the story. another young life brutally cut short in america once again investigators say the suspects are men who crossed the border into the us illegally. 12-year-old jocelyn found dead in a creek in houston friday pick the feds tell fox to make venezuela man charged in her murder were arrested then released by border patrol in the last few months. feds confirming the suspect in the rape and murder of rachel morin 37-year-old mother of 5 in maryland made it into the country as a so-called got away. after border patrol and tried to send him back to mexico 3 separate times. here's also this. the suspect in the rape of a 13-year-old girl in new york city arrested and released after crossing the border illegally. a judge ordered him deported more than 2 years ago. obviously he never was. we have marc thiessen and richard fowler standing by who will join us next. but first we'll go to senior correspondent mike tobin reporting live from chicago this afternoon. hi mike. >> with the release of mugshots we have marked setting details about the sad and brutal death of 12-year-old jocelyn from houston. court documents state jocelyn was lured under a bridge by the suspects into this case. tied up. her pants removed and the suspects with her for over 2 hours ultimately she was strangled. her body dumped in the bayou. police say 1 of the suspects is 26-year-old frank and peña and ice sources he's a venezuelan croston to us at el paso illegally. he was picked up by border patrol in may released with a notice to appear in court at a later date. he ceasing a charge of capital murder. the other suspect 22-year-old johann jose martinez croston to el paso also illegally. he was picked up in march also released with a notice to appear he's now facing a capital murder charge. >> we want justice system to do it's job. if there's ever a circumstance where you do not give someone bail this is it. >> sunday night jocelyn snuck out of her bedroom. it's not clear how she made contact with martinez but they were tracked bridge surveillance cameras say jocelyn was killed. her body was found in a creek off the bayou. last and johnson's mother saw her was when she sent her don't do enough in the city. because we are in the selection phase quick to point to this person's fault and that person's help but there's lack of courage in the city overall when it comes to getting he has something hangover trump ignored his business. he can impose sentence on july 11th and take into account anything including a few things trump engages in threatening behavior's what's the point of a gag order now? >> gillian: interesting question or point. he raised my mind would you're speaking. it seems that's the main purpose of the gag order at least in this case is have some kind of leverage over the defendant former president. the court insists all along it's really been about the safety of the jurists, the safety of the jurors sitting there. is that a reason to keep that in place now, or even that sort of-- >> it through the not because the jury is not sitting any longer and what's effectively happening is bragg is treating trump as if he's convicted him of either threatening participants, obstructing justice inciting violence when he hasn't got proof of that. if you've got proof of that he should indict trump for that but in the meantime judge merchan couldn't possibly have more leverage over trump and he has just by virtue of the fact he's going to sentence him on what he's been convicted for. >> i want to make sure that we ask you about quickly the supreme court obviously did not rule on overall immunity for trump against rymal prosecution today. what you read if anything into the fact that they haven't made a decision on this yet? >> we know the selection will be decided by 7, 8, 9, 10 states across the country. we know those are the purple states battleground states and we know it's going to come down to handfuls of voters in every so go 1 of these states. what we have seen consistently over the course of this year's president trump is leading in every so go battleground paul. he's starting to get up to the point where states like virginia and minnesota and new hampshire are in play and is leading on every single issue. this election will come down to a question of strength versus weakness and what we saw during president trump's 4 years was a record of success, strength. we have seen during joe biden's 4 years as a record of weakness and failure in the american voters are going to go vote based on whether they are better off today than they were 4 years ago and there's not a single nitric president biden can show where america's better off than they were 4 years ago. >> gillian: what is the campaign doing now to try to dissuade more independent voters? from turning towards president biden? >> we are reaching out to every american family. we are reaching out to every american voter and we are looking at the records. we actually have for the first time in a very, very long time 2 former presidents or current president and former president both with track record and we can look at the economy under president trump. we can look at the southern border was the most secure that it's ever been under president trump. we can look at her standing across the world and it was a position of strength under president trump. none of that is true under joe biden. so when we have these conversations with independent voters we are really going back to them and saying are you and your family better off than you were 4 years ago? >> what's the biggest goal for the former president trump in the upcoming debate. >> we need to have a conversation about 4 years under his