it's the first gun reform law of its kind to be passed in the country. the council members say will aim to promote safer gun ownership. but opponents of it say the law violates their constitutional right to bear arms. just moments ago that dylan law group and the national association for gun rights announced its lawsuit filed last night against the city of san jose kron on's sarah stinson did speak to some san jose city council members about their vote on the measure. she has more details on what comes next. >>san jose is the first city in the country to approve a gun law like this. so it's expected to hit some snags along the way. but if and when it does go into effect to the gun law will require gun owners to have liability insurance. they'll also have to pay a $25 annual fee. police officers will be enforcing this by asking for proof of insurance every time they encounter someone with a gun, the first of its kind ordinance also gives officers the right to seize a gun from a non abiding owner. me, my objective is to make. >>gun owners take care of their guns so that they're not used in a way that they're not intended to people's the only council member to vote no for both the insurance and fee was councilman dev davis. i think it's cost unconstitutional. i can't vote for something that's not good policy and he's going to tie the tied up in the courts. >>our >>many, many years, the firearms policy coalition agrees that this is unconstitutional saying, quote, san jose's insurance requirement for law abiding firearm owning citizens is burdensome unconstitutional and prohibited by california law continued by saying the second amendment prohibits local governments from imposing such requirements on gun owners. davis explained to me was she thinks should be done instead to prevent gun violence. the police tell us that most of the guns that they confiscate illegal activity are ghost guns. we need to get the ghost guns off the street. the san jose mayor says he is ready for any legal battle. that is to come. the city council is expected to discuss this again on february 8 and they hope to have it implemented by august 8. i'm sarah stinson reporting back to you. >>now, aside from all this, it was a wild morning in san jose. police say a man wanted for a triple stabbing has died after getting hit by a car on highway. 85 kron on's charles clifford is joining us now from san jose. charles, what do we know so far about this? >>well, this is about a bizarre case that has a tragic ending. let's go ahead and a look at some video here and kind of walk through i walk you through. what happened now, according to the san jose police department, about 2 o'clock this morning, they responded to the 2100 block of tehama. this is on the east side of san jose where they found 3 stabbing victims inside a home. they had non life-threatening injuries and they were able to quickly identify a suspect in the stabbings because the man the suspect lived in the home with the 3 victims. the suspect had fled the area in a car. they started searching for that vehicle and founded a short time later on the west side of san jose near de anza. and 85 then around 5 o'clock in the morning. the san jose police department got a call from the california highway patrol who are investigating a fatal pedestrian accident at along. 85 at de anza. they determined that it was the suspect in the shooting and are in the stabbing. he had died. now at this they say that he was not being pursued when he died. they don't know why he ran into traffic and was killed there. and also they don't know a motive for this attack. the investigation is still ongoing. we don't know. >>what precipitated or or what motivated this individual that to commit the stabbings during the investigation. we were in the process of obtaining an arrest warrant for him for attempted murder for this incident. >>obviously, very tragic sequence of events this morning. i 3 victims. their injuries range from minor to moderate. and now we have the deceased suspect. >>we're having some technical difficulties charles is live shot, but he'll continue to have updates for us on this story as we go throughout the day to the east bay now where teachers with west contra costa county unified school district are threatening to go on strike if the district doesn't address some covid safety concerns among their demands. the teachers union wants kn 95 and n 95 masks provided to all students and staff daily. they want opt out instead of opt in covid testing, meaning more students and staff will likely get tested. they also want to plan that ensures a qualified adult is available to fill in when a teacher is out of the classroom and they would like a formal procedure for what happens in the case of a class covid outbreak. all of this comes after dozens of students and teachers tested positive for covid over winter break, which then forced classes to be canceled. the union and district leaders are set to resume their talks today after meeting on monday. kron on's phillipe chagall is following the story. he's going to have more for us coming up on kron. 4 news at 3. a similar discussion over in oakland has resulted in a tentative deal between the oakland educators association and oakland unified schools. educators had threatened to strike and students held sickouts for the last few weeks over covid-19 safety concerns. the tentative deal, though, does call for weekly testing for students and staff at all school sites. if there is a limited supply, the tests will be prioritized to those who have been exposed to the virus. the deal also provides access to n 95 and higher