going to be guilty. >> reporter: the jury came close to being hung on max zblaharris. >> it came down to 11-1. and we were going to be hung for max harris. >> reporter: billings says after a week-long break, the last juror agreed harris should be acquitted. everyone clad in the deliberation room. as for derek almena, that's when the frustration set in. >> i reasonable doubt the whole idea of blaming institutions, and i blamed almena because i felt that i could at least -- i could at least grasp on the idea that he was given a lease and he didn't read the whole thing, and he purposely violated and lied. >> reporter: but two women felt otherwise and they stood their ground until tend. almena's attorney said he hugged one of those women after the judge declared a mistrial for his client. >> and she grabbed me and she was almost crying. and she was holding on on and look straight in my face. and she said -- you know, they were trying to force me to give it up and go with the minority, but they're not going to bully me. i stood for my rights. >> reporter: we have reached out to two other jurors, including the jury foreman. they say they are still processing their closed off a lot while they figure out what happened. nbc bay area sergio quintana is life at the crime scene. what do we know so far? >> reporter: janelle, i can tell you that according to an employee at the food max here, when he arrived on scene this afternoon, he noticed that there was a body laying right besides that white ford explorer. that's where the san jose police department has their crime scene unit right now. when we arrived this afternoon, we actually noticed there was a bunch of police officers taking pictures of a car nearby. emergency crews were called here for a report of gunfire. they arrived to find a man laying on the ground suffering from a gunshot wound that. man was rushed to a local hospital where he died. people we talked with who were still trying to do their shopping describe a very busy crime scene here. it was difficult to get into the parking lot. >> when we drove by, we saw a body that was covered, and we drove into the one by the motorcycle, because that's the only entrance. everything else was blocked off. >> reporter: police have not released any further information on the victim, and they won't do that until they notify his family. right now police officers do not have a motive in this shooting. they're also trying to figure out who the suspect or suspects are in this incident. reporting live in san jose, i'm sergio quintana, nbc bay area news. thank you, sergio. we have new information tonight on the investigation into the dive boat fire in santa barbara. the sheriff says it appears the 34 people who died all died from smoke inhalation. they were sleeping in tight quarters when the fire broke out above. it trapped all 33 passengers and one crew member below. >> due to the intense fire that occurred on the vessel, all of the recovered remains have suffered varying degrees of fire damage, which requires dna analysis to confirm the identities of the victims. >> investigators moved a barge and crane into place, but operations are suspended because of bad weather. they will resume when it's safe. 33 of the 34 bodies have been recovered. investigators are using state-of-the-art rapped dna technology to identify the remains as quickly as possible. they have i.d.'d 18 of the victims so far. all 34 families have been identified. we are learning more names, and two more are from the bay area. this woman graduated from uc berkeley earlier this year. also from singapore, he owned a master's and doctoral degree from stanford. he worked at point cloud. his father says he took up diving two months ago. there's also a personal connection to the conception for actor rob lowe. >> the dive boat from our hometown of santa barbara was the site of a horrible tragedy where 34 people lost their lives in an unspeakable fire. i've been on the boat many times and i can't imagine this tragedy. >> lowe is teaming up with california strong, an organization that helps provide financial assistance to victims. 100% of the proceeds go to families in need. janelle? firefighters from alameda county are heading north to fight a fast-growing wildfire there. the red bank fire is burning near the shasta trinity national forest north of chico. it was sparked by lightning yesterday afternoon. the fire spread to 7,300 acres and is only 7% contained. mandate evacuations are in place. something is not right. that's what some people who live in the west winds mobile home park are saying about the death of their neighbor. the woman is disabled and she died when her home caught fire. nbc bay area's robert handa joins us live. robert, friends and neighbors have a lot of questions about this death. >> well, they do. at this point the san jose fire department says this fire is considered just under investigation. but more arson experts are coming. >> they will be conducting an investigation starting monday. usually it happens when we have a large enough fire and/or fatality. >> oh, my gosh. >> reporter: bernice contreras couldn't help but react in horror shooting this video around midnight last night, watching her neighbor's mobile home engulfed in flames and smoke. >> i was like hopefully it doesn't spreadful hopefully they can, like, put it out in time. >> reporter: a father and son tried to rescue a neighbor, a woman confined to a wheelchair. >> it was literally a torch shooting up on the right side only. when we went to the back door, it was only black smoke. it was -- all the black smoke was waiting to escape. we opened it and it shot us in the face. >> reporter: neighbors say they expressed concerns to san jose fire investigators saying the on-site cake taker was gone when the fire started. >> he was just hoarding. that right side