democrats remain split on that $3.5 trillion reconciliation package. this morning congresswoman debbie dingell says despite their differences, democrats are determined to get it done. >> we have to get both bills. you can't have one without the other. we've got to get both of the bills. in my book, failure is not an option, and we're going to have to figure it out, and every democrat needs to know that. and new today the border encampment in del rio, texas, is officially empty. it comes almost a week after nearly 15,000 migrants, most of them haitians huddled in makeshift shelters hoping for the chance to seek asylum. some will get that chance while the others will be expelled. flights to haiti will continue throughout the weekend despite democratic opposition. joining us monica alba joins us from the white house, and julie circumstance at the capitol, good day and welcome to you both, talk about the significance of president biden releasing donald trump's white house documents to the january 6th committee. . >> reporter: and this is the white house saying alex essentially initially they're open to this, they're not going to assert executive privilege, but they're going to take this on a case by case basis. the reason this is so notable is that traditionally sitting presidents would use that to shield their predecessors from certain requests, but the point that the white house and press secretary jen psaki is really making and hammering home here is that they feel what happened on january 6th with the capitol riot was so important to investigate that it was such a dark day for democracy in their words that they would like the committee to have all of the information that they are currently seeking. what's of course very important to point out here is that on january 6th, former president trump was still in office. the biden administration had not started yet, but of course they're dealing with it given the months and the investigation as it continues to unfold. but take a listen to their justification for why they believe this is the right decision in this moment as the committee seeks more documents. >> i would say that we take this matter incredibly seriously. the president has already concluded that it would not be appropriate to assert executive privilege, and so we will respond promptly to these questions as they arise, and certainly as they come up from congress, and certainly we have been working closely with congressional committees and others as they work to get to the bottom of what happened on january 6th, an incredibly dark day in our democracy. >> reporter: and later in the briefing, alex, the press secretary did soften her language a little bit to say she didn't want to speak to hypotheticals that this wouldn't necessarily apply to everything going forward, but this was ultimately up to president biden, and that is how he felt in terms of this current request. what's also notable here is that former president trump has already said he's going to fight the subpoenas of these four former trump allies and aides who worked quite closely with him to see what information they can get on them. you see them there on your screen, of course his former chief of staff, his former deputy chief of staff as well as other outside advisers who were working with him in and around the events of january 6th. so even if president biden says it's okay for this to proceed, if the former president does have a legal challenge here, that would still make it more difficult for the national archives to process this request from the hill committee. so that part still needs to play out. but in effect, the white house giving the green light, allowing this investigation to continue because they feel it's critical to understanding what happened during that attack. >> well, look, you mentioned the word traditional, and traditionally that is not done, however donald trump really turned traditions upside down. perhaps this is par for his course. we will see. democrats on capitol hill are racing to pass the president's agenda. speaker pelosi says there will be votes next week on both the bipartisan infrastructure bill and the reconciliation package. nbc's julie sirken is joining us from capitol hill. >> reporter: good afternoon, alex, next week is going to be a busy one on capitol hill, let's dive right in. let's start with monday. both chambers will be back here, and there's going to be two big votes in the house and senate. speaker pelosi maintaining she'll meet that monday september 27th deadline to hold a vote on the bipartisan infrastructure bill despite progressives saying pretty forcefully they're not going to give her the votes for that one if it happens on monday. here's what she told me colleague garrett haake yesterday. >> madame speaker, how are you feeling about the monday vote? do you think they're still on schedule? >> i think we are on a good path. >> reporter: now, pelosi said they might even take up the reconciliation package next week, but it's hard to imagine that from my vantage point and a lot of others in congress, ask that's because progressives and moderates couldn't be further apart, even on what they want in a reconciliation package, and some moderates, even if they want a reconciliation package to happen this year. so as we move forward to next week, we know progressives are putting pressure on democratic leadership and president biden to delay that bipartisan vote until they have a more conclusive answer on that reconciliation package. now, turning to that second vote on monday in the senate, that will be on the continuing resolution. that's basically a short-term