injected people with drugs, so i want to check all that. and president biden will speak in just a few hours to celebrate a big win for his party, the house passing the $1.2 trillion bipartisan infrastructure bill late latest night, and clearing major hurdles to move forward with the build back better act. >> hey, everybody, so tonight we've reached a really important deal for the country, and that is that we will move the bipartisan infrastructure bill forward, and in just two weeks that bill will pass the house with the commitment of our colleagues. the reality is, this is too important for our country. we need to get both bills done. green bay packers' quarterback aaron rodgers will miss tomorrow nights game due to covid and things are swirling. we'll bring you new comments from the league. good morning. it's saturday, november 6th. i'm lindsey reiser. >> and we're here at world headquarters in new york. we do have a team of correspondents and analysts following the latest for you. it's turning out to be a busy morning on this saturday. >> we're going to start with the breaking news in texas where eight people are dead, dozen more hurt at the festival. there were about 50,000 people there. it's a huge event. you can see the crowd in this video before the panic started, and police say around 9:15 central time, the crowd starjed to surge toward the stage. >> right now investigators are still trying to find the answers to a lot of questions. they held a press conference just a couple of hours ago. >> our hearts are broken. people go to these convenience looking for a good time, a chance to unwind, to make memories. it's not the kind of event you go to where you expect to find out fatalities. >> let's go to raf sanchez for the very latest. good morning to you. what do you know? >> lindsey, good morning. this was supposed to be a night of music and fun and raising money for charity and instead it ended in deadly chaos. as you said, around 9:15 p.m. last night local time in texas, that crowd of some 50,000 people there to see headline rapper travis scott started surging toward the stage. authorities declaring a mass casualty event some 20 minutes later. eight people so far have been killed, but 17 more taken to hospital, 11 of them suffering cardiac arrest. authorities treated some 300 people there at the scene. this was a chaotic, deadly, late-night event, and there were some unsettling warning signs earlier in the day. hundreds of people just surging past security trying to get into this sold out festival. you saw concert-goers just pushing past metal detectors, jumping over each other, trying to get through. a number of people were injured in that earlier incident, but the concert did go ahead. police say they're going to investigate all avenues here to figure out exactly what happened. there have been some unconfirmed reports of people taking drugs in the crowd. it's not at all clear if that would have affected what happened. have not yet heard from the festival's organizers about what happened last night. travis scott was the one that was actually organizing this event. it was supposed to happen last year but was canceled due to covid. last night was supposed to be the first day of a two-day event. the whole purpose was to raise money for travis jac's youth charity, the cactus jack group. now it's a crime scene and authorities are trying to figure out what happened here. >> yeah, the video was from earlier in the day when there was literally a stampede as people started to make their way into the concert, knocking over some fencing and knocking over the metal detectors that were there. it just went on from that point. we're going to leave raf sanchez right there with the very latest. thank you. joining us in the meantime is shaun bess set who actually attended the concert. we're glad you're physically okay. thank you for joining us. >> thank you. >> where were you when it all happened? >> i was toward the middle back because i didn't want to be toward the front. >> and what did you see and hear? >> during the time i didn't know what was happening at the front. back where i was, it was a lot more calm, but toward the front, i knew it was a lot more compressed. i tried to stay back and away from it. >> talk to us a little bit about what you knew at the time and then what you learned afterward when you and your friend ended up getting a ride home. did you stay until essentially the concert ended because of what was happening and then you didn't find out until later real damage here? >> yes. we left. the performance ensed. i didn't know anything was wrong. we went and got food and got a lift back to our hotel, and on the way back to our hotel, i was on social media, and i started seeing headlines and reports of people passing away from the festival, and that's when it all started to hit. >> sean, from my understanding, there was a countdown clock. many people believe it was at that point there was a rush to the front of the stage. at the point, travis scott performed. drake appeared. he performed for some 75 minutes. but during that performance, i am told he stopped several times to try to get control of the crowd. >> yes. travis paused several times when he noticed people passing out and asked security to get them out of the crowd and get them help, but at that