us the background because this theft of ashry biden's diary happened last year and now it is making headlines. >> so the federal prosecutors in manhattan are examining the question of how this diary was stolen. and what happens is that on thursday they executed search warrants at the location of two individuals with ties to the group. in response to that, the group's founder, james o'keefe, put out a video in which he got into detail about the group's involvement in this diary, saying that they had been journalists and that they had not disclosed the contents of it. but hours after he did that on saturday morning, federal authorities executed a search warrant at his home. and we don't know what was taken, but we know that it was the latest sort of escalation by the prosecutors in this on going investigation. >> yeah. it's pretty extraordinary as i was reading your article, it was something along the lines of fbi warrant opened up at 6:00 a.m. on saturday morning. but can you just explain to our viewers, please, because they may not be familiar with james o'keefe and project veritas. what is this group? and how would they have gotten their hands on ashley biden's diary? why this group? and do you know if whether or not they paid for it? >> so this is a group that is dedicated itself to conducting sting operations to expose what they believe is liberal bias in the media. and intellectual dishonesty and shortcomings of the left. they are trying to expose anything they can about -- do that in tactics that many would say are underhanded by posing as people that they claim that they're not, by using -- this group has attracted a lot of attention because donald trump has praised the group. now, this group has attracted a lot of attention because of that because people see them as bad faith actors in this process. and the question here, how did they -- what role did they play in making sure that this diary or having this diary or what role did they play in the disclosure of this diary, which became public just days before the 2020 election? >> yeah. you mentioned the video that james o'keefe put out. we're going to play a little of it right now with our viewers, so take a look, everybody. >> at the end of the day, we made the ethical decision that because in part we could not determine if the diary was real, if the diary, in fact, belonged to ashley biden, or if the contents of the diary occurred, we could not publish the diary in any part thereof. >> so michael, i'm not asking you to reveal, even if you know, what's in that diary because that should remain private. but why would thieves target her diary? did they even know that she had one because it seems a little bit inexplicable and are the thooefs in custody and can you confirm ashley biden was a target and not just a random victim? >> so there's a lot about this that we don't know. we're in the early stages of this. the first story we wrote about this was on thursday right after the search warrants were executed. we wrote about it on friday. the -- what we do know is that ashley biden was burglarized in 2020. items of hers were taken. we don't know the extent of all the items that were taken. we do know that in october of 2020, as right before the elections, it was reported to federal authorities. an investigation began. that investigation began. that investigation continued. and federal investigators thought they had enough information, enough evidence, to secure warrants to execute them at the location of these individuals, including james o'keefe which is a fairly high bar to clear to do that, to the justice department knew in doing this they would be attracting a lot of attention and a lot of scrutiny. they had to have enough evidence to convince a judge to let them move forward. >> yeah. last quick question here, would this be an fbi investigation if it weren't the daughter of the president? >> many black voters have said that we voted in huge numbers in 2020 to elect the president. and if you recall, alex, he said on the night of his victory that black voters had my back and i will have your back. and we've not seen the voting rights protection acts go forward. we've seen both the john lewis advancement act not even get a procedural vote just this past week. we saw the act of the freedom to vote act not get a procedural vote about ten days, two weeks ago. we've not seen the george floyd jefferson policing act advance. so things that were the real impetus for this huge voter turnout has not happened. now, the one thing that is some light, there are certainly things that will help the black community directly out of the bill that was just passed the day before yesterday. now, the night before yesterday. where black farmers in the infrastructure bill, there is the commitment that they're going to go into areas, disadvantage areas which are majority black, majority of those areas are areas that blacks live in. so we will benefit from the infrastructure bill. but again, there's the concern about voter protection. there's the concern about police reform. none of which has been able to even move forward for a debate. when you can't pass a procedural vote, they're saying they won't even discuss it or debate it, which is the epitome of an insult to many black voters. >> rev, totally agree with you. but when you look at the they you just referenced, how much is that joe biden versus mitch mcconnell or kevin mccarthy? it's the republicans who are really putting their foot down and opposing it vehemently. so is there not an ability to distinguish between the president and those opposing republicans? >> first of all, there's no question mitch