house speaker kevin mccarthy and kayleigh mcenany join us soon. jakeee is here. >> the president has yet to speak to reporters since his son's conviction. the way the schedule is set up in italy the only time guaranteed to hear from him is at a press conference tomorrow alongside president zelenskyy and that format only obligates him to answer two questions. but with zelenskyy by his side and so much of the agenda on ukraine issues, it is possible that personal and domestic problems get less attention than foreign policy, a big goal at the g7 is finding ways to continue ukraine aid after protracted battle to get the last round of u.s. funding and the possibility of a trump 2024 win and conservative parties in europe gaining seats over the weekend. one option under consideration is tapping $3 hundred billion in frozen russian assets. divisions among the countries how to do this. biden has been pushing to use the funds themselves as well as the interest. european allies want to use interest only. the pope is also going to be here for a discussion on the threats posed by artificial intelligence and china might get criticism for propping up russia's war machine and a discussion around developmental challenges in africa. biden may not be announcing any progress on the gaza cease-fire proposal. secretary of state antony blinken said today that hamas requested more changes to the proposal this morning. >> it's time for the haggling to stop and the cease-fire to start. as simple as that. look, israel accepted the proposal as it was and as it is. hamas didn't. so i think it's pretty clear what needs to happen. >> the war in gaza is a growing challenge for president biden. during his gun safety remarks yesterday a protestor interrupted him and called him strategy. see what you think about it. inside the campaign, aides believe biden walks on the stage with the upper hand. mostly his mandate will be to let trump be trump which they believe will reveal extreme leanings and the less stable trump than four years ago. what do you think of that strategy >> the debate team. reporting they may be hunkering down in camp david. i think they're off. if they expect to show up against an undisciplined trump they haven't watched the last month and a half. they expect to show up and see a trump that attacks them over hunter biden, in a very personal way. i think they are miscalculating. maybe they need to "the new york times." those in trump world have said trump has said in meetings there is a risk overreaching on hunter. it is not worth attacking hunter. a trump who is disciplined and smart and go prepared for that trump. the trump 1.0 debate, you will meet the trump 2.0 debate. >> bill: the former president goes to your old stomping grounds. what is happening here? >> i think this is good. culminating everybody together. the strength of president trump. i was with him monday in palm beach and agree with kaylee. he is disciplined and much different than he was before. just walking onto the stage by biden will be difficult for him. just the sheer -- >> dana: they will be seated, though. that was one of the concessions the biden people asked for. >> he is also speaking to a business round table. how different today than it was four years ago. if you look at the sheer political numbers, four years ago he was down by eight points. biden's numbers are the lowest it has ever been for a president running for re-election. it has flipped plus eight for president trump where he is going into. the business round table. these are people who maybe supported him and opposed him. they are united. he had a successful swing through california. i have friends who never gave to him before who were afraid they would get attacked. they are not only providing money and showing up and proudly behind him. >> bill: policies or conviction. >> the conviction was the straw that broke the camel's back. you can come after me. this is unbelievable what you are doing. it is really the attack on democracy what they are seeing. even the polling show it. npr poll independents, who would be a greater threat to democracy by 53/42 they picked biden four more years with him. >> dana: that's the biden's team whole thing is democracy is under threat if trump wins. >> a threat to democracy people think of a threat to them personally as well. in order to own a home in the country you need to be $43,000 richer and need to have an income of $1 hundred thousand. at a time when the median income is north of 50,000. threat to democracy, the broad themes that are talked about in the media, none of that combats people's personal economy. for all the convictions and convicted felon language it comes back to basic. it's the economy, stupid. that adage hold true. >> bill: nevada, here are some of the voters and what they care about in this election so far. >> immigration situation. the open border and the people coming in, the 30 year background in law enforcement i'm waiting for the next great disaster to happen in the country. >> we need more affordable housing. >> more opportunity for places that are quite livable and you can raise a family. >> i'm worried about climate change is my number one issue, for my kids and nine grandkids. >> illegal immigration. not legal immigration. i understand legal immigration. but illegal doesn't seem -- it is not fair for all the immigrants who have come in legally. >> bill: interesting to hear from the voters here. senate primary turned out for republican sam brown was an easy winner going up against jackie rosen. republicans feel good about this seat. look at the national polling between trump and biden and nevada and trump has an edge and so much of the polling. sometimes he hits 50%, good news for brown. another one here in south carolina, the district that runs the coast down around charleston, nancy mays turned out to be an easy winner, challenged by who other republicans. she will go on to the general election come november as well. i'm sure kevin mccarthy may have a thought on that. this is a bit of surprise. a district in ohio that runs along the ohio river along the west virginia border. the republican bill johnson had the seat forever. he