the misaligned lanes. let's take a look at what they did. on the left hand side, we showed you all yesterday, which was the problem, and you can see the striping and how cars are going over. they had to do a big turn, and nobody could really maneuver that quickly or sharply, and stay in their lanes. so that was a danger and a hazard, and then on the right, you see how smooth it is now with the thick white line going almost absolutely straight, and trouble free. commuters are able no navigate that easily this morning. will tran is really the one who got the results yesterday, and saw the results this morning. will feels pretty good to see it all fixed. >> reporter: it feels really good because obviously we don't want anybody getting into an accident. we complained about it for two hours straight, but it was exactly 24 hours ago that the lead architecture and i had him live on the kron4 news he said it's in green with mark danon and the rest of us that it was too dangerous as you head into the second tunnel southbound on the new presidio parkway. when the lead architecture says he's not happy about, it especially when we told him an exthat 8 hours to work on it, he said i want it fixed immediately. it was not immediately. they shut is down at 10:00 p.m. last night to work on it and reopened it before 4:00 in the morning. when they did, obviously they got the job done. not only are there white lanes now, white stripes, not even a stripe, it's a solid white line, so now it's clearly visible and pay attention to the roadway, the two right lanes, looks like chalk marks because they removed the old curve lanes that caused just a lot of problems for drivers, their right wheels kept touching the lane next to them, and so many near accidents, it wasn't sitting well with the lead architecture. he went to the caltrans news conference, demanded that something be done, and then before they got to working on it, they brought out the signs, told people, curve ahead, slow down, 35 miles per hour, so it did not cause any accidents. caltrans, they initially said it was temporary, and they stuck to their guns. but, you know, kron 4 kept leaning on it, hammering away at it, and when you do that, thousands of people taking to our web site, they listened and they got it done. you think see smooth sailing. good job. back to you guy. >> it's a really big difference. you well, and it's going to take you about 25 minutes to that point, and across the span, sluggish into san francisco. here's a look at a drive time as you make your way through antioch. this is your westbound ride to concord, 25 minutes and the east shore freeway, bumper to bumper there as well. it's 22 minutes on westbound 80 making your way down to berkeley, and to the mcarthur maze. well, and traffic always affected by the weather, so let's get a check of that now with james. good morning. >> good morning. luckily nothing on the weather front that should affect your ride other than the fact you may need to put on sunglasses as you drive on interstate 680. we have a lot of early morning sunshine coming down right you as the skies are here. this is at shot from the golden gate bridge, camera, and you can see the low clouds clipping the tops of the towers. overcast conditions over san francisco where it's nice and clear and sunny in some of our inland valleys. let's take a quick look at temperatures around the bay, 59 in the city. oakland 61. san jose 62. also seeing 62 in concord with slightly warmer conditions in livermore. we should warm up to the low 80s for our inland valleys. san francisco's forecast for today, temperatures probably maxing out right around 67 degrees this afternoon. that should happen right around 2:00, and that will extend into the 3:00 and 4:00 hours. by noontime, though, if you're going to be outside, looking pretty good. 66 and partly cloudy. it will be a little breezy. just want to make that point perfectly clear. we could see gusts up wards of 20 miles per hour in downtown san francisco, so be ready for that. i'll be back in 15 minutes with a complete look at the forecast and talk about the possibility of rain later this weekend. now back to the news. breaking news out of the south bay, san jose police say a man is dead after a shooting in the 5200 block of monterey road. it happened around 9:30 last night. when police got there, they found the man with a gunshot wound. he was taken to the hospital where he died. the gunman is still on the loose. and police are trying to figure out a motive. in other big news we're following a big development in an alleged kidnapping case in vallejo. what police described as a hoax apparently turned out to be true. authorities have now arrested 38-year-old matthew muller in connection with the case. these are the two people who muller allegedly tried to kidnap in a home invasion. lawyers for the victims, denise huskins and aaron quinn, says the police department needs to apologize. >> this is denise and her boyfriend aaron quinn. back in march, both were alleged victims of a home invasion, and huskins the victim of a kidnapping. lawyers for hoskins and quinn were quick to react to that on monday. >> psycho path, a sociopath, somebody bent on destroying other peoples' lives. >> hoskins and quinn did not speak at this press conference. according to the statement, it was quinn who was bound with zip ties, drugged and put in the closet while hoskins was kidnapping, held for ransom, sexually assaulted and dropped off in southern california. hoskins appeared to hold back tears on monday as her lawyers fired back at vallejo police who had previously called this a hoax. >> when they told the vallejo police department this was real, within hours, the police department said it was a hoax, which vallejo police department had just completely went over their heads. had they asked the basic questions, what is the motive here, had they just asked that, they would have never rushed to judgment. they would have understood that there was far more to this than met the eye. well, today the vallejo police department owes an apology to ms. hoskins and mr. quinn. >> reporter: i did reach out to the vallejo police department. they told me they are not commenting on the matter, and referred me to the fbi. jr stone kron4 news. and the father of denise hoskins says it's a relief not only to him but his daughter to hear that the suspect has been arrested. his father hopes have the right guy and they prosecute. >> yeah, i thought, you know, when she was found, i thought they would be more open arms about it, and you know, greet her, and instead they were very hostile. and they continue to be or did continue for several days. even when they were interviewing her, so it's just a big relief right now. people in one dublin neighborhood are shocked to hear about the arrest of muller. they arrested him in connection with the home burglary after the kidnapping incident. alecia reid spoke to neighbors about the case. >> somebody was watching that house and who was in it. that's the scary part. >> reporter: police say a husband and wife sleeping inside this north drive home woke up to matthew muller standing at the foot of their bed, shining a flashlight in their faces. >> in guy came from the back, jumped a fence, and i don't know how he did do that. >> reporter: authorities say muller got in my prying a screen off a window frame, then entering through the open window. he tried tieing up the couple, telling them their