>> shannon: okay. peter doocy, live at the white house. thanks, peter. we have new information tonight about the killing of a 12-year-old girl in houston. allegedly at the hands of illegal immigrants. the latest in a series of high profile crimes that appear connected to the border crisis. senior correspondent mike tobin has the details. >> just 12 years old, court documents say jocelyn nungaray was lured under a bridge in houston. her killers were with her two hours before she was strangled and dumped in a bayou. suspects 2 #-year-old franklin pena and jose martinez. and ice official says the venezuelan men crossed into the u.s. illegally at el paso. pena was apprehended in may. martinez was picked up by border patrol in march. both were released into the u.s. with a notice to appear in court and then arrested for jocelyn's murder on thursday. >> if there was ever a circumstance where do you not give someone bail, this is it. >> jocelyn snuck out of her bedroom sunday night. it's not clear how she made contacted with pena and martin yes, sir. they were tracked on surveillance video all the way to the bridge where jocelyn died. her body was found on monday. >> give her a big hug. a big hug. probably wouldn't let go. >> in queens, new york, christian inga-landi chased down by citizens. >> as he was running away we were trying to hold on to him. >> inga-landi ecuadorian caught in 2021 in eagle pass and released. if february of 2022 a judge ordered him deported. last week he raped a 13-year-old girl in new york: victorren martinez hernandez appeared in court today. he fled to the u.s. after killing a woman in el salvador. he repeatedly entered the u.s. illegally and sent back three times. the fourth time he slipped in undetected. he is now charged for the murder of rachel morin, who went out for a run last august. her body was found on a trail the following day, sexually assaulted and beaten. >> it's sickening because this could all have been prevented. >> and the new york and maryland cases the suspects are now held without bond. in houston a magistrate yet to set bond but the d.a. has requested $1 million bond for both of them. shannon? >> mike tobin, thanks for getting us up to date. ♪ >> shannon: breaking tonight, still awaiting more than a dozen opinions from the supreme court. as we enter what is scheduled to be the final week of this year's term. five opinions came together including one that some have argued a man facing numerous allegations of gun violence and who was under a domestic violence restraining order challenged a federal law banning from possessing a gun. in an 8-1 decision. the court held that it boiled down to, quote: common sense. chief justice john roberts writing for the majority, when an individual pose as clear threat of physical violence to another. the threatening individual may be disarmed. justin thomas loan descenter. second amendment right of any one subject to a protected order even if he has never been accused or convicted of a crime. it cannot. some legal experts had argued a win for the plaintiff in supreme court case might also help hunter biden to challenge his felony conviction on possession of a gun while using illegal drugs. today's decision will provide him no such avenue. the validity of some of the legal charges against january 6th defendants, including president trump. abortion, social media censorship, and much more. and while the court works to wrap up business next week, another headline making case has just landed with the justices. an emergency appeal by steve bannon who is asking the court to allow him to remain free on bail while his appeals process plays out. the court has asked the government to respond to his filing by next wednesday, which is also the next day the supreme court has scheduled for releasing opinions in all of those pending cases. former president trump is challenging allegations he illegally stored classified documents at his florida estate. this time the presumptive republican presidential nominee argues the special counsel in the case was illegally appointed. national correspondent jeff paul reports tonight from fort piers, florida. >> former president donald trump's lawyers walking into federal court on friday starting what will be three days of pre-trial hearings in trump's classified documents case. overseeing the day's arguments centered around the appointment of special counsel jack smith. trump's defense says doj regulations don't actually allow attorney general merrick garland tao point a special counsel, therefore smith's appointment is unconstitutional and the case should be thrown out. special counsel smith's team told judge cannon their argument simply doesn't hold water this judge is allowing hearings where a lot of judges have rejected on the papers. i think it's a credit to the judicial system. >> former u.s. attorney for the southern district of florida kendall coffee says with a case this important and a former president facing 40 felony counts, more time is deserved for pre-trial irches the motion by trump's legal team is seen by analyst as a long shot as several courts previously have rejected near identical challenges. judge cannon was appointed by trump in 2020. her critic no, sir now accuse her of trying to stall the trial ahead of november's election. >> it's not at all a frifless argument, i think the wrap on judge cannon is just ridiculous. this is a classified information case they are very hard to get to trial. >> after several hours of argue. s from both sides, it's important to point out that judge aileen cannon did press prosecutors about what role attorney general merrick garland had in the indictment of former president trump. prosecutors declined to comment. meanwhile, no decision in this latest hearing. we are expecting a written order to be release in the coming days, shannon? u.s. navy told us it has taken 9,000 samples to epa approved labs and found the water now meets state and federal standards adding the hawaii department of health also confirmed no petroleum or jet this debate. immigration and inflation are the otop two issues in the country. the more you talk about inflation or don't talk about it, the