from donald trump to the secretary of state in georgia, brad, and in the letter trump asked him to start the process of the certifying the election. and i know we read a lot here on the program it's to prepare the show for. you sometimes are paying very close attention, sometimes are in the proofread. and i thought oh and you document had surfaced from those heavy days between the november election and january six. those days when donald trump was trying everything he could to and the american democratic experience. you know when he was attempting to install himself a loser over the candidate who won in clear violation of the rule of law and the will of the people. but i was wrong. trump said that will letter for days of go. on september 20 need 20 1:17. and it is a reminder that may have moved on from the last election, donald trump is not. and the fraction of american politics he controlled, and controlled has not moved on either. and that friction controlled one of the two viable political parties in the country. which is to say that faction is just a coin flip away from seizing card anytime. so we have dodged a bullet of the 2020 election. but we are still getting the reminders of just how close we came to losing this democracy. and how active the threat remains going forward. yesterday another document underlining precisely that threat became public. now this one actually is from that period between the election in january six. it is a memo written by a right-wing lawyer by john c. eastman he is a member of the society, actually he recently coauthored an opinion piece for fox news with none other than john who. was the legal architect of the torture regime under president george w. bush. now john c. eastman i'm going to try to put this as charitably as possible, john c. eastman is somebody who's willing to argue for views in positions that the vast majority of constitutional scholars would not just reject. but left it. for instance, questioning whether kamala harris is a national born citizen. and therefore eligible to be vice president. that piece that johnny's been wrote last august you'll never guess, donald trump, who's always looking for one or two people who will agree with him to give him some gravitas for his nonsense. and so you'll never guess when it came time to overturn a democratic election, john c. eastman became one of trump's go to people basically arguing for it could be. i don't genuine for the new york times reported that john c. eastman was delivering a last-minute pitch at the white house, to trump and pence about what the vice president could do to overturn the election on january six. in his new book bob woodward and robert costa reported more details about that >> woodward acosta also obtain these memo in which he lays out the six-step planned he presented to trump and pence that day. as he tried to pressure the then vice president into a seizing power. the memo described, blow by blow, how he saw the skin playing out. and the key point in this scenario. is he's basically for mike pence to serve the whole democratic process of the country. he called on pence to convert what is administered a role, presiding of the counting of the votes, into a substance vote, in which pence declares a lot of electric themselves. and therefore throws the election to the house of because they had 26 state caucuses they would prevail. and what that would mean to extend john c. eastman logic, is that the vice president, the sitting vice president, residing of the accounting of electoral votes could always essentially veto the election. could just side that i don't believe for the next president is. or i could just throw the votes of the house. or congress giving the vote to the american people. why have an election in the first? plus obviously if that was a case america would not be a democracy. and in a recognizable sense, here's the thing, it's really not clear what would've happened if mike pence had followed john east and. we don't know. we do know that pence was trying to that he was kooky areas if you will. according to one wooden costco he called dan quail, they've described quill as adamant telling him >> and ultimately as the mob of trump supporters at the capitol chanted hang mike pence. and they bashed in the heads of police officers defending the building, pence did the only thing the constitution would let him do, he did the right, thing the only option, to the great just disappointment of john easton who spoke at the rally that morning. famously. a heavy insurrection. and then denounced the vice president on the same show that evening. that's after the crowded storm the capital costing several people their lies after the cops heads have been bastion on live national television. one week later falling processed about his participation on january six john c. eastman had to retire at his job at a california law school. but we basically retired in comfort. he is still a member of the federal society, so good jobs that will society. ultimately he's part of an important story from the last election. that there were more conservatives ultimately in key positions who are willing to do the right lawful thing than those are who are not. there were more brad raffensperger than donie stones you might say. he is a notable figure because just of how much pressure has been put it on him in his state and. are we now know the full scale of that pressure point. he was given an unlawful -- brian kemp urging him to persuade the state legislator to overturn president biden joe biden's victory in the state and asked the governor to order signatures >> and now infamously the former president place are long called to secretary state brad raffensperger to try and get him to change the outcome of the vote. that's interesting we found another, way i always wondered what that is, i think it's probably the eastman plot that he's talking about when he says he found another way. i don't know. eight months later trump is still at it. with this letter again. it was sent four days ago. this september claiming >> brad raffensperger is now facing a primary challenge who trump is indoors, and another trump endorsed candidate running for state so native, is one of the key he was outside the capital on january six he has been involved with the preposterous arizona audit. he wants to oversee elections in the state of arizona. so just imagine if both of trump's candidate had stopped -- if they're in power and the swing states in 2024 rule around, and that john eastman member gets dusted off. i hate to tell you this is a possible future. on the state steps are taken to prevent it from happening. and who better to discuss this than georgia secretary state brad raffensperger himself. his new bergen tech really counts is out, and he joins me now. it's good to have you mister secretary. maybe let's start with the reaction getting that weather in symptom or 17 on the expert saying that you're still stonewalling the proven facts that the election. well we're not selling anything, the point that the county reopened we relation probably three or four weeks ago, and were continued to investigated. and i want to have all of the filing of the reports that will