Reporter and that connected police directly to the cars location and then they were able to track down the suspect. The van has on star so its kind of ridiculous. Reporter you have his drivers license. And we have his drivers license so he wasnt a brain scientist. Reporter police say the suspect crashed into a few vehicles on his high speed getaway and ended up on the side of the road when they tracked him down and arrested him in antioch. A coworker has a new nickname for christopher. He is our little local superman. He is Christopher Reeves. Reporter he says he prefers the title top sales guy and despite it all he has a good sense of humor. My name is Christopher Reeves and i got that name a couple of years ago, superman without the muscles so ha. Reporter a lot of bravery. I had to be. Reporter hm. As for the suspect, his name hasnt been released. He is behind bars. They took the test drive to the suspects home. He showed his family so reeves thought this car sale was a done deal. It wasnt. Super salesman for sure. Right now there are new dangers from the wragg fire that is burning in napa and solano counties. The fire flared up again this afternoon. Elizabeth cook has more on the second round battle to contain the flames. Reporter 200 people are being evacuated because of the flareup. Vacaville police are going door to door to make sure everyone gets out. The flareup occurred on the south side of the fire but it still is within the secondary containment lines. The wragg fire has burned nearly 7,000 acres near Lake Berryessa. Check out that cloud of smoke. This is from a fire truck heading that way. A viewer sent us this shot from winters which is east of the fire. You can see crews attack the wragg fire from the air. Now, before this flareup, cal fire had 80 of the fire contained. A large dc10 air tanker has been brought in to fight this flareup and Evacuation Centers have been set up at a Community Center in vacaville. The wragg fire started wednesday afternoon. No injuries, one home damaged. Several roads are closed. Paul, the hot, dry weather today not helping those firefighters for sure. Triple digits in the fire area Lake Berryessa up to about 102, 103 on the shores of the lake today. 106 the hot spot in antioch. As the temperature goes up the humidity goes down, it was down near 10 at its minimum today. That increases the fire danger exponentially. Poor air quality in the south today and new fires are burning which will make the air quality tomorrow worse. Our second consecutive spare the air day. The one good thing is for any new fire starts, wind is not that much of a issue. At its peak today the wind didnt exceed anywhere in the bay area 15 miles per hour. Vallejo currently 92 but only a 15mileperhour wind gust earlier today and the forecast in and around the fire zone for the wragg fire, hot, certainly, triple digits again tomorrow but it will not be windy. The winds will likely stay below 15 miles per hour. Well talk about how long the heat continues and when humidity arrives. Thats coming up. Well look for that. Thanks. Reporter allen, what were you guys doing today . Sipping a cold latte in an air conditioned office . Paving a highway somewhere . No matter what your day was like, it was no worse likely than the guys that had to fight this fire. On this very hot day when the temperatures in san ramon hit 102 by my thermometer, these firefighters were in the midst of this big brush fire where it was even hotter. You can expect another 20, 30 degrees warmer depending how close you get. Reporter they were pretty close. Its warm. [ laughter ] its not even that hot right now. Reporter the captain was being stoic and also busy with the fire at hand making neighbors nervous. We could see there were, like, four piles of smoke. Reporter the steady thump of thoughts didnt help. I was going to leave because the fire just torched to me pretty fast. Reporter there were no evacuations but neighbors worried it was coming their way fast. What you see up there was a top where the giggles are, from there down to there in the space of less than 10 minutes. The potential is there for this to spot and get out away from the fire, the perimeters. Theres nothing that will guarantee it doesnt cross that. Quick work by four different Fire Departments knocked it down in a couple of hours but not before smoke was felt around the valley. Pretty intense. Like, um, gray and it was rising out and the wind like pushed it past that way and it was pretty scary. Were actually about 2 miles away from right here from where the smoke was and weigh could actually feel it after a while. Reporter it ended up burning a section of camp parks and Army Reserve Training camp about the size of 250 football fields but it was just brush. This was what we get paid to do. A Santa Cruz Community is in shock mourning the death of an 8yearold girl her body found in a dumpster close to her homeless than 24 hours after she went missing. Kpix 5s len ramirez tells us you know why her family is critical of the initial search. Reporter this place was crawling with Santa Cruz Police fbi agents and volunteers looking for Maddy Middleton. Her body was here the whole time and police say they think she was murdered before she was reported missing. My brothers