freedman, abc7 news. a san jose nursing care facility is being accused tonight of patient dumping. >> that's a term for discharging residents in favor of taking new patients with higher insurance coverage. >> this is a story you'll see only on abc7 news. >> reporter: karen moo received major injuries as she walked across the street. >> i got two broken legs, and i got my knee actually cracked into four or five pieces. >> reporter: but it really hurt her when in the third month of her residence, she and another patient were told to leave. >> there's no reason why she should have been discharged without at least getting her to a doctor and having the doctor say this is okay. >> karen moo and the other resident anita willis have sued the care facility for not following regulations that require 30 days notice, they only received a week. and karen moo with rods impla implanted in both legs could not care for herself when she was forced to go home. >> i couldn't shower for a week because i couldn't get into the bathtub. with two broken legs i needed a shower chair. >> reporter: she says her abrupt discharge had to do with greed, that she had les coverage because she was covered by medical instead of medicare. >> the law required them to take me back. but i could not trust them anymore. so i don't feel safe to go back. >> reporter: courtyard's corporate office issued this statement. we have not been made aware of any citations related to patient dumping nor have received notice of a lawsuit. court yard continues to work diligently to provide quality care for all the residents. the lawsuit is asking the home to stop its discharge practices. the department released these photos showing what appears to be arcade style games, according to officials, plains clothed officials broke up the office seizing 25 machines. relatives of a man who was shot and killed by a b.a.r.t. police officer last month took their complaints about the incident to the b.a.r.t. board today. in emotion m comments to board members they demanded that the officer who fired the fatal shots be fired and be prosecuted for murder. abc7 news anchor eric thomas has the story. >> reporter: if friends and relatives of cher lean tindle came to the board meeting expecting action, they would leave disappointed. >> the b.a.r.t. 3w0board cannot take action today. >> reporter: but they could listen and that's what the board spent nearly two hours doing, starting with a grieving mother of the dead man. >> i loved my son. and i loved my son. just like you love your children. this has to stop. >> reporter: this body cam video shows what led to the death of her son, 28-year-old chilenchiln tindle. it shows the b.a.r.t. offer outside the west oakland b.a.r.t. statement. he skrems for them to show their hands before firing the four facial shots. b.a.r.t. released a longer version of the video yesterday. tindle's family says he was an innocent victim murdered in front of hiss girlfriend and kids. b.a.r.t.'s police chief session it shows a brave officer running towards a dangerous and confusing fight between two men, a gun on the ground and shots had already been fired. >> and anybody who's running toward gunshots to go help members of our community, i believe that is courageous. >> and rojas continues to his officer and he is back on the job two weeks after the shooting. the command staff is deciding whether the officer should be reassigned for his own safety. meanwhile the shooting itself is being investigated by oakland police and the oakland d.a. senator dianne feinstein is now calling for a hearing on her bill to ban assault weapons. what feinstein says the legislation deserves a hearing, arguing that there's no other country in the world where children are afraid they're going to be killed at school. the democrat offered the 1994 assault webs ban. congress allowed it to expire 10 years later. republicans claimed it didn't work. feinstein him out of the state senate, all because of the findings of a sexual harassment investigation. the investigation found that tony mendoza more likely than not behaved inappropriately toward six staffers. mendoza tendered his resignation lett letter. >> the bottom line is we're going to protect our staff and we're going to lead the way against workplace harassment. if we're serious about changing the culture and holding our people accountable for their conduct, we must start here, and we must start now. >> reporter: mendoza says he will move forward with a lawsuit against the senate and plans to run for the senate seat again later this year. another former google employee is suing over issues of diversity. the software developer who is transgender says he was fired over speaking out about online bullying. in the lawsuit he says he complained about harassment on the company's messaging company. it comes on the heels of another employee who was fired over a memo that criticized google for pushing mentoring programs. google says it decides on termination without regard to the employee's political views. the man trying to -- filed an appeal with the u.s. supreme court arguing the interstate costal commission violated his property rights. cosla purchased 89d feet of that coastline. cosla violated the california coastal act for blocking public access. under his ownership, the microsystems co-founder padlocked the gates to the beach cutting off access to the coast there. crews brought out cadaver dogs to search for potential victims. >> why it is incidents just like problem in the tail gearbox. as you can imagine, the sight of a bright orange helicopter in the middle of a playground, neighbors have never seen this before. the helicopter took off several hours later after mechanics located a metal chip in the gearbox. neighbors say they saw it coming, a big fire at