"today in the bay's" bob redell is joining us live. >> reporter: the virtual experiences are not by any means a complete list. and we're going to show you in-person options. they will have flags to place on the grave of your loved one. service at the mare island preserve cemetery has reached capacity but will be open noon to 5:00. no services are planned. this is open to the public 24/7. it's a tribute to the men and women who served in our five branches. the cemetery will be open only to people visiting loved ones' ceremony. social distancing protocols in place. he will then depart to ft. mchenry to honor the military men and women. coming up at 6:30 these will be the bay area memorial events you can participate via online. social distancing as americans are expected to crowd the nation's beaches. "today in the bay's" tracie potts joins us live with a new travel ban. and one mayor asking president trump to stay away. tracie? >> reporter: but as far as we know the president still will contou about that. federal health officials are concerned that with people out and about they may not be wearing masks and they may not be six feet apart as recommended. reaches >> our two families are staying together in a hotel. we're enjoying the beach. >> reporter: to prevent the spread of covid-19. >> we now have excellent scientific evidence of how far droplets go when we speak or just simply talking to one another. >> reporter: dr. birx says church may not be safe for people with pre-existing conditions despite president trump ordering them to reopen. now he's shutting down travel with brazil citing the country's rate of infection. >> we'll look at other countries. >> reporter: he will head to ft. mchenry. the city's mayor has asked him not to saying it contradicts the stay-at-home order. signs of normalcinngamps to res empty stands. now new york's numbers, their rate of infections is going down. we still see the rise in the death toll now at almost 100,000. back to you. tracie potts, thank you. today the weather is no different. around the bay area law enforcement teams are trying to limit crowds and for social distancing including lake merritt where food trucks are not allowed to set up. people are hitting the beaches but so far crowds have been said to be less than what authorities expected. mounted police did try to remind people to practice social distancing and from the video we saw, seems like so far people are doing that. moving forward and certainly -- sorry about that. moving forward and looking ahead governor gavin newsom will address a couple of issues, when to start entering phase three for all these businesses that have been waiting and also what to do about an all mail-in election in november. and the reason for a lawsuit. "today in the bay's" kris sanchez joins us with a look at both those stories this morning. let's start out with the lawsuit, kris. >> reporter: vote by mail is nothing new for us. santa clara county just had its full vote by mail election a few months ago. the republican leadership says this is a brazen power grab. in case you missed it the republican national party, the congressional committee, and the california gop announced the something that the president himself has said as well. back on may 8th governor gavin newsom by executive order called for all registered voters to get a mail-in ballot. the republican party says that arbitrarily changes voter registration which will call integrity and accuracy of voter rolls. california will continue to defend californians' rights to votes including their right to vote by mail and their right to hold an election that is safe, secure and accessible. voters shouldn't have to choose between their health and right to vote. governor newsom will address that today along with entering phase three which a lot of folks are also talking about. a lot of folks are eager to open churches, salons and gyms and not just the folks looking to attend or get services but also the smallowinuch longer they can last. the governor hinted last week that phase three might begin in june, which is, of course, already coming up next week. kris sanchez, "today in the bay." governor newsom plans to issue new guidelines for reopening california churches. the leaders vow to reopen next sunday no matter what. more than 1,000 churches all making a similar vou. the latest twist in the legal battle came friday. this is when an appeals court upheld governor newsom's ban on in-person services. one pastor says no matter what is decided his sermon will be held in front of his congregation. >> we need each other and i'm never again going to close those doors ever. i don't care what they say. this is god's church, his house. >> and church administrators tell us cdc guidelines will be followed but no one will be turned away for not wearing a mask. we did hear from some who said they would likely stay away because it's too risky. not all pastors are quick to want to reopen. african-american religious leaders are gathering at san francisco city hall to deliver a social distancing sermon. they will push for maintaining virtual services while calling for more medical aid and education about the virus in their communities. >> let's see where we are in the