good morning, from the studio 57 newsroom at cbs headquarters here in new york. it is good to be with you, i'm anne-marie green. the partial government shutdown is now in its 18th day making it the second longest in history. tonight, president trump will address the nation and make his case for funding a border wall. marc liverman is here in new york for more on this, good morning, marc. >> good morning, anne-marie. well, if the shut down last past this weekend, it will become the longest in history. so far, neither sign is showing signs of lets up, bad news if you're more than 800,000 federal workers. president trump will give his first prime time office address overnight tonight to argue the case for the border wall at the u.s./mexico border. >> we have an absolute crisis, and criminal and gang members coming through. it is national security. it's a national emergency. >> reporter: it's an issue mr. trump has been making since the day he announced he was running for president in 2015. >> they're bringing drugs. they're bringing crime. they're rapists and some, i asme, are good people. >> reporter: president trump remains deadlocked with congressional democrats over his demand for $5 billion for border wall funding. he'll visit the border on thursday. >> there's no security crisis at the border. >> reporter: democrats will offer a rebuttal immediately after his speech. >> i expect the president to lie to the american people. why do i expect this? because he has been lying to the american people. >> reporter: trying to lessen the impact of the shutdown, the trump administration announced the irs will process tax returns and provide refunds to taxpayers. mark bayzor of the tax pose center said that will be a relief to thousands of americans. >> people rely on the tax refund to either pay bills that they may have piled up from the holiday season or make a purchase of a consumer durable or even like rent and food and so on. >> reporter: the irs will have to refurlough irs workers meaning they'll be working without pay. tsa says it could be a tipping point. that's when screeners will miss their first paycheck, many of the 51,000 screeners can not afford to lose their weekly pay and may not come to work. anne-marie. >> marc liverman in new york. cbs news will carry a special report tonight starting at 9:00 eastern, 6:00 pacific time. national security adviser john bolton is in turkey this morning for talks on the future of syria. bolton's visit comes amid confusion about when 2,000 u.s. troops will leave syria after president trump's withdrawal announcement last month. david martin has more. >> reporter: although president trump insists he hasn't changed his mind about pulling troops out of syria, the new timetable for their withdrawal is dramatically different. first, it was 30 day, then 120, now, it's open-ended. that became clear when national security adviser john bolton met with israel's benjamin netanyahu over the weekend to discuss how the u.s. plans to get out. >> in a way to make sure that isis is defeated and is not able to revive itself. >> reporter: meaning the creation of enough local security to prevent isis from ever staging a comeback. as the president himself put it -- >> we won't be finally pulled out. >> reporter: that's completely different from when he declared victory on twitter. >> so, our boys, our young women, our men, they're all coming back, and they're coming back now. >> reporter: that decision triggered the resignation of his defense secretary james mattis who said that the president's snap decision to abandon allies on the field of battle. fighting continues as u.s.-backed forces close in on the last isis stronghold, capturing at least one american in the process, warren christopher clark, a houston resident. according to this letter he sent isis, he offered to teach english in the islamic state. instead, he was apparently thrown into the front lines. clark is now more than one of 700,000 foreign fighters captured and held by u.s.-backed forces in syria. if the u.s. were to pull out abruptly, all of those fighters almost certainly would be released and able to return to the battlefield. david martin, cbs news, the pentagon. north korean leader kim jong-un is in beijing this morning for a four-day visit. kim's visit comes after u.s. and north korean officials reportedly met in vietnam recently to discuss the location of a second summit. the trip also comes a week after kim warned that he may take an alternative path if the u.s. is not sanctioned. the north korean dictator is also celebrating his 35th birthday today. back home, actor kevin spacey pleaded not guilty after his first court appearance in massachusetts. he's accused of sexually assaulting a teenager in 2017. jericka duncan was in the courtroom. >> reporter: kevin spacey walked into a packed nantucket courtroom to face the charge of indecent assault and battery on an 18-year-old in 2016. the 59-year-old quietly stood up as his attorney entered a not guilty plea. >> actor kevin spacey sexually assaulted my son. >> reporter: in 2017, former boston television anchor heather unrue accused spacey of groping her son. the alleged victim told authorities spacey bought him nearly a dozen drinks and touched his private area. he said he captured is on video using snapchat. during a recent court hearing, one officer was questioned by spacey's attorney about the video. >> what the video shows is a person's hand made