(pam) another big story we are tracking tonight: new video... just leaked showing a deadly shooting involving a bart police officer....(steve) it's video from the officer's body camera...and we want to warn you...it's graphic. grant lodes is here to break down this new perspective... (grant) pam and steve... shaleem tindle was killed january third when a bart police officer shot the 28-year-old across the street from the west oakland bart station. tonight....the most difinitive account of what happened.officer: "raise your hands."(sound of gunshots) officer: "raise your hands now" (grant in the video you can hear an officer initially say raise your hands. then gunshots. then more gunshots...then he says raise your hands now. we froze the video because of the graphic naure of what happened...but we let the audio play out...to give you an accurate idea of what happened. prominent local civil rights attorney john burris is representing shaleem tindle's family...and in a press conference last week... burris said that police officer joseph mateu ... shot tindle...burris shared a picture...pointing out what he described as bullet holes in his back. investigators found a gun on the ground after the shooting. tindle's family says it was shaleem's. in a civil claim filed by the family against bart... the tindle's say shaleem shot the man he was fighting in the leg before the officer responded... but that shaleem was not in possession of the gun when the officer opened fire. meanwhile, officer mateu (muh-too) remains on paid administrative leave. we just reached out to bart for reacton to the new video....and in part they said... (grant) as a police department and a transit agency we at bart understand that any loss of life is tragic. once the multiple investigations into this incident are complete, bart is committed to releasing all relevant information related to what happened including video from the involved officer's body-worn camera." (pam) everybody likely thought about wearing extra layers to stay warm today. (steve)we hit record lows early this morning. chief meteorologist lawrence karnow is here with when the cold will finally break. lawrence karnow: it was freezing this morning with record cold temperatures. some lows dropped into the mid 20s. highs today were chilly too in the 40s and 50s as the arctic air settled in. on doppler you can see another storm system headed our way. it's not a big storm but it is cold and snow levels will be low around 2,000 feet. showers are possible tonight and tomorrow. on the satellite you can see how the storms are dropping in from the north. these are all very cold storms. they won't bring a ton of rain but more showers and snow to the sierra. it will be slightly warmer tomorrow with partly cloudy skies and a few showers. highs will be in the upper 40s to the upper 50s. another weak storm arrives on thursday bringing showers, gusty winds and chilly temperatures. sunny and breezy weather is forecast for friday and saturday. more rain is possible by monday. by monday. (pam) the lack of rain is having an impact in the bay area ... some reservoirs are seeing very low levels of water. reservoirs in the south bay are already less than half full. coyote reservoir is 21- percent full... lexington reservoir is 31- percent full, and stevens creek reservoir is 33 -percent full. reservoirs in the east bay still retain a significant amount of their water. the briones reservoir is 88 - percent full, san pablo reservoir is 85- percent full, and lafayette reservior is 74- percent full. (pam) (pam) now to a story now to a story you will only see on kron 4... an on-going problem that is threatening the safety of one san jose neighbhorhood... homeless encampments continue to grow. the fear.... fires are being set.. as people try to stay warm... but that is threatening homes. we spoke to the same family back in november, after they were the victim of a massive fire that stemmed from this exact situation... kron 4's ali reid explains how their neighbhors believe ... any of them may be next. this has been an ongoing issue for years.no one seems to know who's responsible for conducting homeless sweeps .... but it's really starting to affect families living here. pkgsetting fires on this property has become the norm. this is ridiculous. it's not safe for them or for ussince the jungle closed down, the homeless have been finding shelter wherever they can. some of them have flocked to this property near herald avenue. back in november, a huge fire took down the singh's backyard fence. since then he says the department has been back.they start fire under the tree and the tree was burning it's frustrating for homeowners who've been calling the city non stop. it's been a cat and mouse game trying to figure out who's responsible for the land. the city says it's private property, but no one knows who the owner is ... everybody's pissed off. everybody's unhappy.the city did a sweep in november, soon after the last fire. but then the homeless returned and started rebuilding the next day.every week they start increasing i numbers. first there were 2, then 4, then 6, now if you look there are about 15-20 camps. once they clear them from our side, san jose city side, then they go to caltrans side. once they clear them from caltrans they come back to this side.i reached out to the city ... and a rep from the homeless concerns team forwarded me to the code enforcement department. but families here are looing for a long term fix.we don't want to be like clear them out or kick them out. they're going to come back again. we want the city to find a permanent solution. standupi spoke with the inspector assigned to the this case and he tells me he will be here tomorrow to figure out if they can make any type of enforcement.if not it'll go back to the homeless response team.reporting live in san jose ... ali reid ... kron 4 news. (pam) tuesday was moving day for homeless people around 5th and bryant in san francisco. the california highway patrol has jurisdiction over state land. to keep it clean, it has the right to throw away any belongings left behind. the c-h-p says, it is doing these cleanups monday though friday - - at different times and different locations. but the homeless say, this is simply forcing them to move from one location to another. (steve) on friday... sonoma county will begin it's annual "point in time" homeless count. 