of the house is what was in the fire are. >> reporter: san jose fire department says no one has been arrested or is in custody. officials in santa clara arson task force has been called. >> sometimes they have more resources we can pull from. they might have more people to question more people that we might be able to glean more information. >> reporter: we talked to the coroner's office and we're told they are not ready to release the name of the victim yet. live in san jose, robert handa, nbc bay area news. a man who opened fire on a freeway is behind bars. ricardo lopez shot at someone on 280 in san jose after midnight on wednesday near the 7th street off-ramp. by the time chp arrived, lopez has driven away. the officers eventually found the shooter. officers arrested him for attempted murder. oak police beefing up patrols looking for illegal side shows. police will have helicopters patrolling from the air. anyone caught joining or participating in a side show could be cited and arrested. it's been years in the making, and tonight the first public event at the new chase center in san francisco. on tap tonight, metallica playing with the san francisco symphony. people are urged to take public transportation, but neighbors are still worried about the traffic. >> christie smith is live. christie, this is the first big run thru for not only chase center but the whole area. >> reporter: yeah, that's right. and i tell you, this concert doesn't even start until 8:00 tonight. boy, people are excited to come out here and see it. metallica fans have been out here taking pictures of each other, and also of the building itself. a lot of work went into improving the muni stop nearby so it can handle big crowds. and the hope is that people got the message to skip driving here. outside the chase center, metallica fans are ready to rock. the band is performing tonight with the san francisco symphony, the first big show at the new arena. >> really awesome. we're just excited. we've been dreaming of this concert since we were little. >> reporter: the warriors' new home is ready to welcome the public. >> we've been waiting for this day for seven years, so to see people today for the first time be able to have access to all the public spaces here at chase center, it's awesome. >> reporter: brittany bates works nearby. she's worried about the traffic and very limited parking. >> initially i think that for the first concert, i think it's going to be a mess, but after they understand that there isn't available parking, then i think the next event they will take public transportation. >> reporter: that's what people are being urged to do at the embarcadero station. signs guide muni riders toward the chase center with its bigger platform and other enhancements. rides are free with an event ticket. >> all of our field crews from parking control officers to ambassadors to transit fare inspectors are going to take notes and bring the information back. >> reporter: muni will run more trains and express shuttles. >> they better have it planned right. that's all i got to say. for those who do drive, there's construction near the 3rd street bridge. but b.a.r.t., caltrain, bikes, walking, and rideshare are good options too. >> what alternatives do we have? we got to use public transportation going forward. >> reporter: back live from where we are, we're not seeing much in the way of traffic, but there's a lot of people. this is the end of the line to get in. doors open at 6:30 and a lot of folks, of course, certainly here to see the music, but telling us they're also very county. this video shows rescuers flying the man to safety. it started yesterday when the man took a hike alone and got lost off trail. a friend called the fire department for help and the search began. people on the ground found the hiker near stinson beach. the helicopter gave him a lift and an ambulance took him to the hospital. after a full night of being lost, he was ultimately okay. frustrated and terrified, that's how people are describing their experience living next to a homeless encampment. >> some say the homeless have attacked them. damian trujillo has the story. damian? >> reporter: janelle, this is the shopping center in question. sometimes they clear it out, but sometimes the homeless guy camped out on the sidewalk, the school is right down the street. but you can see they are blocked the other sidewalk over there at this time. the locals say the homeless are physically terrorizing the area. we were there during morning drop-off and afternoon pickup at the local school on lucretia avenue. each time we saw people and families having to dodge the homeless, who often take over the entire sidewalk. >> we're being tortured by them, i'll say that. >> reporter: when they're not blocking the sidewalk, the owner of the lawn dro mat says they're physically assaulting them. >> especially at night it's really dangerous. >> reporter: the cook at the local taco stand says she too has been attacked. she says she was struck in the face recently. she also accuses the homeless of stealing her tip jar several times. the clerk at the quick stop says that crime is blatantly. he says a homeless person robbed a soft drink delivery guy at gunpoint outside his store recently. >> they all come over there, steal whatever they want, take it, they never pay. >> i witnessed many people openly shooting up in front of police officers who, frankly, can only cite in that situation. >> reporter: counselwoman maya esparza say they have cleaned up the street several tiles in the last few weeks. but they're back an hour later, bringing fear to the locals. it's become a tug of war. >> we need the public to not give up. we're fighting for that corner. we're out there working hard every day. i am not going to let go. >> reporter: the councilwoman says the city needs to hire more outreach workers across the city. right now there's three workers and a supervisor. she says that's simply not enough to solve this issue all across town. live in san jose, i'm damian trujillo, be nbc bay area news. if you think your rent increase is too much-year after year, you might be in luck. california could soon have statewide rent control that would cap the increase at 5%, including inflation. >> as we all know, we have millions of california renters who are one paycheck away, one rent increase away from being evicted or from homelessness. >> the bill still needs to get through multiple committees to have a chance to become law. b.a.r.t. escalators are undergoing a major makeover. crews have gun replacing escalators in the bay area. crews are working here at the powell street escalator downtown san francisco. 