left to be the president of youngstown state university. johnson won this district by 35 points. trump won the district by 29. but in this special election yesterday, you got michael ruhle beating the democrat by nine points. i don't know what that means. turnout was anemic. you had 55, 60,000 votes total in that special election. nonetheless they'll go at it come november. so to you, guys, we say you draw anything from that? >> well, the ohio race is another vote for republicans. he will be sworn in so it is another one going forward. low turnout. in south carolina trump has not lost except one endorsement. endorsement is more powerful after the conviction. i found that it is even stronger. >> dana: it helps for sam brown in nevada when he got that. >> that was only a few days out. give credit to senator danes. he has done a marvelous job getting involved in primaries and getting the best candidates forward. this is how we took the majority in the house. >> dana: we hope to have him on the show tomorrow. nevada is a state republicans haven't won since 2004. >> you see trump competitive in the polling. that could have down ballots attack and unseat jackie rosen. ohio 6th district the republican won, but democrats are saying this should set off alarm bells for republicans. democrats consistently overperform in the polls and seen that in several of the last elections. for all shouting red wave another reminder polling isn't always accurate and ohio six should have republicans study harder what is going on there. >> bill: trump is not on the ballot. he was an easy winner in 2016 and 2020 in ohio. >> it's a special election. 60,000 votes. 280,000 in 2022. >> bill: see you on "outnumbered" at noon. merrick garland speaking now. let's drop in on that. okay. now we're going to the house republicans. so everybody is talking in d.c. here is steve scalise. >> for months and months merrick garland knows what the rules are. he issues subpoenas himself and doesn't let the person he is issuing the subpoena to decide whether they want to comply. he doesn't think this is something he has to comply with. with all due respect, mr. garland, this is not your decision. congress has a constitutional duty to perform oversight, which is what we're doing. we're in the middle of an impeachment inquiry voted on by the house already and now we need to get the facts. you look at the white house themselves. they have acknowledged that as they've turned over the transcripts, those transcripts have been edited. there is one way you can find out what the edits were, to actually get the audio tape. that's the only way we'll know what was really said. we know already by the white house's own admission that the transcript does not reflect what was said. it is only the audio that does, which is why we need to get the audio tape and clearly there is no executive privilege otherwise they wouldn't have turned over the transcript in the first place. but they've done it. but they've also acknowledged they've edited the document they turned over to us. now we get to get the audio and why we're moving forward. we're also taking up the ndaa. really important that we send a message to our men and women in uniform that we'll give them all the tools necessary not only to keep our country safe but to make sure that they and their families have the things that they need so they don't have to be on food stamps, for example, to increase their base pay for the entry level men and women in uniform and all the branches of the military to make sure that we're focused properly on china and threats posed around the world. the world is a more dangerous place than it's ever been. we saw that this morning with the arrest of eight isis fighters here in the united states. >> bill: they want this audio recording. i don't know if they'll get it next? >> good morning to you, bill. you are watching speaker johnson and leadership talk about why they want the vote to happen. speaker johnson came out of the gop conference meeting and told fox he has the votes to push this through today. but some are wondering if it's just a bluff from leadership. as of 30 minutes ago my sources were telling me there is at least four names, i have four names of republicans still undecided and fox digital has the names of two more. that's six total undecided. we're talking about a very slim margin here for error. i can tell you there are some moderate republicans from biden districts that are ready to play ball. they believe that they should hold garland in contempt. garland has been arguing there is no legislative purpose for handing over the tapes. if he hands it over future witnesses could be politically sensitive investigations may shy away from cooperating. democrats are saying the republicans here are being hypocrites. >> it's kind of an amazing thing we would think about holding the attorney general of the united states in contempt for not giving the audio version when we have all these people walking around never given any testimony at all in answer to subpoenas. >> so again we shall see as soon as they take this vote if they have enough republicans, they have to take this vote before 5:00 tonight. don't forget there is as we were watching house republicans respond to a lot of news really about the hur audio, hur transcript. whether or not it goes public. they'll keep banging the drum on this and the issues with the border. we've been reporting the eight people arrested yesterday from coast to coast and we'll continue to stay on that. speaking of the border, president biden's executive action on the border having little effect a week later. massive groups of migrants from around the world continuing to come in. it hasn't stopped. unabated you could say. matt finn is live in southern california with today's news. matt. >> good morning. you can see this group of 63 migrants that just illegally crossed. they entered the united states overnight so they built fires for heat and now they wait for border patrol to process them. all single adult males. they are coming from china, india, moritania and beyond. this week in the san diego sector we've seen illegal migrant groups crossing every