it is a pack of gum. >> you can wake up and go to the store and buy marijuana. >> and we are about to speak with david in a second. >> when this was a proposition this was the point to generate money for the state of california and it kind of hit me this morning when we had some of the video coming in. we saw the receipts with the percentage of the tax. you got 15% tax and the county tax so if you are buying one hundred dollars of marijuana, it will be 125 on your tab. we won't know immediately until next year how much money it will bring. we will talk more about this as the city of berkeley celebrated. >> there was a ribbon cutting. >> the mayor was there as marijuana sales began at berkeley. it is at one of the oldest dispensaries. we will have a report in oakland where workers have been preparing for months. recreational marijuana businesses can't do this in the city. adults 21 and older can use marijuana in morin county and the ability to cultivate up to 6 plants. joining us is david downs. good morning, david. >> good morning gasia mikaelian. >> are there any hiccups or problems that you are hear across the state? >> it has been smooth sailing at harbor side. they have processed several hundred people and people can be served quickly although products are being sold out. i have seen prerolled joints are selling out and as well as the select strands. sacramento has seen slow business so you can walk into stores over there and business in usual and santa ana and san francisco. if i am someone that has a medicinal card. can i just ditch the card and do i need it anymore or do you think people that have those cards should hold onto them? >> hold onto your card, mike and maybe consider about getting it renewed. there's only a fraction of the medical dispensaries in the state open to all adult users, if you have that card it unlocks hundreds of more stores that are available in the adult use market. you can get a sales tax break with that card and carry more products and buy stronger edibles and grow more in your house. >> david, some of the biggest cities including san francisco, los angeles, they are missing out on this opening day. how much might that affect them later down the road? >> they are going to pick up pace in the next couple of weeks. it will eventually even out. it is more of an image problem for them today. cities like cathedral and soco and tiny communities in california have beat los angeles and san francisco for these sales. there is more of ... >> how are the small cities able to make it happen faster than the larger cities? >> great question. they were more hungry for the tax revenue. san francisco is bigger and have more employment and less of a priority for them. >> i was talking about the tax aspect of this and how much money the state will generate because of this. but what about the grower side? if i'm a grower and have the black market on my left and legal market on the right and facing the tax implications, do you think growers will sell to the black market? >> that's right. california is america's number one domestic producer of cannabis and something like four out of the five pounds that we grow and we grow 13 million pounds a year. we will still have that dynamic post legalization and people will be tempted by the prices in the black market but they will be interested in going legal and not worried about potential law enforcement firearms pointed at them. a big change. >> let's talk about the federal aspect. marijuana still under federal law. president trump has instructed the justice department to prosecute marijuana use. how big after threat is that? >> there is conflict between state and federal law. california has a stays and federated states can prosecute it. federal authorities can stop california tourists and citizens for small amount of cannabis. the federal government also is focusing on big fish drug traffickers and king pins. that's the priorities. so they will condition to make that a priority versus low level cannabis offenses. that conflict is still there. >> with prop 54 a reality, do you think california is a better state today than yesterday? >> without a doubt. thousands of people have been released from prison for crimes that are no longer crimes. they have served more time than if convicted. $250 million of year in savings in the courts so this is a change where the whole world is watching and this will reverberate nation wide. >> look ahead. what comes next in the movement? >> a slow roll out and a slow phase in of retail stores across the state in many of the traditional stores and the supply chains will be licensed and more and more growers and manufacturers are going to get the state licenses and they are going to post them on rain. >> yes. >> are we still looking to get rain? >> a little bit. we are not going to see a whole lot. >> no. it will be a little smack. >> how about we take a look outside our doors where we are waking up once again with cloud cover. little bit of dense fog in the north bay. the satellite view will show you would he have a couple of storms brewing in the pacific. they will swing our ways but not for the holiday. we will remain dry for today. it is another spare the air day with the stagnant pattern