it's "way too early" for this. ♪♪ good morning and welcome to "way too early," the show that hopes the flying object was william shatner going for an encore. i'm jonathan lemire on this friday, october 22nd. we'll start with the news. the house has voted to hold steve bannon in contempt of congress for ignoring a subpoena from the house select committee that's been investigating the january 6 attack at the capitol. the final tally, 229-202. that means nine republicans broke with their party to support the resolution. seven of those nine previously voted to impeach president trump following the insurrection. one of the republicans who voted in favor of the resolution was congresswoman nancy mace of south carolina. she spoke to reporters yesterday and explained her vote. >> i want the power to subpoena when we start investigating some of the crises that are facing the biden administration right now, whether we're talking about the border or the botched exit from afghanistan. there are a lot of things i'm going to want to investigate when we're in the majority that we're not doing right now. >> in a rare show of bipartisanship during yesterday's vote t house committee's secretary chairman bennie thompson led the floor debate along with his co-chair, liz cheney. cheney called out her republican colleagues and specifically kevin mccarthy during her remarks. >> my colleagues in the republican party, the republican members of this body, have to understand, have to recognize that there's a moment when politics must stop if we want to defend and protect our institutions. a violent assault on the capitol to stop a constitutional process of counting electoral votes is that moment. they all knew that on that day. in fact, the minority leader himself stood in this chamber and said, quote, the president bears responsibility for wednesday's attack on congress by mob rioters. he should have immediately denounced the mob when he saw what was unfolding. mr. mccarthy was right then. the president bears responsibility. >> among the pressing questions in washington is now whether the justice department will take the time to prosecute steve bannon and act on it. attorney general merrick garland was noncommital when testifying before the house judiciary committee yesterday. >> the department recognizes the important oversight role that this committee, the house of representatives, and the senate play with respect to the executive branch. the house of representatives votes for referral of a contempt charge. the department of justice will do what it always does in such circumstances, will apply the facts and the law and make a decision consistent with the principals of prosecution. joining us now, reporter. what sort of backlash will they face within the gop? >> i mean, absolutely these republicans knew when they took that vote, they're facing possibly becoming political pariah in their party. they voted against the majority whip, the majority party. they've seen this before. congresswoman liz cheney was on the select committee when she voted against -- i'm sorry. when she voted for the impeachment of the january 6 select committee and continued to speak out against donald trump, she was stripped of her leadership position with the blessing of minority leader kevin mccarthy. so it's anyone's game. to say what could possibly happen to the rest of the republicans who decided to step away from their party. >> you mentioned congresswoman cheney. she called out leader mccarthy yesterday. as you just detailed, she's already suffered some consequences within the gop, and then we have this report from "the new york times" yesterday that a lobbyist close to mccarthy warned him. the relationship between the two are clearly, shall we say, strained, but where could it go from here? what could mccarthy do for cheney? it seems like she's going to face a pretty significant primary test. >> oh, absolutely. just think about it. these two started off the year working in leadership together and now cheney is no longer in leadership. mccarthy is pretty actively, you know, speaking against her. he's called her a, quote, pelosi republican. she's whipped right back at him saying he's actively trying to disrupt the investigation. you know, with this political consultant rift, this continuing disintegration of their relationship, she's already lost a fund-raiser, "the new york times" reported, and so likely what could happen is mccarthy will, of course, support, you know, her primary challenger, and he at the end of the day really wants to be speaker of the house, right? in yesterday. it's still affecting the region. then they have a powerful storm, one of the most powerful they've ever had. that will hit california on sunday. first this is the storm moving through. beneficial rain, no damaging winds. you need your umbrella. you're not going to be happen driving in the rain on i-5. again, this is beneficial rain. then over the next five days, rainfall totals pretty epic with the next storm. this will be the one late saturday, all day sunday. the area of red is up to 7 inches of rain. it gets into central portions of california, the bay is included. that's great news. that will help put out the large fires. we've got 18 of them. the snow in the higher elevations, 1 to 2 feet from taho down to mammoth. that's also good, building up the snow pack early. the areas where we've had fire, we could quickly get burn scars or debris flows. we have watches up for a large area from reading to sacramento, modesto, and including areas around mammoth, because the lower elevations will get some of that heavy rain. for today, kind of the last warmish day for the east coast. still above average but not like the last two days. it was incredibly warm. today, 71 in d.c., 71 in boston. cooler on the great lakes and the ohio valley. that cooler type air will flow into the northeast on saturday. mostly sunny conditions throughout