scheme of things, the latest look at the number of tests that are being administered right here in the bay area. berkeley has tests for 100,000 people. san francisco has tested the most people so far. something about 5,600 per 100,000 people. alameda county is somewhere in the 5,000 range. marin, sonoma, napa and san mateo between 3,200 and 3,900 followed by santa clara, contra costa, and solano. on site workers will soon reported reportedly have to check into a smartphone app to verify they are free of that virus. the county hired ibm to make an app for workers for symptoms and exposure. the county is expecting both private sector and government employees to follow the check o the forecast for you. it is going to be a hot one out there. yes, and it's all because we're nearing records as we take a look at our forecast high for today and what the record is for today. i think we'll set a new record in concord as we could go well above the high of 91 degrees set in 2014. also in san jose we could tie or even set a new record this afternoon. as we go throughout the week it will get even hotter. mike, you've been watching the roads. any updates for drivers heading out the door? you talked about the high temperatures. the update is the warning, a fire along eastbound 80 in fairfield. the approach is north of there as you head away from the bay area. a brush fire reported. maybe a campfire. we're on edge because of the conditions today. road conditions and speaking of heat we're looking at the fire in the north bay that has cleared from fairfield. a live look shows you what else has cleared for the north the law is limiting the use of independent contractor status for drivers at companies including uber, lyft and door as much dash. opponents have now acquired enough signatures to exempt the companies from the new law. critics tell "the examiner" this is really a case of uber and lyft trying to buy their way out of basic protections. gearing up for the historic flight. astronauts doug hurley and bob will board the spacex dragon capsule and lift off for the international space station wednesday. both say they are excited for the mission. >> we've seen nasa and consider what the next steps were going to be. we've longed to be a part of a test mission and doug and i are lucky enough to get that opportunity. >> they both say they have been in space twice and when asked if their mission will have a name they said yes. it won't be revealed until the launch day. most people haven't been able to go to concerts or nightclubs in months. >> an l.a. company says they have come up with a protective suit. the suit's goal is to encourage distancing in crowded places. it includes an n95 filter as well as snap-in canisters for if you want to have a drink or i guess vaping. the company says the idea is that different venues would buy the suit, rent it to patrons. then sanitize it before you put it in use again. that's key, sanitize it. you want to be king or queen, the fast food giant doing something good for social distancing. burger king handing out giant sized crowns. if you're hoping to have that royal experience you may be out of luck. unless you could travel which is limited as well. these crowns are only available in germany. i think we're getting loopy with these ideas. we have a new normal coming up. >> can't wait to see that. they could use the crowns to shield out the sun, kari. it will be a hot one. that big old hat would probably be hot but it would give you some shade and we do have our cool start to the morning. take a look at the rains we're feeling across the coastline. we're in the 40s while san jose is at 62 degrees to start out. we will have hot weather. if you're going to be outside grilling in spots like martinez make sure you're taking it easy, maybe grill out there and then bring that dinner inside because we're still going to be in the 90s even at 6:00 this evening. temperatures in the upper 90s today. up to 97 in concord. 97 in santa rosa. san francisco in the low 80s today. we'll have some poor air quality due to high ozone levels making it a spare the air alert day. we will have very dry hills because our temperatures will reach into the 90s and even triple digits for the inland east bay as well as the north bay. this weather pattern stays with us all throughout the week. as we go into the weekend an area of low pressure approaching and, unfortunately, it doesn't bring us a lot of rain. it may bring some lightning. i'll be watching for that as our temperatures come down as we make it through the week we're in the upper 90s inland. friday, 83 degrees and then some 70s for saturday and sunday. san francisco will be in the 80s over the next couple of days. mike, you've been watching the commute. any big issues popping up? no. i can call out the smaller issues, what few we have. holiday traffic. we don't see any of the slowing we had grown accustomed to seeing. we will take you out to the tri-valley but it's not 84 or 580 that's showing the slower drive in your commute direction. bottom of your screen northbound 680 approaching the sue nonol a. that may slow you down. i see slowing. you see that coming on highway 84. a little slowing there. there are at least a few cars. also