in place until we get rain or wind we are likely to see this. so for today, and likely tomorrow, moderate to slightly unhealthy air quality. also the king tides are back along with a nice bright full super moon that you can enjoy this evening. but again getting back to the coast and inside the bay, expect some of the low-lying areas not just along the beaches but our parking lots and trails to experience flooding. we have the next high tide at 10:00. here is a look at the temperatures. a cool start but not as bad as we have been. low 40s to low 50s in the bay area. 45 in santa rosa and in san francisco and pacifica. afternoon highs under partly cloudy skies and low 60s and 62 in mountain view and 63 for concord and the north bay 62 for napa. there is a look at the extended forecast where again we are going to remain mild and dry today and tomorrow and wednesday, it gets more interesting with rain entering the bay area. scattered showers in the forecast for thursday and friday and then we dry it out for the first weekend of january. we were looking at perhaps about an inch-and-a-half rain coming our way. that will be great and now a half-inch to an inch. it will fluctuate between now and wednesday, thursday and friday. but, again, we will take what we can head coach, jack del rio. interested in hiring former coach jonathan gruden. he went 25 and 3 with the silver and black but the team was six and ten this year and it was a year in which they were expected to contend for the super bowl. owner mark davis told del rio that he would no longer need his services. i told him how much i appreciated the opportunity he gave me. and i mean that very grateful. my childhood team. but it is a results business. i understand that. >> the raiders said we appreciate jack's effort in building the foundation of the team. thanks to jack and his wife linda and his family for the contributions to oakland. we wish them the best. we will talk about this more, we will entry in sports director mark ibanez. >> a tale of two different locker rooms. the raiders looking now for a new head coach. the 49ers excited about their future. yesterday they took down the rams down in la, 34-13 to win the 5th straight gain. garoppolo had two it was and had a couple of intersections. the game in doubt. the rams had little to play for and so they decided to rest a few of the stars including jarrett goff and todd gurley. the 49ers happy about the win and what the future holds. i would say i am surprised. we hold ourselves to a high standard. we went on the field and expected that. throughout this whole season there have been hiccups but i think overall it is a good experience. the 49ers and raiders have the same record the nfl will flip a point to who picks 9th and 10th for the april draft. a year ago today chip kelley was head coach of the 49ers. the raiders were a team without a future home. >> you can say it has been an eventful 2017 that has included another championship plight for the 49ers. joe fonzi takes a look back. >> the golden state warriors made sure that 2017 was a day to enjoy the championship. kevin durant durant thriving in the atmosphere. the achievement puts the stamp of validation on a long and distinguished career. >> can get any better than that. money, money, fame. material gain means nothing when it comes to winning. the warriors have won two titles in three years. stanford university won four in this calendar year. stanford is the ncaa champions for men and women. and its women are the water polo and swimming champions. that gives the university 115 ncaa titles. more than any institution in college history. cal does not have the overall numbers to match the pack 12 rivals. the bears own rugby. two more championships added to the total of 28 overall. >> and talk about being a champion, bay area boxer andre ward retired in 2017 after his final fight in june. ward hangs up the gloves at the age of 33, an olympic gold medalist and 32 and 0 as a pro. one other bay area team has the distinction of winning it all and folding, the san francisco dellf won the championship before a sold out stadium and announced that they were broke and were disbanding. the rest of the bay area sports landscape runs a varied spectrum. the long-awaited announcement of where the oakland a's came and winter as the team continues to stockpile prospects to where management says they will be ready to start in that ballpark when ever it is built. >> the raiders are expected to be in las vegas having broken ground on the palace that they plan to occupy in sin city. oakland's other tenant, the basketball champions will have one more year in the east bay before taking up residence in their original bay area home. just up the road from the warriors new arena is a baseball team that lost 98 games and finished 40 games behind the division winning dodgers and said goodbye to the only man to throw a perfect game in franchise history. the giants swung and missed on giancarlo stanton and joe atani. for the first time the giants are concerned about filling the seats at 3rd and king. the race is still on to compile a roster that can stay healthy and stay away from hazardous off the field recreational activities. for now, the bay area still has