young adult daughter was sleeping safely in her bedroom. the wife, somehow got away and ran into the bathroom where she called 911 from her cell phone. the husband fought with muller, managing to pull his mask off. that's when police say the suspect hit the victim, leaving a gash on his head. muller rushed out of the house soon after, but forgot his cell phone. police traced it back to him. authorities also found plastic zip ties, duct tape and gloves near the home. since then, neighbors have taken extra steps to secure their homes. >> before we thought it was, you know, pretty safe, just lock the doors and now we've got the security system put in, and cameras, and you know, sensors on every single window, every single door. >> kron4.com has the latest developments on the case. you'll find a time line of the events, the complete fbi affidavit is all on kron4.com. and happening today, in response to the deadly berkeley balcony collapse, tuesday lawmakers are introducing a bill that would require construction companies to disclose felony convictions and settlements over construction. six people were killed and seven others injured when this balcony collapsed in berkeley last month. the firm that built the apartment had previously paid millions of dollars to settle lawsuits related to balcony failures. the california building association and trade group united contractors oppose this bill. they say construction companies are sometimes forced to settle even if they aren't directly at fault for construction defects. and the berkeley city council will vote on new balcony regulations to try and prevent collapses that range from acquiring inspections to using better materials and design standards. a council members will talk about the regulations in a press conference at one this afternoon and then they'll vote at their meeting at 7:00 p.m. coming up on the kron 4 morning news, a forest service is getting help to fight fires from the coast guard. that's what they're getting help from? >> we're going to show you how they're doing it, and people in the east bay will show how they're fighting the arrival of a convicted sex offender and tell you what they're saying about it. it's happening just past treasure island in the left hand lane. the san francisco fire department arrived quickly, and they put it out. they did have to close lanes for some time, and opened them up after eleven. the chp saying it was debris collected in the expansion joint and the fire may have been started by a tossed cigarette. no vehicles were damaged but this is raising questions about whether this could be another design flaw that needs to be fixed on the new span of the bay bridge. well, let's keep looking at the bay bridge now. here's a live shot, and looking at the bay bridge toll plaza, coming into downtown san francisco, it's going to be a slow ride, traffic backed up into the mcarthur maze. westbound is going to be slow all the way across the span and into the the city. you're looking at about a 20 to 25 minute drive time to get you there so far this morning. the san mateo bridge also heavy out of hayward, that's a 20 minute drive time for your westbound ride toward foster city, and a couple problems for your east bay commute. switching over to the maps now, and walnut creek, southbound 680 as you approach the treat boulevard exit, two left lanes are blocked by a couple cars that mixed it up. so that's going to slow your ride out of concord, and here's your drive time now, 14 minutes from highway 4 getting to the 680 split. well, now let's switch things over to weather now, and get a quick check with james. good morning, james. >> good morning, i want to start with this live look at our san francisco international airport camera where it's cloudy overhead, and i'll mention quickly they have an hour delay for incoming flights because of the low clouds. we're not seeing overcast conditions everywhere across the bay. as we switch the shot, you'll see in waldo creek it's clear and sunny. depend on where you are. you may be dealing with lots of sunshine and a gray start for you. everybody should be seeing decent sunshine this afternoon. we are expecting the clouds to part, and we'll be looking for a partly cloudy day generally around the bay. let's talk about temperatures. right now they are in the low 60s. warming only slightly. we've got livermore at 64. that's way out in the east bay. otherwise we're looking at 61 to 62 degrees in places like oakland, and concord and pleasanton, 58 in san francisco, slightly cooler in the north bay. santa rosa coming in at 56. temperatures this afternoon will be on the mild side. we're looking for generally upper 70s around the bay shoreline, mid- to upper 70s. we'll look for 73 in oakland. 75 in san mateo, 76 in redwood city. should warm up to 79 near sunnyvale and san jose, and warmer still as you head toward the valley. in the south bay, 79 to 89 degrees will be your forecastment in the east bay, 81 to 82 degrees generally, and in the north bay, 83, 84, thereabouts throughout the wine country, again, partly cloudy to mostly sunny skies. san francisco downtown, 67. we'll look for 73 in oakland. might be a little breezy in the city today, especially down near the financial district. they're talking about gusts somewhere in the neighborhood of 20 miles per hour at times during the afternoon so just keep that in mind. here's a quick look at your extended forecast. now the temperatures will rise slightly as we head into wednesday and thursday. that's the first note that you need to know about as we head into the week. slightly warmer weather for wednesday, thursday and even friday. then as we look into saturday, we're fine, a little cooler though. sunday we introduce the possibility of maybe a sprinkle or two because of this system. this is hurricane delores right now which is centered as you can see off the mexico coast, and it will continue to move along this northwest line here, strengthening by wednesday to a category three hurricane, and then it will continue to move off in that direction, just missing the baja peninsula and eventually losing strength and energy. but as it begins to break apart some, and that moisture may find its way in our neighborhood in the bay. we're looking for the chance of a shower, maybe even a thunderstorm sunday and monday. fingers crossed on that. i'll keep track. lots of things have to fall in mind for that to happen. i'll update you day by day as the system continues to progress. new this morning, fire investigators say it was human activity that caused the massive lake fire in southern california that burned four buildings and almost 50 square miles of land. the fire started on june 17th june 17th in the san bernardino mountains. a home and three outbuildings were destroyed. it's unclear if it was set on purpose or by accident. it started in a rugged and remote area. investigators combed that site and ruled out natural causes. the u.s. forest service is converting some u.s. coast guard planes to drop retardant on wildfires irs. the first of the planes is based in sacramento and ready to start flying as much as 500 miles to fight fires. with the new plane there will be 21 planes available to drop retardant on the western u.s. 6 more planes will be added by 2019. the forest service has been working since 2004 to modernize and stabilize its tanker fleet after a series of high profile crashes. you can no longer be fined for letting your lawn go