measure while they squabble out the details to keep the government open but without ten, i should say, they probably won't get there, and they'll have to decide quickly what they're going to do. that government funding deadline comes september 30th, alex. >> we listened to debbie dingell earlier, a soundbite from her, and they're saying they're going to get it done. is that the general consensus, the tenor of things there on capitol hill? because you've got really divergent opinions within the democratic party on whether or not this is going to pass. all sorts of hurdles they have to get through before, you know, warring factions say they're going to get on the same page. so is there truly an air of confidence are there where you are on capitol hill. >> if there is an air of confidence, i'm not seeing it as much as representative debbie dingell is saying it. that's because of my conversations with members. i came in last monday and senate warner was like we never had this many deadlines. we never had spending, we never had this many disagreements on infrastructure. we never did a package this big, so they're all on different pages here, and as recently as wednesday when moderates and progressives came back from their meetings at the white house, i mean, senator manchin was saying he's still good to wait, and president biden basically told them name your price that you can live with, so they are so far apart, it's hard to imagine how this happens next week as democrat leadership is assuring progressives and moderates. >> especially since there's supposed to be a vote tomorrow. all right, thank you so much. there's new reaction today to the official end of the republican supported audit in arizona, more than now ten months after the election. the report from the republican supported cyber ninjas not only reaffirming what we knew already that joe biden won arizona's largest county and therefore the state but also saying biden actually added 360 votes to the official election count from november. but if you thought the fuss over 2020 is finally over, do think again as texas has announced is going to launch an audit in four counties. nbc's steve patterson is following it all for us. okay, steve, we got the report from arizona, the official word. in fact, biden added 360 votes, right? what's been the reaction to that, and are there any concerns in texas that an audit in that state could produce similar results? >> reporter: i think how you're feeling about this is depending on if you're seeing this as a battle or a war. if you're looking at this as some sort of war to overturn the election results in favor of donald trump from this audit, then i think you're waking unfeeling pretty happy about it, 360 net votes actually for biden as you mentioned. the elusions to fraud largely disproven, and you can sort of hang your hat on the fact that at the end of the day experts are saying this largely was a partisan sham. if you look at the donations that were raised from this, more than $5 million in private donations and dark money. if you're looking at this and seeing the relevance of trump being kept in the public eye or the issues that were pertinent to trump supporters being kept this the public eye, you may see this as a victory if you're on that side. and then if you're looking at it and seeing what experts are largely saying about it this morning, which is sort of the erosion of trust in the electoral process writ large or the small drip erosion of democracy itself, then you may see this as a lost battle if you're a democrat and start to see the larger war. here's the secretary of state saying it much more eloquently than i ever could. listen to what she said about this. >> this whole entire process, this fake audit and the resulting report and information contained in there is just part of a multifaceted attack on election integrity and our democracy as a whole. but this report and the associated process of the audit will do is continue to fuel these conspiracy theories and these doubters in our elections, and that's not going to end anytime soon, and that is dangerous. >> and so we're now starting to see the efforts in other states, wisconsin, pennsylvania, and as you mentioned in texas, a state that donald trump actually carried. you start to sort of see maybe a larger strategy and sort of the gop across the country more interested in doing a similar sort of nature audit in similar states. alex. >> yeah, i know, it's just so fascinating. those four counties in texas donald trump won one of them. why don't we count that one, i guess we'll see what happens as a result of that. steve, thank you so much. joining me now is zerlina maxwell, host of the show's zerlina on peacock, and curt cordell la, usa today contributor, and democratic congressional campaign committee. first to you zerlina, what is your reaction to this report? i mean, months later, how much taxpayer money has been spent for a partisan audit and for what? >> well, it was in order to create a distraction from the fact that donald trump lost the election. they wanted to essentially create a circus and point over there and say there's fraud there. we're going to go find it, and then when they couldn't find it, they were like it's so well hidden that we're going to have to search in other states, and we're going to have to keep searching. i think that the reporting that steve laid out there is correct. it is about fund-raising in the short-term, but the long-term damage to the integrity of our elections and the faith that we have in our democracy is what every american should be concerned about in this moment because