carquinez bridge to the macarthur maze. and you can see traffic is busy here in berkeley and emryville as you drive to oakland. when you get to the bay bridge, it is a normish commute. some slowing on the carpool lane here. traffic is a little slow. it could be that people are taking a look at the handsome alex savidge who is right there. his van is right there. he might be fixing his hair or something. you see there is a slowdown right there. there is northbound 101 approaching the 80 split. this traffic is moderate. there have been no major issues driving through. all right. at 7:01, let's go back to the desk. we will go straight to developing news from southern california and the mudslides there where officials announced earlier this morning the death toll has risen from 13 to 15. >> montecito and santa barbara county were hit hard. that's where oprah and ellen degeneres live. >> we received this video taken earlier this morning in a neighborhood in los angeles county that was also damaged by mudslides. about a thousand homes were hit by a river of mud and other debris. some mud piles are three feet high. thousands of people throughout southern california remain evacuated. reporter kelly wright shows us more of the devastation. >> reporter: waves of mud fueled by heavy rains crash into residential areas of southern california. >> i california. the run offbrought debris from the hills devastated by the wildfires. the charred lands have left low- lying areas vulnerable to flooding and mudslides. large boulders were pushed down the hillside, rep turing a -- rupturing a gas line. >> i can't quite believe it. was that a house behind us. >> reporter: crews spent much of tuesday rescuing people stuck in the mud, including one teenager trapped up to her neck for hours. dozens more had to be pulled out by helicopter. this car was one of many vehicles parked at the top of a hill. pushed to the bottom and covered in mud. >> there were just a few people who didn't listen to the fire department when they told us to take every car off the street. those few people, their cars were like any lated into conditions got so bad that authorities had to order new evacuations, forcing some people to drive right into the flowing rivers of mud. >> kelly wright reporting. trees, boulders and other debris poured on to highway 101, a major link of course between ventura and santa barbara. the highway is not expected to reopen for at least two or three more days. the time is 7:03. bay area crews are helping with the relief efforts. the california national guard sent blackhawk helicopter crews including a team from the 129 rescue wing based at moffitt. this shows what could happen to napa or sonoma valleys if they got a lot of rain this winter. we're waiting to learn more this morning from san jose police about the city's first involved shooting of the year. we know it happened at the metcalf energy center and there are reports that the shooting was deadly. allie rasmus is live on the scene to explain what we know what happened. allie. >> reporter: it happened around 5:00 yesterday afternoon at the metcalf energy center. it is a power plant that provides power to parts of san jose. it is located on a private lot. because it is private property, this is the closest we can get to it. when a man parked outside of the front gates, he got the attention of police. police followed him on foot and police reported that it appeared that the man was carrying an ax. >> he has the ax in his hand and he is refusing to drop in t. >> reporter: about two minutes after that exchange is when you hear police explain shots were fired on the dispatch recording. the man with the ax was shot in the chest according to the recording. the police have not commented on his condition. but there are reports that the shot was fatal and the man died at the scene. none of their employees were hurt in any of this and they're cooperating with the investigation. but no information yet from san jose police on who this man was or what he was doing here at the metcalf energy center with an ax. we're waiting to get more information from police this morning as they investigate their first officer-involved shooting of the year. back to you, gasia. >> thank you, allie. in san jose and happening today, the police department is unveiling a new tool that the public can use to find out how and when officers use force. it is an online portal where people can read about incidents in which san jose police officers have used force while dealing with the public. police chief eddie garcia will also talk about why this is important on the local, state and national level. the time is now 7:06. part of highway 121 in napa county is still closed this morning after a deadly crash last night that may have been caused by a landslide. it was first reported at 5:00 last night on highway 121 near wild horse valley road. a car went off the highway and then down an embankment and crashed into a tree. one witness said the car was hit by a falling rock. that may have caused the driver to swerve and lose control. well, that driver died. authorities can't get to the car because the hillside is not stable. the chp is hoping to reopen the highway this morning. this morning the east bay express is publishing a story that says that oakland has fail today report hundreds of thousands of gallons of toxic sewage spill that is affecting people and animals. it could be linked to the closure of lake temescal. according to the story, the defendant of public works has hired outside contractors who don't fix the problem of broken pipes and have failed to report sewage overflows and providing false information to regulators. we have much more on the story coming up on the 9 when we will talk to the reporter who researched and reported the story. our time is 7:07. a federal judge blocked president trump from ending the daca program. up next, what this means for young immigrants living in the u.s. and how the president is reacting. also, he is the latest person in hollywood to be accused of sexual misconduct. the claims being made against actor last night a federal judge in san francisco temporarily blocked president trump's decision to end the daca program. the program that protects young, undocumented immigrants from being deported. just about an hour ago the president tweeted about the ruling says it shows everyone how broken and unfair our court system is when the opposing side in a case such as daca always runs to the 9th circuit and almost always wins before being reversed by higher courts. doug luzader reports more from washington. >> reporter: this federal judge in san francisco has hit upon the very issue that is the crux of ongoing negotiations here in washington. what to do about daca, the deferred action for childhood arrivals program that president obama began and president trump has tried to end. the president pushed back by a federal judge who sided with a number of state that's are fighting white house efforts to end protections for young illegal immigrants. a surprising