's dropping major hints about his next political move. he held a rally last night where we heard the usual hits. a lot of the speech sounded very familiar. >> it's like "free bird" after the 90th year. >> lynyrd skynyrd knows what works. what is interesting is where he was, des moines, iowa and maybe this line. >> my knew slogan was going to be make america -- remember this. it was supposed to be something a little different than make america great. it was supposed to be keep america great, but america is not great right now. so we're using the same slogan, make america great again, and we may even add to it, but we'll keep it. make american great again again. >> the hawkeye state traditionally where the presidential nominating process begins. in the meantime, on capitol hill, we're waiting to see if the committee investigating the january 6th election will deliver handing out a subpoena top steve bannon. he and three other ex-trump aides are days away from their scheduled depositions. it ooh's not clear whether they'll show up. gary, we'll start with you. you were in des moines for this rally. trump pretty much talked about everything under the sun. it was more than 90 minutes, but no mention of the white house rejecting his executive privilege claim. >> that's right, kendis. for something that seemed to take all of the air out of wshl and certain on the mind of the folks in the crowd, no mention of january 6th or his executive privilege claim. he talked about afghanistan, the withdrawal from afghanistan, the 2020 election and, as you mentioned, the possible slogans he may have for a possible 2024 run. but they're talking to voters. there was a lot of anger with republicans and the current state of the gop. we saw in the pre show yesterday iowa representative miller meeks was making remarks and she was shouted down and called a r ino, a republican in name only. another was booed a little. there's a real anger among republicans here for what's going on in the republican party. i want to introduce you to one woman we spoke to who had some thoughts on the current state of the party. >> i think the republicans about as weak as they can possibly be in congress. you have maybe six that are worth their salt, ted cruz, mike lee, rand paul and two or three others. the rest of them are just same as the democrats. they've been there too long. they're establishment. they don't care about the american people because they're in their el let little tower. we're just sick of it, you know. we're not going to take it anymore. i see a civil war coming. i do. i see civil war coming. >> reporter: i see a civil war coming. that's the sort of sentiment that we're hearing from a lot of folks here in des moines from the economy to afghanistan to the border. folks are very upset with the way this country is going right now. they believe donald trump running in 2024 could fix all that. >> gary, it does appear as if any different day you're in a different city. we listen to those sound bites right there and ones in the last hour and it was frightening to many people. is that an anomaly, or are you goating a sense that this is what some people all across the country are thinking. >> reporter: one of the things i asked, do your friends think this way, do your neighbors think this way? they all said yes. i think it's important to get out of washington and new york and come to places where you're hearing a lot of this. >> civil war. >> julie, any insight on the house committee's house move into the investigation into january 6th? >> reporter: the house select committee, once that thursday deadline this week came and went to produce the documents they requested from four former trump aides, they sent out a warning shot, if you will, specifically targeted at steve bannon whose lawyer said he's relying on the former president's executive privilege, and he did not produce any documents. as we look ahead to next week, bannon, we're supposed to hear from him on thursday, the others on thursday and friday as well. if he doesn't show up for the testimony, the committee says they'll swiftly pursue criminal referral for any witness who defies a subpoena. that right now includes steve bannon, former trump campaign adviser. he was one of the organizers credited with that stop the steal rally that led to the insurrection on january 6th. you heard from gary former president trump didn't talk about this last night. but he sure spent all week urging his ex-aides to stay silent and rely on his privilege instead before producing documents or appearing before the committee. organizers showing the direction they're headed in, guys. >> all right, we'll leave it there with julie tsirkin as well as gary grumbach. appreciate it. sean cassidy venting the sixth district of illinois. you've been vocal about the insurrection and what you called trump's coup attempt. are you worried about the investigation now seemingly dragging on? >> i'm not worried about it. i'm delighted we've got excellent leadership, twolt members of the republican party willing to honor their oath and serving on that committee. we're sailing into a situation where there will be criminal referrals to the justice department. when we get there, we'll have a department that honors its oath to the constitution and doesn't see their job as being the former president's con sig airy as william barr did. >> an article points out that they face an inevitable reckoning with their gop colleagues. it's about how things can take an uglier turn between the parties. talking about gop leaders who huddled with trump on the day of the attack, who spoke to him on the phone watching things unfold. is this something democrats are worried about? this whole investigation has been attacked essentially as a part san grab anyway from the beginning. >> i think we're worried about it for the stability of our democracy which is vastly more important than whatever politico headline might run. there have been three attempted attacks on the capitol in our history, the war of 1812, flight 93 on 9/11 and january 6th. no one would reasonably sigh that hiding information about the british motives, hiding