to-toss-up ahead of tuesday's election and the stalling of the president's signature infrastructure plan has denied democrats a signature legislative win to run on. that may also change on tuesday as a house vote on, both, the physical and social infrastructure bills is planned, yet again. another ambitious target after weeks of disunity between democrats. and president biden wrapping up a news conference just a short time ago. ending the g20 summit and before heading to scotland for tomorrow's crucial global climate summit in glasgow. of course, watching all of this are the black voters who helped to give those democrats their majorities in congress. many, wondering where the political capital they gave the president has gone to as federal voter protections have yet to materialize. but voter restrictions have popped up like ghosts in every state. happy halloween, by the way. with me now is congressman adam schiff, democrat of california. he is the chair of the intelligence committee and the author of a brand new book, "midnight in washington." congressman, let -- let's start with the story that is unfolding as we speak. nbc news is reporting that house democratic leaders have told lawmakers they hope to vote on president biden's build back better and infrastructure bills on tuesday. what are you hearing? and are you confident that both bills have the votes to pass? >> i'm hearing that we will vote on tuesday. and i fully believe we do have the votes to pass both measures and when you consider those two bills, along with the rescue plan we've passed earlier in the year, it will be an enormous accomplishment. really, akin to the investment we made to the american people in the new deal so i think the votes are there. we needed unanimity even close to unanimity was not enough when you have a 50-50 senate but i think we're there so we are going to have good news to deliver to the country on tuesday. >> well, if they do, it is a huge social statement in terms of dealing with the social setting that we all deal with. it would be huge. probably new-deal level. and we need to do voting rights right around the same time. but let me go to another issue. court filings revealed this week that former-president trump tried, unsuccessfully, to block the january 6th committee's access to 700 pages of notes and correspondence from his aides and top advisers related to the capitol insurrection. your new book titled "midnight in washington, how we almost lost our democracy and still could," details that dark day in our history and the warning signs you saw throughout president trump's term that he was a wannabe autocrat. are there any new details emerging about trump's anti-democratic tendencies that surprises you? >> well, what i wanted to really write about in the book, reverend, is there was a lot written about what happened inside the trump white house but not much written about what was happening inside the congress and the reality is that donald trump could not have torn down so many of our democratic institutions without the willing help of members of congress, without the willingness of republicans to give up their ideology, give up their morality in the service of this president. and i wanted to write about how that happened, how people come to give up their -- their beliefs and their value system so quickly, so readily in the service of this immoral and unethical president. um, in terms of, you know, where we are right now, reverend, i think you are absolutely right. the -- the failure to pass voting rights is an existential crisis for the country. we need to get the voting rights legislation and h.r. 1 passed. the lesson that donald trump seems to have taken from the failed insurrection was next time if he couldn't get 11,000, you know, brad raffensperger in georgia to find 11,780 votes that don't exist, he seems determined to make sure there's someone in that position and others who will stuff the ballot box the way raffensperger refused. and that is a real risk to our democracy. >> no, that -- that is really something that we are focused on and we're going to stay on that and as well as some of the -- as you wrote in your book. i was lucky enough to get a copy from you and it's a very well-written book. let's, quickly, talk about the governor's race in virginia. just two days away. there have been reports of a flood of gop poll watchers that have descended across the commonwealth to examine vote tallies and how voters are being checked in. leading fears of voting intimidation. do you see some of this activism at the polls by the gop as an extension of trump's big lie? and what happened on january 6th. do you see any connections? >> i do. absolutely. you know, the big lie about the election that we can't trust elections to decide who should represent us anymore. that any time the republicans lose, it must be because the elections are rigged. that's a -- that's an argument that goes right at the heart of our democracy. if we can't rely on elections to decide who should govern, then it just paves the way for violence. we saw that on january 6th. and what they're doing around the country, what they're doing if they're sending people to intimidate folks at the polls in virginia is just more of the same. sadly, the republican party, under donald trump, has become an anti-democratic, anti-truth cult of the former president. and as long as that's the case, they're going to just need to be beaten at the polls. defeated at the polls. because they want to take this -- this country in an authoritarian direction and we simply cannot allow that to happen. >> before i let you go, i'm certainly hoping congress will pass infrastructure legislation this week because it will directly benefit millions of americans. however, there are many people, especially in the african-american community, are wondering whether voting rights should have been the priority in this term, particularly in light of the assaults on democracy, you yourself have highlighted