And Alameda County do the possibility of misconduct by prosecutors just conduct that the Alameda County da. Says purposely excluded blacks and jews from juries kron fours. Dan kerman has the story. Recognize how terrible this and it is something that we have to make right. A News Conference monday, Alameda CountyDistrict Attorney pamela price said a federal judge has ordered her office to review 35 active Death Penalty cases going back 30 years for prosecutorial misconduct. Certain prosecutors and the Alameda CountyDistrict Attorneys office. May have intentionally appeared to have intentionally excluded jewish and black jurors from Death Penalty cases. Prices these prosecutorial note suggesting the exclusion of blacks and jews from juries were discovered when her office was reviewing the appeal of our mistakes. A 51 yearold man convicted in 1993 and sentenced to death in 1995. For the murder of a 9 yearold and the attempted murder of his grandmother during an attempted robbery. The discovered notes were shared with the federal judge in the dikes case who ordered a more thorough review. The evidence that we have uncovered suggest plainly that many people did not receive a fair trial in Alameda County. And as a result, we have to review all of the files. To determine. What happened and what the appropriate remedy price says that review is now underway and loved ones of those harmed by those on death row. Are now being informed of whats going on. She says the alleged misconduct is not limited to just one or 2 prosecutors and dougs case is not the only one that suggests similar misconduct. Price says she doesnt know how many of the 35 cases involve misconduct, but she believes more than one. She also says none Death Penalty cases may also involve misconduct. Dan kerman kron, 4 news for more insight into this story. Kron 4 legal analyst and former prosecutor Michael Cardoza joins us michael, youve been criminal law in the bay area for many years. And you work in Alameda County. Im not going to say it your tell me, do you know anything about this going back 30 years . Was this kind of thing actually happening . Well, not to my knowledge. It wasnt happening. I left there in 85. I to my knowledge, it wasnt going on that end in this particular case, i remember the case and ive talked to some expresa que turs end. The office tax apparently was the 10 minute the landlord. The landlord went over to collect her rent and her grandson. I think it was 9 years old was in the front seat of the car and dikes refused to pay the rent and explain that to by shooting. Yeah. And hitting her in the neck and apparently shot the grandson right in the chest, killing them. And thats why i went on trial for murder. What the das office is still in is that in those cases going back the facts of the case, Police Reports the transcripts and apparently there were some notes from the da that prosecuted the case that there were 5 notes and a couple of them referred to a black juror and a jewish tour and said that they were going to be excused for after because he did not want them on those particular brown. What his thinking was, im not my question is what was the composure of that year yet . But with a composed how many blocks were on the jury, how many caucasians, hispanic . We dont know any of that. And because there are some notes that dont look too good because of the language used it doesnt mean that in totality, he got rid of all blacks or all jewish people. They have to look into that. So to put these notes out right now doesnt make a lot of sense today. I this is obviously too complex for a really short discussion. But da price is the subject of a recall. How does this factor into . Her thinking at all, in your view . I dont know if shes thinking at all about that, but i surmise thats exactly what used to it. This is getting in the effect she was. Its getting the headlines. Its saying look at look what im doing and try and to correct wrongs that happened. What 25 30 years ago. You know, i think people elect were coming on this president ial election and we look at the economy and this look around the house grand doing are they prosecute today . The crimes that are happening or is this just magicians type distraction . Look over there and what were trying to correct evils that happened in the past. If there were enables good for, but that doesnt take the spotlight off. What is going on or whats not going on within that office today . I mean, when people look at her philosophies that a lot of people say, i look around house crime, you know how the property crimes. So that thats in my opinion exactly what shes doing. And shes trying to make hay out of this saying look at look at correct in all these labels that happened 20 years ago. And by the way, all the loss about what gary, questioning. Jurors have changed. So the law has changed thatpand prosecutors if they were inclined to do that, can do that anymore. So the loss change. So now they look back what they wanted let this guy go free, reduce it to him now life without possibility of parole. I dont know. I dont know what other evidence she has. But if theres something that shows that this happened and it was pervasive, ok, go for but Pay Attention to today, too. But talking about the evils of the past. I mean, these notes do not look good regardless of of what they currently lead to. So what would be the rectifying a way to to solve this issue . We would presume 30 years ago the prosecuting attorneys that were in that office may not even be around today. And if they are, theyre certainly much, much and is it just getting this guy off on a lighter sentence or releasing him from prison because of a tainted jury pool. Well, like i said, dont they have to look at new more . Whats the composition of the jury . And i were there black said jewish people on exactly compose this jury because you cant water to blacks and you write some notes that are nasty. Doesnt mean that there werent other black people on the jury. I dont know. They havent let that cat out of the back end, but the remedy will be. As you know, we dont put people to death in california. The more so thats not on the table. So remember, scott peterson, one of the court the Supreme Court reduced peterson apply for possibility of parole as so that might happen here. One would hope it doesnt lead to, you know, retrying the case because where youre going to find the witnesses