contact with the shirt, correct? >> yes. >> okay. not any body part? >> correct. you don't see any body part. >> reporter: there are multiple investigations into allegations that spacey sexually assaulted other men, some of which spacey has denied. cbs legal analyst rikki klieman. >> the prosecution has enough evidence to go forward. it doesn't necessarily mean ultimately they may win. >> and you trusted me even though you knew you shouldn't. >> reporter: last month, on the same day prosecutors announced a felony charge against spacey. he posted this bizarre video on youtube. >> i know what you want. you want me back. >> reporter: spacey's attorney is expected to return back to court in march. spacey does not have to be here. if convicted, though, he could face up to five years behind bars. jericka duncan, cbs news, nantucket. a funeral will be held today for 7-year-old jazmine barnes. texas officials say that two men suspected in the drive-by-shooting that killed her mistakenly thought they were attacking people that they had fought with in a club earlier. barnes was in her mom's car december 30th heading to the store when a gunman opened fire. the suspected driver of the vehicle is being held without bail. >> we believe that the evidence is pointing to eric black as the driver of the getaway vehicle in the shooting of jazmine. >> black was identified over the weekend. deputies are questioning a second man that black said was with him. but no charges have been filed. clemson dominated alabama to win the 2019 college football national football championship. >> the chargers reclaim their crown by crushing alabama. >> kevin lawrence passed for 437 yards and three touchdowns. the final score, 44-16. it's clemson second title in three years. clemson will celebrate its latest national title with a parade and ceremony at its home stadium on saturday. and coming up on the "morning news" now, granted clemency. a convicted murderer released from prison. and a new apology. kevin hart addresses his homophobic tweet. this is the "cbs morning news." kevin hart addresses his homophobic tweet. this is the "cbs morning news." the in-laws have moved in with us. and, our adult children are here. so, we save by using tide. which means we use less. three generations of clothes cleaned in one wash. those are moms. anybody seen my pants? you remembered. it's good. does it make the short list? you remembered that too. yeah, i'm afraid so. knowing what's important to you... it's okay. this is what we've been planning for. thanks, bye. that's what's important to us. it's why 7 million investors work with edward jones. police and good samaritans in corpus christi, texas, are being praised for saving a man trapped in a burning car. newly released video shows what happened on new year's day. authorities say the driver's vehicle caught fire after being hit by a wrong-way driver and flipping over. officers and nearby citizens rocked the vehicle upright and then pulled the 70-year-old man out. comedian kevin hart has issued a new apology. and a call for clemency is answered. those are some of the headlines. on the mourns newsstands. the tennesseean reports that governor bill haslam granted clemency to cyntoia brown. and commuted her life sentence for murdering a man when she was 16. brown who is now 30 shot and killed johnny allen in 2004. she said she was forced into prostitution and claimed that allen was reaching for his gun when she shot him. last month, tennessee's supreme court ruled that brown should serve 51 years before becoming eligible for parole. celebrities such as rihanna, snoop dogg and kim kardashian-west said brown was a victim herself. her case sparked intense debate over harsh sentences for minors. >> we need to see this as a national awakening to change the draconian laws that allow juveniles, children, to be placed in adult prisons when they're just children. >> brown will be released in august and will stay on parole for ten years. the san antonio express news reports police say the father of a missing 8-month-old boy staged the infant's kidnapping to cover up foul play. 34-year-old christopher deville told police that he left his car running with his son inside and the door locked friday night when he went into a convenience store. he told police the car was stolen. investigators say he staged the abduction and the woman who took the car was his cousin. police won't say if they think the infant is still alive. "usa today" reports kevin hart apologized to the lgbt community and reiterated that he's not hosting the oscars. he stepped down last month after past homophobic tweets from heart surfaced. last week on her talk show ellen degeneres said that she should return to host the oscars. yesterday, hart said he's not homophobic and has never been. he also said he doesn't have time to properly prepare for the oscars which airs in about two on february 24th. and the sacramento bee said california governor gavin newsom's 2-year-old son dutch stole the show during the inauguration speech. newsom held him for part of the speech, then he put him down and dutch just didn't want to leave. the governor continued his speech as his wife and 7-year-old son tried to coax him to come down. finally newsom's wife picked her son up and carried him off the stage. >> still ahead, amazon's rise on wall street. the online retailer takes over a coveted title from microsoft. ailer takes over a coveted title from microsoft.
