[laughter] >> but like actually it's scary for me how similar you and i are. rachel: you and me? it's true. >> i never check my fox e-mail. wouldn't know how to set up the out-of-office reply. pete will be on the airplane, going -- rachel: he's very organized. i don't even though the fox e-mail password. it's bad. are you finally in the mood for 4th of july. we had the debate earlier. he feels like it's a little too early. but we've got the barbecue going, we were out on fox square. >> i'm getting there. rachel: you did that great walk. >> my wife says are you excited when vacation is coming up. i say not really. i don't get excited until i get over the final hurdle, the last day of work. it's not like three days before i can start getting all jazzed up for it. i get it for you guys. this is the final hurdle. rachel: this is the final hour before vacation. >> that is true. >> 4th of july is on a thursday. which is perfect. which means you basically check out wednesday afternoon, hopefully. hopefully. in a lot of cases. we've got thursday, maybe you skip out on friday, play a little hooky and you've got the weekend. not for weekend hosts but most people you're staring at a nice long weekend here. rachel: i'm not going to let the segment go without mentioning that during the wall walk where they did the whole 4th of july, the history of 4th of july, will did an impersonation of our found fathers and he said talking about july 4th he said our founding fathers said this gonna be big. [laughter] >> yeah. >> i think that's what ben franklin said to john adams, i don't know, boys, this is gonna be big. rachel: i literally wrote it down, like this is gonna be big. every now and then full texas comes out on will. >> and we've got full texas on the bash barbecue. >> we've got the barbecue coming up in a little bit. the white house denying claims that president biden will discuss the future of his re-election campaign with his family at camp david today. rachel: voters are calling for biden to drop out of the 2024 race after his disastrous debate performance. >> madeleine rivera is live with more. hey, madeleine. >> good morning, guys. the white house says the president's trip to camp david had been on their public schedule for weeks, pushing back on a report from nbc that the president is speaking to his family about next steps after the debate. nbc reporting per a source familiar with the discussions, they, referring to democrats, believe only the president in consultation with his family can decide whether to move forward or to end his campaign early. the decision makers are two people, the president and his wife. a biden campaign spokesperson maintains as we've said many times and the president said himself, he's absolutely staying in the race. that's despite public calls for the president to drop out. on the way to his first funcfundraiser in the hamptons saturday, his motorcade passed a group of people with signs that said step down for democracy, and we love you, but it's time. a plane with a streamer bi-done flew over the hamptons. a local republican donor paid for the banner, per sources. the president telling donors, i understand the concern about the debate. i didn't have a great night. a little movement, it moved us up, actually. former president trump saying this on truth social as every american saw firsthand this election is a choice between strength or weakness, competence or incompetence, peace and prosperity or war and a no war and it's a choice between a president who puts america first or a train wreck who puts america last. also new this morning, the biden campaign releasing new fund raising numbers saying they raised more than $33 million since thursday, $26 million had they say is from grass roots donations. will, pete and rachel. >> thank you, madeleine. >> you got it. >> so he's sticking in and for now it looks like everyone around him is sticking in. this despite the fact that he can only stick in for about six hours a day. [laughter] rachel: crazy. they admitted this. >> axios is reporting that according to anonymous but current biden officials from 10:00 a.m. to 4 4:00 biden is he dependably engaged within those hours. outside of that, he is like throw verbal miscues and become fatigued. rachel: do you remember when hhillary clinton was running and had the famous commercial about the 3:00 a.m. phone call. that's concerning. i read you the x post from this morning about like how long it takes to answer -- you know, for a president, takes like seven minutes or less that they have to make decisionses about, say, you nuclear situation. this -- if he's only available or mentally available during that period of time and then he has to have jello and a nap, that's a problem for america. >> no doubt. axios continued, with another an on muse official, saying internally m many see splashes f an absent minded biden, saying they usually see him engaged. they said thursday's debate shattered the white house efforts to show biden at his best, a president capable of serving to 2029 when he would be 86, i got a text from a congressman who asked me this question moments ago. if biden harris ticket is reelected how much of the second term will harris serve as president. i don't think we talk enough about the fact a -- i said what do you think? he said three yearsing probably. this is basically donald trump running against kamala harris. it's almost inconceivable that joe would be capable of finishing a second term. rachel: absolutely true. >> as a result, remember that. we know how unpopular she is. i think the white house is scared of that narrative. >> at the rate of decline, we showed videos from february -- february was a different you biden from the biden we saw from that debate. it's not going to work anymore. they can try this to continue to tell us he's a different guy behind closed doors. >> they're going to minimize treen travel. he did that big trip. they're going to minimize evening events. they're going to stick to the 10:00 to 4:00. and the convention, what are they going to do there? >> put a teleprompter in front of him. rachel: the democrat party