in pain. Reporter the uncle of 8 yearold Maddy Middleton and a family friend returned to the santa cruz Apartment Building today with questions about how this could have happened. Wondering how a 15yearold kid can carry 80 pounds of dead weight from all the way over there to all the way over here with nobody noticing. Reporter Santa Cruz Police are still trying to piece it together. Investigators believe maddy was somehow tricked into entering the upstairs apartment of her 15yearold neighbor where he murdered her. It appears that she was lured to the suspects apartment willingly. Reporter police wouldnt say how she was killed but they believe the teenager acted quickly carrying her body down three flights of stairs and dumping it in this recycle bin. Its my belief that she was killed before we even got the phone call on sunday night. Reporter although the bin was apparently searched sun night, a different search group on monday looked more thoroughly and found the body hidden under other debris. Everyone was focused on the river. And all through here. Nobody focused really here. Reporter the bin is located behind security gates and covered by surveillance cameras. Police were not specific but they say they have evidence that directly links the suspect to the killing and chillingly, they said the 15yearold was watching from nearby when they found maddy and was arrested on the spot. Its a crime rocking the community and police. Its been a horrific, horrific experience. Reporter the suspected is not being identified because he is a juvenile. Police in Santa Cruz County says he is being held in the juvenile Detention Center and a decision will be made whether or not to try him as an adult. That decision could come as soon as tomorrow. My colleague devin fehely has been looking into the background of this 15yearold. Reporter we talked to the community who say quite frankly they are stunned. Still trying to make sense of maddys death, apparently at the hands of another child from this community. This was a tragic, tragic event. We lost two kids. Reporter in the eye of 8 yearold Maddy Middleton her accused killer would have been, if not a friend at the very least a familiar face another child like herself who had been raised in the heart of this closeknit community of artists in santa cruz. She was 8 years old. I think she had a reasonable amount of trust in him. We dont believe that she was taken there against her will. Reporter if maddy didnt recognize the apparent danger, she wasnt alone. Joe says he didnt think the young man he mentored could be a killer. He is a stellar boy, kind role model working at camp with kids often. Kids looked up to him. They all know him. He is part of our community. He is a quiet young boy very polite. He liked to ride a skateboard play with his yoyo. Reporter nina porter says her daughter is about the same age as the suspect and said she never even seen him be ill behaved nevermind have the capacity for murder. I believe in innocent until proven guilty. I think they should look at all the facts and find out i dont think we should be naive and put our head in the sand. If he did this, then needs to get help. Grief and deep disbelief in a Community Mourning the death of one child, apparently at the hands of another. Now, before yesterday, people who live in this Community Say this young man was well liked and well respected. That he even volunteered and worked in some capacity with other children at art camps that they hold here at this apartment complex and so there are a lot of questions that still remain to be answered in the minds of people who live here. In santa cruz, devin fehely, kpix 5. San francisco prosecutors filed another charge against the man accused of killing a woman on pier 14. Francisco sanchez pleaded not guilty to a new weapons charge today in court. Prosecutors added the felon in possession of a gun to the murder charges he is facing in the death of kate steinle. She was shot and killed on pier 14 earlier this month. Sanchez has been deported five times and has several prior felony convictions. The Hayward Police sergeant killed in the line of duty will be laid to rest this week. A public viewing for Sergeant Scott lunger will be held tomorrow evening at the chapel of chimes in hayward. On thursday, a police motorcade will escort his body to the oracle arena in oakland for funeral services. He will be buried in a private ceremony that afternoon. Chevron is cutting 500 jobs from its san ramon headquarters. The company says its an efforts to reduce worldwide costs by 1 billion. Most of the layoffs have already happened, the rest to be done by november. 