day including one massive caravan in 400 at once. standing in the united states just outside of the major san diego metropolitan. a group of 400 people talking the equivalent of a high school freely cross into the united states with 0 deterrence. some of the border patrol agents we talked to the group of 400 was one of the largest they've seen here. one chinese immigrant says he is escaping the ccp and another chinese immigrant i talked to. >> in my country, don't have free. i don't do anything. i come here. it's good. it is so cool. no problem, yeah. i am so free. >> this is a live look at the process. border patrol lines up these single adult males. they will bring them closer to a highway and then process them there one-by-one. very time consuming. sometimes an entire day to process these groups. we learned some of these people will likely be released into the united states even though president biden promised that would not happen under his executive order. bill. >> bill: more to come. matt finn. thank you, southern california. back on the border yet again. >> dana: commuters taken hostage as a gunman hijacks an atlanta bus. this is all too real. >> it could have been much worse. started with a 911 call from a passenger on the bus saying they were being held hostage by a gunman. when police arrived and confronted the alleged gunman he hijacked the bus with 17 people on board leading to a terrifying chase from downtown atlanta through three georgia counties yesterday. police say the suspect held the bus driver at gun point the entire time. the hijacker warning the bus driver over and over again not to stop the bus as they sped down the i-85 highway. the bus crashed into multiple vehicles including a police car. officers attempted to stop the bus using stop sticks to deflate the tires but with no luck. police were able, though, to get vital information during the chase thanks to a passenger who called 911 and kept the line open. one man received a frantic call from his wife on board that bus. he used her phone location to track her. >> gunshots when i got on the bus. they were arguing about something. i don't want him to shoot you. hang the phone up and i'll track you. >> eventually the bus stopped about 40 minutes later in decab county on the side of the road. swat team using a bearcat vehicle to block the bus and prevent it from fleeing. the gunman came out and was taken into custody. one passenger was found shot on board that bus and died. the suspect identified as 39-year-old joseph greer. a convicted felon with get this 19 prior arrests involving guns, aggravated assault and child molestation. greer faces more than two dozen charges including murder, hijacking, kidnapping and aggravated assault. >> dana: incredible. [music playing] >> bill: here is a story to keep an eye on today and in the coming days and weeks beyond that. vladimir putin's navy has entered our own backyard. it has made its way across the atlantic for drills with cuba, a long time cold war ally. the russian fleet sailing about 30 miles off the southwest coast of florida and the u.s. navy is watching, deploying warships and airplanes to keep track of the movements and we'll see how this goes together. but that is underway as of earlier this morning today. dana. >> dana: attorney general merrick garland is strongly condemning what he calls unfounded and dangerous attacks on the justice department. this as he faces a contempt vote in the house. charlie hurt is with us and great to have you here. just to show everyone, the merrick garland headline in the "washington post" is unfounded attacks on the justice department must end. continued unfounded attacks against d.o.j.'s employees are dangerous for people's safety, dangerous for our democracy, this must stop. your thoughts on that, charlie. >> i think it is interesting that he has taken to the pages of the "washington post" to talk about this after years of far more, i would say, outrageous attacks and rhetoric about police. in fact, he even used the word in this op-ed concerns about defunding portions of the f.b.i. that he gets from republicans. democrats have been talking about defunding the police all around the country for years now. of course, you know, in terms of people's safety, actual front line safety, the police -- your local police department is far more important than the f.b.i. in terms of all that. so getting a lecture from merrick garland who is by the way, about to jail one of joe biden's political opponents next week, about rhetoric, dangerous rhetoric is a little bit too much for me. >> bill: just a quick answer. do you think they get the audio tapes of president biden's recording? do you think that happens or they will banging the drum >> i don't think this justice department is going to give them up. i don't think that they will and it goes to the heart of what is so bizarre about this. that there is absolutely no reason whatsoever for keeping the tapes, not releasing them. but it is part of this sort of contempt both for not only for the public, which is far more important, the public doesn't deserve to know and hear to see what the product of the department of justice but obviously a true contempt of congress because congress gets -- this is exactly what congress is here for is to demand things like this. this is -- if you are the justice department or the executive branch, you don't get to just say oh no, i'm not giving this to you. >> bill: let's talk about the supreme court. a woman went in and she was at the special event. she recorded alito and justice roberts. the secret supreme court tapes, a political activist tried to provoke alito and his wife. the storied truth is that harassment by the left is shrinking the public space where conservative justices and their families can operate. i read it and listened to it. i think what justice roberts said is something every american needs to hear. she said you don't think there is a role for the court in guiding toward a moral path? he said no. i think the role for the court is to decide cases. that's for the people we elect. end quote, charlie. >> if you go back to the constitution, which is kind of an important