150 volunteers and 60 paid homeless people will conduct the from six to ten am. this year... the count will include a phone survey of 2,000 households. the phone survey is an effort to estimate the number of individuals or families county officials say they are doing the phone survey to help impact of the october fires. (pam) a man had his wallet stolen at a san francisco bart station. who police say, they are trying to stop before there are other victims. an elderly woman followed home from a taget and attacked at her livermore home. coming up: how long it took police to catch those who they are responsible. (steve) police are searching for three suspects...accused of robbing a man at a san francisco bart station. it happened around one yesterday afternoon... at the 16th street bart station...in the city's mission district. we're told the three suspects approached a male victim on the platform and took his wallet from him. all three suspects then ran off...and remain at large tonight. (steve)take a look at this video showing a man...robbing a convienence store.it happened in concord back in january.surveillance video shows the man buying a bag of chips...then he grabs the money out of the register and takes off. the police department has not said which convenience store was robbed... only that they are looking for the man seen in the video. (steve) two men charged in the ghost ship fire were back in a bay area courtroom today.derick almena and max harris pleaded not guilty on 36 counts of involutary manslaughter.their trial is set for july.(pam) as kron 4's haaziq madyun explains... a lawyer for one of the defendents says, he has a plan to get his client out of jail ... and the charges dropped. that is what both derek almena and max harris did tuesday here at the alameda county superior court house in oakland. the two defendants are facing 36 counts of involuntary manslaughter in the decemeber 2016 ghostship warehouse fire in which 36 people lost their lives in addition to entering not guilty pleas, the defense attorney representing almena say a date has been set in march to argue for the reduction of the $750-thousand- dollars bail bono and he is not a flight risk and nor is he a person who is a threat to society">he says the same goes for harris. after that is argued serra says the plan is to use evidence from the preliminary hearing to get the charges against both men dropped altogetherbecause he says one... and two... serra alleges there are a host of city and county agencies that did not enforce codes on the building, in fact he says they did the opposite however the prosecution maintains the the behavior of both defendants rose to the level of criminally neglegent on the night a party was held there that ended in the tragic loss of 36-lives. the next court appearance to revisit bail schedule will be in march, followed by a court date in april when the defense will argue in favor of throwing the case out, as of now the trial is set to take place in mid july...in oakland haaziq madyun kron4news (pam) (pam) survivors of the florida high school shooting are fighting for gun law changes. today : they experienced their first roadblock. (pam) new at ten: the use of opioids has reached epidemic proportions in the u.s. the c-d-c now says.... 40- percent of all opioid overdose deaths ... are directly connected to legal prescriptions.(steve)but what's even more alarming is that opioids are being prescribed to children... by their own pediatricians. reporter arezow ((arr-zo)) doost ((doast)) - goes indepth for us tonight. gymnastics is this 12-year-old's life.mom: "she's aware mentally and very in tune to her body."she's no stranger to injury and the pain that follows. mom: "she's my health nut."so her parents were surprised when she was prescribed all this medication. we agreed to not reveal their identities to protect the child's privacy.in october, their daughter had her tonsils and adenoids removed.and it's a very common surgery.but it's what happened after that worries these parents.dad: "it's more than 2 cups and it poured out the top."this is how much hydrocodone with acetaminophen their daughter was prescribed. dad: "why would anybody give a 12-year-old that much medicine?"what's even more concerning... the parents say just 3 days after taking this medication... their middle schooler preferred it. mom: "she'd say, 'i need some pain medication,' and i said, 'okay, we'll get you some tylenol.' she says, 'well that works better.'"dad: "we only gave it to her every other dose for a couple of days and then we said, you know, this is a narcotic, we need to back off on it."arezow doost, investigator: "do you think it was careless to prescribe that much medication?"mom: "um... yes, but i do want to give a caveat. i just think it's standard procedure."super - dr. rae brown / american academy of pediatics - dr. rae brown/chair of american academy of pediatrics: "doesn't mean that they wanted the child to have 3 cups that just means that they wrote a prescription for a long period of time hoping that they wouldn't have to hear from the parent again ever, because that's a bother."dr. rae brown is the chair of the american academy of pediatrics.brown: "children die every year because of having been given opioids after tonsillectomy. it's to the extent of the academy of pediatrics has come out strongly against the use of one specific drug - codeine which especially is toxic in a group of children."and what the food and drug administration is now doing could help... by increasing warning requirements on prescriptions with codeine. before, the agency said the drug should not be used for any reason, even coughing, in children 12 and younger. now, it's anyone 18 and younger. doost: "how much of the medication did she end up taking?"dad: "about 10%.... maybe 15."these parents weaned their gymnast off the drug... and say they never received warnings the drug could be addictive.mom: "i'm all for pain medication when you need it, but there's a time and a place and making it become over used it's just not setting the example we need to set for our kids, and it's not taking us in the direction that we need to reduce this kind of a problem." (steve) some of the medications being prescribed to children are flavored to taste better but doctors warn.... parents should not make it sound like it's candy. and by the way.. the medicine the 12 year old gymnast was prescribed hydrocodone with acetaminophen - that's the combo that makes vicodin. (grant)today lawmakers in florida showed just how tough it is to change gun laws.the house, in talahassee... voted down a bill to ban assault rifles..despite the chamber being packed with students from stoneman douglas high school....the scene of last week's massacre. but as brian todd explains...the students say they are not giving up. in florida tonight- anger, and action...