all of this fraudit here on the left side of the screen was based on a lie and it's based on a lie that actually has a dark underbelly because if you really listen to what the republicans are saying, essentially they're very, very concerned about the demographic shifts in the country. when they're going to review the vote of large majority not white counties, they're telling you that these coming demographic shifts are not in their favor, and they want to ensure they're able to win elections even when there are more people willing to vote against them. that is essentially saying that votes that are not white are not legitimate. >> yeah. to your point, and curt i'll go to you with this one, there's a new article on nbcnews.com, it says while the audit in arizona may not be over, the influence is just begin. there's a quote from kate fan who's a republican who says we need to do bigger audits on every election just to make sure that everybody's following the rules. really? bigger audits, curt? i mean is this going to be the norm after every election now? >> it seems to me like the republican party position -- and really the only position that they have is that if they don't win, then the election must be rigged, and they're going to keep doubling down and tripling down on this until they make it a reality. i mean, democrats need to wake up and realize something right now. this attack on our democracy needs to be issue one, two, and three. this is why getting voter rights reform done has to be an essential act of self-defense of our democracy because it doesn't matter what we do on all the other issues if at the end of the day every election going forward means communities of color don't get to vote. people who are disenfranchised don't get to participate in our democratic process. the republican party's intent on mandating an extreme radical minority view on the rest of the majority, and they're doing anything that they can and using all the levers of power that they have at the local and state level to do that. democrats i'm pleading with you, wake up to this. all the squabbles about process, all the squabbles about parliamentary procedure, none of that matters in the shadow of what is happening right now, this concerted, this organized, this deliberate, this craven effort to permanently hijack our democracy and impose radical extreme views on the rest of us. >> to your point, yeah, let's talk about texas, what's happening there because texas comes under pressure from trump , and then announces a full forensic audit across those four counties, i make the point, one of which he won. trump publicly calls for it, eight and a half hours later there's the announcement it's happening. why is this happening in a state that trump clearly won, i'm trying to understand that, and why now? because it could set up not just a potential legal showdown but a political one, and biden has said so many times he just wants to move forward and look ahead. does january 6th require being accounted for to allow the biden administration to move forward? >> yeah, i think it does because the reality is january 6th isn't going to be an isolated incident if the republican party has their way. we're past the point where we can just dismiss their rhetoric as oh, they're just being hyperbolic. we know when they say show up somewhere, when they say we need to take our country back, that is a call to action that results in an act of domestic terrorism that we saw on january 6th, and if getting to the bottom of a domestic terrorist attack on the united states capitol isn't worth an investigation, isn't worth a comprehensive point by point breakdown to find out the totality of what happened, why it happened, who was beyond it. if we're not willing to do that, what's the point of even having a democracy. this investigation is a defense of our democracy. the american people have a right to know what happened, why this attack on their country, on their capitol happened, and the only way that we can potentially prevent something like this from happening again is if we get to the bottom of it. imagine if after 9/11 we all just said you know what? let's just move on. what if we said, one of the two political parties said one of the two people behind 9/11 is actually a patriot? what if we started labeling them as patriots being held willfully against the law. that's what the republican party is doing right now. we cannot allow ourselves to -- the republican party to whitewash what happened and to try to get us to move past it just because they're afraid of the political consequences. every single person from kevin mccarthy to steve bannons to mark meadows needs to be held accountable about what happened. >> i hadn't thought about it in the 9/11 terms that you just presented there, but that's powerful. asdown donald trump is talking about invoking executive privilege. my question is is that a legit defense? does that hold water now that he is a former president? wouldn't executive privilege apply if he were currently president, felt that there were things that shouldn't be put out there in the grand ether, for the security of the country, for the position of the office, that doesn't hold any longer. >> well, you just laid out very logical and substantive arguments, alex, and that's not really donald trump's m.o. so whatever his lawyers argue in a court in terms of executive privilege, that will be decided by the judges in those cases. i don't necessarily think in this context, though, he has, you know, say as strong of an argument as he did during the two impeachment trials, for example. and i think that in this