quality masks and better ventilation and the classrooms as well as more outdoor spaces for students to eat their lunch. the deal still needs to be voted on, though and approved by the union of the school board. big story out of wall street this afternoon. stocks rising sharply after the federal reserve signaled today it plans to begin raising its benchmark interest rate in march. as of 30 minutes ago, the dow jones industrial average was briefly up about 500 points. are 1.4%. nasdaq come composite added 3.2% and the s and p 500 gained 2.2% iyer interest rate means a wide range of borrowing from mortgages, credit cards, auto loans will get more expensive as well. but the central bank's current low-rate policies have also escalated inflation. this also plans to phase out its monthly bond purchases in march. supreme court justice steven briar is planning to retire at the end of this supreme court term as our dc correspondent trevor shirley reports, this sets up president biden to make his first supreme court judicial nomination later this year. well, this announcement really came as a surprise earlier today. what it will do is set up a showdown in the senate over confirmation hearings. >>what it will do, though, likely is change the ideological breakdown of the court as it stands right now. justice steven briar was appointed to the court in 1994. by former president bill clinton. he's a consistent liberal voting. many of the court's decisions that split down ideological lines. but it 83 years old. his retirement is not totally unexpected. the white house said earlier that any decision to retire is left entirely up to the justices now begins the washington guessing game of who president biden will nominate to fill this vacancy back on the campaign trail, biden pledged to nominate the first black woman to serve on the court. so there will likely be high expectations that the president remain committed to that pledge. whoever he nominates the current breakdown of 6 conservative justices and 3 liberal justices likely won't change the timing on this, though, is worth noting since the midterm elections could see democrats lose control of the senate, which votes to confirm judicial nominees. justice briar may have considered that when making his decision. but so far, neither he nor the supreme court has commented on this announcement. and so far the white house also hasn't laid out any kind of timeline as to when president biden might name a nominee to fill this opening reporting in washington. i'm trevor shirley. >>coming up at 2 o'clock, i'm going to be speaking with law professor rory little to discuss a little bit more about what the justices retirement means for the supreme court. back here at home, governor gavin newsome was in the south bay today highlighting his proposed climate related spending plan. speaking of palo alto, he said he wants to spend a total of nearly 38 billion dollars to help california go green. 10 billion of that is allotted for electric vehicle transformation. the governor said california's climate effort is the most progressive initiative in the nation. >>the industry has radically changed for the benefit of each and every one of us in a world where work i was speaking with kate rooney, our sports reporter, kate. she had frost on her car this morning and on grass outside. she lives in moraga. it was very cold this morning, i guess for some folks and not only that, no, well, but there was also a dense fog advisory for parts of the bay area. but as you can see, the sun. >>making a reappearance out there this afternoon, a little bit hazy, though. so we are still tracking moderate air particles up and down the bay area coastline from coastal valleys as well. we're going to notice that haze sticking around tomorrow as well as today and taking a live look outside as far as temperatures go quite the spread out there. check out oakland, 49 degrees, very stubborn marine layer. they're so slow lifting in burning as far as that fog bank goes. but everyone else in the low to mid and upper 50's san mateo, nearly 10 degrees warmer than oakland at 58 degrees. mid 50's for downtown san francisco and 58 degrees of peace for valais. and even for those of you in napa. but santa rosa also track that marine layer. so we are seeing temperatures there in the upper 40's, much like oakland when trucker for though very calm wind speeds. we are going to notice winds out of the north and east today and tomorrow, 20 miles per hour or less. gusty us along the san francisco peninsula coastline. but noticeably calmer for everyone else in the bay area. but we are going to see some changes ahead. we're going to stay mild and dry for the next couple of days with a slight chance of showers making its return to the bay area today. no, well, day 19 of no monarch butterfly population. >>appears to be on the rebound. the number of endangered western monarch butterflies wintering in california has been counted now at more than 247,000. that is huge, especially coming after a year when fewer than 2000 we're actually recorded. so a much larger population right now. actually, a friend who's been really good about trying to attract more monarch butterflies and help the population growing. still, these numbers are far below what biologists say is needed for a full recovery. but it is a good sign. nonetheless. >>all right. coming up, why on january 9th and hospitalizations peaked at the end of last week. however, there are still warning hospitals are very full. the county currently has 281 covid patients hospitalized expect fewer hospitalizations in the coming weeks, though. currently there