>> i don't believe it frankly. i think they held back from contributions. i think -- i mean, this administration and this campaign has all been about optics and all about optics so i think they knew that trump outraised him after his conviction and they wanted to send a message too and running around raising money and holding it back and i don't buy it and he gave a horrible performance and it's indicative of who he is. one of bill clinton's top advisers told me being president is a superhuman job with superhuman abilities, and president biden is not showing any kind of cognitive abilities to be super human, even vector-borne chilly and that's a real issue and look at him and contrast him to trump, who's super energized and yesterday on your show talked over an hour and was coherent and we may not like some of the stuff he says from time to time but he's on top of his game. she's not on that list. what do you make of that? >> she'll go quietly and then the other candidates they're talking about haven't been battled and and she's not run for office neil going for afar. neil: all these other appealing campaigns and going for the part. they're going to bring somebody younger and somebody vibrant and tested and and republicans going to prepare and and the democratic party to allow joe biden to continue. when you hear donald trump, you know, talking about joe biden and all that, better to have joe bide anne donovan this race if you're donald trump than any other name, or no? >> not necessarily. i think biden of all the named candidates is polling the highest. biden will be -- neil: that's like the tallest dwarf; right? >> yeah, it's a low bar. biden's people were very smart and put him on the ballot in every primary. he's got the delegates locked down. only way he leaves is if he leaves voluntarily. harris would have to go as well. neil: why would harris have to go as well? >> i don't see her sitting as vice president and letting someone who has not run for office, not fought for this position to be able to step in and head the ticket. so i think you'd have to have a total change. i don't think that's happening by the way. i think that the democrats have the canaled dates that are battle tested is wes moore, military veteran, two tours in combat and private sector experience, philanthropic experience. neil: only a year on the job. >> yes, but think about the other people they're talking about. michigan newsom cannot be donald trump. it's too late. neil: we get back to that because normally when parties are in disarray and i can remember 1980 when ted kennedy wanted to take on jimmy carter and progressive wing of the party and was furious at carter and carter survived that but the party went down to defeat. defeat i'm thinking of times when republicans experienced that and 1976 and jared ford fighting off a credible real challenge to the convention from ronald reagan. they're united but the party was still divided and went down to defeat. i'm wondering, is it like rearranging deck chairs on the titanic? will it matter? >> each of those like ted kennedy and who's persuadeable. anybody with donald trump now after all they've taken him through, they're not leaving him. they're there with him till the end. it's about who can persuade. biden has real problems with african american voters and many black entrepreneurs are saying in semi-barsable and unwin and will look at who win as race and who can persuade the other side's support base without african american voters and biden goes down. without overwhelming african american support the democrats go down. trump will compete going out hard and remember, in 1960 and richard nixon got 29% of the black vote against john kennedy and we can all agree joe biden is not john kennedy. neil: you talk to the money guys and very instrumental in helping make barack obama as president. the donor. neil: going to run the could be country. that was the game changer and trickling down stair and you happens stairs and i don't show that stuff because it's just mean and belittling but when it gets to your cognitive skills, you have to present those to the american people and show that to the american people and you are the leader of the free world. that is important. and that was a glaring issue. >> biggest issue he confronts and think about the fact that we're having this discussion and he's an elder statesman and his time has come and gone and he was not qualified neil: does the needle move? >> going to parse the allegations and jack smith's indictment and figure out which ones, which allegations are subject to whatever immunity the supreme court recognizes and which aren't and not something that could be done overnight and going to think that and going to take the parties to prepare for a trial and it's going the president's way. redeem the victory if you want to argue and push it all back. >> sure, if you look at it through that lens and in other words even a defeat if it causes a delay would be a victory then i think it is going to be a victory no matter how you slice it. look, the supreme court took this case and processed this case very quickly by supreme court standards. i know that people are saying how come it's taking that long and they did fast track this and expedited briefing and argument and at least by supreme court standards is lightning fast. neil: you know, help me with this, tom, you're a great lawyer and i'm not. i watch a lot of legal shows so i think i qualify. one thing i notice that john robert said and he tried to craft decisions and reframe this with the 5-4 vote and you do this case and parse it together and going not narrowly one way or another. >> look, you're exactly right and that i'm 100% certain is what the chief has been trying to do behind the scenes and trying to get as many votes from a opinion and he'll try to articulate a standard and the liberals and even the liberals recognize and makes sense in this context because keep in mind even a liberal justices don't want a universe and trump gets elected in november and turns around and tries to prosecute former president biden comedy the shoe would be on the other foot. neil: did you take that as a threat? >> like i said, i'm not an al alarmist and going for people with the american people and they can see it for what it is. it's quite insulting and they're not a serious concern and only a handful of them are concerned and anyone coming in and we don't know who you are and had any potential tie to any terrorist organization and going to have terrorist attacks and september 11, 2001 in new york city. that cannot happen again. our nation worked tirelessly, neil, to ensure that doesn't happen again on our u.s. soil and we spent trillions and thousands of lives military members that are been killed in the line of duty to protect our nation for what?