case, the house committee in this moment is basically the only entity looking into seriously that we are aware of donald trump's actions as it relates to the attack on the capitol. and i do agree with kurt, that was a terrorist attack. if those folks storming the capitol were any other color than white we would see that for what it is because we are conditioned in our culture to see that, and we're not seen to see white men and white faces as a threatening thing. ron johnson even said that out loud. he said if those were black lives matter folks i would have been nervous. but those were my people. i think it's important for us to be clear eyed in this moment. we want to prevent the next attack on the capitol. that is a real threat going forward because republicans not only are going along with the big lie, but they're scared to call out calls for political violence, and that is, again, antithetical to our democracy, and every single citizen, every single person needs to understand what's at stake. >> so these four subpoenas that are out there, zerlina, what kind of questions would you want answered? >> well, i would want to know what kash patel was doing, because he was the person put there weeks earlier and essentially was the one they were calling to find out when the national guard was going to show up as reinforcements because the capitol police were calling for help. i would also want to know what conversations mark meadows had with donald trump because he is the chief of staff, although that might go into the area of executive privilege. what doesn't, stephen bannon. stephen bannon has essentially said on air waves that he wanted to kill the biden presidency, and it will be crazy tomorrow. that was on january the 5th, alex, and so i think it's important for folks to understand exactly what these folks knew, when they knew it, what money went into financing what we saw on january 6th and also what conversations the president was having during the attack because we all watched it, and we were all like where is the national guard. and we want to make sure that doesn't ever happen again. >> hey, kurt, i'm going to have my director steve put up a column in the usa today this week, in which you pose this question about whether or not the worst is behind us, and you make a pretty good argument that you think the worst is still yet to come. talk about that. >> when we see that one of the two major political parties in america is intent on advancing lie after lie after lie, conspiracy theory after conspiracy theory, that they traffic in such insane rhetoric that their followers, their audience consumes as bible, as fact, and it results in something like we saw on january 6th, that's a very dangerous and destabilizing element that is happening right now before our very eyes. and you know, they have the justice for j 6 rally that fizzled out last week, and i don't want anyone to interpret that as, oh, it's over now. we can move on, you know, they're not going to be able to do what they did on january 6th again. that would be a false flag, that would be a false sense of security. they're not stopping. look what they're doing in arizona and texas. look what they tried to do with the california recall, how they tried to explain why they got shellacked at the polls. there's always another reason, always another excuse, always another conspiracy theory. a lot of us have been sitting around for the last five years now asking what's rock bottom? when are they going to figure it out? there is no rock bottom. there is no end to this. they're just going to keep going further and further and further away from reality, and they're going to take their cult-like following with them. that's what cults are, and really a lot of the tactics that they're using to radicalize the republican party, this is exactly what terrorists do in other countries. this is exactly what we fought against for the better part of 25 years in afghanistan. that's happening right here at home right now by the republican party, and it's not going to stop. we need to be on board. every democrat right now that's facing the question about what to do, they need to imagine 2024, january 2025, the election has happened. republicans controlled congress. joe biden gets reelected perhaps, and the republicans in congress won't certify the election, and we're in a constitutional crisis. that's what the stakes are. >> okay. kurt and zerlina, it's always good to get your insights on everything. and for those of you who want a little more of that, you can catch zerlina weeknights at 6:00 eastern on the peacock streaming channel, the choice, from msnbc. donald trump is unleashing his lawyers to settle scores against his niece and the "new york times." but will he succeed? man, that's terrible. the eat fresh refresh™ at subway. it's too much new to fit in one commerc- nothing comes between me and my music. but subway® has so much new it didn't fit in their last ad. ♪ subway®'s got so much that's brand new ♪ ♪ they rented time in this ad too.♪ ♪so now in this track they rap about all the meat they stack.♪ ♪ deli-style turkey all up in your sub.♪ ♪ cut to the new all-american club™.