point it was out of control and the crowd was too big. >> what can you tell us, sean, about the nature of these types of events. we know travis scott, he's very fond of the houston area and astro world was a six flags park that was closing and he ended up bringing it back to life. 21 savage, earth wind and fire. what can you tell us? earlier in the days when the doors opened, there was one security guard and it took moments for cops on horseback to try to come and control this area. do you feel -- even though the sheriff's office says there were hundreds on the scene, did you feel safe? what can you tell us about these events? >> these events are often aggressive. no exception today. that's for how they are. with cops at the side, it felt like resources were limited and there wasn't enough to manage the crowd there. i personally felt fairly safe, but looking back, there weren't enough resources on the side. >> i want to ask you about something they said in a press conference earlier. they're looking into the possibility that people may have been injected by drugs or drug use may have been a factor in all of this. did you hear of anything like that while there. >> i heard rumors but did not observe anything directly. >> we're going to leave it there. appreciate the time and appreciate that you were able to make it out of that scene. what a terrible thing it is. sean bessette, thank you. we have more breaking news out of washington, d.c. it's finally happened. infrastructure. $1 trillion for our nation's infrastructure, just one presidential signature away from becoming law. >> we have been talking about it for weeks, for months. the moment is finally here. after marathon negotiations on the hill, house democrats feej finally got the bill over the line last night. >> motion is adopted. >> so what's in it? universal broadband internet access, repairing roads and bridges, eliminating lead? pipes and water. >> former missouri and our colleague clair mccass kin points out, after all thee years, don't look now. it is infrastructure week for sure. good morning to both of you. is this the win the white house has been waiting for? >> absolutely. think back to when the president first announced this plan and gave his address to congress? it's been a long and bumpy journey to get here, but we are here. i think it's important to put into context why this is happening now. on tuesday night we saw the off-cycle elections, and it was a disappointing night for democrats. they lost to virginia, and it was incredibly close to new jersey. i think the white house and democratic party at large had to confront the fact they could be governing in the second half of president biden's term without the majorities in the house and senate, so that really amped up the pressure that the president felt to get this across the finish line. president biden throughout the past few months has kind of kept his cards close to the sleeve. we heard from both him and the white house on a number of occasions yesterday that he was making phone calls, having conversations with both moderates and progressives. even later in the evening, he was in the residence making arguments in phone calls. i'm here in rehoboth, delaware, but we did hear from him in a written statement. he called last night's bill a mmentous moment for the people. he has viewed the bill as a legacy-defining moment for his administration. when we hear from him in just a few hours, i expect him to continue echoing a similar message. >> the elephant in the room is still the build back better agenda. right now what's next for them? the framework right now, do you expect that to be what sticks? >> yes, i do. you know, there's been a lot of negotiations to get us to this point. i'm confident we're going to get this through. >> how important was it for democrats to come here, to come together and show that they can get something done? i mean for example we're going to show you a tweet here. we all remember terry mcauliffe. he's the democrat who lost the race for governor tuesday night, and he liked this tweet from punch bowl's jake sherman talking about the infrastructure vote was set. did you guys fold your hands a little bit by not getting this dub sooner? >> this is democracy. we're democrats. we don't all agree on every single thing. this is what it's about. we can discuss it. we don't have to fall in lockstep. we can have agreements or different ways to get to the end, but we get to the end, and that's the most important thing. >> you did get some 1,300 republicans to vote with you. some did not, including alexandria ocasio-cortez and a few others in the progressive caucus, but does this give you hope for bipartisanship on the hill? >> you know, we work together a lot more than people think we do. i say that all the time, but i know republicans say that also. if you look at bills that come out of committees, a lot of them are bipartisan, but hopefully this is a first step. the infrastructure bill came to us in a bipartisan way also. we do work together more than people think. >> congressman, on that note, what do you want voters to take away from this. democrats got a lot of heat for the way the sausage was made. it was a necessary and transparent process, but, really, the republicans were, by and large, not involved. when voters are