brown in the drought. governor jerry brown signed legislation that prohibits local governments for penalizing people for deserving waters. residents were being fined for having dry brown lawns. governor brown has ordered communities to cut water use by 36% and is urging people to let their lawns go brown. and congress is now demanding answers. they want to know how the pipeline break near santa barbara created the largest coastal oil spill in california in 25 years. it comes down to who was in charge when it happened, and why wasn't there better oversight. a house sub committee wants to know why the pipeline committee is behind on changes ordered by congress several years ago. the failed line released 21- gallons reached the pacific ocean. washing up on beaches as far as 100 miles away and killing dozens of animals, including dolphins, sea lions and pelicans. baseball fans say major league baseball needs to install netting to protect them. a class action lawsuit was filed in san francisco, netting is needed connecting the foul poles to protect fans from flying bats and balls. the people behind the lawsuit are a's season ticket holders. they say there have been hundreds of preventable injuries but there's been no response yet from major league baseball. and happening today, closing closing arguments begin in the trial of james holmes accused of killing 12 people and injuring dozens of others in 2012. he is facing the death penalty if convicted on all accounts. he's pleaded not guilty by reason of insanity. his lawyers say he suffered a psychotic episode at the time of the shootings. holmes did not testify in his defense, but jurors did hear a series of interviews that holmes had a psychiatrist two years ago. two santa rosa men connected in the shooting of a prostitute are due in court for their air rainment. ronny paul, and 19-year-old koa james sibley were arrested on friday. a woman in her 20s was shot multiple times at a motel 6 on commerce boulevard early morning on june 2nd is when it happened. and the woman is still in the hospital. she has serious injuries. police say that threadgill shot the woman and hit a man who was staying with her. hit him in the head with a gun. officers say that sibley was an accessory to the attempted murder and assault. happening told, a suspected serial arsonist is going to be arraigned in sonoma county superior court. 61-year-old james raymond started several grass fires near a busy intersection in santa rosa. he was arrested on friday night near marlo and guerneville roads where 13 fires broke out between june 29th and july 8th. a surveillance camera showed him in the area at the time of the fires. the fires were close to homes. raymond admitted to setting one fire. residents in a walnut creek neighborhood are fighting the arrival of a sex ownedder. he moved in february and after the court decided he was allowed to stay, his terms of release were revoked because the people supervising him say he can't be trusted. >> the neighbors of 71-year-old charles chrisman want him out of the neighborhood and this hearing today is the only way that could happen. they're going to have to wait longer to learn the fate of both their street and this convicted sex offender. >> he's a danger to our neighborhood. so i think he's someone with a clear mind, a judge has to hear this and remove him from our neighborhood. >> reporter: chris hahn was placed in the walnut creek neighborhood in february. the people who lived there tried to fight hiss arrival in court and lost. now his release has been temporarily revoked while the courts decide whether or not he violated that release in june. >> they had a high level, high expectation for him to be transparent about what sort of thoughts he has, what sort of contacts he has in the community, and they're relying on him in part to report when he has feelings or inappropriate contacts. if he's not being honest with liberty, their feeling is that my understanding is that feeling is that they can't adequately supervise him. >> reporter: the alleged violation was an unapproved and uninvited conversation with a young man at a community center, which he didn't report to his case manager. if the judge decides that is a violation, chrisman goes back into state custody and a mental hospital, and many of his neighbors will breathe a sigh of relief. >> i want him out. i want him gone. there's got to be someplace else they can place him. not in a neighborhood surrounded by young children. >> emmanuelle riva kron4 emily turner kron4 catch -- emily turner kron4 news. matthew graham stole a gun from his mother and made a run for it on saturday after hearing that the search for his daughter had turned up a possible lead. graham became a person of interest after giving inconsistent statements to investigators. the baby girl, ember is still missing this morning. sheriff's deputies say that graham carjacked a couple yesterday and that led to the police chase. the chase ended with deputies opening fire, killing graham. and kron 4 morning news, the international man hunt for an infamous drug lord continues. new pictures showing him enjoying his time out of jail. the massive map hunt for one of the world's most powerful drug lords. two pictures have surfaced of juaquin guzman, also known as el chapo. they are on elblogdelnarco.com. the next picture is him sitting in the cockpit of a claim. the blog claims the image came fnq from guzman's son. it's not clear when the photos were actually taken. and mexico's president is vowing to recapture el chapo after escaping saturday through the tunnel under his prison tunnel. tom foreman takes us on a virtual tour of the elaborate escape. >> reporter: this prison had plenty of security measures in place above the ground. they had ways of blocking cell phone signals. they had heavily armoured vehicles to repulse a ground assault, and 3-foot thick walls so rockets could not break in. for all of that, el chapo found a way to burro out under the noses of mexican authorities and get to this freedom tunnel off in the distance here and go completely free. how did he manage to do that. well, first of all, he tapped into the expertise of his gang, which has been noun to build all sorts of tunnels for transporting drugs and eluding their enemies and started beneath a shower, one of the few places where he wasn't being monitored by video 24 hours a day. he went 33 feet straight down, and then when you look at the details of this tunnel, you see an engineering marvel. this thing was 5 1/2 feet tall. he could walk through it. reinforced with wood so they could keep track of all the structural integrity it of it, weather ground water was seeping in. they had a lighting system, a ventilation system, so there would be no gases that could overcome anyone there. even had a track along the bottom so they could transport dirt out on some sort of cart or motorcycle. it's not clear what they were doing. what we do know is that in the end, this thing was a mile long and over that distance, it could have taken a year to build, easily. and yet, one of the most wanted drug dealers in the world was able to walk out there in what would have been ten minutes or less. : still ahead on the kron4 news, the murder at pier 14. we'll tell you what a live report. hate to tell this to you, if you're heading out the door to fill up. prices at the pump are spiking in california, despite seeing a drop nationwide. jackie sissel is live in emeryville