and kitty hawk road . they spent the entire morning trying to figure out a man in a kia allegedly sped towards them when they were on a dui stop of another car. it started as a dui traffic stop at 3:30 in the morning. livermore police pilled over this car on kitty hawk road . they were conducting a field sobriety test when they heard screeching tires and saw black kia speed toward them. >> he drove the vehicle at the direction of the officers. >> reporter: police say the kia made a beeline towards them on a remote access road. >> they took immediate action and ended up faring their firearms. >> reporter: the driver of the kia was shot in the thigh. he ducked down and police did not immediately take him into custody. instead, they brought in the s.w.a.t. team. police are investigating if the dui suspect called the driver of the kia during the stop. police say they are sure they were driven towards on purpose. >> it is extremely intentional to make that turn. to approach the vehicles at 3:00 or 3:30 in the morning. >> reporter: the dui suspect in the officers were not hurt. there's shooting remains under investigation. the names of everyone involved has not been released. and the scene is now clear. life in livermore, henry lee, ktvu fox 2 news. >> henry, thank you. breaking news where two court houses were evacuated. >> jesse gary is joining us now live from the scene with the latest information. >> reporter: guys, good afternoon to you. we are live at the superior court complex in downtown san jose right off of north first street. court has reserved resume normal activities. officials are checking to see how many cases were impacted due to a two hour delay this morning. they are trying to see which cases have to be rescheduled and which can be moved to the afternoon. they are mandated to make sure employees still get their lunch break. best starter with a bomb threat that was phoned in. we talked to one woman who was inside and had to be evacuated. >> i was scared, obviously. i mean, it was serious. it was an emergency. it was scary. >> reporter: officials say this bomb threat came in around 9:00 this morning and was phoned in directly to the courthouse by a male caller. no information is known at this time. because of that, officials made the determination to evacuate the court complex here in downtown san jose. additionally, they brought in bomb sniffing dogs to check the vehicles parked on the surrounding streets around the complex to make sure no vehicles had any explosive devices underneath them or attached to them. i spoke to officials and they told me there has been no indication of a bomb. they believe it is a hoax but they still took precautionary steps. >> why take the action? >> out of an abundance of caution. we wanted to make sure to take any kind of threat serious. that's why we did the evacuation. >> reporter: again, court officials say court has resumed. however, the morning cases have been impacted because of a two hour delay. they're going to have to move the cases either to the afternoon or reschedule. if you are scheduled to be in court today at the old county courthouse, you. now to washington where the senate impeachment trial of president trump is underway after a marathon day yesterday. >> the democratic house managers began laying out their case. greg lee is joining us now live from the newsroom with an update. greg. >> reporter: the house managers and senators returning after nearly 13 hours of fierce debate yesterday. at times, things got testy last night facing the justice to reprimand both sides. today, we won't see those exchanges. the house managers began the opening arguments about two hours ago. by the rules, they will have up to two 24 hours and three days to make their case. during that time, the other side and senators cannot speak, only listening. adam schiff told reporters this morning they will go into extensive detail into the articles of impeachment proved by the house. at issue, the allegation president trump leveraged $400 million in military aid to pressure ukraine to announce an investigation into joe and hunter biden. >> if not remedied by his conviction in the senate and removal of office, president trump's abuse of his office and obstruction of congress will permanently alter the balance of power among the defense team will have their 24 hours to make their case. they argued they believe the president should not be removed because he has not been accused of a criminal act. after arguments and questions, flights and trains as the coronavirus continues to spread in china. this comes as the cdc is increasing the number of u.s. airports that are screening passengers. sfo, jfk, and l.a.x. first checked passengers last saturday. they have been expanded to atlanta, and also chicago. as we first reported yesterday, washington state has the first confirmed case of the virus in the u.s. the illness has her feet after nine weeks at ucsf benioff children's hospital oakland >> >> she has done really good. it is scary. >> reporter: scary because sami was paralyzed from the waist down when she arrived in november. she had gone to the dentist for a teeth cleaning appointment when suddenly the 10-year-old's hands began to get numb and she couldn't walk. >> it is scary when you don't know if you can walk. it is so weird because when i walked in my upper back was hurting. >> reporter: her mother says that sami had a slight cough but was otherwise fine. she was diagnosed with afm, a rare but serious neurologic disease described as being polio light, causing paralysis, often in children. >> i just want to bring awareness to it. i was fortunate enough to take her to the er and get her immediate help. >> reporter: this is the mri of sami spinal cord. she tested positive for the rhinovirus which is the cause of common colds. it is in her spine, causing inflammation. it is unknown why the virus can lead to this illness. it can cause permanent and sometimes life-threatening paralysis. just a few days ago, sami took her first steps with help. the cdc says there are 603 confirmed cases nationwide since it started tracking the disease in 2014. 