both in your book and in your work on capitol hill. well, what is your response to that line of thinking? >> you know, reverend, i think that voting rights is priority number one. that should be the first and seminal priority because as i write about in the book, if the edifice of our elections isn't strong, if the foundation isn't there and the foundation is voting rights, then the rest comes crumbling down. there's nothing more important than making sure that we don't have another generation of jim crow laws in this country and that we don't have partisans where we ought to have nonpartisan technocrats running our elections around the country. so, you know, from the very beginning, that's been my priority. it's what i have been urging the administration to make their priority. i do think these two bills are also part of a democracy agenda, at the end of the day, a democracy has to deliver for its people and i think the president understands that and gets that. but voting rights are fundamental and -- and that has to be the first, the second, and the last priority. >> i couldn't agree more. thank you, congressman schiff. joining me now, msnbc political analyst and former rnc chair michael steel. and founder of hashtag woke af nation and co-host of the podcast "democracyish" danielle moody. michael, we mentioned president biden's sinking approval ratings at the top of the show. he addressed the issue just over an hour ago at his g20 press conference in rome. take a listen. >> by the way, look. the polls are going to go up and down and up and down. they were high early, then they got medium. then, went back up and now they're low. well, look. this is -- look at every other president. it's the same thing has happened but that's not why i ran. i didn't run to determine how well i'm going to do in the polls. i ran to make sure that i followed through on what i said i would do as president of the united states. >> now, in addition to all that, presidents biden's polling numbers with black americans have slipped. a recent morning consult poll showing that 69% of black voters approve of his performance. 25% disapprove. net approval, down 25 points since august 1st. michael, what do you think is driving these trends? and can the administration turn this around before the midterms? >> it can be turn -- let us a start with the second question, first. it can be turned around before the midterms there is no doubt about that because you are talking about a year from now. as we have seen, reverend, polls go up and down within days. so you are talking months and a year. where the -- where the issue i think lies is getting something done. that's why you see the numbers slipping among african-americans, among the broader populous of voters. is that they bought the idea that, yeah, we wanted to get past the -- the other administration and president trump and all of that crazy. but the expectation was in handling covid, in handling the economy, those two things that were real big drivers for voters. they had a very specific point they wanted to get across. one, i want to feel better. i want my kids to be safe in school and i want my husband, my wife, my family members to go back to work into an economy where we can realize the american dream. that's been stalled and i think that's been a big problem in dragging down the numbers which is why you heard terry mcauliffe screaming over the last week of this campaign, please, just pass the infrastructure bill. give us a win. and look. i get the back and forth between infrastructure bill number one and infrastructure bill number two. but you've got 19 republicans who have -- who -- who've signed onto and passed in the senate the infrastructure bill that democrats have worked hard to get. the -- the straight-up roads, bridges, et cetera. pass it. and then -- and then, you can come on the back end because now you have got something to sell. you've got something where people go, okay, we get now the obstruction is coming from the right. you can get something done. you at least convince 19 sane republicans to get onboard. okay. we'll give you some more runway. but he's run out of runway and that's why this race in virginia is close. that's why the numbers are down to 42% for the president and why black voters are sitting there going, i don't know. >> danielle, voters across the country will head to the polls tuesday in one of the most closely watched races -- closely watching matchups in virginia's governor race where democrat terry mcauliffe is in a dead heat with his republican challenger, glenn youngkin. now, mcauliffe is a well-known democrat and a former governor. why is this race so close? and should democrats be concerned? >> i mean, i think that democrats should be scared out of their minds right now because essentially republicans offered no platform whatsoever. we understand that, right? they don't offer any policy. they don't give us any new ideas. everything that they are about is obstructionism. is telling us what we shouldn't do, is banning books, is telling women that they can't have an abortion. it is doing all of these things. and so, the question now is what is democrats' message? it can't just be that i'm not donald trump. and remember, that joe biden came out of the gate as the comforter in chief. he came out of the gate telling us that he was going to repair washington, not understanding that the republicans that he had dealt with from yesteryear are not the obstructionist republican cult that he is dealing with now. and so, we are seeing that play out in the virginia governor's race because you have youngkin saying -- doing everything that the base republicans want. we're going to ban tony morrison. we're going to get rid of mandates on vaccinations. we're going to do these things that has been red meat for the republican base. and what i am saying is what are democrats offering? because right now, we have been clamoring over the last ten months. we don't have policing reform. we don't