with reaction from drivers, hi jackie. >> reporter: good morning, yeah, you know, you're talking about the prices are going down across the country, but not here in california. you know, oil is cheep at this point, but gas here -- cheap at this point, but gas here in california continues to go up. why is it going up? refineries say they refine more oil and gas this year than they did last year, but they do say that it is a tight supply. that's because demand is up. obviously we're in that summer drive season, and refiners say basically they refine what they think they're going to need and when those supplies are dwindled down, then demand goes up and the price goes up also. and it's not just, well, it is here in california, but it's really hitting hard down in southern california. there are places in southern california that are paying $4.20. it's not that bad here. folks who are at the gas station this morning are feeling the pinch. >> i had a v8, now this is a four cylinder. so i'm saving money on fuel, which is nice. so, yeah, i just put in four gallons of fuel. >> reporter: and it cost you? >> it cost me 15 bucks. so that is pretty high. i remember the days when it was 9 9 cents. >> reporter: long gone. >> long gone. >> reporter: that will get you a 1/4 gallon. what are you paying, according to aaa the california average sits at 3.80. that's up 37 cents in just one week. san francisco is quite a bit lower than that. that's at 3.61. oakland at 3.51. and san jose rounded out at 3.50. la, los angeles, is paying $4.20. that's why the average for the state of california is so high, and just so you know, to make you feel better, we are number one. california is the highest gas prices in the entire country. >> i like the way you say that. pull out that foam finger. thank you, jackie. mark. actually, after we're gassed up, let's go to rebecca and get a look at the commute. the commute is definitely slow if you're going to be taking the bay bridge toll plaza into san francisco. traffic backed up into the mcarthur maze. it's very normal, though, for this hour in the morning. the 880 overcrossing pretty stacked as well. getting to the toll plaza. if you don't have fast track, get one. look at these lanes wide open to the span. a 20 to 25 minute commute time for you, though, if you are paying cash and sluggish across the span all the way into san francisco. the san mateo bridge also very packed for your westbound ride. on the right hand side of your screen to foster city, that clockings in at a 22 minute commute, and a brand new accident as you exit the san mateo bridge. this is right at south 101 before eastbound 92. you're going to see activity on the right shoulder, a couple cars on the side there. chp, and emergency crews are on the scene, possible injuries reported so it's going to be a bit slow on south 101 as you make your way out of burlingame and into san mateo. i'll have a full bridge check, and also your commute along the nimitz in downtown oakland. let's get a check of the weather with james. >> good morning. a live look out of walnut creek, i want to show you the two different things we're seeing right now around the bay. two different conditions. that's the word i was looking for. sunny conditions in walnut creek. nice and clear out there, and then we have cloudy conditions, like what's in san francisco right now. this is our embarcadero camera, looking at the bay bridge, and nothing but gray skies overhead. depending on where you are, a lot of sunshine or cloud cover. now, the good news is later this afternoon we'll expect to see a lot more sunshine as we'll look for clearing, especially inland. here's what we have in general for the forecast today, it should slowly start to get out of the lower 60s here as we start to head toward the 9:00 hour. but for now, anyway, we're in the low 60s. by noontime, we'll start to see some 70-degree weather. it will be low 70s by the bay shoreline, with mid-70s inland, and then by 4:00 this afternoon, partly cloudy everywhere. and temperatures will be hovering right around that 79, 80-degree mark along the bay shoreline, cooler for some as today we're looking for a 1 to 2-degree drop in temperatures. inland, we should solidly be in the low 80s. we have that to look forward to and looking forward to rain it weekend. summer time, we don't typical get rain in the summer. i'll talk about why we're expecting it and when it should arrive coming up in my full check in about 15 minutes after the world according to gary. the big news we're following, the parents of kate steinley are talking about losing their daughter days after burying her. she was shot and killed on san francisco's pier 14 two weeks ago while walking with her father. her parents appeared on fox news saying they support a proposal to give mandatory prison time to deported people who returned back to the u.s. illegally. >> and i'm sure there will be a lot of posturing back and forth. i had no idea how many people have been killed by illegal aliens and we have had quite a few people reach out to us and we had no idea it was an issue. but something definitely needs to be done. >> undocumented immigrants, francisco sanchez has pleaded not guilty. he's been deported to mexico five times. 7:34, and a man is mind bars this morning accused of plotting to blow up a college dorm and execute students live on the internet and it turns out his father, a cop, turned him in. federal investigators say 23- year-old alexander ciccolo had recently become obsessed with extremist islam. he was arrested on july 4th july 4th after he received guns from a person working with federal agents. his father, robert ciccolo is a veteran police officer who was on duty the day of the boston mar marathon bombings. >> his dad is the one that turned him in initialingly federal authorities say he wanted to carry out the attack no later than july 31st. both the fbi and county agency are going to review a series of mistakes that allowed dylann roof to get a gun he never should have been allowed to buy. a mistake was originally made when a county clerk entered the incorrect location for his drug arrest in february. this man, an fbi examiner using records from the state data base couldn't find the details about that arrest. when roof went to go pitch the gun. the background check found nothing after three days and roof was eventually allowed to buy the 45 caliber handgun used in the church shooting to kill nine people. as vicki liviakis shows us outside are now being turned away. >> young quinn here is helping his grandma load up on free water. >> my lawn is the greenest one in pleasanton. >> reporter: thanks to recycled waste water from this dublin, san ramon district fill station. >> we have sent 8.2 million- gallons of water home with folks in pickup trucks and cars. >> reporter: according to dan gallagher of the water district, lines snake around the block. >> 700 people on one four-hour shift. >> that's some thirsty people. >> that's a car every 10 or 15 seconds. >> reporter: nobody could have predicted how popular this recycling program was going to be. it's not drinking water but for the thirsty lawns lawns and gardens around this area, it apparently hits the spot. >> reporter: because of the lingering drought, it's so popular in fact that people have been coming from all over the bay area to pump free water. >> there's a guy when i was here earlier, he was from oakland. >> getting water? >> yeah. >> reporter: but