turn and the justice department promised to fight it saying promoting and enforcing the rule of law is vital to protecting a nation, its borders and its citizens. >> it should be a bill of love. truly it should be a bill of love and we can do that. >> reporter: it followed an unusual day at the white house as president trump met with republicans and democrats on immigration. in a move that shocked the white house press corps, allowed people to listen in. >> this is rare. >> reporter: rare but a strategic move as the president made his case for renewing daca protections in exchange for border wall funding, something that democrats will continue to resist. >> there was no agreement on that. we will be working on that. >> reporter: while they're working all that out, there is a distinct possibility that all of this will upend efforts to prevent a government funding shutdown on january 19th. >> i think they have what they will put in a spending bill already done. but fighting this down to the 19th is going to be rough business. >> reporter: some rough business. and there is not much appetite on either side of the aisle to keep kicking this can down the road. in washington, doug luzader, fox news. california's attorney general holding a news conference at 9:30 this morning in los angeles to talk about the judge's ruling temporarily blocking president trump from ending the daca program. attorney general besara had filed a lawsuit on behalf of dreamers here in california, asking the judge to prevent trump from ending the daca program while the case is heard in court. ohio state officials will defend their process of cleaning up voting rolls by removing people who haven't voted in recent elections. critics say removing inactive voters is banned by federal law. the court's decision could affect laws in other states. the time is 7:13. the new york times has canceled an event featuring james franco. train co-and his brother dave train cowere set to discuss the disaster artist. the newspaper is calling off the event after train co, james train co, that is, was accused of sexual misconduct by an actress. there were similar comments by women on twitter. train co-who appeared last night on "the late show" with stephen colbert has not seen the comments but adds that the comments are, quote, not accurate. the time is 7:14. let's get you to where you need to go. sal, how does it look? >> it looks okay on the east bay commute. >> okay. >> it is better than monday and tuesday. highway 24 is a little crowded here in lafayette, which is not unusual. orinda as well. but definitely a little bit of a better commute. when you get to the bay bridge, certainly there is slow traffic. it is more along the normal lines of slow. you're going to see slow traffic getting on to bridge and slow traffic getting here to the toll plaza. this is a look at san francisco across the bay and northbound 101 at the 80 split. that looks good. a little slowing on 101 northbound between 280 and the cesar chavez exit. if you're looking at the east bay friday, the work horse, the nimitz friday, it slows from highway 92 and stays slow into the middle part of fremont before you break free on the way to milpitas. 7:15. let's bring in steve. >> thank you, sal. >> you're welcome. >> a lot of cloud cover coming over us and light rain. not enough to do much. but a couple one hundredths. this may produce a few light snow showers up in the mountains. generally just ai lot of cloud cover -- just a lot of cloud cover. some of that you might be beating the rain a little bit. some of that is moving into mendocino county. it already has. light rain being reported at ukiah and maybe northern sonoma and napa county. it is inching in there. we're dealing with a lot of cloud cover. maybe even towards davis and sacramento valley and up into the sierra nevada. coming out of the northwest, it is beginning to lighten up. more towards sacramento areas north and also east. but we're close enough that we have to mention it for us. a couple one hundredths could be in the mix for today. not enough but enough to say there is light rain here. includes up to the northwest. 40s and 50s. we had a few 30s with the breaks in the clouds but now that the clouds have come in, a lot more 40s. blackhawk is 43. san ramon is in there as well. alamo, lafayette, mid-40s. 48, pinole, el sobrante and el cerrito. there is your morning trifecta right there. sfo, the wind was picking up and howling around 4:00. things have quieted down. 30s up in the mountains. blue canyon is now reporting light rain. last i saw. and light rain is still down towards san diego but almost done. but the clean-up, big clean-up has begun for those up in the santa barbara area. to you san is getting -- tucson is getting rain. and the rain that we had is moving into new mexico. and this is the cloud cover spilling over the ridge of high pressure. so when that drops in on us, you can occasionally get a few one hundredths. but santa arose asouth a .01 or .02 would cover it. the next system for those who work outside or need to know would be tuesday, probably tuesday afternoon and evening. mid-50s to the north with all of the cloud cover. 50s for many here under a gray, mostly cloudy day with light rain. it looks good going into the weekend. >> thank you, steve. 7:17. it is official, john gruden is back as the oakland raiders head coach after a 16-year absence. mark ibanez caught up with gruden after the news conference. >> when did this thing resinate with you that there was fact in it and you thought, you know what, this might be the year? and why? >> well, i got a lot of respect for mark davis. we have been friends over the years, the last six or seven years in particular. we've had discussions over the years about coaching and his vision of the franchise. and, you know, the reality is when we had a ring of honor game in tampa a few weeks ago and i got around a lot of my old players, and i realized it was like this is what i love the most in life is being on a football team and being with the players. and i never really felt good about leaving the raiders under the terms that i left under. and i wanted to come back here and work for mark and do something special here for the city of oakland. because i love these oakland raiders fans. i can't get outside and meet them. >> that being said, is it a little bit of bittersweet in knowing that the team in a couple of years will probably leave? >> yeah. >> your thoughts and sensitivities with regard to that and oakland raiders fans. >> i'm really sensitive about it. i had a son here in oakland. i've got a lot of friends in oakland. and i want to try every way possible to give them something to remember. i want to show my gratitude to them by coming back and laying it on the line for them. >> final question, jon, you can known as a quarterback whisperer, full. derek carr, you've talked a little bit about him this morning. but things you like about him and maybe what -- what got side tracked? what went wrong with derek carr. >> he got hurt, number