♪ donald trump is gearing up for a rally in georgia today as the prosecutors move forward with their criminal probe into his efforts to overturn the election. last week trump sent a letter to georgia's secretary of state asking him to reconsidering decertifying the election results ten months after he lost. former president donald trump is taking legal action against his niece and three "new york times" reporters filing a $100 million lawsuit trump says mary trump conspired with "the times" to get his tax return for a pulitzer prize winning story about his apparent losses and tax avoidance. the suit alleges "the times" pushed mary trump to smuggle records out of her attorney's office. mary trump has responded to the lawsuit saying, quote, i think he is a loser and he is going to throw anything against the wall he can. joining me now is trump's former personal attorney, michael cohen, author of the "new york times" best seller "disloyal" and host of the podcast "mea culpa" with michael cohen, which is certainly one to tune in to. let's settle in here. i've got a bunch of questions for you. we're going to take some time and go through them. first question comes from mediaite, which says that trump admits in his suit against his niece that the "new york times" story on his taxes which he previously calls fake news was real. so do you agree, does his lawsuit contradict his previous claims? >> okay. everything about donald trump contradicts his earlier claims, and then what he'll do is tomorrow he'll make another statement and he'll expect that everybody should acknowledge that statement as the truth. with donald you never know what the truth is and what's not, unless of course you're in the inner circle, in donald's inner sanctum. let me go back for one second and talk about this lawsuit against mary trump. to those people who follow donald trump, you might remember that there was a case called trump versus timothy o'brien and the "new york times." it's eerily reminiscent of what he did many, many years ago. the only difference is that donald at that point in time sued for $5 billion, right? it's as ridiculous as this lawsuit against mary trump for $100 million. but what makes this case very difficult than the other case is the fact that it's predicated on a non-disclosure agreement. you know, non-disclosure agreements are paid in order to get somebody to do something or not to do something, not to reveal something, and clearly he must have given money to whether it was to mary trump, to her father, to somebody for that non-disclosure, but the part that we don't really know is what's written in that non-disclosure. first of all, is there a duration claus? we don't know that. more importantly, was the non-disclosure agreement predicated on fraud, which is how donald ended up screwing over her family, screwing her over for a significant amount of donald's father, her grandfather fred trump's estate. if in fact, that's true, then the nda could seriously be declared null and void. but what makes this even more interesting to us as a public, is the fact that if i was mary trump and her lawyer, i would turn and say don't fight this. just answer the complaint and look for depositions. let's look for discovery because one thing for certain -- and i have read dozens of donald trump depositions. they are the dumbest written paper that you've ever seen, nothing makes sense. everything is circular. he will -- he does not want to do depositions. right now i'm in a lawsuit against the trump organization. i have asked for depositions of donald. they are adamant that they do not want him to sit for depositions because he doesn't know what he's talking about. even if, in fact, it deals with him, he is absolutely clueless, and he lies so much he doesn't even remember the lies he told yesterday. >> wow. on a scale of one to ten, what do you think the chances are of this lawsuit succeeding then? ten being it's going to get it. >> maybe a one. you know, and on top of that, if you look to see what donald did, donald hired this young attorney, i think her name is alana hava based out of bedminster, new jersey. now, of course we all know that's where he hangs out in the summer. that's where he has the golf course. chances are he probably walked over to her table during the summer while she was eating a mar-a-lago burger or something like that, and you know, asked her what she does. she says i'm an attorney, and so he hired her. and you know, she's taking it as this is a great client to have on my resume. alana, it's not. rest assured, you know, mary trump is going to come with the full gambit. she's this young attorney is not -- this is not her field of expertise, and she should not be taking on this case. first of all, it's just plagued with nothing but problems. >> so do you think donald trump picks an attorney of this caliber that you're describing because nobody else will take the case? >> i don't think anybody else will take the case, for two reasons. one, because deep down they know that it's a loser and they don't want to end up, you know, making a fool of themselves and their firm. and second, you know you're not getting paid, so what's the point? >> okay. so i want to move to the manhattan d.a.'s investigation into the trump organization. a lawyer for trump's cfo alan weissenberg revealed in court, michael, that prosecutors have discovered millions of pages of evidence in the basement of a co-conspirator in the trump organization tax fraud case. what can you tell us about this? have you heard from prosecutors at all about potentially helping them decipher it? >> okay, so obviously as i have said on this show and many others, i don't get into the sum and substance of any of the claims or the actions of the district attorney. personally, like everybody else i would like to see the case progress quicker. rest assured that i have met with the district attorney and spoken with them as well as the a.g.'s office about a dozen times. any questions that they may have regarding old information, the newly found documentation, i am here on home confinement for