never worried wore about the v. since the debate, the biden campaign says they've raised $27 million. since the debate so. the donors haven't fled yet. and again, you think about how they completely cut off any competition to joe biden. there was no choice for democrats. they won't let rfk debate him or be part of the primary process and they're fighting him tooth and nail. whatever you say, the republicans had a legit primary. people were able to look at all the candidates and the best one rorose to the s top. the case of joe biden, these people, obama, eric holder, they're running the show. they really believed they could keep this from the american people. i think the jig is up. >> when 70 million people or whatever the total viewing numbers saw for themselves and immediately, instinct wise, based on the split screen, it fell apart. rachel: and the clips on social media that young people are seeing. >> tomorrow's a big day, the support of the united states, they're expected to have an opinion issued tomorrow on donald trumps' immunity case stemming from the january 6th indictment from 2023. it's four federal charges related to you alleged interference in the 2020 election. trump's lawyers are arguing he can't be charged for any official acts, they're asking for blanket immunity, special council, prosecuting trump argues no one is above the law, including the president. this is going to come down to most likely the opinion's going to be issued, what is an official action, what is a personal action. they'll probably draw the distinction, suggesting he has immunity for official actions, not for personal actions. >> we had shannon breen on the program earlier. here's what he me said. >> of course it has immediate impact on president trump, the federal criminal trials he's facing. this is going to be something that outlines criminal liability potential for presidents for generations to come so i think we're going to need to take a second. when we get that opinion in the morning, to really try to digest and i think neither side is going to get everything they want. there's not going to be complete immunity, not going to be zero immunity. we can't imagine that for commanders in chief have to make really difficult life and death decisions so you've got to imagine the court's going to find some level of immunity but how far it extends and whether they say it extends to president trump's conduct, we'll see. >> yeah. another we'll see. we're less than two weeks away from trump's sentencing which will happen right before the rnc. >> i wonder how much pressure behind the scenes there might be on judge juan merchan to sentence something that p jail timtime or house arrest. rachel: that could shake up the game. >> circle the date. it's coming. it will color a lot of what we see over the next four months. rachel: we asked a lot of you what you thought about cell phones. there's a state calling to ban cell knowns classrooms which we all thought, did duh, that's a t idea. we asked some viewers what they thought. ann e-mailed and she said my child attends a school with a no cell phone poll civil as a parent, i love it. the children don't mind it. they are all equal without their phones. best thing has happened for me as a parent a is knowing that four eight hours a day they don't have a phone. >> this is in response to a law, a state law in pennsylvania that looks to outlaw cell phones in schools. there's a lot of school districts or individual schools that have made this kind of rule. >> we discussed it. it's a little surprising to us. not everybody's in on this idea. one of the things pointed out to me that parents are concerned about safety. rachel: and emergencies, school shootings or something. >> they want their kids to have access to phones but there are others who really like it. >> yeah. apparently. e-mail from suzie said the reason a lot of parents disagree he with the school ban is because they themselves are add indicted to their phones and -- addicted to their phones and can't imagine someone taking them away. kids are there to learn without distraction. >> kathy wrote whatever happened to going to the principal's office, detention or taking the phone away after trans graciouses. seems -- transgressions. seems always comes to mindless - >> i like what ann said about they're all equal without their phones. like the military, you're all equal with bad haircuts and uniforms. this gets rid of the variables that a splits kids up. one kid with a phone, one without it, who needs that when we're trying to the teach kids how to read. rachel: i think it would be great to bring in principals or teachers in schools that have banned it and they the can tell us the difference in how the kids are doing socially and acp academically without their phones. >> how do you account for emergencies. rachel: give your kid a flip phone. >> if something bad happens in the school, there's scores of adults that have phones and will call 911. it's not a -- >> ryan from pennsylvania, pushing the law in the state, looking to be the first in the country with this law and he was on "fox & friends." >> distraction in our schools is so significant, it's so striking and there's very compelling data, extremely compelling data that backs all of this up, was we as parents know to be true and that is we need to free our kids from these devices for a portion of the day for the six and-a-half hours of the school day. i fear that if we don't remove these devices, give our kids a break from these devices, we're not going to move the needle with respect student academic performance and mental health. rachel: he's that's interesting. he's not only of talking about distraction from are they going to perform better academically, he's saying mentally they actually need that break from the phone. >> i'll buy that. rachel: for their own psychological health. i believe that. >> i believe that too. i've seen it in my own life. you realize how addicted i am. sometimes you have to -- rachel: it's one of the things i'm looking forward to getting away. >> are you going to get away from it? rachel: i'm going to try. i packed