thinking about the midterms and what party they want to have control of next year, what do you hope they take away from this process? >> i hope they take away that we give room for people to disagree, but, also, all of us come together at the end to get things done. again, we're all democrats, but we don't have to agree always. the bottom line is we're getting things done. people will have resources in their district, more health care, child care, roads, bridges, broadband. that's the bottom line. i think the public will be happy with that. >> will you make your november 15th deadline? [doorbell rings] lifesaver! you're weird, man. to each his own. ladies and gentlemen, at this point in time, mr. arbery is under attack. by all three of these men. he's under attack. >> and it's about your duty and responsibility as jurors. the state talked about based on assumptions. i'm going to talk about facts, facts in this case. >> day one of the murder trial for the three men charged with killing ahmaud arbery beginning under a cloud of controversy over the makeup of the jury. arbery was shot and killed last year in brunswick, georgia, while jogging down the street. his accused killers, three white men, one a former police officer, have pleaded not guilty to charges of murder, aggravated assault, and criminal attempt to commit false imprisonment. >> one black man was seated on the jury after defense struck down 11 of the 12 remaining black jurors from the pool. nbc correspondent liz mclaughlin is joining us right now from brunswick, georgia, about an hour from savannah, with the very latest on this case. liz, good morning to you. >> reporter: good morning. certainly an i motional and action-packed start to this racially charged trial, the prosecution and defense painting polar opposite pictures of the kill of ahmaud arbery, saying that the three were justified, that they acted legally when they attempted to pursue ahmaud arbery, that they detained him until police arrived and mcmichael fatally killing him with that shotgun was self-defense, the prosecution saying this was the result of reckless driveway decisions, they were making assumptions and assuming the worst about arbery when he was jogging unarmed in the suburban neighborhood and showing that video that's been widely passed around, that moment when travis mcmichael shot ahmaud arbery three times, and that video was shown in the courtroom where his mother wanda cooper-jones saw it for the first time. here's what she had to say about that emotional moment. >> i decided to remain in there so i could get familiar with what happened with ahmaud's life. i avoided the video for the last 18 months, but i decided to see what happened to ahmaud. i'm glad i was able to stay strong and stay in there. >> reporter: certainly a tough moment and lots of emotion in the courtroom. testimony started with the first person that tested was william duggan. they showed dash miami and body cam video that showed travis mcmichaels covered in arbery's blood and deceased arbery on the ground. so this jury really has some graphic imagery and strong language from defendants that will be noodling in their mind this wecht before court convenes at 9:00 a.m. on monday. >> there was an audible sigh that could be heard in the courtroom when that video played out showing ahmaud arbery being shot. what can we expect next in the trial? >> reporter: it's certainly going to be a tough and painstaking trial for the world, i think, to unfold. they told juries that it would take about a month for this to all play out, and we also will see a federal hate crime trial in february of 2022. >> all right. liz mclaughlin joining us from brunswick, a rainy brunswick, georgia, morning. thank you so much. let's bring in former prosecutor and former maryland assistant attorney general debbie hynes. thank you so much for being here. what are your thoughts, i'm curious, in particularly on the makeup of this jury. >> the makeup of the jury is really quite troubling. there's only one black person on the jury. most troubling to me is the eight others who were seated on the jury. what they said is, no, you cannot do this. you cannot racially exclude jurors, and they were correct on that, but what the judge said was, oh, it was intentional discrimination. those were his words. it's intentional discrimination, but i'm going to let it go. that's so totally what the supreme court said you cannot do. i think what this shows is the judge is almost flipping over backward to accommodate them. it's just really always in these cases an uphill batter, but unfortunately that's where we are in this climate right now. >> is that -- intentional discrimination, is that routine for many trials? i've never heard of such a thing. >> well, what happens is -- and this can happen in any case. either side can say what's called a batson challenge. it's an abbreviation for a supreme court case. what it's saying is the other party, in this case, the defense, is trying to exclude a juror based on race, and yo cannot do that under the supreme court, which is the law everywhere. so the way the batson challenge should have played out n this case t prosecution makes it clear i am saying you are excluding these eight jurors solely for the reason they're black based on race, and then the other side would