more people are going to go experience every day in every ownership and the fact that they think they are never going to get there. the "wall street journal" has this headline home prices hit a record high and this comes at the same timed that the president has proclaimed national home ownership month saying this. owning a home is about mort than putting a roof over your family's head. it is a part of the american dream. my administration is delivering on the most consequential housing plan in more than 50 years lowering costs now and for the future. kimberley sound like the data does not support that. >> no one can afford that dream. this ought to be one of the big things that trump brings up in the debate housing problem where sellers don't want to sell because they are worried they won't be able to buy another house because of mortgage rates. people are getting priced out of the market. this did not happen out of thin a air, it is a consequence of democratic overspending, which sent inflation soaring and then the fed had to raise rates to deal with it. we always talk about the american dream. home ownership, that is something that this administration has actually put out of reach of millions of americans. >> carley: olivia we got the numbers from the nonpartisan group crunches the numbers it gets from the hill and from the white house that has a very dire prediction about where we are headed with regards to debt and deficit. that is going to impact everyone's future. certainly young people have to be looking to that, too. >> certainly, i mean, i think across different elections, not just this e, have you seen the economy be huge, because the old sort of political adage is people vote how their pockets feel. and even in some of these swing district states, i remember one a couple of months ago about arizona, immigration and the economy were top issues and i think that that's why biden has been trying to really sell his ability to improve the economy. and he has seen a slight uptick. he needs that to keep going. it needs to become a pattern like we have seen with some of the other polls with him, you know, sort of lagging behind. he needs to change that around before november. >> shannon: let me put up our new polling on issues. who do you trust to do a better job in when it comes to the top two issues, immigration and economy. voters give the edge to president trump. now, here's something that president trump said interestingly when it issue of immigration and dealing with the border came up. that i want to do and will do if you graduate from college you should get a green card to be able to stay in this country. and that includes junior colleges, too. >> shannon: kimberley, what do you make of that that for some folks is not going to line up with other things he said about immigration. i don't know if he means people here legally on a student visa or that's a pathway to keep people here educated. i would assume the former president thinks will contribute to american society. >> yeah. this was a really interesting signal from the president. i was fascinated to hear him say. because, mostly we only hear about trump and his want to close the border. there has been a long discussion for many years and congress about reorienting our immigration system around one where we don't have chain migration, where we are, in fact, trying to get. so best people in the most innovative people in workers in our economy. i think this is a recognition by the president that our economy does need some migrant and immigration workers to keep it going. we have to be smart about how we do it. so, if that signals a kind of policy going forward where he worked with congress to try to change some of that, that's interesting news. >> shannon: yeah, listen, this issue of immigration and the border consistently president biden has gotten lower marks on that than president trump. and every day now it seems we are covering another story tragic disgusting, devastating stories about people who have been raped. who have been killed. who have been injured by people in country illegally. in one case, this 12-year-old girl from houston, jocelyn thank nungarr are a. people came across our border illegally because of some of the polls. this adds a sense of urgency for him. he did an executive order to change asylum rules on the border which we have seen since march. the polls indicate is he up a couple points. he is still lagging, i think 63% disapprove of how he has handled the border. and that's where donald trump seems to be getting a lot more credit. that's going to be something that donald trump hits him on heading into the debate. >> shannon: one of these cases rachel morin mother of five sound sexually assaulted by somebody killed who is in this country illegally. allegations is he responsible for this crime. her sister said today on fox the biden administration has the blood of rachel morin on his hands. that's a very striking statement to make. >> it is. and there are going to be a lot of people that make that kind of statement. it's unfortunate that we have now some of these cases of violent crime committed by people who came across the southern border, or who had been previously arrested and were in the country without permission here illegally. white noise. terrible, terrible tragedy. it's, again, like inflation in the water for this debate. and they have to talk about the threat that comes, even if you let in 9 million great people. the 1 million not so great people present. connected to isis that the fbi arrested last week. most people think we have a ticking time bomb in country. >> that includes the director of our fbi. it is time for winners and losers. olivia would you start us off? >> my media is social media influencers granted access along with reporters going to the dnc in chicago in august. and my loser is the oakland mayor cheng tao who faced a federal raid of her home thursday morning. we really don't know the nature of what the raid was, but she is already having a tough time with a recall challenge where she is from. >> shannon: all right, hume. who have you got on the list this week. >> winner is the cleveland guardians