3200 people work in san ramon. Some of the jobs could come from the closing of an office in concord. Chevron is also slashing hundreds of jobs in houston a broken pipeline sent water rushing into the bay. It flooded a lane of traffic at Junipero Serra county park. The 54 transmission line broke at the entry of the park. The Public Utilities Commission Says in order to keep Vital Water Services up and running it couldnt immediately shut down the pipeline. But tonight, water has been turned off. They are working on backup water supplies. East bay m. U. D. Water customers wont be getting a rebate for replacing live grass with fake grass. They voted against it this afternoon. Several Board Members say they think switching to drought resistant plants is better. Brown may be the new green during the drought but thats nod good when it comes to trees. Don ford says the lack of water has huge trees withering. Reporter Tree Service Companies in the trivalley are seeing more and more severely stressed trees than ever before. Seeing dry leaves, a lot of dead trees, roots are coming up to the surface because they are looking for water. Its the drought. So extreme that even once pampered pines are dying of thirst. This one over 70 feet tall dead and now a hazard, says this homeowner. Limbs begin falling off of them. Reporter oh, yeah. And we even see the branches are all dead and hanging. Reporter this tree and another on the property will be removed. Im sure there are other pine trees in town doing the same thing. Reporter its not just pine trees. While no one counted how many trees are in trouble, there are thirsty trees in every neighborhood. Japanese maples with withering leaves, birch trees with almost no leaves. And even some redwoods like this 50footer are all stressed from lack of water. This tree expert says you can still save some were a special watering rod. I have seen those things at home depot. You stick it deep in is that what youre talking about . Exactly, yup. Reporter it may save a dying tree but not those already dead. In the south bay, not the best air quality. Unhealthy air quality in the south bay will likely spread to the east bay tomorrow. One, we have numerous fires. Two, we have a complete lack of wind which will keep the pollution where it is created and a lot of it is create here in the bay area. Two ridges mean two hot days. We have one today. Another one tomorrow. Another a ridge to the south and east and off to the south and west both blocking any semblance of a strong onshore flow. No ocean influence, just hot. Why a woman in a wheelchair says she had no Developers Pay for public art in order to build in several cities across the bay area. But now a powerful group is suing to stop it. As kpix 5s john ramos tells us that could have a Ripple Effect in cities all across the state. Reporter much of oaklands recent renaissance is centered in its blossoming artistic community. Examples of the citys public art are the magnificent statues honoring civil rights leaders at henry kaiser park. Destiny franklin comes here every day before work. It does make oakland a better place because, you know, its very nice and its peace of. Something you can look at you know. Reporter the park and art were created as part of the Residential Development in the downtown area. The city would like to see this in every large building project so last year they voted to require developers to pay to include public art in their plans or contribute to a public fund. And they put a big price tag on it up to 1 of the value of a new commercial development. Why have a provision that says in order to get public arguments, developer must spend a certain amount of money . Reporter they say its hard enough to build in oakland profitly without a demand for artwork. They Say Developers are already struggling to meet requirements such as parking and Green Building standards. Those are all public amenities or needs that are in part created by the new development. And public art simply isnt. Reporter so the association has filed a federal lawsuit contesting the ordinance citing court rules that say fees must be tied to the directed impact of a investment but the city says emeryville has the same requirements and it has never been challenged. And Brian Williams says those who make money in oakland ought to be willing to contribute to its beautification. You have to consider that one percentage is a very small donation. Reporter everyone agrees oakland needs artwork other than this. But a court will decide if it is legal to make someone else pay for it. John ramos, kpix 5. The lawsuit is asking that the fee be eliminated and that could force other cities with similar ordinances to do the same. Coming up in the next half hour a disabled woman wants to get on the bus but the driver tries to pass her by. How she fought for her seat and is now calling him out. He wanted to climb the monkey bars and now he can. The first of its kind surgery helping a boy who once had no a woman in a wheelchair has an unpleasant ride on a muni bus. She got into an argument with the driver and is taking a stand. Joe vazquez reports. Come, want to get on the bus . Catch the next one. Reporter liz henry says this sort of thing happens way too often. A muni bus driver tries to pass her by. She has to argue for access. Well, im not going to comment specifically on this case. What i can say is that, you know, as soon as we heard about it, we followed through. Reporter a Spokesman Says muni has begun an investigation. Right now we are going through the process to determine, you know, what discipline there is if any. I was very angry and very determined that i wanted to get to work. Reporter liz henry filed a complaint. The hearing at muni was scheduled for 2 00 this afternoon. The driver decided not to walk by the tv cameras to go inside, but he was not so shy when he was yelling at liz so