information about osama bin laden was in any way patriotic. if you have members of congress who had material information and didn't bring it forward in those circumstances, we would have had round bipartisan condemnation of it. what we have now is people who i serve with who has access to our national secrets, who i fundamentally do not trust, who many of us do not trust. that heals by them coming forward and sharing what they know. p the only way to get them forward is through krnl subpoenas, it's a challenge for our democracy. we've got to find our way through it. that's vastly more important. >> congressman, last night trump endorsed senator chuck grassley who is seeking re-election for an eighth term in iowa. here is that exchange. >> i'm thrilled to announce tonight that senator chuck grassley has my complete and total endorsement for re-election. >> i was born at night, but not last night. so if i didn't accept the endorsement of a person that's got 91% of the republican voters in iowa, i wouldn't be too smart. i'm smart enough to accept that endorsement. >> grassley, of course, is 88 years old. he was critical of trump's actions following the january 6th insurrection even though he voted against impeaching him. but all of that said, you also heart that sound bite that gary grumbach had. he interviewed many people with a sentiment, where they're calling for a civil war. when you hear that sort of chatter, knowing what we've gone through in the last nine months, what do you think? >> it's hard -- if you're going use words like civil war, let's go back and look at the civil war, right? there's always been attention in our society, a tension to representative democracy. do you believe your government should represent your personal parochial interests or do you believe representative drem october see survives as long as the will of the majority prevails? >> does it alarm you? >> it alarms me in the sense that there have always been people in our country who put their own personal selfish interest above the good of the country. yes, there have been times when they have taken up arms. we saw it on january 6th. what's alarming is when leaders in position of power encourage that behavior. we lead by example. from john lewis to john mccain, the people who led by example and got people to follow, not the chuck grassleys who say 91% of the people support, so i better follow them. >> from a personal standpoint, it's frightening to listen to that talk. >> it is. >> congressman, thank you so much for being here. appreciate it. developing this morning in new york city, laguardia airport we're told is running as normal again after an unruly passenger forced a plane to land there. in a statement american airlines called it a potential security issue. the plane was coming in from indianapolis, some 80 people on board, 80 passengers. all of them got off the plane safely, albeit, on the tarmac. >> we're still working to figure out exactly what this passenger was doing to cause all this. in this video, firefighters have a man face down on that tarmac with his arms and legs spread, as we've been reporting, unruly passengers have been a huge problem for airlines over the last several months. texas, kentucky, mississippi, these southern states are setting the landscape for women's health across the country. the white house is right in the think of it, at least with texas battling over its abortion ban. what the biden administration's game plan is ahead of the tuesday deadline. since suzie's got goals, she'll want a plan to reach them. so she'll get some help from fidelity, and she'll feel so good about her plan, she can focus on living it. that's the planning effect, from fidelity. - i'm norm. she can- i'm szasz.ving it. >> reporter: guys, this texas law was passed, then halted for 48 hours and then reinstated as of friday night. it was a three-judge panel that decided to reinstate the law friday night, and they asked the justice department to come back to them with a response as of 5:00 p.m. this coming tuesday. that's something we're going to be looking for going into next week. this was expected. this is not a surprise. the appeals court has a representation for being conservative. one of the judges, a trump employee, he has written that abortion is, quote, a moral tragedy. this is no surprise. the justice department would have been expecting this, preparing for it. the biden administration would have been ready for it. the big question is what do they do next? do they ask the supreme court to get involved and step in? we don't know yet. we'll have to wait and see where they decide to go with this. bottom line is this is just the beginning of a very long, a very messy and a very complicated legal battle. ken paxton, the attorney general in texas, has said that the federal government has overstepped, they've over reached, they don't have a right in the first place to bring this case against texas. president biden has committed to using whatever powers he has in the federal government to overturn this law. he has condemned it and promised women in texas that he will fight to get rid of the law. lindsey, kendis, as this long legal battle, as of now, abortion will remain unavailable in texas. >> lauren egan, thanks so much. we want to bring in senior staff attorney molly dwayne. molly, good morning. thank you for being with us. what steps here should the doj be taking? we know they have until tuesday. how hopeful are you that they'll be able to stop this ban? what else should they be doing? >> the department of justice has been an invaluable partner of this fight in texas. what we're seeing in texas every single day is a constitutional right that patients in texas have is being taken away from them. we're seeing patients traveling hundreds of miles, to oklahoma, new york, washington, d.c., just to access their constitutional rights to abortion care, and the impact has really been catastrophic. so what the department of justice has done is really send a message to the state of texas and any other state in the country that seeks to disenfranchise this constitutional right and say we will take this