are 29,000 active cases and contra costa county. up in sonoma county. there's going to be a large scale vaccine clinics starting this saturday. they say it's part of an effort to expand access to vaccines and booster shots. those clinics will be held in the garrett building at the sonoma county fairgrounds. going to be held every saturday and sunday, each for the next for the next 4 weekends. it will be from 09:00am until 04:00pm county says appointments are required but they do suggest making want to guarantee a spot you can sign up on that website list on your screen might turn dot ca dot gov. beginning this friday. walgreens is going to start giving away free and 95 masks. there's going to be a 3 masked limit per person. while the official start of the program is this friday. while greene says it's a rolling start, so some stores may take a few extra days actually get their supplies in. we are checking with other drugstores like cvs and rite aid to see when they'll start handing out. and 95 masks haven't heard any details back from them. a large group of forty-niners fans are expected to head south for sunday's nfc championship game between the niners and rams kron on's fully chagall spoke with a few who are hoping to land tickets to the highly anticipated matchup. >>to say adam fox and his son keaton would give an arm and a leg to watch the san francisco forty-niners square off against the los angeles rams at so-fi stadium in the southland might be a stretch but not too far off dry fly train. >>anything the danville residents say travel wouldn't be the problem. it's just difficult. finding tickets at a decent price. and they've been looking since the niners ended the green bay of hate crimes against members of that community. it's top of mind for san francisco police chief bill scott in chinatown. yesterday. chief scott said there's been a 6 fold increase over the past 2 years when it comes to ap, i hate crimes. 8 incidents were reported in 2019, 9 were reported in 2020 last year. a huge jump. police have investigated 60 crimes against the ap. i community chief scott says more than half of last year's incidents, though, were committed by the same person who they were able to arrest last august san fancisco district attorney chase of the dean is the subject of a federal lawsuit. the alliance for asian american justice says the da's office isn't doing enough to prosecute those who commit hate crimes against asian americans and pacific islanders in the city. the alliance says it's had a hard time finding victims willing to speak up. kron on's rob nesbitt reports on one man who did have the courage to go public. >>his name is on late and he broke down into tears at one point during tuesday's press conference when talking about his attackers and the lack of justice in his 2019 case since the pandemic, more asian-americans have had to endure encounters like these. hate crimes that often turn violent. it's why brian son helped start the alliance for asian american justice last year. growing from 5 lawyers to more than 90 law firms today. we don't want to be walking down the street and have somebody yell out. >>you brought the virus here and start chopping honest with the bat. on tuesday, the lions game on lay a platform to share the story of how he was attacked while out for a walk in san francisco's chinatown saying and beat him with a glass bottle while threatening to kill him. the attack was the most brutal. >>terrifying and you really experience of my life. and the stay with me ever since according to lay them and adolescents and also beat him with a bat and made death threats in addition to sharing his attack, lay expressed his frustration with how the san francisco district attorney handled his case allowed the adult male attacker to to a misdemeanor. with one year probation. the alliance for asian american justice has filed a civil lawsuit on la's behalf as well as a federal lawsuit against district attorney jason dean in response to recent hate crimes. >>quinton is one of the lawyers representing lay these attacks have left our communities in mourning. terrified. let me repeat that terrified. a further severe harm toss as the federal lawsuit isn't seeking money but is asking for restorative justice and an apology from the da's office are seeking systemic change. and we're hoping that other asian-american victims will step up because we're willing to step up with them. i've reached out to the san in the east bay. 10 days after french bull dog was stolen from his owner's at gunpoint in castro valley. the alameda sheriff's office returned t tow to his owners you can see in this video. we're so grateful to see him again. investigators say they made several arrests related to tito's theft that they think could be connected to several other dog thefts in the east bay. so a lovely reunion. 