handed over to the state election board in this position. at the end of the day it's been really now pushing ten months now since the november election. but we continue to fight disinformation, i'm all this election every allegation was made, which i put in my book we ran down the chaplain and we fonda that it wasn't supported by the 66,000 of underage voters there were zero he said where they are 10,000 dead people, that's less and a handful. there's things like that and it takes time to do that, but we do our re-search, and we do isn't based on the fly. so it's just an issue that we have. i'll see you and i do know at the end of the day we have honest and fair elections and make sure that while all of the constitution and follow the sale. in terms of following the law he recorded that i think someone in your staff recorded the conversation with the president. you know there's this debate about what exactly to call the thing that we saw unfold between november and january. culminating in that violet mom, contesting things how do you characterize the president when he tried to do in the phone call? >> this goes really modeled after acted in all serious a reformer, designed to address the abuse and such as the nixon administration. this kind of package of reform exported and expedite congressional subpoenas. . so that we can't do administration and four year after year after year. it strengthens penalties for violating the hush. so white house can't hold a political convention on white house grounds. or reduced federal employees are campaign workers. it protects against the use of the part and it told statutes limitations for president who commit crimes. so they can't simply avoid the prosecution. -- it protects it inspector generals it protects whistleblowers it strengthens the independence of the social justice department. and chris that just a partial. is >> what seems to me that you can imagine a world that this could be bipartisan, insofar its congressional subpoenas. you know there's a partisan interest, air and then there's a different branches of government interest. you know, much of what trump did much could say that it rendered congressional subpoenas pretty empty. i imagine republicans are gonna want to use that power again. but i think i know my answer to the question. but do you have a republican interest in this as well. >> well chris i hope that we will, you know of course they live in so many that are in fear and the statement of the former president of criticizing. them or supporting the pro-democracy appears as if it's v to say this conduct of office. so we have to get over that fear factor in terms -- of many of the reforms the, individual reforms in this bill, passed the republican support in the, pass some of the republicans were leaders of effort in order to protect the general admissible. some republicans introduced legislation in the past two to expedite the congressional subpoenas. and i would hope that they would recognize, look these are things that they should. what no matter who the president of the united states. this they ought to be defending their own institution without oversight. we can be effective. >> i want to play for you what i just said on that question, which is the secretary state of georgia, i asked him about compliance, and corporation with the generators committee, here's what he had to say. >> the vice president in the meeting i had in the oval office with him on the president on january 4th, specifically asked me, do you think i have the authority to simply unilaterally decide gina mccarthy that certain of these electoral votes are invalid? and i said that's an open question this is a direct code and whether or not you have that authority the fact that the legislatures have not defied the alternate slate of electors, would make it foolish to exercise it. and that's why at the end of the day what we were asking was simply that he had pleaded requests from a number of the state legislatures, and to delay things so that they -- were not coming back in the formal session. the governors were viewed the calling in the formal session today with, this they were now back in the normal section, and they wanted to look at it. >> that was obviously not the secretary of state of georgia, that was the conservative john eastman who had been advisement the former president of how to get mike pence to overturn the election unilaterally. through a very tortured reading of his constitutional duties. it seems to me that the late to the project that you're engaged, and in so far as the ultimate power using the power of the office to stay in office. which is was contemplated here, and what it seems to me needs to be a firewall against. >> well absolutely weather was the right quid or, not both are very pertinent and intuitive for the january six committee. we are going to be making an excuse of recommendation about how to protect our democracy going forward, from efforts that you just heard described. where they would continue with the spirit of the, law and put our country into a constitutional crisis. by trying to overturn the clear election results from the will of the voters. so will be addressing that on the january six committee. in terms of the georgia secretary of state said, and we already talked about how we might corporate the committee, and now that we have republican staff as we have democratic staff, look our committee as a cardigan. our members are bike artisan, our staff is bipartisan, and our work is non carbon but i there's no reason why the secretary could not -- with us i think he's got an important story to tell the american people but i will say, this you don't get to pick and decide. i like this committee i don't like this committee. when you get a congressional subpoena. you have to comply with. when you get a request for information we hope that you do so voluntarily. >> yeah i guess the question and what is the lesson you've learned from -- i mean you've got a sort of statutory fixing the legend so issuing that you propose today in the subpoenas. what's the lesson that you've learned about tactics or pressure that document requests from the stonewalling that in some ways ended up being partially successful from the trump vote? >> well clearly deployment of clean energy is increasing last year we saw solar was the big winner and we expect to see solar moving forward again. but the challenge that we're facing is if you look at the science, it tells us that this is the decisive decade that's why the president is standing up at the un general assembly and talking about what we need to do now not 15 years from now and not 30 years from now but how do we take advantage of the shift to clean energy use it to grow, our connor me both in both the developing world and the developed world. and how do we use that to grow jobs and build opportunities for people. this is the critical moment chris, i think you know it, and i do. which is what we're looking for significant investments from congress, so that we can accelerate the paste of clean energy now. but how can that be achieved if the climate provisions of the reconciliation package are being offered by individuals who have a very invested