left fielder steve kwan batting 397 going into tonight's game. he briefly touched 400. is he a couple bats shy of being the batting leader. the last person to bat 400 is ted williams. they call him >> shannon: okay. peter doocy, live at the white house. thanks, peter. we have new information tonight about the killing of a 12-year-old girl in houston. allegedly at the hands of illegal immigrants. the latest in a series of high profile crimes that appear connected to the border crisis. senior correspondent mike tobin has the details. >> just 12 years old, court documents say jocelyn nungaray was lured under a bridge in houston. her killers were with her two hours before she was strangled and dumped in a bayou. suspects 2 #-year-old franklin pena and jose martinez. and ice official says the venezuelan men crossed into the u.s. illegally at el paso. pena was apprehended in may. martinez was picked up by border patrol in march. both were released into the u.s. with a notice to appear in court and then arrested for jocelyn's murder on thursday. >> if there was ever a circumstance where do you not give someone bail, this is it. >> jocelyn snuck out of her bedroom sunday night. it's not clear how she made contacted with pena and martin yes, sir. they were tracked on surveillance video all the way to the bridge where jocelyn died. her body was found on monday. >> give her a big hug. a big hug. probably wouldn't let go. >> in queens, new york, christian inga-landi chased down by citizens. >> as he was running away we were trying to hold on to him. >> inga-landi ecuadorian caught in 2021 in eagle pass and released. if february of 2022 a judge ordered him deported. last week he raped a 13-year-old girl in new york: victorren martinez hernandez appeared in court today. he fled to the u.s. after killing a woman in el salvador. he repeatedly entered the u.s. illegally and sent back three times. the fourth time he slipped in undetected. he is now charged for the murder of rachel morin, who went out for a run last august. her body was found on a trail the following day, sexually assaulted and beaten. >> it's sickening because this could all have been prevented. >> and the new york and maryland cases the suspects are now held without bond. in houston a magistrate yet to set bond but the d.a. has requested $1 million bond for both of them. shannon? >> mike tobin, thanks for getting us up to date. ♪ >> shannon: breaking tonight, still awaiting more than a dozen opinions from the supreme court. as we enter what is scheduled to be the final week of this year's term. five opinions came together including one that some have argued a man facing numerous allegations of gun violence and who was under a domestic violence restraining order challenged a federal law banning from possessing a gun. in an 8-1 decision. the court held that it boiled down to, quote: common sense. chief justice john roberts writing for the majority, when an individual pose as clear threat of physical violence to another. the threatening individual may be disarmed. justin thomas loan descenter. second amendment right of any one subject to a protected order even if he has never been accused or convicted of a crime. it cannot. some legal experts had argued a win for the plaintiff in supreme court case might also help hunter biden to challenge his felony conviction on possession of a gun while using illegal drugs. today's decision will provide him no such avenue. the validity of some of the legal charges against january 6th defendants, including president trump. abortion, social media censorship, and much more. and while the court works to wrap up business next week, another headline making case has just landed with the justices. an emergency appeal by steve bannon who is asking the court to allow him to remain free on bail while his appeals process plays out. the court has asked the government to respond to his filing by next wednesday, which is also the next day the supreme court has scheduled for releasing opinions in all of those pending cases. former president trump is challenging allegations he illegally stored classified documents at his florida estate. this time the presumptive republican presidential nominee argues the special counsel in the case was illegally appointed. national correspondent jeff paul reports tonight from fort piers, florida. >> former president donald trump's lawyers walking into federal court on friday starting what will be three days of pre-trial hearings in trump's classified documents case. overseeing the day's arguments centered around the appointment of special counsel jack smith. trump's defense says doj regulations don't actually allow attorney general merrick garland tao point a special counsel, therefore smith's appointment is unconstitutional and the case should be thrown out. special counsel smith's team told judge cannon their argument simply doesn't hold water this judge is allowing hearings where a lot of judges have rejected on the papers. i think it's a credit to the judicial system. >> former u.s. attorney for the southern district of florida kendall coffee says with a case this important and a former president facing 40 felony counts, more time is deserved for pre-trial irches the motion by trump's legal team is seen by analyst as a long shot as several courts previously have rejected near identical challenges. judge cannon was appointed by trump in 2020. her critic no, sir now accuse her of trying to stall the trial ahead of november's election. >> it's not at all a frifless argument, i think the wrap on judge cannon is just ridiculous. this is a classified information case they are very hard to get to trial. >> after several hours of argue. s from both sides, it's important to point out that judge aileen cannon did press prosecutors about what role attorney general merrick garland had in the indictment of former president trump. prosecutors declined to comment. meanwhile, no decision in this latest hearing. we are expecting a written order to be release in the coming days, shannon? u.s. navy told us it has taken 9,000 samples to epa approved labs and found the water now meets state and federal standards adding the hawaii