all the way up to the supreme court. >> former texas senator wendy davis joined us yesterday echoing what you said, major consequences for women in the state. let's listen to part of it. >> people who are showing up at abortion clinics across the state, who are desperate to receive care, most of whom already have children at home, who already are struggling to financially provide, ultimately this is going to have an impact in raising poverty, which we know happens when women are not able to access abortion, and unfortunately creating greater is stresses on our systems overall. >> what options do patients and providers have at this point? >> so my job over the last several weeks has been to speak with providers every single day and try to help them and their patients navigate through this extremely challenging time. so providers in texas are really doing herculean things to give patients access to care before the current legal limit in texas, which is about six weeks of pregnancy. while that's before many women even know that they're pregnant, providers in texas are nonetheless trying to get as many patients in the door as they can. after that, it's really helping patients get out of state if they can. but what we know is that the majority of patients in texas won't be able to get out of state for care. i'm hearing every day heartbreaking stories about minors, about undocumented folks, about people who simply cannot travel out of state due to child care concerns and losing their jobs. this is a real crisis in texas every single day that this law is in effect. >> this isn't just happening in texas either. kentucky's attorney general is asking the supreme court if he can defend the state's abortion law before the supreme court. we know abortion rights advocates are watching mississippi's case. some see it as an turn to overturn roe v. wade. with all this going on, what are you watching for and what is your biggest fear? >> i think while these cases are getting a ton of attention now, it's important for folks to realize that this has been my life for years. this has been how abortion providers have been operating throughout the country for a decade. that's under a constant, constant assault. so yes, we're seeing the state of mississippi challenging roe v. wade directly. the kentucky case involves a procedural issue, but nonetheless shows just how far anti-abortion politicians in states like kentucky and texas will go to challenge roe v. wade directly but also to chip away simultaneously at the right to abortion. so we're already living in a country where the constitutional right to abortion simply is not available to large segments of the population. >> molly duane, thank you for joining us, appreciate it. >> thank you. migraines, nausea, memory lapses. we're told these are the symptoms of a new incident that has taken place at the american embassy in germany. what's behind it? chase. make more of what's yours. ray loves vacations. but his diabetes never seemed to take one. everything felt like a 'no.' everything. but then ray went from no to know. with freestyle libre 14 day, now he knows his glucose levels when he needs to... and...when he wants to. so ray...can be ray. take the mystery out of your glucose levels, and lower your a1c. now you know. try it for free. visit freestylelibre.us with downy infusions, let the scent set the mood. feel the difference with downy. now you know. try it for free. the headline is alarming. young children of color put in jail for crimes that do not exist. this blockbuster story reported by propublica and national public radio. the community at the center is this one, in rutherford county, tennessee. that's roughly about 40 miles southeast of nashville. >> propublica's investigation started with a 2016 off-campus fight between a few boys you see in these blurred images. they're from video. a few weeks after the scuffle, police showed up at the school to arrested the young bystanders for failing to intervene in the fight. the officer involved declined to arrest the boys actually involved in the fight because they were so young. the girls who were taken into custody included a third grader, two fourth graders and a sixth grader. some of them cried and screamed because they were so scared. one even threw up on the floor. 11 kids were arrested, six were handcuffed and four were locked up. >> they were charged with something called criminal responsibility for conduct of another. that's a crime that, well, doesn't exist, at least not in tennessee law. it has placed the focus on this woman, judge donna scott davenport who oversees the country's juvenile justice system. she said she's not doing a job, she's doing god's mission. >> i've locked up one 7-year-old in 13 years and that was a heartbreak. but 8 and 9-year-olds and older are very common now. >> she's right. across the entire state of tennessee kids were locked up and just 5% of juvenile court cases. in this county, it's 48%. a lawsuit eventually put an end to davenport's policies in rutherford county. but now the juvenile justice center is putting its work to use in other places. here is a video. >> there's also video visitation equipment between the lobby and detainee housing to minimize any security risk between visitors and detainees. >> davenport declined to be interviewed for this piece. msnbc has also reached out to her. and now we have mirva knight, one of the reporters on this investigation. your colleague ken armstrong wrote you guys got 38 hours of audio interviews and watched more than 100 public meetings spanning more than a decade. there's so much to this article that is just mind-boggling and this investigation. first of all, where she said she was heartbroken by the 7-year-old, but the 8 and 9-year-olds is standard operating procedure apparently. how is it that the community has not been more outraged? >> well, we heard about it because i live here in tennessee. i knew about the incident in 2016 and i covered the lawsuits that followed. it's been a long kind of perk lading case that has led to this moment right here where you realize how many policies were in place that suck children