one. he got hurt. that can hurt any quarterback's performance. but i've always liked him from the first time that i met him. i think he is a great person. he has great talent. he has survivor person arm talent. i think he has dynamic leadership traits and he is in his prime. there's a lot to like with derek carr. and it is our responsibility to get him to play at a better level. >> will you understand us media guys now that you have been on tv. >> i will three indexes started the day in record territory. there are losses today. the numbers headed straight down when the opening bell rang this morning. part of the reason, some concern over our economic relationship with china and debt. here is a live look at stocks right now. as i mentioned, all three indexes down. the nasdaq and the s&p -- excuse me, the s&p 500 and the dow are down about a quarter of a percent right now. the dow off about 55 points. there's a live look at it. the nasdaq is slipping more though, more than half of a percent there. still at 7129 for the nasdaq. well, facebook apparently plans to break into the home assistant business. there are reports that the social media giant is developing a video chat device that could be released before the end of the year. industry insiders say facebook's device would be called portal. it would cost about $500. they say it would be marketed as another way to connect with others around the world. facebook not commenting though at this point on the reports. kodak is launching its own crypto currency, kodak coin. the system will allow photographers to register work that they can license and then receive payment. now, it is not just for professionals. it is also for amateur photographers. they will start offering kodak coin at the end of the month. shares in kodak jumped 100% since the announcement. toyota plans to integrate alexa into some of its cars. it wants to improve the vehicle experience. now, alexa will be offered in certain toyota and lexus models this year. it will expand to other vehicles next year. you will be able to use speech commands to order navigation, get news and add items to a shopping cart and other services. i can see a lot of people seeing this a convenience. while you're sitting in traffic. most bay area bridges appears to be gaining momentum. we will tell you how much more you might have to pay to cross the bridges and the important decision that will be made later today. and another pender is getting beauty shots for steve and the forecast. >> there is a little bit of rain to the north. not a lot. look for a cloudy to mostly cloudy day. we will notice that light rain. a trace a couple one hundredths north. that looks like the focus. light rain to the north. some of that might be sneaking in. we will see if santa rosa reports light rain. there it is. windsor and hillsberg. we will keep some of that in there. the amounts would be very little. .01 in napa. .02 san rafael. i doubt it makes it down to san jose. if it does, it would be very, very light. the next okay looking system would be next tuesday. a lot of cloud cover. the bulk is north and east of us. sacramento valley up to the sierra. isolated snow showers are possible. it takes the corner, exit right. 40s and 50s on the temps. 40s on the peninsula. los al toes is 43. over to fremont and union city,47. a few isolated snow showers are possible up in the sierra and up up at shasta under cloudy to mostly cloudy skies. cool. upper 40s mainly for most. 7:30. sal tells us -- >> it is moderate out there. >> okay. >> it is not terrible. monday we had the day where everything was very slow and people complaining about it still. today it is just moderate. i see slow traffic on the nimitz freeway that i have outlined on the san mateo and the dumbarton bridge. traffic has been pretty slow. you also see traffic that continues to be slow on all of the south bay commutes. as a matter of fact, traffic here on 101 and 280 and 85 has filled in getting into the valley. that's what we have there. there have been no major issues here. at the bay bridge, you can see traffic is backed up to the maze. and the metering lights are on. that is pretty typical here. when you get past the bridge getting into san francisco, traffic looks good. driving to the airport, it is fine on 101. at 7:31. let's go back to the desk. >> we're starting this half hour, the latest on the southern california mudslides. now the death toll is up to 15. it may go even higher. 25 people still missing. some of the survivors have critical injuries. some of the victims were trapped in their homes, mud and debris up to their neck. one of the hardest hit areas, the community of montecito about 100 miles northwest of los angeles. celebrities like oprah winfrey, rob lowe and ellen degeneres live there. major roads were turned into mud. ellen degeneres tweeted a photo of her neighborhood with the caption this not a river. this is the 101 in my neighborhood right now. montecito needs our love and support. make sure higher tolls on seven of the bay area bridges. the proposal to raise the toll says the additional money would pay for transportation improvement projects. alex savidge is live at the bay bridge toll plaza. tolls could increase by $3 in the next several years. >> reporter: yeah. if that happens, a trip across the bay bridge during rush hour would cost $9. right now, it is 6 bucks, which i'm sure seems like a lot obviously. but it could go up significantly. ultimately though voters will have the final say on this toll hike. later the metropolitan transportation commission will vote. voters in all nine counties will vote to increase tolls on seven bridges in our area. this proposal would not affect the golden gate bridge. money from the toll increase would go to pay for various transportation improvement projects, freeway intersections, more bart cars, expanded bus and ferry service. some commuters do not like the idea of paying more. >> that is horrible. yeah. i mean, it -- it would be a pretty big -- big dent in somebody's pocket if they can't afford it. i mean, especially if that is what they have to do to make a living. >> reporter: if it's approved, the toll hike would be phased in over six years. starting with a $1 increase in january of 2019. and ultimately it would cost $9 to cost the bay bridge during commute hours and $8 to cross the other state-run bridges in our area. now, the metropolitan transportation commission meets at 9:30 this morning in san francisco. and, again, a special committee will be voting and deciding whether to put this toll hike to the voters on the june ballot. gasia, back to you. >> alex at the bay bridge. thank you. happening at about 10:00 this morning, governor jerry brown is expected to introduce his proposed state budget. california is projected to have $20 billion in reserve. while our state's economy is strong, the governor cannot overspend because of new costs to california. president trump's tax overhaul will lead to less federal revenue which will cut funding for social services. that means that the