another 57 days, so i am readily available to answer all of their questions. >> i love the way you say that, what else i got to do? anyway, i got -- >> it's either that or netflix. it's one or the other. >> weisselberg's attorney said, michael, that they have strong reason to believe that other indictments may come ahead of the trial. it is scheduled to go about a year from now. do you agree with that, more indictments? >> yeah, i do. there's going to be -- and it's -- look, anybody that thinks that allen weisselberg is the big fish in this scheme, they would be sadly mistaken. i know right now that obviously it's been reported calamari is under investigation as well as some other individuals at the trump organization including the children. so, look, the big fish is clearly not allen weisselberg. he is merely a cog in the wheel in order to get to the ultimate prize. now, mind you, the d.a. and the a.g. have millions of documents all on donald trump's taxes, what we know about the valuation and the devaluation of assets in order to increase his net worth for certain tax -- i'm sorry, for certain loan benefits, but you also have the devaluation of the same assets for the purpose of tax. and this is a multiyear situation. this didn't happen just yesterday. this is exactly the allegations that are being raised in mary trump's litigation, that he devalued the assets for purposes of how much that he would end up paying the other members of the family. so this is a long and protracted methodology that donald trump employs. you also have others that are involved in it that are part of the trump organization, not just allen lberg, not just matt calamari, not just don, ivanka, eric and so on, there are other people as well, and i leave it to the competent hands of mark pom ranz, cy vance to bring this full circle. >> let me ask you about weisselberg as he faces up to 15 years in prison if convicted. does weisselberg stay on team trump, michael, or does he flip on his boss? >> you know, i hate to use the term flip or rat and so on. i still get people in the park that want to pick fights with me -- >> i get that. let me rephrase it then, does he want to tell the truth about what he knows and not flip on his boss? you're right, you make a really good point there. >> so the answer is, he does not want to. he's extremely loyal to donald working for him for over 40 years. the problem is his children are also implicated. you have barry weisselberg who is residing in the property, and i know you've had jan weisselberg on the show several times. that's number one. number two, you have jack weisselberg who is involved with latter capital who is the second lender other than deutsche bank to loan money to trump, and there's issues with those documents. and so the question is going to become who is allen more loyal to? is he more loyal to his sons or is he more loyal to donald trump? but really, the big issue like when i finally woke up and snapped out of the cult, am i more loyal to my country. on top of my family, of course it's always my wife, my daughter, my son, but what about my country? all right? you have to understand he's got grandchildren, eventually he'll have great grandchildren, and so are you more loyal to donald trump who as we all know with the january 6th insurrection was really using it as a coup, or are you going to be more loyal to your family and to this country? and i think the answer should be an easy one for him. >> okay. as always, i have more questions, so please, michael, stay with me. i want to get your take on the january 6th committee going after trump's advisers. up next, how will all of this play out with donald trump? i mean, do you think executive -- is it because of executive privilege? >> yes. >> okay. go right ahead. >> let me start with the -- let me start with the most obvious, you're not the president anymore, donald, all right? and so executive privilege relates to -- it would be for joe biden to invoke, not for him. i know that he thinks he's still -- and there are still these crazy people running around believing that donald trump is the president. he is not. as far as, you know, dan scavino, i've known dan now going back to 2007. dan scavino used to be with the general manager of trump national in westchester, and the fact that he's become a deputy chief of staff and so on to me is comical. then again, you put all four of them together, steve bannon is one of the craziest people you could ever meet. i mean, in all fairness donald had told me when i was with him in the oval office, i talked about this in my book, "disloyal" that the entire decision to have the immigration ban, which was against muslims, was really steve bannon and steve miller's idea, which of course did not go over well for steve bannon. how he keeps coming back into donald's orbit, the guy is absolutely just nuts, and mark meadows we already know, i have no regard for him, and kash patel, that's going to be the most interesting of all four of them. what was he doing and who was he talking to? but one thing i want everybody to remember here, it's not going to be as easy as people think simply because donald trump doesn't have an email address and donald trump doesn't text message. what you have to do is look at everybody else, and you have to look at what dan scavino was, for example, saying to mark meadows. what mark meadows was saying to kash patel, what steve bannon was trying to interject on his own behalf, and then, you know, obviously they call him the boss, they call him, you know, mr. president. they would call him djt, and you have to put all of those messages together