practically banned all abortions in the state of texas, is on hold temporarily. judge robert pittman issued a temporary stay blocking the law, as you said, stephanie, immediately appealed up to the circuit court. arguably the most conservative in the country. right now that law may only be lifted for a very short period of time. a lot of whiplash if you're a woman in texas trying to make such a big decision as this. right now the judge said the law was flagrantly unconstitutional. the court didn't get into the constitutionality of this law that they wouldn't weigh in to stop it's merely said procedural questions coming from a bench that shifted more conservative over the past few years. a few questions they wanted answered that now we finally have a federal judge weighing in on the constitutionality of the law, and we'll see how the circuit court responds when this is appealed. >> melissa, given how conservative this next court is, are they headed for a dead end? >> i don't know that they're headed for a dead end. definitely back to the supreme court. it's widely expected the fifth circuit, circuit court of appeals texas sits in, it was the court that originally stayed all proceedings in this case, which then prompted an emergency appeal to the united states supreme court. so i think what we know for sure is that this will likely be back to the supreme court on whether it is the respondent suing or the petitioners, it's unclear, but we're going back to the court at some point. >> barb, since the supreme court had a chance to rule a couple weeks ago and passed, any reason to believe this next potential time will be different? >> i think there is a chance that it could be different this time around. because robert pittman ruled on the merits, the status quo at the moment is to strike this down. as melissa said, depends a little on what happens at the fifth circuit, and i think there is an appetite at the supreme court to preserve this status quo so that may be the case. the posture of the case is a little different that might make it harder for the supreme court to ignore that. i also think that the attacks on legitimacy of the court we have seen since its decision a few weeks ago could cause chief justice john roberts and others to rally behind the idea we need to safeguard our presidents. i maintain a little hope we might see a different outcome this time around. >> melissa, what does it mean for other conservative states potentially trying to ready themselves to put in place the same type of restrictive abortion laws? >> well, judge pittman said strongly in this opinion about the procedural mechanism essentially a need of avoiding federal court review and injunction of such a law allowing a law like this to go into effect and said it cannot be a bar to any meaningful review of a law obviously that is unconstitutional. that puts other states on alert that this kind of ploy is not going to be rel-received. again, everything is up for grabs at this point. there's a major supreme court case on abortion that's coming on the docket, argued in december. these states may decide to move quickly, as texas did, biding its time and wait to see what the court says in this term about abortion in that other case. >> barb, this law bans abortion almost entirely. we saw marches last weekend across the country protesting it. what do the people in the state of texas actually want? >> well, it's interesting, stephanie. i think texas has become a little bit of a microcosm of what we're seeing across the country in that the lawmakers, the leaders of the state, are very conservative, but the people of texas are changing. in the past 20 years a 40% increase in population. most of those people coming in are people working in the tech sector. people of hispanic dissent, lgbtq community. people not on board in this. claim to power use gerrymandering and voter suppression to give an outweighted voice to those who are conservative. at some point i think that's a losing game. meantime, through these kinds of shenanigans they are maintaining hope. >> melissa, get a little technical for us. abortion service providers could be looking to reopen in coming days, but what if this block is temporary? gets reversed in the next court? what happened to any procedures that go on over the coming weeks? could they, could the people go after them rett pro actively? >> the texas state legislature already anticipated prospect of injunction and built into the law a proposition that says if the law is enjoined temporarily then that injunction later vacated or dismissed, the abortions that occurred while the injunction was in force can be prosecuted. there is no reprieve if this injunction is later vacated. providers who provide abortions, those who help individuals seek abortions or provide abortions during the period of this would still be legally liable under the law. >> all right. melissa and barbara and julia, thank you so much. important story. we will be covering it throughout the day. we turn now to capitol hill where a financial disaster may have been averted. going to say "may" in quotations. it's not over until it's over, but after there appeared to be raising the debt creeling in default. senate majority leader mitch mcconnell says he is down to lift it through december. kicking the can two more months, less than two weeks before the deadline. the chamber back in an hour from now with democrats set to accept his offer. going straight to leigh ann caldwell on capitol hill, and without reporter and politico, and mcconnell blinked but calling the shots how it gets done. where do things stand this morning? >> reporter: good morning, steph. mcconnell and schumer are still negotiating and working out the details of this agreement