41 escalators will be replaced at embarcadero, montgomery, powell, and civic center stations. it's all part of a $97 million project, the largest project in b.a.r.t.'s history. >> i think for everyone, many of them are 20 years old, they're going to be fixed and replaced. >> b.a.r.t. expects to replace six escalators a year. the first new ones are expected to be delivered for installment next spring video a hiker fell to her death in yosemite national park. this happened yesterday on the hike to half dome. rangers say the woman is from arizona. she was hiking the steepest part of the half dome trail when she slipped. she fell more than 500 feet down. the hiker died before park rangers arrived. this is live at sfo for a look at repair work that's about to begin on runways. starting tomorrow u one of two runways used for arriving flights will be closed for three weeks. travelers are warned to expect delays and cancels. you might want to opt for early-morning flights because the construction begins at 9:00 a.m. experts say unsettled ground at sfo and increased runway traffic are to blame. the san francisco travel association says the number of visitors next year is expected to hit an all-time high, more than 26 million people, nearly a million more travelers than this current year. more visitors means more money, of course, to the economy to the tune of nearly $10 billion. >> they got the kind of weather high of 88, dropping to 86. here's the thing. numbers dropping another five to ten degrees tomorrow. saturday's forecast will be perfect across the bay area. i know a lot of you want the cooler temperatures, and we're bringing it down. 79 in concord. 75 in livermore. those are usually some of my hottest, but not tomorrow. 78 in napa. 71 in oakland. san francisco, 65. look at san jose, 71 degrees. palo alto, 72. we'll have that entire microclimate forecast coming up. but i want to give you a quick look at hurricane dorian. it's pulling away from the coastline after some major damage in anti-trust investigation into the company. the investigation will focus on facebook's impact on advertising prices, data, privacy and acquisitions of instagram and whatsapp. facebook is already facing a separate ftc investigation over anti-trust concerns as 30 state attorneys general are launching a separate probe into google. santa clara is suing intuit. intuit previously made an agreement with the irs to allow low-income customers to file tax returns for free. if lawsuit alleges intuit hid the software. intuit disputes these allegatio allegations. the university of san francisco found out why hot peppers burn. for the last 20 years he wondered why wasabi is hot and why hot chili peppers burn. he discovered down to a the discovery won him the 2020 breakthrough prize, which would be an thousands of dollars gone in seconds. thieves taking armloads of phones and computers from bay area apple stores and running out with no resistance. >> it just happened again this time in san mateo. anoushah rasta found out apple stores are making changes shoo it is happening again and again. >> they're just take advantage of of an open situation, which is frustrating. >> reporter: thieves robbing another apple store, this time inside the hillsdale hillsdale in san mateo. a security guard now keeps a watchful eye on the store. >> apple puts out products that are extremely popular and it makes sense that if criminals are going to target products, they want things that they know will be attractive and popular when they go to try to sell them. >> reporter: san mateo police say last night three men with their faces disguised stole 40 items from here and took off in a getaway car parked outside. chp even got involved but the driver got away. the san mateo apple store robbery is the latest in a string of similar crimes, like a nearly identical one in burlingame a week ago. >> so easy just to walk in and do it. everything is out. >> reporter: a witness recorded this after seeing employees rush out and hearing someone yell that the thieves inside had guns. investigators say they are now working with companies to find a way to relocate valuable merchandise and make it harder for thieves to just grab and go. >> to have dummy models rather than actually having operational phones. >> reporter: police say store employees should never get involved and confront the robbers. instead give any information you have about the crimes to police. reporting live in burlingame, anoushah rasta, nbc bay area news. a follow-up to the case of a young immigrant receiving life-saving care in the bay area. she was set to be deported but now new hope and big show of support. community leaders rallied in oakland today. they're demanding that undocumented patients getting critical care in the u.s. be allowed to stay, at least until they're healthy. the face of this movement is a 24-year-old woman who gets weekly life-saving treatments at the hospitals for her rare genetic disease. nurses say her case is just one of