because donald would never be involved in any text message. and again, he doesn't have email. >> so that's interesting advice, i'm sure the investigators are doing just that. here's my question about these four, should they end up in front of a house committee, do you think, michael they have anything or could say something that would incriminate donald trump? >> there's no doubt that there's information, whether it's text message or email. one of the things that i also saw is the investigation that's going on as far as subpoenas to don, ivanka, eric at the trump organization, and you know, what i would probably surmise that they've already done is they probably have changed the protocol. before they never used to get rid of emails. now they probably do it on a three-month or six-month basis, and i wouldn't be shocked to ultimately learn that they changed the entire server system and that's probably hidden someplace in one of donald's storage facilities. but the answer is, yes, do i think that they're going to show up? no, i don't believe that they're going to show up. i think that they -- donald has taught, if anything, that you don't have to show up for subpoenas, and despite the fact what adam schiff is going to say, well, we're going to take serious action. okay, you'll give him a monetary fine, and you know, what are you going to threat en them with incarceration? i'm the only dope that ended up getting incarcerated for, you know, lying to congress. had i not gone in and not said anything, right, despite i did it on donald's behalf and everybody knew what, again, it was a ridiculous lie, but what ultimately ends up happening is you're going to get a financial, you know, situation as opposed to incarceration. and that's the saddest part, that there is no method right now of forcing them to speak. and even if there is a way of putting them in front of the committee, they'll take the fifth. i mean, that's how crazy these ak lites are right now. they have shown the country, they've shown the world exactly what you need to do to avoid a judicial or a congressional subpoena. >> wow. let me ask you quickly about another big legal story from trump world. it's involving the big lie, according to the documents obtained by the "new york times," the president's lawyers knew their claims about the dominion claims were false, and yet they keep making them for weeks. what do you make of that? should there be consequences for that? should this be the end once and for all to the big lie? >> it's never going to be the end because donald will continue to perpetuate the big lie and these people will continue to go. anybody that is silly enough to believe for a second that this wasn't a lie against dominion voting from day number one, this is typical donald trump playbook, right? attack the system, attack the system, attack the system. and then all you need is to find one vote that is improper, and he will then use that as the denominator, right? so you could have -- instead of a billion, right? >> well, thanks, alex, it's always great to be with you. yes, in about an hour, our budget committee will convene. we are putting together all of the various parts from the other committees in the house of representatives into one budget resolution, which we will then transmit to the rules committee. that will occur by tonight. we will have initial discussion, a vote followed by three or four hours of republican ranting bearing little relationship to reality, and hopefully this next week the rules committee will be ready to act on the reconciliation bill, or the build back better, which is what it's all about. as they continue in their work, negotiations with the senate will continue because we would like to see a bill approved in the house that can also be approved in the senate. and as you know, it's still a little bit of a mystery as to what senators manchin and cinema will agree to. >> so with the monday deadline that nancy pelosi gave moderates for the vote on the infrastructure package, first of all, will there be a vote on monday, september 27 was the date she gave, and if so, sir, how can it pass given progressives saying they're not going to vote for it until the reconciliation package is ready? >> well, i'm one of those progressives. i believe that the speaker and the president made clear at the outset they want both of these packages to go together, and with senator manchin saying within the last few days that he'd be content to have the second larger social service bill postponed until next year, which might be never, we have to move both of them together. yet, we want to respond to our public transportation, our highway needs, but we also need to respond to the many women in our society who for lack of child care, who for lack of family medical and leave burdens they particularly bear, though they apply to men as well, that we respond to that. i'm very concerned as the health subcommittee chair that we assure the affordable care act remains affordable, that we provide essential benefits to seniors, and that we close the gap that has left 2 million of my neighbors in texas without any benefits in the affordable care act. the educational opportunities in this bill to really build back better by assuring more americans individual educational opportunity from universal, prekindergarten to community college. >> congressman, as you well know, the president with key moderates and progressives at the white house this week, i'm going to confess i did not get a read out of exactly who attended. so did you attend as a self-described progressive, and if not, what did you hear about those meetings?