state must set aside for programs such as medi-cal. the time is 7:35. last october's wildfires in santa rosa are causing problems for the city's new fiscal year. 3,000 homes and 15 businesses were devoid in the fires. the city spent at least $5 million more than it budgeted for this year. city isn't sure when it will be reimbursed by the state and federal government. last night the city council started inviting the public to share their priorities for the upcoming budget so the council can understand what the public thinks is important before they decide how to spend taxpayers' money. a judge ruled to let public money be used to pay for one of the lawyers for max harris. harass and his codefendant derick almena are awaiting trial on 36 counts of involuntary manslaughter in connection with the deadly fire more than one year ago. that is one count for each person who died in the fire. so far harris' lead attorney has been working pro bono because harris doesn't have money to pay him. granting public funds to a defense fund is a rare move but he believes it is in the best interest of justice. the time is 7:36. the san francisco mayor's race is now set. eight candidates qualified for the ballot. the window to file for the june 5th special election closed at 5:00 last night. the field includes former supervisor aliota, london breed, jane kim and mark leno. the other four are community advocate richie greensburg, activist and educator weiss. social worker and michelle bravo also qualifying to appear on the ballot. city attorney dennis herrera who took out the paperwork to run for mayor decided ton join the race after all. also not on the list, assembly man david chu and carmen chu who said this week they would not be running. mark ferrell who was mentioned as a possible candidate said he would not be running. yesterday supervisor aaron peskin called on the board of supervisors to vote next week to find a replacement for acting mayor london breed. critics say if you leave london breed as acting mayor, it would give her an unfair advantage in the election. six people on the board would have to sign off on that to approve a new acting mayor. there is no indication who the caretaker mayor might be. >> the question of the day is should san francisco appoint a 7:38. there was a deadly police shooting at a power plant in san jose. companying up at 8:00 -- coming up at 8:00, we will tell you what the man was carrying that may have prompted the shooting. the (voice fading away) >> the most beautiful and expensive neighborhoods in california. this is where the storm caused so much destruction. there was no mandatory evacuation order in place. residents say they went to bed. the rain was light. they felt comfortable. they never saw it coming. >> reporter: rushing water, giant boulders. mud, debris, everything in its path destroyed. mont city residents were asleep early on tuesday when they heard a terrifying noise. >> so loud. it was constant. >> roar. >> a roar. it sounded like a hurricane or a freight train coming through. i can't quite believe it. was that a house behind us? was that a house. >> reporter: homes were knocked off their foundations. power poles snapped and rolling down the street. 15 people were killed and many still missing. the hardest hit area, hot springs road. a 14-year-old girl was rescued that was trapped in her home, covered in mud. air lifting people from the roofs of their homes, including this woman and her dog. it is a scene that residents say they will never forget. >> i'm just stunned, absolutely stunned. >> i had no idea that the devastation was like this. >> reporter: some of the residents say they woke up to find their neighbors floating in the yard. unbelievable. now, the search for the missing continues this morning. many people have taken to social media, asking for prayers for their missing loved ones. of course, you know, search and rescue teams came in early this morning, as soon as there was light and they're searching the area, looking for more people. 15 people died in this. now, the fires, they happened in december. they survived that. and unfortunately many people lost their lives in this storm. i'll send it back to you in the studio. >> very difficult. gina silva. thank you. >> the time is 7:43. a little boy in richmond is recovering after the family dog, a rottweiler attacked him four weeks ago. he was playing with his brother under a blanket on the couch when the dog for unknown reasons went under the blanket and bit the boy's head and face. their older sister who was babysitting grabbed scissors and stabbed the dog. the boy was ready to get away. he needed more than 60 stitches on his face and scalp. his mother told us about the scary ambulance ride to the hospital. >> the whole time, you know, i was massaging his hand and talking to him. i told him, i said, you know, you have to be strong. and don't go to sleep. because you might not wake up. >> now, today the little boy goes back to the doctor to find out if his bandages can be removed. the dog, the rottweiler, it was a stray and it was adopted in september. it has since been euthanized. the contra costa county animal services says if you adopt a pet, know something about the animal's background, get it spayed or neutered and make sure it is vaccinated. a man accused of sexually assaulting a teachner her classroom in san jose made his first court appearance. andrew is charged with robbery and assault of a teacher at hacker middle school january 2nd at 6:30 in the morning. he was identified through the surveillance video. he was arrested two days later. if he is released on bail, he will need to submit to electronic monitoring. he will return to court next month. the time is 7:45. good news and bad news about the flu season this winter. health officials say it appears to be the worst in ten years but not too late to get a flu shot. so far here in california, 27 people under the age of 65 have died from flu-related illnesses. 70% of them did not get a flu shot. typically around this time of the year, there are three, maybe four deaths. >> many people choose not to get vaccinated because there are many myths regarding the vaccine. and one is that people say, i get the flu from the flu vaccine. >> now, state officials say there are plenty of vaccines available and it is not too late to get the flu shot. even if it is not 100% effective, they say you're still getting some protection. did you knee even your dog can get the flu? it is not the same as human influenza but canine flu is highly contagious between dogs. cases of dog flu were confirmed in 46 states last year. one woman who has show dogs says seven of her dogs got ill from the virus. >> i went to a dog show to show my dogs and i almost killed them. >> common symptoms including coughing, sneezing, lethargy, being more tired than usual, decreased appetite and in some cases they can have difficulty breathing. >> veterinarians say the best way to prevent canine influenza is get your dog vaccinated and limit interaction with other dogs. the