33 confirmed cases in 2019. california had the most, 10. >> it is scary. there is a lot of unknown. >> reporter: winters says the prognosis is not good. sami has hope and determination on her side. >> i would like to kick a soccer ball again. i probably want to go home and get used to it again. >> that is what keeps me going. >> investigating an officer involved shooting. it happened after how officers pulled over a suspected drunk driver. investigators say the driver of another vehicle made a sharp turn and appeared to pablo. the sheriff's office says they were outside of a home a few homes behind us, on the left side of the street, they say a person barricaded themselves in the home and reportedly fired a weapon. that's why they brought the s.w.a.t. team. officers arrived around 9:30 last night. they were out here for several hours over well. we used a drone to see what was going on. officers were spotted in tactical gear. there was a mobile command unit that was brought out to the scene as well. it was in the 8:00 hour that officers went into clear the home. they found the suspect and took that person into custody. it appears things ended peacefully. that is all the information that is being released. cristina rendon own, ktvu fox 2 news. a search for a man who went missing in san francisco continues this afternoon. today marks two weeks since the man was last seen in the mission district. his mom last talk to him back on january 8th when he faced timed her from city college while he was registering for classes. the last person who saw him says he was headed to a restaurant with a man he didn't know very well. >> he told me this guy, he's a bad guy. he carries a gun. >> yes, come to my house later on. call me. i called him twice later on that night and he didn't answer. >> there is no reason for him to be gone this long and has not have any clue. anything. >> the san francisco police department is investigating and they are looking for leads. the city of vallejo has released video from a deadly officer-involved shooting that happened last november. officials say 36-year-old eric riesling was shot and killed by an off-duty police officer. this began with an argument over a parking space. the video shows the man having what appears to be a short heated discussion with sergeant virgil tom it. he has seen retrieving a gun and walking towards thomas who is off-camera. he turns back towards his band, sergeants thomas can be seen drawing a weapon and then opening fire. the shooting remains under investigation. police in san francisco say crime in the city was down last year. as christien kafton tells us, some people say they are not seeing the change on the street. >> reporter: in a city the size of san francisco, crime is a reality. now three weeks into the new year, san francisco's police have data comparing 2019 to 2018. the chief says the news is good. >> the department says violent crime is down. homicide down 11%. down 15%. robberies and aggravated assault down as well. same story with property crimes. burglary down 14%. auto burglaries down 2%. many say they may hear that the crime is down but that doesn't match up with what they are seeing. >> what i do see is absence of police presence on one of the more challenging corners of san francisco. and what i see is a plethora of drug use and drug dealers. that's a fact. >> reporter: chief scott says he hears the concerns and is working to take the data learned over the last year and applied that going forward with a focus on some of the cities hotspots. >> we are going to further and could trees controls and focus on the midmarket area. >> reporter: he says officers will continue to work to make san francisco a safer place and make it feel like a safer place to those who live and work here. >> we have a lot more work ahead. we know that. it has been said. the mayor senate. i said it. one homicide is too many. one car break in is too many. >> reporter: he also touched on working with the new district attorney. they have to allow the prosecutors to proceed and said there may be a the possibility of adding additional stations. the data shows san francisco's balboa park station recorded the number of thefts followed by the oakland coliseum station. the stations with the fewest were west douglas, pittsburgh, and mel brent. the 49ers return to the practice field today as they get set for food bowl 54. it will not be open to the media. they will begin to install its game plan the campbell city council stopped plans for a chick-fil-a restaurant. it was standing room only at the council meeting last night. many people wanted to be heard and most spoke out against the project. a group that opposes the plan claims that chick-fil-a would compromise pedestrian safety and increase traffic and noise. it opposes chick-fil-a's previous support of lgbtq causes. >> i'm concerned the number of cars that are anticipated to come that the drive to mr. pickles will be blocked and those businesses will be negatively impacted. >> and attorney for chick-fil-a says they never found any problems with plans for the restaurant in previous discussions. chick-fil-a hasn't said what comes next. after wet day around the bay area yesterday, we are looking at sunshine today.