a bunch of books. i'm trying to, yeah, go on a phone diet. [laughter] >> i like that. that's a good plan. good plan. rachel: all right. turning now to your headlines. the wife of murdered nypd officer john jonathan diller is demanding justice for her husband and others killed by criminals, saying the way laws are set up, they embolden criminalses because there are no consequences. diller died after a traffic stop in queens. the suspect who prosecutors say is a career criminal is due back in court in july. fdny commissioner laura cavanaugh is ripping some of her firefighters in text to new york attorney general latisha james. she texted james in march to apoll guys one day after firefighters -- apologize one day after firefighters booed her during a ceremony. she said i'm trying to find a way to say i'm sorry that doesn't involve me apologizing for men that don't deserve such grace. i'm sorry we didn't stop them and i can't fix them. imagine her being your boss. the tsa is expecting a busy travel season as we approach the 4th of july. the agency estimates they will screen 28 million people through july 8th. they say travelers are looking to extend the holiday weekend since it falls on a thursday which is what pete was talking about this year. the tsa is bracing for july 7th to be the busiest travel day of the year. and massachusetts transportation officials are hoping to put a smile on the faces of boston commuters. they added googly eyes to five of the trains after riders asked for them in a public campaign. transportation officials call it a creative solution to improve the rider experience. >> what. rachel: isn't this a town that's been overrun by illegal immigration and crime recently and the mayor's like a -- >> you improve your experience by putting googly eyes on the train. >> i'm already worried about july 7th. >> i thought of you when i heard you give an aw audible thing th. rachel: you flying back that day they. >> i'll be working on "fox & friends weekend." rachel: you're coming in on a thursday? >> he's leaving on a sunday. >> that will be going home on sunday. you're doing a drive for -- you're driving. >> yeah. >> which i like a good drive. i like a road trip. >> 15 passenger band, baby. >> what are you going to do? >> we're reading animal farm as a family. >> audio? >> no reading. i read. >> you can't drive and read. >> jen will drive at that moment. >> you'll read in the car. >> absolutely. >> that's awful. >> it's fine. we do it -- normally do it while driving, do it in the living room. >> put it on an audio book. >> rachel: you'll get the voices. >> i'm the voices, i do squealer, that polan, boxer. >> kids, gather around at my feet while we read. >> yes, it's really fun for them,. rachel: we did a long road trip and we did where the red fern grows. >> we might do that. we're watching the chosen as a family. have you seen the chosen? >> some of it. >> so good. the kids are into it. so are we. we're watching the whole thing. it's fun. >> [laughter] >> that's what we'll be doing. we've got two ipads for the chosen and animal farm and the sign game where you find a. b, c, d, e, f, g. >> that's fun for five miles. >> it's a lot of fun in the 15 panning van. rachel: you should shoot vido of that and send it to us. >> should i? rachel: of course. like a reality show. >> i sent a video yesterday. rachel: that was a workout video. they send each other workout videos. >> they don't. one did. it was over the line. [laughter] >> i asked my wife permission if i could send it. she gave me permission. rachel: he is your bromance. >> he's not the guy you send bench pressing videos to. >> it's the first workout video i've ever sent anybody. i'm ashamed of it but now i've admitted to it. rachel: you're officially a gen zer. >> the supreme court clearing the way for cities to ban homeless people from sleeping outside. but our next guest says it's too late for his city. jason brandts on the out-of-control homeless crisis in seattle, next. >> i was thinking about what you said. what can i do to make a better cotton crop? >> yes, so that's really what this is about. this issue you went back to 2018 with the ninth circle court of appeals which made the ruling, sweeping the encampment when you don't have shelter space available is cruel and unusual punishment. a lot of progressive cities declared they can't do anything about the encampments and blaming the court of appeals. it doesn't mean, because that was overturned, that all of a sudden cities are going to start to clean up. seattle is not going to change its policy. san francisco won't be changing its policy. however, the silver lining is all of the other cities and counties that have been subject to this progressive ruling, they now can move forward and clean up the encampments so they're no longer ruled by progressive ideology over homelessness policies and i think we're going to start to see that be geared up in a way that we're just not used to and i'm looking forward to it. i'm finally looking forward to the area just being cleaned up just a little bit. >> when do you think that will be? to your point, cities like seattle and san francisco, all they lost is their excuse. they can tell their unhappy voters oh, well we're not allowed to clean it up. now they've lost their excuse. that doesn't mean they're going to clean it up. you're suggesting there will be cities who are emboldened now, have the legal right to fix the encampments. >> yeah, absolutely. there have been cities or counties that are more moderate or leaning to the right in washington, oregon and california that said we would love to get more involved but the courts are stopping us from doing so. they're going to step up with enforcement. i live in a city where folks realized we've gone too far to the left. they can put political pressure on the politicians to do something and now the politician's going to have to come up with a solution or an excuse that has nothing to with the courts because they're smart enough to realize the supreme court overturned this so the mayor's office, the city councils all across western states, they're going to have to