(--nats--)"so i just want to thank you guys for coming out.."busloads of students who survived the attack at douglas high school in parkland, are converging on florida's state capitol... with a clear and passionate message:they want tighter gun- control laws, a ban on assault-style rifles and high- capacity magazines.chris grady/student, marjory stoneman douglas high school: "if you're not with us you're against us. we are trying to save the lives of innocent children. so - and if you're not for that, we will vote you out."the student-led call for change- comes as investigators are learning more about nikolas cruz, the confessed mass-murderer.ariana lopez, a former friend of cruz's, tells cnn: back in 2015, he asked her to be in a relationship with him.when she refused... she says, he stalked her.in a new interview (today)-- she said cruz's behavior raised alarms-- with her, and others who knew him.ariana lopez/former friend of nikolas cruz:"he used to sell knives out of his lunch box which i thought was insane. you can't have knives. 'hey guys, want some knives?'. he talked about killing our parents, our friends, boyfriends and girlfriends."cruz's behavior raised red-flags with social workers as well.a 2016 report from florida's department of children and families-- based on an in-home visit by social workers-- said cruz's mother said he had started cutting himself after a break-up... that he'd gotten into a fight with another student over a girl.. and that cruz was depressed and wanted to buy a gun.but it concluded at the time that cruz's level of risk was low-- because, an official of that agency tells cnn, he was living with his mother and getting counseling.as frustration grows over missed signals on the ground-- cnn has learned there's new evidence that pro- russiansocial media trolls are trying to capitalize on the shooting from cyber-space.. using the massacre to divide americans.the trolls, some of them automated, jumped on the story last week, with a spike in tweets according to disinformation trackers at the firm "new knowledge."many tweets were pro-gun - like this one that read:"after 11 us school shootings this year, is it time to arm teachers?" others were more conspiracy- oriented...such as: "its only a co-wink-a-dink that all these school shootings are within a close proximity to a large fbi office."jonathon morgan/ceo, new knowledge: "ultimately the goal of this type of attack, or this type of influence operation, is to sow discord. so we have a group of accounts that are trying to basically pit americans against each other. ultimately that destabilizes the country. so we see them hop onto stories that are hot button issues, very divisive." (grant) that was brian (grant) (grant)that was brian todd reporting.the white house also announced it will host a listening session tomorrow on school safety.president trump also ordered attorney general jeff sessions to propose regulations banning bumpstocks...devices which turn semi-automatic weapons in to machine guns. we must do more to protect our children. we have to do more to protect our children. this week i will be holding a number of discussions with students, local leaders, and law enforcement to develop concrete steps that we can take to secure our schools, safeguard our students and protect our communities. school safety is a top priority for my administration (grant) the president explained that when governors from across the nation visit washington next week... they will discuss security measures, mental health issues, and the coordination between federal and state law enforcement. (steve) oprah winfrey is stepping up to support the "march for our lives" movement. the media mogul is matching george and amal clooney's donation of 5-hundred-thousand- dollarswinfrey took to twitter to share her support saying "these inspiring young people remind me of the freedom riders of the 60s who also said we've had enough and our voices will be heard."the "march for our lives" event on march 24th is being organized by students who survived last week's deadly shooting in parkland, florida. (steve) a warning tonight for parents in the east bay... about a game played by high school students with fake weapons. the game is called "spy versus spy" or "assassin". it is being played by seniors at livermore and granada high schools. the game is organized by students in teams...and those participating must pay to play. the goal is to take out other teams with toys guns to win a cash prize. police have received reports of armed and suspicious people in connection with the game... and respond anticipating real emergencies. now they are urging parents to talk to their teens about the potential dangers of the game. (pam) a traffic mess in san francisco today... as hundreds of signals were not working correctly. this is video from along the embarcadero today. you can see the flashing red traffic signals. in total, signals. in total, about 200- signals were not functioning properly throughout the city. the s-f-m-t-a says, most signals were fixed by two:30 this afternoon. (steve) an unwelcome wake up call for folks in the east bay(pam) after a series of small quakes ... rattled people from their sleep early this morning. here's a list of this morning's quakes. a two-point- eight quake just after one:thirty a.m. followed by three others three hours later .... measuring two- point-six, three-point-oh .... and two point nine... all within seconds. but that's not all..... the u-s-g-s website shows ... there have been more than two- dozen small quakes in this same area since friday. this activity is happening near the calaveras fault .. which runs thru the san ramon valley. seismologist brian kilgore says, that does not mean residents there should panic.. (sot) i don't think there's too much cause for alarm since he small swarms are known to of happened in this part of the bay area(pam) seismologists believe ... there is a more than 70- percent probability of a six- point-seven quake or greater ... striking the bay area in the next 30- years. the hayward fault, which runs through the east bay, is the most likely candidate for that kind of activity... since big earthquakes have hit there roughly every 150 years .... and we are overdue for another. (pam) we are looking at the temperatures coming our way .. and giving you a look at the next ten days.