interest, and i don't think it's a slander against him to say this, i think he would tell you the same, was invested interest for political and other reasons to extend the life of fossil fuels extractions as long as it's possible. well i think senator manchin has been a good i live for the president as he worked on the infrastructure deal. and we received a good outcome from those negotiations and we're working now with senator manchin and with his staff, and with others on the hill to look at provisions in the reconciliation bill, that are going to be essential. the senator manchin is not the enemy senator manchin is working with us every step of the way, and ensure he has questioned, sure he has concerns but we're working through them, and i fully expect that we're going to get a significant investment in the reconciliation bill that is going to help us drive this decade to a cleaner energy future. which we so desperately need if we want to maintain a security our safety and our health. is the u.s. gonna meet its paris target this year? sure we are going, we have actually released our commitment level financially which the president had announced today that we are going to move forward to make sure that our prayers commitment which are about getting us on the path to reduce utility admissions or electricity admissions by 80% by 2030. we're going to have clean electricity by 2035 who are looking at reducing our overall greenhouse gases admissions by 50 to 52%. and by 2030, and we're going to get to net zero by 2050. but i think the icc report, has shown us that we need to be as aggressive as possible. even at the goals we just indicated we really have to move forward this decade. or we won't achieve the kind of escalated productions that the world needs to protect ourselves and give our kids a good future. but we will need our commitments >> the chinese president announced that china will not build new colts by a power project that build a broad. how significant is that? >> it's a big deal because i think those of those who follow these issues know that china has been funding significant amount of cold, utility investments across the country and i think it looks important for all of us including china who is the big carbon admitted right now to actually work together to make sure that we're not just transitioning our own economy but expanding the resources necessary to deal with this worldwide. >> finally the president issued an interesting new regulation or at least a direction for a federal label status in the protecting workers from the impact of rising temperatures linked to climate change and we saw during that heat wave numerous people died on the job outside why take this step? >> well excess heat, or heat stress is called the silent killer in climate we look at the wildfires which you've mentioned the hurricanes the flood and the drug we can all, see that but the silent killer is heat stress. when we saw in june of last year and this pacific northwest, we had high temperatures than we have ever seen before. and temperatures across the country are record breaking. that resulted in hundreds of excess gases thousands of emergency room visits. so we put out a plant that across the government were all working together to identify ways that we can address heat stress and allocate money to keep our seniors safe, get cooling centers in our schools and yes protect our, workers with newly-bystanders. >> -- gina mccartney thank you so much i appreciate it. >> thanks chris. >> coming up we have the first lawsuit under the new texas abortion law, and it's a pretty bizarre situation to be honest, i'll explain why and what to expect from the case after this. this. use a single hr software? and jonathan, you don't need international roaming to watch french films. vous n'avez besoin que de vitesses de téléchargement rapides! verizon lets you mix and match unlimited plans so you only pay for what you need. sorry... because everyone deserves better. and with plans starting at just $35, better costs less than you think. the first lawsuits were filed over the weekend in the texas abortion ban law, or at least six weeks abortion ban law. they were filed against the san antonio doctor who publicly revealed in a washington post column, that he violated the texas law. that he had administered an abortion. until this moment, think in texas have been frozen in place weirdly, and that's because this crazy new law that outlaws abortions after six weeks was deliberately crafted so that it is only enforced through private citizens suing doctors and anyone else, and then being rewarded with cash bounties. five conservative justices in the supreme course used that we are structure as a pretext to say well, we cannot block the law there's almost a block, there is no one to enjoin. and so the law is now in effect in texas. but now things have changed. we now have the first known challenge under the law, from plaintiffs in arkansas illinois. and the whole thing i have to say is really ahead scratch. are the archivist our plaintiffs who is suing the doctor who admitted outperforming abortion is he's got no connection to the case he is not even pro-life, he just wants to force the code to review the law. in some ways the other observability of this suit is a great illustration of the ridiculous and to my indefensible nature of the, lot because a lot at least as written, of sources enforcement along for anyone to sue anyone. my very sharp way of keisha who worked in the white house council under president obama, teaches constitutional, she remarked that this is the very plaintive that this law deserves, which i thought was a perfect way to describe, nancy north up is the president ceo of the center for reproductive rights, nonprofits law firm, that's been leading the legal charge against abortion fencing including texas's new law. all right nancy so first of all, what does it mean to have a doctor come forward and say, i have sort of in a civil disobedience, way violated this law. >> you know doctor braid has been providing health care for almost 50 years and he came forward in the washington post to say that he had provided cared to a patient in her first trimester and that he understood that there could be consequences for that, but he is just heartbroken every day when he goes into his clinic to have to turn so many patients away that he knows that he could provide care for and for many of them he just doesn't have many options to give them because for them to travel to oklahoma or at a state to him as to coach isn't even an option, so he knew that he would be exposed to the saw suits but every day he's watching this unconstitutional law in fact his patients really in a devastating way. so there is now a lawsuit that has been filed and one of the things that's weird about, this there's this notion of standing in the law that people have to have some stake in a case. in a normal environment this random arkansas guy would have no standing, to sue this other person in texas, he's not a party to the dispute, he hasn't been harmed, but the point of the texas law is basically to eviscerate the standard as far as i know. what do you understand the legal status to be here?