document, that's exactly the way the constitution lays out the article three branch of our government. and the fact -- but i think this is all part of going back to the merrick garland thing. it is all part of a much larger plan on the part of democrats to try to weaponize the justice department and try to undermine the credibility of the supreme court because the -- for decades they have used the supreme court, used the courts to get what they want. those courts have been changed very much over the past couple of decades especially under the trump administration. and i think that -- i have think the effort here is by democrats to try to discredit the supreme court as much as they can. and because they just want to -- they want to be able to do to the supreme court exactly what merrick garland is claiming republicans are doing to the department of justice. >> dana: charlie hurt, always good to have you with us. >> bill: we'll see you later in the week, okay? around the country you have some 500 trans bills under legislative debate and last night san francisco became a sanctuary city for trans people leaving other states. >> in terms of when, if, how someone comes out to their parents, that is our decision and no one else's damn business. >> california democrats are fast tracking a bill prohibiting teachers from exposing a children's gender identity to their parents. >> the right of parents to raise their children. >> the bill is symbolic of fights around the country over transgender rights. >> here you have policies being imposed on a lot of americans that don't want them. >> tennessee is 18 red states challenging federal rules forcing employers to honor a trans worker's use of their preferred pronoun, restroom of choice and clothing that aligns with gender identity. rules that company employees and customers must follow, otherwise trans workers can sue for harassment. >> if a customer comes in and uses a biologically accurate pronoun for somebody, then the employer is responsible. >> 22 republican led states are refusing to comply with president biden's proposed rule banning states from prohibiting trans athletes from female sports. 19 red states including oklahoma restrict or prohibit gender-affirming care for transgender minors, angering the lgbtq community. the battle is playing out in courthouses, locker rooms, hospitals, strong opinions both sides. not going away. >> bill: more to come on that. >> dana: president biden's student debt hand-out costing taxpayers $167 billion. a major selling point for the biden campaign. how is that going? not so well. a recent poll shows the expensive giveaways are not sitting well with most americans. just three out of ten say they approve of the way biden is handling student loan debt. the possibility the president's bail-out plan could backfire on election day. what's interesting on this, martha, they are trying so hard to not lose the youth vote and so this student loan thing isn't exactly working for him and his position on israel is hurting him as well. the economy has drawn a lot of people to say they don't necessarily want to vote for him again. >> one of the problems here is when you promise people you will relieve their student debt they believe you. and then things fell short, right? the supreme court overruled the first attempt. the second attempt was a smaller amount than intended so if you say to someone this is the problem with giving a lot of stuff away. people are never satisfied if you promise them that you will get relief and the government is going to send you money, then it suddenly becomes never enough and people on the other side of the fence like this person who says we give too much away, you give everything away and nobody appreciates what they have. why should i pay for someone else's loan? you have people on both sides of the fence who are dissatisfied with this program. initially in the mid-terms it polled well, this issue. then it was a promise that was coming down the pipeline. but now a couple years later when people see what happened. >> bill: you remember when it first came to our desk and we all sat here and said this isn't right. there are moral hazards all over this argument. >> dana: not fair. >> one of my favorite sound bites is elizabeth warren being confronted by a man at a campaign event and said are you going to give me my money back? i worked a few jobs to pay for my daughter's college. are you going to give me the money back? of course not, she said. of course not. >> bill: "washington post" headline. democratic effort to lure young voters includes free beer and birth control. is that going to do it? >> i mean, i think these sorts of programs go a certain distance and as dana said they are trying so hard to get the youth vote back. they have lost a lot of people on israel. i think they haven't been clear enough. there is another good piece this morning about muddying the waters that you talked about. they are not articulating clearly where they stand on thing and it leaves people with the opportunity to fill in the blanks wherever they like. >> dana: "politico" wrote the white house insists we've been clear: i was saying to hemmer in the break. if the president had been clear they wouldn't have to keep saying that. it is a chicken and egg situation. they want to repeat the president has been clear. it is because the president hasn't been clear that they have -- >> you worked as press secretary for president bush. did they have a white board somewhere that says we have been clear because every one of them says it across the board all the time. we've been perfectly clear on that. >> dana: the president has been perfectly clear but he hasn't. >> you wouldn't need to say it all the time if it were clear. i'm thinking about being at normandy last week and i go back to eisenhower writing two speeches about d-day and the second speech was essentially said if we fail, it is not because of your efforts. you have all given everything. it will be my fault if we fail. and that's not something we hear much of these days in america from our leaders. i think people would like to hear it sometimes. >> dana: how inspiring was the trip for you?