watch the crash and possibly a break north 680 at monument. just a heads-up there may be a quick traffic break from the interchange. back to you. >> thanks, legal battle heating up over the vote by mail order amid the coronavirus pandemic. a live report on the lawsuit just filed by the republican party and how governor gavin newsom is responding. plus, moving nicely. you have something going on. >> it was a scare of a lifetime for a family. police say a man was driving recklessly. he then lost control smashing into this apartment. nearly taking out a family grilling on the patio. >> he was flipping the chicken, coming back inside the house. we hear screeching and a boom within a second later and have to dive out of the way. >> i dove over my table. that was about it. it happened so fast. firefighters say four units why damaged. officers took the suspect to the hospital but will have a lot of time to think about what he did in jail. governor gavin newsom is facing two major issues. first of all he has to think about when he's going to officially start phase three as businesses wait for reopening. and what to do about a mail-in election. we want to check in with kris sanchez covering both angles of a very busy governor's docket. >> reporter: it will not be a holiday for the governor because he is going to have a lot of state saying calling for an all mail-in election would cause fraud. governor gavin newsom called for all registered voters in the state to get a mail-in ballot. the republican national party says that conference today along with entering phase three. a lot of folks are eager to reopen churches, salons and gyms. the small business owners who say they may not be able to hang on much longer. the governor hinted phase three could begin as early as june and, ofby june is coming up next week. kris sanchez, nbc bay area news. there are 15 new cases reported in marin county. santa clara county is announcing 47 new cases, its largest one-day rise in more than a month. that brings the total to more than 12,000. 425 have died. across the state nearly 4,000 people across the state have died. happening today a pop-up testing site will open in mountain view. this is at the rengstorff park aquatic center. you do not need insurance, documentation or an appointment and testing is free and open to everyone. people over the age of 60 are encouraged to get tested monthly. sonoma county plans to hire people in its first big wave of contact tracers. contact tracers interview people who have been infected or exposed to covid-19. the job pays $22 an hour. well, help could soon be on the way for those trying to make it in the bay. marin and santa clara will consider extending their moratoriums on residential evictions another 30 days. it was put in place when tenants were facing difficulty paying their rent because of the pandemic.o 90 days after the expiration of the resolution to repay back rent. the city of berkeley is holding a food drive to give back to the community today. berkeley mayor and the school of islamic are partnering to give food away to commemorate memorial day and the end of ramadan. starting 11:00 a.m. at the bear pantry. helping find those grab and go meal sites for kids. students created a text service where parents text their zip code and you can get a list of nearby sites. they created a map showing all of the sites and the days and times of operation. the child needs to be enrolled in the school district to get the meal. for the number head to nbcbayarea.com. some flyovers to thank frontline workers. >> they will head all over the bay area. redwood city, san francisco, petaluma and napa. and then down the east bay before wrapping things up in san jose. they want to you maintain social distancing measures if you decide to check out the flyovers. and in southern california more than a dozen vintage planes will fly over to celebrate memorial day. they will fly in an 18 plane formation over orange and los angeles counties. saluting health care workers. convoy of vintage planes will pass over several airports, hospitals and memorials. >> we need clear skies for that flyover. take a look at this live view we have looking at morgan hill. we will see sunshine and quickly warming up temperatures today as we head into the upper 90s. morgan hill will see a high of 97 degrees and livermore also 97. 99 in antioch while napa will reach 95. napa 85 degrees. more hot weather in the forecast. i'll have a look at that in a few "today in the bay's" bob redell joins us live with a few options online for ople. bob? >> reporter: yeah, marcus. it's unfortunate a couple major observances here in the bay area are closed today because of concerns over covid-19 like the memorial service that normally was taking place at the presidio and onboard the "uss who are met" in alameda. you can go online for a virtual celebration. this is by no means a complete list. marin county will honor the men and women who gave the ultimate sacrifice with a wreath laying ceremony, music and speakers being starting at 8:30 with a live feed on the marin county united veteran council facebook page. los gatos memorial park's online service will begin at 10:00. you can see the link to that on your tv screen. that