complain anyway, thats all yall s complain anyway. Alls you do. You shouldnt even be on the bus. I hope muni will take the complaint seriously. I hope the driver wont do that again. And i hope they improve their training for all their drivers. Reporter liz eventually was able to meet with the driver in an ada hearing. Muni says its still not clear what discipline, if any, the driver will face. In San Francisco, joe vazquez, kpix 5. There will be a new penalty phase jury selected for the man convicted of killing a police officer. Henry smith was convicted of killing officer jim capoot in 2011. The trial for the penalty phase was going to start this week but one of the jurors is moving out of state. The judge set the new penalty phase for august 31. A new york prison worker pleaded guilty to helping two killers pull off their daring escape. Joyce mitchell admitted in court today that she provided blades and other tools to one of the escapees. Investigators say she had agreed to be the getaway driver but got cold feet at the loose moment. The former prison seamstress faces up to seven years in prison. Richard matt and david sweat were on the run for more than two weeks. Matt was shot and killed, david sweat was captured. A Virgin Galactic spaceship crashed in 2011, the pilot injured and the copilot dead. There was a structural failure due to copilot error. It was a firstofitskind surgery in philadelphia. Doctors successfully completed a double hand and forearm transplant on a child. Marlie hall on the 8yearold who is now looking ahead to the future. A doctor led the Surgical Team that performed the groundbreaking procedure at the Childrens Hospital of philadelphia earlier this month. Surgeons needed to connect bone, blood vessels, nerves, muscles, tendons and skin. Based on our experience, once we reattach the parts, it allows the amputated part to grow. This area is one of the areas that are under mandatory evacuation orders and you can see why with that plume of smoke over that ridge heading right towards us here from the wragg fire picking up steam once again as it devours all the thick dry brush in this area and pushes downhill in a southwesterly direction towards homes and livestock here. Aircraft has been called become to the fire even some being shared with the lowell fire which is burning nearby in nevada county. Dry winds from the north and hot temperatures help this fire spread along and i talked to cal fire earlier. They say they were prepared for this with the forecast calling for those very hot, dry windy conditions this week. So far they have been able to keep the fires within the secondary containment lines. But about 200 homes west of Pleasant Valley road are under mandatory evacuation orders as this fire has grown by at least 200 acres from yesterday when it was 80 contained. Thank you. The San Francisco company says it rose 61 to 502 million beating analysts expectations. But what has investors concerned is the slow growth of new users. The Online Business review Company Posted a 2nd quarter loss hurt by a slowdown in ad sales. Consumerwatch reporter julie watts on one bed buyers uncomfortable experience when he tried to return the bed. Its a well made frame. Reporter for Dennis Williamson its all about the base, the adjustable one in his bedroom that he would like to get rid of. Earlier this year he bought a sleep number bed for more than 7,000 but it wasnt comfortable as he hoped. It wasnt working out. They said that well be out to pick up the mattress. Reporter but not the 3,000 adjustable base. Williamson says he thought the entire bed was returnable. The salesman told me that if i didnt like the bed we could return it. Reporter and there are several similar complaints online. Thats a complaint i come across quite often. Reporter Nick Robinson of sleep like the dead website says bed Companies Really let you return adjustable bases but says salesman dont always neighboring clear. At least part of the time they dont do a particularly good job about making that clear. Reporter sleep number says its salespeople are instructed to tell people the bases are not returnable. When we visited sleep number undercover and asked about returns, we got mixed message. You lose 199 in the cost of the bed but you can change it and fully return it. Reporter but he did eventually note the exclusion for the base. But bases arent the only thing bed buyers need to worry about. Many return policies require you keep the bed at least 30 days before your allowed to return it. They want to you give the mattress basically a fair chance. Reporter and if you do return it, expect fees. Processing, restocking, transportation. Williamson got hit with a 179 fee for returning the mattress a price he would willingly pay if only he could return the base, too. Sleep number calls this an unfortunate situation. It says it does have customers sign their receipts acknowledging they understand the terms of sale and mr. Williamson did sign his receipt. Thats an expensive proposition all the way. Its not uncommon. Most of these bed companies do this. Something to keep in mind, those bed bases, they weigh 300 pounds. Yeah. So experts say the reason they dont take it back is its hard to get them back. Costs a lot to ship. Julie, thank you.