mcconnell and kevin mccarthy, but i think what the white house must do is come out and aggressively champion these bills even more by saying they're willing to see a carve out. if they had come out and if they still come out and say that we would support a carve out to the filibuster on voting, a carve out to the filibuster on voting, which is basic because we've seen carve outs over 160 times around judicial nominations, around budgetary concerns. why wouldn't we have a carve out on something as basic as the protection of the right to vote in our democracy. if they had taken that stand, i think it would help make it very clear that the president can't do any more than that, that it's all on mcconnell and mccarthy. but by not saying that in that silence, he's given some -- even if it's unfairly some blame for it. >> look, this is top of mind in many ways, including in part of my conversation yesterday with senator ben cardin, we addressed this. take a look to what he had to say. >> senator corner is correct. it's time that we get rid of the filibuster, particularly as it relates to constitutional issues such as a person's right to vote. we would hope that the republicans would join us in this bill. but they won't even vote to allow us to debate the issue. so, we have to look at ways in which we can protect the rights of the people of this country to the fundamental principles of democracy and that is the right to vote. >> so what is the solution to getting this done? >> the solution is for the senate, with the support of the white house, to come with a carve out. i would hope they would get rid of the filibuster period, but the least they can do is a carve out. we cannot end this year without having voter protection bills enacted and legislated. those of us in the civil rights community will fight for that in the streets and in any other medium we can because there's nothing more fundamental than protecting the right to vote. let me say this, alex, it's not only the right thing to do for the white house and for the democrats, it is their only way they will survive the mid term elections. because if people have impediments to vote, how can you turn out if there are impediments there to prevent you from voting. >> i hope democrats are listening. you, rev, are preaching on this sunday. preaching the absolute truth and the gospel regarding voting rights. thank you so much, my friend. we'll see you later on just about three and a half hours on tv. thank you. >> thank you. she entered congress at one of the most consequential times on capitol hill. the newly-minted congresswoman and the challenges she faces amid this heated political climate. ated political climate. as someone who resembles someone else, i appreciate that liberty mutual knows everyone's unique. that's why they customize your car insurance, so you only pay for what you need. >> well, thank you, first of all for having me. excellent choice in your producer. >> it is. >> where i see myself is where i've always seen myself as a public servant to all. when you get elected to congress, you don't get to decide who you represent. you represent all of the people in your district. and so it has been a privilege and an exciting time for me to come into the halls of congress during an opportunity to pass such historic legislation that will benefit not only moderates and progressives but republicans and all the people who are in the 11th congressional district as well as across the country. >> yeah. i love your energy and your positive nature. but you're going to get to some place where there are a lot of sharks and other ways to describe them as well. so this country with facing a lot of issues, whether it's the economy, whether it's abortion, climate change, voting rights, education, covid, i mean, your gauge is what on the issues that are most important to your constituents and what do you hope to focus on during your time on the hill? >> well, again, i think that the ability to be able to pass historic legislation that has actually been in the works for years, i would like to take credit for getting them in two days but the reality is a lot of folks have been working hard on getting this done, especially i like to acknowledge the congressional black caucus who has a very close pulse on the issues that are plaguing our society. you touched on many of them. some of the things that this bill actually addresses, many of those issues around our infrastructure. i mean, being able to make historic investments to address the crumbling roads, railways and bridges that we've all been living with for the last few decades is critical. and it will not only help improve our infrastructure but it's going to provide tons and tons of jobs. jobs our economy are at the heart of the issues of the people in the 11th congressional district. prior to the pandemic and even after the pandemic, the reality is that the district that i represent is one that has been known as one of the poorest big cities in the nation. so when we talk about billions of dollars being invested to deal with some of the roads and bridges and we talk about billions of dollars being invested into public transportation, that can turn and change the tide for so many people here, not only in my district but across the country. so jobs, as well as healthcare, which is a topping i think that we will deal with in our next bill, but justice. we talk about dealing with equity and inclusion and the fact that there have been thoughtful considerations to make investments specifically for small businesses and minority businesses with these huge infrastructure packages that we just passed, that