much of the deep south. but we will be watching a new area of rain developing in missouri. and on sunday, kind of a rainy day for you st. louis to des moines, the quad cities, chicago, indianapolis included. not a great sunday. still dealing with decent weather on the east coast. there's the powerful storm for the west. we'll talk more about that storm on monday where it's impacted and where it's headed. word to the wise on jonathan lemire. as polling shows a virtual dead heat for the upcoming election of governor, you have early voting. through campaign texts, door knocking, and rallies near early voting locations, youngkin has aggressively leaned on a practice labeled as fraudulent by you know who, former president donald trump. he has accepted multiple endorsements from the former president and his inner circle. he's called for another audit of virginia's voting machines despite a previous one confirming that trump lost the state by ten points in 2020. meanwhile president biden will stump for terry mcauliffe next week. the president will join mcauliffe at an event in arlington on tuesday after previously campaigning with him in july. his latest appearance will follow a string of campaign visits from others. former president barack obama is expected to speak as a virginia event tomorrow after vice president kamala harris campaigned for mcauliffe yesterday. late yesterday at a cnn town hall when pressed on why he won't advocate for the filibuster, president biden explained what he's ready do and when. >> if, in fact, i get myself into at this moment the debate on the filibuster, i lose at least three votes right now to get what i have to get done on the economic side of the equation, the foreign policy side of the equation. so what i have said -- you're shaking your head no, but let me tell you something, jack. it's true. >> when it comes to voting rights, you would entertain the notion of doing away with the filibuster on that one issue, is that correct? >> and maybe more. >> let me tell you something jack. joining us now from "punchbowl news," john bresnahan. great to see you. let's start there with the president's stance to not advocate, at least public indicate, any indication of the filibuster. how does that shape the debate and other things going forward? >> voting rights is not going to move if they don't get rid of the filibuster, and it probably won't move if they get rid of the filibuster because you could see joe manchin and kirsten sinema voted against it. so, i mean, it's slard to see voting rights move at this point. you did have manchin sign on to the voting rights bill. they had 50 senate democrats which they pushed for. if they do that, there's going to be another vote next week on the john lewis voting rights act. that's not going to advance because of the republicans opposition and because of the filibuster. as the president noted, you know, if he pushed to get rid of the filibuster now, he woz lose votes somewhere else. this is a difficult issue to see. i don't see any action on this really happening right now. >> so biden last night was also quite candid about the state of reconciliation and infrastructure negotiations. it almost seemed like he was confirming for all of the reporting from the capitol hill reporters like yourself. >> right. >> give us a sense what he said and where he stands. >> he was pretty upbee. he said he was going to get a deal done. anderson cooper pressed him on whether they'll get a deal done before he heads to europe and italy, and there's a big climate change meeting in scotland. he was upbeat about it but realistic. he talked about sinema and manchin. hoe was funny. he said in the 50/50 senate, every senator is a president, every single one. that was his quote. you know, he's negotiating with them. and sinema on the tax side, she looks at the puzzle. joe manchin is concerned about the expansion, the dental and hearing programs. he talked a lot about that. you have the president of the united states in there bargaining, and what we're going to be reporting a little bit today is -- and punch bowl will have this at 6:00 a.m. they're really pushing for a vote next week on the floor of the house. or the white house is voting for a vote on the house floor on this reconciliation package and the infrastructure package, the bipartisan, the $1 trillion bill. so they're going to push really hard on, this and i don't think they're going to get there, but the president really wants this before he leaves the country. >> you're certainly right about the deadlines. it's about, you know, the president wanting to be able to go to scotland with climate change progress in his handses, but it's showing the democrats getting something done ahead of the virginia governor's race. let's go there now. what do you make of what both mcauliffe and youngkin are doing. you heard mcauliffe almost pleading, give me something to sign, give me something to run on. this race is a lot closer than we anticipated. where do you think things stand and where could the outcome tell us for next year's midterms? >> this is huge. we've talked about this before. this is a replay of, you know, 2009. that's what democrats are afraid of, that they were fighting over obamacare at this point, and there was the republican tea party surge. and you first saw it in gubernatorial races in virginia and new jersey. and this s you know, a bellwether race. that's why he's bringing obama, that's why he's bringing the president, that's why he's bringing in kamala harris, that's why he's bringing in stacy agram. he's bringing in these folks to help motivate. like you said, he's openly pleading with the democrats to pass this bipartisan bill, the trillion-dollar bill that's been sitting in the house for weeks. he's pleading to get this done because he needs it. biden knows mcauliffe need as little boost. and getting the bipartisan bill done could swing some votes, and this