that is coming to an end. >> the one thing we had to do at least temporarily is we had to restrict new people, new sign ups to just people from dublin san ramon and pleasanton. >> reporter: not to worry, though, if you have already signed up for the recycled water, even if you are from out of the area, you can still have your fill. otherwise, it's a brown lawn for you or you might just check out one of southeasterly other waste -- several other waste water fill stations around the bay area. >> in many cases the fill station may be closer to folks that than our plant. >> in pleasanton, approach to ffo. we could have delays. and new this morning, we have made it to first brought it live during our 4:00 a.m. newscast. nasa's new horizon spacecraft came the closest to the dwarf planet at 4:49 this morning. nasa posted this photograph, it's the most detailed image sent to earth at the moment of closest approach. new horizons was straight on course for the historic encounter. it got the misaligned lanes. let's take a look at what they did. on the left hand side, we showed you all yesterday, which was the problem, and you can see the striping and how cars are going over. they had to do a big turn, and nobody could really maneuver that quickly or sharply, and stay in their lanes. so that was a danger and a hazard, and then on the right, you see how smooth it is now with the thick white line going almost absolutely straight, and trouble free. commuters are able no navigate that easily this morning. will tran is really the one who got the results yesterday, and saw the results this morning. will feels pretty good to see it all fixed. >> reporter: it feels really good because obviously we don't want anybody getting into an accident. we complained about it for two hours straight, but it was exactly 24 hours ago that the lead architecture and i had him live on the kron4 news he said it's in green with mark danon and the rest of us that it was too dangerous as you head into the second tunnel southbound on the new presidio parkway. when the lead architecture says he's not happy about, it especially when we told him an exthat 8 hours to work on it, he said i want it fixed immediately. it was not immediately. they shut is down at 10:00 p.m. last night to work on it and reopened it before 4:00 in the morning. when they did, obviously they got the job done. not only are there white lanes now, white stripes, not even a stripe, it's a solid white line, so now it's clearly visible and pay attention to the roadway, the two right lanes, looks like chalk marks because they removed the old curve lanes that caused just a lot of problems for drivers, their right wheels kept touching the lane next to them, and so many near accidents, it wasn't sitting well with the lead architecture. he went to the caltrans news conference, demanded that something be done, and then before they got to working on it, they brought out the signs, told people, curve ahead, slow down, 35 miles per hour, so it did not cause any accidents. caltrans, they initially said it was temporary, and they stuck to their guns. but, you know, kron 4 kept leaning on it, hammering away at it, and when you do that, thousands of people taking to our web site, they listened and they got it done. you think see smooth sailing. good job. back to you guy. >> it's a really big difference. you thousand that the problem has been fixed -- now that the problem has been fixed it's a straight shot. bay bridge toll plaza, traffic backed up into the mcarthur maze, all the approaches backed up as well, and it's going to take you about 25 minutes to that point, and across the span, sluggish into san francisco. here's a look at a drive time as you make your way through antioch. this is your westbound ride to concord, 25 minutes and the east shore freeway, bumper to bumper there as well. it's 22 minutes on westbound 80 making your way down to berkeley, and to the mcarthur maze. well, and traffic always affected by the weather, so let's get a check of that now with james. good morning. >> good morning. luckily nothing on the weather front that should affect your ride other than the fact you may need to put on sunglasses as you drive on interstate 680. we have a lot of early morning sunshine coming down right you as the skies are here. this is at shot from the golden gate bridge, camera, and you can see the low clouds clipping the tops of the towers. overcast conditions over san francisco where it's nice and clear and sunny in some of our inland valleys. let's take a quick look at temperatures around the bay, 59 in the city. oakland 61. san jose 62. also seeing 62 in concord with slightly warmer conditions in livermore. we should warm up to the low 80s for our inland valleys. san francisco's forecast for today, temperatures probably maxing out right around 67 degrees this afternoon. that should happen right around 2:00, and that will extend into the 3:00 and 4:00 hours. by noontime, though, if you're going to be outside, looking pretty good. 66 and partly cloudy. it will be a little breezy. just want to make that point perfectly clear. we could see gusts up wards of 20 miles per hour in downtown san francisco, so be ready for that. i'll be back in 15 minutes with a complete look at the forecast and talk about the possibility of rain later this weekend. now back to the news. breaking news out of the south bay, san jose police say a man is dead after a shooting in the 5200 block of monterey road. it happened around 9:30 last night. when police got there, they found the man with a gunshot wound. he was taken to the hospital where he died. the gunman is still on the loose. and police are trying to figure out a motive. in other big news we're following a big development in an alleged kidnapping case in vallejo. what police described as a hoax apparently turned out to be true. authorities have now arrested 38-year-old matthew muller in connection with the case. these are the two people who muller allegedly tried to kidnap in a home invasion. lawyers for the victims, denise huskins and aaron quinn, says the police department needs to apologize. >> this is denise and her boyfriend aaron quinn. back in march, both were alleged victims of a home invasion, and huskins the victim of a kidnapping. lawyers for hoskins and quinn were quick to react to that on monday. >> psycho path, a sociopath, somebody bent on destroying other peoples' lives. >> hoskins and quinn did not speak at this press conference. according to the statement, it was quinn who was bound with zip ties, drugged and put in the closet while hoskins was kidnapping, held for ransom, sexually assaulted and dropped off in southern california. hoskins appeared to hold back tears on monday as her lawyers fired back at vallejo police who had previously called this a hoax. >> when they told the vallejo police department this was real, within hours, the police department said it was a hoax, which vallejo police department had just completely went over their heads. had they asked the basic questions, what is the motive here, had they just asked that, they would have never rushed to judgment. they would have understood that there was far more to this than met the eye. well, today the vallejo police department owes an apology to ms. hoskins and mr. quinn. >> reporter: i did reach out to the vallejo police department. they told me they are not commenting on the matter, and referred me to the fbi. jr stone kron4 news. and the