an abandoned strip mall in hayward last night. >> it has become a magnet for the homeless especially in the cold weather. >> no one was hurt but cadaver dogs were brought in just to make sure. >> reporter: not wanting to take any chances, cadaver dogs from alameda county sheriffs combed through rubble at the california creek strip mall just to make sure they didn't miss any of the homeless. this is what it looked like wednesday night, video shot by a neighbor who lives just behind the abandoned building. >> there was a car fire here. about two months ago. >> reporter: neighbors say they complain about the mall often. >> especially with this cold winter, we have witnessed them building many fires inside the building, many of us have called the fire department countless times. >> reporter: the hayward fire department has responded to 38911 ca38 911 calls to the building since 2005, five for fires, it's a situation that the fire chief says poses a threat. it's something that keeps me up at night often times. >> reporter: this comes just a few months after the city counsel received a plan to redevelop the site. >> 35 townhouses and 39 apartments and about 2,500 square feet of commercial development. >> this is probably the second or third time that they have claimed that there's a plan for that property. >> reporter: this fire might finally mark the end for this building, we talked with the owner this afternoon, who told us, he's moving to have it demolished early next week. in hayward, laura anthony, abc7 news. one of california's largest candy maker hersheys is suing over the jolley meds because of its similar toy to jolley ranchers. the manufacturer of the candy or the products i should say, they manufacture the candy ultimately dischange the name and packaging, hersheys still wants a million dollar from harbor side. harbor side is fighting with the federal government. california is looking at cracking down on drivers driving under the influence of marijuana. the bill in the state senate calls for drivers under 21 to have their licenses suspended for up to one year. lawmakers say it will keep dangerous d d d d d d they're elderly, vulnerable and tricked out of their live savings and today one woman spoke to the u.s. justice department about the scam that hit her family hard. >> michael finney is here with just a heart breaking story. >> powerful, powerful. she told of her 82-year-old grandmother who lost all of her money to a con artist, her grandmother was so devastated by the scam, she took her own life. >> it pains me to say this but she took her life because of this incident. >> angela steincheck of houston didn't hold back her tears or anger. >> these individuals preyed on her and her good heart. >> reporter: this is her grand mother, marjorie earl jones. >> what should have been the best years in the last chapter of her life was taken from her, she was robbed in every sense. >> she says her grandmother fell prey to a sweeps stakes scam, she was told she won money but needed to pay fees and taxes, she ultimately sent all of her h savings to scammers, they took all of her money and she committed suicide. she died with $68 in her account. >> this has happened far too often in this country. >> "7 on your side" is flooded with spectaculimilar reports of stakes scams, phony tech support companies, seemingly a new scam popping up every day. sessions says more than 200 suspects have been arrested in the past year for elder fraud scheme. a sweeps stakes scheme allegedly bilked consumers out of $100 billion from a tech support scam out of india. >> these are despicable crimes, they laugh about their ability to defraud people. >> the feds cracked down in washington, d.c., a local rtailer has set out to stop these scammers in their tracks here in the bay area and it's working. i'll have that has been going all afternoon over mt. hamilton and we have had spotty returns all around the bay area, we have sprinkles all around the bay area. we are seeing some wet roadways, keep in mind, the cold nature of this storm means the higher elevations are starting to see the snow and this will continue, i want to show you one other stop here between morgan hill and san martin, over 101, it's going to be wet across your commute. and this cold storm is limited in moisture, and that's why not everyone is seeing the rain, but we are seeingfoothills, we snow down to placerville. the next few hours, look for scattered showers, gusty winds and hail and snow over the higher elevations. speaking of higher elevations is that a pretty scene or what? heavy snow coming down right now in tahoe. chain controls on all roads leading to the sierra. you can see some of those thunderstorms near amador city, if you headed up into the mountains, snow levels tonight above 2,000 feet. localized areas will get 10 inches of snow. temperatures right now is feeling like winter in the 40s and 50s, today's highs well below normal for this time of year. some of you are seeing blue skies from our east bay hills camera. and you're going what ranin? it's not widespread. a few showers, hail and snow over the hills, hour by hour we go, 6:30 tonight, we'll still see some snow showers over the hills in lake county, mt. hamilton, a few showers, and then the moisture is just pretty much moving out of here, so we will dry out as we head into the nighttime hours, the winds will continue though, 6:00 tonight, close to 40-mile-per-hour wind gusts, we have seen 40-mile-per-hour wirvnd gusts already. blustery at 7:00 p.m. that cold went at 11:00 p.m. which make feel colder. but tomorrow morning with the breeze and the cold is definitely going to be sweater weather, coat weather, jackets, scarves, mid 20s to the upper 30s tomorrow morning. bright sun, you'll need the shades, temperatures will climb