that hopefully they will actually agree on. so what happened is that mcdonnell did blink, and the reason is, because democrats were seriously considering changing the filibuster. changing the senate rules that cover this place a long time and that's the closests they had become to getting rid of some aspects of the filibuster. so mcconnell stepped in and gave schumer two offers. those offers, one is a two-month extension of the debt limit to lift it for two months, and do it by reconciliation, through this budget process that democrats are still united they are not going to do. the other is that republicans would get out of the way, and democrats could pass lifting the debt limit through regular order if they put a number on it. a scary price tag how much the debt limit has to be lifted by. so what democrats decided is, they kind of slipped the baby here, claiming victory saying we will take the two-month extension to lift the debt limit until early december, and we will say how much we need to lift it by, but are also ignoring mcconnell's demands about doing it through reconciliation and putting a final price tag on how much this debt limit has to be lifted. my democratic sources are telling me, look, they can't write that into the legislation. they can't right reconciliation requirements into the bill, and so they're just ignoring that and claiming victory that they now, they say, have two months of leeway to focus on the president's agenda and then they'll address the debt limit in december. but, steph, this is not solving the problem. this is just kicking the can down the road, because you know what hess happens in december? short-term government funding bill also runs out, and so they are just creating a series of cliffs for the end of the year. stephanie? >> eugene, you know republicans love big business and ceos. joe biden had some of the biggest ceos in the country at the white house yesterday specifically talking about the debt ceiling and they made it abundantly clear. this will mean economic catastrophe for this country. was joe biden basically calling mitch mcconnell's bluff saying i'm calling your mom and dad and they don't like the game you're playing? >> that is one of the things that, that the president and administration wanted and probably is going to continue to do. right? use the people, the mitch mcconnell republicans, as you put it, the mom and dad, to say, hey, this can't happen. we don't care about, you know, whether or not you want to play games. we don't care about that. you're messing with the full faith and credit of the united states economy nap is much more serious than anything else and i think that is a really interesting tactic by this white house. right? this is the white house with president biden, he's played good cop a lot of times when it comes to what's hallhappening o capitol hill. he knows everyone. he knows mitch. call mitch. speak about that letter from mitch mcconnell about the debt limit, but now you see him playing a little hardball. sending these people to talk to them. you've heard over and over and over from business leaders actually isn't a lot of stress this would happen, because to them they believe republicans would do something, as everyone's putting it, mitch mcconnell blinked. something you are continuing to hear from republicans, but whether that continues, you know, in december, how that shakes out right before the holidays is a big issue as well, but it frees them up. i think the would us is okay with that. right? to concentrate on the bill, concentrate on the reconciliation to not just find that top line number, which they still don't have. more importantly, the actual policy i think they want to be in there. for the administration, it's one less crisis they have to deal with right at this moment. >> that mitch mcconnell doesn't like disappointing big time ceos. i want to play part of what president biden said about this yesterday. >> doesn't have to be this way. my republican friends need to stop playing russian roulette with the u.s. economy. >> so is this, eugene, biden's plan this week? tuesday he goes to michigan. he goes to a trump-ish region, to talk infrastructure, and say, this is what i'm going to do to help you. yesterday he's talking to business leaders. is he saying to republicans, these games, do you think they're going to work on capitol hill? i'm going to go to your voters and they're going to care. >> absolutely. because that is -- this is something when i talk to sources in the white house, that they want every time for voters to understand what's going on. because something you heard from biden on monday. we were, the remarks, talked to us in the press a little bit who were the in there. he talked about your 401(k), your savings, what this could mean to individual persons. there's a lot of stuff we talk about on capitol hill, language that doesn't make a lot of sense. biden told his press team to do, comp team to do, drill, whittle things down so the american people who are sitting at home can really actually understand it. this is going to hurt you. this isn't just about us on capitol hill. this just isn't about my infrastructure but this isn't just about my agenda. that's the thing they're focusing on and continuing to focus on. i think as we get closer -- as we continue to fight about, they continue to fight about reconciliation he's going to continue to do that. so telling things to the american people and he's been doing that all year, really. >> let's get into infrastructure side. cut down to closer to $2 trillion. how will they do this? fewer new policies, fewer programs more permanent, or keep everything in there and have a much shorter amount of time? two very different strategies? >> reporter: very different strategies and that's exactly the debate happening right now. this, between the white house, democratic leaders, even rank and file members. we know president biden held meetings with different groups of democrats throughout this week, and each of those groups have different ideas. at the beginning of the week, the progressives told him that they need, he needs to include everything in his bill. just fund it. not for ten years like this bill is laid out, but fund it for five years, and so that will cut down the price tag, and then they're betting that voters will like these programs and it's going to be really different for a future congress and future president to not continue to fund these programs. meanwhile, you have some moderates, and i would say probably majority in the democratic caucus, that actually want to focus on a few specific priorities. climate change is one of them. the child tax credit is another, and then when you get on those two, it becomes extremely complicated on what sort of the care provisions they're going to include. paid family leave? is it going to be, you know, free community college? or free preschool? they have a lot of decisions to make, and something that's also complicating it is senator joe manchin and senator sinema. senator manchin, for example, on the climate change provision, that's what he wants rolled back, even though that's what most democrats say has to be in this legislation. senator sinema, as you know, has not been extremely clear about what she wants. members are not sure. i'm told by people close to her that the climate change provisions are actually the most important to her. so manchin and sinema, i'm told, are not necessarily on the same page. so the top line number is one debate stuff, but details where it gets really, really messy and going to be very complicated if they want to get this done by end of the month, which is their new self-imposed deadline. >> indeed it is. thank you both so much. i mentioned james cavil cavil would join us. technical issues. hopefully he'll join us tomorrow. coming up, changes in covid rules? but what have you been doing for the last two hours? ...delegating? oh, good one. move your xfinity services without breaking a sweat. xfinity makes moving easy. go online to transfer your services in about a minute. get started today. we've got breaking news in the fight against the coronavirus. within the last hour pfizer formally applied for emergency use authorization of its covid-19 vaccine for children ages 5 to 11. more on that in a moment. president biden today is heading to chicago expected to tout vaccine mandates for businesses. during the trip with state and local leaders. this after a new report saying mandates increased vaccination rates by more than 20 percentage points in many organizations and reportedly helped cut the rate of unvaccinated americans by a third. the white house also saying mandates could return up to 5 million workers to the labor force. we know we need it. overall, the u.s. has now surpassed 44 million total covid-19 cases since the pandemic began. and more than 710,000 americans have lost their lives. but nationwide covid cases are down nearly 40% since september 1st. a big number. erin mclaughlin is live in los angeles where the city just approved one of the strictest vaccination mandates in the country. and from idaho, the craziest fight ever is going on between vaccine requirements, between the governor and the lieutenant governor. and a professor of epidemiology with the field and school of public health. doctor, now that pfizer formally applied for emergency use authorization of the vaccine for kids, what kind of timeline are we looking for? >> this is great news. we're really moving forward in the right direction. it looks like they've scheduled a meeting for october 26th. that means we can expect this to go forward and potentially have the vaccine available sometime between halloween and thanksgiving. >> that is so awesome. erin, tell us how this new mandate is going to work in l.a. and how they're going to enforce it. >> reporter: well, beginning early next month, angelinas will wake up to a very different reality, stephanie. proof of vaccine required to enter any indoor public spaces from museums to restaurants to the laker game. now, there will be some exceptions allowed for medical reasons, or religious reasons, but those individuals need to show proof of a negative coronavirus cfb test within the last 72 hours. otherwise, they need to stay outside. now, this is designed to continue to push those vaccine rates up and keep transmission rates down. angelinas remember just how bad it got last winter when the health care system here nearly collapsed. los angeles was the global epicenter for the virus, and residents are eager to see that not happen ever again. take a live to what some ang lians had to say. >> this is just another precautious measure trying to get the city back to where it was before pre-covid. >> i'm neither for nor against it, but as the government, for the general population to protect as much as they could, i think this is one of the steps that they feel they need to take. >> there is so many people that don't agree with vaccination. i agree with vaccination. >> reporter: questions remain as to how the city plans to enforce this new requirement. they're still looking to see what department within the city will do that. what department has enough manpower to make sure the second largest city in the country has all the businesses within it complying. fines up to $1,000 for first-time offenders. any business shown to not be requiring a vaccine at its door starting next month. stephanie? >> doctor, love them or hate them, mandates work. cases