is going to be very important to the people that i represent. so, again, i couldn't be more excited to come at a time when we're able to make some real substantive changes to things that we've been dealing with for decades. >> yeah. i'm going to add to that list of infrastructure, given the working population, the internet will be improved, access for everybody. that kind of thing will be so helpful particularly in all this remote working that we're dealing with right now. let me ask you, though, again the parts of cleveland, ohio, which you represent. this week cleveland elected justin bibb as mayor. one of his major campaign promises was police reform. do you support his goals and what's your take away from his victory? >> shout out to justin bibb. i think what we are recognizing and seeing and realizing in our particular area is the desire for change. new energy and so he brings that. his stance is one that i understand the position that he has taken as it relates to issue 24 is what passed here in cleveland. it passed along the same margins as his race and victory to become mayor elected. he and i share very similar values and i've had an opportunity to work with him prior to him becoming an elected official. so i think that we will work well together. i think that there are some opportunity to provide again some real positive change. what that looks like is a change in perhaps community policing. making sure that our police services and police officers have the critical racial, implicit bias training that i think will make them better officers. so it wasn't a defunding the police initiative as i understood it. what it really does is focuses on strengthening our police force and making sure that we're really hearing the voices of the citizens so we can provide safer communities. so, i look forward to working with mayor elect bibb. i think again, this is demonstrative of a changing tide in leadership in our community. and it's an exciting time for me. i'm sure he is equally excited to be able to join the ranks of elected officials to be able to make a real difference for the people who are trying to make decisions on their behalf, alex. >> i am again, offering our congratulations and a big welcome and look forward to following your work and continue to welcome you on the show, too. take care. good luck. it was an accidental moment in history that became a viral sensation. two journalists who witnessed rudy giuliani's press conference at the philadelphia landscaping company join me to talk about what it was like to be there. ♪ there are beautiful ideas that remain in the dark. but with our new multi-cloud experience, you have the flexibility you need to unveil them to the world. ♪ ever notice how stiff clothes can feel rough on your skin? all of them? oh, my goodness, all the networks. >> rudy giuliani outside of a philadelphia landscaping company pushing unsubstantiated allegations on behalf of donald trump. the business owner and staff are now the focus of a new msnbc film called "four seasons total documentary." let's bring in two journalists who witnessed this very accidental moment in history, i'm glad to have you both here. olympia, take me back to november 7th, 2020. what did you think when you saw the backdrop for this press conference, a landscaping company that wasn't all cleaned up with a bunch of flowers and plants and everything outside of it. look at it. it was just a working environment. >> hey, alex, thanks for having me on. yeah, it was confusing, i think, to stay the least. we got back there, and we've been in our fair share of ballrooms, firehouses, convention centers. and this was none of that. we were in the loading dock, basically, of this landscaping company, with some posters on a garage door. just trying to make the best of it at the time. we all thought we were there by mistake. we saw the trump posters, and said, okay, we're in the right place, but we thought somebody made a mistake for sure. >> richard, you wrote, the trump presidency ended in the parking lot of a landscaping company next to an adult bookbookstore. there's where rudy giuliani found out that joe biden was projected the winner of the presidential election. but what else stood out to you that day? >> the whole thing was just very memorable. it was so surreal. it felt like a mistake, a fever dream. it was almost too much to take in. it was so cinematic, almost how the two sides were shouting at each other across the road. and when the results were called, a girl ran to the middle of the road and did a backflip. >> and olympia, the documentary is airing on msnbc, and it explains the business' point of view. >> i never had to deal with that level of hate. hundreds and hundreds of emails. i just got basically, saying to go "f" yourself, going to burn down your building. it created a lot of fear of what the future holds for four seasons total landscaping. >> that was the director of operations at that company. that business got a lot of backlash for hosting that event. why is it important for the business to tell its side of the story now? >> honestly, there was so much speculation afterwards, why were we there? were the big donors active in a trump campaign, in any campaign? after that, having run with the meme was very smart. but putting out their side of the story. what was surprising to me is that they were in total control of it. they had been vetted. it made sense. they were an easy place, right off of i-95. logistically, it made sense. and they said, we were in on it. we didn't know it would be this out of control. >> richard, what have you learned since this became an internet sensation?