step up and say the reason why we're not going to start encampment sweeps is x, y and z and then it becomes a political issue more than a legal issue and i think most reasonable leaders understand that there is a fine line between just going out, sweeping everything and not putting anyone anywhere or offering resources. the resources will be offered even in cities and counties that are moving forward with the sweeps and i think that's an important part of it because we want to be compassionate and get them in a position where they get into shelter. the problem is, and the problem has been, you've got a bunch of people who refuse to go into shelter or take up our resources that we're offering because they know there are really no consequences and so now we're including those consequences. >> we'll be watching what they do in places like seattle and san francisco. i know you'll be on top of it in seattle. thank you so much for being with us this morning. appreciate it. >> he's the first green beret to be elected to congress. congressman michael waltz will share his independence day message, next. ♪ you didn't live this strong, this long to get put on the shelf like a porcelain doll. if you have postmenopausal osteoporosis and are at high risk for fracture, you can build new bone with evenity®. ask your doctor if you can do more than just slowing down bone loss with evenity®. want stronger bones? >> well, number one, we can't ever take independence for granted. number two, we need to take a step back and you're a student of history. all throughout world histories, kings, queens, emperors, they determined what rights you had, who you can marry, what career you can have, what piece of land you could or could not have and our founding fathers brilliantly uniquely in world history had never before been done said no, you, the people, have inalienable rights and you, the people, will determine what government can and can't do and they put it in an amazing document, the constitution that oh, by the way was allowed and had a mechanism to be approved, improved through amendments over time. it is such a unique moment in world history that never before had been done. we can't ever take it for granted. and the end of the day, i'm a huge proponent of what's called theythe enumera the ted powers,s written in the constitution what of government can and can't do. everything else is with the people. >> brilliantly said. thank you for your time. have a great fourth. >> thanks, pete. thanks for your service, brother. >> absolutely. i want to thank colonel waltz and so many other guys out there who helped me write the book, the war on warriors whichs was number one for two weeks in a row, number one right now. if you're looking for something to read this 4th of july on the beach or wherever you are, order it now, you'll have it by the fourth. a huge response from the military. they want donald trump back because of what obama and biden have done to our military. biden's he debate perform mans reportedly has top donors running for the hollywood hills. maria bartiromo on the panic in the democrat party, coming up. ♪ lord, you know what's on our hearts. you know where we struggle. you know where we need to be pushed. help us give it all to you. the good, the bad. help us turn to you in everything we do. amen. i invite you to join me in more prayer on hallow, stay prayed up did you know? , excuse my ignorance. i heard of it, i know what it does. it removes the president if he's not capable of serving but how does the process work? maria: you have to get the okay and the directive from within the administration and congress, congress has to move this forward. right now, this answer is in the hands of leadership, in the senate, nancy pelosi, the clintons, president obama, anybody who was thinking that joe bidens was not running the country and somebody else was, the obama camp is now justified in thinking, yes, that's true. so the 25th amendment works after congress says yes, we are moving forward with the 25th amendment to remove joe biden because he is incapacitated and cannot serve the office of the president. if it is agreed upon that he cannot serve the office of the president, because of capacity issues, then they have justification to say the 25th amendment is the amendment to use to remove this president from office. rachel: seems like that's the only way to g makes a lot of sense. i think a lot of american people think that's the common sense thing to do, given how dangerous the world is right now and his camp saying he only operates between 8:00 and 4:00 in a dependable way. it's insanity. maria: i have questions about that too, rachel, come on, 8:00 and 4:00. you think joe biden is engaged to the hilt from 8:00 to 4:00? i have a question with that. i i don't think that's -- rachel: even if that were true, that's not enough. maria: i'm sorry. rachel: even if that were you true, that's still bad. maria: 8:00 to 4 is still bad. i have an issue with that as well. we're talking about this morning, rachel, this bombshell congressional report that was dropped last week about the intelligence community, how abused the intelligence community has become because of politicking and what those 51 intelligence officials did by lying to the american people just weeks before the presidential election, i'm talking with devin nunes, former chairman of the intelligence committee as well as john ratcliffe, the former dni, i'll talk about that, how do you get the intelligence community back to doing what the intelligence community is supposed to do rather than poll. rachel: th -- politics. rachel: that's a great question. always the best guests, the best conversations. you heard it here, the founders knew what they were doing when they signed the declaration of independence. >> he new something big was happening, he said this is going to be big. >> they'll do this for a long time. rachel: let's celebrate with a barbecue on fox square. it's what our founding fathers who want us to do. ♪ new centrum menopause supplements help unpause life when symptoms pause it. with a multivitamin plus hot flash support.