father of denise hoskins says it's a relief not only to him but his daughter to hear that the suspect has been arrested. his father hopes have the right guy and they prosecute. >> yeah, i thought, you know, when she was found, i thought they would be more open arms about it, and you know, greet her, and instead they were very hostile. and they continue to be or did continue for several days. even when they were interviewing her, so it's just a big relief right now. people in one dublin neighborhood are shocked to hear about the arrest of muller. they arrested him in connection with the home burglary after the kidnapping incident. alecia reid spoke to neighbors about the case. >> somebody was watching that house and who was in it. that's the scary part. >> reporter: police say a husband and wife sleeping inside this north drive home woke up to matthew muller standing at the foot of their bed, shining a flashlight in their faces. >> in guy came from the back, jumped a fence, and i don't know how he did do that. >> reporter: authorities say muller got in my prying a screen off a window frame, then entering through the open window. he tried tieing up the couple, telling them their young adult daughter was sleeping safely in her bedroom. the wife, somehow got away and ran into the bathroom where she called 911 from her cell phone. the husband fought with muller, managing to pull his mask off. that's when police say the suspect hit the victim, leaving a gash on his head. muller rushed out of the house soon after, but forgot his cell phone. police traced it back to him. authorities also found plastic zip ties, duct tape and gloves near the home. since then, neighbors have taken extra steps to secure their homes. >> before we thought it was, you know, pretty safe, just lock the doors and now we've got the security system put in, and cameras, and you know, sensors on every single window, every single door. >> kron4.com has the latest developments on the case. you'll find a time line of the events, the complete fbi affidavit is all on kron4.com. and happening today, in response to the deadly berkeley balcony collapse, tuesday lawmakers are introducing a bill that would require construction companies to disclose felony convictions and settlements over construction. six people were killed and seven others injured when this balcony collapsed in berkeley last month. the firm that built the apartment had previously paid millions of dollars to settle lawsuits related to balcony failures. the california building association and trade group united contractors oppose this bill. they say construction companies are sometimes forced to settle even if they aren't directly at fault for construction defects. and the berkeley city council will vote on new balcony regulations to try and prevent collapses that range from acquiring inspections to using better materials and design standards. a council members will talk about the regulations in a press conference at one this afternoon and then they'll vote at their meeting at 7:00 p.m. coming up on the kron 4 morning news, a forest service is getting help to fight fires from the coast guard. that's what they're getting help from? >> we're going to show you how they're doing it, and people in the east bay will show how they're fighting the arrival of a convicted sex offender and tell you what they're saying about it. it's happening just past treasure island in the left hand lane. the san francisco fire department arrived quickly, and they put it out. they did have to close lanes for some time, and opened them up after eleven. the chp saying it was debris collected in the expansion joint and the fire may have been started by a tossed cigarette. no vehicles were damaged but this is raising questions about whether this could be another design flaw that needs to be fixed on the new span of the bay bridge. well, let's keep looking at the bay bridge now. here's a live shot, and looking at the bay bridge toll plaza, coming into downtown san francisco, it's going to be a slow ride, traffic backed up into the mcarthur maze. westbound is going to be slow all the way across the span and into the the city. you're looking at about a 20 to 25 minute drive time to get you there so far this morning. the san mateo bridge also heavy out of hayward, that's a 20 minute drive time for your westbound ride toward foster city, and a couple problems for your east bay commute. switching over to the maps now, and walnut creek, southbound 680 as you approach the treat boulevard exit, two left lanes are blocked by a couple cars that mixed it up. so that's going to slow your ride out of concord, and here's your drive time now, 14 minutes from highway 4 getting to the 680 split. well, now let's switch things over to weather now, and get a quick check with james. good morning, james. >> good morning, i want to start with this live look at our san francisco international airport camera where it's cloudy overhead, and i'll mention quickly they have an hour delay for incoming flights because of the low clouds. we're not seeing overcast conditions everywhere across the bay. as we switch the shot, you'll see in waldo creek it's clear and sunny. depend on where you are. you may be dealing with lots of sunshine and a gray start for you. everybody should be seeing decent sunshine this afternoon. we are expecting the clouds to part, and we'll be looking for a partly cloudy day generally around the bay. let's talk about temperatures. right now they are in the low 60s. warming only slightly. we've got livermore at 64. that's way out in the east bay. otherwise we're looking at 61 to 62 degrees in places like oakland, and concord and pleasanton, 58 in san francisco, slightly cooler in the north bay. santa rosa coming in at 56. temperatures this afternoon will be on the mild side. we're looking for generally upper 70s around the bay shoreline, mid- to upper 70s. we'll look for 73 in oakland. 75 in san mateo, 76 in redwood city. should warm up to 79 near sunnyvale and san jose, and warmer still as you head toward the valley. in the south bay, 79 to 89 degrees will be your forecastment in the east bay, 81 to 82 degrees generally, and in the north bay, 83, 84, thereabouts throughout the wine country, again, partly cloudy to mostly sunny skies. san francisco downtown, 67. we'll look for 73 in oakland. might be a little breezy in the city today, especially down near the financial district. they're talking about gusts somewhere in the neighborhood of 20 miles per hour at times during the afternoon so just keep that in mind. here's a quick look at your extended forecast. now the temperatures will rise slightly as we head into wednesday and thursday. that's the first note that you need to know about as we head into the week. slightly warmer weather for wednesday, thursday and even friday. then as we look into saturday, we're fine, a little cooler though. sunday we introduce the possibility of maybe a sprinkle or two because of this system. this is hurricane delores right now which is centered as you can see off the mexico coast, and it will continue to move along this northwest line here, strengthening by wednesday to a category three hurricane, and then it will continue to move off in that direction, just missing the baja peninsula and eventually losing strength and energy. but as it begins to break apart some, and that moisture may find its way in our neighborhood in the bay. we're looking for the chance of a