have an infrastructure bill. we don't have a voting rights bill. and that is why you are seeing the president's numbers go down with everyone, including black voters who got you to where you are in the first place and are looking around and saying where am i? >> it seems to me and so many others that as long as the democratic priorities are held hostage to the threat of the filibuster by senate republicans, nothing substantive can be done. the dem -- the president recently signalled some support for altering the filibuster but time is running out to install meaningful federal legislation to counter expanding voter restrictions at the state level. do any other policy priorities matter if democrats cannot protect americans' right to vote which we both know is under assault right now by the republican party. i think the democrats' message has been there for voting, there for the john lewis bill, there for all the bills, there for police reform. but they will not deal with the filibuster. i think that they're being intercepted by the filibuster, not because they don't have a message. their message has no microphone anyone can hear because they are allowing two senators to cut the mic off. >> i mean, you're exactly right, rev, because the only two senators that have the mic right now are the people that the majority of americans didn't vote for. manchin and sinema. and unless we are going to do something about voting rights, then we might as well just stop altogether because none of the bills that are coming out matter if people can't vote. it doesn't matter if republicans can turn around and tell you that after you stood out in line for six hours, that your vote doesn't matter because they're going to decertify it. so if we're not dealing with the basis of our democracy, which is the fundamental rights of all people who are eligible to vote, to vote. then, i don't know what we're doing. >> michael, texas abortion ban heads to the supreme court tomorrow. what do you expect to see as the justices begin to hear arguments with the case? >> that's -- that's a very good question, rev. um, the reality of -- of it is it's -- it's -- the texas bill sets in motion and really sets up the -- the other abortion bill that is before the court this year. i believe out -- out of mississippi. >> right. >> so, you're going to see -- you're going to see these two very different bills. one, more draconian than the other. you know, come into real sharp focus for this court. i -- i'm not sure how much leg this texas bill is going to get in front of the supreme court. i really think if there is going to be any further incursion on roe versus wade, it will be done out of mississippi, not so much this because of the nature of this particular bill which is -- flies in the face of -- of all constitutional principles around the rights of individuals. um, when you set up a bounty on -- on -- on wombs of women in this country, it's just the most unforgiveable thing you can -- you can think of. but the mississippi case is a more narrowly tailored and more narrowly focused bill -- piece of legislation. and where the court comes down there is going to be interesting. i still think, though, that at the end of the day, roe -- roe may withstand this particular assault from the states, given the nature of the -- the history of this bill and the -- and the real reticence at the end of the day to undo that because these things go around, rev. you know that. what goes around comes back twice as hard. and if the democrats ever get the opportunity to make the changes on the court, republicans could find themselves in a very difficult spot so i think it's going to be a short-term play. longer term, um, i still think it stands but, you know, it's hard to say. >> well, we -- we can only mope for the best. thank you, both, michael steel and danielle moody. coming up, it's halloween and i'm taking aim at the scariest characters in the republican party. in true horror-movie fashion, the seditious call was allegedly coming from inside the house. i'll explain, after the break. when you're driving a lincoln, stress seems to evaporate into thin air. which leaves us to wonder, where does it go? [ cheers and applause ] i ask you all -- i ask you all to rise and join us as mark lloyd leads us in the pledge. >> those are virginia republicans. virginia republicans at a rally this month pledging allegiance to a flag carried at the insurrection on january 6th. and if actual treason endorsed by the republican base isn't scary enough, at least a dozen republicans running for state offices this week were present during the mayhem on january 6th. but it's not just a possible collusion with rioters in the republican party. the gop once stood for the grand ole party but with characters like marjorie taylor greene and matt gaetz among their number, maybe we should change the name to the ghoulish offender party. of course, greene and gaetz are only taking their cues from the leader of the party. the disgraced-former president, donald trump, who attended a world series game in atlanta last night. he's a native new yorker who now lives in florida. trump would seem to have no rooting interest in a contest between teams from houston and atlanta. but he wasted no time in joining in one of the braves' most controversial traditions, the tomahawk. widely considered derogatory and racist toward native americans but what else would you expect from a man so vile and corrupt that he was booted off facebook, twitter, instagram, and youtube? and since he's incapable of simple acts of self-reflection or learning, his next farce is his own social media platform where he can spread his big lie and continue his seditious poisoning of our democracy itself. the -- the best part of halloween is telling ghost stories, getting good and scared, and then turning on the lights safe and sound. but while it is halloween, these are not ghost stories. they're all too real. from the radicalization and violence within the