tenure, 4 years we have seen under joe biden and why america will be better off when president trump goes back to the white house. this is not simply about whether or not joe biden can stand up for 90 minutes straight. it's about a conversation about a vision for america. it really comes back to strength versus weakness and we think president trump is going to use this as an opportunity to lay out his vision for the next 4 years which is really going to influence the direction that america's going to go in for decades to come. >> with the president's focus like the former presidents focus like going into these final days? we know he will be out of campaign trail hosting rally right after or in the same day as the debate. how much time is he carving out to prep? >> he spending as much damage she needs to to feel very come to both these issues. this debate is going to be a conversation with the american people. he's been having conversations with the american people for the last year. ever since he decided to run for president again. he's been directly can indicate with american families all across the country. he's been doing it in new york. he's been doing it in battleground states. has been raising money. the guy has been absolutely working every single day to fight for the american people. that's not going to change. we are very excited about the opportunity to be on the stage with president trump and joe biden and let the american people see the difference between these 2 men and their visions for america spee. >> gillian: michael whatley we wish the best of luck. things were taking some of your precious time in this countdown to the big night. we appreciate it. >> thank you gillian. also with us is media buzz host howard kurtz right here live in person in washington. first let me get your reaction to it michael whatley just said. all eyes were on the big debate coming up. he said this is about strength versus weakness and there's basically no better form to highlight that then debate. >> the debate could be game changer could be a bust. 70 donald trump is starting to see joe biden as a pretty good debater after months of you can barely string 2 sentences together but there's no question joe biden has gained a little ground. that maybe because of uptake and how the economy is perceived and may be because he's close the border to asylum-seekers and maybe because of donald trump's criminal conviction although that's brought him lots of money. you mentioned margin of error and this 50 to 48 lead joe biden has over trump and the fox paul. those are national numbers so i don't think there 8, 910 battleground states. at the michigan pennsylvania and wisconsin catka thousand people in the states and the rest of us can take a nap. but also margin of error means they could be tied. trump actually maybe slightly ahead so this is not a political earthquake. it's a bit of a tremor. >> there's people in both sides panicking now but the structure attention coming from james carville the other day speaking without hunt yesterday. take a listen. >> the president needs to give a speech and in 15 minutes don't kid yourself. they knew exactly. tell us what negative took sexually -- to accentuate. and you could have kind of enforcement mechanism but what is hopefully we get the senate debate and there's a coherent line of attack coming out biden against trump. so we can all pick it up. i don't ought to do that. it's pretty wild coming from former data -- democrat strategists saying the president should try to get the media to rig the election along. >> i don't think that's our job and i understand where they're coming from. president biden has gotten a lot more aggressive going after donald trump but 2,000 people in america don't know what they think about both of these president threats. that's why i'm a little skeptical by how much of a game changer the debate might be. the main thing about this fox paul is it's an exhale moment for a lot of pro-biden media people as well as political people who have seen joe biden be behind for so long. no psychologically they'll say he might might catch up and win. they can cancel therapy appointments. but by and large this is a very tight race. i pay more attention to the battleground state polls but gives us something to chew on until next week's cnn debate. >> alyce jordan said all biden really needs to do is not have a senior moment and he will win this thing. there's something to be said for that. we have to leave it there. thanks so much. >> be cogent and don't walk into the curtains. >> gillian: it could be fatal. thanks for being with us. the cnn presidential debate 6 days away. be sure to tune into fox news democracy 24 special coverage of the simulcast. coverage begins thursday june 27th at 8:00 pm eastern right here on fox news. former president trump have a shot at flipping traditionally blue territory? [ cheering and applause ] >> gillian: welcome back. former president trump trailing president biden by just 8 points in deeply new york. it's been 4 decades since republican ronald reagan won. very notable trump is leading biden in new york by 17 points among independents. let's ring in clay travis and former deputy assistant secretary of state for strategic communications for hillary clinton. thanks for being here. let's start with new york. the former president's closing the money gap with president biden raising tens of millions of dollars since the conviction. he remember the opening of support. people in new york presumably at least some new yorkers going to trump tower to support him the day after the verdict or in the afternoon, the same day the verdict came out. pretty