shower, maybe even a thunderstorm sunday and monday. fingers crossed on that. i'll keep track. lots of things have to fall in mind for that to happen. i'll update you day by day as the system continues to progress. new this morning, fire investigators say it was human activity that caused the massive lake fire in southern california that burned four buildings and almost 50 square miles of land. the fire started on june 17th june 17th in the san bernardino mountains. a home and three outbuildings were destroyed. it's unclear if it was set on purpose or by accident. it started in a rugged and remote area. investigators combed that site and ruled out natural causes. the u.s. forest service is converting some u.s. coast guard planes to drop retardant on wildfires irs. the first of the planes is based in sacramento and ready to start flying as much as 500 miles to fight fires. with the new plane there will be 21 planes available to drop retardant on the western u.s. 6 more planes will be added by 2019. the forest service has been working since 2004 to modernize and stabilize its tanker fleet after a series of high profile crashes. you can no longer be fined for letting your lawn go brown in the drought. governor jerry brown signed legislation that prohibits local governments for penalizing people for deserving waters. residents were being fined for having dry brown lawns. governor brown has ordered communities to cut water use by 36% and is urging people to let their lawns go brown. and congress is now demanding answers. they want to know how the pipeline break near santa barbara created the largest coastal oil spill in california in 25 years. it comes down to who was in charge when it happened, and why wasn't there better oversight. a house sub committee wants to know why the pipeline committee is behind on changes ordered by congress several years ago. the failed line released 21- gallons reached the pacific ocean. washing up on beaches as far as 100 miles away and killing dozens of animals, including dolphins, sea lions and pelicans. baseball fans say major league baseball needs to install netting to protect them. a class action lawsuit was filed in san francisco, netting is needed connecting the foul poles to protect fans from flying bats and balls. the people behind the lawsuit are a's season ticket holders. they say there have been hundreds of preventable injuries but there's been no response yet from major league baseball. and happening today, closing closing arguments begin in the trial of james holmes accused of killing 12 people and injuring dozens of others in 2012. he is facing the death penalty if convicted on all accounts. he's pleaded not guilty by reason of insanity. his lawyers say he suffered a psychotic episode at the time of the shootings. holmes did not testify in his defense, but jurors did hear a series of interviews that holmes had a psychiatrist two years ago. two santa rosa men connected in the shooting of a prostitute are due in court for their air rainment. ronny paul, and 19-year-old koa james sibley were arrested on friday. a woman in her 20s was shot multiple times at a motel 6 on commerce boulevard early morning on june 2nd is when it happened. and the woman is still in the hospital. she has serious injuries. police say that threadgill shot the woman and hit a man who was staying with her. hit him in the head with a gun. officers say that sibley was an accessory to the attempted murder and assault. happening told, a suspected serial arsonist is going to be arraigned in sonoma county superior court. 61-year-old james raymond started several grass fires near a busy intersection in santa rosa. he was arrested on friday night near marlo and guerneville roads where 13 fires broke out between june 29th and july 8th. a surveillance camera showed him in the area at the time of the fires. the fires were close to homes. raymond admitted to setting one fire. residents in a walnut creek neighborhood are fighting the arrival of a sex ownedder. he moved in february and after the court decided he was allowed to stay, his terms of release were revoked because the people supervising him say he can't be trusted. >> the neighbors of 71-year-old charles chrisman want him out of the neighborhood and this hearing today is the only way that could happen. they're going to have to wait longer to learn the fate of both their street and this convicted sex offender. >> he's a danger to our neighborhood. so i think he's someone with a clear mind, a judge has to hear this and remove him from our neighborhood. >> reporter: chris hahn was placed in the walnut creek neighborhood in february. the people who lived there tried to fight hiss arrival in court and lost. now his release has been temporarily revoked while the courts decide whether or not he violated that release in june. >> they had a high level, high expectation for him to be transparent about what sort of thoughts he has, what sort of contacts he has in the community, and they're relying on him in part to report when he has feelings or inappropriate contacts. if he's not being honest with liberty, their feeling is that my understanding is that feeling is that they can't adequately supervise him. >> reporter: the alleged violation was an unapproved and uninvited conversation with a young man at a community center, which he didn't report to his case manager. if the judge decides that is a violation, chrisman goes back into state custody and a mental hospital, and many of his neighbors will breathe a sigh of relief. >> i want him out. i want him gone. there's got to be someplace else they can place him. not in a neighborhood surrounded by young children. >> emmanuelle riva kron4 emily turner kron4 catch -- emily turner kron4 news. matthew graham stole a gun from his mother and made a run for it on saturday after hearing that the search for his daughter had turned up a possible lead. graham became a person of interest after giving inconsistent statements to investigators. the baby girl, ember is still missing this morning. sheriff's deputies say that graham carjacked a couple yesterday and that led to the police chase. the chase ended with deputies opening fire, killing graham. and kron 4 morning news, the international man hunt for an infamous drug lord continues. new pictures showing him enjoying his time out of jail. the massive map hunt for one of the world's most powerful drug lords. two pictures have surfaced of juaquin guzman, also known as el chapo. they are on elblogdelnarco.com. the next picture is him sitting in the cockpit of a claim. the blog claims the image came fnq from guzman's son. it's not clear when the photos were actually taken. and mexico's president is vowing to recapture el chapo after escaping saturday through the tunnel under his prison tunnel. tom foreman takes us on a virtual tour of the elaborate escape. >> reporter: this prison had plenty of security measures in place above the ground. they had ways of blocking cell phone signals. they had heavily armoured vehicles to repulse a ground assault, and 3-foot thick walls so rockets could not break in. for all of that, el chapo found a way to burro out under the noses of mexican authorities and get to this freedom tunnel off in the distance here and go completely free. how did he manage to do that. well, first of all, he tapped into the expertise of his gang, which has been noun to build all sorts of tunnels for transporting drugs and eluding their enemies and