republican base up through the alleged crime of republican-elected officials and the gleeful immorality of their standard bearer. these developments should scare us all. if democrats and, indeed, all true american patriots don't demand voting rights protections now, these people will be much more than a scary story to tell on halloween. we cannot allow this wicked minority to seize power, and destroy our democracy. and if we pull together in time, we can relegate these kinds of attitudes to the haunted cemetery of history where they belong. all to ensure that every halloween to come, we can look back and say i gotcha. and say . ♪ i had a dream that someday ♪ ♪ i would just fly, fly away ♪ - [female narrator] five billion people lack access to safe surgery. thousands of children are suffering and dying from treatable causes. for 40 years, mercy ships has deployed floating hospitals to provide the free surgeries these children need. join us. together, we can give children the hope and healing they never thought possible. it's a mission powered by love, made possible by you. give today. in loudoun county, this is the wealthiest county in the country. there's not a lot of racism. >> do you think it's more on the color of their skin? or their actions? how they're dressed, how they perceive, how they respect others. if you have a kid that's pulled over by a cop, does it really matter what color they are? or is it the respect that they give to that police officer? >> so, glenn youngkin's your guy? >> yes. >> he doesn't want to push this racism narrative. he wants to give kids a good education. >> education has become the flash point across the country. >> you know why? >> tell me. >> you don't mess with our kids. >> in the lead-up to tuesday's gubernatorial election in virginia, republicans have made education a central issue in their efforts. but not adequate funding, class sizes, or even school safety. instead, they're fear mongering about critical-race theory which is simply a study of historical racism and its impact on modern laws and life and it's taught in law schools, not public schools in virginia or anywhere else i know of. but there's a troubling parallel between the desperation some white parents feel to stop their children from learning the truth about the history of american racism, and the lengths some white parents went to, in the '50s and '60s, to stop racial integration of public schools. joining me now is author of "culture war lords, my journey into the dark web of white supremacy." talia, you wrote a piece recently on the worrying similarities between the integration protests that were going on during my childhood in the '50s and '60s and the behavior we're seeing in the school board meetings now. you called this, quote, the biggest threat the public education system has faced since the 1950s. and warned of a resurgence of the kind of segregation -- segregation academies of that time. is this same white supremacy operating under a new name? how have tactics evolved? >> so, i would say, just to answer your first question, absolutely yes. i think this is a resurgence of the similar -- a similar sentiment that we saw in what was called the massive resistance movement. um, was to school integration and we saw protest particularly across the south but also notice -- notably in boston and in many other cities against the integration of schools. as one striking parallel -- and i recommend to your viewers, the book "mothers of massive resistance" by elizabeth mcrae, which is a wonderful study of the ways in which white women were central lynchpins of the movement against school integration. utilizing many of the same fear-mongering tactics. this notion that white children will be made to feel bad for who they are. um, these -- these notions that education will become indoctrination and you see these refrains echoing across the years. >> the same kind of -- same kind of things that we are seeing updated now. for example, they say a picture's worth a thousand words and one of the most disturbing parallels i've seen was actually brought into sharper focus by one of the images in your recent piece. showing children holding up protest signs against teaching of racial history in schools, similar to the way toddlers were made to hold up slogans they couldn't even read, let alone understand. at integration protests 60 years ago. i mean, do these parents truly think they're on the right side of this? or they so radicalized online that they don't see the similarities? >> well i mean, i think first of all, central to both campaigns is a weaponization of the figure of the concerned parent. and weaponization of children. you know, there is a notion in american society that children are sacrosanct and a continual sort of holding up of the rights of the parent over their child. and so, that's -- you know, one of the major features of the -- the current propaganda campaign is that the parents should have more rights with regards to framing the curriculum that their children are exposed to. and so, this becomes, you know, an extension of the ways in which american society frames children as property of their parents. um, and certainly, you see that in the instrumentalization of, as you have said, you know, kids who can't read holding up signs, you know, saying they're against a lost school framework. but -- and the -- and the -- so, the question is how the -- how do these people get radicalized? i mean, this is -- this has been a very systemic campaign. um, the right has had it in for public education for a very long time, particularly since school integration. and have been pushing for charter schools, for school choice, and for an over -- overwhelming sort of weakening of public education. >> so, this has been developing over periods of time. they have just found a way to kind of stoke the fire. but before i let you go, i wanted to ask your thoughts briefly on something that really got my attention this week. the judge in the kyle rittenhouse