100% on the peninsula. police are investigating another smash-and-grab robbery involving local jewelry stores. the latest happening, a tan friend mall in san bruno. kron on's dan thorn has that story. >>san bruno police say these types of crimes that happened twice at the mall in the last week. groups are rushing in and using tools to smash open cases and stealing things. but in one case, a store owner was actually able to fend them off. store owners are on high alert at the 10 for all san bruno police sharing these pictures of a group accused of smashing display cases at a jewelry store and stealing an unknown amount of merchandise monday night. it was the second time a jewelry store was targeted at the mall in less than a week. that's crazy that people would like have resort to things like >>i don't know the solution is. it's kind of tragic that these are happening at all. >>shoppers like ariel nigam say smash-and-grab crimes have made going to the mall a little uncomfortable jewelry and high-end retail stores across the bay area have been seeing a recent increase in these robberies. and the scary think that this would happen here. police say despite one man in this group of one of the robbers being armed with a gun on friday, a store owner was able to keep them from taking off with any of his stores jewelry. a display case was destroyed. but once the store owner drew his own gun, the group ran off. police say fortunately no one was hurt. it's unclear if these 2 cases are connected. some shoppers suggest that right now people should be keeping their eyes peeled well out at the malls. just people have to watch out for other people. >>have to say something. you know, god gave us a mouth to speak. that definitely. i see something going on >>san bruno police have not identified any of the suspects. and so far no arrests have been made anyone with any information about these crimes is encouraged to give them a call. reporting in san francisco, dan thorn french president macron's office just announced this afternoon, russia, ukraine, france and germany have agreed to hold talks on the ukraine conflict in 2 weeks. earlier today, the united states delivered an official response to russian demands that ukraine and other ex soviet states never will be admitted to nato. moscow also wants nato to roll back troop deployments in eastern europe, according to secretary of state antony blinken, the u.s. and its allies sent a written response. no concessions will be made. russia has warned it will take, quote, retaliatory measures if the u.s. rejected its demands, there are an estimated 100,000 russian troops near the ukraine border right now. and most analysts do expect flooding reputed to invade. back here at home. the city of san francisco is taking new steps to protect people from eviction. the board of supervisors just passed an ordinance that is the first of its kind in california. kron on's camila barco is in san francisco with the details. >>this is a huge step in reducing evictions here in the city. this legislation gives tenants more time to prevent them from being evicted or save for by the local laws. state laws that we passed, the temporary laws put in place to stop evictions during the pandemic. >>have proven to be successful for san francisco supervisor. dean preston. now he's making it a permanent solution. it's not that landlords won't get their money. it's that we should not be using the fiction as the way to resolve the dispute around money. preston authored the legislation. >>making landlords throughout the city, give tenants a 10 day. notice. >>before beginning the eviction process, this gives tenants the opportunity to fix the problem that could lead to eviction. gives the tenant the time to either come up with the rent resolve whatever the other dispute is, get an attorney if they need one and try to prevent infection prior to the covid-19 pandemic. it only took 3 days before landlords could file. >>an eviction notice. >>but since the pandemic, california state law says landlords must give a 15 day notice if they intend to the laws are very harsh. and so a lot of these protections >>are expiring. the most common eviction filings are for people who don't pay their rent. according to preston, those filings dropped during the pandemic. they went from one 27 per month. 2, 3 at the end of 2021. he credits the pndemic-related policies put in place. and preston says his legislation will ensure tenants continue to have those protections even after the pandemic. so we need to make sure that we don't return. >>to the days when these eviction numbers every year we're in the thousands and hundreds of people a month being evicted. now, preston and the board of supervisors unanimously agreed on this legislation. now, mayor london breed needs to sign it off. and if she does, this could take effect starting in march. for now, back to you. >>time now for a recently and it's going to start at 3.30 for your sunday afternoon. temperatures in los angeles near 70 degrees. a lot of sunshine out there. so best of luck to our forty-niners. and yeah, here's a live look outside east bay over berkeley. we are noticing better lifting and clearing with that fog bank. a lot more sunshine, though, this afternoon, but they expect another round of dense, low clouds and fog to start your thursday morning. but future cast for going to see a pattern change as you could see, increasing cloud cover friday into saturday. but unfortunately, no rain this week storm really just going to make its way north of the bay area. bringing us cooler cloudier weather more sunshine for the 2nd half of the weekend. and take a look at all this rain. you would think that we're going to get a lot with this storm. it turns out it's going to be on the weaker side already trending drier, as i speak with, not even traces amount of rain showing from our futurecast rain totals from now through monday night. so i'm definitely not looking forward to this weather pattern. it looks like long. yes, starting to shift and really dry out. she did give us abundant rain to start out our wet season. but now this 2nd half looking dryer as i speak. so let's take a look at temperatures out there right now. still going to continue to see very mild, dry, hazy conditions for your wednesday afternoon, oakland, upper 40's because of that fog bank as a santa rosa, everyone else in the bay area tracking widespread 50's and then expect to see 60's throughout later this afternoon with a few degrees above average temperatures for warmest inland valleys, about 5 degrees above normal. and taking a look ahead at the next 7 day forecast not liking this pattern at all know. well, we're going to stay cool and dry overnight, but then no rain in the forecast. unfortunately, back to you. that's upsetting. all right. thank every said the world health organization is reporting. 