Even so, he may not serve that sentence because of time already spent in jail. Abc 7 News Reporter lee an melendez explains what happens next. Reporter before being transferred to San Francisco to face drug charges, jose had been detained in texas for illegally reentering the United States. Then 14 days after he confessed to shooting kate steinle on july 14th, 2015, a u. S. District court in texas issued a warrant for his arrest. And today, less than 24 hours after the verdict, that same court again asked that he be turned over to the u. S. Marshal. That request was sent to the Sheriffs Office in San Francisco which said once eligible to be released, the Sheriffs Department will notify the u. S. Marshal pursuant to the federal criminal warrant. What charges could he face . According to Immigration Law because he illegally reentered the United States five times, he faces ten years in a federal prison and could get a penalty enhancement of ten more years because he committed a crime after reentry. Remember, he was found guilty of possessing the gun that killed kate steinle so it could be years before hes deported. Last night immigration and Customs Enforcement sent out its own detainer and administrative order like this one asking to hand him over to be deported to mexico, but that would only happen if and after he serves time in a federal prison. In the meantime garcia will be sentenced on december 14th and his defense will likely ask for 16 months. The prosecution for the maximum three years. In this case, mr. Garcia could receive a sentence of three years but hes been in jail for two and a half years. So it would probably be a credit for time served situation. Garcia will likely go from a San Francisco jail into custody of the u. S. Marshal. He would then be transported to a federal prison. First, he has to be charged. The Justice Department said they will prosecute this to the fullest extent of the law. Some are asking why the jury wasnt allowed to handle the key piece of evidence in the case.