are down 40% nationwide since september 1st. what does that tell you? >> i love that number. >> i love that number, too. i think this is really great news. and what it really means is that we're seeing the people who might have been on the fence, who had been waiting, are really getting pushed to get that vaccine. that's really important. every vaccine counts here. we're moving into a period of time, winter is coming. so we know that this virus tends to go up when it's cold, the air is drier and people are indoors. these mandates are really important in keeping the rates going in the right direction. we also have to remember that last year we also saw cases going down, and right now are trending in a much higher rate than we were a year ago. so it's very important to get as many vaccines into arms and to prepare for the winter's trend. that the trend continues in the right direction. >> where will we head going into winter? flu season is upon us. with so many more people questioning this vaccine, we could see less americans get the flu shot. how worried are you? >> i think it's important to be considering not only just covid but influenza, which is important. if you get influenza, your immune system will be compromised and you could potentially be more at rick for getting covid. it's interrelated. nothing's happening in a vacuum here. it's really important to remember that covid vaccines are critical. influenza vaccine doss what they are supposed to do, keep you from severe disease, hospitalization and death. very important to get your flu vaccine this year as well. >> okay, maura, i'm going to sit back here. i need you to explain to our audience what is going on in idaho? the last few weeks as we talk and idaho, talked cases surging, hospitals forced to ration care. some patients going to other states, and now you've got a legal battle going on between the governor and lieutenant governor all around covid. explain. >> reporter: and all around those vaccine mandates. right, stephanie? basically what happened, this battle playing out very publicly on twitter. like we've become accustomed to in the past five years ago when the republican governor brad little went down to texas for the u.s.-mexico border visit with other republican governors tuesday, the lieutenant governor stepped in saying she was acting in a role of acting governor to fix an executive order to disband a vaccine mandate ban, to schools, universities, also wanted to limit the requirement for covid testing in some places. the government, to note, had a vaccine ban for state agencies in place, but the lieutenant governor wanted to put in a larger ban saying she was acting in "individual liberty." steph, you might ask, why are these two republican top leaders fighting over this? because little ended up repealing the order when he came back to idaho last night after the visit. the thing is, here in idaho the governor and lieutenant governor are elected positions separately. the lieutenant governor here is further to the right on the conservative spectrum when it comes to our covid-19 policy. embattled the governor this entire time and next year running to unseat him. she wants to take the governor's job. we might see this in mid-term elections, how this impacts people's politics and what they're going to vote for. this comes as idaho is not in the same place at the rest of country. seeing hospital beds that are still really limited. only 16 beds left in the entire state, and some of those beds have opened in recent days, but, steph, not because patients are getting better. because they're dieing. the state only has a 42% vaccination rate. doctors here very frustrated and concerned, because they are the second lowest vaccination rate in the entire country. they say this confusion and doubt that is being put upon by these two leaders is really confusing to people as they're trying to message that vaccinations are key. one doctor we spoke to called it a political stunt and said it's shameful. steph? >> reporter: steph, good morning. the suspect right now is behind bars on a $75,000 bond. classes here canceled. you heard a reaction from one of the students there. how about the parents as well? some 1,700 students inside when this happened meaning steph, roughly 3,400 parents did not know for potentially hours yesterday whether their child was shot. police, you said, are investigating about a fistfight that prompted this violence looking at multiple videos. steph, they are disturbing to watch, we have to warn you. outside, heavily armed law enforcement blanketing timberview high school while inside students and staff on lockdown for hours following a school shooting. [ sires ] all of it enough to bring flooding oh motions from parents and terrified teens. >> calling and calming and calling my son. >> like, come here. for us, too, that isn't fair. >> reporter: police say 18-year-old timothy simpkins is in custody. just after a fistfight discharged his gun around 9:00 in the morning injuring four people. one critically. he's facing three counts of aggravated assault with a deadly weapon. >> we need help! >> reporter: arlington pd confirms they're investigating this video showing one student picking up another and slamming him slefrl times, but not confirming identity of anyone in the clip. [girl burps] over. facebook is under more public and political scrutiny than ever thanks to frances haugen's testimony on capitol hill. also they could face new legal scrutiny. s.e.c. chair gary gensler told me it's a possibility. >> public companies mislead the public, mislead the public in financials or they mislead the public in a material way in terms of their products, that can be a violation of securities laws. >> now let's stay on that