event will include a 21 gun salute, "taps" and comments from a retired major general. in washington, d.c., arlington national cemetery will remain closed to the public. the cemetery will only be open to people visiting their loved ones graves and those participating in the 152nd national memorial day observance ceremony. there will be social distancing protocols in place. a live look from the tomb of the unknown soldier. we're waiting for president trump to lay a wreath there. he will then depart for ft. mchenry for another ceremony to honor the military men and women who died on the front lines of war for us. reporting live, bob redell, "today in the bay." thank you so much, bob. happening today bay area activists will hold a memorial day peace caravan to protest u.s. foreign policy in the military stationed around the world. the organizers of san francisco bay area say the caravan starts at 1:00 p.m. through the streets of sausalito and into san francisco. the procession will end at the home of senator dianne feinstein. activists will then hold a rally to demand military spending be instead spent on environmental causes. san francisco's fishing industry not the only thing hit hard by the fire that ravaged fisherman's wharf this weekend. the historic "jeremiah o'brien" sustained minor damage in the weekend fire. it's the only one of two world war ii-era boats of its kind still functional anywhere in the world. so the captain says that fire heavily damaged the pier where the ship is moored and the spare parts stored in the warehouse went up in flames. >> we mostly had engineering parts and spare parts. we had some new tubes for our boiler that were going to be installed. we stored our two fork lifts in the shed. they were, of course, destroyed. the good news for us this morning everything that was damaged can be replaced, but restoring the pier will take time and money. the ship will have to be docked for now and the organization is seeking donations. l.a. county health leaders say they're very encouraged about the latest overall numbers. despite more than 1,000 new cases reported in that area saturday. "l.a. times" reports the county had 41 deaths saturday but over the past week there's been a 13% decrease in daily death rates. also the average number of people hospitalized is down 16% and positive tests are now at an all-time low for the county about 8% of those being tested. more dmv offices will be opening across the bay area starting on thursday dmvs will reopen 46 additional offices. they are under pressure to reopen more locations to help californians who need to renew their license or obtain other documents. among the offices reopening in the bay area, santa clara, oakland, san mateo, pleasanton, daly city and fremont. nascar is now fully back on track satisfying fans' thirst with last night's coca-cola 600. >> the checkered flag, michigan's brad keselowski. >> and the race took place at charlotte motorway. brad keselowski won it. this is typically nascar's longest race of the season. and that rain during the race made it longer. at the end of midnight, became the longest race ever because two more laps were added at the end. 6:49 for you this morning. you know the l.a. dodgers came together to honor fallen heroes before memorial day. >> that's right. quite the sight to see. the stadium was lit up with thousands of red, white and blue lights. the dodgers partnered with the tragedy assistance program for survivors or t.a.p.s. the team says every light represents the memory of a military member and their families that are supported by t.a.p.s. how l big plays has tom brady made in his life? probably too many to count. take a look at this one. it happened out on the golf course. not bad. holed out yesterday from about 110 yards out. quite the athlete. during a special pga event with tiger woods, phil mickelson and eli manning, they were all there. but it wasn't all perfect because at other points a frustrated brady could be heard asking when football season starts. that's his game. the event however, did raise $20 million in donations. brady also lighting up the twitter sphere when he was calling out opponent eli manning a short time after manning posted his first ever tweet this weekend. brady said welcome, eli manning. in typical fashion, you never showed up until the fourth quarter anyway. exchanging some jabs. you know what today anyone getting out driving around in one of those fast cars will be nice because of the breeze you can get from that because it is going to be a hot one out there, kari. yeah, it's going to be really hot today. that will be the concern and yw some air conditioning if possible. a look to san francisco with this beautiful sun rise. a hazy start to the day. if you're going to be grilling out well, just be mindful that the weather will be hot and you may want to bring that grill back inside. we will see a lot of these high temperatures near a record today. i think we'll set a new record in concord as well as tying the record in san jose. very close and more of this hot weather shows more records in danger of being set. 92 in palo alto. oakland will reach 85 degrees and some low 80s in san francisco, north bay highs in the upper 90s. poor