21 million new covid cases globally. >>last week it's the highest number of the who has recorded since the pandemic began, though they do say the number of deaths have been largely unchanged to the united nations health agency says the increase in cases does appear to be slowing. only half of regions reporting increases earlier this month. the previous highest number of covid cases was at just under 10 million. coming up later tonight, our reporter rob nesbitt is looking at how the peak is affecting the bay area. some counties now relaxing restrictions as cases lower. he's going to have that full report coming up on kron. 4 news in prime time. all right. the forty-niners now the team has begun their first day of practice for the nfc championship game against the la rams. the niners have had the upper hand on this division. their division rivals in recent memory kron on's will tran has more on what's going on today. >>they are going to hit each other today for the first time this week. they got an advantage by playing early on saturday. the last time that the rams were here, they but weapon when they played the forty-niners, they lost 31 to 10 and then couple weeks ago when they play this sunday, it will be exactly 3 weeks when they had a meltdown for the ages when they were up 17 points against the niners and then they let the niners come back in when and why was that so important? because had the rams won, the niners would not even be in the playoffs altogether. the trends, if you want to based on history is for sweeping a team in a regular season facing each other for a 3rd time. history says that the niners should win, but that's why they play the game. there's that phrase any given sunday. nobody knows that better than coach kyle shanahan who says when they hit the field, it is just pedal to the metal. >>i mean, every time reading came word that talk about and help with the all these things can change and how quick game can garage and even a model golden gate bridge on the lawn. the owner of this house has been putting on this forty-niners team display since the 1990's. he puts up around thanksgiving just in time for the holidays. but this year he's decided to keep it up to bring the niners some good luck in the playoffs. he says it's, of course, about rooting on his beloved team, but also about bringing joy to the fans have long been enjoying frozen treats with the classic cookie. but those desserts were always co branded with oreo. now oreo has its own line featuring ice cream bars, sandwiches and cones. the cookie company says these treats are more authentic in that. the ice cream is flavored to taste like the iconic cream stuffing of their cookies and the cookie pieces inside are made from actual oreo cookies as well. i'm not sure how be able to tell the difference between these ones and the ones that are branded them or co-branded, but not theirs. but i will definitely be trying that because right. coming up on kron on an update on the relief efforts in tonga speaking with the bay area company helping to shift some supplies. you're watching kron on. we'll have mo >>more than a week after a massive volcanic eruption and tsunami recovery efforts are ongoing for the island nation of tonga. a bay area shipping company is working to send out some much needed relief supplies across the pacific ocean. cecilia hulu with sf enterprises and logistics joins us now to share a little bit more about how it's all been going. cecilia, thank you for joining us. i know first and foremost, you and many of you there at the company have friends and family over in tonga. i know when we last spoke with you last week, you all had not really made any contact because of communications issues over there. what can you tell us now? have you been able to contact anyone over the area? >>contact is finally made it. we've we were able to get a full dozen people over the weekend. the internet still very shoddy. i mean, once we get a little connection, it's only about, you know, a minute 2 minutes. so, you know, we make contact there ok or our facilities are fine on lots of ash or getting a lot of complaints about the air quality and as far as any flooding in it, where are our facilities that, well, a little bit inland from the coastline. so we were okay. just the ash we'll clean up the group outside on sanogo and take years of work, come back out and actually so it's weird how it's still a big issue. >>it's a mauling like that. >>yeah, it's still falling. and they say they can visibly see it but they win for now and come back. it's covered where we are >>yes, some of the images i've been seeing really hard to believe because of, of course, john does increase incredibly green and lush. but now everything is completely brown and gray. have you been able get a better idea of what it is the biggest need over there in terms of relief right now. >>from based on talking to our work family and some are family members. they were happy. we had mass headed there already on a vessel. so luckily was they are ready, but the mask a really helpful erin hill, you national obviously causing people to water. sources are pretty much depleted, but they