time is 7:46. a problem with the popular dog walking app has led to the accidental release of its customers' private information. the wag labs dog walking app mistakenly exposed the web pages showing information that includes names, addresses, lockbox codes that could allow thieves to break into houses. the information was on an obscure page on gasia and dave. right now we're looking at a commute at the bay bridge that looks typical and normal. you can see traffic is backed up all the way out to the maze. but this is within the normal realm. this is all people can ask for. what we don't want is what happened on monday with commutes taking double or triple the time. this is 880 northbound. it is slowing down past the coliseum and pockets of slow traffic into downtown oakland. southbound 880 is going to be backed up as you drive from about 238 on down to fremont. we've had a couple of minor accidents on the way. look at the south bay commute. all of the freeways are slow. 85, 101, 280. even 880 near the airport here which i don't normally see it being that slow, that is backed up. so you still have plenty of time driving in the normal for san francisco. oakland, 78%. san jose at 68%. while it was beneficial rain, we're still running at a deficit there. is a possibility, today won't add too much, but some of that is lightening up in sacramento valley and the mountains. there goes the low. that gave southern california its rain and also into arizona and new mexico. look at the cloud cover toppling over the ridge. tomorrow the ridge will build in and deflect it north and east. today, cloudy to mostly cloudy skies. going 40s on the temps. we had 30s for a while up towards kelseyville and lake port. but now it is all 40s. mid-40s. everyone is close or 50s on the coast. there is a breeze south/southwest. south at davis. the moisture streams in. 34 in truckee. 44 ukiah. there could be a few isolated snow showers coming down from the sierra accumulations won't amount to too much but don't be surprised by it. rain holding on in san diego. but there goes the system with phoenix getting rain. the system will dropped steadily in the past five years. a 23% drop since 2012 in overall violent crime which includes homicide, rape, robbery and aggravated assault. oakland ended 2017 with 72 people killed. that is the second lowest homicide total since 1985. oakland's mayor libby schaaf credits the decline to a holistic approach to crime fighting. >> we have over the last five years reduced shootings by 50%. homicides by 42%. robberies by 38%. this is by no means mission accomplished. >> police chief anne kirkpatrick is coming up on the one-year mark of being in the top seat. she says her department has been working on restoring community trust, reducing crime and cut down on officer's use of force that has dropped 75% since 2012. officers are trying to crack down on car break-ins which is up 53% since 2012. one of the victims of the recent car break-s in is an olympic figure skater that competed in the national championships last week. she and her family went to san francisco before going back home to boston. they stopped to get something to eat in japan town. when they went back to their rental car, they discovered someone had broken into their car. the bag with her skates and both of her very expensive costumes were stolen. it may take weeks to replace the missing iteming and she can't practice without her skates. me and her partner did not qualify for the olympicsor the world champions but are alternates for a competition later this month in taiwan. the warriors have a healthy steph curry. they have won five games in a row. the clippers have won seven of their last ten because it is a lot calmer than the past few days. the rain isn't completely out of town, though. >> you've been listening, gasia. >> since 4:00 a.m. >> yes. there's a little bit of rain to the north. there is enough that we have to mention it. it could move over and that's what is happening. cottages at point reyes is overcast and 50 this morning. inverness, barometer rising rapidly. that is true. it should be -- it should say 30.10. but yesterday at this time in oakland it was -- that is a huge jump. we have to keep a little bit of very light precip amounts in. a couple one hundredths would probably do it. cloud cover looks like a better opportunity for precip north and east of us. northeast california, sacramento valley, the sierra nevada. but we're close. that will give us a lot of cloud cover today. 40s and 50s on the temps. in fact there is a little bit of a breeze. some of that has turned to light snow accumulation. very light. up towards shasta as well. that cloud cover will move northward tomorrow as the high kicks in. 50s and 60s. 8:02. what would you say? moderate today? b, b plus. >> it is a b. good solid commute. we're grading on a curve because, you know, you expect slow traffic some some areas like the bay bridge. we always go there because if you see the bay bridge light, then the rest of the commutes are. we haven't seen it light today. we have seen a lot of slow traffic on the bay bridge and on the approaches. for example, i always look at this ramp right here. if that starts getting lighter than the rest of the bay bridge follows. we're not there yet. on 880 the traffic slows past the coliseum. we are normal. 580 is slow driving into the lake shore curve. there's the bridge. now, in the east bay heading south from hayward to fremont, a lot of that is slow. driving on the peninsula, there is not a lot slowing on the 101 to the airport but slowing on san mateo and burlingame. >> developing news from the southern california mudslides where officials say that the death toll rose from 13 to 15. >> many that died died in the community ofmont city, that is about 100 miles northwest of downtown los angeles. >> if we can bring in live pictures of what montecito is dealing with, we can share that with you from high overhead. this is one of the communities very hard hit. eye certainly a river of mud overtaking cars, some homes actually being pushed off of their foundations. very, very difficult. many residents say they got no warning at all about the impending danger from the very, very heavy mudslides. we have seen a number of people unfortunately be found without life in these mudslides. the rescue efforts continue today. take a look at these homes here. just a terrible, terrible situation. some mud piles three feet high. again, more people are being searched for at this moment. we will get more from reporter kelly wright now. >> reporter: waves of mud fueled by heavy rains crash into residential areas of southern california. the runoff brought debris cascading down from areas scorched by last month's wildfires. without vegetation to absorb the water, the charred lands have left low lying areas vulnerable to flooding and mudslides. large boulders were pushed down the hillside, sparking fires at several homes. other houses were washed away or completely destroyed. >> you can't quite -- i can't quite believe it. was