francisco sanchez with murder. the wheels of justice just starting to turn. it is not the first time that sanchez has found himself on the wrong side of the law. kron 4 news has found out that he has been in and out of the criminal system for more than two decades. starting as far back as 1991 in the years following the initial arrest he has had drug convictions and was deported several times by the fed's. but each time he has made his way back, from back his home country mexico because he knew that his city had a sanctuary of no corporation with deportation he recently had drug charges dropped, and county offices did not inform federal immigration officials of his release many have openly defended that was good policy, spite of the immigration status of the only person charged with her murder sanchez will be appearing in court for his arraignment tomorrow afternoon >> catherine : since the shooting. there's been lots of renewed criticism of san francisco's sanctuary program. this after sanchez was recently released from custody despite 7 felony convictions, and five deportations. and his drug charges were dropped. there's been continued finger pointing since the pier 14 death. and city officials continue to argue that that they're not to blame for what happened. kron 4's alecia reid is live at pier 14 with details. alecia? >> alecia :immigration customs enforcement have gotten a criminal warrant if i had gotten that then he would have been charged and deported, and she would have been alive today >> : really that's what it's about, ice not doing things properly. >> alecia :an ice request to hold accused murderer francisco sanchez was ignored. why? according to criminal justice reform lawyer angela chan, current immigration and customs enforcement-holds violate the 4th ammendment against legal search and seizure. most are signed by an immigration officer when in fact, they need to be signed by a judge. law enforcement can then detain a suspect. sanchez is a resident of san francisco - a sanctuary city.. that ordinance makes it safe for an immigrant to report a crime without the threat of deportation. that is unrelated to the fact that current ice holds are unconstitutional and that is why chan says he wasn't sought after for immigration. >>:local shares have been sued around this issue--sherrifs i snow as this full well and if they wanted to take him into custody they would have had to go to a judge before they could take him into custody, but rather than do that they issued what they know is an unconstitutional ice's hold. -- ice knows felicia >> alecia :chan says last year the dept of homeland security which houses ice, acknowledged that the current ice hold policy is unconstitutional, yet many requests to hold immigrants still do not have a judge's signature.for example, in sanchez's caselive from san francisco's pier 14 >> catherine : in 2008, then- san francisco mayor gavin newsom warned criminals that the sanctuary law in san francisco doesn't let them off the hook. newsom was a vocal supporter of the program until problems emerged - including the tragic shooting death of a father and his two sons -- by an illegal immigrant. the city's policy is supposed to work with federal immigration officials in cases of undocumented offenders with criminal histories. crimes that end in san francisco jails are usually turned over to ice. but that's not what happened in the case of francisco sanchez.now charged with murder. he was released from sheriff's custody without anyone notifying ice. kevin ryan - a former u.s. attorney - was also a deputy chief of staff for mayor newsom. he says that it's time to make public safety the priority. >>:this is simply a notification protocol. pick up the phone and send in e-mail or a text and let us know that there is a person who is released to may not be documented with, so they can decide that they're going to do with this person. that is all that is required but that is not being done >> catherine : ryan and others say a simple notification to ice could have prevented this tragedy. court documents just made public - show that comedian bill cosby has admitted to buying drugs with the intent of giving them to women he wanted to have sex with. in a deposition from 2005. cosby said he got seven prescriptions for quaaludes. he'd been testifying in a lawsuit filed by a former temple university employee. more than a dozen women have accused him of sexual assault-- and some say they were drugged. tonight. many of them are expressing their relief. week's deadly staircase collapse in folsom. the sacramento county coroner's office has identified the victim as 26-year-old shun shang wan of san francisco. friends and family called him "chris." relatives say he was on a trip to lake tahoe. and had stopped by his friend's apartment. when the stairwell collapsed. he fell more than 2 floors. another staircase at the same apartment complex battle a huge brush fire that began this morning in vacaville. this is video from our helicopter partnership with a-b- c 7. the so-called "sky fire" started around 10-30 this morning near mix canyon road and sky ranch lane. it's burned at least 150 acres and is 25 percent contained. voluntary evacuations and road closures are in place. at least ten homes are threatened. officials say a car fire caused the fire. investigators say fireworks probably caused a separate 4- alarm fire that broke out in vacaville over the weekend. it burned more than 300 acres near pena adobe regional park. evidence indicates fireworks were set off on a trail leading up to a radio tower around 9-30 saturday night. the fire was fully contained late sunday morning. police are now asking community members to help identify those responsible for the fire. still ahead. search and rescue crews find the body of a missing teenager - at lake sonoma. also - the u.s. women's world cup win is inspiring young headache for thousands of drivers. kron 4's charles clifford has the latest details. >> charles :in the early morning hours of july 8th.. this coming wednesday.. crews will temporarily close doyle drive in order to install overhead sinage along the new roadway. the plan is to complete the work quickly when traffic is lightest. drivers will be able to use a detour to get around the closure. then at 10pm on thursday july 9th, doyle drive will be completely closed down until 5am the following monday. the closure.. seen here in red...will extend from the marina to the intersection with highway one..drivers will still be able use highway one to reach the golden gate bridge. during the 79 hour shutdown, crews will dismantle parts of the temporary bypass that commuters have been using for the past several years and then move traffic onto the new presidio parkway. during the closure, crews will also work to put the finishing touches on a new intersection with marina boulevard and reopen two off/on ramps to highway 1.. which have been closed for several years. >> catherine : a bill that allows for motorcycle lane- splitting has stalled in the state legislature. assemblyman bill quirk of hayward is putting it on hold for this year. while he figures out how to make it work. the bill would make california the first state to allow motorcycles to weave between cars in slow-moving traffic. law enforcement groups support the legislation. but the american motorcyclist association has opposed it. >> reporter :we have a nice sunshine earlier this afternoon but now we're getting ready for an ice cave collapse in washington state. one of the victims is in critical condition. the person who was killed remains buried under the debris. it happened in the mount baker snow-kwall-mee national forest. about 40 miles north of seattle. and it's the second ice cave collapse in two days. yesterday. several tourists escaped injury when a section of another cave came tumbling down. the forest