were lucky. a lot of that use. ealing vessels have come in already and provided water some some flights came in with with water as cargo. so they're slowly getting and getting that help. but it seems like mostly asked the air quality horrible. like i said earlier, but definitely the water there was some information released. i guess that the municipal water there was okay to drink, but against we even saw after that that recently she says the equalizer everyone scared. you know what, the next move is going to be. so we're really focused on our efforts on getting as much water. there's possible. >>definitely, i like you mentioned, australia and new zealand military planes. they arrived over the weekend with large crates of water. i know 80% of the shipments that come from you guys as prizes and logistics. go there to tonga. i know you sent a ship last week, but you're getting ready to send another one. are you encouraging people to bring donations to you guys to be sent over there? now? >>again, we'll take whatever we get. we'll send it that that's not an issue, especially general donation to mall. fortunately, our organization working closely with the lines and we're able to get help get some relief rates because not only are there people that directly affected that don't have any help from here. but there's also people that want to send their family members. you know, our usual work. you know, been doing this for 37 years. so, you know, family members that ship every vessel now even more urgent like, listen, i know i just in the box in the last year, but he want to be right behind it. you know, so we're helping with our hope when i'm getting relief rates just for the next couple feelings. because after we want to be able to rebuild its economy. you know, the local market for local stores, we can send all this really will not think about the long-term effects. it's going to have on on the businesses. you know, mean, all this free water, clean food. so putting a limit on it. we're doing it for the next 4 ceiling just to get people on their feet. but then we also have to look at the long-term health the economy. after all this, you know? >>right, because right now they're unable to to work. really. they're having to clean up and and try and just keep themselves safe. right? >>right. exactly. exactly. so when people cut, we've been getting lots of calls. i had a cobb paper called and said i want to do entire container. put the out. you won't think that that's a comfort that something you need right away. but yeah, i mean, we're not going to stop people from money to help. the outpour of support has been, to say the least. i mean, my surprise know, it just showed you a humanity and how when someone's in need people are not afraid to help out and want to help. that's a crazy thing. >>well, especially when you know something like this, we even felt the effects, very tiny, you know, we have that tsunami advisory. so i think law allowed people to have heightened awareness about what was going on there on those your next shipment leaves next week, correct? >>cricket is a vessel leaving on february 6, 7, so are receiving donations and also just the regular shippers until wednesday. the second before 4. >>ok and and you want people bringing donations just straight there to your location in oakland. >>yes, and there's a process because we have to distinguish what donated this to and what you know for personal should be. so there's plenty of help here. when you show up to give you a form to fill it out and we'll make sure your car will gets where it needs to get to. >>right. and the mo is basically their equivalent of fema. >>right. it's a national emergency management office. again, calls have been tough to get the call seem like they're coming to us from tonga. so we've been trying to call their it all. they're not able to pick up moving getting also. i'm having my office there in tonga try to make contact looking good. these containers is they get there. they process it right away. >>okay. okay. so if you have a basic needs type of donations, like you said, toilet paper, water masks, that sort of thing. that's what you guys are looking for from folks. yeah, anger. i nonperishable foods because my concern 2 now after seeing that, i still have water that that showed up after last cut off. and i'm going to on this vessel i'm starting to feel like maybe we might need to start bringing some guy nonperishable food. some organizations came light. >>canned food like noodle stuff that they can be right away. you know, just until bacon, who have no props props were so they're kind of depending on nonperishable food at the moment until they can get the forms back. >>okay. and i know that those shipments take a while to get there. but as soon as they get there, that's going to be a really big help for anything else you want people to keep in mind when it comes to this process there men and how long it's going to take to really rebuild. >>i definitely think it's going to take a little loud just like we did with michael key to this is you know, larger magnitude and just regular to be patient. and, you know, everyone's trying their best to it is much help to their family as much help to the general population one thing i did want to say what i've also talked to the organizations that helping is pay attention, expiration dates because you want to receive something and it's expired in march with this missile is to get there to march. okay. so you want to make sure that you have time on your donations, it there and get this person still be usable you. so all right. cecilia, thank you so much