that a house behind us? was that a house? >> reporter: crews spent much of tuesday rescuing people stuck in the mud. including one teenager trapped up to her neck for hours. dozens more had to be pulled out by helicopter. this car was parked at the top of a hill, pushed to the bottom and covered in mud. >> there were a few people that didn't listen to the fire department when they told us to take every car off of the street. those people, their cars were like anialated. >> reporter: some people were forced to drive right into the flowing rivers of mud. >> kelly wright reporting. that highway is not expected to reopen for at least two or three days. a group of firefighters is ready to go anywhere in the state affected by mudslides. the menlo park district has a swift water rescue team. menlo park's fire chief talked about how areas that were ravaged by previous fires are now vulnerable to massive mudslides. >> anywhere below the burn, you know, in a valley or near a creek or river, those are highly susceptible to having the sluffing and the mud flows. all of the things we're seeing. >> menlo park firefighters are part of the california task force 3 swift water rescue team. it looks for trapped victims and assess the terrain ask detect any hidden dangers. one south bay emergency response team has gone to southern california. blackhawk helicopter crews including a seven-person team were sent from the base at moffitt field. we have posted additional pictures of the mudslides on ktvu.com. .com. the time is 8:07. today we're waiting to learn more from san jose police about the city's first involved shooting of the year. it happened at the metcalf energy center. there are reports that the shooting was deadly. ktvu's allie rasmus is live at the scene to explain what you do know about what happened. allie. >> reporter: we know when it happened. 5:00 yesterday afternoon at the metcalf energy center. that's this building here behind us. it is a power plant that supplies power to parts of san jose. it is light now. you can see down towards the end of this road, this private road is the gate where this apparently all happened. this is a private road so this is as close as we can get to it. we can't drive any further on to the property. when a man parked outside of the front gate, he got the attention of police. the man appeared to be carrying an ax. >> i'm following behind him. he is on foot. he still has an ax and a large pole. >> he has his ax in his hand and is refusing to drop. >> it an ax in his hand and he is refusing to drop it. >> reporter: now, shortly after that is when you could hear police explain that shots were fired. the man with the ax was shot here at the scene. and police have not commented on the man's condition. but the san jose mercury news is reporting that the shot was fatal. a spokesperson for the plant says no employees were hurt and they're cooperating with the investigation but unable to comment further while the investigation goes on. we have requested and still have not received any information from san jose police about the man involved in this, what his relation, if any, was to the plant. why he was here, what he was doing here. again, this is san jose's first officer-involved shooting of the year. and there are reports that the shooting was deadly, that the man died from his injuries here at the scene. back to you guys. >> thank you, allie. san jose police department unveiling a new tool that the public can use to find out when officers use force when interacting with the community. it is an online portal where people can read about incidents where police have used force while dealing with the public. eddie garcia will talk about why this is important on the local, state and federal level. part of highway 101 in napa county is still closed after a deadly crash that may have been caused by a landslide. it was near wild horse valley road. a car went off of the highway and down the embankment and crashed into a tree. it was hit by a falling rock and it may have caused the driver to swerve and lose control. the drivers died. authorities cannot get to the car because the hillside is so unstable. they do not anticipate to open the road until this afternoon. oakland has failed to accurately report hundreds of thousands of gallons of toxic sewage spill that's are affecting people and animals. according to the report, this could also be tied to the recent closures at lake temescal that have been blamed on toxic algae. as a supervisor told the newspaper, algae feeds on sewage. according to the story, the department of public works hired outside contractors who do not properly fix the problem of broken pipes, failed to report sewage overflows and is providing false information to regulators. we will have more on this story coming up in the 9:00 hour when we talk live with the reporter who researched and wrote the story. >> the time is 8:10. an increase up to $3 across most bay area bridges. what the money will go towards and why it may be up to voters to decide. >> reporter: and the immigration debate heats up here in washington since surprising news from a federal judge. i'm doug luzader from washington and we will have the latest details coming up. things are getting slightly better for the commute. if you're driving in the east bay, it looks like there has been some better traffic here at the macarthur maze. even though high pressure is building in, clouds continue to come over the top of it, giving us a mostly cloudy day and some light rain is possible. after today, things will be on the improvement. >> last night a federal judge  in san francisco temporarily blocked president trump's plan to eliminate the daca program that protects undocumented immigrants from being deported. >> just about two hours ago, president trump tweeted saying, quote, it just shows everyone how broken and unfair our court system is when the opposing side in a case such as daca always runs to the 9th circuit and almost always wins before being reversed by higher courts. doug luzader reports more now from washington. >> reporter: this federal judge in san francisco has hit upon the very issue that is the crux of ongoing negotiations here in washington. what to do about daca, the deferred action for childhood arrivals program that president obama began and president trump has tried to end. the president pushed back by a federal judge who sided with a number of states that are fighting white house efforts to end protections for young illegal immigrants. a surprising turn and the justice department promised to fight it, saying promoting and enforcing the word of law is vital to protecting a nation, its borders and its citizens. >> it should be a bill of love. we can do that. >> reporter: it followed a very unusual day at the white house as president trump convened a meeting of democrats and republicans on immigration. and in a move that shocked the white house press corps, allowed the media to listen in. >> for people who aren't in the white house every day, you have to explain how rare