department of health also confirmed no petroleum or jet ownership and the fact that they think they are never going to get there. the "wall street journal" has this headline home prices hit a record high and this comes at the same timed that the president has proclaimed national home ownership month saying this. owning a home is about mort than putting a roof over your family's head. it is a part of the american dream. my administration is delivering on the most consequential housing plan in more than 50 years lowering costs now and for the future. kimberley sound like the data does not support that. >> no one can afford that dream. this ought to be one of the big things that trump brings up in the debate housing problem where sellers don't want to sell because they are worried they won't be able to buy another house because of mortgage rates. people are getting priced out of the market. this did not happen out of thin a air, it is a consequence of democratic overspending, which sent inflation soaring and then the fed had to raise rates to deal with it. we always talk about the american dream. home ownership, that is something that this administration has actually put out of reach of millions of americans. >> carley: olivia we got the numbers from the nonpartisan group crunches the numbers it gets from the hill and from the white house that has a very dire prediction about where we are headed with regards to debt and deficit. that is going to impact everyone's future. certainly young people have to be looking to that, too. >> certainly, i mean, i think across different elections, not just this e, have you seen the economy be huge, because the old sort of political adage is people vote how their pockets feel. and even in some of these swing district states, i remember one a couple of months ago about arizona, immigration and the economy were top issues and i think that that's why biden has been trying to really sell his ability to improve the economy. and he has seen a slight uptick. he needs that to keep going. it needs to become a pattern like we have seen with some of the other polls with him, you know, sort of lagging behind. he needs to change that around before november. >> shannon: let me put up our new polling on issues. who do you trust to do a better job in when it comes to the top two issues, immigration and economy. voters give the edge to president trump. now, here's something that president trump said interestingly when it issue of immigration and dealing with the border came up. that i want to do and will do if you graduate from college you should get a green card to be able to stay in this country. and that includes junior colleges, too. >> shannon: kimberley, what do you make of that that for some folks is not going to line up with other things he said about immigration. i don't know if he means people here legally on a student visa or that's a pathway to keep people here educated. i would assume the former president thinks will contribute to american society. >> yeah. this was a really interesting signal from the president. i was fascinated to hear him say. because, mostly we only hear about trump and his want to close the border. there has been a long discussion for many years and congress about reorienting our immigration system around one where we don't have chain migration, where we are, in fact, trying to get. so best people in the most innovative people in workers in our economy. i think this is a recognition by the president that our economy does need some migrant and immigration workers to keep it going. we have to be smart about how we do it. so, if that signals a kind of policy going forward where he worked with congress to try to change some of that, that's interesting news. >> shannon: yeah, listen, this issue of immigration and the border consistently president biden has gotten lower marks on that than president trump. and every day now it seems we are covering another story tragic disgusting, devastating stories about people who have been raped. who have been killed. who have been injured by people in country illegally. in one case, this 12-year-old girl from houston, jocelyn thank nungarr are a. people came across our border illegally because of some of the polls. this adds a sense of urgency for him. he did an executive order to change asylum rules on the border which we have seen since march. the polls indicate is he up a couple points. he is still lagging, i think 63% disapprove of how he has handled the border. and that's where donald trump seems to be getting a lot more credit. that's going to be something that donald trump hits him on heading into the debate. >> shannon: one of these cases rachel morin mother of five sound sexually assaulted by somebody killed who is in this country illegally. allegations is he responsible for this crime. her sister said today on fox the biden administration has the blood of rachel morin on his hands. that's a very striking statement to make. >> it is. and there are going to be a lot of people that make that kind of statement. it's unfortunate that we have now some of these cases of violent crime committed by people who came across the southern border, or who had been previously arrested and were in the country without permission here illegally. white noise. terrible, terrible tragedy. it's, again, like inflation in the water for this debate. and they have to talk about the threat that comes, even if you let in 9 million great people. the 1 million not so great people present. connected to isis that the fbi arrested last week. most people think we have a ticking time bomb in country. >> that includes the director of our fbi. it is time for winners and losers. olivia would you start us off? >> my media is social media influencers granted access along with reporters going to the dnc in chicago in august. and my loser is the oakland mayor cheng tao who faced a federal raid of her home thursday morning. we really don't know the nature of what the raid was, but she is already having a tough time with a recall challenge where she is from. >> shannon: all right, hume. who have you got on the list this week. >> winner is the cleveland guardians