and bring in kevin roos, tech columnist for the "new york times." gary gensler is talking about a publicly trading company, a fiduciary. strict mandates, many can't invest in vice investments. things like alcohol, tobacco, gambling, guns. they have in their charter we don't invest in these types of things. if, in fact, mark zuckerberg knew the problems that higs company caused, what it did to young people, couldn't that put him in legal jeopardy in terms of how he presented his company to investors as well as advertisers? >> it's certainly possible. i would say when facebook views publicly about these issues its often very careful to use non-committal words to say we might be looking into that. instagram might be have be this effect. careful not to taint things that could be construed at direct contradictions of what the fact says, but, yeah. i think there is a question about whether facebook misled not just investors but also congress when executives testified and said their internal research showed instagram and other facebook products were having a positive affect on mental health. turns out that's not always the case. >> certainly gets people excited. mark zuckerberg doubled down on it. we wouldn't obviously push hate speech. that wouldn't work for our advertisers. explain why that doesn't work. hate speech, calling it hate speech is wordsmithing. putting out content, creating con thaent gets people fired up, engaged and excited is what algorithms and advertisers love. >> absolutely. no button at facebook headquarters that says, "add more hate speech." that's not a thing they do. instead, optimize for certain other metrics. engagements, likes, comments, shares. turns out a lot of the most hateful content on facebook actually generates a lot of likes and heart reactions, because the audience it's targeted to are themselves pretty hateful. you see this over and over again where a machine learning algorithm will sort of label something as good on facebook because it's gotten so many heart reactions. algorithm says, good, pro-social content. heartwarming content. you look at what the content actually is, it's something about local parents shouting down a school board member. somebodying a trans teenagers in bathrooms. we would classify it hate speech even though it was liked. >> that's awful. facebook in the hot seat, facebook's in trouble. are they really? because the app, the platforms themselves, they keep rolling along. i know you track the top performing pages and your latest post says yet again number one is the far left. number two is far right. when all is said and done, was yesterday just a big show? are these a whole lot of headlines and nothing's really changed at all? >> no. i think yesterday mattered. i think this stuff is important, and i think that facebook is now under pressure in a way that it was not, say a month ago. but i think it really matters what the follow-up is. if congress does nothing, then there will be no significant changes at facebook. but if they use this as an opportunity to galvanize and come together in a bipartisan way to push forward, for example, federal transparency legislation that would require companies like facebook to disclose what the most popular content on their platform actually is that could go a long way towards fixing the problem. >> well, congress, the ball is clearly in your court. kevin, thank you. always good to see you. coming up, today. today marks the deadline for trump allies to respond to subpoenas from the committee investigating january 6th. but is there any consequence if they don't? we're going to dig into that next. as they say, if history tells us anything, the ansel, "no." it lo. ...hearing about it 24/7 is painful enough... i don't want to catch it. well, you can't catch shingles, but the virus that causes it may already be inside you. does that mean bill might have company? - stop. you know shingles can be prevented. shingles can be whaaaaat? yeah prevented. you can get vaccinated. oh, so... i guess it's just you, me and bill then. i'm making my appointment. bill's all yours... 50 years or older? get vaccinated for shingles today. alright. y'all know when they say your home is a reflection of you? well helene found herself in a lamp. no joke. i got a fancy grown up lamp to make me feel like a fancy grown up. mhm. adulting ain't easy. ooh! check this one out. waffles loves her dog bed. we can hardly get her out of it. she's kind of a diva. yes, waffles! living your best life. 'not just these four. there's 15 people subpoenaed in all. have any of them handed over anything? >> the committee has s declining to comment on that process. an october 13th deadline on the so-called hostile witnesses, whether they'll comply or not and the committee is not saying what has happened thus far. they are saying however they've spoken to cooperative witnesses, doing that in recent days but you're correct in saying that, in suggesting how they handle these four men, these initial subpoenas is going to set the tone and send a signal, a message to everyone else they try to investigate about how aggressive this committee is really going to get. are they going to use tools at their disposal, throw the book at the individuals in pursuit of finding out what happened on january 6th and everything that led up to it. >> the four men now just private citizens like you and me. sahil, thank you. coming up, we're going live to the swiss alps. keir simmons is there, the fastest disappearing glaciers in the world, he's going to give us a firsthand look at the dangerous impact of climate change. ♪ i'm a reporter for the new york times. if you just hold it like this. yeah. ♪ i love finding out things that other people don't want me to know. mm-hmm.