remarkable. >> if trump loses new york by h., if that poll is accurate trump is going to be the winner in 2024 and we will not even have to stay up very late into the night to know. because trump lost new york by 23 points in 2020. just based on being down 8 that would put into play virginia. it would put into play new jersey. it will put into play new mexico. it would put into play minnesota. i think you will win nevada no matter what. but it would mean he would win pennsylvania that he would win michigan and wisconsin. and i bet even philip who doesn't agree with me very much, i bet he would agree if trump loses new york by 8 points joe biden will lose the election. may agree on that right off the top, in the spirit of good faith and the weekend rolling in? >> gillian: i'm betting you will say no. >> i will agree to that. no i would agree to that if pack hold on. hold on. donald trump held the lead in florida by 15 points then 9 and now 6. and we agree of donald trump only wins florida by 6 that he's got a big problem. if we mutually agree if it's a bipartisan mutual agreement i will take that agreement. i think that is a fear. >> that's a good argument by philip. here's the challenge. trump i believe only won florida by 3 in 2020. if you wins by 6 in florida tech and to be fair i think you'll win by more than that, he would still be doubling the amount he won and state of florida by. if trump only wins florida by 3 then i think we can say uh-oh trump may have issues in the state of florida. if he loses new york by 8 that would mean he's improved. i'm not great at math. i went to tennessee public school. i believe that would mean he's improving in new york by 15 points. if he improves by 15 points in new york attack he is not losing pennsylvania can wisconsin or michigan and he's likely even going to add minnesota to his bn record book their, so i think again these numbers when you look at virginia dead even in the fox news polecat when you look at minnesota there is a poll that had him up 1, biden is playing defense. trump is advancing. i don't think north your line is in play. the only route right now 4.5 months out his big ten superiority that would put joe biden back the white house. >> gillian: trump did win florida by just over 3 points, a weak spot. ivy league spot for clay too bad a weak spot for president biden is his lead is now shrinking definitively among black and latino voters. take a look at these 2. cnn poll just conducted has joe biden leading among black america, excuse me black new york state voters by 20 points. 2020 fox water analysis had biden up by 86 points. likewise among latino new yorkers. we have a see in opal now with joe biden leading 28 points. last time around 2020 leading by 49 points. what's he going to do to overcome this? >> i think saber rattling is exactly the right way to describe what we are hearing from vladimir putin. he's not going to nuke london. he will not nuke the united states. what he's trying to do is posture and bluff. that's the way strongmen behave. we seen this time and time the hand again from russia throughout the war in ukraine. this is about ukraine joining nato. then sweden and finland joined nato and its crickets from the kremlin. if you let ukrainians carry out strikes on russian sovereign territory this will be a game changer. that's happening again its crickets. putin is bluffing. we need to take seriously an alarming trend. putin has suspended participation in arms-control treaties that currently cap the number of deployable warheads at 1500 give or take. united states and we sign a treaty we follow it. the russians all bets are off. the chinese threat needs to be taken very, very seriously. in 10 years they will have the same nuclear capabilities we have right now and we have never faced a situation where we have needed to use our nuclear arsenal to deter not 1 but 2 adversaries. >> gillian: anything the biden administration can do, in let's say just through january 21st of next year, anything they can do in months to try and bring the russians back in line or not really? >> we need to take a page from the ronald reagan playbook. we've seen this player before. the 1980s russians dramatically ramping up nuclear keep abilities and reagan's response was if you're going to put intermediate range missiles that can hit us and our friends in europe we will do the exact same thing. that pressured applying american capabilities was more than just words, more than just threats. it was an actual piece of capability on the chessboard. that's how the russians respond. we have to do the same thing. time is short. on a couple of month before the election but maybe joe biden can take a page from jimmy carter playbook. we know about ronald reagan defense buildup. jimmy started that a couple months before voters showed him the door. hope we will see a similar thing happened the next couple months. >> gillian: want to ask you but i ran. reports this week they have acquired some kind of computer program that can help them accelerate development of nuclear weapons using ai. also reports verified by the iaea that they are dramatically expanding their nuclear facility it's buried in a mountain somewhere and highly secretive but they did sort of i guess report a they would undertake this expansion. now we have intelligence that shows they are moving forward. >> it's very concerning. where we have seen over the past 3 and a half years as a rush to the bomb from iran. they have dramatically and ramped up enrichment of uranium. there at the point that they are within striking distance on nuclear breakout if they make a decision. have they made that decision?