this is. >> reporter: rare but a strategic move as the president made his case for renewing daca protections in exchange for border wall funding, something that democrats will continue to resist. >> there was no agreement on that. we will be working on that. >> reporter: while they're working that out, there is a distinct possibility that all of this will upend efforts to prevent a government funding shutdown on january 19th. >> i think they have what they will put in a spending bill already done. but fighting this down to the 19th is going to be some rough business. >> reporter: some rough business. and there is not much appetite on either side of the aisle to keep kicking this can down the road. in washington, doug luzader, fox news. california's attorney general will be holding a news conference this morning in los angeles where he will talk about the judge's ruling, temporarily blocking president trump from ending the daca program. the attorney general had filed a lawsuit on behalf of dreamers in california asking the judge to prevent the trump administration from ending daca while various lawsuits are heard in court. the supreme court will hear arguments in part of a continuing legal battle in an effort by states to stop voter fraud. ohio will defend their process of cleaning up voting rolls for those that haven't voted in recent elections. it could affect laws in other states. former white house strategist steve bannon is stepping down as the director of breibart news. he made criticism that president trump and his family in a tell-all book about the trump white house. he was fired and he return today breibart. the far right website says it is working with bannon on a smooth transition. the new york times has canceled an event involving james franco. he and his brother were scheduled to discuss and promote the disaster artist, their newest film. now they are calling off the event after train co-was accused of sexual misconduct by an actress. there were similar comments by other women on twitter. franco says he has not seen the comments but added that the comments are, quote, not accurate. the time is 8:17. let's and i'm just saying a touch lighter than normal on some of the commutes. for example, we look at the east bay commute. you see red everywhere. it is not all that bad on 680. the height of the commute back in november of '17 -- back in november of '17, you would see slow traffic here. not everyone is back in school. i think that the holiday coming up, the king holiday, may have something to do with that as well. let's go to the bay bridge toll plaza. you will see that traffic is backed up all the way out to the maze. metering lights are on. definitely slow traffic here as it would be for a happy >> a state lawmaker wants to make it easier for people with marijuana convictions to clear their records now that recreational marijuana is legal in california. the bill was authored by rob bontum of oakland. it would require county courts to expunge eligible records from felonies to misdemeanors. currently californians with marijuana convictions must initiate the process themselves some individuals don't even know that they qualify right now. and if they do, they don't know how. and if they do know how, they might not have the resources to execute it. so many barriers and obstacles and pitfalls along the way we should stream line it and make it easier. >> the law involving marijuana convictions was approved by voter as part of prop 64 that legalized marijuana in the state. but north korea says the topic is not open for discussion. for the first time in history, there are two african- american members on the senate judiciary committee. kamal la harris and cory bookers are members of a handle that handles appointments to the justice department. they're both attorneys. before being elected to the senate, kamala harris served as attorney general. and cory booker served as to newark, new jersey. a prototype was debuted at the electronics consumer show in las vegas. the sensor collects data and detects the smallest vibrations using 2d and 3d analysis as it accident taking up a couple of lanes here. you can see traffic is beginning to slow down. not only on 280 but 680 and 101 you might see slow traffic doing this. after that, there's a break in the action. then more slow traffic getting newspaper cupertino. we're also looking at the peninsula where we've had slow traffic on highway 101 here in the area. so one of the things that you can do is use 280 instead. it looks good in both directions up and down the peninsula. 880 northbound will be slow as you pass the coliseum. and at the bay bridge, we have quite a bit of congestion on approach. 8:32. back to the desk. >> thank you, sal. 15 people have now died in the southern california mudslides. >> authorities say they fear the number will just continue to climb as they start to reach more mobile parts of santa barbara and los angeles county. at least two dozen people are unaccounted for. a couple of people rescued are in critical condition. the community of montecito is an area devastated by last month's fires. it is now susceptible to mudslides. montecito is about 100 miles northwest of los angeles. >> so loud. it was a constant roar. it sounded like a hurricane or freight train coming there. >> i can't quite believe it. >> officials say many residents did not heed evacuation orders. the fire zones were expected to be vulnerable to rains and floods but they estimated that only 15% of residents fled their homes. montecito is home to a number of celebrities including oprah winfrey and rob lowe and ellen degeneres. ellen tweeted this picture of her neighborhood with the caption, this is not a river. this is the 101 freeway in my neighborhood right now. montecito needs your love and support. oprah winfrey also took to social media to show the damage to her neighborhood. you see her walking through knee-deep mud. giving a firsthand account of the scene. she says one of the nearby homes is gone. we have so much way in the stories and pictures of the southern california mudslides. find that by going to ktvu.com. a 3 dollar -- $3 toll increase on the bridges in the bay area. voters will decide whether to increase the tolls to pay for improvement projects. alex savidge is joining us with more on the story. alex. >> reporter: yeah. an o eye-popping increase being discussed, mike. good morning to you. if it comes to fruition, a trip across the bay bridge during rush hour will cost $9. right now it is six bucks to cross. ultimately voters will decide on this toll hike. and later on today, the metropolitan transportation commission will be meeting to decide whether to put this on the june ballot. a very important decision. if the committee gives the green light, voters in all nine bay area counties will decide whether to gradually increase tolls on the bridges. this would be affect tolls at golden gate bridge. money from the toll increase would pay for various transportation improvement projects around the bay area. better freeway