air quality. it will be unhealthy if you have breathing problems and then we'll also have our bay area hills as our highs reach into the 90s and even over 100 degrees. several days of this heat. it doesn't look like it brings us a lot of rain. in fact, it may just bring us some dry lightning which may raise other concerns. some upper 90s for the inland areas. back to the 70s. mike, any new issues or reports coming in from chp? the chp had three fires reported. green sensors all over. right around spring town in behind target and the freeway. there's a small brush fire reported there. again we're concerned about those conditions. continued road work getting rid of that overcrossing and that may still be going on. happening now video of police in hong kong dousing protesters with tear gas. thousands took to the streets sunday to protest a new security crackdown. the law would ban anti-government activity. coming up next a quick look at our top stories on this monday morning for you including running for their lives. a new video to show you after a car smashes into an apartment in contra costa county overnight. plus, a legal battle over decision 2020, who is now challenging governor gavin newsom's order for man mail-in ballots. a lot more ahead. and... let's get started. (music fades in) hey! -hi! ♪ ♪ ♪ ♪ welcome back. 6:56 for you this morning. and a look at our top stories. i want you to check out this new video this morning. police say a man in this car is now in custody. this is after leading officers on a chase in pittsburg and then crashing into four apartment units. the family there happened to be grilling on the patio that sustained the brunt of that damage. they barely got out of the way of that car's path. now this happened last night on power avenue. no one, including the driver, was seriously injured. the republican party suing governor newsom's vote by mail order. the order requires every registered voter in the state be sent a ballot by mail for the november elections. newsom says because of covid-19 concerns will limit person-to-person contact. republicans say it arbitrarily changed voter registration for thousands. the governor released a statement saying, quote, california will continue to defend californians' right to vote including their right to vote by mail and the right to hold an election that is safe, secure and accessible. voters shouldn't have to choose between their health and their right to vote. end quote. governor newsom is expected to provide more information on when parts of california can enter into phase three of reopening. now much of the state just entering phase two, the third stage involves reopening higher risk places like salons, gyms, and churches. the governor says that on thursday phase three would start in june. june 1st is next tuesday. well, as soon as today governor newsom plans to issue new guidelines for the reopening of california churches as well. but some leadership at bay area churches about to reopen on sunday no matter what. more than 1,000 churches across the state are all making these similar vows. the latest twist came on friday when an appeals court upheld governor newsom's ban on in-person services. the pastor at san jose's calvary chapel says no matter what is decided this week, his sermon will be held in front of his congregation live. so far memorial day weekend has been a warm one. today's weather no different. but around the bay area law enforcement teams are trying to limit crowds and enforce social distancing. that includes at oakland's lake merritt where parking lots are closed and food trucks are not allowed to set up shop. police in southern california are hitting the beaches, but so far crowds have been said to be less than what authorities were anticipating. mounted police yesterday did try to remind people to practice social distancing. right now let's get a look at the forecast for you. it is going to be a warm one out there, laura. we have been talking about this. kari, the weather has delivered. it's hot. yes, it's going to be hot not only today but the next several days. microclimate weather alert due to the fact that we will see an extended period of heat all throughout the rest of the week. and, mike, you've been keeping an eye on a couple of brushfires around the bay area. the big note is watch out for those and be careful what you do outside. it sounds like everything is under control. light traffic. 92 got very busy. last night coming back from half moon bay. be careful out there. look at this. it's already so sunny. the sun is coming through the blinds. try to keep cool if you can. thanks for joining thus morning. all right. and we leave with a look at the memorial in san jose honoring all of those soldiers. we love you. thank you. good morning buenos días holiday crowds and concerns. millions flocking to pools and beaches over memorial day weekend. for many, social distancing taking a back seat despite the risk. >> this is the first time i've seen this many people in a long time. >> this morning health officials fears that seems like this could lead to a surge in new coronavirus cases. u.s. against the world overnight the white house announcing a travel ban from brazil, the world's latest hot