two football teams, both proved it doesn't take long for fortunes to change. while the return of marshawn lynch to the raiders was a nice field good story not enough for oakland to live up to preseason expectations that included talk about playing in the super bowl and with the new general manager and head coach the 49ers seem to have ways to lose during the season. then when it seems like the half empty levi stadium would never see a win. the 49ers acquired a guy to fill the position considered the most important one in the nfl. number 10, jim garoppolo's jerseys may outnumber the 16s and 8s in 2018 and add a star with money ready to be spent in san francisco's santa clara home may actually see another signature win or two. after a season that saw them make it through the stanley cup finals for the first time in franchise history the sharks were in the playoffs again. the veteran joe thornton played on a torn acl and the post- season was a farewell to the beloved patrick marlowe. but again the sharks were eliminated and expect to be in the playoffs and we will see if it turns out differently. >> this year's heisman trophy winner is baker mayfield. >> and on the subject of de javu all over again the runner- up in the heisman trophy was from stanford. brice love joins toby gear hart and andrew luck and christian mccaffrey as the cared that made a trip to new york to shake hands with the heisman trophy winner. also on the college football front justin wilcox got cal one away from bowl eligibility. brent brennan has heavy lifting to do at san jose state but the spar substance went in the off season with a big upset over bowl bound wyoming. as usual if you want to have a little taste of everything, this is the place to be. you can watch jordan spieth defend his championship and kevin hart defend his or catch stages of the tour of california in monterey and san jose but the determining factor in a successful year in mayor and dee lane easton. the two more republican are john cox and orange county assembly man travis allen. new stars have a campaign for this year. reese witherspoon and three others in the entertainment have announced time is up. aimed to protect women facing sexual harassment in all sectors of the work force. it includes a legal defense fund and a push for legislation to strengthen laws regarding workplace harassment. many stars are involved. a modesto man to keep drunk drivers off of the roadway. the mistake he has made that is helping others to avoid. the sale of recreational marijuana is now legal. a dispensary is in oakland where people have been lining up since the early morning hours. >> you're watching the bay area's news leader. ktvu. this new year brings new laws and the most talked about is the legalization of the sale of recreational marijuana in the state of california. >> we have more from oakland at harbor side where christian, anyone over 21 can walk in and buy an ounce of marijuana. >> looks like they lost their audio. >> go ahead. >> reporter: can you hear me now? >> perfect. >> reporter: perfect. guys you were talking about that, the fact that people can go in. i was saying that there is a lot of demand. we have had people lined up as early as 6:00 last night for the opening that was set for 6:00 this morning. and as you look you can see the customers here inside harbor side and it has been like this all morning. more or less steady. there was a big rush first thing this morning and we have videos that we can show you what that looks like so you can get a sense of the excitement. a lot of people excited about this new law going into effect. the ability now for people to buy and use recreational cannabis. the rules are 21 and up. you can't smoke it in public or use it in public. you have to do it in a more or less private area. think of it akin to one person said you can buy a beer at a liquor store but just can't drink it on the street. it is that idea. also keep in mind that this is now a legit business in california and taxed. 15% state tax and a county tax on top of that. if you are looking to buy, factor that into your cost. we talked to one person that says that they bought $30 worth of product and spend eight dollars in taxes. that is what comes with legitimacy is that all of a sudden you have to pay legit price for it. one more note. we have been talking about all morning, that because there is still a conflict between state law and federal law, you can purchase it, use it here in california, legally. kind of a gray zone, you can take it out of state like you can't take it from what i understand, you can take it from another state where it is legal. if you wanted to buy cannabis here and transport it to colorado or washington state. you can do that. you can take or use it on national parks because those are still under federal jurisdiction. a lot of things to keep in mind. you know they have said that they roll out in colorado and washington and it was bumpy and they are expecting some bumps. we will have to wait for it to show up and figure out how california will navigate it now that use or the sale of rehabilitation cannabis is legal throughout the state. >> christian, thank you so much. we will turn to the question of the day. how does the