thousands. >> we're really here to bring awareness, get loud, get people and that we need everybody to come and show up and support those who need a voice. >> last month immigration officials reopened her case. she is not completely in the clear, but no longer slated for deportation. actress felicity huffman could be facing jail time. back in may she pleaded guilty to fraud charges in the college admissions scandal. she admits talking to a college exam prospector to help change her daughter's answers on the s.a.t. ultimately she didn't go through with it. huffman's attorneys are requesting no jail time, just probation and community service. she will learn her fate next week. an airline mechanic appeared in court today after intentionally messing with a plane. it happened in july on a flight from miami to the bahamas. the american airline mechanic admitted to tampering with the navigation system on the plane before it took off. the pilots noticed something was wrong before the flight. the mechanic said he never wanted to hurt anyone but wanted to earn overtime fixing the navigation system he messed with. the governor signed a new law. he wanted changes first. the governor wants to grandfather in all existing medical exemptions, but critics worry this could create a rush for new vaccine exemptions. over to the east coast now. hurricane dorian is making its way past the carolinas, moving away from the coast. the category 1 storm made a direct hit on the barrier islands off north carolina this morning. >> right now rescue crews are trying to reach people who ignored those mandatory evacuation orders. a big humanitarian operation continues in the bahamas. nbc's jay gray has the latest. >> reporter: after stalking the atlantic coast for days, dorian finally makes landfall in north carolina. the category 1 hurricane swallowing the barrier islands, national guard members flying in supplies. several feet of storm surge pushing the ocean into homes across the outer banks. >> officials are telling people to get to the highest point in their houses. >> we have nothing left. all of our homes are destroyed. we have nowhere to go. >> reporter: battered residents looking for any way to get out. >> it's horrible. it's -- you can't live here. >> reporter: cruise ships loaded with relief supplies are making the short trip from the florida coast. >> i hope it gives hope to the bahamians when they see us, that help is on the way. >> reporter: hope and help that is desperately needed right now. jay gray, nbc news. >> thank you, jay. check this out. a good samaritan is being called a hero for saving a scared cat during hurricane dorian. victoria williams was in north carolina when she saw the cat in distress. the cat was clinging to a fence and nearly fell into the water. you see her fighting the wind to rescue the cat. she eventually wrapped the cat in a towel and carried it back to her home. >> wow, that's brave. >> well done. this month's jobs report showed u.s. employers added 13,000 jo 130,000 jobs in august. the trump administration is touting the report as solid evidence the u.s. economy is strong. but with the global economy weakening, critics see it as signs of trouble. >> numbers for august are fabulous, fabulous. the underlying strength of the economy is really much better than folks seem to think. >> i think this is going to contribute to the general feeling that, oh, geez, maybe we're slowing down and we really wish we would not be having escalation of the trade war. >> the chairman of the federal reserve said today that while he's not expecting a recession, the president's trade policy is causing uncertainty. trade talks with china are set to resume in washington early next month. another plot twist for the 2020 election. howard schultz is out of the running. former starbucks ceo dropped his plan for an independent run today, which comes as a relief to some democrats who worry he could siphon votes from the democratic nominee. schultz wrote a letter acknowledging those concerns and agrees his bid would pose too great of a risk helping the current president getting elected. we just learned health officials have reported a death in three states linked to vaping. in addition, the cdc says the cases of lung disease linked to vaping has doubled in the past few weeks. there are now 450 cases reported across the country. the cdc believes a chemical is responsible, but hasn't yet identified anything specific. researchers say many of the patients had used vaping products made with cannabis. one mother says her 18-year-old son was diagnosed with a lung infection and vaping is to blame. >> the pictures of his lungs, living proof of what vaping does to your lungs. >> the cdc says people should avoid using e-cigarettes. a north bay doctor accused of the drug-related deaths of four elderly people appeared in court today for a preliminary hearing. a judge is expected to determine if there's enough evidence to send 72-year-old dr. thomas keller to trial. last month he pled not guilty to second-degree murder charges. investigators he prescribed dangerously high levels of opioids and narcotics, all of them later died. keller is also accused of issuing suspicious prescriptions. caught on camera, and then caught by police. we're talking about this woman, patricia deabro. milpitas police say she burglarized two homes. she went to a home and stole a package. surveillance video helped them find her. police arrested her on harley-davidson plans to sell electric bikes that have batt y battery-poured motors. a swiss artist turned an austrian soccer stadium into a forest. he planted 300 trees on the field. the artist says the installation was inspired by climate change and his message is that one day this will be the only way people will be able to enjoy nature. the exhibit opens monday and runs through october 27th.