into this system. the incident at this elementary school was the tip of the iceberg. this had been going on for decades and no one had been able to figure out how to stop it. we just found it through digging. now, the community was outraged at the time of the arrest. lawmakers called for a federal investigation. they said it was insane. families were so angry, but they really felt powerless against these policies that were standard operating procedure in the county. >> let's listen to another clip from judge davenport from your investigation. >> i want the children that come in front of me to leave better than they came in. >> from your reporting, is that happening? are these children better off after going through the system and going through this trauma? >> they are not. we spoke with one young man, dylan, one of the named plaintiffs in the class action lawsuit that ended up stopping this practice of illegal incarceration. dylan was arrested one night when he was 15 years old. he had never been arrested before. he was going around trying to look for unlocked cars to steal a bit of change and a radio. he got caught. he spent four days in defense. he didn't get his medication. he had been on lithium at the time. after he was released, he was put on false arrest and the following year he tried to commit suicide three times. he had been diagnosed with bipolar. his time in a detention center sent him on a completely different track in his life. that's just one example of the impact that this policy can have on children. >> so the county there, rutherford county, tennessee, i was looking at the racial makeup for it, it's 69% white, non-hispanic. i believe blacks make up about 15% of the population there. is that reflected in who is getting arrested and who is being locked up in juvenile jail? >> the thing about juvenile court is that everything is seals, right, for the protection of the children. what was amazing in this case is the series of lawsuits that were filed kind of cracked the door open. it's really hard to say exactly the makeup because the state doesn't report that, but what i can say is we interviewed lots of lawyers and they did all say that, like every other aspect of the criminal justice system, that children of color are really overly represented in this case, and they spoke often about the fact that that's what they saw in front of them, and this case is a great example. 11 children are arrested. all of them are black. >> i hope they've gotten some help, some of those kids who are no doubt traumatized if you're handcuffed at 8 years old, that you've gotten some help since then. have they? >> the news is good for today and getting betterment we're seeing a downward slope in cases followed by hospitalizations and deaths. we've seen this cycle happen over and over again. the cycle from the summer to winter last year actually was shorter than the one we're seeing now. this is a pretty large surge that's coming down. it's optimistic that cases are going down. i would agree it is always concerning that, until people get fully vaccinated, until policies are consistent, we are always vulnerable to another surge, especially am months is it the persistently unvaccinated people. >> we've got to admit the information has been quite confusing from the experts at the cdc and beyond about whether this is the last wave. before delta, the cdc was telling us we didn't have to wear mass ksz anymore. the president wupz there at the white house celebrating the fourth of july. where are we standing right now? should we stop wearing our masks fairly soon or feel confident or what? >> we need to respect the fact that our information changes and the guidance changes with it. it doesn't mean the guidance was wrong. it means we need to be flexible. that's how we went against this virus. last summer among june and july, it looked like fally vaccinated people could go unmasked indoors. so we saw the emergence of delta. i would say fully vaccinated people who vaccinated people, especially after children get vaccinated will start to see those liberties come back. they'll start to see family gatherings, especially if they use things like rapid testing when it's available and low cost for gatherings to make sure that nobody that day has any breakthrough cases of covid. >> yeah, in the meantime there was recent analysis by "usa today" that shows that more kids have been testing positive. this is driven of course by the delta variant, relaxed safety protocols and a lack of access to the vaccine for kids. how do we keep children safe in the weeks or months before they are even eligible for the vaccine? >> we do what we should've been doing all along, which is make sure that every adult and qualified person is fully vaccinated around them. children should still be fully masked indoors and be outside as much as possible. and if they're exposed they need to quarantine until they're tested to be negatived. they are still at risk for severe covid and unfortunately hospitalization and death until they also get the chance to be vaccinated. and, again, kids are in school now so they're out there more interactive with other people. so we need to make sure that the rules in school reflect best practices for public health. >> i found this interesting in texas. the gubernatorial candidate and conservative commentator allen west, who is not vaccinated, has contracted covid. he now has covid-related pneumonia. he mentioned that he was going to the hospital. he's opted for hydroloquine and ivermectin, which treats parasite diseases which many health experts have dismissed. what's your message to a person like that doing something like this? >> so, what's happening to west is interesting because getting a lot of retrograde information. he was exposed and then he was taking hydroxychloroquine and then ivermectin. and then he said he and his wife both got anti-colonial antibodies, who early on can get that and now it seems he's hospitalized. why would you take monoclonal antibodies after you're infected, synthetic antibodies when your body can generate natural antibodies from the vaccine to prevent you from getting covid?