trial has ruled that the people shot and killed by rittenhouse at a black lives matter march last year cannot be called victims, but can be referred to as rioters or looters even though they were not rioting or looting. how far do you think these kind of alt-right dog whistles have permeated the judiciary? >> guys were complaining about basic things like toothpaste. a roll of toilet paper last you a month. >> the inmates were considered like animals. >> they want to kill us. >> we are men. >> he was waking up america. >> somebody had to take a stand. >> as "attica" premiering on showtime this week, examines the influences and the institution behind america's most recognizable prison uprising, joining me now, the filmmakers behind "attica," emmy award winning producer stanley nelson and the film's director, tracie a. curry. mr. nelson, ms. curry, thank you for joining us tonight. powerful stuff. stanley, one thing that has stuck with me was hearing and reading one of the former attica inmates interviewed in your film, arthur harrison. because in addition to describing the horrors of the prison life he knew at attica, he says that things have gotten better in our prison system, in our penal system. and i wonder most americans who either weren't in the system back then or simply weren't alive, i wonder if they can appreciate how bad conditions must have been for hundreds of black and latino inmates to revolt knowing they'd likely be punished, if not killed, for it. how bad was it at attica leading up to september of 1971? i was only a teenage activist then, 15 or 16 years old but i remember hearing about the uprising. >> yeah. one of the things that we detail in the film was how really terrible attica was. you know, the prisoners call it the last place. the -- the worst prison in new york state. you know, they -- they -- the prisoners were given one roll of toilet paper a month. you know, and that's just kind of symbolic of how terrible it was. but they also were subject to beatings and -- and -- and -- and -- and -- and torture. if they complained, they were punished. so, you know, they had real reasons why they rebelled and why they wanted to change the system. not only in attica but in prisons throughout the country. >> now, ms. curry, i want to get you -- your, the director's reaction, to another clip from the film. roll that clip, please. >> we was talking, singing songs. it was -- it was a festive night. i loved it. i loved it. i was out in -- in -- in the nighttime, looking at the stars. i was drunk, i was happy. you know, i liked it. i was having a good time. >> and it was good. i felt free. i -- i -- you know, i mean, prison was there but, you know, i felt free. i didn't have to hear the doors knock -- knocking. and it -- it was a good feeling at that -- that first night. >> tracie, can you put those interviews in context for us and did you, as the director, find that there was a unifying theme among the survivors you spoke to? >> yes. um, i'm the co-director and stanley is the director of the film. um, but yeah, i -- i found that of the survivors we spoke with in the film, this was a profound trauma in the lives of all of these people. um, i -- in doing the interviews, um, obviously, this is not something that is very easy for any of them to talk about having lived through the massacre of three-dozen people by the american state. um, there was never any justice for any of them. um, that goes for not only the prisoners but also the families of the hostages who work at the prison who were either killed or injured. and one thing that i really think that i found in common throughout all of them was all of them feeling like they never got any justice. um, there has never been so much as an apology from the state of new york in the 50 years since this happened. and though, everyone has different perspectives depending where they were in -- -- during those five days, every single person feels like they were ultimately harmed by the state of new york in what happened on september 13th, 1971. >> wow. stanley, take us through the aftermath of the uprising because you describe the law enforcement response that ultimately ended the attica riot as a riot unto itself. and i know that -- that the kind -- that the mistreatment of prisoners didn't end there. one -- one of the reasons they asked for amnesty among their demands is -- is that right? >> yeah. i mean, one of the -- the -- the things that the whole thing hinged on was amnesty for the prisoners. they wanted amnesty not for the crimes that they had committed that got -- that got them put into prison but for anything that happened during the rebellion. and that was the sticking point. when they came and took the prison over, um, they came in shooting and killed about 40 people were killed. and you have to understand that, first, they -- they fired gas into the prison. and so, they couldn't even see. they -- there was smoke everywhere and they just fired, you know, round after round after round into the smoke and killed people. but that didn't stop then. then, the -- the prisoners had to crawl through the mud and through the -- the trenches that they had built as latrines. they were stripped naked and marched around the yard, and made to sit nude. and then, they were beaten and made to run over broken glass. um, just a number of -- a number of torture -- torturous things that happened afterwards. after the prison was already taken over. um, and -- and the grave thing for us, as filmmakers, is that there is actually footage of it and great still pictures so that it's not only that the former prisoners are talking about it because in the film are -- are guys who went through it, who were shot and then tortured. but also, that it's -- it -- we have pictures and footage. so, you see the torture and you see it. >> now, tracie, last question and my apologies to your co-director. but did making this film challenge or reinforce any assumptions you had about our current prison system?