new law allowing the sale of rehabilitation marijuana affect you. we will have a peek. 17% says you can buy it legally and eight percent say you may try it and 74% say it doesn't affect them. a tweet here says i don't believe that many more people will use it just because it is legal. we will see. a gentlemen says it won't affect me unless they are driving under the sub standards and crash into me that is a concern. bay area police are worried about people driving while high already. even before the sale became legal this morning san francisco police says one in every four drivers they pull over is high. several breathalyzers are coming on the market, one developed by a lab and by an oakland doctor. it has technology to detect people for recent consumption of thc. everybody is getting behind the notion of the marijuana breathalyzer that can truly differentiate that person that is probably stoned right now versus the person that may have it in their system. thc can stay in the blood stream for weeks. right now police use traditional field sobriety tests. let's get updated on what is happening in the bay area and the country. we bring in ktvu's dave clark. hi. >> gasia mikaelian and mike, thank you. here is the top stories. a vigil in oakland will remember the life of oscar grant. in the 9th anniversary of his shooting death at the bart station. every year people gather to remember the life of oscar grant shot and killed january 1st, '09 on the platform of the bart station by former bart police officer johan messerland that grabbed his stun gun instead of his pistol. he was convicted of involuntary manslaughter was sentenced to two years in jail and released after 11 months. the undocumented immigrant acquitted of murder and manslaughter charges in the san francisco shooting death of kate steinle is due bang in courtroom. the judge will sentence jose ines garcia zarate. he will be punished for being a felon in possession of a firearm. he said it was an accident and it happened when garcia found a stolen gun under a bench. we were still following developing news in san jose in the expressway here. these pictures taken from a traffic cam was of a two alarm fire in that block of the expressway. it may be at a commercial building. we have little information. a plane crash in puerto rico that killed ten americans is being investigated. five of them killed was a frame from new york. the puerto rican president says the pilot was her cousin. a month ago the plane passed a safety inspection. those are some of the morning headlines back to you. this new year's day is not a holiday for california highway patrol. the chp says it is all hands on deck during this maximum enforcement period. it started friday night and continues until midnight. officers out on force on bay area roadways and highways watching out for drunk and impaired drivers and people using their cell phones and seat belt violators and speeders. >> a modesto man knows the consequences of drunk driving offering free rides to his friends that had too much to drink. the self guilt of when you have done it is so much worse than any jail cell they can put you in. there's no confinement that could be as bad on yourself as your brain. you are always going to be your biggest critic and to get over that guilt of knowing that i could have hurt and killed multiple people, i don't want anybody to have to live with that especially if they can do it by just a simple phone call. jonathan says he doesn't drink anymore and that he has been the designated driver for a couple years now. we have been reporting the oakland raiders are in the market for a new head coach after they fired jack del rio. let go yesterday after losing to the chargers 30-10. it capped a season that started with a lot of first off. happy new year to. >> happy new year to all of you. >> thank you. >> good to be with you. >> john fox was fired by the bears and i kind of get that, that's three consecutive last place finishes but the disappointment is perplexing. they were in the playoffs last year, mark. >> a couple of things. number one, i have had this feel fogger a long a -- for a long time that something occurred in the locker room and something that we are not privy to and maybe it will come out and maybe it won't. but it seemed when talking to people in the media, a lot of them feel the same way. there had to be something going on for a team this talented to look so discombobulated. so see them fall to 6 and 10. i felt there would be a coaching change i would say about a month ago because the raiders are a tight organization, they have a lot of the former players in the media that have continuous access to radio shows and very messaged oriented team and when those former players started talking openly about possibly a coaching change needed or criticizing jack del rio openly, i started to think this is a message from the top and it started to become more and more real so i was not surprised at all about this. and then when you add the name jon gruden and having a former player like rich cannon a well respected television guy now, former raider quarterback and mvp say for the first time in a long time he thought all of the gruden rumors had substance and rich cannon