started beneath a shower, one of the few places where he wasn't being monitored by video 24 hours a day. he went 33 feet straight down, and then when you look at the details of this tunnel, you see an engineering marvel. this thing was 5 1/2 feet tall. he could walk through it. reinforced with wood so they could keep track of all the structural integrity it of it, weather ground water was seeping in. they had a lighting system, a ventilation system, so there would be no gases that could overcome anyone there. even had a track along the bottom so they could transport dirt out on some sort of cart or motorcycle. it's not clear what they were doing. what we do know is that in the end, this thing was a mile long and over that distance, it could have taken a year to build, easily. and yet, one of the most wanted drug dealers in the world was able to walk out there in what would have been ten minutes or less. : still ahead on the kron4 news, the murder at pier 14. we'll tell you what they are telling a national tv audience about her suspected killer: have you noticed, gas prices are going up again. i'm jackie sissel in emeryville, i'll tell you when they're coming up, coming up in a live report. hate to tell this to you, if you're heading out the door to fill up. prices at the pump are spiking in california, despite seeing a drop nationwide. jackie sissel is live in emeryville with reaction from drivers, hi jackie. >> reporter: good morning, yeah, you know, you're talking about the prices are going down across the country, but not here in california. you know, oil is cheep at this point, but gas here -- cheap at this point, but gas here in california continues to go up. why is it going up? refineries say they refine more oil and gas this year than they did last year, but they do say that it is a tight supply. that's because demand is up. obviously we're in that summer drive season, and refiners say basically they refine what they think they're going to need and when those supplies are dwindled down, then demand goes up and the price goes up also. and it's not just, well, it is here in california, but it's really hitting hard down in southern california. there are places in southern california that are paying $4.20. it's not that bad here. folks who are at the gas station this morning are feeling the pinch. >> i had a v8, now this is a four cylinder. so i'm saving money on fuel, which is nice. so, yeah, i just put in four gallons of fuel. >> reporter: and it cost you? >> it cost me 15 bucks. so that is pretty high. i remember the days when it was 9 9 cents. >> reporter: long gone. >> long gone. >> reporter: that will get you a 1/4 gallon. what are you paying, according to aaa the california average sits at 3.80. that's up 37 cents in just one week. san francisco is quite a bit lower than that. that's at 3.61. oakland at 3.51. and san jose rounded out at 3.50. la, los angeles, is paying $4.20. that's why the average for the state of california is so high, and just so you know, to make you feel better, we are number one. california is the highest gas prices in the entire country. >> i like the way you say that. pull out that foam finger. thank you, jackie. mark. actually, after we're gassed up, let's go to rebecca and get a look at the commute. the commute is definitely slow if you're going to be taking the bay bridge toll plaza into san francisco. traffic backed up into the mcarthur maze. it's very normal, though, for this hour in the morning. the 880 overcrossing pretty stacked as well. getting to the toll plaza. if you don't have fast track, get one. look at these lanes wide open to the span. a 20 to 25 minute commute time for you, though, if you are paying cash and sluggish across the span all the way into san francisco. the san mateo bridge also very packed for your westbound ride. on the right hand side of your screen to foster city, that clockings in at a 22 minute commute, and a brand new accident as you exit the san mateo bridge. this is right at south 101 before eastbound 92. you're going to see activity on the right shoulder, a couple cars on the side there. chp, and emergency crews are on the scene, possible injuries reported so it's going to be a bit slow on south 101 as you make your way out of burlingame and into san mateo. i'll have a full bridge check, and also your commute along the nimitz in downtown oakland. let's get a check of the weather with james. >> good morning. a live look out of walnut creek, i want to show you the two different things we're seeing right now around the bay. two different conditions. that's the word i was looking for. sunny conditions in walnut creek. nice and clear out there, and then we have cloudy conditions, like what's in san francisco right now. this is our embarcadero camera, looking at the bay bridge, and nothing but gray skies overhead. depending on where you are, a lot of sunshine or cloud cover. now, the good news is later this afternoon we'll expect to see a lot more sunshine as we'll look for clearing, especially inland. here's what we have in general for the forecast today, it should slowly start to get out of the lower 60s here as we start to head toward the 9:00 hour. but for now, anyway, we're in the low 60s. by noontime, we'll start to see some 70-degree weather. it will be low 70s by the bay shoreline, with mid-70s inland, and then by 4:00 this afternoon, partly cloudy everywhere. and temperatures will be hovering right around that 79, 80-degree mark along the bay shoreline, cooler for some as today we're looking for a 1 to 2-degree drop in temperatures. inland, we should solidly be in the low 80s. we have that to look forward to and looking forward to rain it weekend. summer time, we don't typical get rain in the summer. i'll talk about why we're expecting it and when it should arrive coming up in my full check in about 15 minutes after the world according to gary. the big news we're following, the parents of kate steinley are talking about losing their daughter days after burying her. she was shot and killed on san francisco's pier 14 two weeks ago while walking with her father. her parents appeared on fox news saying they support a proposal to give mandatory prison time to deported people who returned back to the u.s. illegally. >> and i'm sure there will be a lot of posturing back and forth. i had no idea how many people have been killed by illegal aliens and we have had quite a few people reach out to us and we had no idea it was an issue. but something definitely needs to be done. >> undocumented immigrants, francisco sanchez has pleaded not guilty. he's been deported to mexico five times. 7:34, and a man is mind bars this morning accused of plotting to blow up a college dorm and execute students live on the internet and it turns out his father, a cop, turned him in. federal investigators say 23- year-old alexander ciccolo had recently become obsessed with extremist islam. he was arrested on july 4th july 4th after he received guns from a person working with federal agents. his father, robert ciccolo is a veteran police officer who was on duty the day of the boston mar marathon bombings. >> his dad is the one that turned him in initialingly federal authorities say he wanted to carry out the attack no later than july 31st. both the fbi and county agency are going to review a series of mistakes that allowed dylann roof to get a gun he never should have been allowed to buy. a mistake was originally made when a county clerk