say, no, no, no, this is the reason, and it flips back to the prosecution where they say, oh, this is a ruse. you're saying that based on the fact they're black. it's because of their race. and then the judge decides. when the judge says it's intentional discame nation, that's the very thing the supreme court is trying to avoid, in this case excluding black jurors based on race. there's no other way to spin it other than it's incorrect. >> this will give us a sense whether or not the judge is colorblind. the first week of the kyle rittenhouse also wrapped up. it also has a mostly white jury, and the judge had to dismiss a juror after he made a comment about another individual shot by the police, jacob blake. how do you explain that in. >> when you have a mostly all white jury, they don't bode well in a lashl charged case such as the kyle rittenhouse case. even though the victims in the kyle rittenhouse case were white, they were there protesting black lives matter. in this case it's doubly troubling because what you have is the judge saying to the prosecution you cannot call the victims victims, which is exactly what they are, but you can call the victims rooters, violators, et cetera. you can call them centimeters but you can't call them rioters. when we see these cases play out, it's a problem. >> we appreciate your analysis. coming up, some expert say combatting covid, it's the biggest step in handling the pandemic, but could it send the wrong mench? what does this mean for the makeup of the school board now? >> well, at this point, candidates who campaigned on a platform against, as you put it, critical race theory have a 4-3 majority. any hope of passing the diversity plan is over and now the board will be able to implement their agenda throughout the district. >> so we know how a lot of adults in southlake feel. what about the students, the kids, how do they feel? >> the few students that i've talked to have been campaigning for this plan, and for more radical changes, frankly. they're disappointed. some of the recent graduates are really heartbroken. but it's also not super surprising. this is a community that in 2020, two-thirds of voters voted for donald trump. what we saw on -- in tuesday's election is not just in southlake, but across the country, what this fight over what conservatives are calling critical race theory has done is it's taken the national partisan divide, and focused it down onto local non-partisan school board races. and so, you know, this candidate won with about 65% of the vote, same margin that donald trump won. and so it wasn't really surprising that this was the result. >> but mike, when we're talking about critical race theory and we're talking about this diversity plan that southlake wanted to implement are we talking about two different things? >> yeah, this is what's really challenging for voters, and for frankly journalists who are covering this issue, because critical race theory, as we know, is this academic approach to studying racism and in the way it's invented in policies, in systems. and what parents and conservative groups are speaking out against here are diversity plans that focus on race. they are focused on -- they're against history books or history lessons that re-examine america's legacy of racism and what it means today. they're opposed to books that center stories on transgender or lgbtq students. these are all things conservatives have misbranded under the label of critical race theory as part of a marketing and branding strategy. but they're -- it's not enough to just say that, oh, critical race theory is not taught in schools so this isn't a real issue. these groups are complaining about real things, it's just not critical race theory. >> mike, it worked clearly in southlake but in another state like activists tried to oust incumbents on the school board and were unsuccessful. these were specific instances, one community where it worked and one where it didn't. what should we take away on a broader scale? >> broadly we should be careful about saying whether this is a good strat or not. this issue drives huge turnout in what are usually sleepy school board races, that's for conservatives and progressives, you mentioned connecticut, and other left leaning suburbs where this issue has embroiled. the progressive voters came out in force also to beat back the anti-critical race theory campaign. we know this is a motivating issue but do we know it's going to have a big sweeping impact or be a good strategy for republicans going forward. i don't think tuesday makes that clear. what's clear is republicans believe it is a winning strategy and we're going to hear more about this. >> we saw that in virginia. glenn youngkin brought it into his campaign. mike, we'll leave it there for you, but thanks so much. good to see you. >> thank you. and you do get a sense that so many republicans will be using that same youngkin playbook for the 2022. >> certainly. >> midterms and we'll be hearing a lot about this. >> i'm sure mike will get tired of hearing or voices on saturday and sunday mornings. >> no doubt. we begin a new hour of msnbc right now. ♪♪ this new hour begins with breaking news overnight on msnbc, concert chaos, at least eight people dead amid a crush at a music festival in houston. how could this have happened?