has credibility and when gruden's name sneaks into it, i have a suspicion there is more to come. why would you fire jack del rio without having someone in particular in mind? that's the way i see it. >> do you think gruden is the guy or anyone else behind the wings? >> i think that's the guy they want and it would be mind boggling to me to think that they fired him this quickly without having a specific plan in mind and maybe they did that as a message to jon gruden like look, we are very determined. we know exactly what we want to do. and we can do it and we are showing you how steadfast we we -- in this approach by not wasting time. i can't imagine who they would have in mind other than a name that pops up, how about jim harbaugh. >> coming back to the nfl. >> yes. >> let me ask you, what would gruden do for carr? how would he benefit having a jon gruden as a head coach? >> jon gruden is perceived as a quarterback guru. he takes special pride in bringing on young quarterbacks. and in talking to a lot of people over the past couple of months since it has been so obvious that carr has taken a step back, my feeling and a lot of other people's feelings that carr has lost a lot of self- confidence. there is a lot of self-doubt and hesitation in everything he does and gruden in my mind would be the perfect guy to rehab him so to speak, maybe even not just mentally but physically, a lot of people feel that maybe he came back a little too soon from his back injury and also recovering from his broken leg of last year. he is kind of in the pocket, he gets rid of the ball so fast that maybe he is thinking in the back of his mind about that broken leg he sustained after being sacked last year. i think gruden would be the perfect guy to bring carr back and take advantage of his still abundant talent. just taking a step back. mark ibanez, what time did you go to bed last night? >> and lose weight and get healthy finally this year. unfortunately it is also the resolution that is the most broken. gym memberships soar in january and many people throw in the towel by february and trainers say there are ways to stick to that new year's eve resolution this year and keep going to the gym. >> if you sign up and don't know what to do, you're not going to come back. if you want to make the most of it, find some help, whether it is a class or a friend or a trainer. >> even if you are not feeling it, get yourself to the gym and do what you can do because once you get the routine it is more of a pain than not go to the gym. research shows probably 50 million americans will vow to work out more and lose weight during the new year of 2018. we have more on this trend of early january at the gym. leigh martinez in boot camp with advice on keeping the personal goals. >> reporter: yes, there are about 30 people here who are starting 2018 off sweaty and starting 2018 off getting fit and doing more than i have in the last couple of weeks. so they are just taking a break and we are going to be talking to a trainer and talking about this is one of the best in the bay. you have been voted best. when i hear boot camp i think military and someone yelling at me. is that the case. >> we try not to yell anyone but just to encourage them. i think of boot camp and high intensity and that is we got the inspiration to do this and it is body weight exercises and interval training and a lot of stabilization too. >> reporter: i see everyone is doing something different. we were talking earlier about calisthenics. are they burning calories so what are they doing. >> burning calories and other days we will built foundation and strength and muscle. >> a resolution for a lot of people to lose weight and get healthy. what is the strategy. so many people end up not sticking to it. >> the number one strategy is to build a community. you know, whoever is starting out with a workout, if you can find a friend and find a community and nice gym that changes things because sometimes people will want you to be successful more than you want it for yourself. we try to make sure that we are a community of change. >> and finally diet. people are living heavyweights and everyone is jumping. there is a lot of work but what about diet, what if they leave and go to in and out burgers. >> in and out is across the street. the biggest tip is to prioritize. make sure you are prepared, because if you are not you will eat something bad at like ten p.m. you want to meal prep and we have territory foods over here as well which is a partnership to get your meals delivered to you. >> how many of you are feeling guilty? so find a community and find something you love to stick with and that nutrition is a big part of it. make sure you have plan and that you know what you are eating throughout the day. and hopefully you will stick to the resolution. >> got it. thank you. we were joking we should check in on that gym february 1st. that's my experience and hopefully everyone comes back. if you can get basically to april, you will be there throughout the year. i have heard 21 days to form a habit and in the end you feel worse if you don't go. >> my bad habit is eating. i have to change. >> i need to get more sleep. that's not going to happen. >> we have confessed