interchanges, more bart cars, expanded bus and ferry service. still, as you can imagine, a lot of drivers we're talking to this morning say another toll hike would really hurt. >> well, i hope the toll hike would be phased in over six years, starting with a $1 increase in the tolls in january of 2019. and then by the year 2025, that full $3 hike would be in effect. the metropolitan another big toll increase. we will have to wait and see. thank you, alex. new this morning, southern california congressman isa says he will not run for a tenth term in congress in the mid term elections in november. he narrowly won re-election in 2016 and was considered vulnerable going into the mid term elections. the district he represents covers san diego, orange county, and riverside counties. his decision not to run likely opens up a battle between democrats and republicans in california. democrats have said they intend to target republican congressional seats in california in an attempt to win back control in the house. in about 90 minutes from now, governor brown will announce the proposed state budget. california will have $20 billion in reserves. the governor cannot overspend because of new costs to california. president trump's tax overhaul will lead to less federal revenue which will cut funding for social services. that means the state must set aside more money for programs like medi-cal. last october's wildfires in santa rosa are causing problems for the city's new fiscal year. 3,000 homes and 50 businesses were destroyed in the fires. the press democrat reports that the city spent $5 million more than it had budgeted for this year. the city isn't sure when it will be reimbursed by the state and federal government. last night they invited the public to share their priorities for the upcoming budget so they can understand what the public thinks is important before it decides how to spend taxpayer money. the san francisco mayor race is now set. the window to file for the june 5th special election closed at 35:00 last night. it includes angela aliota, london breed, james kim and mark leno. the other four, richie greenberg. amy weiss and michelle bravo. dennis herrera who had taken out the paperwork to run for mayor decided not to enter the race after all. not on the list is david chiu and carmen chu who announced they would not be running this week. mark ferrell who was mentioned as a possible candidate previously announced he would not be running. yesterday supervisor peskin called on the board of supervisors to hold a vote to find a replacement for london breed. leaving her as acting mayor may give her an unfair advantage in the election. six members on the board would have to sign off to approve the new acting mayor. there is no indication that the care taking mayor might be london breed. the question of the day is should san francisco appoint a caretaker mayor or should london breed stay in the role. 27% say appoint a care taking mayor. 73% say keep london breed. vote on twitter and ktvu.com and leave comments on facebook. after a 16-year absence, john gruden is back at the head coach for the raiders. he was introduced yesterday. about 50 raiders players past and presidentent were at the news conference. he talked about his passion for the game and the organization that gave him his first head percentage-wise today, slipping half of a percent. toyota and honda are recalling more than a million more vehicles to replace the takata air bags that are defective and potentially deadly. the new recalls come after takata said three million additional air bags are defective. worldwide 20 people have died because of the problem. 280 have been injured. car owners will be notified over the next couple of months about where to get replacements installed. facebook apparently plans to break into the home assistant business. there are reports that the social media giant is developing a video chat device that would be released before the end of the year. industry insiders say facebook's device would be called portal. it would cost about $500. they say it would be marketed as another way for people to connect with others around the world. facebook is not commenting yet on the reports. and toyota plans to integrate amazon's alexa into some of its cars. toyota wants to adopt the hottest new technology to improve the vehicle experience. alexa will be offered in certain models this year and expand to other cars this year. you will be able to use speech commands to get news, add items to a shopping cart x make some notes. and there is a problem with a popular dog-walking app. it led to the accidental release of the customers' private records. the app mistakenly exposed web pages showing names, addresses and lockbox codes. the information was on what the company says obscure pages on the company's website that were not protected bypass words. we don't know at this point how in the deadly ghost ship fire in oakland. they are awaiting trial on 36 counts of involuntarily manslaughter in connection with the deadly fire one year ago. harris' lead attorney briggs has been working pro bono because harris doesn't have money to pay him. the judge agrees that this is a rare move but believes it is in the best interest of justice. briggs will earn between 72 to $100 an hour. a little boy in richmond is recovering today after the family dog attacked him two weeks ago. he was playing with his brother under a blanket on the couch when the dog for unknown reasons went under the blanket and bit his head and scalp. their older sister babying at the time grabbed scissors and stabbed the rottweiler. the boy got away. he needed more than 60 stitches to his head ask scalp. his mother described the ambulance ride to the hospital. >> the whole time i was massaging his hand and talking to him and i told him, you know, you have to be strong. and don't go to sleep because you might not wake up. >> today the boy will go back to the doctor to see if the bandages can be removed. the rottweiler was a stray and adopted in september and has since been euthanized. if you're going to adopt a pet, know the animal's background, get it spayed or neutered and make sure that it is vaccinated. the man accused of sexually assaulting a teacher in her classroom in san jose made his first court appearance. andrew is charged with the robbery and assault of a teacher at hacker middle school january 2nd at 6:30 in the morning. he was identified through this surveillance video that police released. he was arrested two days later. if released on bail, he will need to submit to electronic monitoring. good news and bad news about the flu season this winter. it appears to be the worst in ten years but it is not too late to get a flu shot. health officials say so far here in california, 27 people under the age of 65 have died from flu-related illnesses. 70% of them didn't get a flu shot. typically at this time of year, there are three or four deaths. >> many people choose not to get vaccinate the because -- vaccinated because there are many myths about the
